Councilman Brede moved that the
Council Proceedings for the month
of July be approved as printed. Sec-
onded by Councilman Gabriel. Car-
ried by the following vote:

Councilman Brede moved that the
rules be suspended for the purpose
of allowing any one present to ad-
dress the Council. Seconded by

Mr. Brokhols, Treasurer of the
Rau Appraisal Co., addressed the
Council, relative to the City Coun-
cil'accepting the Audit and Appraisal
of the Dubuque Electric Co.'s hold-
ings, stating that if the City .hold-
cil saw fit to open and examine the
package delivered to them it will not
obligate the City Council in any
future steps the Rau Co. may take
and Will not be considered an ac-
ceptance of the audit and appraisal,
he also stated that he would notify
the Clayton B. Stiver Co. to make
the same statement to the Council
in writing.
Mr. Meinrad Koch addressed the
Council asking permission to oper-
ate a pea -nut and pop -corn stand
without paying a City License.
Councilman Brede moved that Mein -
rad Koch be allowed to operate a
pea -nut and pop -corn stand without
obtaining a City License. Seconded
by Councilman Gabriel. Carried by
the following vote:

Communication of League of Iowa
Municipalities asking the City Coun-
cil to subscribe $25.00 to help pay
for the services of a representative
of the League to keep the City
posted in regard to bills introduced
in the next Legislature. Present-
ed. Councilman Brede moved that
the communication be referred to
the City Manager with power. Sec-
onded by Councilman Rooney. Car-
ried by the following vote:

Report of City Manager Carr rec-
ommending that assessment be can-
celled against Harry Ahrend for
cutting weeds on Lots 63 and 64,
Woodlawn Park Add., in the sum of
$2.25 as the weeds which were cut
were across the street. Presented.

recommendation of the City Man-
ager be carried out and the Treas-
urer so instructed. Seconded by
Councilman Gabriel. Carried by

Report of City Manager , Carr rec-
ommending that the City accept
$40.00 with interest from date of
levy to the present time for the im-
provement of Muscatine street,
Lots 12 and 13, levied Jan. 15th,
1914, against Joseph Straub, as as-
sessment was in excess of the value
of his property: Presented. Coun-
cilman Brede moved that the report
of the City Manager be approved
and the Treasurer so instructed.

STIPULATION AND AGREEMENT.
Whereas, the Carr, Ryder &
Adams Company, a corporation of
the State of Iowa, doing business, in
the City of Dubuque, has petitioned
the City Council of said City for
permission to construct a . cement
tunnel beneath the surface of Tenth
street connecting their buildings,
the construction of the same to be
done under the supervision of the
City Engineer and according to a
- blue print prepared by said Com-
pany and on file in the office of the
City Clerk, which blue print and
application are made a part hereof,
said tunnel to be used for the lay -
ing of pipes, electric wiring and
such other purposes as may be re-
quired from time to time; and,
Whereas, said Company has also
requested permission from the City
Council to install a private sewer
or drain to be used as a boiler
blow -off in the alley West of its
boiler house and connecting with
the storm sewer in Eleventh street,
said improvement to be installed
under the supervision of the City
Engineer and conform to the blue
print on file with the City Clerk,
which blue print and application
are made a part hereof; and
Whereas, permission has been
granted by the City Council to said
Company to make said improve-
ments;
It is, therefore, stipulated and
agreed by said Company to make

the improvements herein described
in a careful and workman -like man-
ner and comply with all the rules,
regulations and ordinances of. the
City of Dubuque.
Said Company further agrees to
hold the City harmless from any
and all damages which may arise or
be occasioned by reason of the con-
struction of said improvements or
subsequent maintenance.
Said Company further agrees to
so construct said improvements as
not to interfere in any manner with
sewer pipes, water mains on con-
duits now laid and, if sewer pipes,

water mains or conduits shall be
laid in the future in said street or
alley nothing herein shall prevent
the City from laying the same on,
through or under said improvements
and the City shall in no manner be
liable to said Company for damages
it may suffer thereby.
The permission granted to said
Company is understood to have been
granted subject to revocation upon
reasonable notice by the City
Council.

ommending the cancellation of per-
sonal taxes of Leo A. Link for the
years 1918 and 1919 in the sum of
$26.55 as he claims he had no in-
terest in the Lenz & Link shop.

