The Dubuque City Council met in special session at 5:30 p.m. on November 7, 2022, in the
second-floor Council Chambers of the Historic Federal Building, 350 W. 6 th Street.
Present: Mayor Cavanagh; Council Members Farber, Jones, Resnick, Roussell, Sprank,
Wethal; City Manager Van Milligen (arrived at 5:34 p.m.), City Attorney Brumwell.
Mayor Cavanagh read the call and stated this is a special session of the City Co uncil called
for the purpose of conducting a work session o n the housing choice voucher program.
WORK SESSION
UPDATE ON HOUSING CHOICE VOUCHER PROGRAM
Housing and Community Development Director Alexis Steger presented on the Housing
Choice Voucher Program, updates on acceptance rates, decrease in utilization, and other pro-
grams offered under the Rental Assistance Division of the Housing and Community Develop-
ment Department. Ms. Steger responded to questions from the City Council regarding voucher
holders who move outside city limits, reasons landlords may not accept vouchers, and the lottery
process for awarding vouchers. Ms. Steger and City Attorney Brumwell responded to a question
regarding voucher and marketing options for senior residents.
There being no further business, Mayor Cavanagh declared the meeting adjourned at 6:26
p.m.

Mayor Cavanagh read the call and stated this is a regular session of the City Council called
for the purpose of conducting such business that may properly come before the City Council.
PLEDGE OF ALLEGIANCE
City Attorney Brumwell announced that Action Item No. 1’s suggested disposition was
amended to “receive and file” as neither state nor city code grants City Council the authority to
approve preliminary plats.
PRESENTATION(S)
1. 2022 Woman of the Year Award Recognition: Amy Gilligan, Executive Editor of the Tele-
graph Herald, recognized Director of Strategic Partnerships Teri Hawks Goodmann as the
2022 Woman of the Year as part of the Telegraph Herald, BizTimes.biz, and Her Maga-
zine's annual Salute to Women Awards.
2. Mississippi River Cities and Towns Initiative Founders Award Recognition: Colin Wel-
lenkamp, Executive Director of the Mississippi River Cities & Towns Initiative (MRCTI) virtually
recognized Director of Strategic Partnerships Teri Hawks Goodmann for receiving MRCTI's
Founders Award.
PROCLAMATION(S)
1. Hospice Month (November 2022) was accepted by Lavonne Noel on behalf of Hospice of
Dubuque.
2. Pancreatic Cancer Awareness Day (November 17, 2022) was accepted by Diane Oglesby-
Rambousek on behalf of the Michael W. Oglesby Foundation.
3. Small Business Saturday (November 26, 2022) was accepted by Ryan Sempf on behalf of
the Dubuque Area Chamber of Commerce.

3. Disposition of Claims: City Attorney advised that the following claims have been referred
to Public Entity Risk Services of Iowa, the agent for the Iowa Communities Assurance Pool:
Connie Gosche for vehicle damage; Debra Heim for property damage. Upon motion the docu-
ments were received, filed, and concurred.
4. Approval of City Expenditures: Upon motion the documents were received and filed, and
Resolution No. 342-22 Authorizing the Director of Finance and Budget/City Treasurer to make
certain payments of bills that must be paid and approved for pay ment in accordance with City
procedures was adopted.

AUTHORIZING THE DIRECTOR OF FINANCE AND BUDGET / CITY TREASURER TO MAKE
CERTAIN PAYMENTS OF BILLS THAT MUST BE PAID AND APPROVED FOR PAYMENT
IN ACCORDANCE WITH CITY PROCEDURES
Whereas, Section 1-7-7(E) of the Municipal Code of the City of Dubuque provides that the
Finance Director-City Treasurer shall keep an accurate account of all disbursements, money, or
property, specifying date, to whom, and from what fund paid; and
Whereas, the invoices, presented by those firms and persons providing such goods and ser-
vices have been pre-audited by Finance Department personnel in accordance with generally
accepted internal control procedures and have been determined to have been requisitioned for
a lawful municipal purpose; and
Whereas, the Finance Director-City Treasurer has provided a list of Expenditures attached
hereto, and by this reference made a part hereof, to be drawn to pay for goods and services
provided for City purposes; and
Whereas, the City Council of the City of Dubuque has heretofore, by Resolution 142 -18
adopted May 7, 2018, authorized the Finance Director-City Treasurer to issue checks in pay-
ment of certain expenditures known as Exception Expenditures prior to City Council approval
and such list is attached hereto.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBU-
QUE, IOWA THAT:
Section 1. The Finance Director-City Treasurer is hereby authorized to issue payment for
goods and services provided for City purposes in response to the purchase orders and contracts
issued in compliance with state and municipal code requirements as requested by designated
requisitioning authorities in accordance with approved budget appropriations.
Section 2. In accordance with Iowa Code Section 372.13(6), the City Clerk and Finance Di-
rector are hereby authorized and directed to provide the statement of receipts and disburse-
ments to the City Council, and to publish a summary thereof.

were received and filed, and Resolution No. 344-22 Approving a Pre-Annexation Agreement
between the City of Dubuque, Iowa and John T. Jr. and Debra S. Kalb was adopted.

