BACKGROUND The newly renamed Dubuque Ice Center (Formerly Mystique Community Ice Center) was designed, developed, and built under a Development Agreement between and among DICE, the City, the Dubuque Racing Association (DRA), and Battlefield Dubuque, LLC which later transferred and assigned its interest to Northern Lights Hockey, LLC. The Agreement commenced October 30, 2009. The Center opened September 18, 2010. The building is owned by the City. The Ice Arena was constructed on property in close proximity to the Mississippi River, on less than favorable subsurface soil conditions. During the original design development for the Ice Center, the geotechnical soils report indicated substantial depths of loose fill sand and miscellaneous landfill materials discovered by the subsurface borings. The Ice Arena building structure was constructed on a deep foundation system; however, the lower -level main floor was constructed as an unsupported slab -on -grade. Since initial construction, the foundation supported structure has displayed no signs of settlement or movement. However, the unsupported slab -on -grade lower level has developed significant differential settlement throughout the main floor. In November 2020, the City completed a full interior building scan of the Mystique Ice Center which indicated settlement in the range of zero to 5 plus inches throughout the main floor concrete slab. The differential settlement had caused operational issues with the ice rink, rotational movement of the stadium bleachers, movement in the unsupported interior concrete masonry block walls, and settlement of ice system mechanical equipment. In the summer and fall of 2021, based on the increased frequency of additional observed settlement and the presence of minor voids under the main -level concrete floor slab, the City completed a Floor Slab Void Filling, Lifting and Leveling Project as an interim remediation options to slow down the floor slab settlement until full remediation work could be performed. DISCUSSION City staff evaluated foundation soil settlement remediation alternatives and consulted with several design -build geotechnical contractors that specialize in low mobility, low head room clearance, interior finished building, non-destructive deep foundation stabilization applications. The settlement remediation solution that was selected and implemented utilized the installation of deep compaction grout columns to density the subgrade soils below the concrete floor slab and prevent further settlement. The mitigation work for the ice arena settlement remediation has been successfully completed. The first phase of work began on June 1st with the removal of the rink dasher boards, the rink ice system, and bleachers to allow for the installation of a non-destructive deep foundation system under the rink area and throughout the lower -level main floor interior finished building space. Once the settlement and foundation system were completed, a concrete subfloor was installed and supported on the deep foundation system. Once the concrete subfloor was in -place, a new refrigerated ice rink concrete floor was installed which is now supported by the subfloor slab and foundation. Once the refrigerated ice rink floor was operational, the arena bleachers and seating were reinstalled along with installation of new dasher boards, and the installation of new rubber sport flooring on the lower -level main floor. All this work was successfully completed, and the Dubuque Ice Arena was reopened to the public on November 1, 2022. The Mystique Ice Center Settlement Remediation Project provided for the construction of 473 deep compaction grout columns on an approximate 10-ft. by 10-ft. grid throughout the arena lower main level to a depth of treatment of approximately 30 to 35 feet. 180 deep compaction grout columns were installed under the ice rink floor, and 300 grout columns were installed under the remaining lower -level areas to support the bleachers, hallways, locker rooms, restrooms, ice system equipment room, office and concession areas, and front lobby entry areas. Once the deep compaction grout columns were installed to support the main level floor, a 2-part expanding polyurethane foam was injected beneath the slab to fill voids, while providing the final lifting, re -leveling, and stabilizing the floor slab. See attached exhibit showing the as -build layout for the deep compaction grout columns installed throughout the arena lower main level. The Mystique Ice Center Settlement Remediation Project was completed by Keller North America, Inc., of Commerce City, CO in the final lump sum contract amount of $1,822,443.00. RECOMMENDATION I recommend that the City Council accept the improvements and authorize the payment of the final contract amount of $1,822,443.00 to Keller North America, Inc. for the Mystique Ice Center Settlement Remediation Project. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: SECTION 1. The recommendation of the City Engineer is approved, and the Project is hereby accepted. SECTION 2. The Finance Director is hereby directed to pay to the Contractor the balance of the retainage of $91,122.15 as provided in Iowa Code chapter 573, and to pay such retainage in accordance with the provisions of Iowa Code chapter 573 or Iowa Code chapter 26.13.
