reported on the petition of Henry Hune recommending that the assessment on the South one fifth of lot 441 for the year 1882 be reduced to $1500.00 report adopted The same committee reported on the resolution of ald Crawford for filling certain lots recommending that the following resolution be adopted which was adopted Whereas lots nos one two three four five six seven eight nine ten and eleven in the west half of Block ten in the subdivision of the Dubuque Harbor Company's Addition to the city of Dubuque said half block being situated on teh East side of Miami Street between Jones and Dodge Street are subject to be and are covered by stagnant water at all seasons of the year to the great detriment of the health and property of the neighborhood Be it therefore resolved by the city council of the city of Dubuque that the owner or owners of said lots be and are hereby ordred and required to fill and raise each of said lots to a heighth even with the present surface of that portion of Main street fronting said lots respectively said filling and raising to be fully completed on or before the first day of July 1883 2 that if any owner or owners of any of said lots above designated shall neglect or refuse to fill up and raise said lots or any or either of them within the time herein designated said filling shall be done at the expense of the city and the cost thereof with all said filling assessed upon the lot or lot so filled respectively 3 That a copy of this resolution duly issued and certified by the city recorder under the seal of the city shall be served by the city Mashal upon the owner or owners of each of said lots in the manner prescribed by ordinance Adopted February 5 1883 The committee of the whole reported on the bill of C J Brayton Auditor for making tax book fo 1882 for $300.00 recommending that an order for $150.00 be drawn in favor of Auditor Brayton Report adopted The same committee reported on the following resolution recommending that the same be tabled adopted Resolved that the city council will not hereafter authorize the payment of any claims by any city officer for extra labor orservices unless such labor or services shall have been previously ordered by the city council laid on the table Ald Crawford moved that a recess of 15 minutes be taken carried Upon reconvening Ald Doerfler presented the following specifications of the materials and workmanship necessary in the erection and completion of a new slaughter house to be erected by the Dubuque Butchers Association in the city of Dubuque Iowa General Conditions This slaughter house is to be Regular Session February 5, 1883 Mayor Linehan in the chair Present Ald Altman Clancy Crawford Glab Deckert Doerfler Jones Kavanaugh and Olinger 9 Absent Ald Foley 1 erected on the southeast corner of Sycamore and 18th Streets The main building is to be 26 feet by 100 feet The 100 feet to be the front on Sycamore Street It is to be a brick building with stone trimmings the sidewalks are to be 18 feet high with stone foundation Floor The floor in the entire building is to be made of 12 inches thick grouting well mixed and covered with 1 1/2 inches thick perfectly dry porland cement Gutter In the center of Main Hall there is to be a gutter with sufficient fall from east to west and from west to east made of Portland cement All of the slop water to be transferred to the main drain Drain the main drain ppe to be 10 inches wide made of the best quality soil pipe The drain pipe to be connected with Couler creek Stop Reserve Box The soil drain pipe to be set one foot above the floor in the slop box to keep back the grease The reserve box to be covered with a movable iron grate The box to be four feet square on the inside and walled all around with a 12 inch thick brick wall well cemented all around the floor of this box is also to be of brick and well cemented Partitions All partitions Regular Session February 5, 1883 Mayor Linehan in the chair Present Ald Altman Clancy Crawford Glab Deckert Doerfler Jones Kavanaugh and Olinger 9 Absent Ald Foley 1 are to be made of two inch planks grooved into the posts which are to be 6"x6" and rest on stone foundations These posts are to support the roof Roof the roof is to be covered with matched and planed fencing and covered with sheet iron printed on both sides The roof is to be constructed of 2 x 6" planks as per plan Boxes The slaughter boxes to be closed with doors on the side of the cattle hall Each door closes the hall when box is opened Ventilation There are to be four ventilators on top of the gable of the roof four feet squre and fourteen feet high At the lower end there is to