The same committee reported on the petition of Henry Hune recommending that the assessment on the
South one fifth of lot 441 for the year 1882 be reduced to $1500.00

The same committee reported on the resolution of ald Crawford for filling certain lots recommending
that the following resolution be adopted which was adopted
Whereas lots nos one two three four five six seven eight nine ten and eleven in the west half of Block ten
in the subdivision of the Dubuque Harbor Company's Addition to the city of Dubuque said half block
being situated on teh East side of Miami Street between Jones and Dodge Street are subject to be and
are covered by stagnant water at all seasons of the year to the great detriment of the health and
property of the neighborhood
Be it therefore resolved by the city council of the city of Dubuque that the owner or owners of said lots
be and are hereby ordred and required to fill and raise each of said lots to a heighth even with the
present surface of that portion of Main street fronting said lots respectively said filling and raising to be
fully completed on or before the first day of July 1883
2 that if any owner or owners of any of said lots above designated shall neglect or refuse to fill up and
raise said lots or any or either of them within the time herein designated said filling shall be done at the
expense of the city and the cost thereof with all incidental expenses connected with

The committee of the whole reported on the bill of C J Brayton Auditor for making tax book fo 1882
for $300.00 recommending that an order for $150.00 be drawn in favor of Auditor Brayton

The same committee reported on the following resolution recommending that the same be tabled
adopted
Resolved that the city council will not hereafter authorize the payment of any claims by any city officer
for extra labor orservices unless such labor or services shall have been previously ordered by the
city council laid on the table
Ald Crawford moved that a recess of 15 minutes be taken

Upon reconvening Ald Doerfler presented the following specifications of the materials and workmanship
necessary in the erection and completion of a new slaughter house to be erected by the Dubuque Butchers
Association in the city of Dubuque Iowa

erected on the southeast corner of Sycamore and 18th Streets The main building is to be 26 feet by 100
feet The 100 feet to be the front on Sycamore Street It is to be a brick building with stone trimmings the
sidewalks are to be 18 feet high with stone foundation
Floor
The floor in the entire building is to be made of 12 inches thick grouting well mixed and covered with 1 1/2
inches thick perfectly dry porland cement
Gutter
In the center of Main Hall there is to be a gutter with sufficient fall from east to west and from west to east
made of Portland cement All of the slop water to be transferred to the main drain
Drain
the main drain ppe to be 10 inches wide made of the best quality soil pipe The drain pipe to be connected
with Couler creek
Stop Reserve Box
The soil drain pipe to be set one foot above the floor in the slop box to keep back the grease The reserve
box to be covered with a movable iron grate The box to be four feet square on the inside and walled all
around with a 12 inch thick brick wall well cemented all around the floor of this box is also to be of brick
and well cemented

are to be made of two inch planks grooved into the posts which are to be 6"x6" and rest on stone
foundations These posts are to support the roof
Roof
the roof is to be covered with matched and planed fencing and covered with sheet iron printed on both sides
The roof is to be constructed of 2 x 6" planks as per plan
Boxes
The slaughter boxes to be closed with doors on the side of the cattle hall Each door closes the hall when
box is opened
Ventilation
There are to be four ventilators on top of the gable of the roof four feet squre and fourteen feet high At the
lower end there is to be a trap door hung on hinges which is closed by means of a rope on rollers All
windows are single windows which balance on axles for ventilation Above each door there is to be a
window as shown on the elevation plan with four lights All doors are to be double flooring doors
Chimneys
Two smoke stacks are to be built at each gable end for heating purposes
Pulleys
the cattle will be drawn up by means of iron pulleys with iron chaines These pulleys hang on the iron
axles to which there are two iron wheels attached all to be made so as to be movable

boxes are to be planked on the floor so that the manure can be taken away and that the boxes may be
kept clean
Water supply
The whole building is to be supplied with the city water works connections to be made to the slaughter
hall and the cattle pens
Finally all the work throughout the entire building is to be done in best workmanlike manner according to
the true intent and meaning of the plans and specifications and to the entire satisfaction of the superintendent
and owners All materials are also to be the best of their several kinds

Mr Geo Gray Attorney for Mrs B McMahon reported that that lady was willing to accept the $60.00 allowed by
the city council for the opening of Grand View through her premises on motion of Ald Crawford the recorder
was instructed to draw an order in her favor for said amount upon the presentation of the proper right
of way deed
The committee on finance reported on the bill of D S Wilson of 26.40 recommending that the same be
paid

Ald Doerfler Chairman of the committee on ordinances presented the following which was read the
first time
An ordinance granting to the CM and St P Railroad Co the right to extend its track on Jackson Street
across Seventh STreet and along the sidewalk on the west side of Jackson Street
Be it ordained by the City Council of the city of Dubuque
Section 1 that permission be and the same is hereby granted to the C M and St P Railroad Company
to extend the track now operated by it on the west side of Jackson Street along said Jackson Street
across Seventh Street to the sidewalk on the west side of said jackson street and along said sidewalk
for the distance of 100 feet
Sec 2 That the track hereby authorized shall be laid to the established grade and should the grade be
changed at any time by the city the said track shall be changed to conform to such change of grade at the
expense of said railroad company
Sec 3 The said track shall be so laid as not to interfere with any culverts or drains where the same crosses
SEventh STreet and the said railroad company shall plank or otherwise cover the space between the rails
of said track where the same crosses Seventh Street as may directed by the City Council and in such
a manner as to afford an easy passage for mayors and other vehicles and shall keep said track where the
same crosses said Seventh Street properly ballasted and the space between the rails and to the ends of the
ties and the street adjacent thereto so graded that wagons and other vehicles may with ease pass

Sec 4 The track or extension hereby authorized shall be so operated so far as the running of cars are
concerned as to interfere as little as possible with the passage of wagons other vehicles and foot passengers
over and along said Seventh Street not shall any car or cars be allowed to stand on that part of the said
track where the same crosses Seventh Street and the sidewalks thereof.
Sec 5 The said company shall strictly comply with all reasonable police regulations which the city may
establish in relation to the running of cas on the extension hereby authorized
Sec 6 A failure to comply with the provisions and restrictions of this ordinance on the part of said railroad
company their successors or assigns shall operate as forteiture of the privileges hereby granted and
said track shall be removed and taken up on the order of the city council
Section 7 This ordinance shall be in force from and after its passage and the publication thereof in the
official papers of the city at the expense of said Railroad Company

Ald Glab moved that the action taken upon the application and petition of J K Graves and others at the
January session be reconsidered the same asking for the extension of Fourth Street and Fenelon Street
Ald Jones called for the yeas and nays on the reconsideration and the same was carried by a vote of 5
for and 4 against as follows

Ald Crawford then moved that the said petition be referred to the committee on streets

