for improving Auburn Avenue
from the end of the present im-
provement to the south property line
of Rosedale Avenue, J. M. Kenety
& Son, contractors.
Amount of special assessment
$1,294:01, same to be assessed against
the property legally subject to as-
sessment upon and along said street.
And that there is a plat and sched-
ule on file in the office of the City
Clerk of said City of Dubuque, show-
ing the street in which said improve-
ment was made and the separate lots
and parcels of ground or specified
portions thereof subject to assess-
ment for such improvement, the
name of the owner thereof as far as
practicable, and the amount to be as-

granted, as she is unable to pay

Council:
Gentlemen: T, the undersigned,
hereby petition your honorable body
to instruct the City Treasurer to
cancel the taxes against my prop-
erty,, Lot 66„ Union Addition, allow-
ing them to remain a lien on the
said property. I am asking your
honorable body to do me this favor
because I am absolutely unable to
pay the taxes and am in hopes that
I can keep the same from being sold
for taxes for my remaining years.

all of Lot 16 Littleton and Sawyer's
Sub. and Sawyer's Sub. of M. Lot
194 in the City of Dubuque, were
drawn in proper form. Councilman
Brede moved that the bond of Leo
J. Fosselman be placed on file, and
the deed of Charles Schultz and
Christian Schultz be recorded with
the County Auditor and placed on
file in the office of the City Clerk.

City Solicitor Czizek stated that
the bond of E. E. Frith for the ful-
fillment of contract to collect gar-

right, title and interest in and to a
certain contract in writing with the
City of Dubuque providing for the
collection and removal of garbage

buque of 1919.
Be it ordained by the City Council
of the City of Dubuque:
Sec. 1. That an ordinance entitled
"an ordinance providing for the elec-
tion and qualification of certain of-
ficers, fixing their term of office and
relating to vacancies in such of-
fices" the same being ordinance num-
ber three (3) of the revised ordi-
nances of the City of Dubuque of
1919, be, and the same is hereby re-
pealed.
Sec. 2. This ordinance shall be
in force and effect ten days from

Be it ordained by the City Council
of the City of Dubuque:
Sec. 1. Par. 48, Section 1, of an
ordinance entitled "an ordinance de-
fining the duties and powers of the
City Treasurer," the same being
ordinance number (10) of the re-
vised ordinances of the City of Du-
buque of 1919, be and the same is
hereby amended by substituting in
lieu thereof as follows:
Par. 48. Duties. Sec. 1. "The
Treasurer shall be known as the. re-
ceiving and disbursing agent for the
' City of Dubuque and he shall re-
ceive all money payable to the City
of Dubuque from all sources and dis-
pose of the same to the persons en-
titled thereto. The Treasurer shah

ORDINANCE NUMBER 9
An ordinance providing fo /
'appointment and qualifications of
certain officers, fixing their term of
office, and salary.
Be it ordained by the City Council
of the City of Dubuque:
Par. 678. Appointments by Coun-
cil. Sec. 1. The City Council shall,
and it is hereby made its duty, to
appoint a Clerk, a Police Judge or
Magistrate, a Solicitor, an Assessor,
and the members of the Library
Board as their terms of office ex-
pire. It may also appoint a Corpor-
ation Counsel, and Assistant Solici-
tor if deemed advirable. On or be-