APPROVING A PRE-ANNEXATION AGREEMENT BETWEEN THE CITY OF DUBUQUE,
IOWA AND JOHN T. JR. AND DEBRA S. KALB
Whereas, John T. Jr. and Debra S. Kalb, the owner of the following described property lo-
cated at 17118 Chicory Street in Dubuque County, Iowa (the Property) have submitted to the
City Council of the city of Dubuque an application for voluntary annexation of the Property to the
City of Dubuque:
Lot 11 of Wildflower Ridge Subdivision #2 in Dubuque County, Iowa, according to the rec-
orded plat thereof, subject to easements and restrictions of record; and
Whereas, John T. Jr. and Debra S. Kalb have entered into a Pre-annexation Agreement with
the City of Dubuque, a copy of which is attached hereto governing the future annexation of the
Property; and
Whereas, the Property is not subject to an existing annexation moratorium; and
Whereas, the Property does not include any state or railroad property; and
Whereas, Iowa Code Section 368.7 authorizes the voluntary annexation of property in Dubu-
que County, Iowa, and the extension of city limits by voluntary annexation; and
Whereas, the annexation of the Property is consistent with the Comprehensive Plan of the
City of Dubuque, necessary for the future orderly growth and development of the City of Dubu-
que, and will promote efficient and cost-effective extension of municipal services; and
Whereas, the City Council finds that the annexation of the Property is in the public interest.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBU-
QUE, IOWA:
Section 1. The Pre-annexation Agreement by and between John T. Jr. and Debra S. Kalb
and the City of Dubuque is hereby approved.

9. Easement Agreement, Ace Construction-Dubuque, L.L.C: Upon motion the documents
were received and filed, and Resolution No. 345-22 Approving an Agreement by and between
the City of Dubuque, Iowa and Ace Construction -Dubuque, L.L.C and a Grant of Easement to
the City of Dubuque was adopted.

APPROVING AN AGREEMENT BY AND BETWEEN THE CITY OF DUBUQUE, IOWA AND
ACE CONSTRUCTION-DUBUQUE, L.L.C AND A GRANT OF EASEMENT TO THE CITY OF
DUBUQUE
Whereas, on August 1, 2022, the City Council approved a resolution authorizing acquiring
property owned by Ace Construction-Dubuque, L.L.C. (Ace) by eminent domain if necessary for
access to a City water well located adjacent to the Ace property; and
Whereas, Ace and the City have tentative entered into an Agreement attached hereto for a
Grant of Easement to the City of Dubuque subject to City Council approval; and
Whereas, the City Council finds that the Agreement and Grant of Easement should be ap-
proved, and the Grant of Easement accepted.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBU-
QUE, IOWA AS FOLLOWS:
Section 1. The Agreement by and between the City of Dubuque, Iowa and Ace Construction-
Dubuque, L.L.C and the Grant of Easement to the City of Dubuque are hereby approved.
Section 2. The Mayor is hereby authorized and directed to sign the Agreement on behalf of
the City of Dubuque.
Section 3. The Grant of Easement is hereby accepted.

10. Corrected Legal Description by Resolution for Urban Renewal Plan for the Dubuque In-
dustrial Center Economic Development District, Version 2022.3 : Upon motion the documents
were received and filed, and Resolution No. 290-22-A Nunc Pro Tunc correcting and amending
a scrivener's error in certain legal descriptions included in the Urban Renewal Plan for the Dubu-
que Industrial Center Economic Development District was adopted.

RESOLUTION NUNC PRO TUNC CORRECTING AND AMENDING A SCRIVENER'S ERROR
IN CERTAIN LEGAL DESCRIPTIONS INCLUDED IN THE URBAN RENEWAL PLAN FOR
THE DUBUQUE INDUSTRIAL CENTER ECONOMIC DEVELOPMENT DISTRICT
Whereas, by Resolution No. 290-22, adopted September 6, 2022, this Council found and
determined that certain areas located within the City and County are eligible and should be
designated as an urban renewal area under Iowa law, and approved and adopted the Urban
Renewal Plan (the "Urban Renewal Plan" or "Plan") for the Dubuque Industrial Center Economic
Development District (the "Urban Renewal Area" or "Area") described therein; and
Whereas, the Urban Renewal Plan approved and adopted by Resolution No. 290-22 con-
tained a scrivener's error in the legal description of the Urban Renewal Project Area; and
Whereas, correcting the scrivener's error does not change the parcels of land which were
intended to be included in the Urban Renewal Area; and
Whereas, the Council has determined to adopt this resolution nunc pro tunc, correcting the
scrivener's error in the legal description of the Urban Renewal Project Area contained in the
Urban Renewal Plan for the Urban Renewal Area.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF DUBUQUE, IOWA:
Section 1. That the findings and conclusions set forth or contained in the Urban Renewal Plan
concerning the area of the City of Dubuque, State of Iowa, described in the preamble hereof
and in Resolution No. 290-22, be and the same are hereby ratified and confirmed in all respects
as the findings of this Council for the Urban Renewal Area with the exception of the amended
legal description as set forth below.
Section 2. The legal description of the Urban Renewal Project Area contained in the Urban
Renewal Plan approved and adopted by Resolution No. 290-22 on September 6, 2022, is
hereby corrected, nunc pro tunc, to provide as set forth in the legal descriptions of such area
attached hereto as Attachment D.
Section 3. The attached Attachment D shall be substituted in lieu of the original Attachment
D contained in the Urban Renewal Plan.
Section 4. That all other provisions of the Urban Renewal Plan not affected or otherwise
revised by this resolution, as well as all resolutions previously adopted by this City Council re-
lated to the Urban Renewal Plan be and the same are hereby ratified, confirmed, and approved
in all respects.

