Sunnycrest Manor is a long-term care facility supported by the citizens of Dubuque County that serves residents with financial need who require the assistance of a nursing facility, skilled care, or disability care. Improved fiber connectivity has been a priority for the facility. However, while its location on the bluffs overlooking the Mississippi is beautiful, it has also been cost prohibitive for providing a direct fiber connection. Recent additions to the City conduit network, achieved through public/private collaborations, have now made it possible to create a low-cost direct fiber link between the County Offices at the Courthouse to Sunnycrest Manor. City proposes to license conduit and fiber to the County for $1.50 per linear foot for 19,805 linear feet for a period of five years. County would provide its payment of $29,707.50 up front. The City would be receiving $29,707.50 for providing access to presently unused fiber capacity. BACKGROUND In 2016 the City of Dubuque undertook its Broadband Acceleration Initiative. The Initiative focuses on public/private collaborations and includes a comprehensive strategy to reduce the cost and time required for broadband expansions in Dubuque. One effort within that strategy is the use of "Master Agreements", where an overall legal, structural, and financial relationship is established between the City and broadband providers or partners and approved by City Council. Project Statements carried out pursuant to that Master Agreement can then be quickly considered and approved. In 2021 City of Dubuque and Dubuque County entered into a Master Co -location and Shared Services Agreement to accelerate the deployment of new broadband capacity to improve public services throughout the region. This amendment represents the first project collaboration under that Master Agreement. Since 2019 County and City staff have been discussing this need and working to find a way to bring costs down. Recent additions to the City conduit network, achieved through public/private collaborations, have now made it possible to create a low-cost direct fiber link between the County Offices at the Courthouse to Sunnycrest Manor. City proposes to license conduit and fiber to the County for $1.50 dollars per linear foot for 19,805 linear feet for a period of five years. County would provide its payment of $29,707.50 up front. BUDGETIMPACT There is no negative budgetary impact to the approval of the proposed amendment. The City would be receiving $29,707.50 for providing access to presently unused fiber capacity. The County would be receiving a much lower cost for needed services than otherwise available. RECOMMENDATION AND ACTION REQUESTED This amendment to the existing Master Co -location and Shared Services Agreement with the County supports the City's broadband acceleration initiative and reduces overall costs to City and County taxpayers. We would respectfully request your approval and recommendation to City Council. Cc: Crenna Brumwell, City Attorney Barry Lindahl, Senior Counsel Steve Brown, Project Engineer Amendment to Master Co -location and Shared Services Agreement between Dubuque County and City of Dubuque Pursuant to the Master Co -locations and Shared Services Agreement between City of Dubuque (City) and Dubuque County (County) effectively dated May 10th , 2021 and attached hereto, the Parties hereby agree to the following PROJECT STATEMENT: Narrative description of co -location and service sharing: - City will license to County access to and use of certain presently unused fiber, further defined in Exhibit A attached hereto, for purposes of providing broadband communication services and support to County facilities, including Sunny Crest Manor. Co -location or service site: The co -location and/or service site for this PROJECT STATEMENT is generally described as below and as further shown in Exhibit A: - 19,805 linear feet of twelve strand (six pair) fiber optic cable running from the Dubuque Law Enforcement Center to the vault located at Jansen Street and the NE corner of Sunny Crest Manor. - County will jet City supplied fiber to run from the Dubuque Law Enforcement Center to the vault at the NW corner of Central Avenue and 9t" Street and from the vault at the SE corner of Hawthorne Street and Rhomberg Avenue to the vault at NE corner of Sunny Crest Manor. - County will be responsible for fiber terminations at the Dubuque Law Enforcement Center and Sunny Crest Manor as well as 12 fiber splices at the following vaults: > Central Avenue and West 9t" Street > Elm Street and West 11t" Street > Hawthorne Street and Rhomberg Avenue Charges and Payment Terms: - County will pay to City on the start date $29,707.50 ($1.50 per linear foot x 19,805 linear feet) Term of Project: This license is for a term of five (5) years and the start date for the project is December 1, 2022 unless a later start date is mutually agreed to by the Parties. County may extend the license for an additional 5 year term at the same price of $1.50 per linear foot. County must provide notice to City of its intention to extend at least 30 days prior to the termination of this agreement.
