City Attorney Intern Keaton Larson is recommending City Council adopt a resolution
accepting the quit claim deed for property located at 1509-1511 Bluff Street from Jade
Engineering, L.L.C.
The City cited the owners for 25 municipal infractions in the years 2018 — 2019
alone. Jade petitioned the District Court of Dubuque County for review of decisions
made by the City of Dubuque Zoning Board of Adjustment, claiming that the Board
violated Jade's procedural due process rights in the relevant administrative proceedings
relating to these and other properties Jade owns. The District Court said that the
administrative procedures were sufficient and dismissed the petition.
Following the Court's denial of review, Jade and the City entered into a settlement
agreement on October 4, 2021, wherein the City agreed to dismiss the outstanding
municipal infractions against 1509-1511 Bluff St. if, among other things, Jade sold the
property by June 30, 2022. Jade agreed to deed the property to the City if it was unable
to sell the property by that date. It failed to sell the property and now, pursuant to the
agreement, is required to deed the property to the City.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

Dear Mr. Van Milligen
Jade Engineering, L.L.C. (Jade) has offered to deed 1509-1511 Bluff Street to
the City. The property is a single building but has two addresses because it is a duplex.
The property has been subject to multiple enforcement actions over the past decade.
The City cited the owners for 25 municipal infractions in the years 2018 — 2019
alone. Jade petitioned the District Court of Dubuque County for review of decisions made
by the City of Dubuque Zoning Board of Adjustment, claiming that the Board violated
Jade's procedural due process rights in the relevant administrative proceedings relating
to these and other properties Jade owns. The District Court said that the administrative
procedures were sufficient and dismissed the petition.
Following the Court's denial of review, Jade and the City entered into a settlement

I recommend you submit to the City Council the attached resolution accepting the
quit claim deed from Jade Engineering, L.L.C. The deed and all relevant documents
transferring ownership over the property located at 1509-1511 Bluff Street are attached
to this memorandum.

ACCEPTING THE DEED TO CERTAIN REAL ESTATE IN DUBUQUE COUNTY, IOWA
FROM JADE ENGINEERING LLC
WHEREAS, Jade Engineering LLC is the owner of certain real property in
Dubuque County, Iowa, described as follows:
The northerly 48 feet of the easterly 90 feet of lot 4 in D. N. Cooley's
Subdivision of Out Lots numbered 668 in the City of Dubuque, Iowa,
according to the recorded plat thereof.
WHEREAS, as part of a court settlement, if the property was not sold prior to June
30, 2022, Jade Engineering LLC would deed the property to the City of Dubuque; and
WHEREAS, Jade Engineering LLC has executed a Deed conveying said real
estate to the City of Dubuque; and
WHEREAS, the City Council finds that it is in the best interest of the City to accept
such deed from Jade Engineering, LLC.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA, AS FOLLOWS:
Section 1. The City of Dubuque, Iowa, hereby accepts the Deed from Jade
Engineering LLC, a copy of which Deed is attached hereto.
Section 2. The City Clerk is hereby authorized and directed to record this
Resolution and the Deed with the Dubuque County Recorder.
