Martin McCarthy and Olinger Bids for the work on Julien Avenue and Weigle Alley were opened and read and referred to the city engineer and committee on streets to report on september 10th 1883 Ald Crawford moved that gas lamps be removed from such localities where they were continuously broken by unruly boys carried On motion the counci then adjourned to meet at 7:30 pm Monday September 10th Kavanaugh The council met in adjourned session at 8 oclock pm The mayor stated the object of the session to be to take action on several important matters laid over at the regular session On motion the ordinance of the electric light and power co was taken up and read and after changing the term committee on streets to as to read city council in section 3 of said ordinance the rules were suspended and the ordinance put upon its passage after being read a second time by its title the ordinance was adopted An ordinance granting to the united states electric light and power co of iowa the right to erect poles wires racks and other fixture in the streets alleys and public parks of the city for illuminating and other purposes Be it ordained by the city council of the city of Dubuque Sec 1 that the United States Electric light and Power co of Iowa is hereby authorized and empowered to erect and maintain proper poles racks wires including district and time telegraph wires and other fixtures in the streets and alleys and public parks of the city for the term of twenty years for the purpose of establishing and maintaining a proper plant for the supply to said city and its inhabitants of Electric Illummination by means of the arc and incanddescent system of Electricity and of Power by means of Dynamos and for other purposes Sec 2 That said company shall erect and maintain its poles wires and other fixture pertaiing to such plant in said city along and through the alleys therein wherever the same can be done and no poles shall be placed in any of the streets of said city unles the same shall be deemed necessary to the proposed system in the opinion of the city council of said city Sec 3 that said company shall not uncessarily obtruct any street or alley in said city in erecting maintaing or repairing poles wires or other fixtures or allow any street or alley or other place to become obstructed or remain in a dangerous condition Adjourned Session September 10, 1883 Mayor O'Donnell in the chair Present Ald Altman Clancy Crawford Deckert Glab Hollnagle Martin McCarthy and Olinger Absent Ald Kavanaugh and shall within reasonable time repair all damage done any street alley sidewalk gutter or other public place and all excavations or other interferance with the streets or alleys and the general work of constructing said electric plant and the placing of poles therefore shall be under the direction and with the consent of the city council of said city in cae of the failure of said company to remove ny obstruction upon streets alleys and public places of the city of Dubuque which may be placed or allowed by them t remain thereon or should any street alley or public place become out of repair by reason of defective repairs made by said company the city may cause necessary and proper repairs to be made for the expense thereof said company shall be liable to the city of Dubuque Sec 4 said company shall be liable to any person suffering any injury or damage occasioned by the erection construction or maintaining said plants as herein set forth and for any damage of whatever kind occasioned by erecting maintaining or operatingthe business of sai company Should any action or proceeding be commenced or prosecuted against the city of Dubuque upon any claim whatever for damage loss or injury to any person or property arising out of the erection maintenance or operation of said plant the agents or managing officers of said company shall upon being notified of such suit or proceeding defend the samem and should any judgment be rendered against the city thereon the amount of such judgment with costs shall be received against said company in a proper proceeding and the record of the judgment against the city shall be conclusive evidence to entitle the to receive against said company Sec 5 the rights herein granted are expressly conditioned that said company shall within three yeras from the passage hereof erect and construct within the city of Dubuque the proper plant for supplying electricity and for the other purposes above contemplated and any failure to do so shall work a forfeiture of this franchise Sec 6 This ordinance shall be in force from and after its passage and publication in the official papers of the city at the expense of said company and of its filing its written acceptance of the conditions and provisions here of adopted Adjourned Session September 10, 1883 Mayor O'Donnell in the chair Present Ald Altman Clancy Crawford Deckert Glab Hollnagle Martin McCarthy and Olinger Absent Ald Kavanaugh Ald Crawford from the committee on ordinance made a report on the sewerage ordinance which after some discussion of the proposed amendment was referred back to the comm for review On motion of ald Crawford the rules were suspended and Judge Pollock addressed the council in relation to the improvement of Brad Street Ald Deckert explained the necessity of said improvement as did also the city engineer Ald Olinger from the committee on fire submitted a plat of the ground for the proposed fifth ward engine house and stated that it was necessary to trce or lease some ground belonging to Mr Pfotzer whom he stated was willing to do so Ald Crawford moved that the proper officers be authorized to draw up the necessary papers or lease with said party for the term of forty years the motion prevailed On motion the committee on fire was authorized to dispose of the old fifth ward engine house Ald Hollnagle moved that the vote by which the report on th epet of P kennedy was adopted be reconsidered and the petition deferred back to the committee carried the bids for the improvement of Julien Avenue and the Weigle Alley were opened and read as follows For the improvement of Julien Avenue James Lee Chas Stuecks On motion the contract was let to Mr Stuecks he be the lowest bidder James Lee bid for the improvement of Weigles Alley 950.07 Ald glab offered the following Resolved by the city council of the city of Dubuque that the following levy be made on all taxable property in the city of Dubuque iowa for the year 1883 for current expenses 6 1/4 miles for payment of interest 4 3/4 miles for water tax 1 mill adopted On motion of Ald Olinger a freight bill amounting $6.00 was ordered paid Adjourned Session September 10, 1883 Mayor O'Donnell in the chair have some additional clauses inserted On motion the bid of James Lee for the improvement of the Weigle alley was referred to the committee on streets the petition of Nick jungles asking privelege to erect a frame barn inside the fire limits was granted The petition of Robert Jess et al asking for the eastablishment of a market in the old market square below first street was referred to the com on markets The remonstrance of A A Cooper et al in relation to the erection of a frame building by burden bros on Iowa Street referred to com on fire A motion to take up the motor ordinance was lost Ald clancy asked for information in relation to the purchase overcoats for policemen Ald McCarthy moved that each policeman be allowed fifteen dollars each for the purchase of overcoats Pending the motion left the city without permission for 6 days the report was received and filed and the recoder instructed to deduct 6 days pay from officer hall's salary. Deputy Marshall O'Neil reported havin gserved the proper notice on Wm Hintrager to abate a certain nuisance situated on his property received and filed Wood Measurer Warring reported having weighed 1132 1/2 cords of wood which arrived by river and rail during the month of September received and filed Treasurer Traut reported that it would be necessary to borrow the sum of six thousand dollars to defray the expenses of the month of September and asked that the finance com be authorized to borrow that amount r and f Chief Engineer Drehouse reported having collected six & 50/100 dollar for old hose and junk sold for which he returns a receipt from the treasurer E Reynoldson weigher at the first ward scales reported having weighed 416 drafs for which he received 62.40 for 15% of which he returns a treasurers receipt for 9.55 received and filed Chas pitschner weigher at the west dubuque scales reported having weighed 153 drafts the gross receipts of which is 22.95 15% of which or 3.45 he returns a receipt from the treasurer received and filed F Fosselman weigher 5th ward scales reported having weighed 127 drafts the gross receipts 19.05 15% of which 2.85 he returns a receipt from the treasurer received and filed Market master rice reported having weighed 149 drafts for which he received 46.60 also for rent of huckster stands the sum of 24.25 for which he returns treasurers city employees for the month of September received and filed City Engineer Tschergi presented a communication in relation to the bad condition of a brick building situated on the S M 1/5 of lot 452 on Clay Street between 15 and 16th streets which was referred to the marshal Police Justice D Hoffmann reported having tried three cases for violation of city ordinances and that the amount of two and 75/100 dollars due him for fees received and filed Street commissioner Foster reported having expended the sum of 2140.85 on the streets for men and teams employed as follows Salnut and Rose Strets 87.00 Sanford Street 200.00 22nd street 25.00 Queen Street 50.00 English Lane and So Ave 128.10 Iowa street 282.25 Rising Ave & West Hill 106.75 18th St Engine House 133.85 West 5th Street 199.90 Carpenter Work 27.00 Express Hauling 15.75 Miscellaneous 855.22 Total 214.82 the report was received and filed and warrants drawn for the several amounts Auctioneer Hedley reported having made sales at auction to the amount of 5510.70 138.90 of which was tranasient 15% of which is due the city 6.95 the report was received and filed and the marshal instructed to collect the amount of 6.95 City Attorney Linehan reported on the petition of