received no money on his notes since the date of settlement
in the aggregate are less than what the notes called for
precedent is to be established that a final settlement made by one Council is to be treated as naught by a succeeding Council, no one can with certainty settle with the city at any time
It is true that the loan was originally made at a higher rate than the law allowed, but we must presume that the officals then controlling the City were acting in good faith, and for what their judgement in their judgement was to the best interest for the City when they borrowed the money