The chairman of the committee on streets made the following report upon the report of the Engineer on
Bridge
your committee on streets respectfully recommends that the contractor for the within named improvement
be paid on account the sum of $212.25 and that the auditor be instructed to open an account with said
contractor and charge him with the amount
Ald Crawford moved that the report be adopted Rule 11 was suspended and the contractor Mr McCoy
addressed the city council stating that he had understood he would receive his full claim by the 15th day
of January AD 1883 Ald Deckert moved to receive and file amendment was adopted by the following
vote 5 for to 3 against

Nays Ald Clancy Crawford and Kavanagh 3
The motion of Ald Deckert to $150.00 on account was then concurred in and the recorder instructed to
draw an order in favor of Mr John McCoy for said amount
Ald Kavanaugh presented a deed for right of way purposes together with a plat of the ground through
lots 1 2 3 4 6 7 8 and 9 in Kavanaugh and Barry's Subd of Mineral lot No 23 which he asked the council
to accept
Ald Crawford replied that he was in favor of compensating Mr Kavanaugh for the quanitity

of ground taken for the opening of Grand View Avenue according to the awards given other parties in the
vicinity for similar purposes provided however that Mr Kavanaugh would not insist on or require the
obligation of not being obliged to lay sidewalk for seven years to be carried out Engineer was called upon and
stated that about an acre and a fraction of Mr Kavanaughs ground had been condemned The aforesaid
deed and plat were then referred to the following committee

Ald Crawford stated that the sum of $100.00 was retained from Mr Rebman for a balance on the
improvement of Roberts Avenue and moved that an order be drawn for said amount in favor of Mr.
Rebman Ald Jones called for the placing of the motion of ald Crawford in writing Ald Crawford there
upon submitted the following resolution
resolved that Mr Wm Rebman the contractor for the improvement of Roberts Avenue be paid the balance
due him on his said contract
Ald Jones moved that action be postponed until a full council meeting was had

the road account has been inceased over that of the previous year owning to the construction of several
large storm water sewers principal the one on 8th street and on Dodge Street I would most respectfully
recommend that the construction of a system of sewage be commenced and used as the warning system
as examined and investigated at Memphis Tenn proves to be successful and is admirably adapted for
this city I would recommend its adoption

The committee on streets made the following report on the petition of J K Graves et al as follows
to the city council of the city of Dubuque
Your committee on streets to which was referred the petition of J K Graves and others asking the
council to cause Fourth Street extended so as to reach the west line of the old stone quarry on fourth
street bluff andn that Fenelon Street be also extended from its present eastern termination to said stone
quarry and thence North to the North line of said Fourth Street Extension would respectfully report that said
improvement is earnestly desired by all the citizens on the Bluffs in that part of the city and consider it a
matter of great importance to them
We therefore recommend that the prayer of the petition be granted and that the city engineer be instructed
to make a survey and plat of said proposed improvement showing the land or lots through or over
which the same is proposed to be made the names of the owners thereof and the quantity of land proposed
to be taken and when said plat and survey are completed that said plat be filed in said Engineers Office
according to ordinance Also that the engineer give the notices provided for in Section 2 of the ordinance
to providing for the opening altering or annulling streets alleys and highways in the city of Dubuque

Your committee to which was referrd the plat of the subdivision of Mineral Lot No 23 submitted by Thos
Kavanaugh for the approval of the city Council and the deed presented by mr Kavanaugh relinquishing
the right of way through the said lot as shown by the plat for a portion of th eetension of Grnad View Avenue
respectfully report that we would recommend the approval of the plat of the subdivision when the proper
dedication shall be made on the same the deed from Mr Kavanaugh for the right of way for Grand View
Avenue we regard as objectionable as it provides that he shall not be assessed for the laying of any sidewalks
along the property for the period of seven years Sidewalks will undoubtedly be needed along the street
very soon and in our opinion the cost should be assessed against the property as in other cases. Otherwise
the expense will have to be paid by the City Mr Kavanaugh has stated to the committee that he will be
willing to convey the right of way without the reservation as to sidewalks if the city will pay him for the same at
the same rate as was allowed by the jury to the other propertyholders on the street which was at the rate
of $100.00 per acre as your com

said plat in his office and has also given due personal notice in writing to all resident owners of the property
proposed to be taken for said extension that at the session of the council to be held April 5th 1883 it would
be determined by said council whether said proposed improvement should be made or not and requiring
said property holders to appear before the council on said date and show cause if any they had why the
contemplated improvement should not be made eveidence of the due service of said notice having been
filed in the office of the city recorder and whereas the time designated in said notice for the considerations
of said question and for hearing any objections to said improvement has arrived and no valid objections have
been presented to the same be it therefore resolved that it is deemed advisable by this council to extend
said street in the manner prayed for by petitioners and
resolved that the city recorder be and is hereby instructed to issue a venire to the city marshall and to
furnish him with the names of the owners of property as furnished and returned by the city engineer and
commending him to summon a jury of twelve freeholders having the qualifications prescribed by
ordinance for the purpose of assessing the damages which may be sustained by reason of the estension
of said street and that all the proceedings under this resolution be had in conformity to the provisions of
the

Ald Olinger offered the following resolution be it resolved by the city council of the city of Dubuque that
the term of office of the present police force be declared at an end
And that this council proceed to elect by ballot sixteen members to be appointed as day policemen and
night watchmen in such manner as may be determined by the city marshall with the consent and approval
of the com on police
P Olinger amended by Ald Crawford that this resolution take effect May 10th next
Amended by Ald Kavanaugh that the matter be laid on the table lost
Ald Crawford then offered that the present police officers hold their positions until May 1 1883
carried
Ald Crawford then moved that the council take a recess until 7:30 pm

which we can pay this debt without interfering with the growth and prosperity of our city or prevent any
enterprise that may desire to locate here Therefore be it resolved by the city council of the City of Dubuque
that there be a specific amount designated for each department and that each department be instructed
not to expend to exceed said amount and that the city treasurer be instructed not to pay orders for such
funds when the amounts so designated are used and that we set apart a portion of our revenue each year

ard they resided in
Ald McCarthy was opposed to placing all the power in the hands of one man
Mayor ODonnell stated that he at any time would accept any responsibility which the council might place
on him but thought tht the aldermen were more competent to to make selections from the applicants than
he as they were better acquainted and therefore could make better appointments
Ald McCarthy moved to lay the resolution on the table the ayes and nays were called

