street for the distance of approxim-

The Engineer's estimate for this
work is $5.00 per running foot. The
bid of C. B. McNamara is given a
charge for rock excavation is not in
accordance with the bidding form as
used at this time. Our estimate of
the cost under his bid is slightly in
access of the bid as submitted by
Thomas Welsh. I would therefore
respectfully recommend that author-
ity be given for execution of contract
between the City of Dubuque and
Thomas Welsh for the construction
of this sewer.

Messrs. Kerper. Adams, and Ro-
shek addressed the Council relative
to the proposed viaduct at Rockdale
and the location of the street lead-
ing therefrom to the City.
A Resolution.
Whereas. the City Council of the
City of Dubuque, the Board of
Supervisors of Dubuque County. the
State Highway Commission, and the
Dubuque Chamber of Commerce
have been considering the advis-
ability of re- locating that part of the
Military Road lying between the
Town of Rockdale and Grandview
avenue in the City of Dubuque, the
same being also known as the
Dubuque- Cascade Road and one of
the Primary roads of Dubuque Coun-
ty, Iowa; and
Whereas, the City Council of the
City of Dubuque has given careful
consideration to the various plans
which have been prepared and sug-
gestions submitted effecting the pro-
posed improvement and the location
or re- location of the road within the
limits defined, for the purpose of
adopting a plan which would entail
a minimum of expense and at the
same time provide a road which will
comply and meet with all require-
ments relative to modern and scien-
tific road construction; and
Whereas, all plans substantially
agreed as to the location of the via-
duct to be constructed over the
Illinois Central Railroad tracks at
Rockdale, and the City Council of
the City of Dubuque is in accord
with such plans as to the construc-
tion and location of said viaduct,
and
Whereas, cne of the plans sub-
mitted pros ide for the re- location of
said road so that, when completed
said road would intersect Grandview
avenue in the City of Dubuque ap-
proximately one thousand (1,000)
feet South of the present road and
such re- location would necessitate an
expenditure of about Twenty Thou-
sand $20,000.00) Dollars from the
Primary Road Fund, also about Two
Thousand ($2,000.00) Dollars for the
acquisition of the necessary land
right -of -way, and about Six Thou-
sand ($6,000.00) Dollars for grading
within the City of Dubuque, said
road when constructed to have a
grade of about Five and One -half
(5 %n) Per Cent; and
Whereas, should said road be con-
structed in accordance with said
plan, the City of Dubuque would be
reouired to maintain, in addition to
said road, another road in the pres-
ent location, which, together would
require the expenditure of consider-
able money annually without any
apparent or substantial benefit re-
sulting therefrom; and
Whereas, from reliable investiga-
tion and expert advice the City
Council has learned that a very de-
sirable road may be built from the
end of the viaduct, as proposed, to
the city limits and thence along the
present road to its present intersec-
tion with Grandview avenue, by re-
locating and maintaining the road to
the city limits from the viaduct at
an elevation of about Ten (10) feet
above the present road at the city
limits and said road, when thus con-

strutted, would have a maximum
grade of Five and Eight - tenths
(5 8 -10 %) Per Cent; and
Whereas, the City Council, after
due deliberation and consideration,
is convinced that the present road,
with the changes as to grade and
location outside of the limits of the
city as herein proposed, is the most
practical, and, therefore, the most
acceptable route to be followed;
therefore be it
Resolved by the City Council of
the City of Dubuque, that the pro-
posed plan to re- locate said Military
Road from Rockdale to Grandview
avenue by constructing an entirely
new road be and the same is hereby
rejected.
Be it further resolved, that the
City Council approve the plan to
construct the proposed road from the
viaduct to the city limits so that
said road at the city limits will have
an elevation of approximately Ten
)10) feet above the present road,
and from the city limits to Grand-
view avenue said road shall main-
tain approximately its present loca-
tion, and when said road is finally
completed it shall have a grade of
not to exceed Five and Eight- tenths
(5 8 -10 %) Per Cent.
Be it further resolved that the City
Council, on behalf of the City of Du-
buque, does hereby announce and
declare that it stands ready to co-
operate with the officials of Dubuque
County and the State Highway Com-
mission in the construction of said
road and does respectfully request
that the Board of Supervisors of Du-
buque County take such steps as
may be necessary for the commence-
ment of the work of constructing the
viaduct with the least possible de-
lay, said Council realizing the fact
that whatever work can be done up-
on this road at this time will aid
materially in relieving the present
condition of unemployment and also
hasten the time when a modern first
class primary road will be built be-
tween Dubuque and Cascade.
Be it further resolved that a copy
of this resolution be sent to the
Board of Supervisors of Dubuque
County and the Dubuque Chamber of
Commerce.

