Ald Doerfler chairman of the committee of the whole reported in favor of referring the petition of C H Meyer et al
for an extension of Elm street to Eagle Point ave to the ald of the Fifth of Third wards in connection with the mayor

and St Paul railroad co to retain their shops at Dubuque
City Attorney Michel read the deed conveying certain property to the C M and St Paul R R Co under certain
conditions

Ald Hayden moved that the mayor apoint a committee of Five councilmen with himself and five citizens to confer
with general manager miller in relation to the retaining of said shops carried

Ald Hayden moved that the city auditor be instructed to make corrections in his books in accordance with the above

Ald Trexler chairman of the ordinance committee presented an ordinance entitled an ordinance to provide for the
erection and maintenance of gates bars or viaducts or the stationing of guards at Railroad Crossings and moved it
be read by its title and put upon its final passage carried

City attonrey Michel read the following report of the committee appointed by the city council to visit Milwaukee with a
view of retaining the C M and St P shops in Dubuque which upon motion was adopted and ordered spread on the
minutes of this meeting
Your special committee appointed to confer with the manager of the chicago Milwaukee and St Paul a Milwaukee
Wis Beg leave to report as follows
That on Monday Dec 5 1887 they left according to previsions arrangements met Mr Rosewell Miller at the general
offices of the company and stated to Mr Miller that they had been sent by the city of Dubuque to enquire of him
whether or not the shops of the company were to be removed from Dubuque and if so what were the causes of
such a decision on the port of the management in reply Mr Miller stated that he would frankly talk the matter over with
the committee and in substance said that at no time had his company entertained anything but the best wishes
for the success and welfare of teh city of Dubuque that it was recognized as an important and growing business
center but that of late it had manifested an aggressive hostility toward the Milwaukee Road that in view of the fact
that the company had maintained its shops here and had done more for Dubuque than it had for

other cities which have always done well by the company he thought that the actions of our citizens and particularly
the Board of Trade in the switching matter and the bitter attacks of the newspapers after the Eagle point disaster for
which he insisted the company was not responsible was neither friendly fair nor just and in view of those facts he did
not think that the company could be expected to go out its way to favor Dubuque when other towns stood ready to make
good what expense the company might be at in locating its shops elsewhere and that under teh circumstances and
in view of the further fact that Dubuque ws not as conveniently located for their purpose as it might be the question of
removal had been considered but that as yet nothing was being done except the drawing of plans that as far as freight
and traffic were concerned they were willing as well as other roads to compete therefor but that they were not willing
and considered it unjust and outrageous to be compelled to have their terminal facilities manipulated for the profit
and advancement of rival roads and that while they were at all times ready and willing to switch cars of other companies
destined to non competition points they were not only not willing to switch those destined to competitive paints but
protested most emphatically against any attempt on the part of the citizens of Dubuque to compel them to do so that
the CM and St P R R was organized and maintained for pecuniary profits and to further that purpose they had spent
large sums of money in acquiring the means of obtaining and doing business and any attempt on teh part of any one
to confiscate their property to turn their own guns upon them would meet with teh most determined resistance on their
part all they wish and want is fair just and friendly treatment and taht they considered they had not received that these
matters grew out of the hostility did not exist was shown by the newspapers in the Eagle Point disaster that newspapers
are supposed to voice the sentiment of teh community where they are published and if the Industrial Leader and
some of the other papers which were almost equally as bitter correctly represented the feeling toward the company
it showed a condition of circumstances under which business could not flourish shops did not grow in such soil
such attacks tended to weaken the respect and obedience of the employees to the managemetn the demoralized
the service and undermined the loyalty of those upon whom the company must depend to have its work done properly
criticisms of course they expected but bitter assaults they did not that the construction of teh south west system
would necessarily largely increase their work and the number of hands employed in teh shops and while at
present he was unable to give a definite answer as to the removal nothing further would be done wtihout first
notifying the people of Dubuque

Your committee has simply to add that the importance of the shops to the city is a matter known to all and it would be
a serious misfortune to lose them through any misunderstanding between the city and the company especially when
there is no especial occasion for any animosity or misunderstanding we wuld ernestly recommend that all appearance
of bitter hostility which we sincerely believe does not exist be removed that in as much as the interests of the railroad
and the city are by no means hostile and do not necessarily clash that the appearance of unity be abandoned and
knowing the dependence of one upon the other that we work hand in hand with the company who we believe only wants
to be fairly treated and who from the interview we had with Mr Miller we are led to believe has no desire to remove the
shops provided that they are satisfied that the men they employ are not in the midst of a hostile community where those
employed are liable to be affected by the eprvading spirit and their efficienty thereby destroyed we would further
recommend that whatever differences now exist be amicably adjusted and think that unless the question is narrowed
down to the proposition that the switching cases be discontinued or settled satisfactorily to the company the removal
of the shops will follow that the beneficial results of a successful determination of the switching cases in the courts
would be but a trifling matter when compared to the importance of the retention of the shops in our city and that if the
best interests of the city are to be considered and if we are working for our advancement as a whole there can be
but one result aimed at We therefore recommend that all actions from which hostility can be assumed be removed and
that what ever differences non exist be amicably adjusted with the company if such and adjustment be possible

of prince Street between Eagle Point Ave and Sanford Street by city of Dubuque Contractor in front of and adjoining
the same a special tax be and is hereby levied on the several lots and parts of lots and parcels of real estate hereinafter
named situate and owned and for the several amounts set opposite each lot on parcel of real estate as follows

