working for the City, presented.

accordance with your instructions
bids were duly received at 10:00
a. m. Tuesday, September 7, for im-
proving Pfotser Street between
Queen Street and Windsor Avenue,
by grading, placing curb and gutter
and by paving with tarvia filled
macadam. Approximately quantities,
465 lineal feet of curb and gutter
and 327 square yards of macadam.
The following bids were received,
each bid accompanied by a certified
check for $300.00. Frank Beutin,
grading $35.00, curb and gutter, $1.11
per lineal foot, tarvia macadam $1.81
per square yard; Dorgan & Ulrich,
grading $45.00, curb and gutter $1.40
per lineal foot, tarvia macadam $2.32
per square yard; N. J. Staner, grad-
ing $49.00; curb and gutter $1.85 per
lineal foot, tarvia macadam $2.25
per square yard; J. J. Leonard, grad-
ing $40.00, curb and gutter $1.85 per

per square yard. I would respect-
fully recommend the acceptance of
the proposal as submitted by Frank

accordance with your instructions
bids were duly received at 10:00 a.
m. on Tuesday, September 7, for the
construction of a sidewalk and curb
and gutter on Valeria Street. Ap-
proximate estimate, 763 lineal feet
of curb and gutter and 2,500 square
feet of sidewalk. The following bids
were received, each bid being accom-
panied by a certified check for
$100.00. Frank Beutin, curb and
gutter, $1.11 per lineal foot, side-
walks .$21 per square foot, N. J.
Staner, curb and gutter $1.27 per
lineal foot, sidewalks $.19 per square
foot; Dorgan & Ulrich, curb and
gutter $1.30 per lineal foot, side-

Report City Manager Carr: In ac-
cordance with your instructions bids
were received at 10:00 a. m. Tues-
day, September 7, for the construc-
tion of an eight inch sanitary sewer
with manholes in Sanford Avenue,
north from Queen Street for a dis-
tance about 150 feet. The following
bids were received, a certified check
for $100.00 accompanying each pro-
posal: J. M. Kenety & Son, sewer
$1.60 per lineal foot, manholes $50.00;
James Street, sewer $1.80 per lineal
foot, manhole $60.00; Oliver Kringle,
sewer $2.55 per lineal foot, manhole
$55.00. Recommending the accept-
ance of the bid of J. M. Kenety &I
Son. Presented. Councilman Brede
moved that the recommendation be
accepted and the contract be award-
ed to J. M. Kenety & Son. Second-
ed by Councilman Gabriel. Carried

Report City Manager Carr: In ac-
cordance with your instructions bids
were duly received for the construc-
tion of an eight inch sanitary sewer
in Lincoln Avenue from Second
Avenue to Fifth Avenue and in Fifth
Avenue for a distance of approxi-
mately 350 feet west of Lincoln Ave-
nue. The work includes about 1,662
lineal feet of sewer and seven man-
holes. The following bids were re-
ceived, each bid being accompanied
by a certified check for $300.00:
James Street, sewer $2.60 per lineal
foot, manholes $75.00 each; Oliver
Kringle, sewer $2.85 per lineal foot
manholes $55.00 each. I was ad-
vised by the County Supervisors
that they would need this sewer by
December 1st, next, in order to take
care of the new Tuberculosis Hos-
pital. I would therefore recommend
the acceptance of the proposal a
submitted by James Street and the
awarding of the contract to him, in
case the County Supervisors advise
that they are willing to pay one -third
of the cost of constructing this
sewer and appurtenances. Council-
man Brede moved that the recom-
mendation be approved and the con-
tract awarded to James Street. Sec-
onded by Councilman Gabriel. Car-
ried by the following vote.

