Gentlemen:
I herewith present a petition ask-
ing for the remission of my taxes
on Lot 79 Union Add., for the year
1919, same to remain a lien against
property. I realize that my assess-
ment for the sewer 011 Cleveland
Avenue, which was reduced to $25.00
is past due, still, I was unable to
make payments during the time
given for same and I ask you to give
me one more year in which to pay
sewer and also to permit me to pay
•for same in six installments which

I will pay bi- monthly. I am a widow
without the necessary means to pay
taxes, or to pay for sewer unless I
can pay for sewer in installments.

stating that he had examined the

tion of the City Manager be ap-
proved and the work be done. Sec-

bucket guides, etc., for the sum of

Resolution of Necessity for Sewer.
Be it resolved by the City Council
of the City of Dubuque that it be
demmed necessary and advisable to
construct a sanitary sewer in Lin-
coln avenue and Fifth avenue as fol-
lows, to -wit: An eight -inch tile
sanitary sewer in Lincoln Avenue
from the manhole in Second Avenue
to Fifth Avenue and in Fifth Avenue
from Lincoln avenue to a point about
250 feet northwesterly.
Said sewer to be provided with
manholes and any other appurten-
ances that may be necessary.
Said sewer to be constructed in
accordance with the plans and speci-
fications prepared by the City Engi-
neer and now on file in the office of
the City Clerk having been duly ap-
proved by the City Manager and by
the State Board of Health.
That the cost and expense of mak-
ing and constructing said sanitary
sewer shall be assessed against the
property abutting upon the same and
also against all adjacent property
benefited thereby.
Be it further resolved, that the
above and foregoing sanitary sewer
is hereby proposed to be constructed
as hereinbefore set forth, and that
this proposed resolution except this
paragraph, be and the same is here-
by set down for further and final
hearing, consideration and determi-
nation at a meeting of the City Coun-
cil to be held August 23, 1920, at
4:30 o'clock p. in., and that the City
Clerk be and he is hereby instructed
to cause notice of the above resolu-
tion, and of the time and place when
and where said proposed resolution
will be considered for passage, and
objections to the passage thereof and
to the construction of said sanitary
sewer heard, to be given by publica-
tion in the official newspapers of the
City of Dubuque in the manner and
for the time provided by law.
The above resolution was approv-
ed and ordered placed on file for
finual action, and notice of the pen-
dency thereof ordered given this 2nd
day of August, 1920.

Whereas, 011 June 28, 1920, the
City Council of the City of Dubuque
by resolution authorized the issu-
ance of 154 bonds, 153 for $300.00
each and one for $79.59, numbereu
from 6196 to 6349 both inclusive, to
pay for the improvement of Grand-
view Avenue from the south prop-
erty line of Delhi Street to the north

property line of Dodge Street and,
Whereas, the cost of said improve-
ment amounted to $35,379.59 and the
issuance of bonds authorized through
error amounted to $45,979.59 or
$10,600.00in excess of the cost of the
improvement, now therefore,
Be it resolved by the City Council
of the City of Dubuque, that those
bonds issued in excess of the amount
required for the payment of cost of
the improvement of Grandview Ave -
from Delhi Street to Dodge gtreet,
numbered from 6314 to 6349 in-
clusive, be cancelled, leaving 117
bonds for $300.00 numbered from
6196 to 6312 inclusive and one for
$279.59 numbered 6313 to pay for
the cost of the improvement.

