Steger, Housing & Community Development Director Subject: First Amendment to CDBG Subrecipient Agreement between the City of Dubuque and Opening Doors - Maria House Date: December 13, 2022 BACKGROUND The City of Dubuque entered into a Community Development Block Grant (CDBG) Subrecipient Agreement with Opening Doors on July 6, 2021, to assist with the rehab of the Maria House. Increased project costs and delayed project start dates have necessitated an increase in funding to make this project viable. This memorandum transmits a resolution to amend the Subrecipient Agreement to reflect increased project costs. DISCUSSION The original Subrecipient Agreement specified the funding amount to be $53,000 based on an estimate that was provided in February 2022. Due to the increase in material costs and the delayed project start dates, Opening Doors has requested an additional $21,580 to cover the project costs up to $74,580. The CDBG Annual Action Plan has available funding, so this increase can be accommodated without a budget amendment. RECOMMENDED ACTION I recommend the City Council approve the first amendment to the Subrecipient Agreement with Opening Doors — Maria House and authorize the City Manager or his designee to execute the amendment on behalf of the City. Breitfelder, City Clerk, 50 W. 13t1 St., Dubuque, IA 52001, (563) 589-4100 RESOLUTION NO. 383-22 RESOLUTION AUTHORIZING THE FIRST AMENDMENT TO THE CDBG SUBRECIPIENT AGREEMENT BETWEEN THE CITY OF DUBUQUE AND OPENING DOORS Whereas, the City of Dubuque and Opening Doors entered into a CDBG Subrecipient Agreement dated July 6, 2021 with respect to rehab the Maria House; and Whereas, the parties desire to modify the Subrecipient Agreement as set out in the First Amendment to the Subrecipient Agreement attached hereto; and Whereas, Opening Doors provides services to a majority low to moderate -income individuals and serve a group primarily presumed to be LMI such as battered spouses and homeless persons. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. That the First Amendment to the CDBG Subrecipient Agreement be approved. Section 2. Breittelder, City Clerk FIRST AMENDMENT TO SUBRECIPEINT AGREEMENT BETWEEN THE CITY OF DUBUQUE AND OPENING DOORS This First Amendment to Subrecipient Agreement, dated for reference purposes the _19th day of December , 2022, is made and entered into by the City of Dubuque, Iowa, a Responsible Entity administering Community Development Block Grant funds (City), and Opening Doors (Subrecipient). WHEREAS, City and Subrecipient entered into a Subrecipient Agreement dated July 6, 2021 (the Subrecipient Agreement); and WHEREAS, City and Subrecipient desire to amend the Subrecipient Agreement as set forth herein. NOW THEREFORE, IN CONSIDERATION OF THE MUTUAL TERMS AND COVENANTS CONTAINED HEREIN, CITY AND SUBRECIPIENT AGREE AS FOLLOWS: Section 1. Section A.3 of the Subrecipient Agreement is hereby amended to read as follows: A.3 Project Budget The City agrees, subject to the terms and conditions of this Agreement, to compensate the Subrecipient for the Statement of Work outlined in Exhibit A, not to exceed $74,580.00. If indirect costs are charged, the Subrecipient will develop an indirect cost allocation plan for determining the appropriate Subrecipient's share of administrative costs and shall submit such plan to the City for approval, in a form specified by the City. Section 2. Section A.6 of the Subrecipient Agreement is hereby amended to read as follows: A.6 Term and Time of Performance Services of the Subrecipient shall start on July 1, 2022 and end on June 30, 2023. All the required activities and services, except for audit, will be completed by or before this date. The City may grant extensions at its sole discretion. Only a valid written Amendment to the Agreement shall alter this completion date. The term of this Agreement and the provisions herein shall be extended to cover any additional time period during which the Subrecipient remains in control of CDBG funds or other assets, including program income.
