names of avenues and which are
not enumerated herein shall be re-
named streets.
Central Avenue shall be consid-
ered the basic line and all streets
running east and west from Central
Avenue take their directions from
that avenue.
Sec. 2. This ordinance shall be
in force and effect ten (10) days
from and after its final passage by
the City Council and publication in
the official newspapers as provided
by law.

Petition of F! T. Gunn, asking the
City Council to accept $25.00 (half
of regular fee) from him as license
to operate a popcorn stand at the

the reason for this request, present-
ed. Councilman Brede moved that
action be deferred and his state-
ments be investigated by the City
Manager. Seconded by Councilman
Melchior. Carried by the following

City Council, Dubuque, Iowa.
Gentlemen: On October 12, 1916,
there was a special assessment lev-
ied against Lot 13, in Concord's Ad-
dition, for the curbing, guttering and
macadamizing of Coates Avenue,
from Fremont Avenue to Cross
Street. The amount assessed against
this lot for this improvement was
$112.17. On November 19, 1914, the
City Council authorized the Treasur-
er to accept 25 per cent as payment
in full on account of this special as-
sessment. Settlement was not made
at that time.

There are also against this lot de-
linquent general taxes from 1905 to-
date. These general taxes for the
five years prior to 1920, with inter-
est, amount to $11.86; while the gen-
eral taxes for the previous years
without interest amount to $27.45. At
the same time these general taxes
in the years prior to 1909 are levied
on an accessive valuation as they
are reduced $3.80 after 1909.
I would recommend that the City
Treasurer be authorized to accept
$64.00 in full settlement for all taxes,
special and general, as advertised
for sale last December. This would
mean a settlement of the special as-
sessment on the basis as authorized
by the Council in 1914, or $28.04, and
the balance, or $35.96, as payment in
frill on the delinquent general taxes.

Report City Manager Carr, recom-
mending that the pavement between
the street car tracks on Central
Avenue be repaired, presented.
A Resolution.
Whereas, the pavement on Central
Avenue, between Fourth Street and
Eighteenth Street, lying between
the street car tracks, which is a part
of the right -of -way of the Dubuque
Electric Company, is in a dilapidated
condition and in need of immediate
repairs; and,
Whereas, it is deemed necessary
and advisable that said repairs be
made without delay; therefore, z
Be it Resolved by the City Coun-
cil of Dubuque, That the City Clerk
be and he is hereby instructed to no-
tify, in writing, said Dubuque Elec-
tric Company to make all necessary
repairs upon its right -of -way on Cen-
tral Avenue, between Fourth Street
and Eighteenth Street, without de-
lay, under the supervision of the
City Engineer and according to plans
and specifications prepared by said
Engineer.
Be it further resolved that should
said Dubuque Electric Company fail
or refuse to make the repairs herein
stated or fail or refuse to signify its
intention of making said repairs
within ten (10) days from the date
hereof, then the City of Dubuque
shall make such repairs as are neces-
sary by contract or otherwise, and
charge said Company with the costs
thereof.
Be it further resolved that a copy
of this resolution be served upon
said Dubuque Electric Company, to-
gether with the notice herein provid-
ed for.
Be it further resolved that this
resolution being deemed urgent and
of immediate importance, shall be in
force and effect frof and after its
passage by the City Council, as pro-
vided by law.

To the Honorable Mayor and -Coun-
cil of the City of Dubuque.
Gentlemen: The notice of your
intention to require the Dubuque
Electric Company to repair its pave-
ment lying between the rails thereof
on Central Avenue from Fourth
Street to Eighteenth Street, together
with a copy of the resolution duly
passed by you on May 2, 1921, has
been received by me, as General
Manager of said Company, and I
hasten to advise you of the Com-
pany's attitude in this regard.
We are In complete accord upon
the fact that this pavement consti-
tuting the company's right of way is
in a deplorable condition and in
need of immediate repairs. We are
also convinced that these repairs
must be made at once. The only ob-
stacle which prevents immediate ac-
tion upon our part is the matter of
financing the cost of the improve-
ment. We are not in a position to
do this at this time. However, we
have a proposition to make to your
Honorable Body. If the City should
undertake to make these repairs, by
contract or otherwise, and pay for
the same out of its funds, the com-
pany will agree to reimburse the
City for this outlay and pay a rea-
sonable rate of interest upon the ac-
count. The only thing we ask is,
that our payments be deferred and
spread over a period of years, so
that it will not cause too great a
hardship upon us and result in dis-
aster to the community. If this ar-
rangement can be made, the com-
pany stands willing to agree in
writing to waive any legal formality
or proceeding necessary to make a
binding assessment and unequiv-
ocally agree to pay the cost of the
improvement in full. If such an ar-
rangement can be made, we will be
glad to co- operate without delay.