fore the first Monday of April in each
gear, the Council shall also ap-
point three (3) persons who shall
constitute a local board of review
of the City, and the compensation
of such board shall be fixed by the
Council and paid from the general
fund of the City, and which board
shall be governed by the statute re-
lating to boards of review, and shall
possess and exercise all of the pow -
ers conferred upon local boards of
review by law.
Par. 679. Manager. Sec. 11. The
Council shall also appoint a mana-
ger in accordance with the provis-
ions of ordinance number 89, who
shall possess and exercise all of the
powers and duties therein prescrib-
ed.
Par. 680. Qualifications. Sec.
111. In making the appointments
above provided for the council shall
he influenced only by the ability,
honesty, integrity, and fitness for
the position to which the appoint-
ment is made and no preference
shall be given to any person on ac-
count of political influence. Before
entering upon the duties of his of-
fice each appointee shall take an
oath or affirmation that he will sup-
port the constitution of the United
States, the constitution of the State
of Iowa, and faithfully and honestly
without fear or favor, perform the
duties of his office to the best of
his ability, which oath shall be ad-
ministered by the Mayor, or presid-
ing officer of the Council, and in the
absence, by the manager.
Par. 681. Term of Office. Sec.
IV. All appointments shall be made
at the pleasure of the Council and
any officer aT,Zpointed by the 'Council
may be discharged with or without
cause and competent person ap-
pointed to fill the vacancy thus cre-
ated.
Par. 682. Salaries. Sec. V. The
annual salaries of the officers ap-
pointed shall beas herein prescrib-
ed, which salaries shall be paid in
semi - monthly installments to each
officer entitled thereto. The sal-
aries herein provided for may be
changed from time to time at the
will ' of the Council. Salaries shall
be paid to the following officers in
the following amounts, to -wit:
City Manager $8,400.00
City Solicitor 3,600.00
Assistant Solicitor 1,800.00
Police Judge or Migistrate 1,500.00
City Assessor 2,200.00
City Clerk 1,800.00

Be it ordained by the City Council
of the City of Dubuque:
Par. 657. _ Manager - Appointment
- Tenure of Office -Sec. 1_ It shall
be the duty of the Council to ap-
point some competent person man-
ager of the city, who shall be and
act as the administrative head there-
of, under the direction and supervis-
ion of the Council, and shall hold
office at its pleasure.
Par. 658. Oath. Sec. 11. Before
entering upon his duties the man-
ager shall take an oath that he will
support the constitution of the
United" States, the constitution of
the Stateof Iowa, and without fear
or favor, to the best of his ability,
he will faithfully and honestly per- '
form the duties of his office.
Par. 659. Bond. Sec. 111. He
shall execute a bond with a reliable
surety company as surety thereon,
to be paid for by the City, in such
sum as the Council may, by resolu-
tion determine, which bond shall
be conditioned for the faithful per-
formance of his duties and shall be
in favor of the City of Dubuque.
Par. 660. Office. Sec. 1V. The
manager shall have his office at the
City Hall, which office shall be
open on all days, Sundays and holi-
days excepted, for the transaction
of business for the City.
Par. 661. Residence. Temporary
Appointment. Sec. V. The •Council
in appointing a manager need not be
influenced by the residence or non-
residence of the person selected,
having regard for his qualifications
and fitness for the position. During
the absence of the manager by leave
of the Council, through sickness or
other unavoidable causes, the Coun-
cil may designate some properly
qualified person to perform and ex-
ecute the duties of his office.
Par. 662. Political Influence. Sec.
6. The manager shall take no part
in any election held for the purpose
of electing councilmen, except that
he may attend at the polls and cast
his vote. Any attempt on the part
of the manager to influence or in-
duce any elector to vote for any per-
son seeking office of councilmen
shall be a misdemeanor and punish-
ed as provided by law, and, in ad-
dition thereto, he may be removed
from office.
Par. 663. Appointment. Discharge.
Section VII. The manager shall ap-
point all employees of the City, to-
gether with deputies and assistants,
except the clerk, police judge or
magistrate, solicitor, assistant solici-
tor, corporation counsel, assessor,
members of the library board and
board of review, and fix their salaries
subject to the approval of the coun-
cil. He shall also have the power
and authority to discharge any em-
ployee whom he has the power to ap-
point, with or without cause and
without right of appeal, except as
may be provided for in other ordi-
nances of the City. z
Par. 664. Powers and Duties. Sec.
VIII. He shall have and exercise
all of the powers and duties con-
ferred upon him by the 36th G. A.
(H. F. 4081, Par. 25) and such other
powers and duties as are incidental
to . and not inconsistent with those
conferred, and such other and fur-
ther powers as may, from cline to
time, be conferred uppn him -by - law.