be a trap door hung on hinges which is closed by means of a rope on rollers All windows are single windows which balance on axles for ventilation Above each door there is to be a window as shown on the elevation plan with four lights All doors are to be double flooring doors Chimneys Two smoke stacks are to be built at each gable end for heating purposes Pulleys the cattle will be drawn up by means of iron pulleys with iron chaines These pulleys hang on the iron axles to which there are two iron wheels attached all to be made so as to be movable Cattle Boxes All cattle Regular Session February 5, 1883 Mayor Linehan in the chair Present Ald Altman Clancy Crawford Glab Deckert Doerfler Jones Kavanaugh and Olinger 9 Absent Ald Foley 1 boxes are to be planked on the floor so that the manure can be taken away and that the boxes may be kept clean Water supply The whole building is to be supplied with the city water works connections to be made to the slaughter hall and the cattle pens Finally all the work throughout the entire building is to be done in best workmanlike manner according to the true intent and meaning of the plans and specifications and to the entire satisfaction of the superintendent and owners All materials are also to be the best of their several kinds Dubuque Iowa January 27th 1883 Fred Heer Architect The foregoing plans and specifications were referred to the committee of the whole Mr Geo Gray Attorney for Mrs B McMahon reported that that lady was willing to accept the $60.00 allowed by the city council for the opening of Grand View through her premises on motion of Ald Crawford the recorder was instructed to draw an order in her favor for said amount upon the presentation of the proper right of way deed The committee on finance reported on the bill of D S Wilson of 26.40 recommending that the same be paid report adopted Regular Session February 5, 1883 Mayor Linehan in the chair Present Ald Altman Clancy Crawford Glab Deckert Doerfler Jones Kavanaugh and Olinger 9 Absent Ald Foley 1 Ald Doerfler Chairman of the committee on ordinances presented the following which was read the first time An ordinance granting to the CM and St P Railroad Co the right to extend its track on Jackson Street across Seventh STreet and along the sidewalk on the west side of Jackson Street Be it ordained by the City Council of the city of Dubuque Section 1 that permission be and the same is hereby granted to the C M and St P Railroad Company to extend the track now operated by it on the west side of Jackson Street along said Jackson Street across Seventh Street to the sidewalk on the west side of said jackson street and along said sidewalk for the distance of 100 feet Sec 2 That the track hereby authorized shall be laid to the established grade and should the grade be changed at any time by the city the said track shall be changed to conform to such change of grade at the expense of said railroad company Sec 3 The said track shall be so laid as not to interfere with any culverts or drains where the same crosses SEventh STreet and the said railroad company shall plank or otherwise cover the space between the rails of said track where the same crosses Seventh Street as may directed by the City Council and in such a manner as to afford an easy passage for mayors and other vehicles and shall keep said track where the same crosses said Seventh Street properly ballasted and the space between the rails and to the ends of the ties and the street adjacent thereto so graded that wagons and other vehicles may with ease pass Regular Session February 5, 1883 Mayor Linehan in the chair Present Ald Altman Clancy Crawford Glab Deckert Doerfler Jones Kavanaugh and Olinger 9 Absent Ald Foley 1 over the same Sec 4 The track or extension hereby authorized shall be so operated so far as the running of cars are concerned as to interfere as little as possible with the passage of wagons other vehicles and foot passengers over and along said Seventh Street not shall any car or cars be allowed to stand on that part of the said track where the same crosses Seventh Street and the sidewalks thereof. Sec 5 The said company shall strictly comply with all reasonable police regulations which the city may establish in relation to the running of cas on the extension hereby authorized Sec 6 A failure to comply with the provisions and restrictions of this ordinance on the part of said railroad company their successors or assigns shall operate as forteiture of the privileges hereby granted and said track shall be removed and taken up on the order of the city council Section 7 This ordinance shall be in force from and