was the lowest bid for the furnishing of
all labor and materials and performing

the City of Dubuque has received Com-
munity Development Block Grant
Funds for the purpose of stimulating
economic development activities within
the community; and
WHEREAS, the City of Dubuque,
Iowa desires to assist F.H. Uelner Preci-
sion Tools and Dies, Inc. in its efforts
to relocate and expand its existing
operations; to create permanent employ-
merit opportunities for its citizens; and
to encourage the manufacture and ex-
portation of Iowa products; and
WHEREAS, a Loan Agreement is to
be executed by F.H. Uelner Precision
Tools and Dies, Inc. and the same hereto
and attached and by this reference made
a part hereof.
NOW, THEREFORE, BE IT RE-

WHEREAS, the City of Dubuque
entered into a Grant Agreement for the
Calendar Year commencing January 1,
1986 with the U.S. Department of Hous-
ing and Urban Development, providing
for financial assistance to the City under
Title I of the Housing and Community
Development Act of 1974, as amended,
and
WHEREAS, pursuant to the rules
and regulations as promulgated by the
U.S. Department of Housing and Urban
Development, an environmental review
has been processed for the hereinafter
described project to be financed with
Community Development Block Grant
funds: and
WHEREAS an ad hoc Environmen-
tal Review Committee on June 15. 1987
has after due consideration made a deter-
mination that the project is not a ma-
jor Federal action significantly affecting
the quality of the human environment.
NOW, THEREFORE, BE IT RE-
SOLVED BY THE CITY COUNCIL

BETTERMENT ACCOUNT GRANT
TO THE F.H. UELNER PRECISION
TOOLS AND DIES COMPANY, INC.
WHEREAS, the EH. Uehier Precision
Tools and Dies Company, Ina is a local
tool and die manufacturer and has pro-
posed the relocation and expansion of its
existing operations; and
WHEREAS, the City Council has con-
sidered said proposal and has determin-
ed that it will create high-skilled, wall-
paying local employment opportunities;
and
WHEREAS, the said proposal will
enhance the strength of the State and
the local economy by aiding an Iowa
manufacturing firm which exports a
growing share of its products out-af-
state; and
WHEREAS, the City of Dubuque has
applied for and received from the Com-
munity Economic Betterment Account
program as defined in House File 225,
Acts of the 71st General Assembly.
NOW, THEREFORE, BE IT RE-
SOLVED BY THE CITY COUNCIL
OF THE CITY OF DUBUQUE, IOWA:
Section 1. That the Mayor and the
City Clerk be and they are hereby
authorized and directed to endorse the
acceptance of the City of Dubuque, Iowa
upon the Subgrant Agreement hereto at-
tached, providing for the Grant of
$80,000 to F.H. Uelner Precision Tools
and Dies Company, Ina according to
terms specified therein.
Section 2. That the City Manager be

funds according to the Subgrant Agree-

COMMUNITY DEVELOPMENT
BLOCK GRANT PROJECT
WHEREAS, the City of Dubuque
entered into a Grant Agreement for the
Calendar Year commencing January 1,
1986 with the U.S. Department of Hous-
lng and Urban Development, providing
for financial assistance to the City under
Title I of the Housing and Community
Development Act of 1974, as amended;
and
WHEREAS, pursuant to the rules
and regulations as promulgated by the
U.S. Department of Housing and Urban
Development, an environmental review
has been processed for the hereinafter
described project to be financed with
Community Development Block Grant
funds; and
WHEREAS, an ad hoc Environmen-
tal Review Committee on June 15, 1987
has after due consideration made a deter~
ruination that the project is not a ma-
jor Federal action significantly affecting
the quality of the human environment.
NOW, THEREFORE, BE IT RE-
SOLVED BY THE CITY COUNCIL

