of Chicago, to prepare preliminary
plans for the extension and improve-
ments of the City Water Works. Sec-
onded by Councilman Melchior.

Mayor Alderson in the chair.

Petition of L. O. Hillyard present-
ed, stating that he wishes to have
fifty feet on the west end of May
Street vacated, that he is building
three duplex houses and wants this
strip to build six garages thereon.
He also states that he has about 100
yards of dirt which he would give
the City free of charge and place it
on May Street if satisfactory. Coun-
cilman Melchior moved that the pe-
tition be referred to the Mayor and
City Manager to investigate and re-
port back to the Council. Seconded
by Councilman Brede. Carried by
the following vote:
Yeas -Mayor Alderson, Council-
men Brede, Gabriel, Melchior' and
Rooney.
Nays -None.
Petition of the Governor's Greys
presented, stating that they leased
from the City the third and fourth
floors of the Ninth Street Engine
House, popularly known as the Ar-
mory, which was in such a deplor-
able condition that it was necessary
to spend a considerable amount of
money to put it in first class shape.
They state further that they have
collected the greater portion of this
money, but are still a considerable
amount in debt, they receiving an-
nually from the state a rental which
barely pays for the upkeep. They
have no other means of paying off
this debt, except by giving dances or
some other beneficial amusement in
the hall, and they hereby petition
your Honorable Body to allow the
Greys to conduct dances this winter.
Councilman Brede moved that the
prayer of the petition be granted, the
City to reserve the right to cancel
this permission at any time. Sec-
onded by Councilman Gabriel. Car-
ried by the following vote:

Gentlemen: Early last spring
while the repairs for the Armory
were going on, the writer took up
with Mr. Carr the matter of putting
in a new stairway, a part of this to
be borne by the City, due to cancel-

lation of one -half year's rent, amount-
ing to $150.00.
The cost of the stairs came to con-
siderably more than this, which ex-
pense was borne by the company.
We petition your Honorable Body
that the rent for the first half year
of 1921, or $150.00, be deducted from
the charges against the company.

STIPULATION OF AGREEMENT
Whereas, City Lot Number 248, in
the City of Dubuque, Iowa, is owned
jointly by Charles Pfotzer and J. H.
Rhomberg and there appears upon
the tax books of the City of Dubuque
delinquent city taxes including pen-
alty and interest against said lots
for the years 1907, 1908, 1909, 1910,
1911, 1912, 1913, 1914, 1915, 1916,
1917, 1918, 1919 and 1920, in the to-
tal sum of Eleven Hundred Thirty -
Six Dollars and Ninety -Six ($1,136.96)
Cents; and,
Whereas, on August 12, 1914, a
special assessment was levied upon
said lot to pay for the improvement
of the alley between Clay Street and
Iowa Street, from Fourth Street to
Seventeenth Street, which assess-
ment, including interest and penalty,

