BACKGROUND/DISCUSSION: Traffic enforcement, particularly speed enforcement, is a frequent request of the Dubuque Police Department. The purpose of traffic enforcement, particularly speed enforcement, is to reduce the amount of motor vehicle crashes and reduce the severity of those crashes by ultimately changing drivers' patterns of behavior. Motor vehicle crashes cause not only impacts to individuals in the form of injuries and monetary loss, they disrupt traffic flow, potentially cause additional crashes, and take a great deal of staff allocation and time to complete. In 2022, the Dubuque Police Department investigated over 1500 motor vehicle crashes. Four of those crashes involved six fatalities (a 10 year high). Excessive speed was a contributing factor in almost all of these crashes. One of those crashes took the lives of three young people along the NW Arterial. Attached is new data using the Iowa Crash Data Tool (ICAT). It should be noted that crash data is very nuanced. To identify specifics of causations, etc., requires driver reporting behavior, behaviors observed though witnesses, officer observation, etc. Additionally, causations such as speed are hard to determine as the sole factor, as most crashes involve multiple causations. The Dubuque Police Department investigates all traffic crashes. An average no injury crash involves at least one officer to investigate. If the vehicles are disabled and in the roadway, more officers are needed for traffic control and potentially the Fire Department is needed for hazardous material spills. Generally speaking, this will take at least one hour to complete. If the crash involves injury more resources and more time are needed. If the crash involves a fatality, the crash involves a lot of resources to complete the investigation and extended roadway closures, which may require additional resources such as public works, highway crews, etc. Prevention of crashes is key. Data provided by the Governor's Traffic Safety Bureau shows that in Iowa, speed was a factor in many of the fatal crashes. Iowa State Patrol Statistics for the last three years has shown an exponential increase in speed citations over 100 mph. The kinetic energy of a motor vehicle crash does increase exponentially with speed. The Department receives on average two to three requests per week for speed enforcement or speed shield placement. The speed shields are not an enforcement tool, but do provide some impact in that they show the speed of a vehicle. Mostly they provide data on speeds and time of day. This allows for better pinpoint enforcement. However, staffing enforcement efforts is based purely on an officer's availability to proactively enforce traffic. Throughout the years, the Dubuque Police Department has had a traffic enforcement unit, that was fielded with 1 and 3 officers as staffing allows. Currently the department does not have a traffic unit. Even with three officers, making thousands of traffic stops per year, it is hard for one officer to make a total impact on driving behaviors, as staffing cannot be and does not give 24 hour, 365 day coverage. Currently the department has 15 sworn officer vacancies. Two officers have left the department since the last report of this. The department responded to over 50,000 calls for service in 2022. On average this number is approximately 55,000. Traffic enforcement is a proactive activity and with the necessity to respond to calls as a priority. Traffic enforcement is a secondary priority purely because of staffing issues. Safety is another issue. Traffic stops are one of the most dangerous activities officers partake in. Not only does the officer have to contend with an unknown driver, the officer also has to contend with other vehicle traffic. Additionally, traffic stops, i.e. flashing lights, cause erratic behavior from drivers that has resulted in crashes as people slow, look, or erratically change lanes. Certain areas (such as lower Dodge St), that often generate speed complaints and are prone to crashes are often difficult and dangerous for officers to work traffic enforcement, without further impacting traffic patterns. Racial profiling, pretextual stops, etc. are allegations made around traffic enforcement, as there is a human factor when an officer decides to stop a vehicle. Additionally, when an officer makes a stop on a motorist, the claim is that the officer has now missed 10 other violations. The average traffic stop takes about 10 minutes to complete. A way to address these issues are through Automated Speed Enforcement. ASE is the use of cameras, administered by a third party, to issue a civil citation to the registered owner of a vehicle. The jurisdiction still maintain discretion on the issuance of citations. The citation/fine is a civil violation that is generally less than a traffic ticket issued by a police officer. The owner is then given options to pay, or appeal. The process for this will be outlined in an ordinance but would consist of a written appeal for police officer