Jas klung and Geo Herbst that the ciyt has no authority to deduct the amount claimed from any balance due contractors as the claim is against sub contractors On the petition of John Bell et al under the facts existing in relation to this lot and the action of the city heretofore would advise no action so far as declaring the street established by user of lot in qusetion for purpose of travel On the petition of R H collier I find that the road referred to in the petition was established by the order of the board of county commssioners January 6, 1842 and has been used as such ever since the city council authorized to remove obstructions from such highway within the city On the petition of John Talty et al I find nothing showing any official grade referred to the com on streets The mayor stated that the doctor who had fallen into the 8th street sewer had agreed to settle on payment of his doctor bills referred to the city attorney and mayor to settle Ald H C Deckert from the committee on streets reported on the petition of Robert Waller that the pet be received and filed on the petition of Jas Wallace et al in favor of ordering the marshal to have the sidewalk repaired as prayed for On a communication from the city engineer that the communication be received and filed On the petition of A Minges in favor of petition of Patk Kennedy in favor of allowing the petitioner to pay on a valuation of three hundrd dollars as prayed for adopted On the petition of S M Langworthy that the city treasurer be instructed to cancel said tax on the proper books and also the sale to Wm Hintrager of said lot for the year mentioned 1858 and to make the proper entries necessary to show said lot to be clear of taxes for said year and invalidity of the sale to Hintrager adopted Ald Deckert reported on a profile of grade of Stafford Ave from Division Street to Linwood that the red line on the profile be adopted as the official grade of stafford ave adopted Ald Crawford from the special committee appointed to confer with the gas co made a report of the conference and also of their views which was referred to the committee of the whole A communication was read from the key city gas company which was also referred to the committee of the whole Ald McCarthy reported on the petition of the new military that the privilege asked for be granted provided that said company do not occupy said hall later than ten oclock pm and further that said company pay the market master for any trouble they cause him adopted On motion the vote by which the special assessment to pay for macadamizing the alley bet 16th and 17th and clay and white was reconsidered and the following resolution was offered by Ald Deckert resolved Ald Olinger Resolution Ald McCarthy offered the following whereas the obstructions on the north side of third street between Bluff and summit streets in the shape of a stone wall and steps is dangerous and interferes with travel thereon Resolved tht the marshal be and is hereby instructed to cause the same to the same to be removed within 15 days from this date at the expense of the owner of the abutting property adopted Ald Glab offered the following Resolved by the city council of the city of Dubuque that the recorder of the city of Dubuque be instructed to draw four loan warrants as follows No 1 for $1000 No 2 for $2000 no 3 for $2000 total $5000 in favor of Dubuque Fire and Marine Insurance Co No 4 for $1500 in favor of D G Scott agent payable Jan 15th 1884 at the rate interest of 6% per annum adopted Ald Deckert offered the following Be it resolved by the city council of the city of Dubuque that the city engineer be and is hereby instructed to make a survey and plat of a proposed street extending from the south end of west main street southerly to Min lot 50a thence westerly to southern avenue that said plat be filed in the city engineer's office according to section 1 chap XXV of the ordinances By Ald Deckert Be it resolved by the city counci of the city of Dubuque that the city engineer be and is hereby ordered to make plans and specifications for the improvement and ashing of 8th street sewr from East side of Iowa to East side of White st and that the city recorder advertize for bids and proposals for the performance of the work Ald McCarthy moved 1883 be the same as for 1882 with the following addition that it run from the junction of first st extenion and the outer levee along the outer levee to the south line of the Dubuque harbor Company's addition to south Locust Street to unite with the present line at Railroad Avenue Adopted Ald McCarthy offered the following Whereas the sidealk on the north side of third street from st mary's to a point on the hill at the west end of Mr P Flanegan's stone wall is so steep an incline that is dangerous for travelers to come down said walk without the aid of a railing to protect from falling referred the advisability of adopting the standard time do recognize the revolutin that has taken place in the adoption of the new standard time of great importance to the travelling public as it gives a universal time to all railroads now running within a certain district and thus avoid collissions which so often cause the loss of many lives Also that the does not interfere in any material manner with the commercial or business interests of the city It is only a qusetion of short time when all cities and railroads of importance will adopt the new standard Therefore your committee do recommend that the city of Dubuque to adopt the standard time to take effect on Sunday Nov 25th at noon and that Asa Horr MD the superintendent of our city clock be instructed to adjust our city clock to cause the removal of said track from the street at the expense of said owners and that the mayor and city attorney be requested to cooperate with the marshal in carrying this resolution into effect and in taking such measures will save the city from being compelled to pay the expense of removing the railway track from the city Ald Crawford offered the following resolution which was adopted but the grund of the eligibility of the discrimination is not stated in the opinion It is based however upon several decisions of the supreme court of the united states in which of the federal constitution was construed that section is as follows the citizens of each state shall be entitled to all privileges and immunities of citizen of several states The state of maryland passed two general laws reglating the subject of traders one relating to resident and the other to non resident traders seeking to do business within the state and both requiring the merchant to take out a license resident traders to pay upon a scale of prices proportioned to the value of the state in trade ranging from 15.00 to 100.00 while trades were required to pay tax of 300.00 of the act regulating non resident traders was with sec 1 of our ordinance It provides that no person not being a permanent resident in this state shall sell or offer for sale within the limits of the city of Baltimore without first obtaining a license therefore the action by the supreme court of the united states held to be inspiration of the above quoted article of te constitution discriminating against citizens of other states Ward vs Maryland 12 Wallace 418 See also Woodruff vs Parliam 8 Wallace 160 Gecy vs Baltimore 100 US 434 In Gould & Co vs the mayor of Atlantic, GA it was held that a power to tax intinerant traders has not by the adoption of an ordinance to tax only itinerant traders who were non residents of the city and that no tax can be imposed upon non residents traders without imposing a like tax on resident traders of the same class Judge Dillon in his work on after reviewing the cases upon the subject the legislature if it does not make discrimination in violation of the constitution may authorize municipal corporations to tax transient traders or itinerant dealers and peddlers and such tax is not in violation of the constitution of the united states although the property he brought from another state provided it must be added it does not fully discriminate in favor of the resident and against the non resident citizen Dillon municipal corp vol 2 744 It seems resident merchant or domestic goods are unconstitutional and therefore void subdivision A or section 150 of chapter XXIII of the ordinances is objectionable upon the same gound this subdivision I believe has never been enforced as it was intended to require a tax upon the sample salesmen of non resident merchants is nowhere decided however that municiipal ties may not traveling and itinerant merchants peddlers and on the countrary the power is unquestioned when duly authorized and the city of Dubuque has full power by virture of its charter to license and tax all such dealers Charter Subdiv 1857 I am clearly of the opinion that while the ordinance in question in its present form is inoperative and cannot be that it may be so amended by making it applicable toward such transient traveling and temporary enterprises contemplated by its provisions whether conducted by residents of the city or non residents of the state that it may be enforced in all cases D J Linehan City Attorney Ald Olinger stated that it was necessary to purchase a new hose cart for the use of the fire department On motion the committee on fire was instructed and authorized to purchase a two wheeled cart carried Ald Crawford presented the following an ordinance to amend an ordinance entitled an Ordinance to license tax and regulate transient merchants and being chapter 54 of the revised ordinances Be it ordained by the city council of the city of Dubuque that section one of the chapter 64 of the revised ordinances of the city of Dubuque and the services here by repealed and that the following be and is hereby enacted in lieu thereof Sec 1 that no traveling or transient merchant or other temporary dealer of goods wares or merchandise whether a resident of the Cit of Dubuque or elsewhere shall by himself or auctioneer or other agent sell or offer for sale in any temporary place of business within the limits of the ciyt of Dubuque without being authorized so to do by a license to him issued by said city for that purpose also the goods wares or merchandise