amounts to One Hundred Thirty -One
Dollars and Seventy -Nine ($131.79)
Cents, all of which is due, delinquent
and unpaid; and,
Whereas, on June 22, 1917, a spec-
ial assessment was levied upon said
lot to pay for the improvement of
Clay Street, Eighteenth Street and
Couler Avenue, from the north prop-
erty line of Third Street to the north
property line of Twenty- Second
Street, which assessment including
interest and penalty amounts to
Three Hundred Thirteen Dollars and
Eighteen $313.18) Cents, all of which
is due, delinquent and unpaid; and,
Whereas, in view of the fact that
there is a controversy and dispute
between the owners of said lot,
hereinafter called the party of the
first part, in relation to the taxes
owing said City on said described
property and in regard to the legal-
ity, validity and justness of some of
said taxes and the expense and pos-
sibility of collecting thereon the full
amount assessed, and it is deemed
advisable by the City Council of said
City and the owners of said lot that
a compromise settlement be made of
all taxes regular and special, due and
owing from the parties of the second
part for the year 1920 and all prior
years, and said parties hereto have
agreed upon a specific amount which
shall constitute a settlement in full
of all such taxes, which amount is
as follows:
Regular taxes, interest and
penalty from 1907 to 1920 $713.72
Special assessment for alley 106.28
Special assessment for Clay
Street 129.95
Total $949.95
Now, therefore, in consideration
upon the part of the City of Du-
buque to accept the sum of Nine
Hundred Forty -Nine Dollars and
Ninety -Five ($949.95) Cents, in full
of all taxes levied against said City
Lot 248, regular and special, inclus-
ive of interest and penalty, which
are due, delinquent and unpaid from
the parties of the second part, the
owners thereof, said parties do here-
by agree to pay to the City Treasur-
er of Dubuque, Iowa, for the use of
the City of Dubuque, said sum of
Nine Hundred Forty -Nine Dollars
and Ninety -Five ($949.95) Cents,
which shall be considered in full of
all city taxes, regular and special,
due from said parties upon said de-
scribed property, said sum to be paid
not later than the 15th day of De-
cember, 1921.
It is further stipulated and agreed
between the parties hereto, that the
amount herein agreed to shall be
taken as a liquidated, adjusted and
settled claim and shall be so consid-
ered for all purposes and in the event
said parties of the second part
should fail or refuse to pay the same
on or before the 15th day of Decem-
ber, 1921, the party of the first part
shall have the right to sue upon this
agreement and said parties of the
second part do hereby expressly
waive all objections they may have
at law or in equity to object to the
same for any reason whatsoever and
consent that an action at law may
be brought against them for said
amount as an agreed and stated
claim.
It is further agreed and understood
between the parties that the consid-
eration for this agreement is the
cancellation of all taxes, interest and
penalties in excess of Nine Hundred
Forty -Nine Dollars and Ninety -Fve
($949.95) Cents, and the extension
of time for payment to December 15,
1921, and the further consideration
that said property will be withheld
from tax sale at the next December
tax sale, 1921.
The signing of this agreement shall
be deemed an acceptance of the pro-
visions thereof.

A property owner living on High
Bluff Street addressed the Council
relative to having water and sewer
mains put in said street. He was ad-
vised to bring in a petition properly
drawn up, and signed, and the mat-
ter would receive consideration.
Petition of Joseph Sitterly pre-
sented:
I take the liberty to write to the
City Council of Dubuque, Iowa, for
a settlement in payment for George
Sitterly's life, shot away by the City
Police of Dubuque, Iowa, on the even-
ing of July 14, 1921.

City Solicitor Czizek advised the
Council that the accident could not
be charged to the City, as the officers
were merely doing their duty. Coun-

Council met at 4:30 p. m.
Mayor Alderson in the chair.

Mayor Alderson read the call and
stated that service thereof had been
duly made and this meeting is called
for the purpose of acting on bids for
the Fire Alarm Station and any
other business that may come be-
fore a meeting of the City Council.
Petition of Mail Carriers pre-
sented, stating that there is pending
before the City Council an applica-
tion of the Dubuque Electric Com-
pany for a new franchise; that un-
der the law, as stated in Section
2157-g of the Supplement to Code
1913, provision is made that cer-
tain persons may be granted free
transportation by public utilities, and
among such persons are policemen,
mail carriers and firemen of any
city wearing the insignia of their
office within the limits of such city.
For that reason they request your
Honorable Body that in the new
franchise you include a clause
which will require the Street Car
Company to transport free of charge
mail carriers within the City of Du-
buque. Signed by Herman Ternes,

thirty -one mail carriers.

Petition of Linwood Cemetery As-
sociation for cancellation of assess-
ment on the following property, pre-
sented:
To the Honorable City Manager and
City Council of the City of Du-
buque, Iowa.
Gentlemen: In July of this year,
Linwood Cemetery Association pur-
chased the following property, to-
wit: Lots 1 to 14 inclusive in Block
2, Lots 1 to 6 inclusive in Block 3,
Lots 1 to 6 inclusive in Block 4,
Lots 6, 7, 8 and 9 in Block 5 and
Reserve Lots A and B, all of Scott's
First Addition to the City of Du-
buque; also Lot 16 of the Subdi-
vision of the N. E. 1 / 2 of Section 13,
Township 89 North, Range 2 East
of the P. M. in the City of Dubuque.
I think this property was formerly
assessed to J. H. Dietrich and the
Otto Dietrich Estate and possibly the
east half of Lot 1 in Block 4 may
have also been doubly assessed to
Adolph J. and Joseph J. Duertscher,
though the Duertschers have no title
thereto. This property adjoins the
property formerly held by the Lin-
wood Cemetery Association as a
part of its Cemetery and now be-
comes a part of its Cemetery, and
is therefore exempt from taxation.
The taxes for 1920 and all prior
years have been paid. Will ' you
please take such action as is neces-
sary cancel an' taxes that have
been assessed against this property
for the year 1921, and it should not
be assessed for any future years.
The deeds by which the Association
acquired title are a guardian's deed
from Molly Kircher, Guardian, filed
July 8th, 1921, recorded 88 TL, 24D;
deed of John Henry Dietrich et al,
dated July 8th, 1921, recorded 88,
TL. 241; another deed by John

