following resolution which was adopted Be it resolved by the city council that the city recorder draw loan warrants for the following amounts for money borrowed to pay the current expenses One warrant in favor of peter Blake for 1000 payable January 1st 1886 with interest at 8% per annum until paid One warrant in favor of P McCullough Executor for 1000 payable January 1st 1886 with interest at 8% per annum until paid One warrant in favor of jos Reinfried for 250.00 payable January 1st 86 with interest at 8% per annum until paid One warrant in favor of Emma Phillips for 600.00 payable January 1st 86 with interrest at 8% per annum until paid ald Ryder of the finance committee reported adverse to the petition of T O'Sullivan the committee was granted further time to report Ald Crawford of th eordinance committee read the ordinance governing sprinkling of streets for the first time and moved that the rules be suspended and the ordinance passed the motion was laid over ald Crawford of the same committee moved that the plat of the Ice Harbor as presented by the city engineer this day be approved carried Ald Page of teh police committee reported in favor of paying the bill of A R Staufenbeil 5.25 for police equipment carried Ald Hollnagel of the committee on public grounds and buildings reported in favor of the petiton of Peter Klauer asking permission to occupy a part of the first floor in the city hall providing he pay an additional insurance and ten dollars per month rent carried ald Hollnagel of the same committee in relation of the proposition of Carson Mcelrath for sprinkling the streets abutting public property moved that sealed bids be received for doing the same and the contract let to the lowest bidder adopted Ald Hollnagel of the same committee reported in chairman of the printing Committee offered a resolution regarding the payment of the Daily Herald for city printing Ald Kane offered an amendment by offering a resolution that the printing be divided Absent Ald J M Byrne Ald Kane moved that the preceeding resolution governing the city printing adopted at the last session be reconsidered This caused considerable discussion and ending with the with withdrawal of Ald Kanes motion Ald Kane made a motio to let city printing to the lowest bidder lost Considerable discussion followed the above motion several alderment taking part in the same Ald Downer moved that the printing be given to the paper that would do it the lowest and that the recorder be instructed to advertise for bids The ayes and nays were called on Ald Downers resolution Ayes aldermen Thos Byrne J M Byrne Crawford Downer Hollnagel Kane Olinger Page Ryder Nays Alderman Deckert the motion was carried 9 ayes 1 nay ald Hollnagel offered a resolution to allow the national demokrat 250.00 for the yearly printing as a German paper Ald Kane amended the motion of ald Hollnagel by giving the printing to German weekly bidding the lowest The ayes and nays were called on Ald committee offered the following resolution that the street commissioner be authorized and instructed to grade as much of the south side of Dodge St from Bluff St to Brad Street and thence on north side of Dodge St to Grandview Ave as is necessary to properly lay sidewalks on a temporary grade and that the city engineer give the proper street lines and the city marshal notify property ownes to Attorney adopted Ald Deckert of the street committee and city engineer reported in favor of the improvement of 19th street from white to jackson st adopted Ald Deckert offered the following resolution carried Ald ryder from commitee on Finance asked for further time to examine books of city treasurer granted Ald Crawford offered the following resolution be it resolved by the city council of the city of Dubuque that a sidewalk twelve feet wide of good two inch plank or of brick or stone be within thirty days from and after the adoption of this resolution constructed and laid in conformity with the ordinance in relation to sidewalks on the north side of third St between Clay street and Iowa Sreet and that teh city engineer be instructed to give the notice by publication required by the provisions of Sec 8 Chapter 26 of revised ordinances adopted Ald Crawford moved the following resolution Resolved that the plat of the Ice Harbor prepared by the City Engineer and this day submitted to city council showing the boundaries of said Ice Harbor and the levees reserved on the North West and South Sides of the same is hereby approved and adopted adopted Ald Crawford offered the following Resolved that the city marshal be instructed to open the extension of East St in West Dubuque for public travel and to remove all obstructions therefrom also that he be authorized to call on Ald Crawford asked that the Daily Times be made the official paper until another is appointed lost D J Linehan city Attorney reported as follows the petition of R W Stewart for clients to be received and filed Recommend the payment of bill of Jos Watry for witness fees 6.35 also that of B Chatfield for same cause 5.20 that the petition of Jacob Auer be received and filed that the petition of Magt and Washington Sts from 12th to 13th streets was referred to the city engineer to see if the majority of property owners had signed said petition the bill of wm Rebman for macadam used by the city amounting to 17.90 was on motion ordered paid Ald Ryder offered the following Resolved by the city council of the city of Dubuque that the city recorder be and is hereby instructed to draw warrants amounting to five 5.00 dollars each to pay the judges and clerks and the ownres of polling places at the