11. Chaplain Schmitt Island Trail Connection Project - Iowa DOT Funding Agreement: Upon
motion the documents were received and filed, and Resolution No. 346-22 Approving a Funding
Agreement (23-EDP-102) with the Iowa Department of Transportation for Community Project
Funding/Congressionally Directed Spending for the Chaplain Schmitt Island Trail Connection
Project was adopted.

APPROVING A FUNDING AGREEMENT (23-EDP-102) WITH THE IOWA DEPARTMENT OF
TRANSPORTATION FOR COMMUNITY PROJECT FUNDING/CONGRESSIONALLY DI-
RECTED SPENDING for the Chaplain Schmitt Island Trail Connection project
Whereas, the City of Dubuque desires to proceed with the Chaplain Schmitt Island Connector
Trail Project; and
Whereas, the trail will extend from near 16th Street along Admiral Sheehy Drive to the Chap-
lain Schmitt Veteran’s Memorial and include a trailhead with ADA parking ; and
Whereas, Chaplain Schmitt Island Connector Trail Project will involve the construction of a
10-foot-wide paved multi-use trail. The project is planned to be constructed in 2023 and will
incorporate the alignment and design of the trailhead plaza RDG developed as an alternate in
the Chaplain Schmitt Veterans Memorial; and
Whereas, the Iowa Department of Transportation (Iowa DOT) has authorized the use of fed-
eral funds for eligible costs for the Chaplain Schmitt Island Connector Trail Project.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBU-
QUE, IOWA:
Section 1. That the Mayor be authorized and directed to execute the Iowa DOT Transporta-
tion Federal-Aid Agreement for a Congressionally Directed Funding Project Agreement (23 -
EDP-102) between the City of Dubuque and the Iowa Department of Transportation be hereby
approved for the Chaplain Schmitt Island Connector Trail Project: along Admiral Sheehy Drive
from near 16th street to the Chaplain Schmitt Veterans Memorial.

12. 2022 Asphalt Overlay Access Ramp Project 4: Upon motion the documents were received
and filed, and Resolution No. 347-22 Accepting the 2022 Asphalt Overlay Access Ramp Project
4 and authorizing the payment to the contractor was adopted.

ACCEPTING THE 2022 ASPHALT OVERLAY ACCESS RAMP PROJECT 4 AND AUTHOR-
IZING THE PAYMENT TO THE CONTRACTOR
Whereas, the public improvement contract for the 2022 Asphalt Overlay Access Ramp Pro-
ject 4 (the Project) has been completed by the Contractor, D&D Concrete Inc, (Contractor), the
City Engineer has examined the work and recommends that the Project be accepted ; and
Whereas, the final contract amount for the Project is $132,127.74; and
Whereas, the Contractor has previously been paid $125,521.35 leaving a balance of
$6,606.39; and
Whereas, the City Council finds that the recommendation of the City Engineer should be
accepted.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBU-
QUE, IOWA:
Section 1. The recommendation of the City Engineer is approved, and the Project is hereby
accepted.
Section 2. The Finance Director is hereby directed to pay to the Contractor the balance of the
retainage of $6,606.39 as provided in Iowa Code chapter 573, and to pay such retainage in
accordance with the provisions of Iowa Code chapter 573 or Iowa Code chapter 26.13.

13. Iowa Department of Transportation Title VI Compliance Review: Upon motion the docu-
ments were received and filed, and Resolution No. 348-22 Approving the Iowa Department of
Transportation Title VI / Non-Discrimination Assurances DOT Order No. 1050.2A and Title VI
Non-Discrimination Agreement was adopted.

APPROVING THE IOWA DEPARTMENT OF TRANSPORTATION TITLE VI / NON-DISCRIM-
INATION ASSURANCES DOT ORDER NO. 1050.2A AND TITLE VI NON-DISCRIMINATION
AGREEMENT
Whereas, the City of Dubuque is a sub-recipient of Federal Financial Assistance which
passes through the Iowa Department of Transportation (IADOT); and
Whereas, IADOT is required to establish, implement, and ensure compliance in program ar-
eas of nondiscrimination, equal opportunity status, regulations, and executive orders that apply
to the distribution of Federal funds; and
Whereas, the City of Dubuque has been notified up an upcoming compliance review pertain-
ing to the City’s Title VI obligations; and
Whereas, the compliance review will be performed with the IADOT Affirmative Action Com-
pliance Officer; and
Whereas, prior to the compliance review the IADOT Affirmative Action Compliance Officer
the City must submit the Iowa DOT Title VI Non-Discrimination Assurances and Non-Discrimi-
nation Agreement; and
Whereas, the deadline for submission is November 11, 202 2.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBU-
QUE, IOWA:
Section 1. That the Mayor is authorized and directed to execute the Iowa DOT Title VI Non-
Discrimination Assurances Dot Order No. 1050.2A and Title VI Non-Discrimination Agreement
between the City of Dubuque and the Iowa Department of Transportation.
Section 2. That staff shall submit the signed document to IADOT and prepare the requisite
Title VI Compliance Site Review documents for submission to IADOT for the complianc e review.