to the hon mayor and city council the undersigned desires to thank your honorable body for designating
the dubuque national demokrat the only general newspaper in the city published in the native language of
more than one third of its tax payers and of one half of the members of the city council with about six times
more city dubscribers than any other German publication as one of the official papers of the city while he
regrets his inability to accept that honor with the conditions attached thereto namely to do the work at
half rate as such acceptance would be unjust to his numerous other subscribers and advertisers and
patrons to whom regular prices are charged
He is however willing to accept in full payment for all the advertising required by the city during the year to
be handed in by the proper officers in time for publication the same amount as that allowed by you
to take the telegraph and demokrat namely $250.00 per annum and would ask your honorable body to
fix aforesaid sum as the compensation of the national democrat for the work required of it as official
paper of the city

to the Hon Mayor and city council
Gentlemen
AS there have been a great many false alarms of fire lately which costs the city a large amount and as there
seems to be keys to the alarm boxes ouside of the proper authorities I would most respectfully recommend
that the alarm boxes be so arranged that the person turning in the alarm can be found by altering the locks
now in use and by having each key registered so that the key turning in the alarm cannot be taken out
of the lock until the chief of the department arrives with his key and finds the number and person turning

four dollars and ninety five cents received and filed and order to pay
the auditor reported that eleven hundred and fift dollars and twenty five cents was necessary to pay the
city officers and employees for April ordered paid

sale of huckster stands one hundred dollars and 45 100.45

Chief Engineer Drehouse reported that the sum of eight hundred and thirty four aand 60/100 dollars was
necessary to pay the men for the month of April also recommended the erection of suitable buildings for
the protection of teh city in the five departments the recommendation was referred to teh committee on fire
Treasurer Traut reported having paid interest on city warrants to the amount of eleven hundred and eifhty
one and 68/100 dollars (1181.68) received and filed and warrant drawn

that a new weigher be appointed Mr Ryan was allowed to address the council after which Ald Olinger
moved to proceed to elect a new weigher

The committee of the whole asked for further time on the petition of G B Burch et al in relation to purchase of
the fair grounds for public park on the petition of Dubuque Street Railway company the committee asked
for further consideration of the matter
Ald Crawford offered the following resolution resolved that in the opinion of the committee it is expedient
to grant the rights asked for by the street railway provided all the conditions and safe guards necessary to guard
and protect the interests of the city can be agreed upon referred ot the commitee on ordinance with the
mayor and city attorney
Ald Crawford from the committee on ordinance offered the following ordinance
An Ordinance to amend Section 12 of Chapter 22 of the revised ordinances an orinance to amend section
12 Twelve of an ordinance entitled an ordinance in relation to license and being chapter XXII (22) of the
revised city ordinances Be it ordained by the city council of the city of Dubuque that section twelve (12) of
the above named ordinance be amended so as to read as follows
Sec.12. No person shall keep any billiard table pigeon hole table pool table or any table to be used in any
game similar there to or any bowling or tenpin alley for hire or gain directly or indirectly received without
a license therefore under a penalty of five dollars for each game played thereon for which pay or gain is
received
(a) there shall be taxed and collected for a license to keep billiard and pool tables and tables used in
games similar thereto the sum of twenty dollars each for teh first three tables and ten dollars each for each
additional table and for each pigeon hole tables five dollars
There shall be taxed and collected for a license to keep a ten pin or bowling alley the sum of five dollars
for each alley

conduct on the premises occupied by him under a penalty of five dollars for each offense
This ordinance shall be published in the official papers of the city and shall take effect from and after the
date of its publication in the dubuque daily herald
after being read a second time by its title it was adopted by a full vote of the council

Ald Crawford the following resolution
resolved that the city engineer be and is hereby instructed to make a survey of the ground in the vicinity of
the fair ground with a view of ascertaining the practicallity of turning the course of Bee Branch into
Faulhopper lake that his report shall give the comparative elevations of the bed of said Bee Branch at
the fair grounds and of Faulhoppers lake also an estimate of the expense of said work adopted
Ald Olinger offered the following
REsolved by the city council of the city of Dubuque that from and after this date the several weighers of the
scales return to the office of the city recorder the stubs of their receipt books as soonas the books are
filled up and that the city recorder be instructed not to issue any blank receipt books to any weigher until
the stubs of his last receipt book shall be returned to the office of said city recorder adopted
Ald Crawford offered the following
whereas by the terms of the ordinance etending the charter of the key city gas company it is made the
duty of the city council once in each year to fix the price of gas furnished the city for lighting public lamps
and for other public uses also the price of gas furnished to private consumers Be it therefore resolved
that the subject be referred to the committee on police and gas and that said committee be instructed to
report at the next regular meeting of the council the proper and reasonable rates of prices to be charged
for gas by the key city gas co for public and private use for the year commencing June 10th 1883 adopted
Ald Deckert oferred the following
resolved by the city council of the city of Dubuque that the alley from Sanford St to Eagle Point Ave
between Jackson and Washington Street be graded and macadamized in conformity with the ordinance

Whereas it is expedient and necessary to extend fourth street in the city of Dubuque through lot number
692 and lots 39 and 40 in prospect hill addition to the city to fenlon place and
whereas in pursuance of the resolution of the city council proper proceedings have been had and the
reprt of a jury duly chosen and sworn has ben filed estimating and assessing the damage to said property
by reason of the extension of fourth street therefore be it resolved by the city council that fourth street be
and is hereby declared to be extended through said lots in accordance with the survey report and plat
of the city engineer and that said plat and description thereof be recorded by the city recorder That the
following sums as assessed by the jury be set apart in the city treasury to be paid to the following
persons upon their demand therefore and upon presenting to the city council a deed of relinquishment
for their interest in said lots

Whatever damages may be awarded to extension of fenelon street from present terminus easterly to my
east line and also one third of any damages which may be awarded for opening said fenelon street
easterly from said east line of my premises to the point and thence northerly to a connection with
including that street I will and do hereby donate and relinquish all to the city of Dubuque and will cause
proper papers to be executed therefore at your pleasure J K Graves

Ald Hollnagle resolution to have the work done was dopted with the provision that Meiser & Co pay one hundred
dollars of the amount of costs Ald Martin offered the following
REsolved by the city council of the city of Dubuque that Iowa Street between Fifteenth and Seventeenth
streets be graded guttered curbed and macadamized in conformity with teh ordinance on that subject that the
city engineer be and is hereby directed to make the necessary plans and specifications for said
improvement The resolution was adopted by the following vote

Ald McCarthy offered the following whereas the high water at present prevents Mr C W Robison from pulling
lumber at the foot of second streete where he usually pulls Therefore be it rsolved he be granted permission
to pull lumbar on the levee on east end of first street subject to the orders of the Harbor Committee
adopted
Ald Deckert offered the following
Be it resolved by the city council of Dubuque that the sewer on Eighth street from the east side of Main
Street to the east side of Iowa Street be arched and that the city engineer be and is hereby directed to
make the necessary plans and specifications for said work and the city recorder directed to give the
proper notice for bids and proposals for the performance of the work
The city engineer accompanied the resolution with an estimate of the cost as follows
320 lineal feet of sewer 5 ft diameter at 3.00 960.00
300 perches old stone in sewer at 50.00 per perch 150.00