WHEREAS, there has been filed with
the City Clerk a final plat of Clarke Crest
Estates Third Addition in the City of
Dubuque, Iowa; and
WHEREAS, upon said final plat ap-
pear a street to be known as Spires
Court, ~ogether with certain public util-
ity easements which the owner by said
plat has dedicated to the public forever;
and
WHEREAS, said final plat has been
examined by the City Planning and Zon-
ing Conunlssion and had its approval en-
dorsed thereon; and
WHEREAS, said final plat has been
examined by the City Council and they
find that the same conforms to the
statutes and ordinances relating thereto,
except that Spires Court has not been
improved; and

a. To reduce all streets to grade and
to construct concrete curb and gutter
and to hard service Spires Court with
bituminous concrete, or with concrete
paving with integral curb, ali Lq accor-
dance with City of Dubuque standard
specifications;
b. qb install sanitary sewer mains
and sewer service laterals in accordance
with plans submitted with the final plat;
c. To install water mains and water
service laterals in accordance with plans
submitted with the final plat;
d. To install storm sewers and catch-
basins in accordance with plans submit-
ted with the final plat;
e. To install concrete sidewalks as re-
quired by Ordinances, and where dir-
ected by the City Engineer and the City
Manager;
f. To Lqstall boulevard street lighting
in accordance with City specifications;
g. To construct the foregoing im-
provements in accordance with plans
and specifications approved by the City
Manager, under the inspection of the
City Engineer, and in a manner approv-
ed by the City Manager;
h. To construct said improvements,
except sidewalks, prior to two (2) years
from the date of acceptance of this
Resolution;
i. To maintain the foregoLqg improve-
ments for a period of two (2) years from
the date of their acceptance by the City
of Dubuque, Iowa;
j. To provide the foregoing construc-
tion and maintenance at the sole expense
of ~he subdivider, Dubuque Land
Development Ltd., or future owner;
And further provided that said Du-
buque Laud Development Ltd., as owner
of said subdivision, secure the perfot~
mance of the foregoing conditions by
providing security in such form and with
such SUrOti~ ~ may be acceptable to the
City Manager.
Section 3. That in the event the owner
shall fail to execute the acceptance and
furnish the security provided in Section
2 hereof within forty-five (45) days after
the date of the Resolution, the provisions
hereof shall be null and void and the ac-
ceptance of the dedication and approval
of the final plat shall not be effective.

assessments as deficiencies are found to
be proper and are levied conditionally

RESOLUTION OF NECESSITY
WHEREAS, Proposed plans have
beer/duly prepared and approved by the
City Council of the City of Dubuque and
are now on file in the office of the City
Clerk showing among other things the
plans, specifications, form of contract,
estimated cost and preliminary plat and
schedule showing the amount proposed
to be assessed against each lot and the
valuation of each lot as fixed by the City
Council, for the 1987 Asphalt Paving
Project.
BE IT THEREFORE RESOLVED
that the City Council deems it advisable
and necessary for the public welfare to
make the herein mentioned improve-
ment, and unless property owners at the
time of the final consideration of this
proposed resolution have on file with the
City Clerk objections to the resolution
of necessity, they shall be deemed to
have waived all objections pertaining to
the regularity of the proceeding and the
legality of using the special assessment
procedure.
Said improvements shall be con-
structed and done in accordance with
the plans and specifications which have
been approved by the City Council and
are now on file with the City Clerk· That
the cost and expense of making said ira-
provement will be assessed partially or
totally against privately owned proper-
ty lying within the assessment limits,
and in an amount not to exceed that pro-
vided by law, and in proportion to the