after its passage and the publication thereof in the official papers of the city at the expense of said Railroad Company Passed February 5 1883 J J Linehan Mayor Attest Martin Kane recorder On motion of ald Doerfler Rule 29 was suspended by the following unaminous vote Yeas January session be reconsidered the same asking for the extension of Fourth Street and Fenelon Street Ald Jones called for the yeas and nays on the reconsideration and the same was carried by a vote of 5 for and 4 against as follows Yeas Ald Clancy Crawford Glab Kavanaugh and Olinger Nays Ald Altman Doerfler Deckert and Jones Ald Crawford then moved that the said petition be referred to the committee on streets carried 5 to 4 as follows Yeas Ald Clancy Crawford Glab Kavanaugh and Olinger 5 Nays Ald Altman Doerfler Deckert and Jones 4 Ald Deckert moved that the action taken upon the bill of John McCoy for the construction of the bridge on 16th street over the Couler Creek be reconsidered Carried Ald Deckert then moved that Mr McCoy be allowed the sum of 150.00 and the auditor be nstructed to open an account with him adopted Dr J E Brady presented a bill of $6.50 for damages to his horse by falling through a bridge referred to the committee on claims On motion the matter of the condition of the Key City Gas Company's lamps was referred to the committee on police and gas to report upon Regular Session February 5, 1883 Mayor Linehan in the chair Present Ald Altman Clancy Crawford Glab Deckert Doerfler Jones Kavanaugh and Olinger 9 Absent Ald Foley 1 The chairman of the committee on streets made the following report upon the report of the Engineer on Bridge your committee on streets respectfully recommends that the contractor for the within named improvement be paid on account the sum of $212.25 and that the auditor be instructed to open an account with said contractor and charge him with the amount Ald Crawford moved that the report be adopted Rule 11 was suspended and the contractor Mr McCoy addressed the city council stating that he had understood he would receive his full claim by the 15th day of January AD 1883 Ald Deckert moved to receive and file amendment was adopted by the following vote 5 for to 3 against Yeas Ald Altman Deckert Glab Jones and Olinger 5 Nays Ald Clancy Crawford and Kavanagh 3 The motion of Ald Deckert to $150.00 on account was then concurred in and the recorder instructed to draw an order in favor of Mr John McCoy for said amount Ald Kavanaugh presented a deed for right of way purposes together with a plat of the ground through lots 1 2 3 4 6 7 8 and 9 in Kavanaugh and Barry's Subd of Mineral lot No 23 which he asked the council to accept Ald Crawford replied that he was in favor of compensating Mr Kavanaugh for the quanitity Regular Session February 5, 1883 Mayor Linehan in the chair Present Ald Altman Clancy Crawford Glab Deckert Doerfler Jones Kavanaugh and Olinger 9 Absent Ald Foley 1 of ground taken for the opening of Grand View Avenue according to the awards given other parties in the vicinity for similar purposes provided however that Mr Kavanaugh would not insist on or require the obligation of not being obliged to lay sidewalk for seven years to be carried out Engineer was called upon and stated that about an acre and a fraction of Mr Kavanaughs ground had been condemned The aforesaid deed and plat were then referred to the following committee Ald P W Crawford Ald H C Deckert Ald P Clancy Ald J H Shields Attorney Ald Crawford stated that the sum of $100.00 was retained from Mr Rebman for a balance on the improvement of Roberts Avenue and moved that an order be drawn for said amount in favor of Mr. Rebman Ald Jones called for the placing of the motion of ald Crawford in writing Ald Crawford there upon submitted the following resolution resolved that Mr Wm Rebman the contractor for the improvement of Roberts Avenue be paid the balance due him on his said contract Ald Jones moved that action be postponed until a full council meeting was had carried Regular Session recorder was directed to draw an order for the balance of $21.10 in favor of Mr Donohue carried Ald Clancy called attention to the bill of John Murphy for labor on streets amounting to $13.75 which inceased over that of the previous year owning to the construction of several large storm water sewers principal the one on 8th street and on Dodge Street I would most respectfully recommend that the construction of a system of sewage be commenced and used as the warning system as examined and investigated at Memphis Tenn proves to be successful and is admirably adapted for this city I would Addition served notice February 