Upon motion rules were suspended and mr ONeil president of the Bronton Bridge Co allowed to address the council
Mr ONeil stated that the bridge co was willing to pay the expense of having the bridge examine by the expert engineer
if the city would pay for the filling doen on the west approach of same
Upon motion the proposition was accepted and teh city agreed to pay for said filling
report of C E Strobel expert engineer who examined said bridge was read as follows
To the hon mayor and city council of the city of Dubuque Gentlemen I have made a careful examination of the bridge
built by Horace E Horton for the Dubuque pontoon bridge company and have read the contract under which it was
built I find the bridge complete in accordance with the contract excepting the east approach where some changes from
the original plans have been made I am informed however by Mr B J ONeil president of the Dubuque pontoon bridge
co that these changes were made in compliance with orders given by his board and are covered by a supplemental
agreement entered into with teh contractor and taht this part of the structure is satisfactory to them I respectfully
recommend the acceptance of the bridge as completed under the contract

Strobel carried

ald Rand offered the following resolution Resolved by the city council of the city of Dubuque that a bounty of one half
cent per head be paid by the city of dubuque for all sparrows caught in traps or killed in any manner provided that
no unnecessary cruelty be practiced and that no poison of any kind be used all sparrows so caught or killed must
be delivered to the market master within twenty four hours afte being caught or killed the market master shall pay for
said sparrows according to teh above rate and keep a strict account of the number received and draw on the treasurer
for funds according to such account adopted by the following vote

ald Rand offered the following resolution Be it resolved by the city council of the city of Dubuque that the salary of

shall be in full for the services of said assessor that he shall attend all meetings when required of the assessment
committee or any other tax committee that he make lot books and place water tax as part of his duties and that he
deliver teh tax books complete in all respects for the compensation as above fixed

Ald trexler offered the following resolution which upon his motion was adopted be it resolved by the city council of
the city of Dubuque that teh water district will extend 1500 feet beyond the outside limit of water supply
Ald doerfler offered the following resolution which upon his motion was adopted Resolved by the city council of the city
of Dubuque that Elm Street be extended from 20th or Lake Street to Eagle Point Ave and that the city engineer
be and is hereby instructed to make the necessary survey and map there of showing the lands and lots and parcels
of real estate required for said street together with the names of the oweners thereof
Ald Trexler offered the following resolution which upon his motion was adopted Be it resolved by the city council of
the city of Dubuque that for the greater convenience and safety of the public the chicago milwaukee and st paul
railroad company and the minnesota and north western railroad company be and are hereby ordered to place and
maintain an flagman on Seventh Street between Washington and Pine Stretes at the point where said railroad
companies main lines cross said seventh street and that the city recorder cause the notice provided by ordinance
to be served upon said companies

The mayor stated that he had been urged by the property owners of teh 5th ward to call a meeting to take some action
toward keeping the OM and St Paul shops in Dubuque and he first wanted to ascertain the feeling of the council and
see whether the board of trade could not be induced to recind its resolution concerning the switching charges in
order that the shops might remain
Ald Mulkern presented the following resolution and moved its adoption
whereas the present atitude of the chicago milwaukee railroad company seems to be due principally to certain
switching charges suits bruoght against said company at the investigation of the board of trade of this city and whereas
the chicago milwaukee railroad company has made known its determination of removing its shops from this city
to some other point unless said switching charges suits are withdrawn and
where as the removal of said shops would be a great loss to Dubuque and would work much injury among the
employees as well as to the citizens in general therefore resolved that the board of trace be respectfully requested
to appoint a committee to confer with the attorney general and the railroad commissioners with a view of having said
switching cases dismissed as soon as possible
The resolution was adopted by a unanimous vote
Bill of m Pickley for lighting and care of gasoline street lamps for the month of Dec 1887 340.75 was read and on
motion of Ald Kleinschmidt he was allowed 250

Ald Parker moved that the mayor appoint a committee of three who with himself would constitute the delegation from
Dubuque the city to pay their actual expenses carried
city attorney Michel reported on the recommendation of city treasurer lange in relation to the F Heimbrucher est that
he be directed to settle on the terms he suggests a valuation of 4000.00 report adopted
He also reported having secured deeds from property owners of the amount of land needed for the opening of Elm
st
ald Trexler offered the following resolution
Be it resolved by the city council of the city of Dubuque that warrant be drawn for the necessary amounts for the opening
of Elm Street from 19th to Lake streets adopted by the following vote

Ald Parker moved that Blumenthal be exempt from paying that portion of his special assessment for the improvement

OConnell he had exhonerated them from all blame as he considered that they had only done their duty under the

Present Ald Byrne Doerfler Kenneally Meyer Mulkern Parker Rand and Trexler
Whereas there has been held in this city commencing on the 17th day of Jan 88 a convention composed of delegates
representing town and cities on the upper Mississippi River for the further improvement of the Mississippi River
between St Louis and St Paul this convention having been called by the mayor of the city and there being some
expenses attending thereto
Be it resolved by the city council of the city of Dubuque that a warrant for 200.00 be drawn in favor of the Mayor for
the purpose of paying the actual expenses of holding such convention none of the above funds to in any manner apply
on the cost of giving the banquet

made on patrol wagon that 1.50 was received as marshalls fee in city ordinances cases tried That 8.00 were received
for impounding animals report adopted and warrants ordered drawn to pay police
City Treasurer Lange reported cash on hand Feb 1 1888 80342.82 also that the books in the auditors office were
about 2300.00 when the present auditor took charge of the office and other irregularities which he would like the