ORDINANCE NUMBER 94.
n ordinance requiring all Rail-
road Companies operating and main-
taining tracks over, upon and across
streets, avenues, alleys and high-
ways within the City of Dubuque to
maintain the space at crossings and
upon the right -of -way in proper state
of repair and requiring them to im-
prove such crossings and right -of-
way with such material as the
'Council or Manager may direct and
approve, and providing the payment
thereof.
Be it ordained by the City Coun-
cil of the City of Dubuque:
Par. 700. Section 1. That when-
ever the Council or Manager shall
consider repairs necessary upon
street, avenue or alley crossings os
right -of -ways occupied by any rail-
road Company operating within the
City of Dubuque, said Council or
Manager shall notify said company
to make the required repairs, Which
notice may be served upon or mailed
to any officer of said company and
shall state the time and place when
and where such repairs shall be made
and prescribe the materials with
which such repairs shall be con-
structed.
Par. 701. Section II. All repairs
ordered made by the Council or
Manager shall be fully performed
without delay at the expense of the

company so notified. However,
should repairs be ordered and not
made by any company the Council
or Manager shall proceed to have
said repairs made and the expense
thereof shall be charged to said com-
pany and collected, if necessary, by
suit in any court of competent juris-
diction.
Par. 702. Section III. The manner
in which such repairs shall be made
and the materials to be used shall
be designated by the Manager and
the work shall be performed under
the supervision of the Manager and
the Engineer.
Par. 703. Section IV. Whenever
repairs are ordered to be made at
any crossing which is used by more
than one railroad, each railroad
shall bear such a proportion of the
expense thereof as the amount of
space occupied of said railroad bears
to the whole amount of repairs or-
dered, and the Manager shall deter-
mine the amount of repairs which
each road shall make and his deci-
sion shall me final.
Par. 704, Section V. Wherever
previous grants to Railroad Com-
pa e ies prescribing the manner in
ich repairs at railroad crossings
shall be made which are in conflict
herewith, the same are hereby re-
pealed and the provisions of this
ordinance are intended to supersede
the same.
Par. 705. Section VI. This ordi-
nance being deemed urgent and of
immediate importance, it shall take
effect and be in force from and after
its passage by the City Council and
publication as required by law.

A Resolution.
Be it resolved by the City Council
of the City of Dubuque, that persuant
to a Resolution duly passed by the
City Council it is hereby ordered
that the improvement described in
said Resolution providing for the
c onstruction of an eight -inch tile
Sanitary Sewer in Sanford Avenue
from the manhole at Queen Street
to a point about two hundred and
fifty feet east, be and the same is
hereby ordered constructed. -
Be it further resolved that the
City Clerk be and he is hereby in-
structed to advertise for proposals
for the construction of the improve-
ment above described, the said im-
provement to be constructed in strict
accordance with the plans and speci-
fications therefore prepared by the
City Engineer, approved by the City
Manager and State Board of Health
and now on file in the office of the
City Clerk, the work to be com-
pleted on or before the 20th day of
September, 1920.
The cost and expens of said work
as is by law assessable against the
property abutting upon or adjacent
to said improvement will be as-
sessed, and payment will be made
to the contractor to the amount of
the assessment out of funds to be
created by the sale of sewer bonds
to be issued in anticipation of the
collection of said special assessment
under the provisions of Chapter 8
Title V of the Code of Iowa, and
amendments thereto; any any de-
ficiency between the amount of the
contract price and the amount of
said bonds will be paid from the
proceeds of a special tax to be
levied under the provisions of Sec-
tion 831 of the Code of Iowa, in an-
ticipation of which bonds will be is-
sued under provisions of Section 912

the requirements of Section 1056 -
b23 of the Supplement to the Code
of Iowa, 1915. The Mayor having

hereby proposed to be made and
constructed as hereinbefore set forth
and that this proposed resolution

on the 22nd day of July, 1920, and
duly passed on the 16th day of

that the improvement described in
said resolution of necessity provid-
ing for the improving of the south
side of Valeria Street from Lot 4
Cushing's Addition, to the west lot
line of Lot 1 of 1 of Lot 145 L. H.
Langworthy's Addition, by curb and
guttering with a combination cement
curb and gutter and constructing a
four foot cement sidewalk along
said portion of said street, be and

property abutting upon or adjacent
to said improvement will be as-
sessed, and payment will be made
to the contractor to the amount of
the assessment out of funds created
by the sale of Street Improvement
Bonds to be issued in anticipation of
the collection of said special assess-
ment under provisions of Chapter 8,
Title V of the Code of Iowa, and
amendments thereto; and any de-
ficiency between the amount of the
contract price and the amount of
said bonds will be paid from the
proceeds of a special tax to be
levied under the provisions of Sec-
tion 830 of the Code of Iowa, in an-
ticipation of which bonds will be
issued under the provisions of Sec-
tion 912 of the Code of Iowa and
Section 912 -A of the Code Supple-
ment.