Gentlemen: — Sometime ago au-
thority was given to the City Man-
ager to execute a contract with J.
M. Kenety & Son for the construc-
tion of a sewer in Sanford avenue
with a distance of approximately
150 feet east of Queen street. I
wish to advise that this contract has
been duly executed and filed with
the City Clerk.
A contract was also authorized to
be executed between the City of
Dubuque and James Street for the
construction of a sewer in Lincoln
avenue and Second avenue to Fifth
avenue and in Fifth avenue from
Lincoln avenue to a point about 350
feet west of the same. I wish to
advise that this contract has been
duly executed and •filed with the
City Clerk..
Sometime ago authority was giv-
en to the City Manager to execute
a contract with Frank Beutin for
the improvement of Pfotser street
from Windsor avenue to Queen
street. I beg to advise that this
contract has been duly executed and
filed with the City Clerk.
Sometime ago authority was giv-
en to the City Manager to execute
a contract with Frank Beutin for
the construction of cement curb and
gutter and construction of 4 -foot
cement sidewalk on the south side
of Valeria street, from Lot .4 in
Cushing's Addition to the west line

emy, and is not used for religious,
educational or benevolent purposes.

council.

Gentlemen: According to the pro-
visions of the ordinance passed at
the last meeting of the City Coun-
cil effective on October 9th, the
number of authorized members of
the police force was reduced to 34
men, besides the Chef of Police and
Matron. I beg to advise that in car-
rying out the provisions of this or-
dinance, John McGrath and Hugn
Markey were given an honorable dis-
charge of the Police Department of
the city.

ing that in 1914 when Julien avenue
was improved the Council allowed
a reduction in assessment for the
same, amounting to the assessment
levied for reguttering Julien avenue
in 1909 on Lots 42, 43, 44, 47 and 48
and Lot 1 amounting to $356.30 as-
sessed to Dubuque Women's Club,
also assessment of $39.00 on Lot 49
owned by Margaret Shepley. Rec-
ommending that as the latter assess-
ment was paid in full by both par-
ties, the Treasurer be instructed to
cancel delinquent assessment for
the reguttering of Julien avenue.
Also cancel assessment charged to
the City of Dubuque amounting to
$28.94 for reguttering Julien avenue.

Manager be approved and the -City
Treasurer be instructed to cancel

Report City Manager Carr as fol-
lows: In connection with the de-
linquent taxes on personal property,
I find the following taxes are in
error for the reasons assigned:
Joseph Quigley, 1917 taxes amount-
ing to $4.20, 1918 taxes amounting
to $4.20 and 1919 taxes amounting to
$4.65 should be cancelled as these
taxes were levied on furniture let to
him in 1917 and sold by him in March
of the same year. The Dubuque

died over seven years ago and I am
advised by letter her real estate was

taxes amounting to $8.40, 1919 taxes
amounting to $9.30 should be can-
celled as this Company discontinued
their Dubuque Branch on the 25th

The taxes against Barger & B1ish in
1917 amounting to $1.40, 1918 amount,
ing to $1.40 should be cancelled as
they disposed of their business in
Dubuque several years ago and have
no longer any interest here. I
would recommend that the City
Treasurer be instructed to cancel
all of the above personal taxes, and
also, that the City Assessor be given
a copy of the Clerk's letter to the
Treasurer, in order to 'avoid carrying
forward any of these errors into the

In connection with collection of
taxes on delinquent personal prop-
erty, I find delinquent personal taxes
against A. A. Cooper Wagon and
Buggy Company as follows: 1908
$578.24; 1909, $556.00; 1910, $622.72;
1911, $622.72; 1912, $644.96; 1913
$507.50; 1914, $622.72; 1915, $622.72;
1916, $622.72; 1917, $622.72; 1918,
$622.72, all of the above taxes with
interest on the same remain unpaid
with full knowledge of the company,
as they have refused to pay the
same on request. Personally, I am
unwilling to force the payment of
taxes by those citizens, who can
raise money to pay their taxes only
with great difficulty and then permit
a company that is able to pay their
taxes dodge the payment of their
just and proper share of the cost of
municipal government and therefore,
I am reporting this delinquency to
the City Council in order that the
collection of the above taxes may
be had without delay.