Gentlemen: In accordance with
the provisions of the law, sealed bids
were advertised for the purchase of
the fifty thousand dollar Water
Works improvement bonds, author-
ized by the City Council and the
fifty thousand dollar general sewer
bonds, also authorized by the City
Council. These bids were to have
been received at 10 A. M. Thursday,
September 1. No bids were received.
These bonds represent a very at-
tractive investment for a certain
class of people. I believe that they
can be disposed of directly to the
people by the City Treasurer. There-
fore, having conformed to the pro-
visions of law enacted by the last
legislature we will now proceed to
dispose of them in that manner.

The City Council,

gentlemen: In 1912 the City of
Dubii bought a, ppinp engine for
the Fire Department from the Robin-
son Company of St. Louis. This
piece of fore apparatus has beep in
twp serious accidents. About 1914 it
collided with a telephone pole and
fire hydrant, and in 1918 was in a
smash up with the fire apparatus
from the station on 18th and Copier
ayeni}e, Op account of the age of
this piece of apparatus, and on ac-
count of the misfortunes which have
befallen it it is pot in a satisfactory
condition. A few weeks ago, while
being tried out, it broke down en-
tirely; and while it is pow in con-
dition fit for service, yet undoubt-
edly if a great deal pf service was
demanded of it it would again break
down.
I had hoped that, the expense of
this new piece of equipment would
be deferred until net year. it does
seem to me, however, to be a wise
precaution at this, time to purchase
pew pumping engine for Fire Head-
quarters, Delivery can probably be
had by the 1st of January, in which
case we will have the benefit of this
additional equipment during that
season when fires are most frequent.
I would therefore respectfully rec-
ommend that authority be given to
advertise for a pumping engine hav-
ing the capacity of 1,000 gallons per
minute, the same to be delivered not
later than January 1st next. The
apparatus manufactured by the
American_ LaFrance Company, the
Seagrave Company and the Agrens-
Fox Company will be satisfactory.

Gentlemen: The appropriations for
the year 1921 carry item of ten thou-
sand dollars for a new fire alarm
station. The City has already spent
two thousand dollars for the ground
and we have had plans prepared for
the building, which plans have been
approved by the National Board of
Fire Underwriters and the Gamewell
Company. The building as designed
will probably cost between five and
six thousand dollars. I would re-
spectfully request that authority to
advertise for the bids for the con-
struction of this building.

was informed that under no condi-
tion would the City Council allow
West 3rd to be torn up at this time.

City Solicitor Czizek reported ver-
bally on the petition of Reinhart F.
Ris, referred to him and City Man-

ment levied against his property for
a sanitary sewer in Chestnut street,
stating that he had already paid for
a sewer in Prairie street. The City
Solicitor and City Manager having
investigated the matter recommend
that Mr. Ris be allowed a reduction
on the sewer in Chestnut street, the
amount of what he paid for the
sewer in Prairie street, the amount
of the reduction to be drawn from
the General Fund. Councilman Gab-
riel moved that the recommendation
of the City Solicitor and the City
Manager he approved and Mr. Ris
be allowed the reduction as recom-
mended. Seconded by Councilman

Assessor that as long as she pro-
tested against the assessment she
would have no interest to pay.