City Council, Dubuque, Iowa.
Gentlemen:—
Under the laws of the State of
Iowa, the contractor for any public
work must give a bond in an amount
equal to the amount of the contract
for the carrying out of the provisions
of the contract, and must also, in
the case of contracts for street im-
provements or sewer construction
give a maintenance bond for a period
of four years, the amount of which
is to be fixed by the City Council.
Our regular sewer contract calls for
the retention, for a period of one
year, of 5% of the amount due under
contract. Also, in the case of sewer
construction, I can see no possible
reason for giving of a maintenance
bond for a period of four years. My
recommendation, therefore, is that
the City Council in awarding a con-
tract for sewer construction, either
today or any future time, stipulate
that an amount equal to 5% of the
amount of the contract be retained
for four years. This retained per-
centage to be held in lieu of any
other maintenance bond for sewer
work. This recommendation is made
after consultation with the City At-
torney, who advises that such a re-
tained percentage may be agreed
upon by the City Council and fixed
as the amount of the maintenance
bond, thereby eliminating an un-
necessary expense to the contractor
in connection with sewer work,
which by the contractor is undoubt-
edly passed on to the public who
finally paiy for the cost of this work.

I have had the work examined in
connection with the construction of
the sanitary sewer in Seventh Street
from the end of the present sewer
in said street to the west line of
Lot 12, Block 1$, Dubuque H arbor
Improvement Co.'s Addition, which

work was done by Oliver Kringle,
Contractor. I would respectfully
recommend the acceptance of the
Work and the adoption of the accom-
panying resolution, instructing the
Engineer to prepare a special as-
sessment plan covering this im-
'provement.

A Resolution.
Whereas, Oliver Kringle entered
into a contract with the City of Du-
buque for the construction of a
Sanitary sewer in Seventh Street
from the end of the present sewer in
said street to the west line of Lot
12, Block 13, Dubuque Harbor Co.'s
Addition, and
Whereas, Oliver Kringle has com-
pleted his contract in accordance
with the plans and specifications for
said improvement as shown by the
report of the City Manager.
Now therefore, be it resolved by
the City Council of the City of Du-
buque, that the report of the City
Manager accepting said work be ap-
proved, and the City Engineer be and
he is hereby instructed to prepare a
plat and schedule showing the par-
cels of real estate subject to assess-
ment for the construction of said
sewer and file the same in the office
of the City Clerk subject to public
inspection. The City Clerk shall
upon receipt of such plat and sched-
ule publish the notice of said special
assessment as required by law.

Resolution of Necessity for Sewer.
Be it resolved by the City Council
of the City of Dubuque that it be
deemed necessary and advisable to
construct a sanitary sewer in Leib-
nitz Street as follows, to -wit: An
eight -inch sewer in Leibnitz Street
from Hempstead Street to Clifford
Street, said sewer to be provided
with manholes, laterals and any
other appurtenances that may be
necessary.
Said sewer to be constructed in ac-
cordance with the plans and Speci-
fications prepared by the City En-
gineer and now on file in the office
of the City Clerk, having been duly
approved by the City Manager and
forwarded to the State Board of
Health for its approval.
That the cost and expense of
making and constructing said Sani-
tary sewer shall be assessed against
the property abutting upon the same
and also against all adjacent prop-
erty benefited, thereby.
Be it further resolved that the
above and foregoing sanitary sewer
is hereby proposed to be constructed
as hereinbefore set forth, and that
this proposed resolution, except this
paragraph, be and the same is here-
by set down for further and final

hearing, consideration and deter-
mination at a meeting of the City
Council to be held September 30th,
1920, at 4:30 o'clock p.m. and that
the City Clerk be and he is hereby
instructed to cause notice of the
above resolution, and of the time
and place and when and where said
proposed resolution will be consider•
ed for passage, and obpections to
the passage thereof and to the con-
struction of said sanitary sewer
heard, to be given by publication in
the official newspapers of the City
of Dubuque in the manner and for
the time provided by law.
The above resolution was ap-

for final action, and notice of the
pendence thereof ordered given this

Gentleman: I herewith submit
copy of certificate to the County
Auditor and Board of Supervistors
of Dubuque County, Iowa, of the
taxes voted and levied for the year
1920 and all of the taxable property
of the city of Dubuque subject to
general taxation, also attached re-
ceipt signed by the County Auditor
for the same and would respectfully