The portion of the cost which shall be

General Obligation Bonds and the

RESOLUTION OF NECESSITY
WHEREAS, proposed plans have
been duly prepared and approved by the
City Council of the City of Dubuque and
are now on file in the office of the City
Clerk showing among other things the
plans, specifications, form of contract,
estimated cost and preliminary plat and
schedule showing the amount proposed
to be assessed against each lot and the
valuation of each lot as fixed by the City
Council, for the 1987 P.C. Concrete Pav-
ing Project.
BE IT THEREFORE RESOLVED
that the City Council deems it advisable
and necessary for the public welfare to
make the herein mentioned improve-
ment, and unless property owners at the
time of the final consideration of this
proposed resolution have on file with the
City Clerk objections to the resulution
of necessity, they shall be deemed to
have waived all objections pertaining to
the regularity of the proceeding and the
legality of using the special assessment
procedure.
Said improvements shall be con-
structed and done in accordance with
the plans and specifications which have
been approved by the City Council and
are now on file with the City Clerk. That
the cost and expense of making said im-
provement will be assessed partially or
totally against privately owned proper-
ty lying within the assessment limits
and in an amount not to exceed that pro-
vided by law, and in proportion to the
special benefits conferred.
The above resolution was introduced,

WHEREAS, pursuant to Resolution
and published Notice of time and place
of hearing, published in the Telegraph-
Herald, a newspaper of general circula-
tion of the City of Dubuque, Iowa, on
December 23, 1986, the City Council of
the City of Dubuque, Iowa, met on the
5th day of January, 1987, at 7:30 o'clock
P.M. in the Public Library Auditorium,
llth and Bluff Streets, in the City of
Dubuque, Iowa, to consider the proposal
to dispose of interests in certain real
estate by executing Partial Releases of
a Real Estate Mortgage filed December
9, 1982, as Instrument No. 6742-82, and
a Financing Statement filed December
9, 1982, as Instrument No. 6743-82; and
WHEREAS, the City Council of the
City of Dubuque, Iowa, overruled any
and all objections, oral or written, to
dispose of interests of the City of
Dubuque, Iowa, and adopted Resolution
No. 2-87, authorizing the execution of
said Release documents; and
WHEREAS, the Mayor of the City of
Dubuque, Iowa, and the City Clerk did
execute such instruments on or about
January 5, 1987; and
WHEREAS, Iowa Department of
Transportation has objected to the form
of said Releases and requested corrected
Releases be executed; and

WHEREAS, an evaluation of the staf-
fing needs of the department concluded
that the training activities can be ade-
quately performed by a police sergeant.
NOW, THEREFORE, BE IT RE-
SOLVED BY THE CITY COUNCIL
OF THE CITY OF DUBUQUE, IOWA:
Section 1. That one (1) police captain
position be and is hereby abolished ef-
fective July 20, 1987, which reduces the
budgeted complement for the classifica-
tion of police captain from six (6) to five
f5) positions.
Section 2. That one (1) police sergeant
position be created effective July 20,
1987, which increases the budgeted com-
plement for the classification of police
sergeant from seven (7) to eight (8)
positions.
Section 3. That this resolution shall
serve as certification as required by
Chapter 400 of the Code of Iowa to the
Civil Service Commission of the City of

cial establishment holding a liquor con-
trol license may apply for and receive
permission to sell and dispense alcoholic
liquor and wine to patrons on Sunday
for consumption on the premises only,
and beer for consumption on or off the
premises between the hours of 10:00
a.m. and 12:00 midnight on Sunday.
(b) Any club, hotel, motel, or commer-
cial establishment holding a Class B
beer permit may apply for and receive
permission to sell and dispense beer to
patrons on Sunday for consumption on
or off the premises between the hours of
10:00 a.m. and 12:00 midnight on
Sunday.
(c) Any Class C beer permittee may
sell beer for consumption off the
premises between the hours of 10:00
a.m. and 12:00 midnight on Sunday.
(d) The holder of a Class E liquor con-
trol license may sell alcoholic liquor for
consumption off the premises between
tile hours of 10:00 a.m. and 12:00 mid-
night on Sunday. The holder of such
license is not required to apply for a Sun-
day sales privilege, nor required to pay
a fee for a Sunday sales privilege.
(e) A holder of any class of liquor con-
trol license or the holder of a Class B
beer permit may sell or dispense alcohol,
liquor, wine or beer to patrons for con-
sumption on the premises between the
hours of 10:00 a.m. Sunday and mid-
night Sunday when that Sunday is the
day before New Year's Day."
Section 2. That the Code of Ordi-
nances of the City of Dubuque, Iowa, be
amended by repealing Subsection (d) of
Section 5-21 thereof and enacting a
new Subsection (d) in lieu thereof as
follows:

(d) Class E. A Class E Liquor control
license may be issued and shall authorize
the holder to purchase alcoholic liquor
from the Iowa Alcoholic Beverages Divi-
sion only and to sell the alcoholic liquor
to patrons for consumption off the

control licensees. A Class E license shall
not be issued to premises at which
gasoline is sold. A holder of a Claee E
liquor control license may hold other
retail liquor control licenses or retail wine
or beer permits, but the premises li-
censed under a Claes E liquor control
license shall be separate from other
licensed premlses. However, the holder
of a Class E liquor control license may
also hold a Claes B wine or Class C beer
permit or both for the premises lb
censed under a Class E liquor control

Section 3. That the Code of Ordi-
nances of the City of Dubuque, Iowa, be
amended by repeafing Subsections (a)
and (b) of Section 5~23 thereof and enac-
ting new Subsections (a) and (b) of Sec-
tion 5-23 in lieu thereof as follows:
"SEC. 5-23. APPLICATION BOND.
(1) With any Class A, B, C, F, G, or
H Liquor Control License the bond shall
be five thousand dollars 155,000.00).
(b) The bond for a Class E Liquor Con-
trol License shall be a sum of not lees
than five thousand dollars ($5,000.00)
nor more than fifteen thousand dollars
($15,000.00) as determined on a sliding
scale established by the Iowa Alcoholic
Beverages Division; however, a bond
shall not be required if all purchases of
alcoholic liquor of said division by the
licensee are made by cash payment or
by means that ensures that said division
will receive full payment in advance of
delivery of the alcoholic liquor."

VIDING FOR THE REGULATION
OF NEWSRACKS IN THE CITY
NOW THEREFORE, BE IT OR-
DAINED BY THE CITY COUNCIL
OF THE CITY OF DUBUQUE, IOWA:
Section 1: That the Code of Or-
dinances of the City of Dubuque, Iowa
be amended by enacting a Division 3 to
Article VI of Chapter 33 comprised of
Sections 33420 through 33-127 thereof
as follows:
DIVISION 3.-NEWSRACKS
"Sec. 33-120. DEFINITIONS.
(a) Distributor shall mean the person
responsible for placing and maintaining
a newsrack in a public place.
(b) Newsrack shall mean any self-
service or coin operated box, container,
storage unit or other dispenser install-
ed, used or maintained for the display
and sale of newspapers or other news
periodicals. This definition shah not in-
clude a portable platform or stand used
by a person to distribute printed
materials on a temporary basis, which
is removed from the public place when
not in use, so long as its use conforms
to the location restrictions contained in
this division.
(c) Public place or places shall mean
public grounds, streets, sidewalks,
alleys, bridges, culverts, overpasses,
underpasses, grade crossing separations
and approaches, public ways, squares
Sec. 33-121. LOCATION AND SIZE.
(a) No newsrack shall be located where
it would endanger the safety of persons
or property, obstructs the vision of
motorists or unreasonably interferes
with or impedes the flow of pedestrian
or vehicular traffic or the ingress into
and egress from any building.
(b) No newsrack shall be located:
(1) within six (6) feet of any fire
hydrant or other emergency facility:
(2) where it projects beyond any
curb line onto the roadway;
(3) within three (3) feet of any mark-
ed crosswalk;
(4) within three (3) feet of the curb
return at an intersection;
(5) within three (3) feet of any curb
return on any driveway;
(6) where it unreasonably interferes
with access to a bus shelter or a bus
bench;
(7) where it unreasonably interferes
with loading or unloading at the front
or rear door of buses;
(8) in any handicap access ramp;
(9) in such a manner as to reduce the
clear space for the passageway of
pedestrians to less than three (3) feet;
and
(10) on any planted public place im-
proved with lawn, flowers, shrubs, or
other landscaping.
(c) No newsrack shah exceed five (5)
feet in height, thirty (30) inches in width
or two (2) feet in depth.
Sec. 33-122. STANDARDS.
(a) No newsrack shall be used for
advertising or publicity purposes other
than dealing with the display, sale. or
purchase of a newspaper or new period-
ical sold therein.
(b) Each newsrack, except those news-
racks dispensing publications without
charge, shall be equipped with a coin
return mechanism to permit a person
using the machine to secure an im-
mediate refund in the event be/she is
unable to receive the publication paid
for. The coin return mechanism shall be
maintained in good working order.
(c) Each newsrack shall have affixed
to it, in a readily visible place, a notice
setting forth the name and address of
the distributor and the telephone
number of a working telephone service
to call or report a malfunction or to
secure a refund in the event of a mal-
function of the coin return mechanism,
(d) Each newsrack shall be maintain-
ed in a neat and clean condition and in
a good state of repair.
Sec. 33-123. IDENTIFICATION.
Any person who places or maintains
a newsrack in a public place or places