last city election the resolut was adopted The petition of H B Glover and about two hundred others asking the council to order the extermination of the English Sparrows was referred to the committee of the whole the petition of John McCoy asking for the laying of a sidewalk on Hill Street from Third to Fifth Street to gather with a resolution ordering said sidewalk laid was referred to the committee on streets and city engineer The city engineer made the following report on the petition of Chas Luete et al to the honorable mayor and city council Gentlemen I find on examination that the majority of the property owners have signed the written petition who are abutters on said alley the report was adopted Ald Deckert offered the following REsolved by the city council of the city of Dubuque that the alley between Washington and Jackson streets from 12th to 13th street be graded and macadamized in conformity with the ordinance upon that subject That the city engineer be and is hereby directed to make the necessary plans and specifications for said improvement and the city recorder directed to give the proper notice for bids and proposals for the performance of the work the grading and macadamizing to be done at the expense of the owners of abutting property The improvement of Elm Street between 13 and 14th streets was referred to the com on sts The remonstrance of Margaret Rooney et al against the erection of a stone wall on the south side of Emmett Street was referred to the committee on streets The petition of City officers for the renovation of their offices in the city hall was referred to the committee on PG & Buildings The petition of Geo Salot for reduction of assessment was referred to the committee on delinquent tax The petition of John Flynn for permission to reduce the dimension of his frame barn was referred to the committee on fire with power the proposition of Robt McGivern to donate grounds to the city for the West Dubuque Scales was referred to the committee of the whole and city attorney the city engineer to make a survey of that portion of the street and ascertain if the scale is now on private property. The remonstrance of DG Scott Et al against the laying of a sidewalk on James Street was referred to the committee on streets The marshal reported on the petition of Kamman et al in relation to nuisance that he had examined the same and found the premises complained of in a clean and orderly condition the report was adopted the bill of F H Finke amounting to 15.00 for painting express and team numbers was ordered paid Ald Hollnagel offered the following resolved that the city engineer be instructed to survey and mark out by stakes or other suitable monuments to the north and south lines of the millville road from the west boundary of couler avenue to the west boundary of the city Resolved further that the city marshal be instructed after having notified all persons having fences or other obstructions on any portion of said Millville road to remove the same within ten days to proceed at once on the expiration of the time fixed in the notice to remove all such fences and Ryder full width of the same as shown by the records The resolution was adopted by a unanimous vote of the city council The bids of the daily times Telegraph Democrat and the German Weekly Paper the Iowa were opened and read and on motion referred to the committee of the whole Ald Page called the attention of the council to the contract with Geo W Burden for the gasoline lamps that such contract was about to expire the subject matter was refered to the committee of the whole Ald Olinger Chairman on Fire called the attention of the council to the bad condition of the wheels of the truck and stated that it was necessary to purchase new wheels he also stated that he thought it would be economy to purchase tools and employ a man permanently to do the repairs the subject matter was referred to the committee of the whole Ald Crawford moved that the committee on fire have power to purchase tools necessary to do the present repairs needed the motion prevailed Adjourned Attest J W Halpin Stout against the removal of obstruction on Jones St at his expense was read Moved that the marshal be instructed to notify the owners of said obstruction to remove the same within 30 days carried The remonstrance of market Master Rice against the peddling of vegetables etc about the city in violation of the ordinance was referred to the committee on markets and market master The rules were suspended and mr Chesley Taylor was premitted to address the council stating that unknown parties molested his workmen nightly and asked for protection The marshal as instructed to protect him carried ald Page of the police committee reported in favor of the petition to light Main Street with electric lights Ald Olinger amended by referring it back to the committee for a fuller report and that they adding the following additionnal conditions 6 The rights and priviliges conceded to the Dubuque and Northwestern Railway Company in the first section of this ordinance are granted upon the further express conditions that the city of Dubuque shall be constituted and permanently remain the terminus of the First Iowa Division of said railway for both freight and passenger business also that the machine shops for the repairs of the freight and passenger cars and locomotives used on said division shall be located within the corporate limits of the city of Dubuque In case of the failure or neglect of the said dubuque and northwestern Railway company or its successors to carry out in goof faith the above conditions or either of them this