Be it ordained by the City Council
of the City of Dubuque:
Par. 685. Manager shall appoint.
Sec. 1. Except the officers appoint-
ed by the Council under ordinance
number 90, and such employees as
are specifically provided for by law,
the Manager shall appoint all depu-
ties and employees of the City and
fix their salaries, subject to the ap-
proval of the Council. Such em-
ployees shall be directly under the
supervision and control of the Man-
ager and he shall prescribe their du-
ties and make such rules and regu-
lations regarding the conduct of
their departments as he shall deem
advisable.
Par. 686. Salaries. Sec, 11. The
Manager shall fix the salaries of
such employees and appointees, as
lie has power to employ or appoint,,
from time to time and report such
salaries to the council and receive
the approval of the council thereon.
Par. 687. Discharge. Sec. 111.
All appointments made by the Man-
ager shall continue until terminated
by him, and any appointee or em-
ployee may be discharged summarily
by him, with or without cause.
Par. 688. Bond. Sec. IV. Em-
ployees, assistants or deputies, when
required by the Manager, shall file
a bond before taking office, in such
an amount as shall be considered
adequate and said bond shall run in
favor of the City of Dubuque.

of the City of Dubuque:
Par. 689. How elections are con-
ducted. Sec. 1. All of the provis
ions of chapter 14 -D affecting cities
adopting the manager plan of gov-
ernment, especially sections 1056 -b4,
as amended relating to nominations
of candidates, section 1056 -b5, relat-
ing to the ballots, the duties of the
clerk, the appointment of judges, the
conduct of the election and the can-
vass of the returns and all other pro-
visions of the general election laws,
not inconsistent therewith, shall de-
fine the manner in which elections
shall be conducted in the City of Du-
buque.
Par. 690. Who elected when held.
Sec. 11. Municipal elections shall
be held every two (2) years on the
last Monday in March. At such elec-
tions the onliy officers to be voted
for are the of Councilman, whose
tenure of office shall be two (2) for
two (2) years and three (3) for
three (3) years, according to the
terms to which they have been
elected. Every two (2) years there
shall be elected a member or mem-
bers of the Council for the term of
three (3) years to succeed those
terms of office will expire the first
Monday in April, following such elec-
tion, and there shall also be elected
at such regular biennial municipal
election a member or members of
the council for a term of three (3)
years to succeed those whose term
will expire one wyear after the first
Monday in April following such elec-
tion. The time when each candidate
for councilman shall begin his term
of office shall be specified under his
name on the ballot and all petitions
for nominations, for members of the
council to be voted for at such regu-
lar biennial election, shall specify
the length of the term of office for
which the candidate seeks nomina-
tion.
Par. 691. Qualifications of Coun-
cil. Sec. 111. The councilmen elect
for the two (2) year term shall take
their office on the first Monday in
April following their election, and
the councilmen elect ofr the three
(3) year term shall take their office
one (1) year after the first Monday
in April following the election. Be-
fore assuming office each council-
man shall qualify by taking an oath
to support the constitution of the
United States and the constitction
of the State of Iowa, and to faith-
fully and honestly perform the duties
of his office, without fear or favor to
the best of his ability.
Par. 692. Salary - contracts. Sec.
IV. The members of the council
shall serve and perform all of the
duties of their offices without com-
pensation and no councilman shall
be interested directly or indirectly,
in any contract with the city, nor
shall he receive any benefit or thing
of value from such contract.
Par, 693. Powers. Sec. V. The
Council shall have power and may
exercise all executive legislative and
judicial powers conferred by law
upon councils of cities of the first
class, except only such powers as
are expressly conferred upon the
manager, or those which are inci-
dental thereto, and such other pow-
ers as the council, by resolution or-
, dinance or motion may delegate to
the manager or some other ofR^er
or committee.
Par, 694. Meeting. Sec. VI. Reg-
ular meetings of the Council shall
the held on the first Monday of each
month and special meetings may be
called from time to time by two (2)
councilmen. AlI meetings, whether
regular or special, shall be open to
the public. If a regular meeting day
falls upon a legal holiday the meet-
ing shall be held on the day follow-
ing. The Council shall prescribe the
rules and regulations for the con-
duct of the business of the meetings.
Par. 695. Quorum, Sec. VII.
Three members of the Council shall
constitute a quorum for the transac-
tion of business.