A RESOLUTION.
Be it resolved by the City Council
of the City of Dubuque, that pur-
suant to a resolution of Necessity,
proposed at a meeting of this Council
on the 23rd day of August 1920, and
duly passed and approved on the 15th
day of September, 1920 it is hereby
ordered that the improvement de-
scribed in said Resolution of Neces-
sity providing for the construction
of an eight inch tile sanitary sewer
in West Fourteenth Street from
North Glenn Oak Avenue to the Alley
first east of Mt. Pleasant Avenue be
and the same is hereby ordered con-
structed.
Be it further resolved that the
City Clerk be and is hereby instruct-
ed to advertise for proposals for the
construction of the improvement
above described, the said improve-
ment to be constructed in strict ac-
cordance with the plans and specifi-
cations thereof, prepared by the
City Engineer, approved by the City
Manager adn State Board of Health
and now on file in the office of the
City Clerk, the work to be complet-
ed on or before the let day of
November 1920.
The cost and expense of said work
as is by law assessable against the
property abutting upon or adjacent
to said improvement will be assessed,
and payment will be made to the
contractor to the amount of the as-
sessment out of funds to be created
by the sale of sewer bonds, to be is-
sued in anticipation of the collection
of said special assessment under the
provisions of Chapter 8 Title V of
the Code of Iowa, and ammendments
thereto; and any deficiency between
the amount of the contract price and
the amount of said bonds will be
,paid from thep roceeds of a special
tax to be levied under the provisions
of Section 831 of the Code of Iowa,
in anticipation of which bonds will
be issued under the provisions of
Section 912 of the Code of Iowa and
Section 912 A. of the Code Supple-
ment.

As suggested in communication at
the last meeting of the City Council
certain of the City's working funds

are already practically depleted.
This is a contingency which is not
recognized as a possibility by any
State law. The City is not allowed
to incur any indebtedness, unless
the funds are available to meet the
charge. Neither is the City author-
ized to borrow money for payment
for any current bills. The City has
money in the general fund sufficient
at least, to last until December 1.
I have, therefore, instructed the
City Auditor to overdraw accounts
as may be necessary in order to
meet current bills. Our only care
will be that sufficient moneys are in
the general fund with which to
meet the various over drafts as pre-
sented. At a later time as money
shall be received transfers should
be made to take care of any funds
which in the meantime may have
been overdrawn. In the past the
City has niet similar contingencies
by going to the banks and borrow-
ing money and paying the current
rate for money as required. This
old method of borrowing money is
not legalized by Statute. Further-
more by permitting overdrafts when
necessary and utilizing all the
money in the general fund to meet
these various overdrafts, the city
will save a defference between 2%
per annum, which she has paid on
bank balances and the current rate
which she would be required to pay
if the money was borrowed at a
local bank. I am writing the Council
of this action for their approval and
in order that it be made a matter
of record.

Gentlemen: —
The statement of the City Treasur-
er's for the month ending Septem-
ber 1, discloses the following facts
regarding certain funds. The debt
sinking fund has to its credit $16,-
268.11; the regular bonded debt sink-
ing fund has to its credit $197.10;
the water works bonded debt fund
has to its credit $574.98; the old
water works debt fund has to its
credit $337.16. After conference with
the City Solicitor, I directed that the

City Treasurer carry the funds now
credited to the debt sinking fund
and the regular bonded debt sinking
fund under one account, called the
general debt and interest sinking
fund. Also, the City Treasurer was
instructed to transfer moneys in the
water works bonded debt fund and
in the old water works fund to the
general funds of the City, and also
any moneys which accrue to these
funds in the future to be credited to
the proper funds immediately with
these directions. The above trans-
fers are authorized directly by law.
I am writing you this letter for your
approval and in order that the
above transfers be made a matter
of record.