ordinance shall become absolutely null and void and the rights and privileges granted shall revert to the city of Dubuque 7 It is further expressly provided and made a condition of this ordinance that in case the said Dubuque and Northwestern Railway shall at any time hereafter pass into the possession on control of any railway company or corporation now operating its line of railroad in the city of Dubuque either by sale lease or judicial him on certai streets in booths addition and of the city taxes due on the lots in said addition respectfully submit the following report Gen Booth in his communication asks that the city council apply the amount of the city taxes due on the lots in his addition on the amount of the filling done by him on the streets and alleys in said addition the rates of compensation for such filling to be the same per cubic yard as the lowest price allowed and paid by the city to others for such work during the year 1884 the city engineer in his report to the council at its last regular session gives the quantity of filling done by Gen Booth on the streets in the addition up to May 29, 1885 Special Session July 6th 1885 Mayor Glab in the Chair Present Ald Thos Byrne Crawford Downer Hollnagel Kane and Page Absent Ald J M Byrne Deckert Olinger and Ryder as 11063 cubic yards not including the filling done north of Third Street by gravel train the taxes on the lots in the addition up to this time withoutinterest or penalty are 300 Gen Booth has no contract with the city and the filling he has done on the streets in the addition has been entirely volunary on his part As the property however has no value either for taxation or any other purpose except what has been given it by the improvements made by Gen Booth it would seem unjust to require him to pay taxes on it without allowing him for the filling of the streets on its original condition the property consisted of sloughs and islands subject to overflow until filled it was worthless The filling of the streets in the addition is as necessary in order to utilize the property as to fill the lots the improvements being made by Gen Booth are highly beneficial to the city in making valuable property out of what was previously worthless Your committee has been unable to agree upon a rate per yard to be allowed Gen Booth for the filling of the streets in his addition which we would recommend the council to adopt nor do we consider it absolutely necessary to do so at this time The quantity of filling already done as shown by the report of the Engineer at any price which might be fixed is far more than sufficient to pay the taxes due at this time on the property in the addition We would therefore recommend that in consideration of such filling the taxes on all the lots in Booths Addition due at this time be marked paid and cancelled and that the question of allowing compensation to Gen Booth for filling already done or to be done hereafter on the streets of his addition and the price to be paid be left for the city council of the city of Dubuque At the last regular session of the council a petition signed by et L Pizer and several hundred other citizens asking the city council to compel the enforcement of the state and municipal sabbath laws was referred to your committee on ordinances As instructions accompanied the reference your committee is not clear as to the object in referring the matter to the ordinance committee the city council has already several years ago adopted a very stringent ordinance providing for the observance of the sabbath It not only enacted the state law on the subject but added several additional provisions making it more comprehensive Nothing could possibly be added to it which would make it Regular Session September 7th 1885 Mayor Glab in the Chair Present Ald Thos Byrne J M Byrne Deckert Downer Hollnagel Kane Page and Ryder stronger We also find the ordinances of the city providing for the enforcement of all municipal laws and for punishing city officers who may neglect or refuse to perform their duties are sufficiently full and ample Under the ordinance relative to the refusal or neglect of any city officer to perform him duty any resident of Dubuque may prefer charges against such city officer in which case it is made the duty of the council to try the officer charged Section 3 provides that the complaint shall be in writing signed and sworn to by some resident of the city of Dubuque and directed to the city council that such complaint shall briefly set forth the name of the person charged the title of the office byhim held and the facts which constitute the grounds of the charge The ordinance further provides for the removal expulsion or other punishment on connection of the officer charged In the opinion of your committee no addition or amendment could be made to the ordinance on the subject which would give it greater force or effect Unless then some resident of the city of Dubuque shall present written charges under oath against the Mayor Marshal or other city officer of neglect or refusal to perform his duty the city council has done everything in its power under the city charter to secure the object of the petitioners viz the observance of the sabbath. It has passed a stringent ordinance providing for such observance and also provided for the punishment on conviction of any officer who may be guilty of neglect or refusal to do his duty under th eordinance whenever any citizen under oath shall prefer the charges It is the opinion of your committee that while the petition referred to us is signed by many intelligent and worthy citizens they greatly mistake the powers