review or a request for a court date via the municipal infraction process. DISCUSSION: The City Council discussed this proposal at the 2/6/23 City Council meeting. At that meeting, Council approved moving ahead with the proposal with the next step of drafting an ordinance. The ordinance was developed by the City Attorney's Office and is attached. ACTION REQUESTED: I am recommending the first reading of the drafted ordinance and review of the attached documentation. Brurnwell, Esq. 300 Main Street Suite 330 Dubuque A 52001 563 589-4381 ORDINANCE NO. -23 AMENDING TITLE 9 MOTOR VEHICLES AND TRAFFIC, CHAPTER 7 OPERATION, DIVISION 5 SPEED RESTRICTIONS BY ENACTING A NEW SECTION 9-7-321.286 AUTOMATED SPEED ENFORCEMENT REGARDING AUTOMATED SPEED ENFORCEMENT AND THE PROCESS FOR CHALLENGING AN AUTOMATED SPEED CITATION WHEREAS, the City Council has been presented with information and opinions concerning Automated Speed Enforcement; and WHEREAS, the Dubuque City Council finds the use of Automated Speed Enforcement advances a multitude of public interests including but not limited to, traffic safety, safety of emergency responders, acting as a police force multiplier, and as a cost effective mechanism for the enforcement of speed laws benefiting taxpayers; and WHEREAS, the use of Automated Speed Enforcement devices which capture license plate image(s) strikes a desirable balance between the above stated public interests and privacy interests of the motoring public; and WHEREAS, the National Law Enforcement Telecommunications System is a cost effective means for determining ownership of vehicles detected as traveling in violation of speed laws within the city limits; and WHEREAS, the technology underlying Automated Speed Enforcement is reliable and its accuracy is verified by a police officer. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. Title 9, Chapter 7, Division 5 of the City of Dubuque Code of Ordinances is amended by adding the following section- 9-7-321.286- AUTOMATED SPEED ENFORCEMENT - A. General- In accordance with its police powers, the City may deploy, erect or cause to have erected an automated speed enforcement system for capturing images of motor vehicles that violate speed laws by failing to obey the posted speed regulations within the city. The system may be managed by a private contractor that owns and operates the requisite equipment. The police department shall retain supervisory control over the system. The contractor shall provide photographic and/or video images of any potential violations to the police department to review and, in the event the police department determines a vehicle was operated in violation of the city's speed ordinances, the police department shall direct that a notice of Automated Speed Citation be issued to the vehicle owner in accordance with this section. B. Definitions: 1 . Automated Speed Citation shall mean a notice of violation generated in connection with the automated speed enforcement system. 2. Automated Speed Enforcement Contractor shall mean the company or entity, if any, with which the City of Dubuque contracts to provide equipment and/or services in connection with the Automated Speed Enforcement System. 3. Automated Speed Enforcement System shall mean an electronic system consisting of a photographic, video, or electronic camera and a vehicle sensor installed to work in conjunction with an official traffic controller or police department employee to automatically produce photographs, video or digital images of each vehicle violating a speed restriction. 4. Vehicle Owner shall mean the person or entity identified by the Iowa Department of Transportation, or identified by any other state vehicle registration office, as the registered owner of a vehicle detected violating a traffic law by failing to obey speed regulations within the City. Notwithstanding the foregoing, in the event the Iowa Department of Transportation or any other state vehicle registration office identifies a person or entity as the lessee of the vehicle, that lessee shall be the vehicle owner for purposes of this section. In the event a state registration office does not specify whether a person or entity listed on the registration for the vehicle is the owner or the lessee of the vehicle, any person or entity listed on that vehicle registration may be deemed the vehicle owner and held jointly and severally responsible for a violation of this section. C. Vehicle Owner Subject to Civil Fine for Automated Speed Citations: 1 . If a vehicle is detected traveling at a speed above the posted limit, the Vehicle Owner shall be subject to a civil fine as scheduled below in subsection 9- 7-321.286(d). 2. Exemptions from this section are set forth in subsection 9-7-321.286(g) and shall not be considered violations for purposes of the Automated Speed Enforcement System. 