so offered for sale shall have been generously assessed for taxation by said city Adjourned Session December 10, by the city council of the city of Dubuque that the generous offer of Dr Cogswell of San Francisco to donate to the city of Dubuque a beautiful granite and bronze drinking fountain with a life size statue thereon be and at once thankfully accepted by the city and that in behalf of our fellow citizens we hereby make grateful acknowledgment of the philanthropic spirit which prompts so generous a gift Resolved further that a committee of three be appointed to ask the citizens in the vicinity of Jackson and Washington parks to organize and collect a sum of money to be donated by the citizen for the purpose of paying the freight and such other expense as may be necessary resolved further that the fountain be set up in the park donating the most money for defraying the expenses and that resolution which was adopted Whereas it is deemed important and necessary that section 17 and 19 of the building ordinance relating to proper construction and inspection of chimney flues be strictly enforced although the city engineer has charge of issuing building permits and c it is more proper and can be more efficiently attended to by the chief of the fire department therefore be it resolved by the city council of Dubuque hat it be made the duty of the chief of fire department to strictly and fully carry out and enforce sections 17 and 19 of the building ordinance The following resolution was offered by Ald Deckert and adopted Where as an error has been made in teh sale for taxes of lots 3 and 4 in staffords addition the property of Cath Schueller for the taxes of 1882 as the same was to be cancelled by the council at its regular session held Aug 7th 1882 Be it therefore resolved by the city council of the city of Dubuque that said lots be redeemed from said sale by the auditor Ald Deckert offered the following which was adopted Be it resolved by the city council of the city of Dubuque that the city engineer be and is hereby instructed to make a survey and plat of a road extending from a point near the intersection of Clark street in Linehans addition and Grandview Avenue southerly to the city limits Ald Glab offered the following which was adopted Whereas considerable dissatisfaction arises every spring beween teh outgoing and incoming officers both claiming pay casing extra expense to the city Be it therefore resolved that all out going officers time to be condemned by the city council and removed by the owner The same reported on the petition of Frank Brede that he be exempt from taxes on 3700 moneys and credit the amount loaned to the city The salaries of the city officers have been once fixed by the city council for the present term and no good reason has been presented calling for an increase wherefore resolved that it is inexpedient to increase the salary of any officer for the current municipal year adopted The question arising as to whether the marshal should receive the one hundred dollars extra it was decided by the council that the resolution adopted cover all city officers. Ald Glab reported on the petition and claim of Hugh Wiley that he be allowed the fum of fifteen dollars in full for all damage A communication was read from treasurer Traut in relation to traveling merchants who come to the city after assessment for the year has been made and doing business without paying any tax on their stocks of goods calling on the council to provide for the assessment of the same referred to the committee on Ord Ald Crawford reported on the ordinance that the committee to whom was referred the water gas ordinance had given the matter a careful investigation and had also received proposals from the Key City Gas Co to enter into a new contract with that company with a reduced schedule of prices greatly reducing the price of gas which the committee had embodied in an odinance providing the council would enter into said contract the period of the contract to be the years from Jly 1st 1884 Regular Session February 4, 1884 Mayor O'Donnell in the chair Present Ald Altman Clancy Crawford Deckert Glab Hollnagel Kavanaugh Martin McCarthy and Olinger Ald Clancy moved the adoption of the report of the committee on which the ayes and nays were called Ayes Ald Altman Clancy Crawford Deckert Hollnagel Martin McCarthy and Olinger Nays Ald Glab and Kavanaugh On motion the rules were suspended and mr J J Linehan addressed the council he presented a section of the rail proposed to be laid for the new street railway track the rail is known as the Johnson rail which was on motion approved by the council Mr Linehan said that the street car company had been notified to pay a license on the street cars he stated that the ordinance granting the company right of way through the city did not specify any license the matter of license was referred to a special committee to consist of Ald Clancy altman Hollnagel and city attorney The petition of the Dubuque Northwestern Railroad Company asking right of way through the city also the remonstrnce of the property owners on Jackson Washington and Elm Street were read and on motion the rules were suspended to allow the petitioner to address the council in relation to the matter. John Wunderlich Nick Gonner Mr Brewster and other property owners along the proposed route opposed the granting of the right of way on any street west of Pine Street as the granting of said right of way would damage property to a very great extent Ald Olinger moved that in granting the right of way to the Dubuque Northwest Railroad Company the company be confined to that section lying east of Pine Street ald Altman seconded the motion Mr. Woodruff being present was asked to explain the purpose of teh company he said the company did not desire to damage any property more than was necessary to give them a cheap and feasible route through the city Ald McCarthy asked to have the matter referred to a committee of one from each ward as he did not feel prepared to vote in the matter at present Ald Olinger moved that the matter be deferred until an adjourned meeting on Tuesday afternoon February 5th when the council should meet and visit the proposed route in a body and report adopted Ald Altman offered the following resolution which was adopted Whereas the building known as the Barracks is reported in a dangerous condition and the city may be liable to damages caused by such alley extends and that they be allowed to use a right of way not to exceed 35 thirty five feet of the east part of the city hay market adopted The petition of W J Knight asking a reduction of ten thousand dollars on monies and credits after being sworn to by mr Knight was granted The committee to whom was referred the gas ordinance reported in favor of the adoption ordinance provided the prices named be for the term of one year instead of five and that the gas company pay the salary of the lamp lighter on which the ayes and nays were called Ayes ald Alman Deckert Glab Hollnagel and Kavanaugh five Nays Clancy Crawford Martin McCarthy and olinger five the vote being a ie the mayor voted aye Ald Hollnagel moved that the ordinance be adopted as amended Ald Crawford moved to lay the and Olinger Absent Glab DIFFICULT TO READ Crawford the proposition of the gas company was adopted and the city attorney instructed to prepare an ordinance present the same at the next session of the council following recommendation regarding when the contract for the fourth street engine house was requested delay upon the matter until after opportunity to bring the matter before you gentlemen to it my reason for so doing was that it has become perfectly apparent that an engine house according to teh plans proposed a finished much more contracts were first let expend any more money on the improvement an engine house than is absolutely necessary the contracting for these houses last fall were 2000 to 3000 for the upper and not to exceed 4000 for the lower did not include the expense necessary to for occupation and yet probably none of us thought of this we thought of building at the above figures now the upper house is finished and instead of expending 3000 upon it expended the sum of 5233.94 as the lowest bid was 3955 and the balance was for extra and necessary work and it will take about 100 more to finish the lower window casing and other small matters making the total cost 5333 The amount is nearly if not quite double what we first thought sufficient to secure the upper engine house if we build the lower house as at present contemplated the contract being for 5595 will it not when properly finished and furnished come very near costing us 8000 making a total of 13,333 approximating a sum far in excess of what the people would desire to have us expend for new engine houses at a time hwen we cannot afford the money and really must borrow in order to make payment How can we cut down the cost it seems to me we can change the proposed plan by reducing the properties of the building and still have sufficient rroom for working of the department as I understand it is proposed to have the house large enough to accommodate the engine hose cart and hook and ladder truck to do this would necessitate a wide double doored building now can not we have the hook and ladder truck just where it is at the ninth street house where it is more centrally located than at either of the new houses and save the expense of the increased building to accomodate it at fourth street the room at ninth street is sufficnet to house the LInehan when kept as reserve and the hook and ladder truck also by reducing the proportion of the new building we can save to the city and it seems to me it is our duty to do so There is not in the state as large and fine an engine house as the one we have already finishe and there is no need of building a larger or more expensive one I propose we do not exceed the amount expended for the upper house but try and contract below those Ald Crawford the subject was referred to the committee on fire and the mayor to so modify and change the plans and arrange with the contractor to build a suitable structure the following ordinance was read for the first time and second time and adopted