the mayor stated the object of the meeting to be to take final action on the gauge of the proposed double
track for the street railway and called on the citizens present for their views on the matter after hearing
remarks on the subject from several citizens the matter was allowed to remain as it was a broad gauge
The mayor aslo stated that a notice had been served on the city by the property owners on Main Street
giving notice that suit would be commenced for an injunction to restrain the city from collecting a special
assessment for the improvement of Main street
Ald Crawford moved that the matter be referred to the city attorney to examine and report to the council
at its regular session next Monday
the petition of James H Shields in relation to filling lot 2 of block 9 was referred to the committee on harbors
The resignation of Policeman A Pfeffer was read and on motion accepted
Health Officer Waples made a report in relation to some nuisances and asked the council to order the
same abated the officer was instructed to report at the next regular session when action would be taken
the marshal was instructed to notify Mr H H Clark to put his building in proper shape to comply with the
ordinance
the bid for the improvement of Weigel Alley was opened and read and on motion the contract was awarded
to Spear and Lee
The proposals for the improvement of bluff Street extension was referred to the city engineer

Marshal Zugenbuehler reported that 85 arrests had been made during the month that he had paid into the
city treasury 2.25 for impounding 1.00 fines and 4.25 for broken lamp post that the sum of 1191.10 was
necessary to pay the police force for the month of June the report was received and filed and the amounts
ordered paid
Auditor Reilly reported that the amounts due the city officers and employees for June was 944.90 and the fire
department 903.30 ordered paid
Treasurer Traut reported having paid out during the month as interest etc 1576.80 ordered paid
Street commissioner Norton reported that 1291.65 had been expended on streets during the month of
June ordered paid
Police Justice Hoffmann reported that he had tried eight cases for violation of city ordinances and had paid
into the city treasury 12.00 as fines in said cases that there was due him 7.75 as fees in said cases which
was ordered paid
Lamplighter Hackney reported having lighted 200 gas lamps during the month received and filed
Auctioneer Hedley reported auction sales amounting to 13,430.05 during the month received and filed

We hereby recommend that the water tax of the CM & St P Railroad be place at 19.00 and the IC Railroad

recommends that an order be drawn on the city treasurer for the amount of 44.00 as refunded tax

the same committee reported on the petition of E W tyler et al in favor of placing a lamp post corner of 5th
and nevada streets
Ald Olinger Chairman of Committee on Fire reported on the petition of A A Cooper that the same be
granted
Ald Page from the committee on claims reported on the petition of Dr Sigismund Lesser that the sworn
statement of petitioner and mayor be given before the whole council
Ald McCarthy from the committee on public grounds and buildings reported in favor of paying several bils
referred to his committee in the previous session

the same recommended that the city buy fifty new iron seats for use in the parks at an expense of 350.00
the recommendation was received and filed
Ald McCarthy reported on the petition of John Pier in relation to old bond that the same be received and
filed
On motion the sidewalk on the east side of Jackson Park was ordered to be gravelled by the street commissioner
A recommendation to paint the town clock was on motion received and filed
ald Kane moved that the street commissioner employ Thos Hackney as foreman on the streets if he has
work for him which was adopted
City Attorney reported on the petition of B J Duffy that he had made application for a rehearing of the case
and that the petition be received and filed
adopted
On the petition of John Cooney that the same be received and filed he also returned the contract with B W
Jones for building the 4th street engine house to the recorder
He also presented an ordinance entitled an ordinance to prevent hogs and other animals from running at
large which was read and on motion the rules were suspended and the ordinance read for the second time
and adopted by a unanimous vote of the council
Ald McCarthy offered the following resolution
Whereas the steps leading from fifth street to the alley leading from the eastern terminus of Fenlon Place
are in a bad condition and dangerous to travel over the same and as it is the only outlet that those residing
on Fenlon St have
therefore resolved by the city council of the city of Dubuque that the street commissioner be and is hereby
instructed to have the same repaired the ayes and nays were called on teh adoption of the resolution and
it was adopted by a unanimous vote of the council
Ald McCarthy offered the following which was adopted
Resolved hat the com on Police and Gas have power to order the gas company to lay gas pipe to the
center of Washington park as the citizens have a lamp post in the park that they ask gas for

Ald Crawford offered the following resolution which was adopted
Resolved that a special committee be appointed to confer with the proprietors of the lorimer House artesian
well with a view to obtaining the free use of water from said well for a drinking fountain to be placed on the
outer edge of the sidewalk at the point for the use of passers by including animals also with the proprietors
of the steam heating works relative to water for a similar fountain on 6th street between Iowa and Clay Streets
The mayor appointed Ald Crawford McCarthy and Deckert as such committee
Ald Crawford offered the following
Resolved that a street lamp post and gas lamp be put in on the north side of Julien Avenue at a point opposite
the vacant lot immediately west of the store of Joseph Traut the resolution was referred to the committee on
Police and Gas with power
Ald Crawford offered the following resolution which was adopted
Whereas it is deemed advisable by the city council to lay out and open Russell Street in the manner shown
on the plat now on file in the office of the city engineer and the owners of the property proposed to be taken
have been duly notified as required by law
Therefore resolved that the city recorder be instructed to issue a venire to the city marshal commanding him
to summon a jury for the purpose of appraising the damages caused by laying out of said street all of the
proceedings to be had in conformity with the provisions of chapter 25 of the revised ordinances
Ald Crawford offered the following which was adopted
Whereas it is deemed advisable by the city council to extend Rowan St southerly to Grand View Ave and
the persons whose property is proposed to be taken as shown by the plat in the office of the city eng
have beenduly notified as required by ordinance therefore resolved that the city recorder be instructed to
issue a venire to the city marshal commanding him to summon a jury for the purpose of appraising the damages
caused by laying out and extending said street all of the proceedings to be had in conformity with the provisions
of chapter 25 of the revised ordinances

the city attorney gave his opinion on the petition of Wm G Watters and stated that a public water way could
not be used by private parties
Ald Crawford moved that the street commissioner be instructed to turn the water into the gutters out of the sewer
and the matter of pumping out the cellar be referred to the mayor with power
carried
Ald Crawford moved that the committee on fire be instructed to place a fire plug at the corner of ninth and
pine street which was adopted
Ald McCarthy moved to reconsider the vote by which Mrs Sophia Stange was allowed 100.00
Ald Crawford moved to lay the motion on the table which was carried
The bill of Wm Rebman for the improvement of Park Street was referred back until the work was accepted by
the street committee and city engineer
Ald Byrne stated that some disatisfaction was expressed at the manner that main street was being improved
the matter was referred to the special committee on Main St

The petition and claim of Ross McMahon was on motion referred to the committee on streets with Ald Kane

Ald Crawford chairman on ordinance reported on the ordinance of the Dubuque Overland Telephone Company
with two sections added as amendments
Ald McCarthy moved to amend by inserting another section fixing the amount to be charged for telephones
on which the ayes and nays were called

The mayor voted nay and the amendment was lost
The report of the committee as amended was then adopted
On motion of Ald Olinger the ordinance was then referred back to the committee to agree on a report
A petition from the residents on white street between 12th and 13th street in relation to the children of the
Lutheran School was referrd to the marshal with power to abate the nuisance complained of
Ald McCarthy reported in favor of paying the bill of the Dubuque Times fo 22.70
adopted
Ald Hollnagel offered the following resolution which was adopted
Be it resolved by the city council of Dubuque that the gutter on the east side of Couler Avenue from the
residence of Mrs P Ellwanger to Eagle Point Avenue be repaired so that the stagnant water will flow into
the Eagle Point Avenue sewer and the street commissioner be instructed to commence the work immediately
Ald Crawford moved that the street commissioner be instructed to put a gang of men to work repairing
Couler Avenue as soon as the street railway company have laid their track onsaid street the matter of grade
to be left with the city engineer
carried.
Regular Session July 16th 1884

