INTRODUCTION
This memorandum transmits the Final Plat of Silver Oaks Estates No. 3, a resolution,
and related materials for City Council review and approval.
BACKGROUND
The submitted Final Plat of Silver Oaks Estates No. 3 is an approximately 95.99-acre
subdivision located at the southeast corner of intersection of Hwy 61 and Hwy 151 off
Elmwood Drive. The property is bordered by residential development to the south, east
and north, and Granger Creek, US Hwy 61/151 and agricultural land to the west. The
City Council reviewed and approved a preliminary plat for the subdivision at their June
21, 2021 meeting.
DISCUSSION
As submitted the Final Plat of Silver Oaks Estates No. 3 subdivides 95.99-acre tract of
land into 128 lots. The subdivision is zoned R-2 Two -Family Residential which would
primarily allow for residential development including single-family detached dwellings,
townhomes (max two dwelling units), and two-family dwellings (duplex).
The City of Dubuque has installed water and sewer services to the airport. These public
utilities run along Elmwood Drive and will adequately service the subdivision. A new
frontage road, Elmwood Drive, was constructed as part of the Southwest Arterial project
and provides access to Silver Oaks Subdivision as well as the other adjacent Dubuque
County subdivisions.
The subdivision will have a gated emergency access lane from Elda Court through the
City's existing water booster station site on Lot 1 of Silver Oaks to US Highway 151/61.
Elmwood Drive and Cambria Drive will be stub to adjacent property for future extension
and road connectivity. The streets are 31' wide within a 50' wide right-of-way. Public
sidewalks will be installed along all street frontages.
The subject subdivision complies with the Unified Development Codes 40 points of
sustainability through a mixture of development tools.

The submitted Final Plat does provide sufficient easements to provide for the future
extensions of utilities to the individual building lots. This ensures that the City will not
need to acquire individual easements from future property owners at such time as City
utilities are extended to serve the subdivision.
RECOMMENDATION
Staff recommends approval of the resolution for the Final Plat of Silver Oaks Estates
No. 3 as it is in compliance with the City of Dubuque's Unified Development Code.

A RESOLUTION AUTHORIZING APPROVAL OF THE FINAL PLAT OF
SILVER OAKS ESTATES NO. 3 IN THE CITY OF DUBUQUE, IOWA
Whereas, there has been filed with the City Clerk a Final Plat of Silver Oaks
Estates No. 3 in the City of Dubuque, Iowa; and
Whereas, upon said final plat appear public streets to be known Fameza Drive,
Elmwood Drive, Anee Court, Ebony Drive, Jovie Court, Abaca Court, Cambria Drive,
Acacia Court, and Elda Court (all in Lot A), and Silver Oaks Drive Cul-De-Sac (Lot E),
which the owner by said final plat has dedicated to the public forever; and
Whereas, upon said final plat appear certain public utility and storm drainage
easements, which the owner by said final plat has dedicated to the public forever; and
Whereas, upon said final plat appears Lot B and Lot C (Storm Water Detention
Basins), Lot D (Public Park), and certain water main, sanitary sewer, storm sewer,
storm water impoundment, storm water detention basin embankment, and storm water
detention basin access easements, which the owner by said final plat has dedicated to
the City of Dubuque forever; and
Whereas, said final plat has been reviewed by the City Planner and his approval
has been endorsed thereon, subject to the owner's agreeing to the conditions specified
herein: and
Whereas, said final plat has been examined by the City Council and the City
Council find the final plat conforms to the applicable statutes and ordinances, except that
streets and public utilities have not yet been completely constructed or installed.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:

Section 1. That the dedication of Fameza Drive, Elmwood Drive, Anee Court,
Ebony Drive, Jovie Court, Abaca Court, Cambria Drive, Acacia Court, and Elda Court (all
in Lot A), and Silver Oaks Drive Cul-De-Sac (Lot E), and Lot B and Lot C (Storm Water
Detention Basins), Lot D (Public Park), together with certain water main, sanitary sewer,
storm sewer, storm water impoundment, storm water detention basin embankment, and
storm water detention basin access, as they appear on said final plat, to the City of
Dubuque be and the same are hereby accepted; and
Section 2. That the Final Plat of Silver Oaks Estate No. 3 is hereby approved
and the Mayor and City Clerk are hereby authorized and directed to endorse the approval
of the City of Dubuque, Iowa, upon said final plat, provided the owners of said property
herein named, execute their written acceptance of the attached conditions and further
agree:
(a) To reduce Fameza Drive, Elmwood Drive, Anee Court, Ebony Drive,
Jovie Court, Abaca Court, Cambria Drive, Acacia Court, and Elda
Court (all in Lot A), and Silver Oaks Drive Cul-De-Sac (Lot E) to
grade and to construct longitudinal sub -drain, concrete curb and
gutter with asphaltic concrete pavement or with Portland Cement
concrete pavement with integral curb, and temporary cul-de-sacs, all
in accordance with the City of Dubuque standard specifications in a
manner acceptable to the City Engineer, in conformance with
construction improvement plans approved by the City Engineer, and
inspected and approved by the City Engineer.
(b) To grade Public Park (Lot D) in accordance with the City of Dubuque
standard specifications in a manner acceptable to the City Engineer
and Leisure Services Manager, in conformance with construction
improvement plans approved by the City Engineer, and inspected
and approved by the City Engineer.
(c) To install sanitary sewer mains and sewer service laterals into each
individual lot, water mains and water service laterals into each
individual lot, storm water detention basins, storm sewers and catch
basins, boulevard street lighting, fiber optic conduit and vaults, and
erosion control devices all in accordance with the City of Dubuque
standard specifications in a manner acceptable to the City Engineer,
and in accordance with construction improvement plans approved by
the City Engineer, and inspected and approved by the City Engineer.
(d) To construct accessible sidewalk ramps at each intersection and
street crossings in accordance with City of Dubuque Standards and
Specifications, all in a manner acceptable to the City Engineer, and
in accordance with the construction improvement plans approved by
the City Engineer, and inspected and approved by the City Engineer.

(e) To construct concrete sidewalk across Lots B, C, and D in
accordance with City of Dubuque Standards and Specifications, all
in a manner acceptable to the City Engineer, and in accordance with
the construction improvement plans approved by the City Engineer,
and inspected and approved by the City Engineer.
(f) To construct the improvements outlined in (a), (b), (c), (d) and (e),
above within two years from the date of acceptance of this resolution,
at the sole expense of the owners, or future owner.
(g) To maintain the improvements outlined in (a), (b), (c), (d) and (e)
above for a period of two (2) years from the date of the acceptance
of those improvements by the City Council of the City of Dubuque,
Iowa, at the sole final expense of the owners, or future owner.
(h) That access to Silver Oaks Drive is prohibited from Lots 53 thru 55
of Silver Oaks Estates No. 3.
(i) To provide security for the performance of the foregoing conditions
specified in this Section in such form and with such sureties as may
be acceptable to the City Manager of the City of Dubuque, Iowa.
Section 3. That sidewalk installation shall be the responsibility of each lot owner
for each lot abutting the public rights -of -way, including lots with multiple frontages, as
required by City Code Chapter 10-1-2 (Sidewalk Installation and Repair).
Section 4. That the owner must construct and maintain erosion control devices
in Silver Oaks Estates No. 3 which control erosion and prevent sediment from leaving the
site. The owner shall also be responsible for maintenance of the detention facility located
on Lot B and Lot C of Silver Oaks Estates No. 3 until 80% of the lots in Silver Oaks Estates
No. 3, which drain into said detention facility, have been fully developed and adequate
erosion control measures, as approved by the City Engineer, have been installed on the
remaining 20% of said lots. Until the above 80% of lots are developed, the owner shall
provide maintenance of the entire lot and detention facilities on Lot B and Lot C. After
80% of the lots are developed, the City shall provide maintenance of the entire lot and
detention facilities on Lot B and C. Maintenance of the Lot B and Lot C shall include
keeping the property in a good and safe condition, regular turf mowing, and other
customary upkeep for the permitted use. Maintenance of the detention facility in Lot B
and Lot C of Silver Oaks Estates No. 3 shall include the removal of sediment and other
debris caused by construction activities in Silver Oaks Estate No. 3 and reshaping and
reseeding of the disturbed areas. In addition, the owner shall install and maintain a
temporary fence around the perimeter of the Lot C storm water impoundment easement
area until the above 80% of lots are developed. The intention of this temporary fencing is
to prevent filling/cutting/grading or installation of obstructions in the easement area from
residential construction activities on the adjacent homesites. Prior to acceptance of said
detention facility by the City, the Owner shall hire a professional engineer or land surveyor