judgment think the following delin-
gllent personal taxes should be can
celled and. the City Treasurer and
the City Assessor advised of the
cancellation and the reasons. Arendt§
Shoe Company, delinquent taxes
from 1915 to 1919 with interest
amountet to $90.10' and should be
cancelled as- this company is report-
ed to have been out of business for
several years.
A. Schwartzberg, taxes of.1918 and
1919 which with interest amounts to
$5.30 should be. cancelled as the same
property is taxed under the name
of the American Shoe Repair. Com-
pany and the taxes have been paid
under that name:
Taxes against Chas. Lute from
1914 to 1919 which with interest
amounts to $89.55 should be can-
celled ..as Chas. Lute has been dead
for seven years.
Taxes against Abe Olansky from
1916. to, 1919 which with interest
amounts to $6.64 should be cancelled
as this - party is cut of business and
has left the city.
Taxes against Josephine Fortman
from 1913 to 1919 which with interest
amounts to $1,136.98 should be can-
celled as this lady is reported to
have no property, the same having
been given to her children several
years ago.

cancelled as this • company is no

amounts to $3.34 should be cancelled
as. this man has been dead for two

Petitioner paid excess under protest

22 ft. of City Lot 78 for the 1918
assessment at $12,000.00, but later
:without notifying petitioners raised
said assessment to $12,780.00. They
paid excess under protest to avoid
having same sold at tax sale. Rec-
ommending that a refund of $25.79
be given to petitioners. On the 1919
taxes they were charged the same
rate but only paid on the original
assessment but did not receive re-
ceipt for same. Recommending that
petitioners be given receipt and cor-
rection made on records. Relative
to petition of Mae R. Lacy for per-
sonal property tax for the year 1919
said tax was paid under protest to
prevent having same sold at tax sale.
Stating that Mae R. Lacy died July
28, 1917, was assessed in 1919 was
not paid, recommending that peti-
tioners should be refunded $36.27
and taxes for 1918 and 1919 should
be cancelled. Also taxation on Min.
Lot 300 and Und. 1 / 2 of Lots 298 and
299 located on Hams Island. Lots
received no benefit from City and
are used for agricultural purposes.
The only tax that can be levied is
Road Tax and Library Tax, Tender
was made for 1918 for Road Tax and
General Tait only, and not Library
Tax, recommending refund. The
amount to be retained representing
the mi lage levied as Road Tax, in-
creased by the proper interest to
'time of payment. In 1919 a tender
of Road Tax only was made, recom-
mending that amount should be
equal to Road and Library Tax with
interest to date of payment„ and
warrants should be drawn covering
all refunds and corrections made on
books, presented. Councilman Mel-
chior moved that the recommenda-
tion of the City Solicitor be accepted,
and the City Treasurer so instructed.

A Resolution.
Wheras, the County Treasurer of
Dubuque County, Iowa, at the regu-
lar December Tax Sale in the year
1920, will offer for sale all real es-
tate upon which delinquent taxes,
general, personal and special, for the
year 1919 and prior years are a lien,
which taxes have been levied by the
City Council of the City of Dubuque
and been duly certified for collection
to said County Treasurer; and
Whereas, there may. be cases
where the total tax due, for various
purposes, with interest and costs
added thereto, may exceed the value
of said real estate as shown by the
Asessor's return, to be made in 1921;
and
Whereas, it is the desire of the
City Council of the City of Dubuque,
not to confiscate property or impose
extraordinary hardship upon the
owner thereof or the taxpayer, to
pay his just and fair share of said
taxes;;
Be it therefore resolved that, in
order to secure prompt payment on
delinquent taxes and to invite per-
sons, firms or corporations, whether
they are the owners of property
upon which such taxes are a lien or
otherwise, to bid, purchase and pay
said taxes, the City Council agrees
to refund to any such person, firm
or corporation, purchasing at tax
sale the amount of tax, interest or
costs actually paid which is in ex-
cess of the actual value of the real
estate upon which the tax was a lien
as shown by the valuation to be
placed by the Assessor for taxation
in the year 1921. Provided, how-
ever, that, in order to be entitled to
such refund, a demand therefor must
be made upon the City Council not
later than August 1, 1921, and such
evidence of payment and other mat-
ters furnished by the taxpayer as
may be required by the City Coun-
cil.