by a full vote of the council An ordinance granting to the Dubuque and Northwest Railway Company the right of way on and along a certain street in the city of Dubuque Be it ordained by the city council of the city of Dubuque Secion 1 that permission be and the same is hereby granted to the Dubuque and Northwestern Railway company to successors and assigns to lay down and operate such railroad track or tracks as may be necessary in the prosecution of its business upon along and though Pine Street in said city of Dubuque provided such track or tracks do not interfere with the rail road tracks now laid in actual use of any other railroad company Section 2 That whenever required by the city council of this city said Dubuque and Northwestern Railway Company shall at its own expense grade such part of said Pine Street as shall be used for said track or tracks and that portion of any street crossed by its tracks along said pine street shall keep the space between the rails and to the end of the ties so graded that carriags and other vehicles may easily pass over the same and on each side of every street crossed by its said track along said pine street shall construct and maintain suitable culverts and drains so that the free passage of water shall not be impeded by the track or tracks hereby permitted shall at street crossings along siad Pine Street plank between the rails and make suitable approaches to enable vehicles to cross its track and shall fully comply with all reasonable police regulations which the authorities of this city may establish in relation to the running of trains on said track or tracks within the limits of this city Section 3 that the track or tracks herein authorized shall be liad to the grade established by the city and should the grade be changed at any time the said track or tracks shall be changed to conform to said change of grade such change of the track or tracks to be made at the expense of the company and the company to have no claim for damages against the city because of such change Section 4 all ordinances of this city heretofore passed in conflict with this ordinance or inconsistent with this ordinance are hereby repealed Section 5 That of said company or its successors does not construct a rail road and operate the same upon said right of way within company intends to make and valuable improvements in connection with its gas works and proposes to renew and extend its gas mains in order to accommodate consumers not now on its lines and in view of the further fact that at the reduced prices for gas hereinafter proposed said key city gas company will be unable to realize fair and just dividends upon the capital actually invested in its works until t the amount of consumption of gas is largely increased That to obtain such increase or consumption said company will require much time and also be compelled to put forth great efforts in order to make good the losses necessarily incident to said reduction of prices and the fact that a period of five years will be too short a time within which to accomplish the purose aforesaid And in view of the fact that the city of Dubuque has already determined to change or lower the surface of Main Street between first and eighty in said city a change that will compel said gas company to relay or renew its mains on that portion of Main Street and also to put in or replace new service pipes to every building necessary to make proper connections within said mains altogether making an outlay of expenditure of many thousand dollars the said key city gas company makes to the city of Dubuque the following proposition which is in accordance with the recent report made by your committee on the subject and ask its immediate consideration to the Mayor and council of the city of Dubuque The key city gas company hreby proposes to furnish to the city of Dubuque for a period of ten years from the first day of July 1884 all the gas which said city shall have occasion to use for heating or illuminating purposes good to the inhabitants of said city all the gas they may desire to use for illuminating heating or other purposes where the buildings to be supplied are situated on or contiguous to the line of streets or alleys in which the gas pipes of said company are now laid or may hereafter be laid at prices not exceeding the following rates First for all gas used by the city in the city hall Fire Engine Houses and other buildings and offices for the five years commencing July city not to be liable for any damage to the pipes or other property of said company caused by any change of grade in the cutting down of the surface of any street nor for the expense of lowering or relaying of said pipes necessary in conequence of teh change in the surface of any street in the city In consideration whereof the said city shall extend or continue in force all the rights privileges floor which was unused an accumulation of water and drainage from rear of building which in warm weather must become the source of sickness and offensive odors the combined sewerage from the entire building is allowed to accumulate in one place and flow in quite a stream toward Walnut Street becoming quite offensive to passers by in warm weather. We think that section 3 page 144 of our ordinances clearly applies to this case and should be enforced for not only is the health of the inmates of this unwholesom and unfit for habitation building endangered but the entire community may suffer if it is allowed to remain. We would therefore recommend that the proper steps be taken to have the above building condemned as being unfir for habitation the foundation walls being insecure and the sanitary condition of the the Dubuque Harbor company's addition situated on the east side of Main Street between Jones and Dodge Streets in the city of Dubuque have wholly neglected and refused to comply with the resolution of the city council adopted on the 6th day of December AD 1883 requiring said lots to be filled and raised to a height even with the present surface of Main Street in front of said lots although duly nnotified of the adoption of said resolution in the manner required by law and ordinance therefore resolved that the city recorder be and is hereby instructed to advertise for proposals for the filling and raising of said lots in the manner and to the height designated in said resolution the advertisement to require the proposals to state the price per cubic yard for earth filling and to reserve the right to the council to reject all bids if deemed excessive also to require a good and sufficient bond to accompany such proposal the resolution was amended so as to include lot 2 two of block 9 nine owned by J H shields On motion the rules were suspended and mr Shields addressed the council in relation to the matter after which the resolution as ammended was adopted by a full vote of summoned to assess the damages caused by the extension of West 8th Street as proposed and as shown by the plat on file in the office of the city engineer therefore resolved that the verdict of the time had come when the ceremonies incidental to the retirement of the old and the initiation of the new council would take place and that the retiring members of the council desired to say a few words whereupon Ald Altman delivered the following Mr President and gentlemen the time has come for me to retire from the service of the city of Dubuque I believe I go out of office as an alderman after a longer service in that position than any other person except one whoever held the office During all those years the city has passed through a good many changes but I am proud to say they have all been changes for the better We have increased in population in wealth in railroads in commerce in trade and increased greatly in the amount of capital invested in factories Dubuque is growing rapidly and her prospects for the future were never as bright as they are today I feel proud of all this beause it is certain to help us all and keep our city at the front of other ciies in the northwest We as a city council have spent some money for the prupose of giving the new railroads and other enterprises a good start and the people knew that we did well I say to you now tive help to every new company or factory which wants to come here and increase our wealth and population Now tht I am going to withdraw from the council after coming to its meetings so many years I expect to forget myself sometimes and come up the same as before I will always take an interest in your proceedings and be happy at any good thing you do for the city where I have lived so long and where I expect to end my days Ald Glab Mr Mayor and membes of the council It affords me pleasure to say a few words before closing my relation with you as trustee for the city of Dubuque which we all live so well and of which we are justly proud I know that to be selected as an alderman to act for a city like Dubuque is a compliment It could hardly be hoped that every act of a body of man like this would always be the wisest and best but if in their judgment they do everything for the best the people should be satisfied and contented I believe this council at all times acted in good faith for the best interest of the city and has accomplished some good for the whole people We have mainained the credit and standing of the city in a financial way and met promptly all maturing liabilities I can see for thsi city a great future in extended limits and increased population much will depend upon the spirit and pride of her common council I am conficent that the gentlemen who are elected to succeed us will act most cordially with the older members of the council in doing every thing for an honest and economical administration As i now take my Regular Session April 10, 1884 Mayor O'Donnell in the chair frommy attention to city matters during that time I wish you all the greatest success and hope that you so well act your several parts that the people will again honor you with their support Mr President before I leave my seat I desire to thank you in behalf of the retiring members of the council for the fairness and impartiality with which you have at all times presided over us I do not think any member of the