to verify that 80% of the lots have been built on and are stabilized. The professional
engineer or land surveyor shall also conduct an as -built survey of the detention basin,
outlet structure, and other appurtenances to certify that the facility was constructed per
the plans approved by the City Engineer. After said 80% lots are developed; inspection,
administration, and maintenance expenses incurred by the City of Dubuque on Lot B and
Lot C, including the storm water detention facility, of Silver Oaks Estates No. 3 shall be
assessed against the property owners, except the City of Dubuque, in Silver Oaks Estates
No. 3, as indicated on the preliminary plats thereof, in equal amounts. The City Manager
shall certify such costs to the City Clerk, who in turn shall promptly certify such costs to
the Dubuque County Treasurer, and such costs shall then be collected with and in the
same manner as general property taxes in accordance with provisions of law.
Section 5. That the owner must maintain the temporary cul-de-sacs on
Elmwood Drive, except for snow removal and deicing, until such time as the development
of the adjacent property begins or owner designs and constructs permanent cul-de-sac
improvements to current City Standards and dedicates said improvements and an
appropriate right of way to the City.
Section 6. That the owner must construct a secondary access roadway with
lockable gate, in conformance with construction improvement plans approved by the City
Engineer, and inspected and approved bythe City Engineer, overthe City's existing water
booster station site on Lot 1 of Silver Oaks from Elda Court to US Highway 151/61. After
inspection and acceptance, the City of Dubuque will own and maintain said secondary
access roadway thru the water booster station site.
Section 7. That Lot F be maintained as private recreational open space in
perpetuity.
Section 8. That the planting of street trees shall be coordinated with the City's
Urban Forester. Any tree(s) planted within the street right-of-way must be approved by
the Urban Forester. The location and species of tree(s) will be approved by the Urban
Forester and planted and cared for through establishment by the developer at the
developer's expense.
Section 9. That the final acceptance of the public improvements shall only occur
upon certification of the City Engineer to the City Council that the public improvements
have been completed in accordance with the approved improvement plans and City
standards and specifications and accepted by City Council Resolution.
Section 10. That in the event Royal Oaks Development Corporation fails to
execute the acceptance and furnish the guarantees provided hereof within 180 days after
the date of this Resolution, the provisions hereof shall be null and void and the acceptance
of the dedication and approval the plat shall not be effective.

consent and in accordance with the desires of the undersigned owners and proprietors of said real estate.
We hereby dedicate Lot A (Elmwood Drive, Fameza Drive, Anee Court, Ebony Drive, Jovie Court, Abaca Court, Acacia Court,
Cambria Drive, and Elda Court) to the Public for Street and Public Utility purposes.

Physical Characteristics: The 95.99-acre tract of land is bordered to the north and east
by Silver Oaks Estates (residential subdivision partially in the city and partially in the
county), to the south by Wildernest Heights #2 (county residential subdivision) and to
the west by Granger Creek and US HWY 151/61. The property is primarily cropland
bordered to the east by timber and to the west by Granger Creek. The property is a
westward facing slope that has an approximate elevation change of 180 feet over 3,200
linear feet from the southeast corner to the northwest corner of the lot. property line to
the western property line.

Conformance with Comprehensive Plan: The subject property has been designated
by the Comprehensive Plan as single-family residential and helps meet the following
recommendations:
■ Foster the development of new and additional housing products in suitable
locations throughout the City.
■ Integrate new development into the natural environment by protecting significant
woodland, prairie, and wetland areas and avoiding steep slopes.
■ Encourage a mix of housing affordable for all segments of Dubuque's population
throughout the community.
Impact of Request on:
Utilities: City water is available to the site along the Elmwood Drive frontage and
there is a hydrant at the intersection of Elmwood Drive and Silver Oaks Drive. The
water main is adequate to serve the proposed development. City sanitary sewer
service is also available along the Elmwood Drive frontage. The sewer main is
adequate to serve the proposed development.
Traffic Patterns There are no traffic counts available for Elmwood Drive which
provides access to the development. Elmwood Drive was the former US Highway
61 and carried a large volume of traffic. A new frontage road has been constructed
as part of the Southwest Arterial project. Based on trip generation formulas, the
development will have approximately 1,337 average daily trips when fully built out.
A gated emergency access lane will extend from Elda Court to Hwy 61 and will not
be open to the public.
Public Services: Existing public services are adequate to serve the site.
Environment: Staff does not anticipate any adverse impact to the environment
provided that any future development of the property is in compliance with
established City standards for storm water management and erosion control.
Adjacent Properties: The plat will create 128 residential lots that will be access by
Elmwood Drive. Staff anticipates that the most likely impact to adjacent property
will be an increase in the number of vehicle trips generated by the proposed
additional single-family lots when fully developed.