9th 1883 Referred to the city attorney to examine and report upon The market master reported that he had weighed 316 drafts on the market house scales during February at 15 cents $47.40 The receipt of the treasurer attached to board of prisoners and lodgers 115 meals at 20 cents $23.00 Report received and filed and hat Mr Rice be paid $23.00 the council then Altman chairman of the committee on claims recommending that an order be drawn in favor of petitioner to refund amount paid by him for within license less a reasonable tax for the yeaer 1882 and the recorder be insructed to draw a warrant for said amount $84.10 report adopted The committee on Claims reported on the petition and claim of John E Brady of $6.50 recommending that the same be paid following report on the petition of J K Graves et al as follows to the city council of the city of Dubuque Your committee on streets to which was referred the petition of J K Graves and others asking the council to cause Fourth Street extended so as to reach the west line of the old stone quarry on fourth street bluff andn that Fenelon Street be also extended from its present eastern termination to said stone quarry and thence North to the North line of said Fourth Street Extension would respectfully report that said improvement is earnestly desired by all the citizens on the Bluffs in that part of the city and consider it a matter of great importance to them We therefore recommend that the prayer of the petition be granted and that the city engineer be instructed to make a survey and plat of said proposed improvement showing the land or lots through or over which the same is proposed to be made the names of the owners thereof and the quantity of land proposed to be taken and when said plat and survey are completed that said plat be filed in said Engineers Office according to ordinance Also that the engineer give the notices provided for in Section 2 of the ordinance to Kavanaugh and Olinger 6 Nays Ald Altman Deckert and Jones 3 The street committee with Ald Clancy made the following report upon the plat and deed of Alderman Kavanaugh To the city council of the city of Dubuque Your committee to which was referrd the plat of the subdivision of Mineral Lot No 23 submitted by Thos Kavanaugh for the approval of the city Council and the deed presented by mr Kavanaugh relinquishing the right of way through the said lot as shown by the plat for a portion of th eetension of Grnad View Avenue respectfully report that we would recommend the approval of the plat of the subdivision when the proper dedication shall be made on the same the deed from Mr Kavanaugh for the right of way for Grand View Avenue we regard as objectionable as it provides that he shall not be assessed for the laying of any sidewalks along the property for the period of seven years Sidewalks will undoubtedly be needed along the street very soon and in our opinion the cost should be assessed against the property as in other cases. Otherwise the expense will have to be paid by the City Mr Kavanaugh has stated to the committee that he will be willing to convey the right of way without the reservation as to sidewalks if the city will pay him for the same at the same rate as was allowed by the jury to the other propertyholders on the street which was at the rate of $100.00 per acre as your com Regular Session March 5, 1883 Mayor Linehan in the chair Present Ald Altman Clancy Crawford Glab Deckert Doerfler Foley Jones Kavanaugh and Olinger 10 is informed the ground taken from mr Kavanaugh is something over an acre and the amount would be about $100 We append the written communication from the city attorney stating that Mr Kavanaugh has never made any dedication or in any manner released the right of way so far as the public is concerned he can fence up t the street at any time Your committee recommend that mr Kavanaugh be allowed for the right of way for the portion of Grand View Avenue shown on his plat at the rate of $100 per acre the quantity of ground tken to be ascertained and certified by the city engineer and that an order be drawn for the same Respectfully submitted P W Crawford Pat Clancy H C ordered on the aforesaid premises The committee on streets reported on the petition of A M Downer et al together with a profile of Iowa Street from 5th to 7th streets as follows The property owners abutting on Iowa Street from 15th to 17th streets having signed the proposed change of grade as shown on the within profile we would recommend that the said change of grade be adopted Report was correct report adopted and ordered that the several claims be paid The committee on public