council will say that you ruled to favor anyone but only as you thought it right as an officer of the city I now bid you goodbye Ald Kavanaugh Gentlemen of the council after spending four years in the service of the city the time has come for severing the pleasant relations as members of the common council whether any of us have discharged our duties faithfully for the best interest of the city is perhaps for the people we have served to say and not me I can only say gentlemen that I retire with the most kindly feelings toward you all and in the fullest confidence that whatever mistakes I have made are entirely those of the head and not of the heart you must not expect because you do just as you think right that you will not be blamed any man who serves the public must expect to take his share of the blame you must not mind this but go on and do right and you will be satisfied with yourself I now bid you all good bye with the hope that you may have a pleasant year and do much good for the city And while you are engaged in looking after all the different interests of the city do not fail to keep in mind the necessity for the water gas ordinance Kane Martin McCarthy Olinger and Page Mayors Address Gentlemen of the city council In obediance to a custom which has much to commend it I wish to briefly to engage your attention while we review to some extent the administration of the city government for the year just past and anticipate as far as we may be able thte couse for the new year upon which we are about to enter allow me to congratulate you most cordially upon the present evidences of thrift and prosperity in our city and especially upon the grand prospects for our future growth that Dubuque is entering upon an era of unparralleled advancemenbt in population and material resources is best attested by the fact that within six months from this period we will have the certain assurance of three more railroad connections to be added to the facilities which we already enjoy the Dubuque and northwestern will certainy be built it is equally certain that the Chicago Burlington and Quincy will afford us another outlet to Chicago and the east while the Chicago and Northwestern is only waiting an opportunity to reach an arm from Galena to connect with its great system it is not necessary to urge the importance of doing everything possible to foster and encourage these great municipal wealth makers First in importance is the railroad officered by our own people and encouraged by our own and this road is going to reach sections of country with which heretofore we have had but little communication but which will when bound to us by bands of steel pour its rich traffic into the markes of the key city There are but two great agencies which can make a city leap to wealth power and importance and they are railroads and factories secure the railroads and the factories cannot be driven away Today no city in the state compres with Dubuque as a munafacturing metropolis this interest fully capitalized would represent millions of dollars with the new railroads secured who can tell the factories growth Who can say how many thousand of our people how many of our young men and women may find employment at home instead of tramping the streets of strange cities seeking the uncertain chance to earn the equivalent of bread we must employ all our people at home if we would grow to greatness and the smoke of the factor and the locomotive are the signs which give assurance of this employment Already an appreciation of Dubuque as a manuracturing point is becoming apparent and a sewing machine company has made a proposition to erect a factory in our city as a branch of their chicago factory The capital to be employed will be 200,000 one half of which they wish our people to subscribe on a guarantee of keeping at least 150 men employed and an assured return on their investmentShould this offer prove all that is claimed for it I have no doubt our fellow citizens of means will cheerfully subscribe to the stock and thereby assure Regular Session April 10, 1884 Mayor O'Donnell in the chair Present Ald Byrne Clancy Crawford Deckert Hollnagel Kane Martin McCarthy Olinger and Page The expenditure of about $100,000 more every year in our city Economy in Administration We commenced the last year with many promises and confident hopes that we would be able by wise economy to save a number of thousand of dollars in the current expense of the city There was an honest purpose to accomplish that end upon the part of every member of the council but that we did not succeed to the extent anticipated I am forced by frnkness to admit Of course it is much easier to talk economy than to practice it still the result shows that we did save on street expenses last year the sum of $3999.00 and paid $4700.00 of the floating debt We also saved about $200 on gas and something perhaps in every department except that during the year we expended about $700 more for printing We should have saved more money than we did and I believe we can do so this year We naturally look to the committee on streets to make the largest saving in annual expense Last year the net expense in the department was $30,502.01 a saving of $4000 over the year preceeding but still a heavy expense I know well some of the difficulties under which the committee labored Last year was a severe one on many persons in the city and a large numer of deserving men were out of employment and the means of gaining a livlelihood the necessity for affording the most needy an opportunity of earning a few dollars is apparent to everybody Had it not been for the severe winer and the lack of employment I am assured the committee could have made a still better showing If the expenses on streets can be kept below $25,000 this year and they can we will have some money next year with which to discharge more of the floating debt Will we cut down it depends entirely upon ourselves People will blame us for being extravagant and charge that too much money is spent for repairs and permanent improvements while these same people will turn around and petition for improvement in their respective localities and think we do well if we grant their particular petitions It remains for us to do only such work as necessity demands and we can truthfully answer petitioners that the city cannot afford anything not of absolute necessity one thing is certain we should not feel that we are under obligations to do work anywhere simply on account of locality It matters not that we come to the council representing constituencies in teh different wards we are still the representative of the whole city and should always be guided alone by the question is the work necessary for the people at large regardless of its benefit to this or that locality I think if we bear this constantly in mine we may save some money Gas Last year we expended $10,688.57 for gas for city purposes This includes gas for street lamps Engine Houses City Offices and all purposes for which we require illumination Regular Session April 10, 1884 Mayor O'Donnell in the chair Present Ald Byrne Clancy Crawford Deckert Hollnagel Kane Martin McCarthy Olinger and Page This amount is a saving of $200 as I before stated and we will be able to save in both price and consumption for the coming year as you are aware we passed an ordinance giving the Key City Gas Company a charter for ten years from the first of July next by which gas is to be furnished the city and private consumers at reduced rates and such as we hope will prove satisfactory to the people The city still reserves to itself the right to charter other gas companies when in their judgement it is proper to do so Fire Department We ordanized the fire department last year by providing for a full paid department the ordinance to take effect on the first of January last We have had three months trial of the new system and it works admirably It will cos probably $3000 a year more than formerly but is imparably better This department cost us $12279.10 last year and will as I say cost about $15000 per year as now organized This seems a large amount for protection from fire exclusive of the water rates but we have a highly efficient department one as far as it goes quite equal to that of Chicago or Milwaukee They can save more than this difference every month Police This department was also re-employed if not reorganized last year notwithstanding some people have complained and perhaps may continue to do so Our force has done good service during the past year a less percent of crime has been committee in this city than in other of equal population in the whole United States the total expense of the force was 13,500.90 a reduction of $3000 from the year before General Expense Our general expenses for the past year were 16,769.60 This amount inclues salaries of city officers and all current expenses such as stationary supplies fuel etc $600 of this amount came over from other years which would bring the amount to nearly the $16,000 during the year we provided that all supplies in the way of stationary or other matters which could be purchased by the recorder should be procured on his order alone This was a very salutary and economical regulation for a very considerable amount has been saved in this eay to allow any officer to purchase as he might think proper was but to lead to extrvagance That we can by close economy cut down the amount of general expense I have no doubt as soon as I am able to suggest in detail the different items upon which we can retrench I will lay the same before you Regular Session April 10, 1884 Mayor amount from license than for last year The assessment of property is $835,375 more and this will yield about $9,000 more revenue Now it is estimated that we will collect $22,000 of delinquent tax That we will get about $20,000 from licenses which with the large balance of cash on hand march 1st 1884 $53,763.59 and the tax of 1884 estimated at $145,000 would give us a total fund of $240,763.59 There is no reason why If taxes were collected semi-annually we could not with such a revenue pay off may obligations including interest and the mturing portion of the bonded debt and have money sufficient to discharge a portion