Special Session, December 1, 1921.
Meeting called by order of Mayor
Alderson and Councilman Brede.
Council met at 4:30 P. M.
Mayor Alderson in the chair.
Present —Mayor Alderson, Council-
men Brede, Gabriel and Rooney.
Absent — Councilman Melchior.
Mayor Alderson read the call and
stated that service thereof had been
duly made and that this meeting is
called for the purpose of levying a
special assessment for the improve-
ment of Bluff Street, from the north
property line of Eighth street, to the
intersection of Bluff and Locust
Streets; acting on the vacation of
the west fifty feet of May Place, and
acting on any other business that
may come before the meeting.
Notice certified to by the publish-
ers that a special assessment as pro-
vided by law will be levied at a spec-
ial session of the City Council to be
held December 1, 1921, to pay for
improving Bluff Street, from Eighth
to the intersection of Bluff and Lo-
cust Streets. There being no remon-
strance, Councilman Gabriel moved
that the notice be received and filed.
Seconded by Councilman Brede.
Carried by the following vote:
Yeas — Mayor Alderson, Council-
men Brede, Gabriel and Rooney.
Nays —None.
Absent — Councilman Melchior.

same, a special tax be and is hereby
lieved on the several lots, and parts
of lots, and parcels of real estate
hereinafter named, situate and
owned, and for the several amounts
set opposite each lot or parcel of

A Resolution.
Whereas, the contract heretofore
entered into by the City of Dubuque
pro-
for the improvement of Bluff Street,
hereinafter described, has been com-
pleted and the City Engineer has
computed the cost and expense of
said improvement, amounting to
$15,003.70;
Therefore, be it resolved by the
City Council of the City of Dubuque
that to provide for the cost of im-
proving Bluff Street from the north
property line of Eighth Street to the
intersection of Bluff and Locust
Streets, there be issued Improve-
ment Bonds to the amount of $15,-
003.70. Said bonds shall be issued
under the provisions of Chapter 8,
Title V, of the Code of Iowa, and
amendments thereto, shall bear date
as of the 31st day of December, A.
D. 1921; shall be in the denomina-
tions of $300.00 each, except that
there shall be one bond to the
amount $303.70; they shall be num-
bered from 7159 to 7208 inclusive,
and shall be divided into ten series,
of which the bonds numbered 7159
to 7163 shall constitute the first
series, and shall be payable on the
first day of April, A. D. 1922; the
bonds numbered 7164 to 7168 shall

THREE HUNDRED DOLLARS
with interest thereon at the rate of
five per cent per annum, payable on
the presentation and surrender of
the interest coupons hereto at-

are payable at the office of the City
Treasurer, in the City of Dubuque,
in the State of Iowa. This bond is
issued by the City of Dubuque per -
suant to and by virtue of Chapter 8,
Title V, of the Code of Iowa and

ance with a resolution of the City
Council of said City, duly passed on
the 1st day of December, A. D. 1921.
This bond is one of a series of fifty
bonds, forty -nine for Three Hundred
Dollars each, numbered from 7159
to 7207 inclusive, and one bond for
Three Hundred Three and 70 -100
Dollars, numbered 7208, all of like
tenor and date, and issued for the
purpose of defraying the cost of im-
proving Bluff Street from the north
property line of Eighth Street to the
intersection of Bluff and Locust
Streets, in the City of Dubuque, and
described in said resolution; which
cost is assessable and levied along
said improvement, and is made by
law a lien on all. abutting or adja-
cent property, and payable in ten
annual installments, with interest on
all deferred payments at the rate of
five per cent per annum, and this
bond is payable only out of the
money derived from the collection
of said special tax, and said money
can be used for no other purpose.
And it is hereby certified and re-
cited that all the acts and condi-
tion and things required to be done
precedent to and in the issuing of
this series of bonds, have been done
happened and performed in regular
and due form as required by said
law and resolution; and for the as-
sessments, collections and payment
hereon of said special tax, the faith
and diligence of said City of Du-
buque are hereby irrevocably pledg-
ed.