Ald Martin moved that a cooper be allowed to store barrels in the basement of the city hall the matter was
referred to the committee on public grounds and buildings
City engineer Tschergi stated that he had asked the mayor pro-tem not to sign the warrant ordered at the
last session as he had been ery careful in his measurement of the macadam and that Mr Lavan had received
all that was due him
On motion the action of the council in the matter and the petition was referred to the committee on streets
Ald Clancy stated that the charge preferred against a policeman referred to his committee at the last session
had been throroughly investigated and proved to be groundless the mayor also stated that from what he
could learn there was no foundation to the charges
Ald Deckert offered the following resoluton which was adopted
Be it resolved by the city council of the city of Dubuque that four hundred dollas be paid Ross McMahon as part
payment on 8th street sewer contract the warrant to be drawn in favor of the city treasurer who holds a receipt
for the amount
Ald Deckert offered the following
Resolved by the city council of the city of Dubuque that Washington Street between 19th and Lake Streets
be graded guttered curbed and macadamized in conformity with the ordinance upon that subject that the city
engineer be and is hereby directed to make the necessary plans and specifications for said improvement and
the city recorder directed to give the proper notice for bids and proposals for the performance of the work
the guttering curbing and macadamizing to be done at the expense of the abutting propety the resolution
was adopted by a unaminous vote of the council
The special committee on Main Street was called on to report and ald Crawford asked the attorney to report
on the matter referred to him in relation to the subject
The city attorney reported that he had examined the records as instructed and found all the proceedings in
the matter correct and regular and that the city had the right and can collect the special assessment for
the improvement

Ald Deckert moved that the work be stopped at third street until such time as the injunction suit threatened

The mayor voted nay and the motion was lost
Ald Crawford moved that it be declared the sense of the council that the work be prosecuted as speedily
as possible
Ald McCarthy moved to amend that a committee of three be appointed to ascertain what the property owners
were willing to do the ayes and nays were called on the amendment

Ald Crawford motion was then put and carried
The bill of F Heer architect for plans for engine house c c amounting to 110.00 was ordered paid

On motion W H Rebman was allowed $400.00 as part payment on his contract for the improvement of

killed by the police force the sum of 1148.65 was necessary to pay the force for the month the report was
received and filed and the men ordered paid
The deputy marshal reported that he had served the proper notices of special assessment for improvements

he paid into the treasury Also that he had furnished 110 meals to prisoners and lodgers amounting to

Ald Deckert offered the following resolution
Resolved by the city council of the city of Dubuque that the alley between 13th and 14th between Jackson
and Washington streets be graded and macadamized in conformity with the ordinance upon that subject
That the city engineer be and is hereby directed to makle the necessary plans and specifications for said
improvement and the city recorder directed to give the proper notice for bids and proposals for the performance
of the work the grading and macadamizing to be done at the expense of the owners of the abutting property
the resolution was adopted by the unanimous vote of the council
Ald McCarthy offered the following
Whereas it is costing the city a large sum of money each month for assistants to the city engineer and that
the cost for the month ending to the city was 113.50 therefore be it resolved by the city council of the city of
Dubuque that we proceed to elect a deputy city engineer at a salary not to exceed 70.00 per month until
January 1st 1885 and that no bills be allowed for assistants to help the city engineer other than provided in
the foregoing

Ald Crawford moved as an amendment that the engineer be authorized to nominate an assistant

and the vote resulted on the first ballot in the election of Wm Evans
Ald Hollnagle called the attention of the council to a nuisance on Francis St Livola add Mr Brown was heard
in relation to the abatement of a nuisance on his property the subject matter was referred to the ex com of
the board of health
Ald Crawford offered the following resolution
Whereas upon an examination of the plat and report of the engineer on Russell and Rowan streets and of
the assessment and estimate of the jury summoned to appraise the damages resulting to the owners of
the property on the line of said streets caused by the laying out and offering the same it is decided by the
city council that it is expedient and necessary to lay out and open

Resolved that the assessment of the jury summoned to assess the damages caused by the opening of
Russell and Rowan sreet this day returned to teh council be and the same is hereby accepted and approved
and the several amounts awarded as damages be set apart in teh city treasury and paid to the several
persons entitled to the same on their executing in the proper legal manner a relinquishment to the city of the right
of way for said streets over the property taken. That Russell Street and Rowan Street be each and severally
declared public highways and the marshal be instructed to proceed to open the same as soon as practicable

the jury summoned to assess the damages caused by the opening of Russell and Rowan Streets made the
following report

ald Kane moved that the vote by which Mr Evans was elected assistant engineer be reconsidered
Ald mcCarthy moved to amend that the matter be postponed until the next meeting of the council in one
week
The amendment was lost by a vote of 4 to 6
ald Kanes motion was put and carried by the casting vote of the mayor
Ald Crawford moved that the election of an assistant engineer be indefinitely postponed which was lost

Ald Crawford then moved that the question of creating the office of assistant engineer be referred to the
city attorney to report at the next session of the city council
The matter of the improvement of Main Street was then referred to the city engineer and the contractor to
work in harmony
the city attorney reported that he had made a lease for two years for right to mine under Weigel Alley with
condition with condition that surface shall not be broken and in case of damage to surface leasee to pay
all expense of repairing resulting from damage leasee to pay of all mineral discovered
Ald Clancy moved that the contract for the improvement of Bluff Street extension be let to Spear and Lee the
motion was lost
On motion the bids for the improvement of Washington street between ninteenth and lake Street were opened
and the contract awarded to Geo Martin for 624.85 he being the lowest bidder

the mayor stated the object of the meeting to be to take some action in relation to the erection of a frame
building in the fire limits
the petition of John McCoy was read and attached thereto was the building permit of the city engineer
the marshal was called on and explained his action in relation to the matter
the city engineer was also called and stated that he had issued the permit with the understsanding that the
building was to be covered with sheet iron
On motion the rules were suspended and Mr McCoy was allowed to explain the matter and stated that he
had stopped work when notified
Ald McCarthy moved that the action of the city engineer in granting the permit be approved
The mayor suggested that the building be allowed to proceed under the supervision of the city engineer
Ald McCarthy said he would change his motion in accordance with the mayors suggestion
ald Byrne moved to amend that the work be allowed to proceed under the fire building ordinance and that the
building be covered with iron themotion as amended was carried by a full vote of the members present
the petition of thos Hackney for employment on streets was read and on motion of Ald Kane the petition
was granted and teh street commissioner instructed to employ Mr Hackney

On motion the rules were suspended and J Drehouse was allowed to address the council in relation to the

On motion of ald Kane the fire building ordinance was referred to the committee on ordinance and city attorney

the city attorney was called on and stated his opinion in relation to the collection of license from private boarding
houses that under the existing ordinance the city could not collect said but the ordinance could be so amended
that the city could collect a license
Ald McCarthy asked the street committee about the improvement of West street ordered at the last session
On motion the street commissioner was instructed to proceed with the work at once
Ald Kane moved that the marshal proceed to collect all saloon licenses by the 20th of this month and to close
all those who have not paid at that date the motion was carried

Resolved that no policeman shall be paid except for the time he shall be actually on duty unless his absence

resolved that the city treasurer be and is hereby instructed to cancel lot 13 in Block 8 in the dubuque Harbor

resolved that the Fire committee is hereby authorized and instructed to have a stairway constructed in the fourth
street engine house from the first floor to the basement so that access can be had to the basement without
going out doors also to provide for stalls for horses in the engine room
ald McCarthy moved to amend that the committee be instructed to make all absolutely necessary improvements
and put the house in a habitable shape The resolution as amended was adopted
Ald Kane offered the following which was adopted Resolved by the City council of the City of Dubuque
that the Recorder be instructed to issue the following warrants in favor of B W Jones in part payment for
the construction of teh Fourth St Engine House One warrant for Eight Hundrd and twenty five 825 dollars
one hundred and seventh five 175 dollars
and four warrants for five hundred 500 dollars each making a total of three thousand 3000 dollars

Resolved
That the street commissioner is hereby instructed to require the street railway company to proceed at once
to put its roadway where the same has been relaid or newly constructed in perfect repair and condition and to
complete the same as soon as possible and that in case of the neglect of the company to comply without
delay that teh commissioner carry out the provisions of the ordinance provided for such cases

Resolved that teh marshal be instructed to proceed at once in the collection of team express billiard hotel
butcher and all other unpaid license and that persons failing to pay up be prosecuted in accorance with

the committee to whom was referred the claim of Ross McMahon cold not agree on a report Ald mcCarthy
from one portion of the committee reported in favor of allowing him $50.00 in full settlement of his claim the
ayes and nays were called on the adoption of teh report which resulted in a tie the mayor voted in favor of
allowing him the 50.00 provided he finish his contract in a satisfactory manner
The bids were tehn opened and read for the improvement of the alley between washington and jackson from
13th to 14th st and the contract awarded to W H Rebman for 196.00 he being the lowest bidder
The council then adjourned to meet on Monday September 15th at 2 oclock pm

