Assistant City Engineer Robert Schiesl is recommending City Council accept the
improvements and authorize the payment of the final contract amount of $408,805.00 to
Portzen Construction, Inc. for the Mystique Ice Center - Rink Concrete Subfloor Project.
This is a 7.9% increase from the original contract amount of $379,000.00. The increase
was primarily due to the regrading that was required prior to the placement of the
concrete subfloor, and the removal and replacement of the concrete floor in the
resurfacing room.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

The attached resolution provides for the acceptance of the public improvement
construction contract for the Mystique Ice Center - Rink Concrete Subfloor Project.
BACKGROUND
City staff evaluated foundation soil remediation alternatives and consulted with several
design -build geotechnical contractors that specialize in low mobility, low head room
clearance, interior finished building, non-destructive deep foundation stabilization
applications. The settlement remediation solution that was implemented utilized the
installation of deep compaction grout columns to density the subgrade soils below the
concrete floor slab. The grout columns were installed on an approximate 10-ft. by 10-ft.
grid throughout the arena lower main level to a depth of treatment of approximately 30 to
35 feet. Once the deep compaction grout columns were installed to support the main level
floor slab, rink, bleachers, and interior block walls, a 2-part expanding polyurethane foam
was injected beneath the slab to fill voids, while providing the final lifting, re -leveling, and
stabilizing the floor slab.
The mitigation work for the ice arena settlement remediation has been successfully
completed. The first phase of work began on June 1st with the removal of the rink dasher
boards, the rink ice system, and bleachers to allow for the installation of a non-destructive
deep foundation system under the rink area and throughout the lower -level main floor
interior finished building space. Once the settlement and foundation system were
completed, a concrete subfloor was installed and supported on the deep foundation
system. Once the concrete subfloor was in -place, a new refrigerated ice rink concrete
floor was installed which is now supported by the subfloor slab and foundation. Once the
refrigerated ice rink floor was operational, the arena bleachers and seating were
reinstalled along with installation of new dasher boards, and the installation of new rubber
sport flooring on the lower -level main floor. All this work was successfully completed, and
the Dubuque Ice Arena was reopened to the public on November 1, 2022.
The Mystique Ice Center - Rink Concrete Subfloor Project provided for the construction
of an approximate 200-ft by 85-ft by 10-inch thick fully reinforced concrete subfloor. Upon
completion of the Settlement Remediation Project, performed by others, the concrete
subfloor was constructed approximately 13-inches below the new Ice Rink Refrigerated
Concrete Floor and is supported on the deep compaction grout columns.
DISCUSSION
The Mystique Ice Center - Rink Concrete Subfloor Project was completed by Portzen
Construction, Inc of Dubuque, IA in the final contract amount of $408,805.00. This is a
7.9% increase from the original contract amount of $379,000.00.
The increase was primarily due to the regrading that was required prior to the
placement of the concrete subfloor, and the removal and replacement of the concrete
floor in the resurfacing room.
Prior to the installation of the deep compaction grout columns within the rink area, the
original ice rink system was removed, and the site was excavated to the lower elevation
of the new concrete subfloor. As a result of the grout column installation operations, the
subgrade was substantially disturbed, and the site needed to be excavated and
regraded prior to the placement of the concrete subfloor. This extra cost was
approximately $8,900.
When the deep foundation settlement remediation work was successfully completed in
the resurfacing room area, we were unable to restore the original floor slab grades to
allow for proper floor drainage. Since it was critical to ensure proper drainage when
operating the ice resurfacing equipment and to also ensure there is no standing or
ponding water on the floor, the decision was made to remove and replace the concrete
floor and install new floor trench drains in resurfacing room area. This extra cost was
approximately $16,300.
When the deep compaction grout columns were installed near the front entry doors, the
interior floor slab heaved approximately '/z-inch, which caused operational issues with
the doors. The contractor removed and replaced the concrete floor slab at the front
entry doors at an additional cost of approximately $4,700.
RECOMMENDATION
I recommend that the City Council accept the improvements and authorize the payment
of the final contract amount of $408,805.00 to Portzen Construction, Inc. for the
Mystique Ice Center - Rink Concrete Subfloor Project.

REQUESTED ACTION

ACCEPTING THE MYSTIQUE ICE CENTER - RINK CONCRETE SUBFLOOR
PROJECT AND AUTHORIZING THE PAYMENT TO THE CONTRACTOR
WHEREAS, the public improvement contract for the Mystique Ice Center - Rink
Concrete Subfloor Project (the Project) has been completed by the Contractor, Portzen
Construction, Inc., (Contractor), and the City Engineer has examined the work and
recommends that the Project be accepted; and
WHEREAS, the final contract amount for the Project is $408,805,00; and
WHEREAS, the Contractor has previously been paid $388,364.75, leaving a
balance of $20,440.25; and
WHEREAS, the City Council finds that the recommendation of the City Engineer
should be accepted.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
SECTION 1. The recommendation of the City Engineer is approved, and the
Project is hereby accepted.
SECTION 2. The Finance Director is hereby directed to pay to the Contractor the
balance of the retainage of $20,440.25 as provided in Iowa Code chapter 573, and to pay
such retainage in accordance with the provisions of Iowa Code chapter 573 or Iowa Code
chapter 26.13.