of the floating debt and never borrow a cent from anyone The Floating Debt The proposition submitted to the people to fund the floating debt was voted down by such a majority as leaves no doubt as to the public mind on that proposition the ground upon which it was voted down was that to remove the present debt would but furnish an excuse to the members of future councils to increase the debt by commencing another one If this would be the result then the people voted wisely One would think that when once the floating debt was bonded that it would require great temerity in a city council to commence to create another one especially as such a course would at once attract public attention and invite public condemnation whereas the increase by a few thousands a year of an existing floating debt is hardly noticed by anyone the object in submitting the proposition was I know gentlemen to avoid the very evil most feared by the people the debt may now run without provision for payment such as the funding proposition contemplated however the people have clearly expressed themselves and it is our duty to govern ourselves accordingly Let us not forget that this debt is to be met and discharged and the people expect us to devise the ways and means Municipal Legislation In the course of the past year we have considered a great many important propositions and taken action in the form of ordinance or otherwise upon most of them we have passed the gas ordinance the electric light ordinance the street railway ordinance and charter and the ordinance to provided for the filling of lots We considered and acted upon the offer to purchase the fair grounds have granted the right of way to the D & N W Railway have reached an end of the stange suit and must pay the judgement have stopped the motor and built a new engine house have considered an ordinance providing for a system of sewerage built a portion of Eighth Street sewer opened fourteenth street from Alta Vista to Delhi Road Settled the Stocking claim granted right of way to the Eagle Point Street Railroad Company and given a charter to the Eagle Point Ferry Passed an ordinance fixing the Regular Session April 10, 1884 Mayor O'Donnell in the chair Present Ald Byrne Clancy Crawford Deckert Hollnagel Kane Martin McCarthy Olinger and Page time for terms of office to commence so as to avoid paying double salaries. We enlarged the water district and did many other matters requiring deliberative action which do not come to my mind at this time Recommendations I think your attention has already been called to the necessity for amending th eordinance providing for the grading of streets and alleys so tht it shall conform to the statute of Iowa which permits the cost of grading alleys to be taxed to abutters instead of to the city as the ordinance now provides I would very strongly recommend that it be made the part of the duty of every city officer to keep up any and all records which properly belong to his office A dispute as to the obligation to thus keep up some records has in the pat and may in the future lead to the procuring of the work to be done by other parties at a very large expense to the city where any unusual work is thus required let the obligation to do it be considered in fixing the salary and have it so understood I am constrained to again renew the recommendation made last year that in the interest of economy in our expenses we do what every well regulated government does make an estimate of our total expense of our total expenses for the year set apart a fixed amount for the street police interest and sinking fund to pay the floating debt etc and determine that the expense in each fund shall not exceed a dollar of the amount thus set apart under this system we wouuld know exactly how much we were going to sav each year and could save it In conclusion let me say that all the officers of the city have done their duty faithfully and well They have been polite and accomodating to those with whom they have had business and the people express themselves well satisfied with the services rendered it is with regret that we part company with Ald Glab Kavanaugh and Altman who now retire from our body The associations of the year that is gone leave only the most pleasant recollections of our common service with those gentlemen I hope sincerely we may enjoy a year of official service profitable to the city and pleasant to ourselves That all our actions and deliberations may be for the public good free from ought that would tender to injur or offend Let us so discharge the several duties which may devolve upon us that when the time shall come to leave our places for those who then succeed we will be the recipients of the most gratifying compliment We as the meeting Ald McCarthy reported that the committee on PG&B had appointed M OLoughlin as custodian of the parks for the year the action of the committee was approved by the council The petition of Peter Kiene et al asking that the water company be instructed to extend the water mains to and along Broadway Street in Kings Addition was referred to the committee on fire The petition of C F Scheppele et al asking that 18th street between Jackson and Pine be curbed and macadamized was referred to the committee on streets The petition of T Faherty et al asking for the grading of an alley between 3rd and Fenelon Street referred to the committee on streets Ald Deckert reported a list of men employed on streets during march and omitted from the regular payroll ordered that warrants be drawn for the several amounts The petition of James Houre asking extra compensation for damages caused by the extension of West Eighth street was referred to the committee on streets The petition of E W Albee asking permission to erect a frame building within fire limits referred to the committee on fire The petition of motor railway company in relation to the plank covering on the sewer on Hill Street to the committee on streets The proposition of W W Wormood in relation to town clock was referred to the committee on PG&B On motion of Ald Kane the recorder was instructed to draw warrants in favor of the judges and clerks of the late election to the amount of five dollars each and also for the owners of the houses where the election was held adopted Regular Adjourned Session April 17, year The Iowa Gazette 250 per year The Independent 100 per year and that no extra bills be allowed for printing more than the above named and that all bills be accompanied by copies of the publication adopted On motion of Ald Kane the council proceeded to elect a street commissioner which resulted on the 12th ballot in the election of John Norton On motion of Ald Byrne the council proceded to elect a captain of police which resulted in the election on the twelfth ballot of John Raesli On motion of Ald Kane Ed Moore was appointed to take the place of John Raesli on the day force For weigher of the first ward scales N C Rya and Ed Reynoldson were nominated the first ballot resulted in the choice of Edward Reynoldson On motion the weighmasters of the other city scales were elected by acclamation For poundmaster Mr Jms L Vaughan was elected on the third ballot For inspector of Weights and Measures Mr Dennis McCabe was elected by acclamation Ald Olinger made a report in relation to the building of the new fourth street engine house stating that the committee could not come to any terms with Mr Jones for the building and they recommend that the recorder be instructed to advertise for bids Ald Deckert moved that the recorder be so instructed Amended by Ald Crawford that action be postponed until the next session and that the committee agan consult Mr Jones carried Regular the following a committee on appropriations Ald McCarthy Clancy Crawford Hollnagel and martin Ald Hollnagel moved that the saloon license be fied at one hundred dollars to be paid in two installments of fifty dollars each on the first of May and the first of August adopted Ald Crawford m,oved that when the council now adjourn it be until Monday April 21st at 7:30 p.m. Ald Deckert offered the following which was adopted Be it resolved by the city council of the city of Dubuque that the abutting property owners on the north side of Lake Street from Jackson to Washington street be granted permission to set curb stone and gutter along said property The work to be done under the direction of the city engineer and to the satisfaction of the street committee and engineer Ald Deckert Be it resolved by the city council of Dubuque that the city marshal be and is hereby insructed to remove the obstructions from seventh street in Hms addition immediately adopted Ald McCarthy Resolved that the ordinance committee be instructed to report an ordinance at the next regular meeting what amount of license should be charged for the privelege of conducting a skating rink in the city of Dubuque adopted Ald McCarthy Whereas the embankment on the southside of lots 10 and 12 and the west half 1/2 pf ;pt 6 in Prospect addition to the city of Dubuque and abutting on third street is dangerous to persons traveling upon said stret and is in its present condition a public nuisance Therefore be it resolved that the city marshal be and is hereby instructed to notify the ownres of said lots to properly secure said embankment by building such walls or structure as as well permanently abate the nuisance caused thereby and that upon their failure so to do within a resonable time to be fixed in was agreed by the city council of the city of Dubuque that upon the payment of the sum of one hundred and forty one 141.00 dollars in to the city treasury that the sum of six hundred and seventeen 617 dollars to be set apart in the treasury for the payment of damages to lots no 1 and 2 in Wilsons addition for opening 8th street and it appearing that said amount has been so paid Therefore be it resolved by the city council of Dubuque that Eighth Street be and is hereby declared open from the old corporation line to Wilson Avenue and that the sum of six hundred and seventeen 617.00 dollars be set apart in the treasurers office to be paid to the owners of lots 1 and 2 in Wilsons addition to the city upon the presentation of deeds to the lots aforesaid Adopted