Meeting called by order of Mayor
Alderson and Councilman Brede.
Council met at 5:00 p. m.
Councilman Melchior in the chair.
Present —City Manager Carr, Coun-
cilmen Gabriel, Melchior, Rooney.
Absent —Mayor Alderson, Council-
man Brede.
Councilman Rooney moved that
Councilman Melchior act as Chair-
man of this meeting. Seconded by
Councilman Gabriel. Carried by the
following vote.
Yeas— Councilmen Gabriel, Mel-
chior, Rooney.
Nays —None.
Absent —Mayor Alderson, Council-
man Brede.
Chairman Melchior read the call
and reported that service thereof
had been duly made, and stated that
this meeting is called for the pur-
pose of levying a special assessment
for the improvement of Grandview
Avenue from the north property line
of Dodge Street to the south line of
Lot 11, Block 5, Grandview Park
Addition, and acting on any other
business that might properly come
before a regular meeting of the City
Council.
Notice certified to by the publish-
ers of the City Council's intention
to levy a special assessment to pay
for improving Grandview Avenue
from the north property line of
Dodge Street to the south line of
Lot 11, Block 5, Grandview Park
Addition, presented. Councilman
Gabriel moved that the notice be
received and filed. Seconded by
'Councilman Rooney. Carried by the
following vote.
Yeas — Councilmen Gabriel, Mel-
chior, Rooney.
Nays —None.
Absent —Mayor Alderson, Council-
man Brede.
Remonstrances against the amount
of the assessment for the improve-
ment of Grandview Avenue from
Dodge Street to South Dodge Street,
John J. Curran, Mary C. Mullen, T.
J. Donahue. Also petition signed by
30 property owners asking the City
Council to allow them a reduction
of 30% on said assessment, present-
ed. Councilman Gabriel moved that
the rules be suspended for the pur-
pose of allowing any one present to
address the Council. Seconded by
Councilman Rooney. Carried by the
following vote.

Several property owners present
addressed the Council stating that
all they asked was the same reduc-
tion as those on the upper part of
Grandview Avenue received. Coun-
cilman Gabriel moved that all re-
monstrances relative to assessment
on Grandview Avenue be received
and filed. Seconded by Councilman
Rooney. Carried by the following
vote.
Yeas— Councilmen Gabriel, Mel-
chior, Rooney.
Nays —None.
Absent —Mayor Alderson, Council-
man Brede.
Councilman Rooney moved that
the assessment be levied as spread
and the City assume Thirty (30)
per cent of the assessment for the
improvement of Grandview Avenue
from the north property line of
Dodge Street to the south line of
Lot 11, Block 5, Grandview Pork Ad-
dition. Seconded by Councilman
Gabriel. Carried by the following
vote.

Whereas, The contract hereto en-
tered into by the City of Dubuque
for the improvement of Grandview
Avenue hereinafter described has
been completed and the City Engin-
eer has computed that the cost and
expense of said improvement amouns
to $77,260.73.
Therefore, Be is resolved by the
City Council of the City of Dubuque
that to provide for the cost of im-
proving Grandview Avenue from the
north property line of Dodge Street
to the south line of Lot 11, Block 5
Grandview Park Addition, there be
issued Street improvement Bonds to
the amount of $77,260.73. Said bonds
shall be issued upder Chapter 8
Title V of the Code of Iowa and
ammendments thereto, shall bear
date as of the 16th. day of October
1920, shall be o; the denominations
of $300.00 each, except that there
shall be one bond of the amount of

the purpose of defraying the cost of

in the City of Dubuque, and de-
scribed in said resolutions; which
cost is assessabI .. to and levied
along said improvement, and is
made by law a lien on all abutting or
adjacent property, and payable in
seven annual installments, with in-
terest on all deferred payments at
the rate of five per cent per annum,
and this bond is payable only out of
the money derived from the collec-
tion of said special tax, and said
money can be used fo no other pur-
pose.
And it is hereby certified and re-
cited that all the acts, conditions
and things required to be done, pre-
cedent to and for the issuing oif this
series of bonds, have been done
happened and performed, in regular
and due form as required by law
and resolution; and for the assess-
ment, collection and payment here-
on, of sad special tax the full faith
and diligence of the City of Dubuque
are hereby irrevocably pledged.