14. Community Development Block Grant Contract for Henry Stout Apartment Complex:
Upon motion the documents were received and filed, and Resolution No. 349-22 Authorizing
execution of CDBG Subrecipient Agreement with Gronen was adopted.

AUTHORIZING EXECUTION OF CDBG SUBRECIPIENT AGREEMENT WITH GRONEN
Whereas, Gronen applied for Community Development Block Grant (CDBG) funds to acquire
Henry Stout Apartment Complex to assist low and moderate-income persons; and
Whereas, the submission was reviewed by the Community Development Advisory Commis-
sion on March 16th, 2022; and
Whereas, the City wishes to engage Subrecipient to assist the City in utilizing such CDBG
funds to assist Subrecipient with acquisition of real property; and
Whereas, City and the Subrecipient certify that the activity will meet the CDBG National Ob-
jective of benefit to low- and moderate-income persons.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBU-
QUE, IOWA:
Section 1. That the Subrecipient Agreement, beginning November 7, 2022, for Gronen be
approved, including authorization by the Community Development Advisory Commission.
Section 2. That the Mayor of the City of Dubuque is hereby authorized and directed to execute
said Agreement and related documents on behalf of the City of Dubuque, Iowa.

15. Experience Schmitt Island: Mississippi River Outdoor Amphitheater and Island Trails Pro-
ject Destination Iowa Outdoor Recreation Fund Grant Resolution Adoption : Upon motion the
documents were received and filed, and Resolution No. 350-22 Authorizing the Mayor to submit
a resolution to the Iowa Economic Development Authority for the Experience Schmitt Island:
Mississippi River Outdoor Amphitheater and Island Trails Grant Applicati on to the Destination
Iowa Outdoor Recreation Fund was adopted.
RESOLUTION NO. 350-22
AUTHORIZING THE MAYOR TO SUBMIT A RESOLUTION TO THE IOWA ECONOMIC DE-
VELOPMENT AUTHORITY FOR THE EXPERIENCE SCHMITT ISLAND: MISSISSIPPI RIVER
OUTDOOR AMPHITHEATER AND ISLAND TRAILS GRANT APPLICATION TO THE DESTI-
NATION IOWA OUTDOOR RECREATION FUND
Whereas, Governor Reynolds has allocated $100 million dollars to bolster the quality of life
in Iowa’s communities and attract visitors and new residents to the stat e; and applications are
being accepted and administered by the Iowa Economic Development Authority (IEDA); and
Whereas, the allocated funds are focused on shovel -ready projects; and
Whereas, IEDA has four areas for grant funding, one of which is Outdoor Recreation; and
Whereas, over the last two and one-half years during the pandemic there has been a large
increase in the utilization of outdoor amenities across the state; and
Whereas, Dubuque is uniquely situated along the Mississippi River for outdoor activities and
exploration, is located directly adjacent to Wisconsin and Illinois, and is a major Iowa tourism
destination; and
Whereas, the City has an approved Master Plan for Chaplain Schmitt Island (Plan) and has
identified the Plan implementation as a top priority for the community; and
Whereas, the Island is prime for redevelopment with shovel-ready outdoor recreation projects
which will both enhance the quality of life for existing residents while also drawing tourists and
attracting new residents; and
Whereas, staff has worked with a team of community members to prepare an application for
an IEDA Destination Iowa Outdoor Recreation Fund grant and the City of Dubuque has taken
the lead to administer the IEDA Destination Iowa Outdoor Recreation Fund upon a grant award;
and
Whereas, the Mayor and City Council approved the submission of a grant application to the
IEDA Destination Iowa Outdoor Recreation Fund on behalf of the City of Dubuque at their Oc-
tober 3, 2022 meeting; and
Whereas, the City Manager included a letter of funding commitment in the grant application
and was authorized to submit the grant to Iowa Economic Development Authority on October 3,
2022 with the grant being submitted October 4, 2022; and
Whereas, the City wishes to additionally formalize all actions through Resolution .
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBU-
QUE, IOWA, THAT:
Section 1. This resolution codifies all actions of the City Council and the City Manager related