Gentlemen:
On June 17, 1893, Lot 225, Davis
Farm Add., was assessed on account
of the improvement of White Street
for the sum of $59.93. This amount
was never paid. The property was
then assessed to Rhomberg and
Meuser. These owners later sold
the property to the H. B. Glover
Company, who are the present own-
ers. This piece of property was
among other pieces for which the
tax titles were recently purchased
by the city. The H. B. Glover Com-
pany are desirous of clearing the
title of this property and have of-
fered to the City Treasurer the orig-
inal assessment plus costs.
In view of the fact that this as-
sessment was levied twenty -eight
years ago and that it has passed
into th'e hands of what might be
considered an innocent purchaser, I
would recommend the acceptance of
the original assessment plus costs,
by the City, as payment in full on
this account.

of sidewalk construction as levied
against City Lot 553 be allowed to

lows: This lot is improved by a
large two -story brick house, at the
corner of Dodge and Locust Streets,
while on the North 25 feet there is
a small frame house in which Helen
Meehan lives. The brick building
is and has been constantly rented
for $50.00 per month. In 1919 this
property was assessed for $4,280.00
and in 1920 taxes amounted to
$66.35. In view of these facts, I
would recommend that the petition

I have investigated the matter and
wish to report as follows: Lot 54
is improved with a small frame
house in which Elizabeth McGreavy
lives. Lot 53 is unimproved. I be-
lieve her circumstances are as set
forth in her communication. My
recommendation to the Council
would be that on the filing of a
proper petition, the general taxes be
allowed to remain a lien against the
property until paid.

Petition of John M. Lee, owner of

Sub., presented. He respectfully re-

tary sewer in Leibnitz Street, which
was completed in 1919 and the as-
sessment levied at that time. He
states also that he had filed a peti-
tion at the time the levy was made,
remonsrating against the assess-
ment, but failed to follow it up. As
a result the assessment stands as
levied, amounting to $57.00 on each
lot, while the value of the lots is
only $40.00 each, for which amount
he is perfectly willing to sell.

City of Dubuque, presented. He
states that on September 7th, 1920,
the City of Dubuque levied a special
tax for the construction of a sani-
tary sewer in Valeria Street against
said, lot, amounting to $192.05; that
said lot runs from. Kaufman Ave-
nue to Valeria Street, i s62 feet front
and 330 feet deep; that his house
is on Kauffman Avenue and he is
using the sewer which runs through
Kaufman Avenue, consequently the
sewer in Valeria Street is of no
benefit to him and never can be
until the North. 1/2 of said lot is
sold and a building erected thereon.
Said North 1/2 is of but little value
and at its best would not bring more
than $200.00, it being valued by the
Sourer system at $3.00 a front foot.
He therefore asks that the special
assessment be reduced to $50.00 or
to an amount equal to 25 per cent
of the value of the North 1 /2 of said
Lot 1 of Lot 2. of Lot 145 in L. H.
Langworthy's Addition.

Gentlemen:
Some time ago a list of persons
indebted to the City of Dubuque for
personal property tax which had be-
come delinquent was turned over to
me with instructions to collect the
same; even to the extent of bring-
ing suit thereon. I beg to advise
you that I have notified by personal
letter each person. upon that list of
the amount due, including accrued
interest thereon. In some cases the
taxes have been paid to me. In
others I am convinced that taxes
should not have been assessed
against the person, in other cases
the tax is wholly unavailable, and
still in others no response has been
made to my letter. In these latter
cases b shall start suit for the Janu-
ary Term of the District Court to
enforce collection.

been made by me and checks cover-
ing the same as herewith returned:

The Little Star Theatre is no
longer being operated and the owner
thereof at the time the tax was
levied had departed from the city.
Tax of 1919 should be cancelled.
The Vyverberg Auto Company has
failed and has no personal property
at this time. The tax of 1919 should
be cancelled. Ed. T. Sprengelmeyer
has been out of business since 1911
and should not have been assessed
upon prsonal property since that
time. Taxes from 1912 -1919 should
be cancelled.
The Studebaker Company is also
out of business and the taxes for
1918 and 1919 should be cancelled.
Andrew Weiner has left the city
and has no property here. The
taxes for 1916 -1919 should be can-
celled.
The taxes included within these
collections do not go back any far-
ther than 1916 and in each instance
where there are taxes due beyond
1916 where settlements have been
made as herein stated, these taxes
should be cancelled.
I have also made a few collections
from persons owing penalties upon

The petition of the Catholic Wom-
an's League, requesting cancellation
of the 1920 tax upon the South 1 /2
of the North Middle 1 -5 and North
1 / 2 of the Middle 1 -4 of Lot 479, has
been referred to for a report. The
petition also requests that this prop-
erty be exempt from taxation in the
future as long as it is owned by this
organization.
From my examination, I am con-
vinced that this organization, com-
monly known as the Neighborhood
House, is purely a charitable insti-
tution and its objects and purposes
are to aid in the welfare of the poor
and needy. It has no working capi-
tal nor any profit plan, but its whole
aim is to assist worthy persons in
the community. I do not think that
there is any question but what the
petition should be granted and I

therefore recommend that the taxes
for 1920 upon this property be can-
celled and the County Treasurer in-
structed accordingly and that the as-
sessor be notified that this property
should be carried as exempt from
taxation as long as it is owned by

buque, involving the collection of the
City's share of the taxes collected by
the County Treasurer upon moneys
and credits for the years 1918 and
1919, has been compromised and
settled for the sum of Five Thous-
and ($5,000.00) Dollars, the County
to pay the costs of suit in addition
to said sum. The manner in which
this payment is to be made is as
follows:
Immediate upon the passing of the
attached resolution the County will
pay to the City the sum of Twenty -
Five Hundred ($2,500.00) Dollars on
account and the remaining Twenty -
Five Hundred ($2,500.00) Dollars
will be paid on March 1, 1922.
I request that you pass the attach-
ed resolution so that the records in
both the City and County will be
clear upon this matter.

Whereas, an action at law was in-
stituted by the City of Dubuque
against the County of Dubuque to en-
force payment of the City's share of
the taxes collected by the County
upon moneys and credits for the
years 1918 and 1919, the same being
in the sum of Seven Thousand Five
Hundred Eighty -Eight Dollars For-
ty -Five Cents ($7,588.45), the same
being Law Number 20260; and,
Whereas, owing to a controversy
arising involving the legal right of
the City to insist upon such pay-
ment by the County because of cer-
tain matters which directly affect
the substantial rights of the parties,
it was deemed advisable to compro-
mise the claim of the City and mut-

ually adjust the same and thereby
save the expense and delay neces-
sarily incident to a law suit of this
kind.
Now, therefore, be it resolved by
the City Council of the City of Du-
buque, that, in consideration of the
payment to the City of Dubuque by
the County of the sum of Five
Thousand ($5,000.00) Dollars, to-
gether with the costs of suit, said
City of Dubuque does hereby settle
all matters involved in said action
and release said County from any
further liability or obligation arising
thereunder or from any future claim
involving the matters upon which
said action was brought and the City
Solicitor is hereby instructed to dis-
miss the action now pending against
the County.
Be it further resloved that said
County shall pay to the City said
sum of Five Thousand ($5,000.00)
Dollars as follows:
Immediately hereafter there shall
be paid to the City the sum of
Twenty -Five Hundred ($2,500.00)
Dollars and the remaining sum of

Mrs. Larkin is the widow of an
honorably discharged soldier of the
War of the Rebellion and as such is
entitled to an exemption in the
amount provided by law. Up to the
year 1920 she was the owner of Lot
Twelve (12) of Lot Two (2) of City
Lot 720, and received her exemption
upon said property. In 1920 she sold
this property to Martha Eckler and
acquired the property which she now
owns, namely, Lot One (1) of Dil-
lon's Subdivision from • Henry C.
Bechtel. It appears from the peti-
tion that the soldier's exemption to
which she was entitled was granted
to Martha Eckler upon Lot Twelve
(12) of Lot Two (2) of City Lot 720,
which is an error. Mrs. Eckler is
not entitled to this exemption.