Ald McCarthy offered the following
whereas the sidewalk on the north side of Third from Bluff to Summit is in a bad condition and dangerous
to travelers therefore resolved by the city council that a sidewalk not less than eight feet wide be laid at
the expense of the abutting property holders within forty days from this notice in compliance with the
ordinance in relation to sidewalks and that the city engineer be instructed to give proper grade for said
sidwalks and that the street commissioner be instructed to have all obstructions removed from line of
said sidewalk to enable propertyholders to lay sidewalk in compliance with this resolution
adopted
Ald Crawford offered the following
Whereas it is rumored that the CM and S P railroad company intends removing the headquarters of the
Dubuque Division to LaCrosse in Wisconsin and apparently to that end now has its superintendant in Dubuque
but two days each week and whereas the city of Dubuque has given property worth over $30,000 and
granted large and valuable privileges to said company all of which was done under the promise that the
said railroad company would maintain its division headquarters at Dubuque therefore resolved that we most
earnestly protest against such proposed change and insist that to make the same wold be a violation of
good faith and of teh contract under which said property and privileges were granted to said company
and such course will if carried out necessarily interupt for all time the good feeling at present existing
between said company and the city of Dubuque
Resolved that a copy of this resolution be transmitted to S S Merrill General Manager of said company
at Milwaukee accompanied with a polite request for informatiaon on the subject
On motion the council then adjourned to meet thursday May 10th at 2 o'clock pm

The mayor stated the object of the meeting to be to hear further reports in relation to the laying of new
double track by street railway and also as to the purchase of fair grounds for park purposes
The rules were suspended and Mr Knight was allowed to address the council in opposition to laying a
double track on the lower part of main Street Mr Walker Mr hinds also addressed the council on the same
subject Mr Linehan President of the street railway being present was allowed also to address the
council the matter having been referred to the committee on ordinance with the city ttorney and they
not being ready to report further time was granted to them
Ald Deckert offered the following resolution be it resolved by the city council of the city of Dubuque that the
city engineer be instructed to make a survey and relocation of fifth street in Ham's addition from High
Street To make a plat of same showing the land or lots through or over which the same is proposed to
be made the names of the owners thereof and the quantity of land proposed to be taken adopted
Ald McCarthy reported on the insurance policies referred to his committee at the last regular session and
recommend the payment of the bills for same

Ald Crawford offered the following resolution
Resolved that the city council cordially approves the vigerous efforts of Marshal Zugenbuehler in endeavoring
to remove and prevent the obstruction of the streets sidewalks and alleys of our city by unauthorized
persuasion and that he is hereby instructed to continue his exertions in that direction until the ordinance
of the city on that subject shall be strictly enforced. That he be further instructed to promptly arrest for violation
of ordinances all persons who shall be guilty of obstructing the gutters of our streets with cord wood pine
wood lumber rock or other materials or rubbish

Ald McCarthy offered the following
Whereas as the tile pipe on Third and Bluff Streets is not sufficient to carry the water coursing down said
Third Street and whereas the gutter on bluff st between 3rd and 4th street on the west side is not constructed
to drain the water in front of the residences on the west side. Therefore be it resolved that the city engineer
be instructed to eamine the same and report to the council a remedy

The petition of John Raup for cancellation of saloon license on account of the loss of an arm was on motion
received and filed
On motion of Ald Crawford the matter of the erection of an engine house on the present site of the Sol
Turck house was offered to the committee on fire with the city attorney
Ald Glab made a few remarks in relation to the purchase of the fair grounds by the city for park purposes
the matter was ruled out of order
The mayor called the attention of the council to the bare appearance of the walls of the council chamber
and adjusted that it would be a good idea to decorate said walls wit the portraits of ex mayors and if
it was the pleasure of the council he would address a note to each of those gentlemen now living requesting
them to furnish

The mayor stated the object of the meeting to be to the further consideration of the purchase of the fair
grounds for park purposes
the mayor also stated that Col Swords was present and wished to address the council in relation to
supplying the city and citizens with gas at a greatly reduced price
On motion of Ald Crawford the matter of the purchase of the fair ground was referred to the committee
on public grounds and buildings with the mayor or city attorney to confer with Mr Brown and to report at the
next regular session
On account of the absence of Ald Olinger from th ecity Ald Glab was added to the committee
On motion of Ald McCarthy the use of the lower floor of the city hall was granted to the veteran corps for
drilling purposes for decoration day
The matter of obstructions in the street was the Iowa and Novelty Iron Works was on motion referred to
the committee on streets with the mayor and marshal
On motion the rules were suspended and Mr Tschirgi was allowed to address the council in regard to the
running of the motor
Ald Crawford offered the following resolution
Resolved that the motor railway company be and is hereby authorized to continue the operation of its
road and to occupy the streets heretofore used by it for said purpose until the further action of this
council on that subject the council to take action at the next regular session

engineer be and is hereby directed to make the necessary plans and specifications for said improvement
and the city recorder directed to give the proper notice for bids and proposals for the performance of
the work the macadamizing to be done at the expense of teh owners of abutting property
adopted by the full vote of the council
Ald Deckert also offered the following
Resolved by the city council of Dubuque that the alley between Jackson and Washington from Lake st to Eagle
Point Avenue be graded and macadamized in conformity with the ordinance upon that subject That the
city engineer be directed to make the necessary plans and specifications and the city recorder directed
to give the proper notice for bids and proposals for the performance of the work macadamizing to be
done at the expense of abutting property

On motion Chief Engineer Drehouse was allowed to address the council in regard to the tournament
at Waterloo. He also stated that two new nozzels were necessary for use in the department the matter
was refered to the committee on fire with power
On motion of Ald McCarthy the matter of the present fire alarm system as to its efficiency was referred
to the committee on fire for full investigation to report at the next reglar session of the council
On motion of ald McCarthy a committee of three in arrangement for decoration day such committee to
consist of Ald Hollnagle Glab and Clancy

and buildings on the purchase of the fair grounds
Ald McCarthy chairman of the Public Grounds and Buildings reported follows
Your committee to whom was referred the matter of waiting on Mr. Brown to ascertain on what terms he would
sell the fair grounds to the city of Dubuque
respectfully make the following report
that we waited on Mr Brown and he made the following proposition that he would sell all his right and title in
the fair ground to the city for $12350.00 and he will guarantee that his interest will not cost any more and
that he will assign his certificate of sheriff sale and let the city take a deed from the sheriff and then give
a quit claim deed to the city 2nd his terms are as follows
Cash $6350.00