A Resolution.
Whereas, the contract heretofore
entered into by the City of Dubuque
for the improvement of Cushing
Place hereinafter described has been
icompleted and the City Engineer has
computed that the cost and expense
of said improvement amounts to
$1,228.17,
Therefore, be it resolved by the
City Council of the City of Dubuque
that to provide for the cost of im-
proving Cushing Place from the
south property line of Valeria Street
to the north property line of Kauf-
man Avenue, there be issued Street
Improvement Bonds to the amount
of $1,228.17; said bonds shall be is-
sued under Chapter 8, Title V of the
Code of Iowa and amendments there-
to, shall bear date as of the 16th
day of September, 1920, shall be of
the denominations of $200.00 each,
except that there shall be one Bond
of the amount of $28.17; they shall
be numbered from 6393 to 6399 both
inclusive and shall be divided into
seven series, of which the bond
numbered 6393 shall constitute the
first series and shall be payable on
the first day of April, 1921; the bond
numbered 6394 shall constitute the
second series and shall be payable
on the first day of April, 1922; the
bond numbered 6395 shall constitute
the third series and shall be payable
on the first day of April, 1923; the
bond numbered 6396 shall constitute
the fourth series and shall be pay-
able on the first day of April, 1924;
the bond numbered 6397 shall con-
stitute the fifth series and shall be
payable on the first day of April,
1925; the bond numbered 6398 shall
constitute the sixth series and shall

An Ordinance establishing the en-
tire City of Dubuque into one sani-
tary and road district, for the pur-
pose of oiling, sprinkling, flushing
and cleaning of streets, avenues and
alleys, presented. Councilman Brede
moved that this be considered the
first reading of the ordinance. Sec-
onded by Councilman Gabriel. Car-
ried by the following vote.

Resolution.
Whereas, in 1916 the City Council
ordered the improvement of Clay
Street, Eighteenth Street and Couler
Avenue from the North property line
of Third Street to the north property
line of Twenty- second street; and
Whereas, said improvement was
constructed by C. B. McNamara Com.
pany, Contractor, and said work was
completed and accepted by the Coun-
cil in 1917; and
Whereas, several persons whose
property was charged with special
assessments to pay said improve-
ment appealed therefrom to the
District Court of Dubuque County,
Iowa, and in July, 1920, said action
was determined by said Court and a
decree rendered by the terms of
which the appellants were granted
reduction upon their assessments
amounting to fifty (50) per cent
thereof, providing, however, that
said assessments, as thus reduced,
be paid on or before the 19th of
August, 1920; and
Whereas, some persons who were
parties to said action paid their as-
sessments in full before said action
was decided in order to remove the
cloud created thereby and making
it possible for them to give clear
title to purchasers, or for other
reasons, while others who were not
parties to said action either paid in
full or in part or not at all; and
Whereas, it is the desire of the
City Council to make an equitable
and just settlement with all parties
affected by the assessment for said
improvement in order to close up
said assessment upon the books of
the City,
Be it, therefore, resolved that the
following plan be adopted:
1. That all persons who paid their
assessment in full before delinquent,
whether they were parties to the
suit or not, a refund be granted
amounting to fifty (50) percent of
such payment without interest there-
on, and a warrant be drawn in their
favor on the Treasurere for said
amount.
2. That all persons who paid their
assessment in part be granted a re-
duction of fifty (50) percent upon
their entire assessment and they be
required to pay interest at the rate
of six percent (6 %) per annum upon
their assessment as thus reduced
from the date of the last payment.
3. That all persons who have
paid no part of their assessment and
who were not parties to the suit, be
granted a reduction of fifty (50)
per cent upon their assessment, but
be required to pay interest upon the
assessment as reduced from the date
of acceptance of the work at the
rate of six per cent (6 %) per annum.
IV. That inorder to receive the
benefit of the reduction herein pro-
posed, all assessments must be paid
on or before the 23rd day of Septem-
ber, 1920, and if the assessments are
not then paid no reduction will be
allowed and the entire assessment
shall be collected and the Treasurer
is hereby instructed to notify all
persons of the action of the Council,
and if any person fail themselves of
the privileges hereto provided for
within the time prescribed, it shall
be the duty of the Treasurer to
certify all such unpaid assessments
to the County Auditor to be by him
certified to the County Treasurer
for collection by sale of the property
affected thereby.