Miss Julia Kemler addressed the
Council relative to the condemned
building at 854 Central avenue on
City Lot 281, stating that she was
willing and ready to repair said
building. City Manager Carr report-
ed that Architect Saam, a very com-
petent man, had investigated the
place and found the same in very
poor condition and not fit to repair.
A Resolution.
Whereas, on August 12th, 1921, a
resolution instructing A. W. Kemler
Estate, the owner of the building on
City Lot 281, situated on the East
side of Central avenue, to remove
said structure by the 6th day of
September. 1921, or to appear before
the City Council on the 6th day of
September, 1921, and show reason, if
any there be, why such structure
should, not be removed, and
Whereas, said A. W. Kemler Es-
tate has apbeared before the Council
and set forth reason why such build-
ing should not be removed, and

McEvoy had gone over the plans
with him and found them alright.
He was informed that the plans are
acceptable to the Council and that
permission will be granted to re-
model the building providing that
Messrs. Schilling and McEvoy do the
work and Albert Ney superintends
the same. Councilman Brede moved
that permission be granted to Oliver
Kringle to remodel the building on
4th and Iowa streets on City Lots
189 and 190 N. 14' 3 ", providing he
complies with the above conditions

Gentlemen: A number of years
ago, probably prior to the paving of
Ninth street, a storm sewer was laid
in Ninth street from Ninth and Iowa
to the alley between Central avenue

and White street. This storm sewer
is supposed to take the water from
the intersection of Ninth and Iowa
and Central and Ninth and is a lit-
tle 8 -inch sewer. This storm sewer
terminates at the alley between
Central avenue and White street and
is there connected into a 6 -inch san-
itary sewer.
I cannot understand how any one
at any time would permit such a
piece of construction work. I would
recommend at once that a 12 -inch
sewer be laid from the terminal
manhole of the storm sewer to Ninth
and White street, at this point tak-
ing up the water from inlets to be
placed at Ninth and White streets
and to be extended from Ninth and
White to Tenth and White as a 15-
inch sewer to connect at Tenth and
White streets with the existing 18-
inch storm sewer.

An ordinance granting to the
Klauer Manufacturing Company the
right to construct, maintain and
overate a side track in Washington
street and regulating the use there-
of.
Be it ordained by the City Council
of the City of Dubuque:
Section 1. That permission be and
the same is hereby granted to the
Klauer Manufacturing Company, its
successors and assigns, to lay, oper-
ate and maintain a spur or side
track in Washington street begin-
ning about 60 feet south of the South
property line of Eighth street by
connecting with the center track of
the Illinois Central Railroad Com-

pany, thence running in a north-
easterly direction 'till it reaches the
North property line of Eighth street,
thence on the East side of Washing-
ton street to the South property line
of Tenth street, as shown by the
blue prints which has been filed
with the City Council and is attach-
ed to this ordinance and made a
part hereof.
Sec. 2. That the laying down of
said spur or side track shall be
done under the supervision of the
City Engineer.
Sec. 3. That in the laying down
and operation of said spur or side
track the same shall be so construct-
ed as to create the least possible
obstruction to ordinary travel and
the use of the street upon which it
is located. That cars shall not be
allowed to stand in said street in
such manner as to unnecessarily in-
terfere with the use thereof, and
said track shall at all times be used
in accordance ith all police regula-
tions now or hereafter enacted by
said city.
Sec. 4. The said spur or side
track shall be laid to the established
grade of the street on the streets
which it crosses and should the
grade be changed at any time said
track shall be changed to conform
with such change in grade at the
expense of said company without
any claim against the said city.
Sec. 5. That said company shall
keep the space between the rails of
said spur track and the space at
the ends of the ties so graded, that
vehicles can easily pass over the
same and shall keep such spaces
properly paved or otherwise im-
proved as the Council may from
time to time direct and shall make
all repairs immediately upon being
notified by the City Council or pro-
per officer of the. city to do so.
Sec. 6. That said spur or side
track shall be so constructed and
maintained as not to dam up or ob-
struct the flow or drainage of water
in the gutters or on the surface of
said streets, and said company shall
be subject to and strictly comply
with all police regulations bearing
on the use and operation of said
track.
Sec. 7. The City of Dubuque here-
by reserves the right to revoke the
privileges hereby granted at any
time after twenty (20) years from
the time this ordinance becomes op-
erative, or sooner in case said track
ceases to be used for mercantile
purposes.
Sec. 8. This ordinance shall take
effect and be in force ten (10) days
from and after its final passage by
the City Council and publication as
provided by law, and written accept-
ance on the part of the Klauer Manu-
facturing Company.