grounds and buildings reported on the petition of John P Page recommending to receive and file the said petition report adopted The same committee reported on the petition of Rev P Burke recommending that the prayer of the petitioner be granted but that he pay gas bills and the fees allowed the market master report adopted The comittee on police and gas reported favorably on the loction of several lamps report adopted the committee on delinquent tax made the following reports on the several petitions referred to them all of which were severally adopted that the assessment of Mrs J W Parker for the year 1882 on lot NO 2 of subdivision of lot 3 of outlot 738 be placed at $1000 That the assessment of Philip Heuses on lots 99 and 100 in McCraney's 2nd addition be reduced to $700 for 1882 That the tax of Ann Stuart on lot 33 in Wests Addn be extempted for 1882 Regular Session March 5, and S 1/2 of lot 283 Don's Farm That the petition of Patrick Smith asking for exemption of tax of 1882 be tranted That the petition of M Schlegel asking for the year 1882 be granted on exemption of tax That the tax of Mrs Kate Seidel on lot No 17 in Gates Subdivision be cancelled for 1882 The special committee to whom was referred the petition of John P Page reported on the same as follows Your committee recommend that the city lease to John P Page for the term of Twenty Five Years at the rent of $40.00 per year lot 27 of city Lot 304 to be improved and used in connection with his new hotel report adopted and attorney to draw lease The delinquent tax committee and city attorney made the following report upon the petition of the A M E Church to the hon the city council of the city of Dubuque Gentlemen Your committee to which was referred the petition of the African Methodist Episcopal Church relating to the sale in 1882 for the taxes of 1881 of lot no 7 in Central Addition and asking that said premises be declared exempt from taxation for the said year 1881 on the ground that the same was during said year owned and used for church purposes would report Regular Session March August 1880 said premises were conveyed to the African M E Church and have since been owned and used by said church for church purposes and could not be taxed for said year 1881 And therefore recommend that the purchaser at tax sale of said premises for the year aforesaid be notified by the Treasurer that upon application therefore by said purchaser the money paid at tax sale shall be Foley Delinquent Tax Committee Report adopted The committee on Delinquent Tax together with the City Attorney made the following report upon the petition f Wm Carter To the hon Mayor and council of the city of Dubuque Gentlemen Your committee to which was referred the communication of Wm Carter asking that the taxes for 1881 on the South 42 feet of Lot 754 or lot 5 of the subdivision of lot 754 and 755 be cancelled as exempt would report respectfully that on the 30th of April 1878 the south 42 feet of lot 754 was conveyed to the Regular Session March 5, 1883 Mayor Linehan in the chair Present Ald Altman Clancy Crawford Glab Deckert Doerfler Foley Jones Kavanaugh and Olinger 10 African M E church and owned by said church until the 30th of June 1881 when th esame was conveyed to petitioner and has been owned by him since that time Section 3 of the tax ordinance provides that all real estate shall be bested and assessed each year in the name of the owner thereof on the first of january The A M E Church was the owner and held the legal title of said premises on the first of January 1881 and occupied the same as a church and was therefore exempt We would therefore recommend that said tax be cancelled but that petitioner pay the taxes for 1881 on the north 14 feet of said lot Respectfully H C Deckert P Olinger P C Foley Delinquent Tax Committee J H Shields Attorney Report adopted The special committee on sewerage consisting of Ald Crawford Deckert Kavanaugh Altman and Foley to which referred the subject of a general system of sewerage for the city and also the petition of Asa Horr and other owners of property abutting on the alley between Main and ocust streets asking the city council to construct a tile sewer along said alley from First to Seventeenth Streets in accordance with the warning system submitted a preliminary report the said committee being unanimous in deeming it unwise for the city council while contemplating Regular Session March 5, 1883 Mayor reported on the petitions of mr Hintrager Mrs O Langworthy to special committee adopted Also on the petition of W K de Lorimer recommending to cancel $5000 moneys and credits for 1883 Report adopted