The mayor stated the object of the meeting to be make a report of the tax levy for the year 1884
On motion the committee on equalization retired for consultation
The mayor stated that the street railway company desired to put in transfer tracks on main Street to connect
their tracks and asked for the views of the council on the matter after some discussion the matter was postponed
until the regular session
On motion the rules were suspended and supervisor J Ruegamer addressed the council in relation to the
condition of teh road leading to St Mary's and St Johns cemeterys he stated that the road was in a very bad
condition and asked that an appropriation of twenty five dollars be made for the repair of the same which was
on motion granted the money to be expended under the supervision of Mr Ruegamer
On motion the bill of John Needham for fifty 50 dollars for the improvement of West Street was ordered paid
as was also the bill of the daily times for printing
The matter of the collection of garbage for the balance of the season was discussed and the matter was
finally referred to the board of health
Ald Kane offered the following resolution
Resolved by the city council of the city of Dubuque that the following levy be made on the taxable property for
the year 1884
For current expenses six 6 mills
For payment of interest 4 1/2
To pay judgments duffy and Stange one half 1/2 mill
Water tax one mill
On motion the resolution was unaminously adopted

Ald Crawford stated that a large number of ordinances had been adopted by the council since the last
ordinance book had been published and throught that they should be published in pamphlet form
Ald McCarthy moved that teh matter be referred to the committee on printing to ascertain what it would
cost to have said pamphlet published the motion was adopted
ald Crawford offered the following resolution
Resolved that it shall be unlawful for any person or persons to dig up or remove any portion of the surface
of any macadamized or paved street of the city without first procuring a written permit from the city engineer
approved by the mayor and that the replacing and repairing of any street dug up or removed under such
permit shall be done as soon as possible at the expense of the parties doing the same and under the supervision
and to the satisfaction of the city engineer Also that the marshal and police be instructed to arrest promptly
any person or parties violating these regulations and that the ordinance committee be instructed to report
an ordinance containing the above provisions the resolution was adopted
Ald Crawford from the special committee on fountins for the corner of Eighth and Bluff and also on Sixth
reported that arrangements had been made to have artesian well water to supply the fountains
On motion Ald Kane was added to the committee
Ald Deckert offered resolutions for the levying of special assessments for the payment of improvement on
streets and alleys
Ald Crawford asked if the work had been accepted by the council if not he thought it would be proper to accept
it before the special assessment was levied
Ald Deckert chairman on streets then reported that the committee had addepted of the work done on the
alley between west 3rd street and Fenelon Place from Summit Street east the alley from 19th street to
Eagle Point Avenue between White and jackson Sreet also Washington Street from 19th street to Lake
Street the report of the committee was adopted

The petition of M Morgan in relation to taxes was referred to the committee on delinquent tax
the petition of Cecile Paen et al in relation to a nuisance was referred to the marshal to abate
Ald Deckert reported that a great many complaints had been made against the pount master for neglect
of his duty and thought the officer should be made attend to his duty
Ald Crawford moved that the marshal be empowered to look after the pound master and if he does not
attend to his duties remove him and place a competent man in his position
Ald McCarthy moved to amend by leaving the matter with the mayor which was carried

Police Justice Hoffman reported having tried seven cases for violation of city ordinances and that the sum of
ten and 25/100 10.25 was due him as coses which was ordered paid
Marshal Zugenbuehler reported that seventy four arrests had been made during the month of September and
that $1179.40 was due the police force which was ordered paid
Street commissioner Norton reported that the sum of $1666.75 had been expended on the streets during
the month for men and teams which was ordered paid
Treasurer Traut reported having paid out for damage to property 217.00 postage 7.00 interest 445.15 and
freight on fire department supplies 16.60 warrants were ordered drawn for the several amounts
Auditor Reilly reported that the payroll of the fire department amounted to 903.30 and that of city officers
and employees to 944.90 warrants were ordered drawn for the amount
Recorder Halpin reported having issued 29 licenses amounting to 560.15 the report was received and filed
Woodmeasurer Warring reported having measured 1239 2/8 cords of wood which had arrived by river and
rail during the mnth for which he received 43.35 received and filed
Auctioneer Hedley reported having sold at auction real estate and furniture to the amount of 6450.00 r and f
Deputy Marshal O'Neill reported having served the proper notice of a special assessment for the improvement
of the alley from 19th to Eagle Point Ave bet white and jackson Streets

30.60 also that he had furnished 118 meals to prisoners and lodgers 23.60 which was ordered paid

Owing to the increased traffic over High Street there is a great necessity of a public scale
Therefore be it resolved by the city council of Dubuque that a public scale be located on or near High Street

resolved that the marshal be instructed to notify all property owners on Main Street from 1st to 8th streets to
raise their sidewalks to the grade of the curb wherever the same is now below the curb and that upon their
failure to do so within ten days the same will be done by the city at their expense

graded guttered curbed and macadamized in conformity with the ordinance upon that subject and that the

and the city recorder directed to give the proper notice for bids and proposals for the performance of the
work the guttering curbing and macadamizing to be done at the expense of the owners of the abutting property

gentlemen the undersigned special committee on main street improvement hereby respectfully report that
we examined and accepted the work done on Main Street from first to Eighth streets by D W Linehan contractor
and recommend that the action be approved

ald Deckert moved that the contractor be paid for the amount of grading to be paid for by the city
Amended by Ald Kane that the matter be referred back to the special committee on main street which
was lost by a vote of seven to three

Resolved that the four policemen whose term expires Nov 1st be continued until further orders from this
council
Amended by Ald Crawford provided that they be continued on the beats where tehy now are stationed unless
temporarily removed after some discussion the resolution as amended was adopted
Ald Deckert chairman on streets made the following report
To the honorable mayor and city council
Your committee would report that they have examined and accepted the work done on Weigel Alley by James
Lee contractor

The report was adopted
The city attorney presented a report of witness fees due in the case of Jacob Breitback administrator of
the estate of B L Mulski vs the city of Dubuque amounting to 21.65 and recommended the payment of the
same warrants were ordered drawn for the amounts
Ald Deckert offered the following resolution which was adopted
Resolved by the city council of the city of Dubuque that Jones Street between main St and Levee be graded
curbed guttered and macadamized in conformity with the ordinance upon that subject that the city engineer be
and is hereby directed to make the necessary plans and specifications for said improvement and the city
recorder directed to give the proper notice for bids and proposals for the performance of the work the
guttering curbing and macadamizing to be done at the expense of the owners of the abutting property
The following ordinance wsa presented and read
An ordinance to regulate the opening of junction boxes by the steam supply company
Be it ordained by the city council of the city of Dubuque
section 1 whenever hereafter the steam supply company shall find it necessary to open any junction box
on Main St between 1st and 8th streets they shall repair the same by bringing such junction box flush with
the surface of the street

and by covering the same with an iron cover properly corrugated or roughened upon its surface so as to
prevent teh slipping of horses tehreon and sufficiently strong to support the heaviest loads ordinarily drawn
upon said street and it shall be the duty of said company to constantly replace the macadam when it becomes
worn at the edges of any such cover
Section 2 the work and material used in making such changes and alterations shall be under the supervision
and subject to the inspection and approval of the city engineer
On motion the rules were suspended and the ordinance read for a second time by its title and adopted by
a unanimous vote of the council
the council then adjourned to meet Tuesday October 21st 1884 at 2 olock pm

The petition of L Hartmann et al in relation to the erection of a frame building in the fire limits was referred to
the committee on Fire with power
The remonstrance of Peter Meyer in relation to the same matter was referred to the same committee with
power
The city attorney made the following report on the bill of John McCoy
the city not being liable for the wrongful facs of its police and as this is the basis of the claim is said alleged
wrong committed by the city marshal the city would not be legally bound to pay the claim the report was adopted
and the claim received and filed
the city attorney made the following report on the petition of H Geiger
As will be seen by the accompanying statement the special assessment against petitioners lot was canceled
by a decree of the district court in 1879 and should have been so entered upon the treasurers books I call
the attention of the council to the assessment of th eother parties to the suit which were also cancelled by the
same decree and which perhaps might with propriety be cancelled upon the treasurers books if they have not
been so marked The report was adopted and the treasurer instructed to cancel the assessment mentioned
Ald Crawford chairman of the special committee on the improvement of Main Street made the following
report
To the city council of the city of Dubuque
Your special committee on the improvement of Main Street from First to Eighth Streets respecfully reports
that in connection with the city engineer we have carefully examined the work performed by D W Linehan
under his contract for grading paving cubing and macadamizing the above mentioned portion of said
street and find the same in our judgment to have been faithfully done according to contract we therefore
recom

mend that the same be accepted as complete and satisfactory Your committee further recommend that his honor
the mayor be requested to call on the Dubuque Street Railway Company to pay into the city treasury the
sum of $1534.54 that being the amount reported by the city engineer to be due the city from said company
under the provisions of section 3 of the ordinance adopted July 9th 1883 We also recommend that all owners
of lots and ground abutting on said portion of said street be severally duly notified in the manner prescribed
by the ordinance that the question of levying a special tax on said abutting property to pay for the said curbing
paving and macadamizing less the amount due from the Dubuque Street Railway Company will be considered
at a special meeting of the city council to be held on Friday October 31st 1884 at 2 pm and that any person
owning or being interested in any of said abutting property and having any objections to the levying of said
special tax will be heard at said meeting All of which is respectfully submitted