3. In no event will an Automated Speed Citation be sent or reported to the Iowa Department of Transportation or similar department of any other state for the purpose of being added to the Vehicle Owner's driving record. D. Notice of Automated Speed Citation; Fines: 1 . Upon a Dubuque Police Officer's determination that the Automated Speed Enforcement System has detected a violation described in subsection 9-7- 321.286(C)(1), a notice of an Automated Speed Citation will be mailed to the Vehicle Owner for each such violation recorded by the Automated Speed Enforcement System. The Automated Speed Enforcement Contractor shall mail the notice within thirty (30) days after receiving information about the Vehicle Owner. The notice shall include the name and address of the Vehicle Owner; the vehicle make, if available and readily discernable; the vehicle registration number; the violation alleged; the time, date and location of the alleged violation; the applicable fine; information as to the manner in which the Automated Speed Citation may be challenged; and that the basis of the notice is a photographic or video record generated by an Automated Speed Enforcement System. 2. Any violation of subsection 9-7-321.286(C)(1) above shall be subject to a civil fine as scheduled in the table below, and the fine for any violation committed in a designated construction zone (as provided by the Code of Iowa), shall be doubled, as scheduled below, subject in any event to the limit on fines sought in municipal infractions. E. Challenging an Automated Speed Citation: Within thirty (30) days from the date appearing at the top of a notice of Automated Speed Citation sent to the Vehicle Owner, the Vehicle Owner may either pay the fee associated with the citation or challenge the citation by submitting a written challenge to the citation or requesting that a municipal infraction be filed pursuant to Iowa Code §364.22. Any such written challenge or request must be on a form specified by and available from the City as indicated on the notice and be sent to the City according to the instructions on that form. Upon receipt of a written challenge, a Dubuque Police Officer shall determine whether the citation should be rescinded. Within thirty (30) days after the City receives such a challenge, the City shall notify the Vehicle Owner whether the challenge to the Automated Speed Citation is successful, in which case, the citation shall be rescinded. Otherwise, the citation shall stand. Thereafter, the City may seek voluntary payment and/or file the citation as a municipal infraction against the Vehicle Owner, all as set forth in subsection (F) hereof. F. Failure to Timely Pay or Challenge Automated Speed Citation: If the recipient of an Automated Speed Citation does not either pay the fine by the due date stated on the original citation or successfully challenge the citation as provided herein, the City may file a municipal infraction against the Vehicle Owner in accordance with City Code §1-4-2 and §364.22 of the Code of Iowa, seeking judgment for violation and applicable civil fine provided in subsections 9-7-321.286(C) and (D) plus state mandated filing fee and court costs. If judgment is entered for the City in the municipal infraction proceeding, the City may, subject to applicable law, pursue enforcement of the judgment together with interest as permitted by law. Collection of that judgment may include referral to the State of Iowa Income Offset program administered by the Department of Administrative Services, State Accounting Enterprise. Notwithstanding the City's right to file a municipal infraction, the City may first seek voluntary payment of the fine by sending a written request for payment to the Vehicle Owner and/or referring the matter to a private service agent to conduct collection in accordance with all applicable law. G. Exemptions from Section 9-7-321.386: The following shall not be considered violations for purposes of the Automated Speed Enforcement System: 1 . The operator of the vehicle in question was issued a uniform traffic citation for the violation in question pursuant to City Code §9-7-321.285 or Chapter 321 of the Code of Iowa. 2. The violation occurred at any time after the vehicle in question or its state registration plates were reported to a law enforcement agency as having been stolen, provided, however, the vehicle or its plates had not been recovered by the Vehicle Owner at the time of the alleged violation. 3. The vehicle in question was an authorized emergency vehicle. 4. The Dubuque Police Officer inspecting the recorded image determines that the vehicle in question was lawfully participating in a funeral procession. The foregoing list of exemptions from Section 9-7-321.286 shall not be construed as limiting the defenses available to challenge an Automated Speed Citation or defend a municipal infraction. PREVENTION SAVES MONEY The best way to reduce motor vehicle crash costs is to prevent crashes. Some effective strategies for preventing crashes include: • automated red-light and speed -camera enforcement • comprehensive graduated driver licensing systems • publicized sobriety checkpoints • mandatory ignition interlocks for all (including first-time) offenders convicted of a[cohoI.