I would respectfully recommend
that the contract for the improve-
ment of Washington Street as above
outlined be awarded to James F.
Lee and that the execution of a con-
tract between the City of Dubuque
and this company be authorized, in-
asmuch as their bid is the lowest
one received for this improvement.

lineal foot; asphaltic macadam,

yard; James Lee Paving Co.: Ce-
ment curb, 90c per lineal foot; re-

yard; paving car tracks, $1.59 per
square yard.

It is an open question as to
whether asphalt or tarvia is the bet-
ter filler for a bituminous pavement.
There are warm advocates for each
material. Personally, everything
else equal, I would be inclined to fa-
vor asphalt filler and yet I am satis-
fied that if properly applied, either
material will give satisfactory re-
sults.
The bid as submitted by James
Saul at $1.29 for asphalt bituminous
macadam is the lowest bid received
for asphalt filler. The bid as sub-
mitted by the Even - Ulrich- Staner Co
at $1.21 for tarvia X macadam is
the lowest bid received for this type
of pavement.
I am submitting the report of
these bids without recommendation.

Be it resolved by the City Council
of the City of Dubuque, that it be
deemed necessary and advisable to
construct a sanitary sewer in alley
between Locust and Bluff Streets; an
six -inch tile pipe sanitary sewer in
the alley between Locust Street and
Banff Street, from the sewer in
Dodge Street to a point about sev-
enty -five feet south of Jones Street.
Said sewer to be provided with
manholes and any other appurten-
ances that may be necessary.
Said sewer to be constructed in
accordance with the plans and speci-
fications prepared by the City Engi-
neer and now on file in the office of
the City Clerk, having been duly ap-
proved by the City Manager and
submitted to the State Board of
Health for their approval.
That the cost and expense of mak-

side the street car tracksk, the gut-
ter excepted, with either sheet -as-
phalt, willite, or bitulithic on the
present macadam foundation, or with
brick block on a concrete foundation
using a bituminous filler, and by
paving that portion lying between
the street car tracks and one foot
outside thereof with brick block on
a concrete foundation, using a bitum-
inous filler.
Said work to be done in accord-
ance with the plans and specifica-
tions to be prepared by the City En-
gineer and approved by the City
Manager. -
The cost and expense of said im-
provement will be assessed against
all of the property subject to assess-
ment for the improvement as is pro-
vided by law.

Gentlemen:
The condition of Bluff Street from
Eighth Street to the intersection
with Locust Street, just north of
Fourteenth Street, is very bad. Last
year I endeavored to repair it with
cold patches, but was not very suc-
cessful.
I am assured that an asphaltic
binder can be lain upon the present
paving and in that way be built up
to a smoother surface and a wear-
ing surface laid upon this surface
at the expense of not to exceed $1.25
per square yard.
I believe that this improvement
should be made during the present
season and would recommend the
adoption of a resolution for the im-
provement of this street.

Gentlemen: I believe that the
City should now make plans for
street improvements for the year
1922, by now making sure that all
lots are connected with sewer, water
and gas and the necessary storm
sewers are in place.
Two streets which I would now
recommend for improvement next
year are White Street from Sixth
Street to Twenty- Second Street and
Twenty -First Street from Central
Avenue to Lincoln Avenue and Linc-
oln Avenue from Twenty -First
Street to Second,Avenue (now Ham-
ilton Street).
Prior to the improvement of White
Street, there should be a necessary
relief sewer constructed in this
street from Sixth Street to Fifteenth
Street in order to divert all the sani-
tary sewerage from the hill district
away from the present main sewer,
which is entirely inadequate to serve
the demands upon it. There should
also be a number of storm water
sewers laid on White Street in order
to take care of the storm water at
this point, instead of letting it flow

