City Engineer Gus Psihoyos is recommending City Council authorize the public bidding
process for the Upper Bee Branch Creek Restoration Railroad Sanitary Interceptor
Crossing Project (part of Phase IV of the Bee Branch Watershed Flood Mitigation
Project) setting a public hearing for November 21, 2022 and preliminarily approving the
proposed plans, specifications, form of contract, and construction estimate in the
amount of $3,203,300 authorizing the City Engineer to advertise for bids for the Upper
Bee Branch Creek Restoration Railroad Sanitary Interceptor Crossing Project.
The Project consists of the construction of trenchless installation of one 48-inch
diameter steel casing across the railroad property that will house a 36-inch diameter
sanitary sewer, a reinforced concrete transition structure, restoration of Garfield Avenue
(concrete curb and gutter, asphalt pavement, and sidewalk), fiber optic lines, vegetative
surface restoration, and other miscellaneous elements.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

INTRODUCTION

The purpose of this memo is to seek authorization to initiate the public bidding process for
the Upper Bee Branch Creek Restoration Railroad Sanitary Interceptor Crossing Project
(part of Phase IV of the Bee Branch Watershed Flood Mitigation Project).
BACKGROUND
In November of 2013, the City Council passed Resolution 335-13 adopting the 2013
Drainage Basin Master Plan Amendment that outlined several improvements throughout
the Bee Branch watershed to mitigate the effects of future flooding and disasters.
Collectively, the improvements form the basis of the multi -phase Bee Branch Watershed
Flood Mitigation Project outlined below.

' Bids for the project were rejected in June of 2022 with the low bid at more than 50% (almost $9 million) over the
engineer's estimate and City budget. Currently exploring re-design/funding options
2 80 of the 240 alleys have been reconstructed as "green", pervious alleys. Several are currently under design.

DISCUSSION
The improvements associated with the Upper Bee Branch Creek Restoration Railroad
Sanitary Interceptor Crossing Project (Project) involves the installation of a 36-inch
diameter sanitary sewer under the railroad tracks, providing a connection between the
sewer system constructed as part of the Upper Bee Branch Creek Restoration Project with
the sewer system installed with the Lower Bee Branch Creek Restoration Project.
Until the sewer system through the railroad property could be installed, a temporary siphon
was installed as part of the Upper Bee Branch Creek Restoration Project improvements
included a temporary siphon to force wastewater flow under the restored creek, allowing
the wastewater to flow west along Garfield Avenue, then south down Elm Street, and to
the Cedar Street Lift Station. Siphons require significant maintenance challenges and as
the flow characteristics necessarily back up wastewater flows which can lead to the
accumulation of solids within the line upstream of the siphon. Installation of the proposed
sewer through the railroad property will allow for the elimination of the siphon, providing a
more hydraulically efficient system that will not be prone to the accumulation of solids or
require frequent, intensive maintenance.
The improvements associated with the Project were previously designed and bid as an
alternate to the Upper Bee Branch Railroad Culverts Project. With the base bid coming in
slightly over the engineering estimate, the City was not in a position to fund the sanitary
sewer improvements at that time.
Specifically, the Project consists of the construction of trenchless installation of one 48-
inch diameter steel casing across the railroad property that will house a 36-inch diameter
sanitary sewer, a reinforced concrete transition structure, restoration of Garfield Avenue
(concrete curb and gutter, asphalt pavement, and sidewalk), fiber optic lines, vegetative
surface restoration, and other miscellaneous elements.

RECOMMENDATION
I recommend preliminary approval of the proposed plans, specifications, form of contract,
and construction estimate for the Upper Bee Branch Creek Restoration Railroad Sanitary
Interceptor Crossing Project. I further recommend establishing the date of a public hearing
and authorization to advertise for bids for the Project.
BUDGET IMPACT
The estimate of probable costs for the Project is as follows:

The Project is to be funded through a FY22/23 appropriation in the amount of $386,300 for
engineering and design (CIP#3402769) and an FY23 appropriation in the amount of

AND ESTIMATED COST; SETTING DATE OF PUBLIC HEARING ON PLANS,
SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATED COST; AND
ORDERING THE ADVERTISEMENT FOR BIDS FOR THE UPPER BEE BRANCH
CREEK RESTORATION RAILROAD SANITARY INTERCEPTOR CROSSING
PROJECT
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. The proposed plans, specifications, form of contract and estimated cost
for the Upper Bee Branch Creek Restoration Railroad Sanitary Interceptor Crossing
Project in the estimated amount $3,203,300.00, are hereby preliminarily approved and
ordered filed in the office of the City Clerk for public inspection.
Section 2. A public hearing will be held on the 21 st day of November, 2022, at 6:30
p.m. in the Historic Federal Building Council Chambers, 350 W. 6th Street, Dubuque,
Iowa, at which time interested persons may appear and be heard for or against the
proposed plans and specifications, form of contract and estimated cost of said Project,
and the City Clerk be and is hereby directed to cause the attached notice of the time and
place of such hearing to be published in a newspaper having general circulation in the
City of Dubuque, Iowa, which notice shall be published not less than four days nor more
than twenty days prior to the date of such hearing. At the hearing, any interested person
may appear and file objections to the proposed plans, specifications, form of contract, or
estimated cost of the Project.
Section 3. The Upper Bee Branch Creek Restoration Railroad Sanitary Interceptor
Crossing Project is hereby ordered to be advertised for bids for construction.
Section 4. The amount of the security to accompany each bid shall be in an amount
which shall conform to the provisions of the Notice to Bidders hereby approved.
Section 5. The City Engineer is hereby directed to advertise for bids for the
construction of the improvements herein provided, by publishing the Notice to Bidders to
be published on the City of Dubuque website and a contractor plan room service with
statewide circulation, which notice shall be published not less than thirteen but not more
than forty-five days before the date for filing bids before 2:00 p.m. on the 8th day of
December 2022. Bids shall be opened and read by the City Clerk at said time and will be
submitted to the City Council for final action at 6:30 p.m. on the 19th day of December
2022, in the Historic Federal Building Council Chambers (and/or by virtual means) 350
West 6th Street, Dubuque, Iowa.

NOTICE IS HEREBY GIVEN: The City Council of the City of Dubuque, Iowa will
hold a public hearing on the proposed plans, specifications, form of contract and
estimated cost for the Upper Bee Branch Creek Restoration Railroad Sanitary Interceptor
Crossing Project, in accordance with the provisions of Chapter 26, Code of Iowa, at 6:30
p.m., on the 21St day of November 2022, in the Historic Federal Building Council
Chambers (and/or by virtual means), 350 West 61" Street, Dubuque, Iowa. Said proposed
plans, specifications, form of contract and estimated cost are now on file in the office of
the City Engineer. At said hearing any interested person may appear and file objections
thereto.