Ald Crawford moved the adoption of the report which was carried
The bill of James Lee for $527.32 for the grading of the Weigel alley was ordered paid
the bill of Ed Ryan for the improvement of the alley bet west third st and fenelon pl from summit street east
amounting to 355.29 was taken
Ald McCarthy objected to the paymenht of the bill as there was a remonstrance from abutting property owners
in the hands of a special committee who had not yet reported
Ald Clancy stated that the street committee had accepted the work and so reported to the council and that
the report was approved by the council and a special tax levied for the payment of said work and moved
that the bill be paid
Ald McCarthy moved to lay the bill on the table which motion was lost
Ald Clancy's motion was then put and carried

The mayor from the committee to whom was refered the petition of Henrietta E Wilson Ailmx of the estate
of D S Wilson deceased in relation to certain taxes for the years 1876 1877 1878 1879 inclusive which appear
upon the books of the treasurer as delinquent after proper examination of the records and papers pertaining
to the matter make the following report It appears by the records of the District Court of Dubuque County that
a decree was entered on 2nd day of December 1880 declaring the taxes against D S Wilson for the above
years to have been fully paid by installments excepting the sum of 143.30 which Wilson was decreed to pay
within 10 days From this decree the city appealed and while the cause was pending in the Supreme Court
the Adminx of the extate of Wilson and the city entered into a written stipulation for the settlement of the cause
involving the claim of the city for the taxes for the above years the estate of Wilson to pay 500.00 in full payment
of the city's claim which sum was paid into the treasury Sept 16/81 and the receipt of the then treasurer D A
Gehrig given therefor a copy of the receipt is hereto attached theses been the unquestioned fact it follows that
the treasurer should be directed to cancel the taxes assessed to D S Wilson for the years 1876 to 1879
both inclusive upon the books in his office

the report was adopted and the treasurer instructed to cancel the taxes above mentioned
On motion the rules were suspended and Mr Wm Rebman addressed the council in relation to digging
up in an alley at the head of fifteenth street he presented a plat of the ground showing it to be his private
property and asked that he be allowed to proceed with the work as he had been stopped by the marshal
and had tried to have the matter explained by the city attorney but he being absent from the city he was
delayed
The city engineer being called on stated what he knew of the matter and that he had procured the plat at
the county recorders office
On motion of Ald Crawford the matter was referred to the city attorney to examine into carefully and report
to the council at its next regular session

hereby levied on the several lots and parts of lots and parcels of real estate herein after named situate and owned
and for the several amounts set opposite each lot or parcel of real estate as follows

Marshal Zugenbuehler reported that 1189.30 was due the police force for the month of October 1884 That
71 arrests had been made during the month and had collected 2.50 for tile pipe broken which he had paid

To the city council of the city of Dubuque the undersigned a majority of your special committee to which
was referred the resolution offered at the last adjourned session of your body providing for the levy of a
special tax on the several parcels of real estate abutting on Main Street between First and Eighth

streets to pay for the curbing guttering and macadamizing of that portion of said street less the amount to be
paid by the Dubuque Street Railway Co have had the subject under careful consideration and respectfuly
submit the following report
The improvement to defray the expense of which it is proposed to levy the special tax has been under contemplation
for several years the street was originally curbed guttered and macadamized about thirty years ago and although
frequently repaired at the expense of the city its condition had become extremely bad In the opinion of the
city council it was not only necessary to thoroughly remacadamize the street and put in new curbing but to
lower the middle of teh street about eighteen inches so as to make the whole width of it between curbs easily
available for travel as to the great desirability and utility of the improvement we think there was no difference
of opinion either in the council or among our citizens We think we are safe in saying that a great majority of
the abutting property holders were strongly in favor of the improvement That the contract let at a very low price
was well and faithfully executed we think is univesally admitted if there has been the slightests complaint
from any source as to the performance of the work we have failed to hear it
It is also admitted universally that it has added greatly to the condition and appearance of the street The question
now is who are the proper parties to pay for it Whether the abutting property holders or the tax payers of the
city at large Your committee desires to controvert the idea expressed by some that this improvement was made
to any extent or degree for the benefit of the dubuque Street Railway Co that compay never asked for it or
suggested that it should be done The work had been in contemplation several years before the railway co
applied for the privilege of laying its double track It remonstrated strongly against the conditions insisted on
by the council that it should pay a portion of the expense of lowering the street stating that it would not benefit
them and that they did not desire it to be done they also claimed that it was all they could do to make the contemplated
improvements to their railway line without being compelled to pay for city improvement As the council however
insisted on the condition the finally consented to it The amount to be paid by the company towards the improvement
under the contract is 1534.54 As instructed by the council we have conferred with the owners of the abutting
property and heard their objections to the proposed levy and carefully considered them These objections as
we understand them are not based on legal grounds The legality of the tax appears to be condeeded by most
if not all of the parties interested In the opinion of your committee no valid legal objection can be made Every
step has been carefully taken The abutting property holders all express themselves greatly pleased with the

the improvement and the names in which it has been executed It is admitted by a majority if not all of them that
it was a necessary improvement and is a great benefit to the street They claim however that Main Street is
the great business thoroughfare of the city and that the work was for the benefit of the citizens of Dubuque
generally and ought to be paid for out of the city treasury instead of by a tax on the abutting property It is also
claim by some of them that while the appearance and convenience of the street is greatly enhanced by the
improvement that it does not enable them to do any greater amount of business nor obtain any increase of
rent for their business houses It is also urged that having once paid for the original curbing gutter and macadamizing
they ought not to be required to do so a second time In regard to this last argument we have to state that when
Main street was previously improved in 1854 or 1855 the records of teh city show that the abutters paid but
one half of the cost and the city the other half while the property holders on every other street which has been
improved during the last twenty years have had to pay the entire expense It may be true as asserted that the
improvement of Main Street does not directly bring its property owners any immediate increase or rents and
that property fronting on a handsomely paved and graded street is not more valuable than if situated on a
rough shabby and ill paved one That however is not the general opinion nor accrding to the experience of mankind
and we do not think it is well founded If it is a good reason that because Main Street has far the largest business of
any in the city it ought therefore to be improved and beautified at the expense of the tax payers generally it would follow
as a legal sequence that improvements on other streets used only for residence purposes or on which only
a small amount of business is done should be improved at the expense of the abutting property This is on
the principle of taking care of the rich and leetting the poor take care of themselves While the improvement of
Main street in the manner it has been done may be to a certain extent a convenience and gratification
to every citizen of Dubuque yet it is clear to your committee that the primary advantage resulting from it will
mainly ensure to the benefit of those owning property on the street At a conference between your committee
and the property owners in which they were represented by a committee consisting of Mefrs W J Watters
W H Peabody John Thompson Peter Kiene Sr and Wm Andrew and their attorney Judge McCeeney a
proposition was made by them to compromise the matter by paying one half the amount the amount of the
tax proposed to be levied It was urged by them tht this would settle the question in an amicable and satisfactory
manner and avoid any possible litigation Some of the members of your committee have also advocated the
acceptance of the proposition and it is deserving of a respectful consideration It is the opinion of a majority
of your committee however that the duty of the council in thismatter is limited to ascertaining

and determining what is the legal and proper method of raising the means for paying for the improvement and
that it has no just right to compromise away the rights of a portion of our tax payers in favor of another portion
even for the sake of harmony and good feeling and to avoid litigation Section 466 of the code of Iowa clearly
confers the power of the city to curb gutter and macadamize the streets of the city by means of a special
assessment on the abutting property It may do so a second time when as in this case after a great number
of years the old maerial has become worn out and unfit for further use and in the discretion of the council it
requires to be renewed and reconstructed The action of the council in this matter will undoubtedly establish
a precedent for all such cases in teh future If this improvement shall be paid for from the city treasury whenever
hereafter it may become necesary to renew the curbing guttering and macadamizing of a street the abutters
will justly insist that it shall be done at the expense of the city It should be borne in mind that the whole expense
of the improvement of main Street will not in any event fall upon the abutters The entire cost of the grading 1073.99
will be paid by the city and the street railway co the street car co also pays 1176.61 towards the expense
of the macadam the amount contributed by the city treasury to the improvement on the grading is 715.86 In view
of the whole situation and circumstances of the case we are clearly of the opinion that it is the duty of the
council to levy the special tax as proposed and we therefore recommend the adoption of the resolution
offered at the last meeting of the council for that purpose

