Dear Mayor and City Council Members:
The City of Dubuque Zoning Advisory Commission has reviewed the above -cited
request. The application, staff report and related materials are attached for your review.

The applicant, Pat Norton with Buesing & Associates, spoke in favor of the request on
behalf of the property owner, Plaza 20, Inc. He stated that the plat is creating a lot with
no street frontage. He noted that the proposed plat contains a new Lot 1, and Lot 2 is
the remainder of the existing parcel. He explained that they are seeking a waiver of the
street frontage requirement for Lot 1 and Plaza 20, Inc. is separately coordinating with
the property owner for additional access easements through their property for the
proposed Lot 1.
Staff detailed the staff report, noting the submitted Plat of Survey of Plaza 20 No. 7
located at 2600 Dodge Street. They explained that this is a simple subdivision to carve
out Lot 1, which is approximately 0.3 acres. The lot has no street frontage, so it requires
a waiver of bulk standards. Staff noted it does include an access easement, which
satisfies the City's requirement, and the property owner is separately working to
establish additional access easements with the future tenant. Staff noted the existing
building located on a portion of the proposed Lot 1 would be demolished. Staff
mentioned that during the review of the proposed plat it came to light that the there was
an unresolved access easement requirement for Lot 1 of Plaza 20 No. 6 and staff has
included a recommended condition of approval to address this. Staff recommended
approval of the plat as submitted subject to waiving the street frontage requirement for
Lot 1 upon receipt of an approved and finalized access easement for the lot legally
described as Lot 1 of Plaza 20 No. 6 through the Plaza 20 Inc. property.
There were no public comments.

The Zoning Advisory Commission discussed the request, and recommended approval
of the Plat of Survey of Plaza 20 No.7 as submitted subject to waiving the street
frontage requirement for Lot 1 upon receipt of approved and finalized access
easement(s) for the lot legally described as Lot 1 of Plaza 20 No. 6 in the City of
Dubuque, Iowa through the Plaza 20 Inc. property.
Recommendation
By a vote of 4 to 0, the Zoning Advisory Commission recommends that the City Council
approve the request.
A simple majority vote is needed for the City Council to approve the request.

RESOLUTION NO. 294-22
A RESOLUTION APPROVING THE FINAL PLAT OF SURVEY OF PLAZA 20 NO. 7, IN
THE CITY OF DUBUQUE, DUBUQUE COUNTY, IOWA
Whereas, there has been filed with the City Clerk a Final Plat of Survey of Plaza
20 No. 7, in the City of Dubuque, Dubuque County, Iowa; and
Whereas, the intention of platting the property is to sell Lot 1 of Plaza 20 No. 7
within the City of Dubuque, from Plaza 20 Inc. of Dubuque, Iowa to RBS Real Estate,
LLC;and
Whereas, said Plat of Survey has been examined by the Zoning Advisory
Commission and its approval has been endorsed thereon; with the condition that a waiver
of the 50-foot street frontage requirement for Lot 1 of Plaza 20 No. 7 will only occur upon
receipt of approved and finalized access easement(s) for the lot legally described as Lot
1 of Plaza 20 No. 6 in the City of Dubuque, Iowa through the Plaza 20 Inc. property, within
the City of Dubuque, Iowa.; and
Whereas, said Plat of Survey has been examined by the City Council and they find
that it conforms to the statues and ordinances relating thereto; and
Whereas, the City Council concurs in the condition of approval established by the
Zoning Advisory Commission.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That Section 11-14 of Title 16 of the City of Dubuque Code of
Ordinances, Unified Development Code, is waived to allow 0 feet of frontage for Lot 1 of
Plaza 20 No. 7 on a public street or an approved private street.
Section 2. That the Plat of Survey Plaza 20 No. 7, in the City of Dubuque, Dubuque
County, Iowa is hereby conditionally approved, and the Mayor and City Clerk are hereby
authorized and directed to endorse the approval of the City of Dubuque, Iowa, upon said
Plat of Survey provided the Plaza 20 Inc. shall execute their written acceptance of the
condition hereto attached, acknowledging and agreeing:
(a) To provide an approved and finalized access easement(s) for the lot
legally described as Lot 1 of Plaza 20 No. 6 in the City of Dubuque,
Iowa through the Plaza 20 Inc. property, within the City of Dubuque,
Iowa.
Section 3. That in the event Plaza 20 Inc. fails to execute the Acceptance provided
for in Section 2 herein within forty-five (45) days after the date of this Resolution, the
provisions herein shall be null and void and the approval of the plat shall not be effective.

INTRODUCTION
The Plat of Survey of Plaza 20 No. 7 is located within the Plaza 20 commercial
development within the City of Dubuque. The Simple Subdivision' plat would create two
lots on the property, Lot 1 and Lot 2. Lot 1 would be an approximately 12,800 square foot
(.294 acre) lot located in the northeast section of the property. Lot 2 would be comprised
of the remaining portion of the property and would be approximately 25.175 acres in area.
Lot 2 will continue to have frontage along the public frontage road and Dodge Street. Lot
1 will not have frontage along a private or public street. Pursuant to the Unified
Development Code (UDC) Chapter 11-14, all lots shall have frontage along a public street
or an approved private street. Because Lot 1 will not have street frontage, the applicant
is requesting a waiver of this bulk regulation requirement. Access to Lot 1 would be
provided via an access easement extending from the southern boundary of Lot 1 to the
frontage road to the north.
DISCUSSION
The subject property is an approximately 25.5-acre parcel that is irregular in shape. The
property is improved with a commercial shopping center that consists of multiple buildings
and tenants. As part of a redevelopment plan for some portions of the property, the
property owners are seeking to create a new outlot development on the proposed Lot 1.
An existing detached building will be demolished in order to accommodate the proposed
Lot 1 (see Exhibit A attached). Lot 1 would be approximately .294-acres in area and
would be accessed via an access easement extending from the frontage road to the lot.
As proposed, Lot 1 would not have frontage along a platted private or public street and
therefore a waiver of the street frontage requirement is being requested.
During the staff review of the proposed Plat of Survey of Plaza 20 No. 7, an unresolved
access easement requirement for a Lot 1 of Plaza 20 No. 6 was discovered (see Exhibit
A attached). Pursuant to previous correspondence between the City of Dubuque and the
property owner, Plaza 20 Inc., the access easement(s) must be resolved before the City
can approve any new subdivisions within the Plaza 20 property. Consequently, staff has
included a recommended condition of approval requiring Plaza 20 Inc. to provide an
UDC Chapter 16-11-6 defines a Simple Subdivision as "Any subdivision or consolidation of property in
which no new streets, public or private, are proposed, which does not require the construction of any public
improvements, and which creates fewer than three lots."

approved and finalized access easement(s) for Lot 1 of Plaza 20 No. 6 through the Plaza
20 Inc. property prior to the release of the subject Plat of Survey Plaza 20 No. 7.
The UDC categorizes the proposed plat as a Simple Subdivision. The Zoning Advisory
Commission and City Council are the reviewing authorities for a Simple Subdivision that
requires a waiver of bulk regulations. The Zoning Advisory Commission shall review the
plat to determine whether it is in substantial conformance with the Unified Development
Code and shall consider the waiver of the street frontage requirement.
RECOMMENDATION
Planning staff requests that the Zoning Advisory Commission review the Plat of Survey
of Plaza 20 No. 7 and recommends approval as submitted subject to waiving the street
frontage requirement for Lot 1 upon receipt of approved and finalized access easement(s)
for the lot legally described as Lot 1 of Plaza 20 No. 6 in the City of Dubuque, Iowa through
the Plaza 20 Inc. property.