Ald Hayden chairman of the finance committee reported the following amounts due city treasurer Refunded tax
Expense Fire Interest report adopted and warrants ordered drawn to pay city treasurer
Ald Trexler chairman of the ordinance committee read an ordinance entitled an ordinance to amend an ordinance
entitled an ordinance to establish and regulate markets and teh sale of meats etc and moved its adoption carried
Ald Trexler moved the rules be suspended the ordinance read by its title and placed upon its final passage carried
Recorder read the ordinance by its title after which it was adopted by the following vote

Ald Mulkern chairman of the committee on streets reported on teh special assessment for the improvement of
Washington street from 7th to 10th st as follows that in consideration of the fact that the city has made said improvement
by day work at a cost of 500.00 or 41% less than the lowest contract bid for said improvement your committee
would therefore recommend that the special assessment be reduced to teh actual cost for macadamizing said
street as follows

Ald Mulkern moved the report be adopted carried
Ald Byrne chairman of teh committee on public grounds and buildings recommended that Jos Stoltz be released
from paying any more money on the old thirteenth street engine house of said Stoltz removes the house and occupants
from said lots without further expense to the city within 40 days recommendation adopted
Ald doerfler chairman of the fire committee reported the expense of the fire committee in purchasing horses for
fire dept to be 103.70 the committee allowing themselves 500 per day for time spent
Ald Mulkern moved that the per diem claimed by the committee of 5.00 be reduced to 3.00 carried

Ald Kenneally reported in favor of adopting the report of the jury which condemned property in opening valley street

Ald Hayden moved that the platt of the proposed opening of valley street as prepared by the city engineer be approved
carried
Ald Mulkern moved that ald parker and the two ald of the first ward be appointed as a committee to waite upon mr
Randall for the purpose of getting the right of way for Valley Street ex as recommended by the jury who condemned
property for the opening of said street carried
Ald Meyer moved that the present wood measurer be appointed as Wharf master to receive the same salary as last
year the same to begin when navigation opens carried
Ald Kleinschmidt moved that one ald from the second and fifth wards be added to the delinquent tax committee carried
Ald Parker moved that the marshall be instructed to abate the nuisance on the east side of jackson Street between
8th and 9th street consisting of a frame shop carried
ald Parker moved that the recommendations of the chief of the fire dept to pay the minute men a fixed sum per month
be adopted and they be paid the sum of 12.50 per month carried
Ald Meyer moved that the council proceed to appoint three comissioners to assess damages to property holders

Ald Meyer moved that when we adjourn we do so to meet on the 21st day of Feb 88 at 7:30 pm carried
Ald Rand read an ordinance entitled an ordinance to amend an ordinance entitled an ordinance defining offences
and prescribing the punishment therefor and moved its adoption carried
Ald Rand moved the rules be suspended the ordinance read by its title and put upon its final passage carried

Resolutions
Ald kenneally offered the following resolution which upon his motion was adopted Resolved by the city council of the
city of Dubuque that a warrant be drawn in favor of Job Randall for 200.00 damages by the opening of Valley Street
as per platt drawn by the city engineer and that the city attorney be instructed to have the deed drawn for said property
and have same recorded
Ald Meyer offered the following resolution which upon his motion was adopted Be it resolved by the city council of
the city of Dubuque that the city recorder be and is hereby instructed to isseu a Venire to the city marshall and to
furnish him with the names of the owners of the property as furnished and returned by the city engineer of the proposed
extension of Division Street from Johnson Ave to Kniest Street commanding him to summon a jury of twelve free
holders citizens of Dubuque not directly interested to assess damages to said proposed extension
Ald Meyer offered the following resolution which upon his motion was adopted Resolved by the city council of the
city of Dubuque that a stone arch sewer be constructed on Seventh Ave in Hams add from the north line of Division
Street to the CM and St Paul R R Track and that the city engineer be and is hereby instructed to prepare the necessary
plans and specifications therefore
ald Kleinschmidt offered the following resolution which upon his motion was adopted Resolved by the city council
of the city of Dubuque that the bounty for killing sparrows be changed from one half cent to one cent a piece for
all sparrows killed within the limits of the city of Dubuque and delivered to the market master and that the city recorder
is hereby ordered to have a notice to this effect inserted in three different newspapers three times
Ald Kenneally offered the following resolutions which upon his motion was adopted be it resolved by the city council
of the city of Dubuque that Valley Street be made passable from Wilde Street to Southern Ave

Ald Hayden offered the following resolution which upon his motion was adopted be it resolved by the city council of
the city of Dubuque that the city treasurer be and is hereby ordered to publish in the daily papers a notice that all outstanding
loans of the floating indebtedness past due bearing 8 percent interest will after the end of the fiscal year Feb 29 1888
cease to bear interest unless presented to teh city treasurer for payment
Ald Hayden offered the following resolution which upon his motion was adopted
Whereas there are outstanding against the city loans bearing 8 percent interest which are past due and believing
it is to the best interest of the city that such loans should be cancelled and when needed replaced with warrants bearing
6% interest
Therefore be it resolved by the city council of the city of Dubuque that the city treasurer under the direction of the finance
committee be empowered to take up such loans with teh money we now have in teh city treasury for which we have
no immediate use
Ald Hayden offered the following resolution which upon his motion was adopted Be it resolved by the city council of
the city of Dubuque that under the direction of the mayor and marshall policemen be stationed at Third and Fourteenth
street at the intersection of bluff and Locust streets and on seventeenth street at the intersection of Clay Street and that
coasting be permitted on these streets under the supervision of said policemen between the house of one 1 pm and
6 pm of each saturday during the coasting season
Ald Rand offered the following resolution Resolved by the city council of the city of Dubuque that the city engineer be
and is hereby directed to make a survey and plat of a proposed new street running from West Locust to Seminary
street at a point on the line between Cox's add on the east and sub minl lot 93 and porterse add on the west
and adjoining and parallell with Seminary Street to Gold Street the western line of said proposed new street to be
parrallell with and fourteen feet west of the western line of Cox's add to a point forty feet south of the southern line
of Seminary street the starting point being at West Locust Streets thence timing and running parallell with Seminary
Street to Gold Street the said new street to be forty feet wide from West Locust to Almond Street and Thirty Five feet
wide from Almond Street to its junction with Seminary Street adopted by the following vote