Gentlemen: In accordance with
your request, bids were received for
the paying of that portion of Central
Avenue, lying between the rails of
the Electric Company, from the
south property line of Fourth Street
on clown to the railroad. Plans and
specifications with estimates will be
worked out as soon as possible for
covering these improvements, which
will probably have to be financed.
The City Engineer now has plans
practically completed covering the
construction of a storm sewer on
Lincoln Avenue from Kniest Street
to Humboldt Avenue ,now Humboldt
Street). Also the relaying of the
S -inch sewer on Lincoln Avenue from
Johnson Avenue (now Johnson
Street) to Elm Street (at the pres-
ent time the 8 -inch sewer in John-
son Street takes the flow from three
8 -inch sewers at that point, passing
under the Kniest Street sewer by
syphon, runs uphill from there to
the Bee Branch sewer, where it en-
counters another syphon from the
Bee Branch sewer). The 8 -inch sew-
er is inadtequate as well as improp-
erly constructed.
Plans are also practically com-
pleted covering storm water sewers
in Second Avenue (Hamilton Street)
from the river to Lincoln Avenue.
Also a storm water sewer in Ann
Avenue (now Ann Street) from the
river to Lincoln Avenue and in
Lincoln Avenue from ,Ann Street to
Middle Avenue (now Farley Street).
By the construction of these storm
sewers much of the water now find-
ing its way to the Bee Branch sewer
will be diverted to the river. Also
all the water now coming on Lincoln
Avenue will be carried underground,
which arrangement should be made
prior to the improvement of this
street.
I also believe that there are funds
available at the present time set
aside for municipal improvements to
enable these sewers on Lincoln Ave-
nue to be immediately constructed.
I am reporting this matter to the
City Council with the request that
the authority be given to the City
Manager to advertise for bids for
the construction of these sewers, as
soon as the Engineer shall have en-
tirely completed the plans and pre-
pared specifications for the work.

fications for the work as shown by
the report of the City Manager;

proved and that the City Engineer
be and he is hereby instructed to
prepare a plat and schedule show-

velope, as a guarantee that the work
will be entered into if the contract is

Six inch sanitary sewer in Chest-
nut street from the end of present
sewer westerly for a distance of
about 280 feet together with one
manhole.
Also a sanitary sewer in the alley
lying east of Bluff street between
Jones street and Dodge street. Ap-
proximately 473 feet of six inch sew-
er is required with two manholes.

AN ORDINANCE.
An Ordinance repealing an ordi-
nance entitled "An Ordiance relat-
ing to the licensing and regulation
of dogs," the same being Ordinance
Number Seventy -two (72), of the Re-
vised Ordinances of the City of Du-
buque, 1919.
Be it ordained by the City Council
of the City of Dubuque:
Section 1. That an Ordiance en-
titled "An Ordinance relating to the
licensing and regulation of dogs,"
the same being Ordinance Number
Seventy -two (72), of the Revised Or-
dinances of the City of Dubuque,
1919, comprising Paragraphs 519 to
528, both inclusive, be and the sane
is hereby repealed.
Section 2. This Ordinance shall be
in force and effect Ten (10) days
from and after its final passage by
the City Council and publication in
the official newspapers as provided
by law.

Sixty Four (64) of the Revised Or-
dinances of the City of Dubuque of
1919.
Be it ordained by the City Coun-
cil of the City of Dubuque:
Section 1. That an Ordinance en-
titled "An Ordinance to regulate, lic-
ense and tax junk dealers," the same
being Ordinance Number Sixty -four
(64) of the Revised Ordinances of
the City of Dubuque of 1919, and
comprising paragraphs 470, 471, 472
of such Revised Ordinances, be, and
the same is hereby repealed.
Section 2. This Ordinance shall
be in force and effect Ten (10) days
from and after its final passage by

AN ORDINANCE.
An ordinance establishing a grade
on Seventh street from the east
property line of Jackson street to
the west rail of the Chicago, Mil-
waukee and St. Paul railroad tracks.
Be it ordained by the City Council
of the City of Dubuque:
Section 1. That an ordinance es-
tablishing a grade on Seventh street
from the east property line of Jack-
son street to the west rail of the
Chicago, Milwaukee and St. Paul
railroad tracks be and the same is

hereby established and adopted as
shown by the profile of said street
and grade, as prepared by the City
Engineer, being profile No. 1019.

Said grade begins at the east prop-
erty line of Jackson street which is

ORDINANCE NUMBER 72 -A.
An Ordinance relating to the lic-
ensing and regulation of dogs.
Be it ordained by the City Council
of the City of Dubuque:
Par. 519 -A. Shall Procure License.
Sec. No. 1. No person owning or
harboring any dog or bitch within
the city shall allow the same to run
at large, without procuring a license
therefor, which license shall be is-
sued for the term of One (1) year,
on payment of the sum of One Dol-
lar ($1.00) for each dog and Three
Dollars ($3.00) for each bitch.
Par. 520 -A. When Due. Section
II. The license herein above provid-
ed for shall be due and payable on
April 1st of each year, and if the
same be not paid on or before June
1st of said year, said license shall
then become due in double the
amount thereof.
Par. 521 -A. Who Included. Sec.
III. Wherever used in this ordi-
nance, the word "person" shall in-
clude and be held to apply to cor-
porations and firms.