AUTHORIZING AND DIRECTING THE CITY MANAGER TO PREPARE AN URBAN RE-
NEWAL PLAN FOR THE JOHN F. KENNEDY (JFK) ROAD URBAN RENEWAL AREA, SET-
TING A DATE FOR THE PUBLIC HEARING AND DIRECTING THE CONSULTATION PRO-
CESS ON THE PROPOSED AMENDED AND RESTATED URBAN RENEWAL PLAN FOR
SAID DISTRICT
Whereas, the City Council of the City of Dubuque has determined that the creation of the JFK
Road Urban Renewal Area (the “Area”) will stimulate, through public involvement and commit-
ment private investment in redevelopment activity; and
Whereas, Iowa Code Chapter 403 requires that before urban renewal authority may be exer-
cised, a City Council must adopt a resolution of necessity finding that the area in question is a
slum, blighted or economic development area, and that so designating such area is necessary
in the interest of the public health, safety, or welfare of the residents of the municipality.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBU-
QUE, IOWA:
Section 1. That the proposed JFK Road Urban Renewal Area, as generally described in At-
tachment A and Attachment B to this Resolution, is an economic development area as defined
by Chapter 403 of the Iowa Code and is appropriate for an urban renewal project.
Section 2. That the development of the JFK Road Urban Renewal Area is necessary and
appropriate to facilitate the proper growth and deve lopment of the community in accordance
with sound planning and local community objectives.
Section 3. That the City Manager is authorized and directed to prepare an Urban Renewal
Plan for the JFK Road Urban Renewal Area to include in such Plan any appropriate project
activities and details, to forward said Plan to the City's Long Range Planning Commission for
review and comment, and to determine an appropriate date for and conduct the consultation
process required by law with affected taxing entities concerning the proposed plan.
Section 4. That the City Council hold a public hearing on the adoption of the proposed Urban
Renewal Plan for the JFK Road Urban Renewal Area on December 5, 2022 at 6:30 p.m. in the
form attached hereto. The notice of said hearing shall generally identify the areas covered by
the Plan and the general scope of the urban renewal activities planned for such areas and said
notice shall be published in a newspaper having general circulation within the City not fewer
than four days nor more than twenty days before the date of said meeting.
Section 5. That the Economic Development Department is further directed to send by ordi-
nary mail a copy of said Plan, the notice of public hearing, a notice of consultation, and, to the
extent the Plan includes the use of tax increment revenues for a public building, an analysis of
alternative development and funding options for such public buildings, to the Dubuque Commu-
nity School District and the Dubuque County Board of Supervisors, as the aff ected taxing enti-
ties.

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DUBU-

Section 1. Section 2-2-10 of the City of Dubuque Code of Ordinances is amended to read as
follows:
2-2-10: MEETINGS:
A. Regular Meetings: The commission meets monthly. When there is no business, there
is no obligation to meet.
B. Special Meetings: Special meetings may be called by the chairperson or at the written
request of a majority of the commissioners.
C. Open Meetings: All meetings must be called and held in conformance with the Iowa
open meetings law.
D. Attendance:
1. In the event a commissioner has been absent for three (3) or more consecutive meet-
ings of the commission, without being excused by the chairperson, such absence will
be grounds for the commission to recommend to the city council that the position be
declared vacant and a replacement appointed.
2. Attendance must be entered upon the minutes of all meetings.
E. Minutes: A copy of the minutes of all regular and special meetings of the commission
must be filed with the city council within ten (10) working days after each meeting, or by
the next regularly scheduled city council meeting, whichever is later.
F. Quorum: Two (2) commissioners constitute a quorum for the transaction of business.
The affirmative vote of a majority of the commissioners present and voting is necessa ry

OF IOWA, CITY OF DUBUQUE, COUNTY OF DUBUQUE, DUBUQUE COMMUNITY
SCHOOL DISTRICT AND OTHER TAXING DISTRICTS, BE PAID TO A SPECIAL FUND FOR
PAYMENT OF PRINCIPAL AND INTEREST ON LOANS, MONIES ADVANCED TO AND IN-

renewal area known as the Derby Grange Road Housing Urban Renewal Area (the "Urban Re-
newal Area"); and
Whereas, expenditures and indebtedness are anticipated to be incurred by the City of Dubu-
que, Iowa in the future to finance urban renewal project activities carr ied out in furtherance of
the objectives of the Urban Renewal Plan and the future needs for redevelopment within the
Urban Renewal Area are such as to require the application of the incremental tax resources of
the Urban Renewal Area; and
Whereas, the City Council of the City of Dubuque, Iowa desires to provide for the division of
revenue from taxation in the Urban Renewal Area, as above described, in accordance with the
provisions of Section 403.19 of the Code of Iowa, as amended, and the Urban Renewal Plan.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DUBU-
QUE, IOWA:
Section 1. For purposes of this Ordinance, the following terms have the following meanings:
a. Urban Renewal Project Area shall include that area described as follows:
All that part of the right of way of John F. Kennedy Road lying between the following
described line:
A line beginning at the intersection of the west line of Lot 3 of Lot 2 of Helen E. and
Mary H. Stewart Subdivision and the south right of way line of John F. Kennedy Road
which then runs northeasterly perpendicular to said south right of way line and terminates
at the northerly right of way line of John F. Kennedy Road; and the Northeasterly extension
of the Northerly line of Lot 2 of Barton Randle Addition, City of Dubuque, Iowa; and
All that part of the right of way of John F. Kennedy Road lying between the Northwesterly
right of way line of Northwest Arterial (Iowa State Highway #32) and the Northe asterly
extension of the Northerly line of Lot 2 of Barton Randle Addition, City of Dubuque, Iowa;
and All that part of the Easterly half of the right of way of John F. Kennedy Road lying
between the Northeasterly extension of the Northerly line of Lot 2 of Barton Randle Addi-