Ald McCarthy offered the following amendment to the report Whereas the improvement of Main Street is to
a certain extent a public benefit and Whereas that Main street property owners pay very largely in taxes
the money expended in improving our streets generally Therefore be it resolved that 40% of the amount
new assessed against the abutting property on Main Street for the improvement done during the year 1884 be
cancelled provided that all the abutters pay 60% of teh amount assesssed into the city treasury on or before
Jan 1 1885 and withdraw all suits and injunctins against the city of Dubuque

Ald Crawford offered the following resolution
Resolved that the forty foot street running east and west through O'Hares's addition be hereby named and hereafter
known as Bennett Street
Ald McCarty moved to amend the resolution by referring the same to a special committee of five which
amendment was lost
The resolution of ald Crawford naming the street Bennett street was then adopted
Ald Crawford offered the following resolution
Whereas it is deemed advisable by the city council to extend east street in west Dubuque to the south line
of Bennett Street in O'Hare's addition extended therefore resolved that the city engineer be instructed to
make a survey and plat of such proposed extension showing the land or lots through or over which the same is
proposed to be made together with teh names of the owners and the quantity of land proposed to be taken
and report the same to the council for its further action the resolution was referred to the committee on
streets and engineer
Ald kane offered the following
resolved that a discount of 3 percent be allowed on all regular taxes of 1884 provided they are paid on or
before the 20th day of December 1884 the resolution was adopted
Ald hollnagel offered the following
whereas the property owners on 17th and Clay streets are complaining very much about the small approaches
on said street
therefore be it resolved that said approaches be widened and lengthened and the street commissioner
be instructed to do the work at once the resolution was adopted
Ald Deckert offered the following resolution which was adopted
Be it resolved by the city council of the city of Dubuque that the alley between 12th and 13th streets and
between Jackson and Washington Streets be graded and macadamized in conformity with the ordinance
upon that subject that the city engineer be and is hereby directed to make the necessary plans and specifications
for said improvement and the city recorder directed to give the proper notice for bids and proposals
for the performance of the work the grading and macadamizing to be done at the expense of the abutting
property owners

On motion the bids for the improvement of Jones West 8th and Jackson Street were opened and read
Ald Kane moved that the contracts be awarded to the lowest bidder the work not to be paid for before the
31st day of may 1885 the motion was carried
The lowest bidders were as follows Jones St from main to the levee to Spear & Lee Jackson Street from
19th to lake Streets to Chas Steuck West Eighth st from Air Hill St to Wilson Ave to Spear and lee
A communication from the Health Officer in relation to the enforcement of the ordinance of the Dubuque
Butcher's association was read and the following resolution was offered
Resolved by the city Council that on and after the first of December 1884 the rodinance against the slaughtering
of animals within the city limits be rigidly enforced and that the city marshal be instructed to have the police
force cooperate in securing its enforcement as therein contemplated
On motion of Ald Crawford the aldermen of the fourth ward were added to the street committee to act on the
extension of east Street West Dubuque
The subject of an ordinance to further enforce the cleaning of alleys was referred to the committee on ordinance
with the health officer and city attorney
Ald Martin moved that the office of pound master be discontinued until next spring the motion was lost by
a vote of 5 to 4
On motion the street committee was instructed to prepare a place for the impounding of animals

Auditor Reilly reported that 984.90 was necessary to pay the city officers and employees and 903.30 to
pay the fire department for the month of November the report was adopted and warrants ordered drawn
for the several amounts
The street commissioner reported having expended 1141.70 to pay men and teams for the month of November
as follows
Repairing Seventh Street 90.00 Eagle Point Levee 161.85
Repairing front street 310.35 grading sidewalks 227.65
General repairing 351.85 the report was received and filed and warrants ordered drawn for the amounts
City attorney Linehan reported on the report of Justice T T Duffy recommending the payment of the fees
the report was adopted
Marshal Zugenbuehler reportred that thirty arrests had been made during the month and that 1168.00 was
necessary to pay the police force for the month 58.00 of which was to be paid by the county the report was
received and filed and warrants ordered drawn for the several amounts
Justice J P Quigley reported having tried one case for the violations of city ordinance and had paid into the
city treasury 7.75 as Fine and cost and there was due him 2.75 as fees in the case the report was received
and filed and a warrant was ordered drawn for the amount of the fees
Treasurer Traut reported having paid out 318.00 as interest 7.00 as postage 2.15 refunded tax expense
of 20.82 warrants were ordered drawn for the several amounts and the report was received and filed

The city attorney made the following report on the petition of Mrs Ellen Ahern
In view of the fact that the injury complained of was received more than three years ago and that upon a
similar petition to the city council immediately after the accident the claim was rejected We cannot recommend
that the action of the council had at that time should now be reversed upon an examination of the claim we do
not find any testimony which would warrant us in doing so The report was adopted

I recommend that no entry be made upon the tax books cancelling the tax upon this lot but that the treasurer

The City Attorney made the following report in relation to the private sheet in Cooleys sub
I find that the street to which a petition was referred to me was reserved by D W Cooley and Thomas Yates
as shown by the accompanying plat and memoranda in a partition had of certain lots and set apart as a
private street it is claimed that the street has been used by the public generally for more than 20 years as a
public street If so the city council may exercise control over the same as a private way the council cannot
control its use

Mrs Carrie Cain presented the following proposition which was adopted and accepted by the city council
To the city council of Dubuque as the owner of the ground prposed to be taken by the city for the extension
of East street west Dubuque to the south line of Bennett street as shown on a plat prepared by the city
engineer I will agree to make the proper deed to the city for the sum of thirty five dollars 35.00 If this proposition
is accepted the city council may at once proceed to establish said highway and I will bind myself to execute
the necessary deed on receipt of the amount I have specified
This offer is made with the understanding that the street shall be laid out only 50 feet wide

Resolved that the plat of the proposed extension of East Street in West Dubuque presented by the city engineer
be approved and that the proposition of Mrs carrie Cain to convey the right of way for said extension
fifty feet wide as shown on said plat for the sum of thirty five dollars be and is here by accepted and that
said sum be appropriated and set apart in the city treasury and paid over to Mrs Cain on teh execution and delivery
by her of the proper conveyance

Ald McCarthy moved that a special committee of three be appointed with the chairman on fire to purchase

Be it resolved by the city council of the city of Dubuque that Kniest Street extending from Lake Street to Eagle
Point Avenue be altered by vacating the easterly four feet and the westerly ten feet of said street and that the
city engineer is hereby ordered to make the necessary survey and plat of said street as is proposed and
file said plat in his office for public inspection according to section 1 of ordinances page 69 referred to
the committee on streets and city attorney
Ald Kane offered the following
resolved that the recorder draw a warrant for th efull amount of 4011.72 and that a receipt be given in settlement

Whereas there are a great many men in the city whose families are along dependant upon their labor for
support and such labor cannot now be procured during the winter months
and whereas said men who are now out of employment are residents of the county of Dubuque as fully as
they are the city and there is a necessity for immediate employment and whereas the city pays 58 percent
of all the taxes for the support of persons in needy circumstances no matter from what part of the county
they are from
Resolved that it would be manifestly unjust for the county to escape contributing to the assistance of such
persons and thereby compell the city in her present financial condition to pay the whole amount necessary
to employ such unemployed laborers and 58 percent of the amount given to all others and that it is the sense
of this council that no matter where the citizen of the county may reside within its limits it is the duty of
the county to assist him in cases of pressing necessity like the present Resolved that a committee of three
be appointed to wait on the county supervisors immediately and urge upon them