Mayor protein. Sec. 1. The Coun-
cil shall organize itself into a work-
ing body at the first meeting fpllow-
ing the regular biennial election and
at the first meeting at which newly
elected members qualify and assume
their positions in the Council. The
Council shall elect one of their num-
ber as chairman and presiding of-

the presiding officer or Mayor be not
present, the members of the Council
present shall select one of their num-
ber to act as presiding officer pro -

ed by the regularly elected presiding
officer of the Council.
Par. 698. Powers and duties. Sec.
11. The Mayor shall be recognized
as the official head of the• City, by
the courts and officers of the State,
upon whom service of civil process
may be made. He may take com-
mand of the podlice and govern the
city by proclamation in times of
public danger, or during any emer-
gency, and shall be the judge as to
what constitutes such public dan-
ger or emergency. He shall also
perform such duties as the election
laws of the State impose upon the
Mayor of the City. He shall sign all
bonds, deeds to real estate, most=
gages and releases. He shall sign
and execute all public improvements
contracts, provided, however, that
the council maw delegate the power
to sign and execute such improve-
ment contracts to the Manager,
whose acts shall then be taken as
the acts of the Mayor for and on be-
half of the City. The election of a
member of the council as Mayor
shall not give him or confer upon
him any additional power or author-
ity, except such as herein provided,
and such as is ordinarily exercised
by a presiding officer.

levying a special assessment for the
construction of an eight inch tile
pipe sanitary sewer in Valeria street
and Cushing Place and acting on any
other business that might properly
come before a regular meeting of the
City Council.

ers of the City Council's intention to
levy a special assessment to pay for
constructing an eight -inch tile pipe
sanitary sewer in Valeria street from
the end of the present sewer in Cush-
ing Place and in Valeria street from
the east lot line of Lot 1 of 1 of 3 of
Mineral Lot 316 to Cushing Place
from Valeria street to the manhole
in Kauffman avenue. Also remon-

Whereas, The contract heretofore
entered into by the City of Dubuque
for the construction of , a sanitary
sewer in Valeria street and Cushing
Place hereinafter described has been
completed and the City Engineer has
computed that the cost and expense
of said improvement amounts to
$5,859.52;
Therefore, Be it resolved by the
City Council of the City of Dubuque,
That to provide for the cost of con-
structing a sanitary sewer in Valeria
street from the end of the presetn
sewer to Gushing Place and in Va-
leria street from the east line of lot
1 of 1 of mineral lot 316 of Cushing
Place and in Cushing Platce from Va-
leria street to the manhole in Kauf-
mann avenue, there be issued street
improvement bonds to the amount of
$5,859.52. Said bonds shall be issued
under Chapter 8, Title V of the Code
of Iowa and amendments thereto,
shall bear date as of the 30th day of
July A. D. 1920, shall be of the de-
nominations of $300.00 each, except
that there shall be one bond of the

numbered from 6373 to 6392 both in-

by the City of Dubuque, persuant to

cited that all the acts, conditions

series of bonds, have been done.

A RESOLUTION.
Whereas, C. B. McNamara & Son
entered into a contract with the City
of Dubuque for the improvement of
Cushing Place from the south prop-
erty line of Valeria street to the
north property line of Kaufmann
avenue, and
Whereas, the said C. B. McNamara
& Son have completed their contract
in accordance with the plans and
specifications for said improvement
as shown by the report of the City
Manager.
Now therefore, Be it resolved by
the City Council of the City of Du-
buque, that the report of the City
Manager accepting said work be ap-
proved and the City Engineer be and
heis hereby instructed to prepare a
plat and schedule showing the par-
cels of real estate subject to assess-
ment for the improvement and file
the same in the office of the City
Clerk subject to public inspection.
The City Clerk shall upon receipt of
such plat and schedule publish the
notices of said special assessment as
required by law,