A Resolution.
Whereas, the contract heretofore
entered into by the City of Dubuque
for the construction of a sanitary
sewer in Seventh Street hereinafter
described has been completed and
the City Engineer has computed that
the cost and expense of the said im-
provement amounts to $2,340.77.
Therefore, be it resolved by the
City Council of the City of Dubuque:
That to provide for the cost of con-
structing. a sanitary sewer in Sev-
enth Street from the end of the
present sewer in said Street to a
point opposite the west line of Lot
12 in Block 13, Dubuque Harbor Im-
provement Co.'s Addition, there be
issued Sewer Bonds to the amount
of $2,340.77. Said bonds shall be is-
sued under Chapter 8, Title V of
the Code of Iowa and amendments
thereto, shall bear date as of the
30th day of' October, 1920, shall be
in denominations of $300.00 each, ex-
cept that there shall be one bond of
the amount of $240.77; they shall be
numbered from 6658 to 6665 both in-
clusive and shall be divided into
seven series, of which the bond
numbered 6658 shall constitute the
first series and shall be payable on
the first day of April, 1921; the bond
numbered 6659 shall constitute the
second series and shall be payable
on the first day of April, 1922; the
bond numbered 6660 shall constitute

This Bond is one of a series of eight
bonds, seven for three hundred dol-

defraying the cost of constructing a
sanitary sewer in Seventh street from
the end of the present sewer to a

ment Co.'s Addition, in the City of
Dubuque, and described in said
resolution; which cost is assessable
to and levied along said improve-
ment, and is made by law a Hen on
all abutting or adpacent property,
and payable in seven annual instah-
ments, with interest on all deferred
payments at the rate of five per
cent per annum, and, this bond is
payable only out of the money de-
rived from the collection of saia
special tax, and said money can be
used for no other purpose.
Andit is hereby certified and re-
cited that all the acts, conditions
and things required to be done,
precedent to and in the issuing of
this series of bonds, have been done
happened and performed in regular
and due form, as required by said
law and resolution; and for the as-
sessment, collection and payment
hereon, of said special tax the full
faith and diligence of said City of
Dubuque are hereby irrevocable
pledged.
In witness whereof, the City of
Dubuque, by its City Council, has
caused this bond to be signed by
its Mayor and countersigned by its
City Clerk, with the seal of said

Be it resolved by the City Council
of the City of Dubuque that it be
deemed necessary and advisable to
construct a sanitary sewer in Leib-
nitz street as follows to -wit: An
eight inch sanitary sewer in Leibnitz
street from Hempstead street to
Clifford street, said sewer to be pro-
vided with manholes, laterals and,
any other appurtenances that may
be necessary.
Said sewer to be constructed in ac-
cordance with the plans and speci-
fications prepared by the city Engi-
neer and now on file in the office of
the City Clerk having been duly ap-
proved by the City Manager and for-
warded to the State Board of Health
for its approval.
That the cost and expense of mak-
ing and constructing said sanitary
sewer shall be assessed against the
property abutting upon the same and
also against all adjacent property
benefited thereby.
Be it further resolved that the
above and foregoing sanitary sewer
is hereby proposed to be constructed
as hereinbefore set forth, and that
this proposed resolution, except this
paragraph, be and the same is here-
by set down for further and final
hearing, consideration and determin-
ation at a meeting of the City Coun-
cil to be held September 30th, 1920,
at 4:30 o'clock P. M. and that the
City Clerk be and he is hereby in-
structed to cause notice of the above
resolution, and of the time and place
when and where said proposed reso-
lution will be considered for passage,
and objections to the passage there-

The cost and expense of said work
as is levied by law assessable against
the property abutting upon or ad-
jacent to said improvement will be

to the contractor to the amount of
the assessment out of funds to be
created by the sale of Sewer Bonds,
to be issued in anticipation of the
collection of said special assessment
under the provisions of Chapter 8,
Title V of the Code of Iowa aria
amendments thereto; and any de-
ficency between the amount of the
contract price and the amount of
said bonds will be paid from the pro-
ceeds of a special tax to be levied