-impaired driving The next best way to reduce costs is to prevent injuries when crashes occur. These actually alert people to the amount of time to get through the intersection. People speed up for stale green lights when count -downs can actually alert you to the time remaining and alert driver to potential safety issues. They have count -downs on many red light intersections. What the percentage of accident at these intersections compared to those without the clocks. Has that been looked into? 36 1 oppose until I get more information about the proposal. Where would they be, how would the 2/8/2023 8:06 AM process work, what would the police that are normally assigned to do this be re -assigned to do? Would private lots, such as the lot at Crescent, benefit from the surveillance if there was a break-in or other mischief recorded on said camera(s) or would they strictly be used for speeding? Where are the areas in Dubuque where speeding is the worst? 37 Speed cameras have already shown to be faulty, and has chance for error, causing a person, 2/8/2023 8:04 AM to have to take time out of their already busy schedule to deal with the situation, that could be an error. Spending tax dollars, to get the tax payers to pay more, sounds LAZY. 38 Automation of public policing regardless of how inconsequential it may seem right now, is not 2/8/2023 7:58 AM something I support. 39 12/20/2008 Maryland Students Use Speed Cameras for Revenge Students in Montgomery 2/8/2023 7:58 AM County, Maryland use fake license plates to send speed camera tickets to enemies. Maryland plate, photo by Amy the Nurse/Flickr High school students in Maryland are using speed cameras as a tool to fine innocent drivers in a game, according to the Montgomery County Sentinel newspaper. Because photo enforcement devices will automatically mail out a ticket to any registered vehicle owner based solely on a photograph of a license plate, any driver could receive a ticket if someone else creates a duplicate of his license plate and drives quickly past a speed camera. The private companies that mail out the tickets often do not bother to verify whether vehicle registration information for the accused vehicle matches the photographed vehicle. In the UK, this is known as number plate cloning, where thieves will find the license information of a vehicle similar in appearance to the one they wish to drive. They will use that information to purchase a real license plate from a private vendor using the other vehicle's numbers. This allows the "cloned" vehicle to avoid all automated punishment systems. According to the Sentinel, two Rockville, Maryland high schools call their version of cloning the '.speed camera pimping game." A speed camera is located out in front of Wootton High School, providing a convenient location for generating the false tickets. Instead of purchasing license plates, students have ready access to laser printers that can create duplicate license plates using glossy paper using readily available fonts. For example, the state name of "Maryland" appears on plates in a font similar to Garamond Number 5 Swash Italic. Even though anything can happen at any 2/8/2023 7:49 AM speed, I believe they should solely be used at 45mph or higher. You 2/8/2023 7:42 AM spend your hours lunch with 30 minutes of it in traffic. There is no quick way around Dubuque, don't slow it down anymore. 49 Violations for speed cameras are very difficult to defend and prosecute in court. The plaintiff 2/8/2023 7:40 AM only shows a snapshot of data and the defendant often has to recollect the events of that day as "violators" don't know when they are being ticketed until weeks later. "Violators" don't know if they are going to get ticketed at 2mph over the speed limit which could easily be within reason of accuracy on a vehicles instruments or if they will be ticketed at 5 or 9 or 11 over the posted limit. This could easily result in one of our employees getting multiple citations before they even know they have the first. Additionally, countering these fines in court, during regular business hours, pulls our staff away from revenue generating work... essentially an indirect tax on our company and at times can hamper critical schedules when repairs must take place in a specific time -frame... sometimes only a few hours and by specifically qualified individuals. These cameras always "claim" to be for safety wherever used but the money incentive is just a happy by-product that cities have to "deal with". Simple truth is that the cameras are a revenue generator and this is a new tax. All of the locations that have been discussed (published in the Telegraph Herald), I personally, as well as my crews, travel through all of these areas, often multiple times each day. The speed of traffic in these locations is typically very reasonable and appropriate for conditions. Additionally, to pay for the installation, servicing, and enforcement, this requires outside companies that are not always