Par. 522!A. Harboring Define&
Sec. IV. Any person who shall allow
any dog or bitch habitually to re-
main and be lodged or fed within his
or her house, barn, store, or enclos-
ure of any kind, shall be considered
as owning or harboring the same
within the meaning of Section One
(1) of this Ordiance.
Par. 523 -A. Shall Have Tag. Sec.
V. When a license has been issued
and the license fee paid the License
Clerk shall furnish to the person pay-
ing the same a metal license tag,
which shall contain thereon the num-
ber of the license tag and the year
of issue. Said license tag shall be
securely fastened on the neck of the
dog by means of a collar, and on
said collar shall be engraved or
stamped the name of the person to
whom such license tag is issued.
Par. 524 -A. May Impound Unlic-
ensed Dogs. Sec. VI. Any dog
found running at large at any time
of the year without the check pro-
vided for in Section Five (5) hereof,
may be taken up by any officer or
person and placed in the City pound,
to be kept there for a period of not
to exceed Forty Eight (48) hours.
Unless such dog is claimed within
that time by the owner thereof, and
the tax provided for herein is paid,
together with a penalty of one dollar
for the taking up and keeping of sucn
dog, said dog shall be destroyed in
such humane manner as the pound -
master may determine.
Par. 525 -A. Vicious Dogs. Sec.
VII. Any dog shown to be vicious,
or otherwise dangerous to the com-
munity, whether licensed or not, is
hereby declared to constitute a nuis-
ance, and may, if found running at
large, be taken up and held at the
pound for a period provided for in
Section Six hereof, and the owner of
such dog, if known, shall be notified
of such impounding, and upon pay-
ment of the penalty in said section
named, said dog may be surrendered
to such owner. In case of emergency,
however, such vicious or dangerous
animal may be instantly killed by
any officer or other person having
reasonable cause to fear injury to
any human being because of such
dog. Evidence showing that any dog
has previously bitten any one with-
out provocation, or habitually snaps
at or attacks persons, shall be pre-
sumptive as to the vicious nature of
such animal.
Par. 526 -A. Shall Not Run at
Large. Sec. VIII. It shall be un-
lawful for any person, owning or har-
boring any dog, found to be a nuis-
ance as herein defined, to permit
such dog to run at large, that is to
say, such dog shall be kept securely
tied or otherwise under control, so
that persons lawfully on the public
streets or highways or on the prem-
ises of the owner of said dog shall be
safe from attack. Provided, that any
dog duly licensed may be permitted
to run at large, if he is securely and
safely muzzled while thus at large.
Par. 527 -A. Dogs to Be Taxed.
Sec. IX. It shall be the duty of the
Assessor to assess every dog or har-
borer within the City, and the tax
due on such dog shall be charged
against the owner or person harbor-
ing said dog; if said tax is not paid,
the same shall become delinquent
and collectible as other city taxes.
Par. 528 -A. Owners Shall List for
Taxation. Sec. X. It shall be the
duty of any person owning or harbor-
ing a dog as hereinbefore set out, to
assist the Assessor in listing such
dog, and failure to do so, or failure
to pay the tax herein provided for
on or before June 1 in each year, or
to comply with the terms of this ordi-
nance in any other particular, shall
be deemed to be guilty of a misde-
meanor and upon conviction shall be
fined not less than Five Dollars
($5.00) or more than One Hundred
Dollars ($100.00).
Sec. XI. This ordinance shall be
in force and effect ten (10) days
from and after its final passage by
the City Council and publication in
the official newspapers as provided
by law.

ORDINANCE NUMBER 64 -A.
An Ordinance to regulate, license
and tax junk peddlers and collectors.
Par. 470. Sec. 1. That no person
shall engage in or carry on, in the
City of Dubuque, the business of col-
lecting or peddling, with a vehicle
or otherwise, junk, old metal, scrap
metal, old iron, rags, paper, rubber,
bottles or other materials commonly
called junk, without first securing
the license provided for irf this
ordinance.
Par. 471. Sec. 2. Any person en-
gaged in the business as a junk
dealer as herein provided who oper-
ates a wagon, cart, automobile or
auto truck for the purpose of pur-
chasing or dealing in junk shall pay
a license fee of Twelve Dollars and
Fifty Cents ($12.50) for every

wagon, cart or vehicle drawn by one
horse and shall pay a license fee of
Twenty -five Dollars ($25.00) a year
for every wagon, cart or vehicle
drawn by two (2) horses or for
every automobile or auto truck so
used.
Par. 472, Sec. 111. Any person
who engages in the business as a
junk dealer as herein provided with-
out first procuring the license pre-
scribed shall be guilty of violating
the terms of this ordinance and upon
conviction shall be fined not less
than Ten Dollars ($10.00) or more
than One Hundred Dollars ($100.00)
or imprisoned not to exceed thirty
days.
This ordinance shall be in force
and effect ten (10) days from and
after its final passage by the City
Council as provided by law.