The necessity of affording employment in cases of real necessity to as many idle men as can be worked
and that the city of Dubuque is willing that the taxes paid by her people be used in this manner the mayor appointed
Ald Olinger Clancy and Kane as such committee after the adoption of the resolution
Ald Crawford from the committee on ordinance made the following report on the petition of the CM&St P
Railway to the city council of the ciyt of Dubuque
At the last June session of your honorable body the petition of the Chicago Milwaukee and St Paul Railroad
Company asking for the grant of a strip of ground for an additional railway track east of the outer track of the
Illinois Central railroad and extending from the northerly side of teh alley next south of Sixth Street to the South
side of First Street was referred to your committee on ordinance
Shortly after the reference a meeting of the committee was held to consider the application at which were present
the attorney and division superintendent of the petitioning company also a committee of the directors of
the Dubuque Northwestern Railway Company At this meeting the question was fully discussed no definite
conclusion as to the proper action to be taken was reached at the time but subsequently a report was substantially
agreed upon by a majority of the committee the presentation of which to the council has been repeatedly
postponed at the request of the Milwaukee Company In the opinion of your committee there is now no good
reason for further delay in reporting
The ground desired by the railway company north of third street is a part of the one hundred foot strip acquired
by the city from Booth and Stout at the time the location for the ice harbor was secured The westerly fourteen
feet of this strip was granted to the Illinois Central Railway Company for an additional track about two years
ago leaving eighty six feet if fourteen feet more should be granted to the Milwaukee Company as asked
for the city would still lhave seventy two feet remaining Thsi would afford space for at least five additional
tracks of fourteen feet each which would seem to be amply sufficient for the needs of the Dubuque and Northwestern
Company and all other companies which are at all likely to be built into Dubuque for many years if ever
If the city should grant to the Dubuque and Northwestern company ground sufficient for three tracks or
forty two feet there would still be left thirty feet or enough for two tracks for the use of any other roads which
may in the future enter or be extended to our city South of Third Street the right of way petitioned for would
extend southerly along and through the western border of the Ice Harbor ground to First Street This would
diminish the area of the Ice Harbor grounds to the extent of fourteen feet on its westerly side

and the track would pass immediately in front of the levee contemplated on the westerly side of the Ice Harbor
In the opinion of your committee no further curtailment of the ice harbor on its westerly side in excess of the
fourteen in question should be permitted and the city in granting said fourteen feet to the Milwaukee or any
other company should reserve the right to permit any other railway company which may herafter be constructed
in Dubuque to use the same jointly with the Milwaukee and St Paul compan for railway purposes on proper
conditions The fourteen foot strip desired by the Milwaukee company is almost entirely covered by water its
whole length and in its present condition is of no value to the city or anyone else If it can be spared as well
not it would be wise policy in the judgment of your committee to make the grant and permit it to be filled and
utilized providing the railway company on its part will offer proper inducements and preset to reasonable
conditions It is well known to the council and painfully apparent to every one that at this time there is a great
scarcity of work in the city and a great number of laborers and others who are unable to obtain employment
if this should continue much want and suffering are likely to ensue If the city council can take any action which
will result in furnishing work to any considerable number without embarassing the city finances or adding to the
burdens of the tax payers we think it most desirable to do so as speedily as possible
Your committee therefore recommend that the Chicago Milwaukee and St Paul Railway company be granted
the right of way fourteen feet in width extending from the alley next south of sixth street to first street for an
additional track adjoining and immediately east of and parallel with the right of way granted to the Illinois
Central Railway company by ordinance on the 8th day of January 1883 reserving the power to the city to
grant to the Dubuque and Northwestern Railway Company and any other railway company which may hereafter
construct or etend its road to Dubuque the right to the joint use of the portion of said additional track south
of third street on the payment to the Chicago Milwaukee and St Paul Company by said company or
companies of their portion of th eexpense of construction such portion of said additional track between
Third and First Streets and on the express condition that the filling and construction of said track shall be
commenced within thirty days and completed by the first of May 1885 and that the laborers and mechanics
employed in the construction of said track shall be bonafide residents of Dubuque and on such further conditions
as are embodied in an ordinance prepared by your committee and herewith presented
over

Whereas the extension of Lake Street to Couler Avenue is regarded as important and earnestly desired by
a large number of citizens in the northern part of the city therefore
resolved that the subject of said extension be referred to a select committee consisting of one from each ward
who shall be instructed to carefully investigate the practicality and expediency of the same and confer with the
owners of the property necessary to be taken and report to the council as early as practicable the committee
to consist of the street committee with Ald Crawford and page
Ald McCarthy from the special committee on revision of ordinances reported in favor of having the work done
at a cos not to exceed 300.00
Ald Crawford moved to lay on the table the report which was lost
Ald Deckert moved to amend that the matter be postponed for one month the committee to report the cost
at that time the amendment was carried

The mayor stated the object of the meeting to be to hear further reports on the petition of the C M & St Paul
and D N W Railroad companies
His honor also stated that there was some trouble caused to the operation of the fourth elevator on account
of some objections of abutting property owners and he wished the council to take some action on the matter
Ald Kane moved that the city attorney be instructed to draft an ordinance giving right of way to the fourth street
elevator company on fourth street from the base of the bluff to the top of the same the motion prevailed
His honor also stated that some citizens had waited on him and objected to the Dubuque Butchers Association
using an old barn adjoining their premises for rendering purposes
On motion the matter was referred to the committee on fire with the chief engineer to examine and report
Ald Crawford chairman on ordinances presented an ordinance granting certain additional rights to the CM and
St Paul Railway Co and moved that it be read for the second time by the recorder
Ald McCarthy objected as under the rules the ordinance had to lay over until the next session and that the committee
had not fulfilled its duty in not reporting on the petition of the Dubuque North Western Railway Company
Ald Deckert moved that the rules be suspended in order to hear from the representataives of the railroads
present on the matter
Mr W J Knight from the C M and St P Railroad and Geo B Burch addressed the council in relation to the
question as to the wants of their respective companies
Ald McCarthy moved that the ordinance be referred back to the committee with an additional member from
each ward to report on both petitions at the next regular session the motion prevailed

In the opinion of your committee the proposed extension is a very desireable enterprise affording as it
would to the residens on High and North Lake Streets and those living in the vicinity or working in the
CM & St P shops a direct connection with Couler Avenue If not carried out speedily the ground will soon be
built up and the extension hereafter rendered impossible except at great expense the question mainly to
be considered by the council is one of expense If the city can afford to open the street in its present
financial condition it ought to be done In order to afford the council some idea of the probable cost of
obtaining the right of way We have examined the city assessment lists for the year 1884 with a view to ascertain
what the lots necessary to be taken were assessed at for that year As the city assessment of real estate is
supposed and intended to be made at its full cash value it will give something of an idea of the probable
cost
The following is a description of the property required to be taken and the assessed value for 1884 To wit

Resolved that the committee on ordinances in sonnection with the city attorney be authorized and instructed
to have copied from the ordinance books and other records all ordinances and contracts with railway corporations
adopted or entered into by the city since the publication of the revised ordinances in book form together with
all laws of the state of Iowa affecting cities organized under special charters passed since said publication
and present the same with a suitable index and marginal notes properly prepared for publication in book form
complete to the city council at its next meeting if possible provided that the total cost of copying indexing and
preparing the same for publication shall not exceed the sum of thirty 35 dollars
Resolved further that upon the presentation of said compilation to the city council complete and ready for
publication and the approval of the same by the council that said committee in connection with the committee
on printing be authorized to invite proposals from all job printers and binders of the city for the publication of
one hundred copies of said compilation in substantial book form provided that the total cost of said publication
including copying indexing proof reading printing and binding shall not exceed one hundred and fifty 150
dollars

Mayors Valedictory
Gentlemen of the council we have now reached the close of the second year of our official association and
some of us are about to retire to give place to the gentlemen who have been selected to fil our respective
positions. Perhaps it may be of advanage to review the work done and the record made during this period
while at the same time we advert to some of the evils incident to our administration and suggest some of
the changes or amendments which might conduce to a less expensive government by fixing greater pesonal
responsibility on is official had and closely following well known economic rules
the result of our first year was highly satisfactory to may of us and to the people generally as far as I could
learn the year just closed has not been quite so satisfactory Although I am confident every member of the
council has tried to make it so and do what he believed best for the general welfare we have expended more
money than the year before with good and permanent improvements to show for every dollar it is true but still
in excess of the amount we should have expended if we wish to attain that result so closely allied to the prosperity
of our city The extinguishment of the public debt and meeting all current expenses from current revenue
without the necessity of borrowing but notwithstanding what I have said and the heavier expenditures for
improvements during the past year we have during the fiscal year above mentioned commencing March 1st
1884 done admirably well in the management of city finances and present a statementof which we may feel
proud for we have paid off and reduced 10,000 of the floating debt and over 15,000 of the bonded debt
making an actual total of 25,573.18 as I will show hereafter and this to without the slightest increase in the tax
levy but with a decrease in the assessment and receipts The large expenditure of which I speak was
occasioned almost entirely by the improvement of Main Street and the filling of the Bush and Cooley los
and payment of the Duffy and the Stange judgments The main street improvement cost the city 8264.47
not including work on cross streets the fifth ward engine house 4714.08 not including furniture second
ward engine house 8535.17 not including furniture Bush and Cooley los 1333.36 Duffy and Stange judgments
4826.99 The money expended on Main Street we are seeking to recover from the abutters and the cost of
filling the Bush and Cooley lots from the owners so that we may be reimbursed these amounts the Duffy
and Stange judgments were recovered the one for personal injury the other for damages by the motor both
before our time and they of course had to be paid