said 20 acres of land reserved for a private roadway, in Dubuque County, Iowa).
b. Urban Renewal Plan shall mean the Urban Renewal Plan for the Derby Grange Road
Housing Urban Renewal Area, approved by Resolution No. 133-17-A on April 17, 2017, as
the same may be amended from time to time.
Section 2. That the taxes levied on the taxable property in the Urban Renewal Area, legally
described in Section 1 hereof, by and for the benefit of the State of Iowa, City of Dubuque,
County of Dubuque, Dubuque Community School District, and all other taxing districts from and
after the effective date of this Ordinance shall be divided as hereinafter in this Ordinance pro-
vided.
Section 3. That portion of the taxes which would be produced by the rate at which the tax is
levied each year by or for each of the taxing districts upon the total sum of the assessed value
of the taxable property in the Urban Renewal Area, as shown on the assessment roll as of
January 1, 2016, being January 1 of the calendar year preceding the first calendar year in which
the City of Dubuque is expected to certify to the County Auditor the amount of loans, advances,
indebtedness, or bonds payable from the division of property tax revenue described herein, shall
be allocated to and when collected be paid into the fund for the respective taxing district as taxes
by or for the taxing district into which all other property taxes are paid. The taxes so determined
shall be referred to herein as the "base period taxes" for such Urban Renewal Area.
Section 4. That portion of the taxes each year in excess of the base period taxes determined
for the Urban Renewal Area as provided in Section 3 of this Ordinance shall be allocated to and
when collected be paid into a special tax increment fund of the City of Dubuque, Iowa hereby
established, to pay the principal of and interest on loans, monies advanced to, indebtedness,
whether funded, refunded, assumed or otherwise, including bonds or obligations issued under
the authority of Section 403.9 or 403.12 of the Code of Iowa, as amended, incurred by the City
of Dubuque, Iowa, to finance or refinance, in whole or in part, urban renewal projects undertaken
within the Urban Renewal Area pursuant to the Urban Renewal Plan, except that (i) taxes for
the regular and voter-approved physical plant and equipment levy of a school district imposed
pursuant to Iowa Code Section 298.2 and taxes for the instructional support program of a school
district imposed pursuant to Iowa Code Section 257.19 (but in each case only to the extent
required under Iowa Code Section 403.19(2)); (ii) taxes for the payment of bonds and interest
of each taxing district; (iii) taxes imposed under Iowa Code Section 346.27(22) related to joint
county-city buildings; and (iv) any other exceptions described in Section 403.19 shall be col-
lected against all taxable property within the Urban Renewal Project Area without any limitation
as hereinabove provided.
Section 5. Unless or until the total assessed valuation of the taxable property in the Urban
Renewal Project Area exceeds the total assessed value of the taxable property in the Urban
Renewal Area as shown by the assessment rolls referred to in Section 3 of this Ordinance, all
of the taxes levied and collected upon the taxable property in the Urban Renewal Area shall be
paid into the funds for the respective taxing districts as taxes by or for said taxing districts in the
same manner as all other property taxes.
Section 6. At such time as the loans, advances, indebtedness, bonds and interest thereon of
the City of Dubuque, Iowa referred to in Section 4 hereof have been paid, all monies thereafter
received from taxes upon the taxable property in the Urban Renewal Area shall be paid into the
funds for the respective taxing districts in the same manner as taxes on all other property.
Section 7. All ordinances or parts of ordinances in conflict with the provisions of this Ordi-
nance are hereby repealed. The provisions of this Ordinance are intended and shall be con-
strued so as to fully implement the division of taxes from taxable property in the Urban Renewal
Area under the provisions of Section 403.19 of the Code of Iowa. In the event that any provision
of this Ordinance shall be determined to be contrary to law it shall not affect other provisions or
application of this Ordinance which shall at all times be construed to fully invoke the provisions
of Section 403.19 of the Code of Iowa with reference to the Urban Renewal Area and the territor y
contained therein.
Section 8. This Ordinance shall be in effect after its final passage, approval and publication
as provided by law.

described as follows:

the Amended and Restated Urban Renewal Plan for the District approved by Resolution
No. 289-22 on September 6, 2022, which Subarea C includes the lots and parcels lo-
cated within the area legally described as follows:
Lots 1 and 2 of Dubuque Industrial Center North Second Addition;
Lots 2, 3, C and A of Dubuque Industrial Center North First Addition, excepting that
Part of said Lot A originally platted as Lot 2 of the SW ¼ of the NW ¼ of Sec. 30,
T89N, R2E of the 5th PM; and
any adjoining public street right-of-way, all in the City of Dubuque, Dubuque County,
Iowa,
EXCEPT those lots and parcels included in Subarea K, those lots and parcels in-