Ald Mulkern offered the following resolution which upon his motion was adopted Be it resolved by the city council
of the city of Dubuque that the city recorder be and is hereby directed to issue a venire to the city marshall and to
furnish him with the names of the abutting property owners who object to the vacation of the alley lying southerly
from lot 46 Coriells add and northerly from lots 24 25 and 26 Coriells add and commanding him to summon a jury
of twelve free holders citizens of said city not interested in said matter to appear at a time and place therein stated
to assess the damages if any said objecting property owners may sustain by reason of the vacation of said alley
Ald Rand moved we proceed to ballot for an assistant city assessor
Ald Parker offered as an amendment that it be deferred until the adjourned session carried

Communication from Jacob Collins and Peter Nix in relation to damages done their property by teh grade of the
bridge over the M and NW track on Peru Road was read and it and the plat of the bridge as prepared by the city
engineer was referred to teh street committee city engineer and city attorney
There being objections made by property holders on Lake st to Peter Oeth as a member of the commission
appointed to assess damages on Lake street Jms Wunderlich was appointed in his stead
Ald Mulkern offered the following resolution which upon his motion was adopted Resolved that to pay for curbing
guttering and macadamizing Washington Street from 7th to 10th street by city of Dubuque contractor the special
assessment as amended by the city council Feb 6 1888 be levied
Rules were suspended and property owners on Elm Street were given permission to address the council Messers
meyer Baumgartner and Rhomberg spoke briefly in relation to the opening of said street

unanimous vote be it resolved by the city council of the city of Dubuque that the city recorder of the city of Dubuque
be and is hereby directed to issue a venire to the city marshall and to furnish him with the names of property as furnished
and returned by the city engineer commanding him to summon a jury of twelve free holders citizens of Dubuque not
directly interested to assess damages of said proposed extension of elm Street
Ald Meyer offered teh following resolution which upon his motion was adopted by a unanimous vote Resolved by the
city council of the city of Dubuque that Division street between Reed Street in mcCraneys Add and First Ave in Hams
add and the alley between Division and High Street from Reed Street to First Avenue be changes so as to run on a
direct or straignt line between said reed street and first avenue and that the city engineer be and is hereby instructed
to make the necessary survey and map showing said change
the finance committee to whom was referred the matter of having the books of the auditor and treasurer balanced
made the following report Your committee to whom was referred the communication of the city Treasurer would most
respectfully state that with the aid of the auditor and treasurer we examined the books of the auditor and herewith asubmit
a statemetn showing the errors which proved to be purely clerical the auditors books have been out of balance since
1885 the attached statemetn is offered as a part of our report and will locate the trouble we would recommend that
the treasurer and auditor be authorized to make the necessary corrections thereby bringing the books to a valance
report adopted
Ald Hayden offered the following resolution which upon his motion was adopted Be it resolved by the city council of
the city of Dubuque that the finance committee be and are hereby authorized to purchase at a cost not to exceed 100.00
a small safe of modern make for use in the city treasurers office
Ald Parker moved that we reconsider our action takers Fb 6 1888 in approving the plat of valley street as prepared
by the city eng carried
ald Kenneally offered the following resolution which upon his motion was adopted be it resolved by the city council
of teh city of Dubuque that Valley street be and is hereby declared open according to the plat on file in teh city engineers
office and the same is hereby declared a public highway in said city for public use and shall be known as valley
street
ald Parker moved that the balancd due wm Rebman for work done on West 5th street be paid Ald Parker agreeing
to insure the repair of gutters should the give away inside of 3 years carried
Ald Trexler offered the following resolution which upon his motion was adopted Be it resolved by the city council of
the city of Dubuque that the street commissioner be instructed to place

Ald Meyer offered the following resolution which upon his motion was adopted be it resolved by the city council of
the city of Dubuque that the city engineer be and is hereby instructed to make a plat and survey of the proposed
extension of Division Street showing the lands or lots through or over which the same is proposed to be made giving
the names of owners thereof and quantity of land proposed to be taken from Jackson Ave to Jackson Street
Ald Doerfler offered the following resolution which was adopted by a unanimous vote
Whereas It has pleased Almighty God to summon from earth in the ripeness of his years our honored friend and neighbor
Anton Heeb therefore be it resolved by the council of Dubuque that we have heard of his death with the deepest sorrow
and sincerely mourn with those who are nearer and dearer to him Resolved that as a member of this council in the
early history of our city representing the ward in which he lived so many useful years and died he faithfully performed
every duty and never betrayed a single trust and leaves behind on council recods and in fond memories lasting examples
worthy of the best efforts of any man Resolved that his death records the loss of a devoted husband an affectionate
father a trustworthy friend a public spirited liberal minded citizen and an honest man Resolved that as an additional
mark of respect to his memory these resolutions be spread upon the records and a copy of the same be forwarded
to the family of the deceased

the alley from the west side of lot 34 in block eleven 11 all in Dubuque Harbor Companys add also for the right of way

ald Mulkern moved that teh city engineer be instructed to measure all macadam broken for the city carried
Annual reports were read for the fiscal year ending Feb 29 1888 of the auditor treasurer marshall attorney city
attorney and chief of the fire departmetn showing the amounts of receipts and disbursements of the city finances the
cost of maintaining and operating the different departments under the city's control a statement of the legal cases
of which the in which the city is a party and the damgs of the of the police and fire department togther with a number
of recommendations from the chief officers for the consideration of the council during the present
On motion of Ald Mulkern the reports of the officer were referred to the finance committee for printing in book form
as soon as possible.