ORDINANCE NUMBER 89.
An ordinance providing for t7ie
appointment of a City Manager, fix-
ing his compensation and prescrib-
ing his duties and powers.
Be it ordained by the City Council
of the City of Dubuque:
Par. 657. Manager - Appointment
- Tenure of Office. Sec. 1. It shall
be the duty of the Council to ap-
point some competent person mana-
ger of the City, who shall be and act .
as the administrative head thereof,
under the direction and supervision
of the Council, and shall hold office
at its pleasure.
Par. 658. Oath. Sec. 11. Before
entering upon his duties the man-
ager shall take an oath that he will
support the constitution of the
United States, the constitution of
the State of Iowa, and without fear
or favor, to the best of his ability,
he will faithfully and honestly per-
form the duties of his office.
Par. 659. Bond. Sec. 111. He
shall execute a bond with a reliable
surety company as surety thereon,
to be paid for by the city, in such
sum as the Council may, by resolu-
tion, determine, which bond shall be
'conditioned for the faithful perform-
ance of his duties and shall be in fa-
vor of the City of Dubuque.
Par. 660. Office. Sec. IV. The
manager shall have his office at the
City Hall, which office shall be open
on all days, Sundays and holidays
excepted, for the transaction of bus-
iness for the city.
Par. 661. Residence. Temporary
'Appointment. Sec. V. The Council
in appointing a manager need not be
influenced by the residence or non-
residence of the person selected,
having regard for his qualifications
and fitness for the position. Dur-
ing the absence of the manager by
leave of the council through sick-
ness or other unavoidable causes,
the Council may designate some
properly qualified person to perform
and execute the duties of his office.
Par. 662. Political rnfluence. Sec.
6. The manager shall take no part
in any election held for the purpose
of electing Councilmen,- except that
he may attend at the pons and cast
his vote. Any attempt upon the
part of the manager to influence or
induce any elector td' vote for anY

Par. 663. Appointment. Discharge

itor, corporation council, assessor,
members of the library board and
board of review, and fix their salar-
ies, subject to the approval of the
council. He shall also have the pow-
er and authority to discharge any
employe when he has the power to
appoint with or Without Cause and
without right of appeal, except as
may be provided for in other ordi-
nances of the City.
Par. 664. Powers acid Duties. Sec.
VIII. He shall have and exercise all
of the powers and duties conferred
upon him by the 36th G. A. (H. F.
408, Par. 25) and such other powers
and duties as are incidental to and
net inconsistent with those confer-
rd, and such other and further pow-
ers as may, from time to time, be
conferred upon him by law.,
Par. 665. Acts for Mayor. Sec.
IX. Whenever any power or duty is
by law vested in the Mayor which is
administrative and proprietary in
character, as distinguished from leg-
islative; the manager shall perform
such duties and exercise such pow -
ersa and his acts, whet( approved by
the council, shah be taken as the
acfs of the Mayor.
Par. 666. Salaries. Section X.
The manager shall be paid an an-
nual salary Of Eight Thousand Four
Hundred ($8,400:00) payable in

ORDINANCE NUMBER 90.
An ordinance providing for the ap-
pointment and qualifications of eer-
tain officers, fixing their term of of-
fice and salary;
Be it ordained by the City Council
of the City of Dtibullue:
Par. 678: Appointments by Coun-
61. Sec. 1. The City'Council shall,
and it is hereby made its duty, to ap-
point a clerk, a police judge or mag-
istrate, a solicitor, an ,assessor, and
the meinbers of the library board as
their terms of office expire. It may
also appoint a corporation council,
and assistant solicitor if deemed ad-
visable. On or before the first Mon -
day of April in each year, the Coun-
cil shall also appoint three (3) per-
sons who shall constitute a local
board of review of the city and the
compensation of such board Shall be
fixed by the Couucil and paid froth
the general fund of the City and
which board shall be governed by
the statute relating to boards of re-
view, and shall possess and exercise
all powers conferred upon local
boards of review by law.
Par. 679. Manager. Sec. II. The
Council shall also appoint a manager
in accordance with the provisions of
ordinance number 89, who shall
possess and exercise all of the pow-
ers and duties therein prescribed.
Par. 680. Qualifications. Sec. III.
In making the appointments above
,provided for the Council shall be in-
fluenced only by the ability, honesty,
integrity and fitness for the position
to which the appointment is made
and ne preference shall be given to
any person on account of political in-

fill the vacancy thus created.

tion shall be sufficient to cause the
removal of such officer.