Petition of Annie M. Dolan pre-
sented. She states that she is the
owner of the North Middle twenty
(20) feet of City Lot 83, in the City
of Dubuque, and that shortly here-
tofore she learned that the property
was sold on or about the 25th of
April, 1921, for special assessments
as follows: Sewer, $35.48; alley,
$61.19; Second Street improvement,
$56.19; Locust Street improvement,
$128.97, making a total of $281.83;
that this sale carries with it a pen-
alty of 8% and 8% interest from
the 25th day of April, 1921, making
a total of $314.66. She further states
that she made payments on these
special assessments on December
14th, 1917, as follows: On alley be-
tween Main and Locust, $13.50; on
Second Street, $12.30; on alley be-
tween Main and Locust, $20.50, mak-
ing credits in the sum of $46.30;
stating that she has receipts of the
properly accredited officer of the
City for the same. She further rep-
resents that she is a widow, has
little or no property and lives un-
der very frugal circumstances, and
will experience hardship in redeem-

burden of special assessment and
penalty under sale. She therefore
prays your Honorable Body for a
cancellation of the interest and pen-
alties assessed against her and re-
duction of the amount due from her,
in order to redeem to a minimum

tion of my contract on Bluff Street,

I was awarded contracts in April
for the improvement of Heeb Street,
Jackson Street and Washington
Street, from Eighth to Eleventh
Streets. I started work on Jackson
Street April 19, or just as soon as
the weather conditions permitted. A
severe snow storm prevented my
starting on this job earlier. Within
one week, or on April 25th, the City
forces took possession of the north
end of this street in the construc-
tion of sewers, catch basins and in-
takes until about the first of July
and this street was not put in its
original condition as found until
some time later. We started work
on the improvement of Heeb Street
on April 28th. The contract date for
the completion of this job was Sep-
tember 1st. The actual working
time for completing this work was
not over ten days, and the work
was completed May 22nd.
I started work on my Eleventh
Street contract on May 6th. The
City immediately took possession of
this street in the excavation for
water mains, new hydrant connec-
tions, storm sewers, sanitary sewers
and gas, and continued operations
on this street until July 14th. On
account of the City's occupancy of
Jackson Street and Eleventh Street
during this interval, I was not able
to make any definite plans or map