sanitary sewer in Lincoln Avenue
from the manhole in Second Ave-
nue to Fifth Avenue and in Fifth
Ave from Lincoln Avenue to a point
about 350 feet northwesterly.
SAID SEWER TO BE PROVIDED
WITH manholes and any other ap-
purtenances that may be necessary.

D ` ORDINANCE NUMBER 94.
An ordinance requiring all Railroad
companies operating and maintaining
tracks over upon and across streets,
avenues, alleys and highways within
the City of Dubuque to maintain the
space at crossings and upon the right
of way in proper state of repair and
requiring them to improve such
crossings and right of way with such
material as the Council or Manager
may direct and approve, and provid-
ing the payment thereof.
Be it Ordained by the City Council
of the City of Dubuque:
Par. 700. *3ection 1. That when-
ever the Council or Manager shall
consider repairs necessary upon
street, avenue or alley crossings or
right of ways occupied by the Rail-
road company operating within the
City of Dubuque, said Council' or
Manager shall notify said company
to make the required repairs, which
notice may be served upon or mailed
to any officer of said company and
shall state the time and place when
and where such repairs shall be
made and prescribe the materials
with which such repairs shall be con-
structed. -
Par. 701. Section II. All repairs
ordered made by the Council or Man -'
ager shall be fully performed withorat
delay at the expense of the company
so notified. However, should repairs
be ordered and not made by any com-
pany the Council or Manager ' shall
proceed to have said repairs made
and the expense thereof shall be

charged to said company and collect-
ed, if necessary, by suitjjany court
of competent jurisdiction.
Par. 702. Section III. The manner
in which such repairs shall be made
and the materials to be used shall be
designated by the Manager and the
work shall be performed under the
supervision of the Manager and the
Engineer.
Par. 703. Section IV. Whenever re-
pairs are ordered to be made at any
crossing which is used by more than
one railroad, each railroad shall bear
such proportion of the expense there-
of as the amount of space occupied of
said railroad bears to the whole
aniount of repairs ordered, and the
Manager shall determine the amount
of repairs which each road shall
make and his decision shall be final.
Par. 704. Section V. Wherever
previous grants to Railroad compan-
ies prescribing the manner in which
repairs at railroad crossings shall be
madew hich are in conflict herewith,
the same are hereby repealed and
the provisions of this ordinance are
intended to supersede the same.
Par. 705. Section VI. This ordi-
nance being deemed urgent and of
immediate importance it shall take
effect and be in force from and after
its passage by the City Council and
publication as required by law.

\Whereas, The City of. Dubuque,
in the County of Dubuque, State of
Iowa,, is a municipal corporation,
duly `organized and existing under
and by\ virtue of the laws and con -
stitution the State of Iowa; and
Whereas, The Connell of said
city heretofore, pursuant to the pro-
visions of law applicable thereto,
duly adopted and purchased certain
voting machines' to be used in and
by said city; and
Whereas, The cost of said voting
machines are to be paid at the gen-
eral expense of the city and from
the General Fund, such provisions
having not yet been made; now
