INTRODUCTION
The purpose of this memorandum is to recommend adoption of the attached resolution
to approve the award of the Public Improvement Construction Contract for the Comiskey
Park — Phase 1 Redevelopment Project and the Project Schedule Enhancement
Payment for the Project and to provide the City Council with information related to the
Project.
BACKGROUND
The 3.74-acre Comiskey Park serves the Washington and North End Neighborhoods
and also serves as a community park. The current Comiskey Park has a playground
(circa 1994) with some older pieces, tennis court (circa 2005), softball diamond with
skinned infield, 18-stall parking lot, small skate park (circa 2005), basketball court
(2005), community center (2002) and open space used for soccer, rugby, and
community events. Existing amenities are aged and do not meet current recreation
demands.
The City of Dubuque purchased an adjacent 1.95-acre parcel for the Bee Branch
Project which expanded Comiskey Park. Comiskey Park is now 5.69 acres. The
expansion will increase recreation access, enhance quality of life and improve health
outcomes for the City's lower income neighborhoods.
The City of Dubuque was awarded a $508,000 Land and Water Conservation Fund
Outdoor Recreation Legacy Partnership Program grant to expand outdoor recreational
opportunities. The City also was awarded a $100,000 Wellmark Large Match grant for the
splash pad and basketball courts and a $25,000 America In Bloom/CN EcoConnexions
From the Ground Up grants for trees, native forbes and grass seed, shrubs and flowers.

The goal from day one of the Comiskey Park Project was to make the planning effort for
development of Comiskey Park an engaging process for the neighbors and citizens of
our community. The input received in the engagement process was to go directly into
the design and elements of renovations for Comiskey Park. It was to become a plan of
the people that were involved in the engagement processes.
Saiki Design was selected to assist with the community -engagement process.
Subcontractor Urban Assets brought on -the -ground experience of engagement and
equity work. Michael Ford of BrandNu Design added another dimension of engagement.
He is known as the Hip Hop Architect and has used music and other forms of expression
to really change up engagement and attract persons who typically are not engaged in
community outreach. The engagement and planning process was branded Re -Imagine
Comiskey Park. The input and engagement had many methods to gain the feedback
from a representative cross-section of our community with particular emphasis on
neighbors, park patrons, businesses, and organizations.
The community engagement process for Re -Imagine Comiskey Park had some very clear
priorities coming from residents and partners. They desired a splash pad, more
opportunities for basketball and a new playground. Those wishes and dreams and more
will come true with the Re -Imagine Comiskey Park Phase 1 Redevelopment Project.
DISCUSSION
Saiki Design of Madison, WI, along with IIW Engineers, Architects, Surveyors P.C. of
Dubuque, IA (IIW), was also contracted to develop the bid documents for the Phase 1
Project. Due to the grant funding from the National Park Service and the United States
Department of Housing and Urban Development Community Block Grant, environmental
and historical assessments and archeological as well as flood plain documentation had
to be developed, reviewed and approved. Many approvals and permits were needed
from the Iowa Department of Natural Resources, US Army Corps of Engineers, SHPO,
and Housing and Urban Development. All processes and approvals have been cleared
so the bidding process may now begin.
The Phase 1 Project includes a new playground, splash pad and a basketball court,
walkway additions, seating walls, park amenities like litter receptacles, bike racks, picnic
tables, etc., one small and one larger shade picnic shelters, trees, landscaping,
bioswale, native seeding, and other improvements.
The Project also includes a Project Schedule Enhancement Payment incentive. The
maximum amount of the incentive is $20,000. To qualify to receive the On -Time Finish
Incentive Payment, the Contractor must meet all functional and safety related contract
performance requirements in accordance with the Contract Documents, and specifically
shall have met the definition of Substantial Completion as defined in the City of Dubuque
Supplemental Specifications for this Project.

BID RESULTS
The City received sealed bids on August 10, 2022, for the Comiskey Park — Phase 1
Redevelopment Project. Portzen Construction Inc. of Dubuque, IA submitted the low base
bid in the amount of $1,932,750.00. The project was bid with four alternates, they are
included in the recommended contract award amount and shown in the table of the
Budget Impact section below. The four bid alternates have a total value of $117,750. A
summary of the bid proposals received is as follows:

RECOMMENDATION
I recommend that Project Schedule Enhancement Payment in the amount of $20,000.00

amount of $1,932,750.00.

AWARDING PUBLIC IMPROVEMENT CONSTRUCTION CONTRACT FOR THE RE -
IMAGINE COMISKEY PARK MASTER PLAN PHASE ONE REDEVELOPMENT
PROJECT AND APPROVAL OF THE PROJECT SCHEDULE ENHANCEMENT
PAYMENT
WHEREAS, Comiskey Park is a popular community park and was identified by the
City of Dubuque City Council as a priority for redevelopment; and
WHEREAS, the public engaged to provide theirdreams and ideas in the Re -Imagine
Comiskey process that resulted in a Re -Imagine Comiskey Park Master Plan and Phase
One Redevelopment Project (the Project); ar-,d
WHEREAS, the city and grant funding now allows the Project to move forward and
make those dreams come true; and
WHEREAS, the residents of the City of Dubuque will benefit from the renovated
park opening as soon as possible; and
WHEREAS, sealed proposals have been submitted by contractors for the Project
pursuant to Resolution No. 252-22 and Notice to Bidders published on the City of Dubuque,
Iowa website and plan room service with statewide circulation on the 20th day of July 2022;
and
WHEREAS, said sealed proposals were opened and read on the 10th day of August
2022 and it has been determined that Portzen Construction Inc. of Dubuque, IA submitted
the low bid in the amount of $1,932,750.00 and is the lowest responsive, responsible bidder
for the Project; and
WHEREAS, the proposed Project Schedule Enhancement Payment for the Project
provides for an On -Time Finish Incentive Payment of Twenty Thousand Dollars ($20,000)
which shall be applied to the Project if the Contractor completes the required work by the
Project's Substantial Completion date of May 11, 2023. To qualify to receive the On -Time
Finish Incentive Payment, the Contractor must meet all functional and safety related
contract performance requirements in accordance with the Contract Documents, and
specifically shall have met the definition of Substantial Completion as defined in Section
1050, paragraph 1.14 of the City of Dubuque Supplemental Specifications for this Project.
Accordingly, to qualify forthe On -Time Finish Incentive Payment, the Contractor must have
requested and completed the punchlist/joint inspection for the Project, after the inspection
is completed, and the Engineer/Architect must have determined that the requirements of
Substantial Completion have been satisfied in order for On Time Finish Incentive Payment
to be issued. For each calendar day the Project is not Substantially Complete after May
11, 2023, Two Thousand Dollars ($2,000) per day will be deducted from the On -Time
Finish Incentive Payment. For example, if the Project is deemed Substantially Complete
on May 15th, ($2,000 x 4 days =-$8,000) the On -Time Finish Incentive Payment would be
Twelve Thousand Dollars ($12,000).
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
That a Public Improvement Construction Contract for the Project is hereby
awarded to Portzen Construction Inc. and the City Manager is hereby directed to execute
a Public Improvement Construction Contract on behalf of the City of Dubuque for the
Project.
It is further recommended that the proposed Project Schedule Enhancement
Payment for the Project be approved.
Passed, adopted, and approved this 22"d day of August 2022.