and duties of the city council. The council is purely a legislative body It may pass ordinances but has nothing to do with the enforcement of them except to try and punish officers neglecting or refusing to do their duty and then only when charges are properly presented Congress and the legislature may pass laws but no one not an idiot would think of densuring the members of those bodies because some of the laws they enacted were not enforced It is further the opinion of your committee that the signers of the petition may also be mistaken as to their own powers and duties as citizens if they or any considerable number of them really desire the enforcement of the laws and ordinances for the observance of the sabbath and know of any violations of them the mater is in their own hands Regular Session September 7th 1885 Mayor Glab in the Chair Present Ald Thos Byrne J M Byrne Deckert Downer Hollnagel Kane Page and Ryder All they have to do is to go before a justice of the peace and file their complaint The justice will cheerfully issue the warrants and the officers will be greatly pleased to serve the papers. the only way to enforce any law or ordinance is to punish those offending against it. The constitution of Iowa provides that no man shall be punished for crime except by due process of law Somebody who knows the law has been violated must first make a complaint under oath against the violation It is not the duty of an officer to do this more than any other citizen It is equally the duty of any citizen who has personal knowledge of the violation of the ordinance to make teh complaint If he fails to do so any charge against others of neglect of duty comes with a poor grace from him After a careful consideration of teh subject your committee respectfully reports that no new ordinance or amendments to existing ordinances are necessary or would tend to promote the object of the petitioners. As all the various city officers are required by the present ordinances to perform their duties faithfully and are likewise sworn to do so it would seem that any additional special instructions to that effect are uncalled and superfluous As no present actions of the council relative to the matter referred to in the petition is required we recommend that it be received and filed Respectfully from and look for it in their local newspapers printed in the German language and whereas ever since the city of Dubuqeu has had a corporate existence the publication of notices and advertisements of the city in some local paper printed in German has in the public interest and as a matter of justice and fairness towards a large proportion of our population been considered a necessity which necessity instead of decreasing increases with the growth of the city Therefore be it resolved that the publishers of newspapers in this city printed in German be requested to hand in propositions for doing the city printing during the ensuing year to the committee on printing on or before Sept 15th 1885 at 4 oclock said propositions to be accompanied by sworn statements regarding the bona fida laid out since the lots were sold at tax sale ald Kane moved the matter referred to the mayor and city auditor with power to redeem carried the city attorney reported on the petition of J N Hill that the property be redeemed if the city find the sale was irregular and to cancel the sale if found to be illegal ald Crawford moved that the mayor be authorized to have the property redeemed by the stated a new bridge was needed also that he thought it would be advisable to have a commtitee appointed to consult with the board of supervisors and try and secure the aid of the county in shall become delinquent adopted Ald Crawford moved that the city attorney draft an amendment to the same ordinance providing that the notice by the holder of a tax sale certificate for a tax deed relation to the measurement of wood At the last session of the council I was instructed to examine and report the defects in the ordinance in relation to the Regular Adjourned Session October 12th 1885 Mayor Glab in the Chair Present Ald T Byrne J Byrne Crawford Deckert Hollnagel Kane Olinger and Page measurement of wood On the face of the ordinance there appear to be no defects which can prevent the enforcement of any of its provisions this ordinance was enacted for the protection of purchasers of wood within the city and applies only to wood bought within the city limits and there offered for sale If purchased outside of the city limits an delivered within the city after sale there is nothing in the ordinance requiring the purchaser to have the wood inspected as otherwise provided by the ordinance th eordinance also exempts all wood sold or offered for slae outside of certain limits prescrived by Section 8 of the ordinance if offered for sale while loaded on any vehicle The woodmeasurer suggests the repeal of seciton 8 and the amendment of the ordinance so as to authorize the measurement by him of all wood brought within the city wherever purchased or offered for sale Whether these changes are desireable the council must first determine When an ordinance embracing these amendments will be necessary D J LInehan City Attorney Ald Kane moved the report be referred to the committee of the whole carried The city attorney presented the following report in regard to the petition of Magt Rawlins We respectfully report that mrs Rawlins has been assessed for 1.61 acres of minl lot 170 which includes the part covered by Delhi Road as shown the street has been traveled as shown for more than ten years There appears to be no legal claim by reason of the part