out any program for the completion
of my work within the contract time,
as I was unable to get any informa-
tion from the City Engineer relative
to the City's intentions in regard to
making the above mentioned exca-
vations. During this time I en-
deavored on four different occasions
to get the necessary instructions
from the City Engineer relative to
the Washington Street improvement
from Eighth Street to Eleventh
Street, but owing to • some con-
troversy regarding the location of
new railroad track he was unable
to give me the necessary instruc-
tions. With this situation exisiting
at that time, I was fortunate to se-
cure a contract for the improve-
ment of the Car tracks on Central
Avenue which permitted me to keep
my organization intact. This job
was awarded to me on May 20th and
work was started on May 26th. The
date of .completion as per contract
was placed at August 15th. The
original contract on this street was
increased over 50% and the work
was pompleted July 2nd, including
a delay of five days on account of
weather and the street railway com-
pany's operations in preparing the
work ahead. This contract was com-
pleted in 27 working days. After
completing this contract, we again
started work on Eleventh Street, in
the laying of brick gutters, but I
was unable to complete the work of
surfacing the street or make any
definite plans for the same, as the
City's forces were still working at
the White Street intersection sub-
sequently at the Jackson Street
and Washington Street intersections,
making storm sewer connections.
After the City had completed opera-
tions on Jackson Street, I was given
to understand that a track extension
was to be made above Tenth Street,
but I was unable to get any definite
information as to the starting point
of this track extension on the north
until about July 14th. A delay of
four days occurred after this in
awaiting delivery - of new ties and
new rails on this street by the I. C.
R. R. Company. On July 30th we
started excavation on Washington
Street, at Eleventh Street, working
south. Up to this time nor for some
time later could I get any definite
information regarding the railway
trackage as above mentioned. About
September 10 I was advised that a
new line of track would be placed
along the curb line on the east side
of Washington Street from Eighth
Street to Tenth Street. I immedi-
ately started excavating for this
track and had almost completed the
same when we were advised that it
was not properly located. After a
delay of some two weeks in adjust-
ing a controversy betwen . the rail-
road company and property interests
on this street, we got final and
definite instructions as to the loca-
tion of this track, which involved ex-
tra and additional expense to me in
making, new excavation for the
above trackage. On June 4th I was
awarded a contract for the improve-
ment of Washington Street from
Seventh Street to Eighth Street
which would have been completed
within the contract time were it not
for the intervening of the City as
before mentioned and the delay en-.
countered in the location of the rail-
road trackage.
On July 26th I was awarded a
contract for the improvement of Bluff
Street. I was advised in a letter
from the City Ma:nager, dated Aug.
31st, that I would not be permitted
to start any work on Bluff Street
until the completion of the above
mentioned contracts were assured. I
endeavored on two different occa-
sions to get the necessary informa-
tion from the City Engineer regard=
ing the completion of the Bluff
Street contract. About September
10th I was again advised by the
City Manager that I would not be
permitted to start work on this con-
tract until the completion of the en-
tire three contracts (Jackson, Wash-
ington and Eleventh Streets) was as-
sured. On September 21 I again
asked for instructions as to the com-
plexion of this work and was ad-
vised in a letter from the City Man-
ager on the day following that I
could not start until the completion
of Jackson Street and Washington
was assurred. At that time I had
one day's work to complete on Jack-
son Street and it was completed
within the contract time. In con-
nection with the aforementioned
contracts, I am able to show that I
am in no way responsible for the
delays whcih have occurred and at
the present writing I am complet-
ing the track work on Washington
Street from Tenth Street to Elev-
enth Street, on my attorney's ad-
vice, at considerable additional ex-
pense to me in being compelled to
excavate under rails and ties, hav-
ing had verbal orders from the City
Engineer on July 30th to omit this
particular track work. I beg to state
further in this connection that I
have been delayed and handicapped
by the interventions of property
owners along this Washington Street
contract in dictating the construc-
tion of this work. The time fixed
for the completion of my work on
Dodge Street is November let. I
am also pushing the completion of
this job in every way possible, al-
;though 'I have factors to deal with
over which I have no control. I am
willing to submit to any penalty you
may deem proper for my failure to
complete either of these contracts or
any contract that may be awarded to
me in the future within the allotted
time, but I shall expect the City to
assume the same obligation with me
in the way of penalty for any delays
sustained at their hands.
I have asked for an extension of
time for the completion of Bluff
Street, for which I feel that I am
rightfully entitled, in view of the
above circumstances, and I am still
awaiting your action in this matter.

($2.00) Dollars per square yard, the
amount to be approximately fifteen
hundred (1500) square yards. If
this meets with your approval, the
time of completion of this contract
to be as per special agreement.

necessary for the construction of a
fire alarm building, the same to be
located on city property at Central
avenue and Eighteenth street. The

Albert Ney $5,989.00
The last bidder, however, did not
include in his price the cost of
plumbing and steam heating. Our
estimate would be that the cost of
plumbing and steam heat would be
not less than $1,500.00. This being
considered, the bid of Anton Zwack
is the lowest bid received for the
construction of this building and is
also in line very closely with the
estimate of the architect, Mr. Karl
Saam. Mr. Zwack also assures the
completion of this building ninety
days after the award of contract for
the building.
I would therefore recommend that
the contract for the erection of a
building for the fire alarm and police