Resolved by the city council of the city of Dubuque that from and after this date the grading of the streets and alleys
where practable shall be done by the city by day work under the supervision of the street committee and city engineer
and that all bids by contractors for macadamizing paving and guttering shall be by the square yard
Ald Rand offered the following resolution which upon his motion was adopted Resolved by the city council of the city
of Dubuque that the city recorder be and is hereby instructed to issue a venire to the city marshall commanding him
to summon a jury according to ordinance to assess the damages to the property necessary to be taken for right of
way for the proposed new street leading from west locust street to seminary street and gold street at the west end of
Coxs add according to a plat furnished by the city engineer
Ald rand offered the following resolution which upon his motion was adopted
Resolved by the city council of the city of Dubuque that west seventeenth from Clark Street to Cox Street be brought
to its proper grade.
ald Trexler offered the following resolution be it resolved by the city council of the city of Dubuque that the city recorder
be instructed to draw a warrant for 210.00 in favor of the city marshall allowing 10% for more licenses collected than
his predessor Ald Mulkern moved that the resolution be laid on teh table lost by the following vote

Where as the city treasurer has called the attention of the council by tabulated statemetn which is presented herewith
to differences existing between the books of the auditor and treasurer which shows they have been out of balance
since 1874 to 1886 inclusive in amounts ranging from 2500 to 2000 therefore be it
Resolved by the city council of the city of dubuque that the mayor of treasurer be authorized to engage an expert
accountant to examine the books for the years named and to report to the council the result of such examination

the city of Dubuque that a globe gas lamp be placed on the cor of 18th and White st in front of Lutheran Church

the city council of the city of Dubuque that the street commissioner be instructed to arch 14th street sewer sewer from
Pine to Maple Streets
Ald Parker offered the following resolution which upon his motion was adopted Be it resolved by the city council of
the city of Dubuque that the city attorney in connection with the mayor be and is hereby directed and empowered to
settle the cases of Bolt vs City of dubuque Kringle vs city of dubuque and city of Dubuque vs Jm O"meara et al
and report their action in said cases to council

horses in the patrol house which disturb the rest of those living in adjoining houses
ald trexler moved that the repeater connected with the Gamewell Fire alarm system be purchased for 450.00
carried Health Physician Greene and City Engineer Evans reports were read and referred to the finance committee
for printing

premises to wit lots 203 4 5 and 9 east dubuque add to appear at the next regular session of the city council at which
session it is the intention of the council to pass a resolution ordering said lots to be filled up to prevent stagnant water
remaining thereon and show casue if any they have why said resolution should not be adopted

Ald Kleinschmidt offered the following resolution which upon his motion was adopted be it resolved by the city council
of the city of Dubuque that the street commissioner be and is hereby instructed to lay a stone crossing on the west
side of jackson and thirteenth street
Ald Mulkern offered the following resolution and moved its adoption Be it resolved by the city council of the city of
Dubuque that the city attorney be and is hereby instructed to procure deeds from the owners of lots 14 15 16 17 18
and 19 block 30 Dubuque harbor improvement cos add for so much of said lots as may be necessary for the proposed
extension of Fourth street said street to be 64 feet wide and to be paid for on the basis of 200.00 for a full lot and

city of dubuque that the street commissioner be and is hereby directed to remove the superstructure of the bridge
on Sixth street extension to fill to grade the space spanned thereby said work to be done under the supervision of

Ald Meyer offered the following resolution which upon his motion was adopted Be it resolved by the city council of the
city of Dubuque that the city engineer be and is hereby instructed to confer with the owners of property required for
the straightening of Division Street in Nicks add McCraneys add and Scotts 2nd add as shown on plats now on file
in the office of city engineer and have said property owners fix a price upon the property required for said street and
report at the next session of the city council

the city of Dubuque that a stone sewer be constructed four the north side of division street along seventh avenue
to the east side of C M and St P R R companys right of way under the supervision of the street committee and

ald Meyer offered the following resolution which upon his motion was adopted Whereas the bridge on the Peru Road
crossing the railroad is an injury to the adjoining property and not constructed under the direction of the committee
on streets as agreed by this council and the railroads attorney therefore be it resolved by the city council of the city of
Dubuque that said bridge be and is hereby declared a nuisance and the city marshall be instructed to cause the asme
to be removed within ten 10 days at said railroad companys expense
Ald meyer offered the following resolution which upon his motion was adopted be it resolved by the city council of the
city of dubuque that so much of the east side of Kniest street as is now occupied by Henry Millers house in the city
of Dubuque be and is hereby vacated Henry Miller to give in return so much of the west side of his lots as is necessary
for the improvement of Elm street extension
ald Trexler offered the following resolution which upon his motion was adopted be it resolved by the city council of
the city of Dubuque that the recorder be instructed to draw warrants for 2.00 each in favor of right of way juries on
Division and Foye St

and laid in conformity with the ordinance in relation to sidewalks on the north side of Rhomberg Ave between Couler
Ave and Railroad Track
Ald Meyer offered the following resolution which upon his motion was adopted Resolved by the city council of the
city of Dubuque that a sidewalk 4 feet wide of good two inch plank be within 10 days of this notice constructed
and laid in conformity with the ordinance in relation to sidewalks on the south side of Windsor Ave between Eagle
Point Ave and Lincoln Ave