(s) Amended Project Area means that portion of the City of Dubuque, Iowa and Dubuque
County included within the Original Project Area, Subarea C, Subarea D, Subarea E,
Subarea F, Subarea G, Subarea H, Subarea I, Subarea J, Subarea K, Subarea L, Sub-
area M, Subarea N, Subarea O, Subarea P, Subarea Q, and Subarea R each as de-
scribed in this Section.
Section 2: The taxes levied on the taxable property in the Amended Project Area, and each
subarea thereof, legally described in Section 1 hereof, by and for the benefit of the State of Iowa,
City of Dubuque, County of Dubuque, Dubuque Community School District, and all other taxing
districts from and after the effective date of this Ordinance shall be divided as hereinafter in this
Ordinance provided.
Section 3: As to the Original Project Area, that portion of the taxes which would be produced
by the rate at which the tax is levied each year by or for each of the taxing districts taxing prop-
erty in the Original Project Area upon the total sum of the assessed value of the taxable property
in the Original Project Area as shown on the assessment roll as of January 1, 1987, being the
first day of the calendar year preceding the effective date of Ordinance No. 26 -88, shall be
allocated to and when collected be paid into the fund for the respective taxing district as taxes
by or for said taxing district into which all other property taxes are paid. The taxes so determined
shall be referred herein as the "base period taxes" for such Subarea.
As to Subarea B, Subarea B has been removed from the division of revenues by Or-
dinance 22-21. Subarea B will remain within the District.
As to Subarea C (except the lots and parcels now forming Subarea K and those lots
and parcels removed by Amended and Restated Urban Renewal Plan Version 2021.4
now forming Subarea O, and those lots and parcels removed by Ordinance 28-22, now
forming Subarea R), base period taxes shall be computed in the same manner using
the total assessed value shown on the assessment roll as of January 1, 2007, being the
assessment roll applicable to property in such subarea as of January 1 of the calendar
year preceding the effective date of Ordinance No. 70-08, and base values shall be
reduced due to the removal of area from Subarea C.
As to Subarea D, base period taxes shall be computed in the same manner using the
total assessed value shown on the assessment roll as of Ja nuary 1, 2007, being the
assessment roll applicable to property in such subarea as of January 1 of the calendar
year preceding the effective date of Ordinance No. 70-08.
As to Subarea E, base period taxes shall be computed in the same manner using the
total assessed value shown on the assessment roll as of January 1, 2013, being the
assessment roll applicable to property in such subarea as of January 1 of the calendar
year preceding the effective date of Ordinance No. 10-14.
As to Subarea F, base period taxes shall be computed in the same manner using the
total assessed value shown on the assessment roll as of January 1, 2014, being the
assessment roll applicable to property in such subarea as of January 1 of the calendar
year preceding the effective date of Ordinance No. 39-15.
As to Subarea G, base period taxes shall be computed in the same manner using the
total assessed value shown on the assessment roll as of January 1, 2014, being the
assessment roll applicable to property in such subarea as of January 1 of the calendar
year preceding the effective date of Ordinance No. 55 -15.
As to Subarea H, base period taxes shall be computed in the same manner using the
total assessed value shown on the assessment roll as of January 1, 2015, being the
assessment roll applicable to property in such subarea as of January 1 of the calendar
year preceding the effective date of Ordinance No. 49 -16.
As to Subarea I, base period taxes shall be computed in the same manner using the
total assessed value shown on the assessment roll as of January 1, 2015, being the
assessment roll applicable to property in such subarea as of January 1 of the calendar
year preceding the effective date of Ordinance No. 49 -16.
As to Subarea J, base period taxes shall be computed in the same ma nner using the
total assessed value shown on the assessment roll as of January 1, 2015, being the
assessment roll applicable to property in such subarea as of January 1 of the calendar
year preceding the effective date of Ordinance No. 49 -16.
As to Subarea K, base period taxes shall be computed in the same manner using the
total assessed value shown on the assessment roll as of January 1, 2017, being the
assessment roll applicable to property in such subarea as of January 1 of the calendar
year preceding the effective date of Ordinance No. 18-18.
As to Subarea L, base period taxes shall be computed in the same manner using the
total assessed value shown on the assessment roll as of January 1, 2017, being the
assessment roll applicable to property in such subarea as of January 1 of the calendar
year preceding the effective date of Ordinance No. 45 -18.
As to Subarea M, base period taxes shall be computed in the same manner using the
total assessed value shown on the assessment roll as of January 1, 2017, bei ng the
assessment roll applicable to property in such subarea as of January 1 of the calendar
year preceding the effective date of Ordinance No. 45 -18.
As to Subarea N, base period taxes shall be computed in the same manner using the
total assessed value shown on the assessment roll as of January 1, 2020, being the
assessment roll applicable to property in such subarea as of January 1 of preceding the
effective date of Ordinance No. 16-21.
As to Subarea O, base period taxes shall be computed in the same manner using the
total assessed value shown on the assessment roll as of January 1, 2020, being the
assessment roll applicable to property in such subarea as of January 1 of preceding the
effective date of Ordinance 32-21.
As to Subarea P, Subarea P has been removed from the division of revenues by Or-
dinance 21-22. Subarea P will remain within the District.
As to Subarea Q, base period taxes shall be computed in the same manner using the
total assessed value shown on the assessment roll as of January 1, 20 22, being the
assessment roll applicable to property in such subarea as of January 1 of the calendar
year preceding the effective date of Ordinance No. 21-22.
As to Subarea R, base period taxes shall be computed in the same manner using the
total assessed value shown on the assessment roll as of January 1, 2022, being the
assessment roll applicable to property in such subarea as of January 1 of the calendar
year preceding the effective date of this Ordinance No. 28-22-A.
Section 4: That portion of the taxes each year in excess of the base period taxes for the
Amended Project Area, determined for each sub-area thereof as provided in Section 3 of this
Ordinance, shall be allocated to and when collected be paid into the special tax increment fund
previously established by the City of Dubuque to pay the principal of and interest on loans,
monies advanced to, or indebtedness, whether funded, refunded, assumed or otherwise, includ-
ing bonds issued under authority of Section 403.9 or Section 403.12 of the Code of Iowa, in-
curred by the City of Dubuque, Iowa to finance or refinance, in whole or in part, urban renewal
projects undertaken within the District pursuant to the Urban Renewal Plan, except that taxes
for the regular and voter-approved physical plant and equipment levy of a school district imposed
pursuant to Section 298.2 of the Code of Iowa and taxes for the instructional support program
of a school district imposed pursuant to Section 257.19 (but in each case only to the extent
required under Section 403.19(2)), taxes for the payment of bonds and interest of each taxing
district, and taxes imposed under Section 346.77 (22) related to joint county -city buildings, shall
be collected against all taxable property within the Amended Project Area without any limitation
as hereinabove provided.
Section 5: Unless or until the total assessed valuation of the taxable property in the subareas
of the Amended Project Area exceeds the total assessed value of the taxable property in said
subareas shown by the assessment rolls referred to in Section 3 of this Ord inance, all of the
taxes levied and collected upon the taxable property in the Amended Project Area shall be paid
into the funds for the respective taxing districts as taxes by or for the taxing districts in the same
manner as all other property taxes.
Section 6: At such time as the loans, monies advanced, bonds and interest thereon and in-
debtedness of the City of Dubuque referred to in Section 4 hereof have been paid, all monies
thereafter received from taxes upon the taxable property in the Amended Pro ject Area shall be
paid into the funds for the respective taxing districts in the same manner as taxes on all other
property.
Section 7: All ordinances or parts of ordinances in conflict with the provisions of this Ordi-
nance are hereby repealed. The provisions of this Ordinance are intended and shall be con-
strued so as to continue the division of taxes from taxable property in the Amended Project Area
under the provisions of Section 403.19 of the Code of Iowa, as authorized in this Ordinance No.
28-22-A. In the event that any provision of this Ordinance shall be determined to be contrary to
law it shall not affect other provisions or application of this Ordinance which shall at all times be
construed to fully invoke the provisions of Section 403.19 of th e Code of Iowa with reference to
the Amended Project Area and the subareas contained therein.
Section 8: This Ordinance shall be in effect after its final passage, approval and publication
as provided by law.