Recommended Conditions on Plat: None.
Staff Analysis: The submitted Final Plat of Silver Oaks Estates No. 3 subdivides
95.99-acre tract of land into 128 residential lots. The property is bordered by residential
development to the south, east and north and Granger Creek, US Hwy 61 /151 &
Agricultural land to the west.
The City of Dubuque has installed water and sewer service to the airport. These public
utilities run along Elmwood Drive and can adequately service the site. A new frontage
road (Elmwood Drive) was constructed as part of the Southwest Arterial project
provides access to Silver Oaks Subdivision as well as the other adjacent county
subdivisions.
The subdivision will have a gated emergency access lane over the City's existing water
booster station site on Lot 1 of Silver Oaks from Elda Court to US Highway 61.
Elmwood Drive and Cambria Drive will be stub to the adjacent property for future
extension and road connectivity. The streets are 31' wide with in a 50' wide right-of-
way. Public sidewalks will be installed along street frontages.
The subdivision will meet the minimum 40-point requirement outlined in Article 11-10
(C) of the Unified Development Code and 80-point requirement to be eligible for TIFF:

The foregoing plat of SILVER OAKS ESTATES NO. 3 IN THE CITY OF DUBUQUE, IOWA, is made with the free
consent and in accordance with the desires of the undersigned owners and proprietors of said real estate.
We hereby dedicate Lot A (Elmwood Drive, Fameza Drive, Anee Court, Ebony Drive, Jovie Court, Abaca Court, Acacia Court,
Cambria Drive, and Elda Court) to the Public for Street and Public Utility purposes.
We hereby dedicate Lot B and Lot C to the City of Dubuque for Storm Water Detention Basin purposes.
We hereby dedicate Lot D to the City of Dubuque for Public Park purposes.
We hereby dedicate Lot E (Silver Oaks Drive Cul-De-Sac) to the Public for Street and Public Utility purposes.
All water main, sanitary sewer, and storm sewer utility easements as stated and as shown on this plat are hereby dedicated to the
City of Dubuque, and its agents and contractors, for the purpose of constructing and maintaining said utilities, along with the right,
privilege, and authority to construct, reconstruct, maintain, operate, repair, patrol, and remove said improvements. Said easement
shall also include the right to cut, trim, or remove trees, bushes, and roots as may be required. City shall restore the disturbed
surface areas due to the construction maintenance, or repair of said utilities and appurtenances to equal conditions. Lot owners
shall not erect or install any trees, landscaping, paving, or structure over or within the easement areas without obtaining the prior
written approval of the City Engineer. Lot owners shall not change the grade, elevation, and contour, or perform any construction
or any excavation that will diminish the lateral support or integrity of said utility improvements without obtaining the prior written
consent of the City Engineer.
All public utility easements and storm drainage easements as stated and as shown on this plat are hereby dedicated to the Public.
Lot owners shall not erect any structure, fence, planting or other obstructions over or within the public utility or storm drainage
easement areas without obtaining the prior written approval of the City Engineer. Lot owners shall not change the grade, elevation,
and contour or perform any construction or any excavation that would hinder the orderly flow of storm water runoff or diminish the
lateral support or integrity of said utilities and improvements without obtaining the prior written consent of the City Engineer.
The Storm Water Impoundment Easement as shown over Lot C is hereby dedicated to the City of Dubuque for storm water
impoundment purposes. Said easement shall be for the purpose of temporarily impounding storm water, along with the ability to
remove fallen trees and other possible obstructions. Lot owners shall not erect any structure, fence, planting or other obstructions
over or within the storm water impoundment easement areas without obtaining the prior written approval of the City Engineer. Lot
owners shall not change the grade, elevation, and contour or perform any construction or any excavation that would hinder the
orderly flow of storm water runoff and impoundment volume, without obtaining the prior written consent of the City Engineer.
All Storm Water Detention Basin Embankment easements as shown are hereby dedicated to the City of Dubuque for the purpose
of owning and maintaining a storm water detention basin embankment for lateral support, along with the right, privilege and
authority to survey, inspect, construct, reconstruct, alter, maintain, repair, replace, patrol and remove said Improvements. Said
easement shall also include the right to cut, trim or remove trees, bushes and roots as may be required incident to rights given
herein. Lot owners shall not erect any structure, fence, planting or other obstructions over or within the embankment easement