the Knights of Columbus, asking for
the cancellation of taxes levied
against their property located at 780
Locust street, now for collection by
the County Treasurer, was referred

I inquired regarding this proposi-
tion from the City Assessor, who
told me that building was placed up-
on the tax list. This is an error, as
this property is used for fraternal
purposes and for that reason should
not be subject to taxation.
The County Treasurer, therefore,
should be instructed to cancel City
taxes against this property which
are now on the books.

Gentlemen:
Dubuque in common with the en-
tire nation must, and soon will
emerge from the depression of the
last two years, and it is necessary
that public utilities be ready to meet
the demands of those improved con-
ditions. For years we have been
forced to the closest economics of
operation and to the lowest limits of
additions and improvement, but as
demands arise we must be able to
respond to the full measure of our
obligations to the public. If we are
to be prepared when these demands
arise it is imperative that we begin
to increase our production facilities
at the earliest possible moment, be-
cause the delivery and installation
of the necessary improvements will
require considerable time, labor and
money. For this the required cap-

ital must be secured and you are
aware of the impossibility to market
a bond which outruns the franchise,
and also the limited market and
burdensome terms which confront a
short term bond.
With these facts in mind we are
submitting herewith two proposed
franchises covering the future opera-
tion of our properties in this city
for which we ask consideration by
your honorable body, with the hope
that the provisions thereof will dis-
close themselves so distinctly in the
line of preserving the regulation and
control of our operation in the hands
of the city government, that you will
order the submission of the propo-
sitions to the legal voters for their
approval.
It may be helpful to know that
among the principal additions that
improved conditions will demand are
the completion of the steam plant
and accessories, already begun but
discontinued by reason of money
conditions, and the installation of a
new generating until of approxim-
ately 10,000 horse power capacity.
These will provide a total capacity
equal to all the hoped for demands,
and furnish the additional capacity
which the welfare of the city and its
industries are entitled to as a safety
factor, thus insuring quantity and
continuity of service.

cil and stressed the importance of
early action for reasons express in
his letter submitting the franchises.
Action was deferred as a sufficient
number of copies of the proposed
franchise had not been prepared for
distribution to the individual Coun-
cilmen.
Petition of J. R. Wallis, Trustee,
and Sarah O'Neil Wallis, by their
Attorneys, Frantzen, Bonson and Gil -
loon, to compromise the tax penalties
imposed by the City of Dubuque
against their property, presented.
Penalties imposed were as follows:
Against J. R. Wallis, Trustee, for
the year 1914, $77.09; for the year
1915, $315.14; for the year 1916,
$217.71; for the year 1917, $66.96;
making a total of $676.90.
Against Sarah O'Neil Wallis, for
the year 1914, $15.80; for the year
1915, $25.82; for the year 1916,
$12.40; for the year 1917, $5.60.
The petitioners claim that the said
taxes became barred four years from
the first day of January in the year
in which the tax books containing
the same were placed in the hands of
the City Treasurer, and that more
than four years have elapsed since
the tax books containing the taxes

land allowed by the Council. The re-
vised valuation should be $6,400.00
instead of $7,130.00 land value. I
therefore petition your Honorable
Body to instruct the City Treasurer
to have this amended on his books.