US based that collect a high percentage of the fines. The minimums that the servicing company sets will often dictate how much the fines may be... not our local elected officials. This was not a "hot - button" issue in our most recent election. Our city council seems to be taking a sudden stance on an issue where they believe they need to "solve it" before some sore of magical timer runs out. I feel they are acting far too hastily and trying to suppress the voice of the people. The most recent meeting showed this issues as a split -decision topic, something that almost never happens in Dubuque, which shows that even the city council is divided on the issue. Our elected officials need to put their efforts towards the areas that they campaigned on... if this is an issue that they feel compassionate about, let them put it on record in their campaigns so the people can make their judgement at the polls. We are already looking out in our best interests and our commitment to safety. Because of this initiative, can companies like ours receive a waiver from these cameras... because we are already self - policing our company vehicles? What is in it for us? Our company fleet consists of a large number of vehicles so we already pay far more in road taxes, fuel taxes, sales tax on service and maintenance, sales tax in new vehicle purchases, and taxes on insurance. This is just another tax and an unnecessary burden on our professional staff that is already billed at a premium labor rate... in part because of our outstanding efforts in providing worker safety, safe vehicles, and safe equipment. 50 1 don't believe any citation should be issued by mail. Taxpayers spent millions of dollars on synchronizing Dodge St and the it appears you would have to speed to hit all green lights. I think it encourages speeding. Most municipalities treat these as simple revenue generators where the service provider makes most of the money. How about inattentive driving - will the cameras improve that? What causes more accidents - texting/inattentive while driving, or speeding? Does the city know the answer? Has the city studied where the actual human safety risks are at (traffic or otherwise), and applied resources proportionally? Additionally, the part that gets overlooked is that stealth speed and red light cameras are a very unfriendly way to treat your residents and visitors by sending them a surprise violation in the mail. If there is an area that has problems with speeding, maybe a non -moving -violation type radar with speed read-out, as you see some cities placed near problem areas would be more beneficial. The city needs much more justification and a more logical approach to what the real goals are: revenue or safety and quality of life and personal freedom. 55 1 oppose the cameras because I've been a resident of the area and worked downtown my 2/8/2023 7:25 AM whole life. If we don't need the cameras for safety reasons - as was put forward by Chief Jensen - then it is simply a revenue grab opportunity by the City, an imposition on personal liberties, and an unnecessary additional regulation. I do have a great deal of respect for Chief Jensen and agree with the supposition that it would save on police labor. Let us know what type of community service you think replaces a fine. There will be the same repeat offenders because a slap on the hand has never worked. And what happens if the person doesn't show up for community service? It will be all about collecting money from those with money .... kind of like the comment from a council member that doesn't want to miss revenue from parking meters fines if the city converts the meters. Motives are questionable. A reason to fine people is the most important part of any project. I believe it is governmental intrusion that violates our civil rights and violates substantive and procedural due process. My understanding of previous cases is that they are unconstitutional as "criminal penalties", but allowed to endure as "civil infractions." For example, preliminary information reported in the newspaper is that the cameras will be placed where complaints and traffic accidents are the highest. Think about that -- they are going to put cameras where people call up and complain more, not necessarily where there is a problem (whether due to speeding or due to underlying factors such as street design or maintenance, etc.). By placing one at the Locust/Dodge intersection, you won't fix the fact that the intersection and lights are set-up very poorly in a high traffic pressure point. By placing one on the Arterial, are cameras really going to stop the rampant late night drag races and horsing around? If you placed one on West 32nd, aren't you really just taxing the people who travel on that road? Frankly, I have not seen or heard of all that many "problem areas" in town. Let's be honest, these cameras are all about generating revenue for no work. It is outsourcing the responsibility of the City to a third -party. Much like our pay parking system, they