constructed and laid in conformity with the ordinance in relation to sidewalks on the north side of west Eagle Point
Avenue between Couler Ave and Valeria Street
ald Kleinschmidt offered the following resolution which upon his motion was adopted by a unanimous vote Resolved by
the city council of the city of Dubuque that the alley between Elm and Pine and Thirteenth and Fourteenth Street be
graded and macadamized in conformity with teh ordinance upon that subject that the city engineer be and is hereby
directed to make the necessary plans and specifications for said improvement and the city recorder directed to give
the proper notice for and proposals for the performance of the work the grading and macadamizing to be done at the
expense of the owners of the abutting property
Ald Mulkern offered the following resolution which was adopted by a unanimous vote Resolved by the city council
of the city of dubuque that the approach to the High Bridge to the intersection with commercial street be graded
and macadamized in conformity with the ordinance upon that subject that the city engineer be and he is hereby directed
to make the necessary plans and specifications for said improvement and the city recorder directed to give
proper notice for bids and proposals for the performance of the work the macadamizing to be done at the expense
of the owners of abutting property
The time having arrived for the old council to give way the new Ald Trexler offered the following resolution which was
adopted by a unanimous vote
Whereas the terms of our worthy mayor and four aldermen have expired and they are about to surrender their official
positions and whereas the retiring mayor and aldermen have our hearty good wishes for their future prosperity
having while in office given their useful devotion to the welfare of the public good and in their retirement may they
have rest and satisfaction of knowing that they will ever hold a warm place in the memory of the members with whom
they have served to promote the best interests of our fair city therefore Resolved that we owe our sincere thanks to
Mayor Voelker Dubuques best mayor for his gentlemanly conduct toward the members of this council and also to
our retiring Brother

One year has quickly glided into irretrievable past and the time has arrived when I gladly relinquish the executive
helm of the municipal government into the hands of my successor the same power that placed me here has transferred
the mayorality to another the sovereign people so will it and no individual has no choice but obedience to the majority
so far as I am concerned personally I am rejoiced to be liberated from the duties of the office and I deliver the chief
stewardship of the city to my successor with pleasure only hoping that he may serve the public better than I ever have
during the course of my administration Dubuque has prospered as usual its growth has been steady sure and solid
Business has revived with increased trace greater profits and better demand for labor the great mass of toilers no
longer suffer for the conforts of life the city has been visited by no pestilence on teh contrary the public health has
been better than ever before the elements have been kindly and the people have not suffered from fire or flood
order has been well preserved and the laws have been obeyed as usual the noble work of educating the rising
generation has gone forward as in days past and will go forward in days to come There has been seed time and
harvest and the rains of heaven have decended on the just and unjust Charity goodness and religion have not died
out among men but have preserved their wanton reign in the hearts of the people The little storms of politics and
administration changes only ruffle the surface while the deeper vital forces of community remain unchanged HOwever
vigorous and steady may be the growth of a city However pleasant may be

its location however free from epidemic disease still it is not a disireable place of residence its property is heavily
mortgaged with a public debt if a large portion of every mans income is swallowed up by burdensome taxation Dubuque
has during all the past years of its existence well escaped the calamity of a great municipal debt few otehr citeis of its
size in the whole country have been so fortunate and I may be permitted to rejoice that during my administration
the small debt has not bee increased as in previous years but sensibly diminished The books of the city auditor show
that he debt one year ago was 833,542.85 and the books of the same faithful public officer show that the debt now is
822179.54 proving a decrease of 11372.31 I sincerely hope the decrease may continue during the administration
of my successor to be able to decrease the above amount in the face of a large subsidy fund which was voted by the
previous council namely 16500.00 to the High Bridge Company and 850.00 to the Eagle Point Ferry company and
considering that this was the most progressive council for the city I would state that they have added permanently
to the city the following property the Gamewell Fire Alarm Telegraph at a cost of 5450.00 and a patrol wagon horses
and harness at a cost of 1000.00 and have added five first class horses and harness to the fire department at a cost
of 1500.00 also 2000 feet of good fire hose at a cost of 2000.00 also built a viaduct and approach to High Bridge
at a cost of 3000.00 also our public building were repaired and put into first class shape at a cost of 1000.00 all the
above being necessary for the public good also the opening of Lake Street which cost 6372.00 and opening Elm
Street at a cost of 2725.00 and other extraordinary improvements at a cost of nearly 30000.00 and as a credit due this
council I would also state that doing our street work by day labor was a great success and saved to the tax payers a
large sum of money it is not necessary for an outgoing executive to dwell upon the workings of the older and established
departments of the city government I may say that the fire and police departments have maintained their high
reputation for discipline and effectiveness no important conflagration has destroyed the property of citizens during
the past year The criminal class has as usual given Dubuque wide berth the well trained firemen have always been
ready at the first tap of the bell either night or day to rush to the rescue of our homes or places of business from the
red hands of the fire fiends A fearless and watchful police force have guarded our persons and property both night
and day finally I must thank the city council for their part in maintaining the uniform courtesy and general harmony that h
have existed between us in all our official relations we may all of us have made mistakes but I trust the mistakes
have all been of the head and not of the heart We have sought in our several ways the good and prosperity of our
beloved city I know the