Total $12350.00
We have instructed the city attorney to look up the title as much as the short space of time would allow

Street commissioner foster reported having collected one hundred and twenty two dollars for which he attches

Marshal Zugenbuehler reported that the sum of $925.05 was necessary to pay the police force for the
month of May also that there had been fifty arrests made during the month and he has returned treasurers
receipt for 1.50 as fees collected received and filed
City engineer Tschirgi reported the cost of grading and re-macadamizing Main Street from first to eighty street
at $905.86 and relaying crosswalks $320 and that the cross streets would need some attention also
on the petition of Wm L Bradley for the grade of Lake street I find that two grade lines are shown I deem
it best that a resolution adopted declaring the blue line as the official grade as shown on the profiles
recorded in grade book No 1
Also as to railroad avenue bridge I would recommend that the bridge be taken down and the span reduced
from fifty to twenty feet and the approaches filled with earth and stone this can be done for about what
the repairing would cost and would be a permanent structure Estimate of cost of the building $449.00
Also the estimtae of improving alley from Eagle Point Ave to Lake Street between Jackson and Washington
Streets at $1001.85 all of which was referred to the committee on streets
C C Coakley police justice reported having tried three cases for the violatio of city ordinances and
accompanies his report with the treasurers receipt for $7.00 the amount of fines collected received

To the city council of the city of Dubuque
Your committee to whom the draft of an ordinance presented by the Dubuque Street Railway Company
granting the additional rights asked for by said company of laying a double track on Main Street from Jones
to Thirteenth Street from Thirteenth Street northerly on Clay and Eighteenth Street and Couler Avenue to
Sanford Streets also of constructing lines of single track railway on Main street from thirteenth streets to
fifteenth streets hence easterly on fifteenth street to clay street also from the intersection of Main and First
street easterly on first street to Iowa street thence northerly on Iowa Street to third street thence easterly on third
to clay thence northerly on clay street to thirteenth also from the intersection of couler avenue and nineteenth
street easterly on nineteenth street to jackson street thence northerly on jackson street to lake street thence
easterly on lake street to high street thence northeasterly on high street to eagle point Beg leave to report that
we have duly considered the question and crefully examined the ordinances which the company desires
to have adopted We find that the ordinance is intended to entirely supercede the original ordinance granted
in 1867 and which expires by limitation in a little over four years It makes a new grant from the present time
of all the rights now possessed by the company under its old charter with the additional ones above specified
for the term of twenty five years the provisions of th eordinance impose no binding obligations upon the
company whatever it merely provides that the company shall forefiet th eright to lay the double track to lay the
double track or to construct either of the additional lines of railway unless done within two years there is
no compulsion on the part of the company to lay a single foot of additional track either double or single
or to make any improvements whatever It secures however the renewal of its charter for twenty five yeras
from the present time this seems to your committee what might be termed a jug handled management
the effect of the ordinance if passed would be to give the company a renewal for twenty five yeras of all
its present rights and grant of certain additional privileges which it is under no obligation to carry out No
consideration whatever ensures to the city for the extension for a quarter of a century of the company charter
your committee cannot recommend the passage of a measure by which the city would be placed at so great
a disadvantage we have prepared instead and herewith present the draft of an ordinance which merely
grants the company additional privileges applied for without revising the one heretofore granted or providing
for any extension of the charter It contains the condition that the railway company shall pay one half the expense
cutting the surface of Union Street

to the street The ordinance prepared by your committee further provides that of the railway company
shall within four years put down its double track on main Street and shall also have constructed and put in
operation all the additional lines of railway which it asked the right to lay except from JOhnson Avenue
to Eagle Point and shall have complied in good faith with all other conditions in its charter as ammended
It shall then be entitled on the expiration of its charter on October 1st 1887 to a renewal of its franchises for a
further term twenty years Believing that the interset of teh city are fully provided for and protected we recommend
the passage of the ordinances all of which is respectfully submitted

Whereas Messers Martin and Strane for the purpose of quarrying rock have excavated the sidewalk on the west
side of prairie in front of lot no 783 in A McDaniels subdivision and have neglected and refused to refill said
sidewalk although duly notified to do so
Be it resolved that the city engineer be insructed to cause said sidewalk to be refilled to the proper
grade at the expense of said martin & Strane and to deduct the amount of said expense from the
first estimate in their favor made by said engineer for work done for the city under any contract performed
for being performed by said contractors

Whereas the citizens on fifth and broad street are complaining of a goos pond with stagnant water which
will cause sickness around that neighborhood if not removed before hot weather sets in said goos pond
lies on the north side of west fifth street on lot no 10 Therefore be it resolved that the street commitee
with teh engineer be instructed to adopt a plan to remov e said nuisance at once and charge the expense
to the owner of the property

Ald Glab from the finance committee reported that it would be necessary to borrow the sum of six thousand
$6,000 dollars to pay the expeses for the month of june
Ald crawford from the committee on ordinances presented odinances for the construction operation and
maintenance of the motor street railway which after being read further action was deferred until the adjourned
session to be held on July 9th 1883
The city attorney presented an ordinance in relation to billiard license which after being read a second time
was adopted
The committee on finance reported an ordinance to provide for the funding of the floating debt which after
being read by the recorder further action was postponed until the adjourned session to be held July 9th 1883
the ordinance in relation to teh double track street railway coming up and mr linehan being present the sales
were suspended and mr Linehan allowed to address the council he stated that the company objected to
section 3 which ways that the company shall pay half the cost of cutting down main he offered for consideration
of the council the ordinance granted to a company by the city of Des Moines to lay and operate a new
street railway
A remonstrance was read from the property holders on Main street north of thirteenth street objecting to
laying of track along said street north of thirteenth street
A motion by Ald Glab to strike out section 3 of the ordinance was lost by the deciding vote of the mayor
Further consideration of the matter was postponed until the adjourned session of the council to be held
July 9th 1883 and the ordinance then to be put on its passage
The city engineer presented a profile of grade of an alley between chestnut and eleventh streets from
prairie to walnut street which was referred to the committee on streets
Also a communication in relation to the old brick building on the
corner of Emmett and St mary Street that the same was dangerous

On motion of Ald Olinger the drinking fountain on the corner of Thirteenth and Washington was ordered

resignation of Nick Lents which resulted in the election of Peter Scharf on the fifth ballot
On motion of Ald McCarthy the marshal be instructed to proceed to collect the brokers license according to
the ordinance on that subject
Also that the city engineer give the property owners along the north side of third street to lay their sidewalks
within the shortest possible time according to the resolution adopted at the June session
On motion the chief engineer was instructed to take care of the key city hook and ladder truck he thought
best
Mr W J Cantillion being present on motion he was allowed to address the council in behalf of the residents
of the bluffs asking for police protection during the summer months on motion the matter was deferred