Chamber of Commerce presented:

Gentlemen: For the past eleven
years Dubuque has had a Municipal
Fireworks exhibition on the night of
July 4th in lieu of the periodic
"celebration" which is carried out in
many towns. This policy has result-
ed in decreased fire risks and has
been a saving to the businessmen.
Up and until last year the City has
always donated $200.00 to the ex-
pense of this fireworks display. From
'this fact came its name, Municipal
Fireworks Exhibition. Last year the
expenses were paid out of the Com-
munity Chest Fund. This year in
an . effort to centralize and co -ordi-
nate all funds that are raised from
the business men, the Chamber stood
sponsor for the exhibition.
The total xepenses of this year's
e hibition amounted to $1,074.39,
$800.00 of which was spent for fire-
works and the balance for. the band
concert which preceeds the exhibi-
tion, the war tax on admissions and
various miscellaneous matters, such
as printing tickets, lighting the
grounds and building the band stand.
The Chamber would appreciate
very much the assistance of the City
Council by their donating the usual
$200.00 as was given in the past. This
sum is included in the budget so

Petition of S. B. Lattner, referee,
for the Richard Waller Estate, pre-
sented. The petitioner states that
through error an assessment of
$10,000.00 against money was enter-
ed in the Assessor's books in the
City of Dubuque for the year of 1920,
and that said assessment was void
by reason of the provision of Section
1310 of the supplement to the Code
of Iowa, which provides for a tax of
five mills on the dollar on moneys
and credits. And that it further pro-
vides that said millage tax shall be
in lieu of all other taxes upon
moneys and credits, and shall be col-
lected by the County Treasurer.
Your petitioner, therefore, respect-
fully asks that said assessment be
ordered cancelled in the sum of
$140.00.

erty was not proportionately assess-
ed with other property in the same

tion in taxes for 1920. The Treas-
urer's report shows the assessed val-
uation of six other property owners
in the same neighborhood, which
compare favorably with Mrs. Aure-
den's assessment.

Petitioner stated that she had pe-
titioned former Councils at three
different times to reduce her assess-
ment. She also stated that the As-
sessor at t hat time told her that
there would be no interest to pay
while her petitions were pending.
We find on investigation that she
petitioned the Council for a reduc-
tion in taxes April 1, 1915. This pe-
tition was referred to the committee
of the whole. We find nothing more
relating to this petition.
We find that December 22, 1916, a
petition of Winifred Carney, relative
to a reduction of taxes on her prop-
erty was referred to the City Assess-
or. He reported as follows: That
the land value on Lot 1 of 16, First
King's Addition, owned by Winifred
Carney, was assessed for 1914 and
1915 without deducting the 10% on

the confusion in the city on account
of new street names and numbers,
which is causing a delay in the com-
piling of the new City Directory, in
making up tl;e telephone directory
and also in the postoffice, I have felt
it desirable to put additional people
at work to complete this work as
soon as possible. To make matters
worse, Professor Hornick, who had
been engaged on this work during
the summer and who I had expected
would stay indefinitely, advised me
pn Sept. 8th that he had discontinued
this work and had accepted other
employment on the 6th.
I have arranged with Mr. C. E.
Bradbury, Mr. F. W. Faherty and
Miss Martha Considine to carry on
this work at a rate of $4.50 per day.
I would also like to employ addition -
al.help at the same compensation.