shall inform the City Engineer, in
writing, where it has located a newsrack
within seven (7) business days after plac-
lng the newsrack in a public place.
Sec. 33-124. INSURANCE.
(a) Any person placing newsracks in
or about a public place or places within
the city shall provide proof of general
public liability insurance in the mini-
mum amount of five hundred thousand
dollars ($500,000) for each occurrence
and one million dolloxs ($1,000,000) in
the aggregate, and fifty thousand
dollars ($50,000) for property damages.
(b) SMd insurance policy or policies
shall name the City of Dubuque as an
additional insured and shall provide for
ten days written notice by certified mail
to the City Engineer of any material
change or cancellation of said policy.
(c) A Certificate of Insurance in a form
approved by the Corporation Counsel
shall be delivered to the City Engineer
prior to the placement of any newsrack
in a public place. A single policy of
surance may cover more than one
(d) The failure of any person to main-
rain said policy or policies in full force
and effect shall be grounds for the City
Manager to declare that the newsrack
has been installed, used or maintained
in violation of the provisions of this
Division, subject to a written order to
correct the offending condition as pro-
vided in Section 33-125 of this Division.
SEC. 33-125. VIOLATIONS
(a) Upon determination by the City
Manager that a newsrack has been in-
stalled, used, or maintained in violation
of the provisions of this division, the
City Manager shall issue a written order
to correct the offending condition to the
owner of the newsrack. The order shall
specifically describe the offending
condition.
(b) Failure by the owner to properly
correct the offending condition within
seven (7) calendar days after the mall-
lng date of the order shall result in the
newsrack being summarily removed by
the City.
SEC. 33-126. APPEALS.
(a) Any person aggrieved by a finding,
determination, notice or action taken
under the provisions of this Division
may appeal to the City Manager.
(b) A written appeal to the City Coun-
cil from the decision of the City Manager
shall be filed by the aggrieved person
with the City Clerk within ten days of
the decision of the City Manager. The
time and place for the hearing of the ap-
peal shall be set by the City Council and
written notice thereof given. The ag-
grieved person may present evidence to
the City Council by way of the public
hearing as to why the decision of the
City Manager should not be upheld.
(c) The taking of an appeal to the City
Council shall suspend the removal of any
newsrack until the City Council makes
its determination unless, in the judg-
ment of the City Manager, the newsrack
presents a clear and present danger of
eminent personal injury or property
damage.
(d) Nothing contained in this section
shall be interpreted to limit or impair the
exercise by the City of its police power
in the event of any emergency to remove
any such newsrack.
SEC. 33-127. ABANDONMENT.

passenger, is a misdemeanor. A fine may
be imposed upon the owner, operator or
lessee of the motor vehicle. The fine for
each violation is fifteen dollars ($15.00).