Gentlemen: During the past year
there has been accumulating a large
number of requests for additional
al streets lights. Practically all of
these requests are fully justified. On
the other hand, we have to consider
the fact that our budget for 1921 in-
cludes $50,290.10 for street lighting.
Also in this connection there is no
estimated need for the placing of ad-
ditional street lights. It is therefore
necessary for me to present my rec-
ommendation to the City Council for
additional street lights in order that
the appropriation may be secured
for the money necessary in order to
maintain these additional lights from
November 1st to April 1st next.
My recommendations are as fol-
lows:
October 7, 1921
That the street light at the corner
of Davis Avenue and Johnson Street
be transferred to the corner of Queen
Street and Clinton Street.
That the street light at the corner
of Davis Avenue and Burden Avenue
be transferred to Marquette Place.
That an additional street light be
placed at the corner of Dubuque
Avenue and Audubon Avenue.
That an additional street light be
placed at the corner of Algona Ave-
nue and Dubuque Avenue. Also:
At the intersection of Twelfth and
Jackson Streets.
On Rhomberg Avenue at Stanton
Street (Sixth Avenue).
On Rhomberg Avenue at Emerson
street (Fourth Avenue).
On Kane Street at the angle north
of Kaufman Avenue.
Two additional lights on White
Street, the exact location to be
worked out.
One additional light on Grandview
Avenue at Bennett Street.
These lights, in my judgment, in-
clude those most badly needed.
These arcs will cost the City $65.00
per year, for a 600 candle power
light and $57.50 for the 400 candle
power light.

Gentlemen: Have interested my-
self toward acquiring another School
Nurse to assist Miss Dolan with the
work in connection with the Pa-
rochial schools as per your resolu-
tion a few weeks since.
We have approximately 4,000 pu-
pils enrolled in the Parochial schools,
entirely too many for one School
Nurse to properly care for, however
efficient she may be.
I recommend that Miss Dolan be
paid a salary of $130.00 per month.
She is experienced in the work and
has proven to be willing and capable.
Her past and present salary of
$120.00 per month is not comensurate
with her services.
I further recommend the employ-
ment of Miss May Ryan as assistant
to Miss Dolan, at the salary of
$120.00 per month for the remainder
of the fiscal year.
I feel this action is entirely neces-
sary at this time. The salaries above
mentioned are both fair to our em-
ployes as well as the employer.

City Council of the City of Dubuque,
that to provide for the cost of im-
proving Washington Street from the

The City of Dubuque, in the State

of Two Hundred Dollars, with in-
terest thereon at the rate of five per
cent per annum, payable on the pres-
entation and surrender of the inter-
est coupon hereto attached. Both
principal and interest are payable at
the office of the City Treasurer in
the City of Dubuque in the State of
Iowa. This bond is issued by the
City of Dubuque persuant to and by
virtue of Chapter 8, Title V, of the
Code of Iowa and amendments there-

sessments, collections and payment
hereon of said special tax, the faith
and diligence of said City of Dubuque
are hereby irrevocably pledged.

Gentlemen: Some time ago the
petition of Mrs. Harriet Marlin, cor-
ner of Cleveland Avenue and Quince
Street, asking that the special as-
sessment levied on June 3, 1915, for
the improvement of Quince Street
be reduced, was referred to the City
Manager with power to effect a set-
tlement and report the terms of set-
tlement to the City Council for their
approval.
I beg to advise that a settlement
has been effected on the basis of the
amount of the original levy for this
improvement, or $222.04, plus 75c ad-
vertising costs and county fees.
There is, in my judgment, no rea-
son why this assessment together
with the other assessments for this
improvement should not have been
collected immediately after the im-
provement was made. Other assess-
ments have been permitted to run
and have been somewhat reduced in
order to effect a settlement. In view
of the treatment accorded to the
other property owners, I would rec-
ommend that a settlement as above
mentioned, be approved by the City
Council.

Honorable Mayor and City Commis-
sioners of the City of Dubuque,
Iowa.
Gentlemen: In June, 1915, special
assessment for the improvement of
Hill Street was levied against Lot
14 of Geo. W. Rogers' Sub., in the
City of Dubuque, Iowa, in the name
of Miss Bessie Kennedy for the
amount of $80.32. This assessment
has never been paid because Miss
Kennedy felt that the amount of the
assessment is in excess of the lot
value.
About a year ago Miss Kennedy
interviewed Manager Carr regarding
a settlement and Mr. Carr, at that
time, suggested that Miss Kennedy
pay one -half of the original assess-
ment, or $40.16 and costs, exclusive
of interest, and that he thought such
an amount would be satisfactory in
lieu of the claim. At that time Miss
Kennedy did not think this a fair set-
tlement. Since then, however, after
thinking the matter over, and wish-
ing to bring the matter to a settle-
ment, she has considered the offer of
Arr. Carr a fair one and now petitions
your Honorable Body to settle the
claim on that basis: One -half of
the original assessment, plus costs,
exclusive of interest.
Mr. Carr in a talk with the writer
a few days ago, expressed his ap-
proval of the offer of the settlement
as above, and it is hoped that the
Council will look with favor upon
the proposal.