SPECIAL ORDINANCE
An ordinance granting the Illinois
to construct and maintain a track
Central Railroad Company the right
on Washington Street, from Fourth
Street to Tenth Street, and regulat-
ing the use thereof.
Be it ordained by the City Coun-
cil of the City of Dubuque:
Sec. I. That there is hereby
granted to the Illinois Central Rail-
road Company the right to construct
and maintain a track on Washington
Street, from Fourth Street to Tenth
Street, said track to be laid in the
center of said street and used for
the purpose of placing and switch-
ing cars thereon.
Sec. II. That the period for

which this grant is given shall cover
a period of twenty (20) years from
the date hereof and may be renewed
at the end of that time by proper
application being made to the City
Council of the city of Dubuque.
Sec. III. That during the period
covered by this grant said Illinois
Central Railroad Company shall
maintain said track in a manner so
as to cause the least possible .ob-
struction and inconvenience in the
use of said street and shall at all
times be subject to proper police
regulations which may be adopted
and enforced by the City of Dubuque
and said track shall be so con-
structed as not to interfere with
the flow of surface water upon,
over or under said street.
Sec. IV. That said track shall be
laid to the established grade on the
street on which it is laid, and should
the grade be changed at any time
the said track shall be so changed
as to conform to such change of
grade,a at the expense of said Rail-
road Company, without claim for
damages against said City because
of such change.
Sec. V. The said Railroad Com-
pany shall keep the space between
the rails of said track and one (1)
foot on the outside thereof, so grad-
ed that vehicles may easily pass,
over the same, and it shall be re-
quired to pay the expense of any
improvement of said street which
has been or may be made between
the rails of said track and one (1)
foot outside thereof as the Council
may direct and it shall further be
required to keep in repair said part
of said street at its own' expense,
which repairs shall be made imme-
diately upon being notified thereof
by the City, and shall be of such
materials as said City shall order
and prescribe.
Sec. VI. That the said Illinois
Central Railroad Company shall
switch, spot and place the cars of
all other railroad companies operat-
ing lines in the City of Dubuque
over said track, or whenever any
railroad company operating in the
City of Dubuque desires to switch,
spot or place cars over and upon
track with its own engines, it shall
have the right to do so, and the said
Illinois Central Railroad Company
shall be compensated for the ser-
vices herein provided for and the
use of the track herein stipulated
upon, in compliance with a uniform
charge for such services or use of
track, mutually agreed upon be-
tween the said Illinois Central Rail-
road Company and the other rail-
road companies for which services
are performed, or by whom said
track is used, and such compensation
•
shall cover the use of all other
tracks leading to or from said track
belonging to the said Illinois Cen-
tral Railroad Company.
Sec. VII. That no cars shall be
placed upon said track for unload-
ing purposes north of Ninth Street.
That no oars shall be unloaded on
said track between Eighth and Ninth
Streets and said track shall not be
used as a "team track" within said
limits. Provided, however, that
should a request - be made upon any
railroad company by the owner or
occupant of abutting property to
plane a car to be unloaded oppo-
site or in front of abutting property,
then and in that event cars may be
unloaded upon said track between
Eighth and Ninth Streets, but such
cars shall he unloaded only in front
of or opposite the abutting property
who owner or occupant has made
the request.. Cars may be unload-
ed between Seventh and 4ighth
Streets providing such cars are not
so pla yed as to interfere with the
use of the driveways of abutting
property. It is further provided
that no cars shall be permitted to
be spotted or placed upon said track
south of Ninth Street, either for
loading or unloading purposes,
within thirty (3Q) feet of any car
which is located upon any side track
tipon either side of said street, nor
shall any par or cars he spotted, or
Placed upon any turn out from the.
center track to the side tracks any-
where, on said street between FOUrth
and Tenth Street at a distance of
less than fifteen (15) feet between
the Center of the main tracks and
center of the side track. The pro:
visions of this section shall apply
not 0,111y to railroads but also to,
persons, firuas or corporations• who
may move, place or spot, or cause
to be moved, placed or spotted, cars
upon said track, and any such per-
son, firm, cgrporatiou or railroad
company who shall violate any of
the provisions of this section shall
be, subject to a fine of not to eX.ceed
Twenty-Five ($,25,) Dollars for each
' offense, or he imprisoned until such
fine is paid, but not to, exceed thirty
(30,) days.