such space is'illegaily in use. Such
mete?s shall be placed in operation by
deposit of appropriate coin therein dur-
ing the hours of 8:00 a.m. to 5:00 p.m.
inclusive Monday through Saturday of
each week, except holidays. Holidays
shall include the following days only: the
first day of January, Memorial Day, the
fourth day of July, the first Monday in
September, Thanksgiving Day and the
twenty-fifth day of December."
Section 2. That the Code of Ordi-
nances of the City of Dubuque, Iowa be
amended by repealing subsection (b) of
Section 25-325 and enacting a new
subsection (b) of Section 25-325 in lieu
thereof as follows:

be defined as a permit to park a vehicle
at a parking meter upon the streets in
any parking meter district or in a
municipal public parking lot. When a
validly issued parking meter hood/
placard is displayed upon a parking
meter, the person operating such vein-
cie shall be exempt from the provisions
of this chapter from depositing coins in
the parking meter so covered.

(b) Parking meter hoods/placards shall
be only issued to a person actually
engaged in a construction, maintenance
or aloading/unloading activity at a site
adjacent to or within a reasonable
distance of a parking meter.
(c) Parking meter hoods/placards shall
not be issued for a period exceeding one
(1) month.
(d) No person shall knowingly repre-
sent or intentionally falsify any informa-
tion which is required in order to obtain
a parking meter hood/placard.
(e) No person or firm shall park a vehi-
cle using a parking meter hood/placard
at their place of business.
(i) The City Manager is hereby author-
ized to establish a fee for the issuance
of a parking meter hood/placard. Such
fee shall bear a reasonable relationship
to the income received by the City from
the operation of the meters in the park-
lng meter distr'lct or in the municipal
parking lot in which the meter is located.
No parking meter hood/pincard shall be
issued until the fee therefor has been
prepaid.
(g) The City Manager in addition to
establishing a prepaid parking rental
fee, may collect a deposit to insure the
safe and prompt return of the parking
meter hood/placard.'
(h) The City Manager is authorized to
revoke the parking meter hoed/placard

Telegraph Herald, a newspaper of gen-
eral circulation, and provided for a
public comment period until 12:00 Noon
on Friday, July 24, 1987; and
WHEREAS, public notice of a "Find-
ing of No Significant Effect on the En-
vironment'' for the projects was sent by
regular mall to various federal, state and
local public agencies and to local news
media, individuals and groups known to
be interested and believed to be ap-
propriate to receive such a public notice;
and
WHEREAS, any and all objections.
if any, to such proposals have been du-
ly considered; and
WHEREAS, it is the intent of the
City Council to authorize the submission
of a request to the U.S. Department of
Housing and Urban Development for
the release of funds to carry out the
above-identified projects.
NOW. THEREFORE, BE IT RE-
SOLVED BY THE CITY COUNCIL
OF THE CITY OF DUBUQUE, IOWA:
Section 1. That the Environmental
Review Record for the projects shall con-
tinue to remain on file in the Office of
the City Clerk where said record may be
examined and copied by any interested
party.
Section 2. That the Mayor of the City
of Dubuque is hereby authorized and
directed to submit to the U.S. Depart-
ment of Housing and Urban Develop-
ment a request for release of funds to
undertake the said projects.
Section 3. That the Mayor of the City
of Dubuque is hereby authorized to con-
sent to assmne the status of a responsi-
ble federal official under the National
Environmental Protection Act, insofar
as the provisions of the said Act apply
to the U.S. Department of Housing and
Urban Development responsibilities for
review, decisinn-maklng, and action
assumed and carried out by the City of
Dubuque as to environmental issues.
Section 4. That the Mayor of the City
of Dubuque is hereby authorized to con-
sent personally, in his official capacity
and on behalf of the City of Dubuque,
to accept the jurisdiction of the Federal
Courts if an action is brought to enforce

action.