Now while the engine houses are among the finest structures of the kind in the west and every complete in
every appointment we could hve built two engine houses of sufficient capacity to answer the demands of the
service for many years to come at nearly one half the cost a least we could have saved 5,000 money thus
saved would swell the fund from which a floating debt could be liquidated
It is highly gratifying however gentlemen to know that while in disbursing and appropriating the public funds
we may not in all cases have done what was wisest and best there has not been during this whole period a
breath of intimidation so far as has come to my knowledge against the integrity or honor of my associates
in the council or against any official connected with the collection or disbursement of these large amounts
as public servants we must not expect much commendation for the good we do but rather anticipate with good
natured philosophy a vigorous censure for mistakes of judgment or for disappointments to individuals seeking
our favor it is quite excusable therefore to express our conscious satisfaction at such a record Why is it then
that while members of a council may all desire to administer the city government for the least possible
amount they find at the end of a given year that the expenses are greater than they expected or would have
been willing to make them at the commencement of the year This has been the experience of nearly every
council It is becasue there has been no anticipation of the annual revenue available for current expenses and
limitation of expenses with such revenue at the commencement of the fiscal year If at the commencement
of each year we had apportioned the revenue to the different funds from which we were required to expend
such as a salary fund fire department fund road fund police fund etc we would have known in advance the exact
amount we could have expended on account of salaries strets fire police etc and in having such amounts
definitely ascertained and constantly before us and beng pledged not to exceed them we could with certainty
save a given amount annually for the extingishment of the floating debt So fully am I impressed with the great
advantage of this system in its application to municipal expenses that I can but renew my recommendations
of one and two years ago upon this subject and would continue so to until adopted
Municipal expenditures
As I have stated above we never reach the close of a financial year perhaps without realizing that some items
of city expense have reached much in excess of what we have supposed they would be and of what we
would be willing to have made them at the commencement
There are several evils in our system which conspires to bring

About these results in the first place we come from different portions of the city which are clearly and distinctly
divided by artificial bounds called wards and our constituents in these several precints while they would
condemn any unnecessary expense in a general way have no condemnation to visit upon us if the expense
happens to be made in their particular neighborhood or ward but upon the contrary rather they encourage any
improvement or expenditure if it is going to be made in their vicinity this makes it embarrassing to the aldermen
representing any such ward for being chosen by the people of that ard to reflect their wishes they very naturally
feel that they are under obligations to favor a proposition petitioned for or supported by their constituents If
the consideration of ward or location could be entirely eliminated from all propositions before the council
and if the people would before petitioning for improvements and expenditures take into consideration the
question of the general necessity for the work many thousands of dollars might be saved
Perhaps there is not one of us who if he alone controlled and was responsible for all expensiture could not
carry on the city government for from 20,000 to 25,000 less per year than has been or will continue to be done
To reach then that management and close economy when acting in the aggregate that we would exercise if
acting as individuals is the great duty we owe to our fellow citizens
Appreciating the fact that an alderman is expected to act more for his ward than for the city at large has led
many people to fel that the mayor should be held more directly responsible for what might be considered improper
or unnecessary action of the city council than any other of its members in this I heartily concur provided as a
matter of law and fact he is responsible but in this city and all cities under special charter he has not the power
to veto any action nor even the right to vote except upon a tie being reached This should not be so the
mayor should be clothed with power to veto any action which did not meet his approval and then upon his
exercise of non exercise of this power should he answer to the people We have the strange anomoly of the
denial of the power to the mayors of cities under special charters while the mayors of all other cities in the state
of over 8000 inhabitants possess it it has proven a most salutory grant of power and I would most cordially
recommend that our senator and representatives in the next general assembly be requested to secure
the passage of an act conferring such power upon mayors of cities under special charters

This responsibility once fixed upon the mayor would command his closest attention to and examination of
all proposed action would require him to keep constntly advised of the public feeling while it would confer
that salutary restraing which should be reposed in the chief executive officer of any municipal government
We have however adopted some rules and regulations in reference to purchases and expenditures which
have saved us no inconsiderable sum of money notably among which is the order requiring all supplies for the
different city offices to be purchased through the recorder alone This has fixed the responsibility upon one officer
and he has exercised it with marked economy The incidental expenses of the different offices were less
those of the mayors office will not exceed five dollars per year
For several years past there has been heard frequent complaints that our streets have not been lighted on
some nights which appear almost as dark or as other nights when the lamps are lighted The gas company
is not required under its contract with the city to illuminate upon these particular nights for the contract is
that the lamps shall burn according to what is known as the philadelphia schedule of moonlight nights and when
the moon should shine no matter whether it does or not or how completely it may be eclipsed by the clouds
the gas need not burn It would be a good thing to change the conract in this respect and provide for gas light
on all nights in the year except those of unobscured moonlight while the lamps have been well attended and cleaned
during the past year it would still be well to have an ordinance fixing the intervals at which all lamps should
be cleaned and repaired and generally prescribing the duties of the lamplighter of ll the ordinances affecting
the condition of our street perhps tht requiring the removal of ice and snow from the sidewalks has been the
most difficult to enforce this proceeds partly from the fact that a failure to comply is punished by a fine with
no provision for collecting the expense of removal from adjoining owners An amendment in this respect
would secure the more efficient working of the ordinance

Notwithstanding we have not accomplished all we have had hoped to accomplish within the last two years
in the reduction of city debt we can still feel highly gratified and justly proud of what has been actully done
during that period

to have met the extraordinary expenses which were created by the new engine houses main street Bush and
Cooley lots and the Duffy and Stange judgments and at the same time reduce the debt over 25,000 and
expecially the floating over 10,000 should satisfy any reasonable peson that we have done something in
the direction of an economical management of our finance It mst be borne in mind that while our tax receipts
read that a one half mill was collected to pay the two judgments referred to above we did not in fact make
any levy of the half mill additional the levy was the same as that of 1883 Eleven mills the half mil was saved
from the expense and special interest fund and applied in discharge of these judgments
Not only is this true but our tax for last year was less than for the year before

Being less for 1884 1952.02
While this tax should have been increased by many thousands it was as you see reduced largely on account
of merchants reducing of stocks of goods in some cases as much as 10,000 the etotal decrease in tax
actually received for last year over the year before of 5775.71 and there was a decrease in the amount of
licenses of 2993.10 You will remember that for the year 1883 the marshal collected the highest amount for
license ever received by the city
Another matter upon which you are to be congratulated is the fact that we were able last year to carry on the
city and meet all obligations without borrowing as much money as the year before for while it was necessary
to borrow in 1883-4 the sum of 34307.25 in 1884-5 we only borrowed 18484 Of course the large balance
in the treasury at the end of our first year of 53763.59 helped us to this gratifying result
the expense of the fire department increased this year 4647.77 a heavy increase but occasioned largely
by the purchase of a new four wheeled hose cariage New swinging harness furniture and fixture and beds
and bedding for the new houses With these purchases all made there is no reason

Why there cannot hereafter be a generous reduction in the expenses of this department Excepting this
increase in the Fire Department and an increase of 1364.95 in the police expenses the aggregate has
been the same as the year previous some items of expense being very considerably reduced It was my
intention to submit a detailed tablulated statement of all our receipts and expenses during the last two
years but I find it would extend my remarks to so great a length that I must forego its presentation Although
I deem it the proper thing to do by persons going out of office as we do today
I would also have liked to present a review of the work done by the council during the past two years as to the
nature and character of ordinances passed and other legislation but am met by the same objection If it wold
not lead to invidious distinctions where none should be made I would be pleased to avail myself of this
opportunity to speak a truthful word of our different city officers but the people who have had business relations
with them know as well as I that they are faithful honest and competent public servants It has never been good
luck of the city to have better men filling the different offices within its gift
Before closing I wish to give some expression to my deep sense of obligation to my fellow citizens for twice
electing me to the honorable position from which I now retire I am not unmindful of the fact that the rule had been
to select for the office of mayor men older and of larger experience than I and therefore to have been elected
under such circumstances bears evidence of that confidence which is more highly prized than any other reward
I could receive By no act have I consciously forfeited the trust reposed either upon their part or as I am assured
upon the part of you gentlemen who have participated so intimately with me in the discharge of every official
duty
With many thanks to all the city officers for the uniform kindness and constant courtesy which I have ever
received and with the assurance that I shall ever bear in greatful remembrance the cordial and cheerful spirit
with which you have sustained me as your presiding officer be assured that I shall ever entertain the most
pleasing recollections of the two years passed and now with a wish that you extend to my successor a
gentleman in every worthy your confidence and regard the same sustaining hand which has so generously
supported me I yield the chair that he and the new council may be inducted into office