are also error prone. They are also "anti -business" and "anti - tourism." The cities that have them all have a negative and unwelcoming connotation associated with them. How would anyone feel driving through a town and getting a ticket in the mail a week or so later? While I have not received a camera ticket before, I know plenty of people who have gotten them in other communities and it ruins their day, and it sours people from going back to that town. If speeding is a problem, hire enough law enforcement to enforce the laws, but don't throw cameras up and say it is for safety when it is really all about revenue. It is an insult to our intelligence to say otherwise. Last, I do not understand at all the process that is being employed -- Why is the City Council entertaining a proposal to approve them and to then tell us the "how" they are going to implement them later? However it would be difficult to determine who was speeding in a particular vehicle and how to hold them accountable for the fine. 114 1 oppose speed cameras because they are indiscriminate. They do not know if there is an 2/7/2023 3:27 PM emergency, they can't talk to someone about the situation, find out why they were over the speed limit and perhaps leave them with a warning. I cannot support any speed camera or red light ordinance without language protecting the interests of business owners with corporate owned vehicle fleets. Our business provides 35+ courtesy vehicles for patrons of our vehicle service facilities. These vehicles are registered to our business and are driven by our customers. In addition, many of our customers test drive vehicles we hold in inventory prior to or in contemplation of purchase. If any of these vehicles are "caught" on speed cameras or red light cameras the citation/fine will be directed to the registered/legal owner of the vehicle not the driver. While we maintain records that would assist with the identification of the responsible party and allow us to forward the penalty for payment this should not be our responsibility. Fining businesses under these circumstances or placing business owners such as ours in the position as the fee collector for the City of Dubuque is not equitable. 117 1 oppose & use 1-380 as an example where this failed miserably. Our law enforcement issues in DBQ are far more reaching than this. The information I've received has come mostly from the telegraph herald. I do have some concerns with the process. I know reading the paper that the concern of the two descending votes was the process was moving to fast and not enough information was provided to council to make such a HUGH decision. For the record I'm not against this. However I do question it's effectiveness. In the article they quoted a study done that says it reduces accidents. I did look at the study. I also looked at several others. I seems you can pick your study depending on which side of the fence your on. To me that means it's inconclusive. Several years ago the council took up this same issue and had turned it down. I know at that time Mike VanMilligan was a Hugh supporter of it. At the time they had looked at the projections they we're in the millions of dollars revenue for the city. Hence his opinion to me doesn't matter. I do believe the council has not done there do diligence on this. I do question the effectiveness of these cameras. One study pointed out the citizens that speed just know when they have to slow down because of camera placement. Once there past that they speed up again. I'm 68 year old. I've driven countless miles. How many times have you seen a law enforcement officer driving on a hiway and all the vehicles have slow down because of it. Then he turns off and most all those cars start speeding up. I would ask that one of you give me the answer to the following questions. 1. Given my previous example of driver's knowing where the cameras are and slowing down and speeding back up after that. How can you say that's effective? 2. How much are the fines going to be? 3. How much of that money goes directly to the city and how much goes to the company installing the cameras? 4. In regards to the placement of cameras. The locations being chosen is by accidents correct? 5. If 4 is correct how do they determine that speed was a factor in the accident and what percentage of those accidents had speed as a contributing factor? 6. Will the fine be charged to whoever the car is registered or will they charge the driver if the car. 7. If the owner is charged then will it go in his record? 8. Sometimes when an officer pulls someone over for speeding they will let them off with a warning or reduce the speed he was going to either save the driver money or possibly lose of license. How does this factor in on the cameras? 9. Mr. Jones had said he didn't care if we didn't make a dime off of this. I would challenge you all to send that money to something other that the cities coffers. This would prove to the citizens that say it just a money maker. Has that been considered?