for an extension of time under his

for the resurfacing of Bluff Street

Whereas, James F. Lee, of Du-
buque, Iowa, entered into a contract
with the City of Dubuque, Iowa, on
or about the 26th day of July, 1921,
for the re- surfacing of Bluff Street
from the northerly property line of
Eighth Street to the intersection of
Bluff Street and Locust Street, and
Whereas, it was provided in said
contract that the work should be
completed on or before October 1st,
1921;
Now, therefore, i consideration of
the City of Dubuque granting to the
said James F. Lee a proper exten-
sion of time for the completion of
said contract, the said James F. Lee
agrees to assume all liability on ac-
count of any special assessments
made for said street improvement be-
ing held invalid by reason of the
work on said contract having been
done after October 1, 1921, provided,
however, that said City shall do and
perform all acts on its part required
to be done and performed under said
contract prior to this agreement, and
to the same extent and in the same
manner as if said contract had been
completed prior to October 1st, 1921.
The said James F. Lee further
agrees to leave one -half of the con-
tract price of said improvement with
said City until September 1st, 1922,
Its an additional guarantee that said
Improvement will not be affected nor
Ingerior because of the construction
having been done after October 1st,
1921, said amount to be left with
the City as above provided, to draw
interest at the rate of fiv eper cent
per annum from the date of thte ac-
ceptance of said contract until paid.
The said James F. Lee further
agrees to place a representative of
Warren Bros. Co., of Boston, Massa -
Ohusetts, in full and complete charge
of the construction work on said con-
tract, which representative shall be,
and hereby is, vested with authority
to act for and on behalf of the said
James F. Lee in making said im-
provement and in dealing and co-
operating with the City of Dubuque
in carrying out the specifications
covering said improvement.

Gentlemen: During the past sea-
son the Park Board has improved the
drive into Eagle Point Park beyond
the entrance by laying a concrete
pavement. That part of Shiras Ave-
nue from the park entrance to the
end of the present improvement is
and has been for years in very bad
condition.
In order that Eagle Point Park
be made properly available to the
public, this stretch should be paved
at the earliest possible time. Also,
prior to paving, it is necessary that
the street . be graded and t hat a
couple of culverts and a retaining
wall be constructed. The present
time, to me, seems an opportune
time to do this work.
The work of improving Rhomberg
Avenue from the old end of Rhom-
berg Avenue to Lincoln Avenue will
be completed tomorrow. If the prop-
osition of the improving of Shiras
Avenue at this time is acceptable to
the City Council, I would further de-

Gentlemen: During the present
year, delinquent tax penalties
amounting to approximately two
thousand dollars have been collected
by the City, or the payment has been
arranged for. There are still out-
standing quite a good many of these
delinquent tax penalties, which, in
justice to those who have already
paid their own, should be collected
by the City.
The City Solicitor advises that
most of these penalties are legally
collectible. I would, therefore, sug-
gest that the Council direct the City
Solicitor to advise these parties who
are still delinquent in the payment
of these tax penalties of the neces-
sity for them to pay these penalties,
and if they are not paid they will
be turned over to the County for col-
lections with other delinquent special
assessments and personal taxes
which were not turned over last
year.

Gentlemen: —Some time ago, a pe-
tition for cancellation of taxes, as
filed by Mrs. Anna Fischer, 929 High
Bluff street, was referred to the City
Manager for investigation and re-
port.
I beg to advise that the property
referred to is Lot 41, Coopers' Addi-
tion, and was assessed in 1919 at
$1,030. I would say it was worth
twice that amount. City taxes now
due on this property amount to
$17.36. In past years since Mr. Fis-
cher's death they have been paid by
Mr. Trewin, who holds an $800 mort-
gage against this property. This
property has been exempted from
county taxes since 1918.
Mrs. Fischer has five children, the
oldest daughter being about twenty -
one and the next daughter about
nineteen. The second daughter is
now working. There is also a little
grandchild at the house. Mrs. Fis-
cher undoubtedly has a very hard
time of it to support the family and
to pay the interest on taxes against
the place.
If it were legally possible to do
so, I would recommend that taxes
against her property be cancelled.