A Resolution.
Whereas, the County Treosurer of
Dubuque County, Iowa, at the regu-
lar December Tax Sale in the year
1920, will offer for sale real estate
upon which delinquent taxes, gen-
eneral, personal and special, for the
year 1919 and prior years are a lien,
which taxes have been levied by
the City Council of the City of Du-
buque and been duly certified for
collection to said County Treasurer;
and
Whereas, it is the desire of the
City Council of the City of Dubuque
to protect any person or persons,
film or corporation who may bid in
and purchase real estate at such Tax
Sale from and loss which he, they
or it may suffer by reason of the ex-
action or payment of a tax or por-
tion thereof which might be found
to have been erroneously or illegal-
ly levied, exacted or paid.
Be it further resolved by the City
Council of the City of Dubuque, that
whenever any tax or portion there-
of, interest or costs, is found to have
been erroneously or illegally levied,
exacted or paid, and such fact has
been established by a Court or Tri-
bunal with competent jurisdiction to
determine the question, the City
Council shall order a refund to be
made to the taxpayer of such tax or
portion thereof, together with all in-
terest and costs actually paid there-
on, found to have been erroneously
or illegally levied, exacted or paid
and shall order a proper warrant
drawn upon the City Treasurer cov-
ering the same, and thereupon all
records shall be corrected accord-
ingly.
In case any real estate sqbject to
taxation shall be sold for the pay-
ment of erroneous tax or costs, the
error or irregularity in the tax may
be corrected at any time by the
City Council, but such correction
shall not effect the validity of the
sale or the right or title conveyed
by a Treasurer's Deed, if the prop-
erty was subject to taxation for any
portion of the taxes for which the
land was sold was levied, and the
taxes were not paid before the sale,
or the property redeemed from sale.
Be it further resolved that should
an action at law or equitrbe brought
questioning the validity of any tax
by any person, firm or corporation,
it is agreed that the City of Du-
buque will defend said action with-
out expense to the purchaser at
such Tax Sale.

Whereas, the improvement of
Grandview Avenue from the North
property line of Dodge Street to the
South property line of Lot, Block 5,
Grandview Park Addition, has been
completed and the cost thereof com-
puted; and
Whereas, a special assessment has
been levied by the City Council of
the City of Dubuque against the
real estate legally subject to assess-
ment to pay for said assessment;

Whereas, such assessment as

Now, therefore, be it resolved by
the City Council of the City of Du-
buque, that the report of the City
Manager recommending the acept-
ance of said work be approved and
that the City Engineer be and he
is hereby instructed to prepare a
plat and schedule showing the par-
cels of real estate subject to assess-
ment for said sewer and file the
same in the office of the City Clerk
subject to public inspection. The
City Clerk shall, upon receipt of
such plat and schedule, publish the
notice of said special asessment as
required by law.

An ordinance fixing the numb
police officers of the City of Du-
buque, reducing the police force to
said number and providing for honor-
able discharges for all police officers
above said fixed number.'
'Whereas, the revenue of the City
of Dubuque available for the use of
paying the salaries of the police
force as now constituted is insuffic-
ient to lia,y current salaries to the
end of the'fiscal year 1920; and
Whereas, i \\order to maintain said
police departm and pay reason-
able salaries therein until the end of
the fiscal year 1920, it is necessary
to reduce the police force to the
number not in excess \of thirty -four
(34) patrolmen and officers, not in-
cluding the , chief of pollee and one
police matron, and to effect\.such re-
cduction it is necessary that certain
police officers be discharged; now
therefore,
Be it ordained by the City Council
1 of the City of Dubuque;
2 Par. Number Fixed. Sec. 1.
hat from and after the 9th day of
October, 1920, and until such time
as the C'ouncil may determine, the
police force of the City of Dubuque
shall consist not in excess of thirty -
four officers and patrolmen, the
chief of police and one police Ma-
tron.

Par. to bring the police force, as
now constituted down to the number
prescribed in Section 1 hereof, it is
necessary to reduce the present
force by the number of men in ex-
cess of said prescribed limit, it is
therefore provided that such reduc-
tion shall be made in the following
manner; —
(a) The Manager shall, in writing
designate the persons to be dis-
charged.
(b) In making such discharges,
the Manager shall take into consid-
eration the length of service, com-
petency and efficiency of such mem-
hers of the police force.
(c) In designating the person to
be discharged the Manager shall be
influenced as far as possible, by the
length of service performed and the
efficiency shown by such discharged
members and, all things being equal,
such men shall be discharged whose
length of service is of the shortest
duration and who have shown the
least efficiency.

(d) Any person discharged under
the provisions of this ordinance
shall receive an honorable discharge,
which shall be recorded upon the of-
ficial Council records.
(e) Any person who is discharged
hereunder and who has paid into the
Policemen's Pension Fund during
the time he was a member of the
police department, shall be entitled
to have paid back to him the amount
of money he actually has contribu,:ed
to 'said fund, said payment to be
made on a warrant drawn upon the
general fund,