Gentlemen of the council having been selected by the voters of this city to preside over your honorable body and
in obedience to their choice I assemble here with you to inaugurate a new municipal government for the
ensuing year
Our city with its wealth of manufacturing and business interest its large factories with the myriad of revolving
pulleys whose ceasless whirl furnish employment to many thousand workmen its find business blocks magnificent
private residences miles of finely macadamized streets its railways and river commerce cause it to rank first
among the many prosperous cities of our rapidly rising state in wealth and manufacturers All of which can be
attributed to the generous liberality with which our citizens donated their money to build up and foster those
enterprises
Although our city is burdened with a large floating debt our citizens are striving hard to refund the same and
elevate our city to a higher rank than it occupies at present the great problem which our predecessors have
been trying to solve is how shall we liquidate this debt and there is but one way which I know of That is to practice
economy and bring our expenditures within our revenue without increasing the present rate of taxtion It is for
you gentlemen to say how we shall limit the expenditures for the ensuing year whether we shall set apart a
special amount for each department and bring its expenses within this amount thereby saving to the city and
its taxpayers a greater or less surpluss annually the same to be used in refunding our present large debt
I am fully satisfied that every member of this council enters upon the duties he is now called upon to perform
which is to foster the citys interests for the city and its tax payers alone irrespective of party politics treating
every man equally without recourse to his past doings as a citizen and to act as a representtive of the
whole people and general good of our city By so doing the partisan feeling which arises from an election
contest gradually wastes away and little by little we gain the confidence and good will of those who were
aggressive to us by making them feel that we are their servants bound to obey and not their masters By
doing this we gain their gratitude and earnest support in all our undertakings

Foremost among which are railroads to furnish cheap transportation for the products of our immense manufacturies
thus enabling them to compete with their more formidable eastern competitors thereby increasing their
capacity and number of employees we have now a good chance of having an east shore line connecting
our city with all the great north central states opening many new fields for our surplus productions to the west
of us the Chicago Milwaukee and St Paul Railroad extends her arms of steel silently awaiting the day when our
citizens will give it the necessary encouragement to enter and form another mighty connecting link between
this and our sister cities of the far west It is also rumored that in the near future another iron bridge will span the father
of waters at Eagle Point more formerly uniting us with our neighboring states with a little energy on the part
of our citizens it will also serve as a wagon bridge over which our Wisconsin and Illinois neighbors can dome
at all seasons of the year and find here a market for their valuable produce All of these things will do much to
increase the commercial and manufacturing interests of our city adding untold wealth to its populace
I will aval myself of the opportunity hereafter to make such suggestions and recommendations to your honorable
body as many require your mutual consideration Earnestly hoping that we may have a year of official intercourse
that will be gratifying to ourselves and all our constituents that the griendship that has arose between us during
our career as private citizens will be strengthened by our acts toward one another as public servants
Bcoming the successors of gentlemen who have been faithful an defficient officers in the respective positions
they have filled with valor and today turn over to use We extend to them our kindest wishes for their future welfare
as private citizens

Ald Crawford stated that a question had arisen as to the legality of the election of the marshal at the last
session and to settle the matter he moved that the council proceed to elect a marshal by ballot
After some discussion as to the merits of the case in point and the opinion of the city attorney being had on
on the matter Ald Crawfords motion prevailed and the council proceeded to elect a marshal by ballot
The mayor appointed Ald Ryder and Deckert tellers
The first ballot resulted in Mr Ed Moore receiving eight votes and F J Zugenbuehler one Mr Moore was declared
elected marshal for the term of one year
the marshal elect was called upon to select his deputy after qualifying before the mayor he made the following
recommendations stating that either one of the partys named would suit him Col John ONeill John Noell
M Blumenauer and P Hanlon were named
the council then proceeded to ballot for deputy marshal and the second ballot resulted in the election of Col
John ONeill he having received a majority of the votes cast on motion of Ald Kane the election was made
unanimous

Be it resolved by the ciyt council of the city of Dubuque that the city recorder be and is hereby instructed to
issue a venire to the city marshal to summon a jury in the case of the proposed vacation of a portion of Kniest
Street and to proceed in accordance with the ordinance on said subject the resolution was referred to the
street
Ald Deckert offered a resolution for the improvement of Nineteenth Street between White and Jackson
Streets the resolution was referred to teh street committee and engineer
Ald Hollnagel offered the following
Be it resolved by the city council that the city engineer be instructed to make a survey of the Bee Branch
from the bridge on Couler Ave to the Bluff on the property of John Heim and report to the council at its
next session the resolution was adopted

Ald Ryder called the attention of the council to the bad condition of one of the horses in the fourth street
engine house endangering the health of the other horses
After some discussion as to the proper parties to take action in the matter it was refered to the executive
committee of the Board of Health the physician and chief engineer
Ald Kane moved that the finance committee be instructed to examine the books and offices of the different
city officers
amended by Ald Hollnagel that two members be added to the committee one from each ward not represented
on the finance committee the motion as amended prevailed and the mayor apointed Ald Downer and Crawford
as such members
Ald Kane moved that a special committee of five be appointed to examine and find out the amount of license
unpaid and collectable if any and report to the council at its next regular meeting the motion prevailed and
the mayor appointed Ald Kane Downer Hollnagel JM Byrne and thos Byrne.

be paid on or before May First 1885
On motion the rules were suspended and Mr John Wunderlich president of the Personal Liberty Association
addressed the council in relation to the matter of saloon license asking for delay
Ald page moved that action on saloon license be postponed until the regular session in may
carried
Ald Olinger presented the specifications and proposals of the Gamewell Fire Alarm Telegraph Company
for the construction and putting in use their system of fire alarm Telegraph in this city which after beng read was
referred together with any other proposals relating to the same to the committee of the whole
Ald Hollnagel chairman on public grounds and buildings reported in favor of leasing a strip of ground 20 by
36 adjoining the Ice Harbor at the foot of First Street to Jms Keckwot after a rental of ten $10 per year in advance

heartfelt sympathy to his bereaved family in this their hour of affliction and that we fully realize that in his death
the city of dubuque has lost one whose voice and means were always employed in the development of our
city
resolved further that this resolution be spread upon the record of council proceedings of the city

that the city engineer an dcity attorney be instructed to attend the meeting of said committee and render
all assistance and information within their power the resolution was adopted
Ald Olinger stated that as some dissatisfaction had been expressed by some members of the council at the
price paid for horses by himself and other members of the committee he stated that he was now ready to take
the horses off the hands of the ciyt at the price he had paid for two horses 450.00
Ald Deckert moved that the proposition of Ald Olinger be accepted and the horses returned to him

ald ryder offered the following
Resolved by the city council of the City of Dubuque that the finance committee be instructed to borrow 3,000
to pay the current expenses of the past month the resolution was adopted
Ald Crawford offered the following
Resolved that the north and south boundaries of the ice harbor be established as follows to witt
the north boundary to be a line 200 feet south of an dparallel with the south side of third street extension
a strip 100 feet wide being reserved on th enorth side of said ice harbor for a levee along the entire north
front of the same
The south boundary of said ice harbor to be a line 110 feet north of and parallel with the south side of First
Street Extension the north 70 feet of the 110 feet of the south line of First Street to be reserved and used as
a levee slope
Also that the committee on ordinances be instructed to prepare an ordinance permanently establishing said
boundaries in conformity with this resolution the resolution was adopted and the city recorder instructed to
forward a copy to the goverment engineer
Ald Kane moved that Mr John Keckwot be given the proper notice to quit the premises now occupied by
him in the Ice Harbor and that his lease with the city be revoked the recorder to draw a warrant in his favor
for the rent paid the motion prevailed
Ald Kane offered the following
Whereas Death has entered the household of Ald A M Downer and robbed it of an oly son a youth who had
just stepped upon the threshold of manhood whose career though brief was replete with usefulness and
pregnant with the promise of a brilliant future who was idolized by his parents an whose many traits of
character commanded the esteem of all
Therefore be it resolved that in this his hour of profound grief the city council of Dubuque extends to Ald
Downer and his affected family its earnest sympathy and that as a mark of respect this body do now adjourn
Resolved further that a copy of this expression of condolence be sent to the family of Ald Downer and that
the resolution be spread upon the records and published in the city journals

Ald Hollnagel moved that the council attend the funeral of Charles Downer in a body and that the chair appoint
a committee of arrangements the motion prevailed and the mayor appointed Ald Olinger and J M Byrne
as such committee
