North of the Northwest Arterial Final Plat of Asbury Plaza No. 3 Dear Mayor and City Council Members: The City of Dubuque Zoning Advisory Commission has reviewed the above-cited request. The application, staff report and related materials are attached for your review. Discussion The applicant spoke in favor of the request, reviewing the proposed lot split that will allow Rubloff to sell Lot 2 to Wendell Corey. Staff reviewed the submitted plat, noting that neither Lot 1 or Lot 2 have frontage on a street; however, there is a 60-foot access easement provided, and a future roadway is planned as part of Asbury Plaza that will provide frontage for Lot 2. The Zoning Advisory Commission discussed the request, noting that the plat in all other respects except frontage complies with the Subdivision Regulations. In addition, the Commission reviewed that frontage will be provided in the future as Asbury Plaza develops. Recommendation By a vote of 7 to 0, the Zoning Advisory Commission recommends that the City Council approve the request. A simple majority vote is needed for the City Council to approve the request. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. That Section 42-19(b) of the Subdivision Regulations is waived to allow Lot 1 and Lot 2 to have 0 feet of frontage respectively, where 60 feet is required. Section 2. That the final plat is hereby approved, and the Mayor and City Clerk are hereby authorized and directed to endorse the approval of the City of Dubuque, Iowa upon said final plat. Kritz, Associate Planner Final Plat of Asbury Plaza No. 3 INTRODUCTION The submitted final plat of Asbury Plaza No. 3 subdivides an existing parcel of land into two lots. The Zoning Advisory Commission is reviewing this plat as neither lot has frontage on an existing public or private street. DISCUSSION The submitted final plat of Asbury Plaza No. 3 subdivides an existing parcel of land into two lots. The submitted plat was prepared to facilitate the sale of Lot 2 to Mr. Wendell Corey, while Rubloff Development Group, Inc. will retain ownership of Lot 1. The Zoning Advisory Commission is being asked to waive the frontage requirements for both Lot 1 and Lot 2. Both lots do have access by way of a 60' wide access easement shown on the attached final plat. In addition, it is anticipated that subsequent platting of the proposed Asbury Plaza Shopping Center will provide a public or private street from the Northwest Arterial (Iowa Highway 32) that will serve both Lot 1 and Lot 2. The platting of these two parcels at this time is being undertaken to facilitate the sale of Lot 2 to Mr. Wendell Corey. Lot I will be retained by Rubloff Development Group, Inc. and will be part of the Asbury Plaza Shopping Center. RECOMMENDATION Planning staff recommends that the final plat of Asbury Plaza No. 3 be approved as the subdivision does not adversely impact adjacent property nor prevent the future development of that property, subject to waiving of the lot frontage requirement for both Lot 1 and Lot 2.