Whereas, knowledge and informa-
tion has come to the City Council of
the City of Dubuque that freight
rates from certain points in the
State of Wisconsin within a radius
of Twenty (20) Miles from the City
of Dubuque upon stone tailings from
the mines are excessive, exorbitant
and wholly prohibitive, due to the
fact that no commodity rate upon
such materials has been fixed by
the Railroad Commissioners of said
State of Wisconsin or the Interstate
Commerce Commission; and
Whereas, the City of Dubuque is
anxious and desirous of using such
materials in large quantities for
street construction and repair work,
but is prevented from doing so by
reason of the high and excessive
freight rate charged thereon, due to
the fact that no commodity rate has
been established; and
Whereas, said Council of the City
of Dubuque believes that if the at-
tention of the proper authorities of
the State of Wisconsin and the
United States be called to this con-
dition a fair and equitable com-
modity rate will be established upon
such materials;
Be it therefore resolved by the
City Council of the City of Dubuque
that the matter of having a fair,
reasonable and equitable commodity
freight rate established upon stone
tailings from the mines in Wisconsin
to Dubuque be presented to the Rail-
road Commissioners of the State of
Wisconsin and to the Interstate Com-
merce Commission and such effort
made and such evidence prepared as
will bring about favorable results.
Be it further resolved that a copy
of this resolution, together with any
other facts as may be considered
necessary, be transmitted to said
Board of Railroad Commissioners of
the State of Wisconsin and to the
Interstate Commerce Commission,
duly certified to, as correct by the

Whereas, the Board of Health of
the City of Dubuque is satisfied upon
Special Session, September 30th, 1920 373
due examination of the building
located upon the North One -Third
(1 -3) of City Lot 556 and used as a
dwelling has become unfit for such
purposes and is a cause of nuisance
or sickness to the occupants thereof
and to the public on account of un-
cleanliness and filth, such property
being owned by W. J. Burns and
W. J. Brown; and
Whereas, said Board of Health is
also satisfied upon due examination
of the building located upon the
Sub -97, the south 42 feet of Lot 1
of L. H. Langworthy's Addition, to
the City of Dubuque; that said build-
ing is unfit for dwelling purposes,
and is a cause of nuisance and sick-
ness to the occupants and public,
due to uncleanliness and filth, said
building being owned by Elizabeth
Justis, and of which C. B. Trewin is
agent.
Be it therefore resolved that the
quarantine officer of the City of Du-
buque be and he is hereby instruct-
ed to issue a notice in writing to the
occupants of said building and their
respective owners and agents, re-
quiring them to put said premises
in proper condition as to cleanliness
and make them fit for habitation
within ten (10) days from the date
hereof.
Be it further resolved that upon
failure to comply with the notice
herein provided for upon the part of
the tenants or owners of said prem-
ises, that the said officer notify said
tenants, owners or agents to remove
from said premises within three
(3) days after the ten (10) days
notice herein provided for shall ex-
pire; and, if such persons thus noti-
fied neglect or refuse to comply with
such notice that said occupants be
removed from said premises by
force, if necessary, and said prem-
ises be closed, and if closed that the
same shall not be occupied again as
a dwelling without written permis-
sion of this Board.

An Ordinance establishing the en-
tire City of Dubuque into the sani-
tary and road district, for the pur-
pose of oiling, sprinkling, flushing
and cleaning of streets, avenues and
alleys.
Be it ordained by the City Council
of the City of Dubuque: Par 714.
City established as one road district:
Sec. One: That .for the purpose of
oiling, sprinkling, flushing and clean-
ing the streets, avenues and alleys,
the city is hereby established as one
road district, and shall be considered
as such by the council and manager
in expending money for the purpose
herein named. -
Par. 715. Tax for,Sec. Two. There
shall be assessed and levied by the
Council each year against all tax-
able property within the corporate
limits of the city a tax not exceeding
two (2) mills on the dollar of the
taxable property within the same,
said tax to be known and designated
as the sanitary road_ fund, and said
fund shall be -kept separate and
used and expended for the purpose
of oiling, sprinkling, flushing and
cleaning of streets, avenues and al-
leys and maintaining the same in a
sanitary and healthful condition.
Said tax shall be assessed, levied'
and collected at the same time and
in the same manner as now provideal
by law for the assessment, levy and
collection of general taxes.

This ordinance shall be in force and
effect Ten (10) days from and after