ORDINANCE NUMBER 91.
An ordinance providing for the ap-
pointment of assistants and employ-
ees.
Be it ordained by the City Council
of the City of Dubuque:
Par. 685. Manager Shall Appoint.
Sec. 1. Except the officers appoint-
ed by the Council under ordinance
number 90, and such employees as
are specifically provided for by law,
the Manager shall appoint all depu-
ties and employees of the ,City and
fix their salaries, subject to the ap-
proval of the Council. Such em-
ployees shall be directly under the
scpervision and control of the Man -
agfer and he shall prescribe their du-
ties and make such rules and regula-
tions regarding the conduct of their
departments as he shall deem advis-
able.
Par. 686. Salaries. Sec. 11. The
Manager shall fix the salaries of such
employees and appointees, as he has
power to employ or appoint, from
time to time and report such sauar-
les to the Council and receive the
approval of the Council thereon.
Par. 687. Discharge. Sec. 111.
All appointments made by the Man-
ager shall continue until terminated
by him and any appointee or em-
ployee may be discharged summar-
ily by him, with or without cause.
Par. 688. Bond. Sec. IV. Em-
ployees, assistants or deputies, when
required by the Manager, shall file
a, bond before taking office in such
an amount as shall be considered
adequate, and said bond shall run in
favor of the City of Dubuque.
Par. 689. Publication. Sec. V.
This ordinance shall bein force and

ORDINANCE NUMBER 92.
An ordinance provided for th
election of Councilmen and prescrib-
ing the powers and duties of the
Council.
Be it ordained by the City Council
of the City of Dubuque:
Par. 689. How Elections Are Con-
ducted. Sec. 1. All of the provisions
of chapter 14 -D affecting cities adopt-
ing the manager plan of government,
especially sections 1056.b4, as amend-
ed, relating to nominations of candi-
dates, section 1056 -b5, relating to the
ballots, the duties of the clerk, the
appointment of judges, the conduct
of the election and the canvass of
the returns and all other provisions
of the general election laws, not in-
consistent therewith, shall define the
manner in which elections shall be
conducted in the City of Dubuque.
Par. 690. Who Elected -When
Held. Sec. 11. Municipal elections
shall be held every two (2) years on
the last Monday in March. At such
elections the only officers to be vot-
ed for are those of Councilmen,
whose tenure of office shall be two
(2) for two (2) years and three (3)
for three (3) years, according to the
terms to which they have been elect-
ed. Every two (2) years there shall
be elected a member or members or
the Council for the term of three (3)
years to succeed those whose terms
of office will expire the first Monday
in April, following such election,
and there shall also be elected at
such regular bziennial municipal
election a member or members of
the council for a term of three (3)
years to succeed those whose termb
will expire one year after the firs.
Monday in April following such elec-
tion. The time when each
date for councilman shall begin his
term of office shall be specified un-
der his name on the ballot, and all
petitions for nominations of mem-
bers of the Council, to be voted for
at such regular biennial election,
shall specify' the length of the term
of office for which the caadidate
seeks nomination.
Par. 691. Qualification of Council.
Sec. 111. The Councilmen elect for
the two (2) year term shall take
their office on the first Monday in
April following their election, and
the Councilmen elect for the three.
(3) year term shall take their office
one (1) year after the first Monday
in April following the election. Be-
fore assuming office each Council -
,man shall qualify by taking an oath
to support the constitution of the
United States and the constitution
,of the State of Iowa, and to. faithful-
ly and honestly perform the duties
of his office, without fear or favor,
to the best of his ability.
Par. 692. Salary- Contracts. Sec.
IV. The members of the Council
shall serve and perform all of the
duties of their office without com-
pensation and no Councilman shall
be interested directly or indirectly
in any contract with the City, nor
shall he receive any benefit or thing
of value from such contract.
Par. 693. Powers. Sec. V. The
Council shall have, possess, and may
exercise all executive, legislative and
judicial powers conferred by law
upon Councils of cities of the first