right, by, ordinance, resolutions or
motion, to impose additional re-
strictions, liuritatio.ns or conditions
upon the Illinois Central Railroad
Company and other railroad com-
panies in the use of said track, hav-
ing due, regard for the interest and
benefit of the public in the use of
said street, and failure to comply
with any, such regulation will sob
je,et the offending company to the
same penalty as provided in Section
Eight (9) hereof,

Gentlemen: In accordance with
your instructions, bids were receiv-
ed on Tuesday, September 27, for
the furnishing of one triple combina-
tion pumping chemical and hose
wagon for the Fire Department.
Each company agreed to supply
the apparatus in full accordance
with the general specifications of the
city and detailed specifications of
their own. The following bids were
received:
The Stutz Fire Engine Co., $13,000.
American La France Co., $13,360.
Seagrave Co., $13.300.
Ahrens Fox Fire Engine Co.,
$13.850.
The pumper furnished by the
Ahrens Fox Co. is a piston type of
pump.
The pumper furnished by the Sea-

grave Co. is a centrifugal pump.
The American La France and the
Stutz both equip their apparatus
with a so- called rotary pump.
The apparatus furnished by the
Seagrave, American La France and
Ahrens Fox Companies have all
stood excellent tests for years, giv-
en by the Underwriters' Associotion
and are all old established compan-
ies. The apparatus furnished by any
of these three companies would un-
questionably meet the requirements
of the City of Dubuque in a very sat-
isfactory manner.
The Chief of the Fire Department
joins me in recommending to the
City Council that the proposal of
the American La France Co. be ac-
cepted and that the exedution of a
contract between this company and
the City of Dubuque be authorized.
The difference in price is not suf-
ficient to be given very much con-
sideration. Each company, however,
was asked to state the amount which
they would give for the old Jumbo
pumper, on delivery of the piece of
apparatus which they might furnish.
On the basis of their offers for the
old piece apparatus, the American
La France Company's proposal will
mean a somewhat less outlay of cash
for the equipment than the proposal
of any of the other three companies.

Petition of L. 0. Hillyard present-
ed, stating that he wishes to have
fifty feet on the west end of May
Street vacated, that he is building
three duplex houses and wants this
strip to build six garages thereon.
He also states that he has about 100
yards of dirt which he would give
the City free of charge and place it
on May Street if satisfactory. Coun-
cilman Melchior moved that the pe-
tition be referred to the Mayor and
City Manager to investigate and re•
port back to the Council. Seconded
by Councilman Brede. Carried by
the following vote:

Petition of the Governor's Greys
presented, stating that they leased
from the City the third and fourth
floors of the Ninth Street Engine
House, popularly known as the Ar-
mory, which was in such a deplor-
able condition that it was necessary
to spend a considerable amount of
money to put it in first class shape.
They state further that they have
collected the greater portion of this
money, but are still a considerable
amount in debt, they receiving an-
nually from the state a rental which
barely pays for the upkeep. They
have no other means of paying off
this debt, except by giving dances or
some other beneficial amusement in
the hall, and they hereby petition
your Honorable Body to allow the
Greys to conduct dances this winter.
Councilman Brede moved that the
prayer of the petition be granted, the
City to reserve the right to cancel
this permission at any time. Sec-
onded by Councilman Gabriel. Car-

Gentlemen: Early last spring
while the repairs for the Armory
were going on, the writer took up
with Mr. Carr the matter of putting
in a new stairway, a part of this to
be borne by the City, due to cancel-

lation of one -half year's rent, amount-
ing to $150.00.
The cost of the stairs came to con-
siderably more than this, which ex-
pense was borne by the company.
We petition your Honorable Body
that the rent for the first half year
of 1921, or $150.00, be deducted from
the charges against the company.