Ald McCarthy presented a renewal policy of $3,000 on the Town Clock and recommended the payment of the bill of $37.50 which was so ordered Ald Crawford moved that the matter of Bonds and Salaries of officers be referred to and moved the suspension of the rules in order that Dr Horr might address the council in relation to the matter which was done Ald Crawford moved that action on the matter be postponed until the next regular session carried Ald McCarthy from the special committee on the Simplot case made the following report To the mayor and City Council Your committee to whom was referred the proposition of Aleander and Chas Simplot for settlement of all cases now pending in the courts and brought by said Simplots against the city of Dubuque and CM and St P railway company and arising out of the disputed title and right of possession to a certain triangular lot on Iowa Street adjoining lot 530 in said city respectfully recommend the pyament toward Simplots of the sum of Five Hundred 500 dollars upon the condition that they dismiss at their own cost all cases brought by them in any court upon any claim of title or right in said triangle and upon executing to the city of Dubuque a quit clim deed to all of said triangular lot provided this proposition be accepted within thirty days. by fixing the salary of the recorder at 1600 per year lost Ald Kane moved to place the salary of the recorder at 1500 per year amended by Ald Crawford that he be allowed 100 extra for finishing the index book and that the salary remain as reported by the committee the amendment prevailed Ald Crawford of the special committee on the improvement of Main Street improvement made the following report To the city council of the city of Dubuque your special committee to which was referred the proposed reduction of the surface of main street between curbs from first to eighth street respectfully report that it has given the subject the careful consideration it deserves This improvement has been contemplated for several years and is now almost a neceessity The original macadam by the heavy travel over it formore than twenty years has become largely ground up and rotten and the continual repairing rendered necessary of late years in order to keep the stret in fit condition for travel has made the surface of the street so high and rounding in the center that a considerable portion of it each side next the curbing is almost useless for ordinary travel by vehicles by contract with the Dubuque Street Railway company that company has bound itself to pay one half the expense of cutting down the street if the improvement shall be commenced within one year from July 9th 1884 In order It is essential therefore that the work be commencedwithout unnecessary delay In making this improvement it has been considered by many of our citizens that it would be well to substitute some kind of paving for macadamizing and the attention of your committee has been directed to this question We find from investigations and estimates of the city engineer that a granite block pavement for the portion of the street mentioned would cost about $38,000 and a cedar block pavement about 19,000 This expense is greater than the city of the property owners under the present circumstances could afford to incur and we therefore cannot recommend either The city engineer in his report has recommended a mode of remacadamizing which if properly performed will be a great improvement over the usual method and in his opinion will be little less inferior to a stone block pavement His estimates of the expenses is 8882.72 besides the curbing which will mostly have to be renewed He estimates that this can be reduced by the value of the present macadam which can be used to the amount of 1,600 leaving 7,282.72 as the cost of the improvement This expense will have to be paid by the abutting property owners less the portion to be paid by the street railway company as they will have to pay the entire cost of macadamizing beneath and between their tracks the cost to the property holders will not be large It will be a question to be decided hereafter whether the city should not pay for the improvement at the street intersections less what the railway company will have to pay Your committee recommend that the plan proposed by the city engineer be adopted and the work performed by the contract and be commenced as soon as proposals can be received and the contrct let The work to adopted On motion of Alderman McCarthy the matter of caring for the twon clock was taken up Ald Kane moved that the contract be awarded to W W Wormood at $200.00 per year Ald Olinger moved to amend by awarding the contract to Asa Horr Ald McCarthy moved to amend the amendment that the contract be let to W W Wormood at $100.00 per year for superintending the clock and that the cost of all necessary repairs shall not exceed $100.00 The amendment was carried and the city attorney instructed to draw up a contract in accordance therewith Ald Olinger moved that the bill of the telephone company for fire alarm locks be paid and stated that Mr Keirn had a proposition to make the council in relation to a new system of fire alarms he moved that when the council now adjourn it be until Monday May committee on cogswell fountain made the following repot Your committee on receiving the fountain known as the gift of Dr Coggswell to the city of Dubuque do hereby appoint the following committee of citizens to receive and set the same up in Washington Park without expense to the city Tom Connolly Adam Koch Jms R Waller J C Farley and J Christman as such committee the Fountain must be set up in first manner and subject to the committee who were appointed to receive the fountain The report of the committee was adopted Ald McCarthy moved that the license for skating rinks be fixed at fifty $50 committee on delinquent tax A remonstrance against the proposed improvement of Main Street signed by the abutting property owners was read and after some discussion was on motion of ald McCarthy received and filed Ald Hollnagel moved that the matter in relation to the improvement of Main Street be taken up which motion was carried Ald McCarthy then moved that the work be let and that the city pay one half the expense and teh street railway company pay the other half of the expense Ald Crawford moved to amend that the improvement be indefinitely postponed the alderman stated that if the street railway company would pay one half the expense he would vote to proceed with the work Mr Linehan stated that he wold do as the ordinance required him to do which he thought was enough Ald Kane called for the reading of the ordinance which was read by the recorder Ald Crawford then amended the amendment that the abutting property owners pay for the curb which amendment was carried by the which was adopted Whereas it has been stated in the news papers of this city and of Bellevue that a person affected with small pox was permitted by certain city officers to go at large through the city and was ordered and permitted by said officers to leave the city unrestrained while in a sick and suffering condition and has since died from said sickness and exposure be it therefore resolved that a committee to consist of the mayor the physician of the board of health and the chairman of said committee be instructed to investigate said statements and report the facts to the city council had been ordered done at a previous session but as some alteration had been made in the plans he thought it would be better that the recorder be instructed to again advertise for bids Ald McCarthy moved that the recorder be instructed to advertise for proposals for doing the work one half 1/2 of the expense of grading guttering and macadamizing to be done at the expense of the city of Dubuque and one half at the expense of teh Dubuque Street Railway Company the curbing to be at the expense of the abutting property owner The motion was ruled and the recorder instructed to advertise for bids according to the resolution adopted April 21st Ald Crawford stated that the new four wheeled Hose Carriage would arrive in a few days and would like to have the matter settled as to which house it should be placed in Ald McCarthy moved that the new carriage be placed in the fourth street engine house and that the committee on fire be so instructed which motion was adopted by the casting vote of the mayor Ald McCarthy offered the following which was adopted I move that a contract be executed in accordance with the plans and specifications submitted last fall for the building of the fourth street engine house 2nd that a contract in accordance with bids received at the time advertised for 3rd that the committee on fire be instructed to first agree on all changes that may seem proper for majority report To the city council of the city of Dubuque Your special committee on the improvement of Main Street respectfully report that in accordance with the instructions of the council at its last session we have conferred with the Dubuque Street Railway Compny in regards to the proportion of the expense to be paid by said company of lowering the surfact of main street between curbs from first to eighth street in the manner shown in the plans approved by the council and have effected an arrangement with said company by which it agrees to pay one third of the expense of the grading between curbs and of the macadamizing between the gutters as its entire share of the expense of the proposed improvement which the city is to accept in full satisfaction of the conditions of section 3 of the ordinance adopted July 9th 1883 granting certain additional rights and priveleges to said street railway company. The section referred to provides that the company shall pay one half the expense of lowering main street but the city has adopted plans for a more expensive method of macadamizing than that at present on the street and it is claimed with much appearance of justice that the railwau company cannot be compelled under the section of the ordinance specified to pay more than one half what would be the expense of lowering the surface according to the present method. We regard the proposed adjustment of the question as fair and equitable