Dear Mayor and City Council Members:
The City of Dubuque Zoning Advisory Commission has reviewed the above -cited
request. The application, staff report and related materials are attached for your review.
Discussion
The applicant spoke in favor of the request, stating that they hope to purchase this small
piece of land for expansion of their existing substation to upgrade and modernize
equipment and provide redundancy in the electrical distribution system.
Staff reviewed the staff report, noting the current land uses and properties of the Sam's
Club parcel and the Alliant Energy substation parcel. Staff reviewed the zoning history
of the area. Staff explained that even with the loss of the 20 parking stalls on the lot to
be subdivided, Sam's Club would have an excess of parking stalls according to Unified
Development Code requirements. Staff noted the principal permitted uses in the AG
Agriculture zoning district, which include utility substations.
There were no public comments.
The Zoning Advisory Commission discussed the request, and had no questions or
concerns.
Recommendation
By a vote of 5 to 0, the Zoning Advisory Commission recommends that the City Council
approve the request.
A simple majority vote is needed for the City Council to approve the request.

AN ORDINANCE AMENDING TITLE 16 OF THE CITY OF DUBUQUE CODE OF
ORDINANCES, UNIFIED DEVELOPMENT CODE, BY RECLASSIFYING HEREINAFTER
DESCRIBED AS A PORTION OF THE PROPERTY LOCATED AT 4400 ASBURY ROAD
FROM PC PLANNED COMMERCIAL DISTRICT TO AG AGRICULTURE DISTRICT
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That Title 16 of the City of Dubuque Code of Ordinances, Unified
Development Code, is hereby amended by reclassifying the hereinafter —described
property from PC Planned Commercial District to AG Agriculture District, to wit:
A portion of Lot 2 of Sam's Place in the City of Dubuque, Iowa as shown in
Exhibit A.
Section 2. That the foregoing amendment has heretofore been reviewed by the
Zoning Advisory Commission of the City of Dubuque, Iowa.
Section 3. This Ordinance shall take effect immediately upon publication
as provided by law.

Total Area: 0.52 acres out of a parcel that is 18.1 acres
Property History: The subject property is currently improved with a Sam's Club retail
development which was built in 2006. The property was rezoned from C-3 General
Commercial to PUD with PC Planned Commercial designation in 2005 to allow for the
Sam's Club development. Prior to that it was a farm field and zoned AG Agriculture.
Physical Characteristics: The subject property is an 18.1-acre parcel that is developed
with the 134,532-square foot Sam's Club store and gas station. Much of the site is paved
for parking, and there are currently 645 parking stalls. There are three access points —
one from a signalized intersection on Asbury Road, one from a right in -right out on the
Northwest Arterial, and one connecting to Plaza Drive. There is a stormwater detention
basin on the south part of the parcel and screening trees on the east edge.
Concurrence with Comprehensive Plan: The Comprehensive Plan goals promote infill
and adequate public utilities to meet the community's needs. The goals also recommend
buffering non -compatible uses from each other. The City's Future Land Use Plan
identifies this area as Commercial.

Impact of Request on:
Utilities: The request is being made to allow for an electric substation use by the
applicant, Interstate Power and Light Company, to be able to improve or expand their
provision of electric service to their customers. The proposed rezoning will not impact any
other utilities in the area.
Traffic Patterns/Counts: The Iowa Department of Transportation classifies Asbury Road
as a minor arterial, and a traffic count at this location in 2017 showed Average Annual
Daily Traffic of 17,100 vehicles. The Northwest Arterial is classified as a principal arterial,
and a traffic count at this location in 2020 showed Average Annual Daily Traffic of 12,600
vehicles. The amount of traffic generated by the proposed change in use should be
minimal, limited to a few utility service vehicles.
Public Services: Public services are adequate to serve the site as it is proposed to be
used.
Environment: The proposed rezoning should have a marginal impact on the
environment. The rezoning would allow the substation to expand to the east, but the
existing 20-stall parking lot here would remain. Changes to the property would go through
the site plan review process. Site plans are reviewed by all relevant departments
regarding access, parking, screening, paving, stormwater management, water
connection, sanitary sewer connection, and fire safety. Effects on the environment would
be mitigated or controlled through appropriate site development.
Adjacent Properties: Directly to the west of the area to be rezoned is an existing electric
power substation owned by the Interstate Power and Light Company. To the north, east,
and south of the area is the Sam's Club parcel.
CIP Investments: None proposed.
Staff Analysis: The applicant proposes to rezone a portion of the Sam's Club property
from PC Planned Commercial to AG Agriculture. The current parcel is 18.1 acres. The
portion to be rezoned is 0.52 acres in area and would be subdivided from the existing
parcel and consolidated with the existing substation site through a simple subdivision plat
which would be reviewed by the City Planner. This will bring the Interstate Power and
Light parcel to 1.864 acres. The Sam's Club property improvements which include a
134,532-square foot retail store, a gas station, 645 parking stalls, private streets, drive
aisles, and a detention basin, would remain unaffected by the rezoning. This is a mixed -
use area with commercial, institutional, residential, and public utility uses in the vicinity.
The Sam's Club structure was built in 2006. It was rezoned from C-3 General Commercial
to PUD with PC Planned Commercial designation in 2005. Prior to that it was a farm field
and zoned AG Agriculture. The portion of land to be rezoned will be consolidated with the

existing electric power substation that is zoned AG, which permits the use of public utility,
including substation.
The portion of land to be rezoned will allow for expansion and improvement of the existing
electric power substation. The site plan shows the existing 20-stall parking lot on the site
will remain, though they will no longer be the property of Sam's Club.
With the removal of the 20 parking stalls, Sam's Club will have 625 parking stalls
remaining. The parking requirement for retail sales and service land uses is to provide
one stall for every 250 square feet of floor area accessible to the general public. The total
floor area of Sam's Club is 134,532 square feet, though not all that space is accessible
to the public. Using that total area, however, Sam's Club would be required to provide
539 parking stalls, so they will retain an excess of parking stalls required for compliance.
The AG Agriculture district allows the following principal permitted uses:
1. Farming and agriculture, including the raising of field crops and livestock,
horticulture, forestry, animal husbandry, and similar farming activities.
2. Noncommercial nursery.
3. Railroad or public or quasi -public utility, including substation.
Staff recommends the Commission review the criteria established in Chapter 9 of the
Unified Development Code regarding granting a rezoning.

reclassifying the hereinafterdescribed property from PC