class, except only such powyers as
are expressly conferred upon the
Manager, or those which are inci-
dental thereto, and such other pow-
ers as the Council, by resolution, or-
dinance or motion may delegate to
the Manager or some other officer
or committee.
Par. 694. Meetings. Sec. VI. Reg-
ular meetingsc of the Council shall
be held on the first Monday of each
month and special meetings may be
called from time to time by two (2)
councilmen. All meetings, whether
regclar or special, shall be open to
the public. If a regular meeting day
falls upon a legal holiday, the meet-
ing shall be held on the day follow-
ing. The Council shall prescribe
rules and regulations for the con-
duct of the business of the meetings.
Par. 695. Quorum. Sec. VII. Three
members of the Council shall consti-
tute a quorum for the transaction
of business.
Par. 696. Pcblication. Sec. VIII.

ORDINANCE NUMBER 93.
An ordinance providing for the
election of Mayor and Mayor pro -
tem and prescribing his powers and
duties.
Be it Ordained by the City Coun-
cil of the City of Dubuque:
Par. 679. Election of Mayor-
Mayor Pro -Ttem. Sec. 1. The Coun-
cil shall organize itself into a work-
ing body at the first meeting follow-
ing the regular biennial election and
at the first meeting at which newly
elected members qualify and assume
their positions in the council. The
Council shall elect one of their num-
ber as chairman and presiding of-
ficer who shall be designated as Ma-
yor of the City. If at any meeting,
the presiding officer or Mayor be not

present, the members of the Coun-
cil present shall select one of their
number to act as presiding officer
pro - tempore, and his act as presiding
officer pro - tempore shall have the
same force and legality as though
perforined by the regularly elected
presiding officer of the Council.
Par. 698. Powers and Duties. Sec.
II. The Mayor shall be recognized
as the official head of the City, :by
the courts and officers of the State,
upon whom= service of civil process
may be made. He may take com-
mand of the polite and govern the
city by proclamation at tomes of
public danger, or during any emer-
gency, and shall be the judge as to
what constitutes Such public danger
Or emergency. He shall also per-
form such duties as the election laws
of the State impose' upon the Mayor
of the City. He shall sign all bonds,
deeds to real estate, mortgages and
releases. He shall sign and execute
all public improvement contracts,
provided, however, that the council
may delegate the power to sign and
etedtite such improvement contracts
to the Nfanager, whose acts shall
then be taken as the acts of the
Mayor for and on behalf of the city.
The election of a member of the
Council as Mayor shall not give liln
or confer upon him any additional
power or authority, except such as
hereing provided and such as is or-
dinarily exercised by a presiding of-
ficer.
Par. 699. Publication. Sec. III.
This ordinance shall be in force and
effeet ten days from and after its
final passage by the City Council
and publication in the official new
papers of the city as provided by law.

RESOLUTION OF NECESSITY
Be it resolved by the City Council
of the City of Dubuque that it be
deemed necessary and advisable to
improve the South side of Valeria
street with cement curb and gutter
and 4 ft. cement sidewalk from Lot
4, Cushing's Addition, to west lot
line of Lot 1 of 1 of Lot 145, L. H.
Langworthy's Addition.
Said work to be done in accord-
ance with the plans and specifica-
tions to be prepared by the City En-
gineer. The cost and expense of
said improvement will be assessed
against all orf the property subjject
to assessment for the improvement
as provided by law.
Be it further resolved that the
above and foregoing improvement is
hereby proposed to be made and
' constructed as hereinbefore set forth
and that this proposed resolution
(except this paragraph) be and the
same is hereby set down for further
and final hearing consideration and
determination at a meeting of the
City Council to be held on the 16th
day of August, 1920, at 4:30 p. m.,
in the Council chamber and that the
City Clerk be and he is hereby in-
structed to cause notice of the pend-
ency of the above resolution and the
time and place when and where said
proposed resolution and the time
and place passage and objections
heard, to be given by publication in
the official newspapers of the city,
in the manner and for the time pro -
:vided by law.
The above resolution was approv-
ed and ordered placed on file for
final action and the notice of the
pendency ordered given this 22nd
day of July, 1920.