7. Public Works Staff Videos: Motion by Farber to receive and file the documents and view
the videos. Seconded by Roussell. Assistant Public Works Director Arielle Swift introduced sev-
eral videos that highlight the work of the Public Works Department. Due to technical difficulties,
the videos were unable to be displayed until after Council Member Reports.
COUNCIL MEMBER REPORTS
Council Member Sprank reported that Election Day is November 8th and reminded residents
whose voting precinct is Comiskey Park that voting is still occurring there regardless of current
construction at the park.
Council Member Farber congratulated the Dubuque Racing Association (DRA), Leisure Ser-
vices, and Engineering on the recent re-opening of the Dubuque Ice Arena.
Council Member Wethal reported on attending the NAACP’s Freedom Fund Banquet and
expressed enthusiasm for Avelo Airlines plan to offer Dubuque flights.
Mayor Cavanagh also expressed enthusiasm for Avelo Airlines.
Council Member Resnick congratulated Director of Strategic Partnerships Teri Hawks Good-
mann on her accomplishments.
Council Member Jones provided statements regarding state laws that restrict on -street park-
ing.

CLOSED SESSION
Motion by Jones to convene in closed session at 8:41 p.m. to discuss Purchase or Sale of
Real Estate – Chapter 21.5(1)(j) Code of Iowa. Seconded by Resnick. Mayor Cavanagh stated
for the record that the attorney who will consult with City Council on the issues to be discussed
in the closed session is City Attorney Brumwell. Motion carried 7-0.
The City Council reconvened in open session at 10:12 p.m. stating that staff had been given
proper direction.
There being no further business, Mayor Cavanagh declared the meeting adjourned at 10:12
p.m.