to the company and to the city and herewith submit a written agreement providing for carrying it into effect executed by the street railway company which we recommend be approved by the council and executed on the part of the city If the council shall approva of the forgoing agreement with the street ralway company your committee would further recommend as an equitable settlement of teh question as to how teh improvement shall be paid for that the expense of the curbing and of the paving of the gutters be assessed as a special tax to the abutting property and that the remainder of the epense less the amount to be paid by the street railway company shall be paid from the city treasury all of which is respectfully adoption of the agreement with the street railway company But as the proposed improvement of Main Street will be a great benefit to that street and to the owners of property fronting on the same we believe the entire expense except what is to be paid by the street railway company should be paid by the abutting property holders and we therefore recommend to the resolutions that effect heretofore adopted by the council remain unchanged H C Deckert P Olinger Ald Crawford moved a division of the question and that so far as the street railway company is concerned the report of the committee be adopted which was carried Ald Crawford then moved the adoption of the majority report Ald Deckert moved to amend by substituting the minority for the majority the ayes and nayes were called on the the license as precribed by ordinance from all hotels and boarding houses in teh city adopted Ald Kane presented a petition of residents on the still against the placing of bells on cows running at large the matter was referred to the marshal to abate the nuisance Ald Crawford moved that the city attorney draft an ordinance covering the petition and stated that the pound master was derelict in his duty ald McCarthy moved that the officers conduct be investigated The city attorney reportd on the bill presented by the authorities of Jackson Co that the city was not liable for the bill on the Weigle Alley petition that the city should again advertise for bids He also stated that the Board of Equlization must be appointed at this sesson and that the assessor asks for further time to McCarthy's motion was then carried to allow her $100.00 Ald Crawford offered the following resolution which was adopted Resolved That the street laid out and platted by James Rowan running southernly from Southern Avenue on the East side of Minl Lot 35 be named and hereafter known as Rowan Street Also resolved that the proposed street running south from Grand View Avenue along the line between Mineral lots 12 and 20 be named and hereafter known as Russell Street ald Crawford offered the following Resolved that the city engineer be instructed to give the notices prescribed by Sec 2 of Chapter 25 of the published ordinances to the property owners on the line of Russell Street and also fo Rowan Street whos property is proposed to be taken for said streets on file in the office of the city engineer Said notices to be given to the property owners who have not already given the right of way for said streets adopted Ald McCarthy offered the following Your committee on printing recommend that no notices be inserted in any of the official paper more than once at the expense of the city unless the ordinance provies that notices be inserted more than one time Adopted Ald Hollnagel offered the following resolution Whereas the sidewalks on both sides of Couler Avenue from 18th Street to the Fair Ground are in a very bad condition Therefore be it resolved that the city marshal be instructed to notify all abutting property owners on Couler avenue from 18th Street to the Fair Ground to repair their sidewalks within ten days from date of notice adopted Regular Session alley from 13th to 14th street between Jackson and Washington Street is in a very filthy condition and in the opinion of the board of health should be improved. Therefore be it resolved by the city council of Dubuque that the street commitee be instructed to examine said alley and report as to the advisibility of making such improvement as needed ald Kane offered the following Resolved that the tax of Ann McLaughlin be cancelled for the year 1883 adopted Ald Martin offered the following resolution which was laid on the table. Be it resolved that the office of inspector of Weights and Measures be from this date discontinued and the property belonging to the city returned to the market master. Ald Deckert offered the following Resolved by the city council of Dubuque that the retaining wall on the east side of Windsor Ave Sewer be extended the cost not to exceed the estimate of the city engineer $165.00 adopted Ald Deckert resolved by the city coundil of the city of Dubuque that Weigel Alley between 11th st and south end of the alley be macadamized in conformity with teh ordinance on that subject that the city engineer be and is hereby directed to make the necessary plans and specifications for said improvement and the city recorder directed to give the proper notice for bids and proposals for the performance of the work the macadamizing to be done at the expense of the abutting property adopted Ald Deckert be it resolved by the city council of Dubuque that Bluff Street Extension from Dodge to Villa Street be improved by grading constructing retaining walls and gutter that the city engineer be and is hereby instructed to prepare plans and specifications for the above work and that the city recorder give the proper notice for the bids and proposals for the performance of the work The resolution was adopted by the casting vote of the mayor the amount to be expended to be limited to $900.00 an ordinance to license roller skating rinks was read the rules were suspended the ordinance read for the second time and adopted. Regular Session June 2nd, 1884 Mayor ODonnell in the chair Present Ald Byrne Clancy Crawford Deckert Hollnagel Kane Martin McCarthy Olinger and Page On motion of Ald Olinger the bids for the material in the fourth street engine house were opened and read and the material sold to Joseph Stoltz for 65.00 he being the highest bidder On motion the bids for the improvement of Main Street were opened and read and the contract awarded to D W Linehan for 10,118.00 he being the lowest bidder after which council adjourned Attest J W Halpin Recorder Special Session June 11th, 1884 Mayor ODonnell in the chair Present Ald Byrne Clancy Crawford Deckert Hollnagel Kane Martin McCarthy Olinger and Page The council met at 7:30 pm The mayor stated the object of the meeting was to consider the granting of a charter to the dubuque overland telephone company On motion the rules were suspended and Mr Keim addressed the council in relation to the matter and presented an ordinance which was read for the first time Ald Kane moved that the ordinance be referred to the commitee on ordinance for examination to report at a special session to be held June 19th at 7:30 pm Ald McCarthymoved to amend and offered the following resolution Resolved that it be the sense of the city council of the city of Dubuque that a charter be granted to the Dubuque Overland Telephone Company for putting in a new telephone plant with the conditions and amendments that the council may make at its next regular session adopted Ald McCarthy offered the following Resolved by the City Council of the City of Dubuque that a sidewalk twelve feet wide of good two inch plank or brick or stone be within fifteen days of this notice constructed and laid inconformity with the ordinance in relation to sidewalks on the south side of Seventh Street between White and Jackson Street referred to the committee on streets The petition of Nick kauffmann asking to have street graded and alley improved was referred to the committee on streets Ald McCarthy offered the following Whereas several petitions has been presented by the residents on the bluffs for a policeman and whereas the residents on west 8th street from the diamond house west including Fenelon Place and Wilson Avenue have been continually annoyed by tramps and burglars during the summer season Therefore be it resolved that a policeman be elected by this council to serve as patrolman on the Special Session June 11th, 1884 Mayor ODonnell in the chair Present Ald Byrne Clancy Crawford Deckert Hollnagel Kane Martin McCarthy Olinger and Page above named district up to November 1st 1884 including from the cor of 3rd and summit st Amended by Ald Hollnagel that one be appointed to patrol couler ave to the fair ground Amended by Ald Crawford that on ebe appointed on the bluffs north of Julien Ave to fourteenth Street and one on Dodge Street and Southern Avenue Ald Olinger moved to lay the whole matter on the table which was carried by the casting vote of the mayor Ald Crawford them moved that the marshal be instructed to replace the two men on the beats on the bluffs and one on southern avenue the place they were elected to patrol and taken of by the marshal without action of the council The marshal was asked if he could spare the three men from their present beats and he said he could not Ald Martin moved to reconsider the vote by which the resolution and amendments were laid on the table which was carried The resolution as amended was then adopted Ald McCarthy moved that the council proceed to elect four policemen Ald Olinger moved to adjourn which was lost The council then proceeded to elect four policemen and Thomas Blake Patrick Kenneally and Wm Klauer were elected by acclamation For the fourth man A Anderson P Kearney Thos Rieley and John McNulty were place in nomination On the second ballot Peter Kearney was elected having received six votes the matter of paying F L Randall contractor for filling done on the Bush and Cooley lots Ald McCarthy offered the foll resolved that $1000.00 be paid Mr Frank Randall on his contract of filling the bush and cooley lots on condition that he enter into an agreement with the city of Dubuque that he will not proceed against the city for any damages growing out of this contract with the city when he gets the amount due him as per estimate of the city engineer adopted