A Resolution.
Whereas, the contract heretofore
entered into by the City of Dubuque
for the improvement of Jackson
street, hereinafter described, has
been completed and the City Engi-
neer has computed the cost and ex-
pense of said improvement amounts
to $16,810.61;
Therefore, be it resolved by the
City Council of the City of Dubuque
that to provide for the cost of im-
proving Jackson street from the
north property line of Eighth street
to the south property line of
Eleventh street, there be issued im-
provement bonds to the amount of
$16,810.61. Said bonds shall be is-
sued under the provisions of Chap-
ter 8, Title V, of the Code of Iowa
and the amendments thereto, shall
bear date as of the 28th day of No-
vember, A. D. 1921, shall be in the
denominations of $300.00 each, ex-
cept that there shall be one bond to
the amount of $310.61; they shall be
numbered from 6829 to 6884 inclu-
sive, and shall be divided into seven
series, of which the bonds numbered

by the City of Dubuque pursuant to
and by virtue of Chapter 8, Title V,

bond is one of a series of fifty -six
bonds, fifty -five for Three Hundred

cited that all the acts and condition

ments, collections and payment
hereon of said special tax, the faith
and diligence of said City of Du-
buque are hereby irrevocably

Gentlemen: —We place the follow-
ing request before you to be taken
up by you with the City Councilmen
at the earliest possible date, so that
a favorable decision will, without
delay, permit us to make slight
changes in the arrangement of the
space occupied by the Dubuque
Boys' Club.
During a period of years part of
the second floor of the City Hall
and practically the entire third
floor of the same building has been
occupied by the Dubuque Boys' Club,
rendering a service to hundreds of
under- privileged boys. During the
summer the trustees of the Dubuque
Boys' Welfare Association, (spons-
ors for the Dubuque Boys' Club) de-
cided that the work with these boys
must. increase in scope or eventually
dwindle. This due partly to the in-
ability of Miss Van Duzee, Dubuque's
boy enthusiast, to give the work the
time required. It was therefore nec-
essary to hire a paid superintendent
and we have secured a most capable
man in the person of Earl G. Cook.
We have come to the time when
we, the trustees and works, con-
sider it advisable to have a definite
understanding with your body with
reference to continued use of pres-
ent quarters and possibilities for
slightly increasing space used, and
it is with that in mind that we are
addressing you.
We are confident that this space
in our City Hall cannot be used to
better advantage, and we see no
reason why it cannot be understood
that the quarters are available for
this work as long as the work con-
tinues, and in reference to the extra
space, we believe this can and will
he arranged, if possible. Otherwise
we, of course, will have to get on
with our present quarters. We are
in hopes that . some day some re-
arrangement of a second floor will
permit of an extension of our quar-
ters and perhaps at this very mom-
ent this is not entirely impossible.
In talking this matter over with you
a few days ago, you stated that it
might be well for possibly Mr. Cook
and myself, and perhaps other trus-
tees, to appear before your Body. If
you think it advisable, we will glad-
ly appear. Please remember that
we are all busy people, and if things
can be worked out with less appli-
cation of time it is better for all
concerned.
We sincerely appreciate the very
great favors extended to the Boys'
Club by the present and past city
administrations. They have made
possible the development of this
work and we are sure that the city's

interest and the interest of the in-
dividuals call for a furthering of
this work and a granting of our re-
quest, as surely we must all appre-
ciate that work of this kind de-
velops our citizenship and indirectly

of our Directors, it was called to
our attention that automobiles pass-
ing Finley Hospital were evtremely
noisy and were disturbing many of
our patients, especially those who
were confined to the Hospital on
account of nervous conditions.
We beg to ask permission to erect
two signs, which will state that this
is a quiet zone and will request
motorists and others to observe it.
Our idea would be to place one sign
on the south side of Delhi street
between the Hospital and the corner
of Grandview avenue, and another
sign on the west side of Delhi street
between the hospital and the corner
of Fifth street. This would place
the two signs approximately two
blocks apart. We would probably
want a sign similar in size and shape
to those placed near some of the
schools.