difficulties which beset the executive head of the municipal government too well to wish to throw any obstacles in the
way of the gentleman who is here to succeed me conflicting interests and aspirations personal ambition and party
prejudice hunger for office and greed for place must be encountered at every turn
My successor was born among you in this county and has been elevatedt o his present exalted position by the votes of
those with whom he has lived most of his days Coming from a foreign country to teh home of the free it has been my
good fortune to spend most of all my life in Dubuque and I love the city of my adoption as well as my successor loves
the city of his birth I have labored to the extent of knowledge and ability for the good of our beautiful city and I have
no doubt he will do the same Although we honestly differ in our politics yet we have a common citizenship and I tender
him my sincere congratulations my sympathy and my good wishes for a successful administration
Ald Hayden spoke briefly on surrendering his seat in the council to his successor Thanking the mayor and aldermen
for the kind and courteous treatmetn extended to him during his term of office and solicited a continuation of the same
to his successor stating that he was by nature of a quick temperment and at times in the heat of discussion had said
some things which he under other circumstances would probably have left unsaid and that if he had wounded the feelings
of any member of this council no one regretted it mroe keenly than he did himself
Mayor Burch then took the oath of office administered by Mayor Voelker who then swore in teh nely elected aldermen
they taking the seats vacated by the retiring aldermen

Gentlemen of the city council
I have now taken the oath of office as mayor of Dubuque with that oath I have taken a great deal of responsibility in
accepting teh responsibility I did it not for its honors whatever they may be thought to be nor for its emoluments as
you may well understand it was accepted upon considerations of duty to the people of the city and to those public
interests which attach to enlightened civilized society having in years past been twice chosen to the office I know
from experience that the year before me is not to be made up of holidays but of work care and diligence OUr city
has grown many thousands in population since I last oddupied this chair ten years ago but its growth in business
importance during that time has been in far greater rates than in numbers two lines of railroad of the first

importance have been added to our transporting facilities by means of which our commerce has been very much enlarged
in volumn and value our manufactories multiplied and stimulated and every branch of business strengthened and
made more secure it is only when we place the conditions of those times and these side by side that we are enabled
to realize what an important step forward our business interests have taken as a result It will help us all to a clearer
view of this if we but picture Dubuque without these roads by their introduction here the firld of our trade by direct
and close connections has been enlarged much more than we had ever before dared to hope and what is of hardly
less importance the fresh competition has soon for our mercantile and manufacturing concerns such reductions in freight
rates as to put our trade on an equality with the older and larger business centers in the mutual course of things this
doubling of our transportation facilities has had the effect to make a score of new stores and factories and the enlargement
of old ones a necessity along with these improvements have come new and increased employments for our people
new and larger uses for our capital brighter hopes and stronger confidence among all our people during these ten
years in fact only last year came the new highway bridge across the mississippi that great structure is a fit and enduring
monument to its projectors Yet I venture to say taht its energetic builders have less pride in it as a monument to their
enterprise than they have in the lasting gratitude of every citizen of Dubuque who is so much benefitted by it our street
railway also touched by these better times have replaced their old tracks with new and the best improved rails and
have very considerably and otherwise their lines indeed turn our eyes in whatever way we may our city shows very satisfactory
evidences of growth in population and in every departmetn of business enterprise and the city in its corporative character
is by no means unmarked by proofs of improvements though it must be confessed that much remains to be done and
this gentlemen of the council is your peculiar province to consider It is these steady steps forward in the race of
business life during the past few years that have educated our people to some extent in the art of carrying on their
local affairs upon business rather than party principals He who will explain how a people annually divided and excited
upon party lines in which the city as a corporate community neither has nor can have any interest will be better off
by such distractions than by united action upon a basis of business in which all are agreed has more wisdom than
I have it is impossible to explain this some of the party doctors to the contrary notwithstanding on party questions I may
be of one political faith and you of another but the people organized the city of Dubuque under the law as an arena
for the exhibition of partisanism If it should be insisted that our city government ought to be chosen upon party lines
I am very sure it will be a troublesom question to

answer why the council of this city is hardly the place for making party issues or for futile attempts at nourishing them
in fact it is laughably absurd when we think of it seriously As communities grow wiser by experience they are
gradually abandoning partisinism in local government and making their officers business instead of party agents We
see illustrations in many cities of the country which are coming more and more into the habit of chosing citizens peoples
or Union tickets I am persuaded that this motive prevailed in teh late election in this city and so far as the duties of the
mayor extend I shall take the people at their word and make business the watchword of the current city year and I am
very sure this council will cooperate with me on that line Here let me refer to one matter that is of first importance and
which we all know is uppermose in all minds the condition of teh city finances requires all the care and wisdom we can
command in the matter of expenditures Money should not be spent except upon clear necessities and the one thing
which the public expect at our hands and which they have a right to demand is economy this is due both to the people
as taxpayers and to ourselves as the official agents of its expenditure I have had no time to look in to the details of
our city affairs since the election of monday and am therefore not prepared to make any particular suggestions or recommendations
As the business of the council year proceeds we shall be able to see the needs of teh city as they develop and meet
them as our revenues justify and our wisdom guide It is quite probably that we shall have some important matters before
us for consideration during the year and when they appear you will find the mayor taking his just share of responsibility
for whatever action may be taken In doing the work in which we are engaged we mean to act honestly and faithfully
But whatever we may do we shall hardly expect to escape more or less criticism for this seems to be inseperable from
public action Yet it may not be amiss to say that much of public censure proceeds either from want of correct information
or from a spirit of inborn opposition found among a few in every community Whatever of ability I have shall arise and
the public may feel assured that whatever errors may occur will be chargable to mistaken judgement and not to wrong
intention I do not suppose the council will always be in agreement on all questions and such differences honestly
held show how important it is that a fair compromise shall work out the best results to the people The message of the
retiring mayor and the reports of the several city officers show the condition of the city finances the fire health police
and other departments these may be carefully examined with reference to the various questions therein treated