Police officers OBrien and Hanlon being present were called on to explain why no arrests were made on
the occassion of the disturbance at Bush's Grove on July 1st The officers explained in an apparently
satisfactory manner their conduct on the occasion
Ald Crawford stated that he had ammended the ordinance in relation to the street railway which had been
referred back for that purpose the ordinance as ammended was read and offered as a substitute for the
ordinance before submitted Ald Crawford then moved the adoption of the substitute the ayes and nayes were

whereas Lot No 2 of block no 6 in the Dubuque Harbor Companys addition to the city of Dubuque is subject
to be covered with stagnant water at all seasons of the year to the great detriment of the health of that
part of the city and whereas it is impossible from the nature of the locality to drain the water from said lot
be it therefore resolved that said lot is hereby ordered and required to be filled up and raised to a height
equal to the present surface of Jones Street abutting on said lot said raising and filling to be completed
by the first day of October 1883 Resolved further that a copy of this resolution duly certified by the recorder
under the seal of the city be served by the city marshall on the owner or owners of said lot

the subject of building of Engine houses would respectfully report that they have examined into the matter
and would recommend that the city proceed at once to erect an engine house in the 5th ward at a cost
of $1500.00 and one on 4th and locust st to cost $4000.00 the above buildings are not to be finished
at present but only to consist of walls and roof to protect the apperatus and finished at the pleasure

An ordinance granting certain additional rights and privileges to the Dubuque Street Railway Company
Be it ordained by the city council of the city of Dubuque
Section 1 That in addition to the rights and privileges heretofore granted and now possessed by the dubuque Street
railway company under the provisions of an ordinance entitled an ordinance authorizing and regulating
street railways in the city of Dubuque adopted October 4th 1867 the following additional rights and privileges
are hereby granted to said Dubuque Street Railway to-wit
First to change its present line of street railway on Main Street from the intersection of Main and Jones
Streets to the intersection of Main and thirteenth Streets Also on Clay Street from the intersection of Clay
and Thirteenth Streets to the intersection of Clay and Eighteenth streets also on Eighteenth Street from the
intersection of Eighteenth Street and Couler Ave also on Couler Avenue from the intersection of Eighteenth
Street and Couler Avenue to Sanford Street from a single to a double track
Second to construct maintain and operate in connection with its lines already in operation a line of single
track railway with the necessary side trcks and turnouts commencing at the intersection of Main and First
or Main and Second Streets at the option of the company and running thence east on First or second street
to Iowa Street thence north on Iowa Street to Third Street thence east on third Street to Clay street thence north
on Clay Street to Thirteenth St Also commencing at the intersection of Main and Thirteenth St thence northerly
to Fifteenth Street thence easterly on Fifteenth St to Clay street also commencing at the intersection of
Couler Avenue and Nineteenth Street and running thence Easterly on Nineteenth street to Jackson Street
thence northerly on Jackson Street to Lake Street thence easterly on Lake Street to High Street thence
northeasterly on High Street to Eagle Point and it is hereby provided that in the event that Lake Street shall
hereafter be extended westerly to couler Avenue the line of said railway from couler avenue to Eagle Point
shall be so changed as to commence at the intersection of couler avenue and lake street and run thence
easterly on lake street to high street in lieu of the route on the portions of nineteenth and jackson streets
as above specified it is further provided that no cars shall be run on that portion of Clay street between
Twelfth and thirteenth streets during market hours without the consent of the city council

Section 2 The gauge of the tracks of said Dubuque Street Railway company shall be and is hereby fixed
at four feet eight and one half inches between the highest portion of the rails and in changing its railway
on main street from a single to a double track and in constructing the and additional lines of railway
authorized in th eproceeding section of this ordinance said company shallmake use only of a train rail the
width of which from outside to outside shall be not less than five inches and the height along the wagon
edge and from the train to the highest part of the rail shall not be more than seven-eighths of an inch a section
of the kind of rail proposed to be used shall be first submitted to the council an dapproved by the council
said company shall within two years from the passage of this ordinance replace the rails now in use on
thirteenth Clay and Eighteenth streets and couler avenue from Eighteenth Street to Sanford Street with rails
of the kind above described provided that in the construction of the line of railway herein authorized from
couler Avenue to Eagle Point said company may use rails taken from its line of railway now in operation and
replaced by said new and approved rail
The privilege herein granted to said railway company of laying a double track on Main Street is upon the
further express condition that said company shall pay to the city of Dubuque one half the expense of lowering
the surface of main Street from First to Eighth Street between curbstones in each manner and to such an
extent AS THE CITY COUNCIL SHALL DETERMINE AND APPROVE SAID EXPENSE TO BE ASCERTAINED
AND DETERMINED BY THE estimates of the city engineer whose report to the council on the subject shall
be final and conclusive
The aid one half the expense of reducing the surfact of said street so ascertained shall be demed a debt
against said street railway company payable within thirty days after the final report and estimate of the city
engineer to the city council of the expense of said work the provisions of this section shall have no force
unless the work of cutting down the surfact of main Street shall be commenced by the city of Dubuque within
one year from the date of the taking effect of this ordinance
in the construction of the additional lines of railway provides for in the first section of this ordinance and in
changing the line on main street from a single to a double track the tracks shall be placed as near the center
of the streets as practicable and shall conform as closely as possible to the surface of the street and shall
be constructed and maintained

in such manner as not to obstruct or interfere with the ordinary travel on said streets: it shall be the duty of the
street railway company in constructing said additional lines of railway and said double track to re-macadamize
the portion of the said streets between rails and between the tracks said work to be done under the supervision
and to the approval of the city engineer and said company shall keep the portion of the street between the
rails and between the tracks where a double track is laid in perfect repair and condition The officer acting as
street commissioner of the city of Dubuque shall be the judge of the necessity for repair at anny time of said
portion of any street and shall have authority to make such repairs at the expense of the railway company whenever
said company shall neglect to make the same after being notified to do so by said street commissioner
Nothing in this section shall be construed to operate to relieve the street railway company from any responsibility
for damage caused by the bad condition of its tracks or to render the city of Dubuque liable therefore in
the event of teh city of Dubuque shall hereafter change the mode of paving any street occupied by the tracks of
the Dubuque Street railway company from macadamizing to any other method of improvement it shall be the
duty of said railway compay to improve the portion of teh streets between the rails and between its tracks at
its own expense so as to conform to the change made by the City and in case it shall fail to do so the city of
Dubuque may cause the same to be done at the expense of the railway company Provided the provisions
of this section shall not apply to any change in the mode of having within ten years from the taking effect of this
ordinance
The rights and privileges hereby granted shall cease and determine as to all streets and parts of streets not
occupied with single or double tracks as herein authorized within four years from the date of the passage
hereof Provided that if said company shall be delayed by order or injunction of any court or judge thereof
in the construction of any portion of the lines of railway or double track thereof the time of such delay shall
be given to said company for the completion of the portion of th eline on any street or part of any street over
and above teh time designated in this section for the construction and putting in operation of the same This
provision for additional time is on the express condition that in case any such injunction or order shall
be issued upon the application of any party other than the city of Dubuque said company shall immeditely notify
the mayor and city attorney of such order or injunction and therefore the mayor