The undersigned as owner of a
barn on lot 241 in the City of Du-
buque, which barn consists of a
frame building, two stories in height
and is thirty feet from any other
building, is desirous of taking down
said building and rebuilding same
into a one -story building, about 8
feet high with a flat roof.
That it is necessary to have a
building of this kind upon the above
described lot for the purpose of us-
ing same as a coal shed, for myself
and tenants; that the same is lo-
cated on the alley between Fifth
and Sixth streets in the City of Du-
buque; that the building of said
building will make the same less
inflamable than before, as the under-
signed will have either corrugated
iron or stucco finish on the outside.
Wherefore the undersigned would

City Council,
Gentlemen: —In connection with
the improvement of Jackson street
next year, it is very important that
provisions be made for taking care
of the surface drainage. The plans
by the Engineer provide for a 60-
inch sewer under the tracks of the
Milwaukee Railroad Company, at
the foot of Nineteenth street, and
extending up to Washington street,
changing in size at Elm street to
54 -inch, the 54 -inch extending to
Jackson street and a 36 -inch sewer
in Jackson street to Twenty -first
street. It is also our intention to
lay a similar sever south on Elm
street and south on Jackson street,
in order to take care of the drain -
a ge from the various street inter-
sections. The Engineer estimates
the cost of the above mentioned
sewers, namely, the 60 -inch, 54 -inch
and 36 -inch together with manholes,
head wall, etc., to be approximately
$27,000.
Under the Appropriation Ordin-
ance, passed last March, the Coun-
cil appropriated for sewer construc-
tion, from current revenues, the sum
of $35,290.98. There is also avail-
able from the bond issue of $50,000
made for the construction of the
Lincoln avenue sewer, something
like $5,000. Of this total there is
now an unincumbered balance
amounting to about $30,000. There
has been, however, expenditures
made for which no appropriation
was made; for the construction of
the gutters along Dodge street,
amounting to in the neighborhood of
$3,000. There should be, therefore,
still available from the funds already
authorized, a balance sufficient to
pay for this new construction.
The plans for this work have been
ready for some time. I have de-
ferred placing the matter before the
City Council on account of the fact
that the consent of the Milwaukee
Railroad Company has not yet been
secured, to pass under their tracks.
In case their, consent is withheld,
we will have to change our plans to
connect with the Bee Branch sewer
on the west side of their tracks.
This will reduce the cost materially
but will not be as satisfactory from
an engineering point of view.
I would ask for authority from the
City Council to receive bids on this
work, bids as received to cover both
locations. This work can go ahead
immediately and aid in taking care
of the unemployed in the city.

Gentlemen: —At a meeting of the
Council held on October 24, the peti-
tions of George Fritsch and Mrs.
Tuegle, both requesting permission
to tear up Central avenue for the
purpose of making water connec-
tions, were referred to the Ctiy
Manager.
I find that on April 3, 1913, the
City Council directed that notices be
served upon all people along Couler
avenue from Twenty -sixth street to
Peru road, advising them to make all
necessary connections and at the
same time a resolution was passed
forbidding anyone to open this street
for a period of ten years after April
23, and providing for a fine of one
hundred dollars for each violation of
such resolution. Inquiry along this
street shows that notices were duly
served upon all of the abutting prop-
erty owners.
I understand that Mrs. Tuegel's
only means of support is the brick
building located at 2247 Couler ave
nue, and I also assume that she felt
at the time that she could not afford
either the connection or the use of
city water. My suggestion would be
that she arrange to hook onto the
tap of one of her neighbors until
such time as it will be possible to
permit her to tear up the street.
These taps are very conveniently
situated and a connection can be
made and both houses can be sup-
plied from the same service. While
this is contrary to the Water Works
rules, yet in my judgment it is the
best solution to this proposition.
The matter of the petition of J.
Fritsch is different. The lot at 2S50
Central avenue runs from Central
avenue to White street. Mr. Fritsch
lives on White street. This lot was
properly connected with both sewer
and water years ago. The lot on
White street has since been divided
and the portion on White street im-
proved. The house occupied by Mr.
Fritsch on White street has been
supplied with water from some time
and has already been installed with
the necessary fixtures. There seems
to have been sort of a neighborhood
quarrel and the party living next to
him has disconnected the water sup-
plied to Mr. Fritsch, which had pre -.
piously passed through their home.
Assuming that there would be no
difficulty in making the connection
on Central avenue, Fritsch has al-
ready laid the lateral across the
other lot to the curb on Central ave-
nue. In view of these facts, I would
suggest that a special permit be
granted to Mr. Fritsch to make the
connection on Central avenue. The
water main is located only about
eleven feet from the curb line, which
will not mean very much of an
excavation in the street.