Before proceeding to the work of this opening session of the year I wish to express to the retiring mayor Mr Chris A
Voelker my high respect for him as a man and citizen and my sincere appreciation of his and devotion to the thankless
work he had had in hand during the year now closed and I wish this expression to include the retiring members of the
city council in our various settings here during the year I wish now to bespeak the aid and forbearance of every Alderman
in my position as presiding officer and now gentlemen of the council as we enter upon the discharge of our several
duties I beg leave to make two suggestions First that we do only what in good conscience ought to be done and second
that the manner of our doing it shall be such as to command the respect and confidence of the entire constituency
of the city of dubuque

ald rand offered the following resolution which upon his motion was adopted Be it resolved by the city council of the
city of Dubuque that all work of guttering curbing and macadamizing streets and alleys which has not yet been commenced
and excepting commercial street to the High Bridge and which work it has been heretofore resolved should be done
by the city that said work be abandoned by the city on such streets and alleys and that all such work be done by contract
labor after due advertisement excepting said commercial street and that the city recorder be and is hereby instructed
to advertise for bids for guttering curbing and macadamizing the following named streets according to the plans
and specifications on file in the office of the city engineer to wit
Seventh street from jackson to pine streets
Twelfth street from Jackson to pine street
Thirteenth street from Pine eastside to Maple Street
Eleventh Street from Washington to Pine Street
Seventeenth Street from Pine to Sycamore Street
Couler avenue from Sanford Street to Diagonal Street
ald Mulkern offered the following resolution which was referred to the committee on fire with the mayor to more thoroughly
investigate the advisibility of adopting the same Be it resolved by the city council of the city of Dubuque That the
committee on fire with the mayor be directed to contract with the gamewell fire alarm company for the erection and
placing of eleven 11 fire alarm boxes at the points selected by the special committee appointed for that purpose
and approved by the city council
Ald Trexler offered the following resolution which upon his motion was adopted Be it resolved by the city council of
the city of Dubuque that the owners of the following described premises be and is hereby ordered to fill said lots
18 inches above their present grade to prevent stagnant water from accumulating there on lots 203 204 205 and
209 East Dubuque add and that said filling be done and completed within 60 days after the service of notice or
passage of this resolution
Ald Trexler offered the following resolution which upon his motion was adopted Be it resolved by the city council of the
city of Dubuque that a sidewalk six feet wide of good two inch plank be within twenty days of this notice constructed
and laid in conformity with teh ordinance in relation to sidewalks on the west side of Jackson Street between fourteenth
street and Rhomberg Ave

giving an opportunity to all our citizens to read in their own papers all official proceedings and notices and whereas
the newspapers in any city can contribute in a large measure to their business and commercial prominence and
be active effort on their part serve the general public perhaps more than any other enterprise of a city and whereas
such new cities as well as old ones as are prosperous have live and well patronized papers that continue to keep
their great advantages before the public and
Whereas the practice of giving to a newspaper the city printing

on account of its politics has teh effect to deprive other papers of Public recognition and their readers and the public
of the news touching official proc eedings the publications of which is also a material advertisement of a city therefore
be it resolved by the city council of the city of Dubuque that the three daily papers viz the herald Telegraph and Time
be and are hereby appointed official papers for the ensuing year at a compensation of 500.00 each and that one German
paper also be appointed the german paper and its compensation to be disignated by the council and it shall be a
concidion of the appointment of each paper that no charge shall be made for extras but that the compensation herein
provided for shall cover the publication of all teh proceedings of the council right of way notices notices relating to streets
and alleys or cleaning or vacating same Mayors proclamations and all notices resolutions and other matters proceeding
in any way from the city or any of its officers excepting the delinquent tax list Ald Mulkern offered an amendment to Ald
Daniels resolution that the Independent be included carried

grade the property owners cannot be made to chagne it the question as to whether the sidewalk or the street as

Depot be changed to Jones and Main Streets and that the one at Julien Avenue and Walnut Street be placed at the
Diamond House

to the mayor and council of the city of Dubuque Iowa The Chicago St Paul and Kansas City Railway co shows to
your honorable body that on or about the 1st day of August 1887 the then Minnesota and Northwestern Railraod Co
were granted have by the city council of Dubuque to erect a high bridge over its tracks at the Peru road crossing on
a grade approach of 13' in 100 as appears in the plans then submitted to and approved by the council and that
afterwards said high bridge was constructed in accordance with said plans and by permission of the said city
council
That after the said bridge and approaches were completed the said city council were led to

approach thereto on a gradient of 6.60 in 100 and have asked the Chicago St Paul and Kansas City Railway Co
the successor of the Minnesota and Northwestern Railroad Co to change the grade from 13 in 100 to 6.60 in 100
and which the said chicago St Paul Kansas City Railway Co are willing to do after proper authority from said city
council shall be granted therefor
Wherefore in order to carry out teh wishes of teh city council of Dubuque the said Chicago St Paul and Kansas City
Railway co respectfully ask that authority be granted said Railway co to change said approaches to said high bridge
so that teh gradient will be 6.60 in 100 in accordance with the plan prepared by the city Engineer of the city of Dubuque
a copy of which is hereto annexed and made a part of this petition
Your petitioners will pay all damages found against the said city by reason of claims made by abutting property owners
by reason of the erection of said bridge and approaches and will maintain teh bridge in good repair the said railroad
to be duly notified of any claim or action made against teh city by reason of said bridge A copy of the bridge and gradient
thereto are hereto annexed the same being an exact copy of the new plan made by order of the city authorities and
approved