or city council may instruct the city attorney to resist such order or injunction and to obtain a disolution of
the same or to assist the attorney of the railway company in so doing said company shall pay all expenses
that may accrue by reason of such suit or suits
The additional rights and privileges granted by this ordinance shall be subject to all the ocnditions and provisions
contained in the ordinance referred to in the first section hereof and to which this ordinance is supplemental
and nothing herein contained shall be construd to change impair or waive any of the provisions or requirements
of said ordinance nor to revive or extend any of the rights or privileges therein granted and not now in force
except as herein expressly provided That if at the expiration of its present charter from the city of Dubuque
as amended by this ordinance on the first day of October 1887 Said Dubuque Street Railway Company shall
have constructed and put in operation within the time limited in the sixth section of this ordinance all the additional
lines of street railway provided for in the first section of this ordinance except from Johnson Avenue to
Eagle Point and shall have laid and put in operation the double track on main street in accordance with the
provisions hereof and shall in all respects have complied with and carried out in good faith all th eprovisions
conditions and obligations of this ordinance and of the original ordinance passed October 2nd 1867 then
said company shall be entitled to an extension of all the rights and privileges now in force granted by said
original ordinance and hereby amended for a further term of twenty years from the first day of October 1887
That the said Dubuque Street Railway Company shall be required within thirty days from the passage here of
to file with the mayor an unconditional acceptance in writing of the provisions of this ordinance that on the
filing of said acceptance this ordinance shall be published in the official papers of the city and shall take
effect from and after the date of its publication in the Dubuque Daily Herald In case said street railway
company fail to file said acceptance within thirty days then this ordinance shall cease to have any further
force or effect

The mayor stated the object of the session to be in relation to the proposed sewerage system mr Waring being

On motion of Ald McCarthy the mayor appointed a committee of five interested citizens to draft a proper
ordinance for the purpose of putting in the proposed sewer
Ald McCarthy moved to reconsider the resolution offered by Ald Crawford at the previous session in relation
to the filing of a certain lot in the Harbor Company's addition as a mistake had been made in the description
of said lot the motion prevailed and after amending the resolution so as to read lot 2 of Block 9 in the
Harbor Companys addition it was adopted
The council then adjourned to meet at the call of the mayor

to surrounding property and calculated to produce diseas and is unfit for use or habitation
Therefore be it resolved by the city council of the city of Dubuque that said building be and the same is
hereby declared a nuisance and the marshal is instructed to notify the owner or owners in writing to remove
said building within ten 10 days from the service of said notice and in case of the failure of owner or owners
to remove said building within the time fixed in said notice the marshal is hereby instructed to procure the
same to be removed immediately thereafter and that the expense there of shall be collected from said
owner or owners

The mayor stated the object of the meeting to be to take action on several important matters laid over
from the regular session

To the city council of the city of Dubuque your committee on ordinance to whom was referred the ordinance
entitled an ordinance authorizing the establishment and operation of the Eagle Point Ferry respectfully
report that we have carefully eamined the provisions of said ordinance and recomend its adoption

The ordinance was read for the second time and put upon its passage
And ordinance authorizing the establishment and operation of the eagle point ferry
Be it ordained by the city council of the city of Dubuque
Sec 1 that free license full authority and right be and are hereby granted to John Rugamer John Trexler
J Schroeder John Klein Frank Schroeder and Geo Fengler and their assigns to establish and for the period
of twenty five yeras from the passage of this ordinance maintain and operate a ferry to be known as the
Eagle Point Ferry from the point on the Mississippi near Eagle Point in said city where division street in said
city meets said river across said Mississippi River to the easterly shore of said river in the state of Wisconsin
under the provisions contained in this ordinance

Sec 2 that within one year from the passage of this ordinance said grantees and assigns shall procure and
keep at said ferry one or more boats of sufficient capacity to accomodate the public travel and business
at said ferry commerce and thereafter during all seasonable times continue to run said boat or boats
across said Mississippi river from the place where division Street in said city meets the shore of said river
near Eagle point to the easterly side of said river in the state of Wisconsin and on being paid therefore
herein provided for receive and transport over said river all persons desiring to cross and all freight offered
for transportation
Sec 3 That in keeping and running said Ferry Said grantees and assigns shall use all proper care and
prudence to insure the safety and convenience of the traveling public
Sec 4 That the city council of Dubuque shall have the right to make such rules and regulations for said ferry
as it may think necessary and fix from time to time the rates of ferriage from the Iowa side but shall not
fix the rates lower than those of the Dubuque and Dunlieth Ferry
Sec 5 That this ordinance shall take effect and be in full force from and after its passage and publication
in the official papers of the city

Whereas the finance committee reported that it will be difficult if not impossible in addition to the amounts which
will have to be borrowed every mmonth until next winter to defray the ordinary expenses of the city to borrow
the sum of $9500 required to build the two engine houses
and
whereas the proposed expedient of drawing warrants on the treasury in payment for said work when there
will be no funds to meet them thereby compelling the contractor to hawk them about for sale to obtain money
to carry on the work is the adoption of a dangerous practice which in times past has proved disastrous and
highly injurious to the credit of the city and therefore right not to be resorted and whereas in the opinion
of many citizens the erection of one engine house is as much as right to be undertaken this season and
will supply the present needs of the fire department
Be it therefore resolved that only one engine house be constructed for at this time and that the erection of more
be postponed until next spring

At the request of the executive committee of the early settlers association of Dubuque County I write to
earnestly request you as a body to unite in celebrating the semi-centennial of the first settlement of Iowa
We hope by your aid to make the occasion a memorable one It should be so for it was here that Iowa
was first settled and where she commenced under adverse circumstances her march to that high position
which she now occupies among her sister states It was here that the first houses were erected the first
farms made and the first white child born we have every assurance that the celevration will be a success
that it will not only be one of pleasure to our citizens and their families but to all who may attend
yours respectfully

Ald Crawford from the special committee to which was referred the remonstrance of Wm Hintrager against
the amount of his assessment for monies and credits reported
To the city council of the city of Dubuque your special committee consisting of the aldermen of the fourth ward
to which was referred the communication of William Hintrager remonstrating against the raising of his
assessment of monies and credits for the year 1882 by the board of equalization of taxes of $50,000
respectfully submit the following report
after due notice to Mr Hintrager your committee met at the city hall where Mr Hintrager appeared before
us and stated the grounds of his objection to the increase made by the board of Equalization these objections
were in substance as follows
1.that his monies were mainly interested in purchaes of real estate at tax salse and were therefore not legally
assessable as monies and credits
2 that the amount of the assessment as increased is n excess of the monies and credits possessed by
him
In regard to the first objection your committee is clearly of the opinion that money invested in purchases
at tax sales are subject to assessment as monies and credits In fact tht is the only method by which money so
invested can be taxed Until the expiration of the period of redemption from delinquent tax sales has expired
the purchase merely constitutes a lien on the property subject to be paid of at any time by the owner we have no
doubt that money invested in such purchaes should be assessed as mmonies and credits up to the time
the tax purchaser obtains a tax deed
After careful consideration and investigation of the second ground of objection to th eincrease of the
assessment and after twice postponing of final action on the matter at the request of Mr Hintrager in order
that he might be enabled to make a sworn statement of his monies and credits to the committee which he
has wholly failed to do your committee have been unable to find any good reason for reversing the action
of the board of equalization which in our opinions was adopted on substantial grounds Your committee found
that the notices of the change in assessment proposed by the board of Equalization was properly posted
in the manner required by ordinance and that Mr Hintrager failed to interpose any objection to the increase
at the proper time or for several months thereafter your committee therefore recommend that the action of
the board of equalization be confined and that the amount of Mr Hintragers Assessment of Monies and credits
for the year 1882 remain as raised and fixed by said board at fifty thousand 50,000 dollars

An ordinance authorizing the construction and operation of the eagle point street railway
Be it ordained by the city council of the city of Dubuque
Sec 1 that John Rugamer John Trexler J P Schroeder John Klien Frank Schroeder and Geo Fengler and their
assigns be and are hereby granted the right and privilege to construct maintain and operate a street
railway over and along the streets of said city hereinafter amed for the transportation of persons and property
for the period of 25 years from the passage of this ordinance
Sec 2 That said granteed and their assigns may construct maintain and operate a single track of their railway
with such side tracks switches and turnouts as they may deem necessary for the convenient operation of
said railway upon the following named streets in said cit yof Dubuque beginning at the intersection of 4th
street with the east line of Clay Street thence eastwardly on 4th street to the west line of the Chicago
Milwaukee and St Paul Railway on White Street thence on White Street northerly to 18th street thence
eastwardly on 18th street to washington street thence on Washington Street northerly to 19th street thence
on 19th street to Pine Street thence north on Pine street to lake street thence on lake street t Johnson Avenue
thence westerly to Johnson avenue to division street thence northeasterly on division street to the levee
on the mississippi river at eagle point in said city
Sec 3 that said grantees and their assigns shall within two years from the passage of this ordinance commence
the construction of said railway and have the same commpletd and in full operation within one year
thereafter and a failure to operate said railway continuously when completed shall work a forfeiture of the
rights herein granted

Street Railway Ordinance
Sec 4 that in the construction of said railway said grantees and assigns shall lay their track to the established
grade where the street is graded and as near to the center line of the street as practicable and place in such
manner and position as not to obstruct the passage of other vehicles along and across said street and shall
put and keep the space between the rails of said trck and for one foot along the outer side of each rail in the
same condition of repair as the balance of said street and in cae of failure to so put and keep said parts of
street in repair after reasonable notice therefore the city of Dubuque may make such repairs at the expense
of said grantees the amount thereof to be collected by the city the city reserves the right to require said grantees
and assigns to take up and remove the tracks of said railway whenever said city desires it done in order to
make repairs or improvements on said streets or to lay gas or water or other pipes or to construct sewers
drains or other public works said tracks to be take up and replaced in such cases at the expense of the
propietors of said railway
Sec 5 Whenever any street or a part thereof while occupied by these grantees shall be macadamized or paved
in any manner by order of the city council of the city of Dubuque the expense of so macadamizing or paving
the space between and under the rails of the road of these grantees and one foot on each side thereof
shall be paid by them on the on the completion of such work upon an estimate to be made by the city
engineer
Sec 6 In the construction of said railway upon the streets herein named the granteed shall make proper and
ample provision for the flow of water across or under their tracks and all gutters crossings sewers and drains
necessary therefore shall be constructed by said grantees in the manner directed by and under the supervision
of the city engineer
Sec 7 that in the construction of said railway the grantees shall adopt and lay down only such rail as may be
first approved by the city council of the city of Dubuque
Sec 8 that in operating said railway said grantees and assigns shall have precedence over other presons
using said streets and if any person shall unnecessarily obstruct or impede the running of cars on said
railway he shall be subject to a fine not exceeding ten dollars for each offense by any court having jurisdiction
of the case
Sec 9 that said granteed and assigns shall have the right to make such rules and regulations for the operation
of sai railway as they may deem proper or necessary and establish from time to time the rates of fare to
be charged and collected by them for the transportation of persons and property on said railway but
the city of Dubuque reserves the right to make all necessary and usual police regulations concerning the
operation and management of said railway and to regulate and reduce the rtes of fare if necessary but
not to reduce the fare to be charged such passenger on said railway

acceptance thereof filed with the city recorder and publication of the ordinance at their own expense in
some official paper of the city
The ordinance was read a second time by its title and adopted by a full vote of the council
the ordinance of the electric light and power company was read and further action postponed until the arjourned
session to be held Sept 10th 1883
a petition and an ordinance for the construction and operation of water gas company in th ecity of Dubuque
was on motion to the com of the whole
On motion the rules were suspenced and Mr J B Harvard addressed the council ion the gas question asking
that a committee be appointed to confer with the key city gast company
Ald Olinger moved that a committee of three be appointed to confer with the key city gas company
The mayor appointed Ald Crawford Deckert and McCarthy as such committee
On motion of Ald Crawford the rules were suspended and Mr McBride was allowed to address the
council in relation to a wall on eleventh street for the falling down of which he holds a judgement against
the city in the sum of twenty five dollars he stated that he would settle with the city for $300.00
On motion the matter was referred to the committee on claims with the city attorney for investigation
The consideration of the motor and funding ordinances was on motion deferred
Ald Crawford moved that the vote by which the vote by which the matter of the erection of the Fifth Ward
Engine House was postponed be reconsidered

showing the land or lots through or over which the same is proposed to be made the names of the owners
thereof and the quantity of land proposed to be taken and report said survey and plat to the council at its
next regulara meeting