Gentlemen: In the levying of the
assessment for the improvement of
Bluff Street, from Eighth Street to
Locust Street, the sum of $515.54
was assessed against the city lot on
which the Public Library stands.
To me it seems quite important
that every distinct municipal acti-
vity through its financial statement
should show the entire cost of the
municipal activity. It is, therefore,
important that this assessment be
paid by the L ibrary Board and out
of the library board funds.
The above assessment was not
foreseen when the library tax levy
was determined for 1920. They have

therefore no money available with
which to meet this unforeseen cost.
I would recommend that the sum of
$515.54 be transferred from the Con-
tingency Fund of the General City
Funds to the Library Fund in order
to enable them to take care of this
assessment.

the matter of a petition of John M.

I beg to advise that this work was
done and the assessment levied in
1919. Each of the three lots were
assessed $58.11. The tax books for

$60.00, which is probably a fair value
without the sewer. I would recom-
mend that a deduction in the assess-
ment against each of the above lots
of $33.11 be made, leaving a balance
of $25.00 puus interest paid on ac-
count of the sewer assessment.

that the building thereon had been
destroyed by fire July 9, 1919; that
the property had been assessed for
$9,000.00, assessable valuation in the
County $3,037.00, and taxes paid for
1919. And now they find that the
taxes for 1920 are still the same as
in 1919, which is incorrect, and re-
spectfully ask that the taxes on this
property be cancelled and the lots be
reassessed at $100.00 per lot, making
avaluation of $400.00.

valuation on this property be placed
at $150.00 per lot, making a valua-
tion of $600.00, and the County
Treasurer be instructed to accept
the taxes on this valuation for said

Gentlemen: In the matter of the
improvement of Eleventh Street,
from Central Avenue to the railroad
tracks, the actual cost was consider-
ably beyond the original estimates.
This was due very largely to the fact
that a much greater amount of bin-
der was laid than had been estimat-
ed. The individual assessments
were also higher than we had figur-
ed, on account of the fact that of
the entire cost of the paving of this
street the street and alley intersec-
tions amounted to 33.88% or over
one-third.
It has been for years the practice
of the City to require the owners of
property to pay for all street inter-
sections. At the present time the
municipal finances, in my judgment,
do not warrant a deviation from
this principle. On the other hand, it
is a little unfair to require people
abutting certain streets to pay for
the street and alley intersections,
while people abutting streets run-
ning in the opposite direction have
no alley intersections to pay.
We also find that the cost of the
paving of the alley intersections
amounts to 9.3% of the total cost of
the improvement of Eleventh Street.
In order to equalize the paving
costs and also in order to make some
reduction on the very large cost of
the abutting property owners on ac-
count of the improvement of this
street, , I would recommend that the
City assume, on account of the alley
intersections, 10% of the entnre cost
of this improvement, which will
amount to something in the neigh-
borhood of $2,500.00, and that the as-

sessments of all those assessed for
this improvement be reduced 10 %.

Gentlemen: Lot 1 of 1 of Min.
Lot 67, containing fifteen and eight -
tenths acres, was assessed on ac-
count of the improvement of Dodge
Street, from Bluff Street to South
Dodge Street, for $1,533.44. The
above property belongs to W. A. Mc-
Lean and is carried on the Assessor's
book at $2,040.00.
Mr. McLean wrote to me asking
that some arrangements be made for
a reduction in this assessment. I
suggested to him that an assessment
on account of the improvement of
Dodge Street, amounting to $600.00
based on a $2,400.00 valuation of
property, would be in my judgment
a fair proposition to all concerne.
Mr. McLean concurs in this feeling.
I would, therefore, recommend that
the total assessments as levied
against this Lot 67 be reduced by
the sum of $933.44, leaving a bal-
ance to be collected of $600.00.

Gentlemen: The accompanying pe-
tition of Ida M. Reid for a reduction
in the assessment on account of the
improvement of Angella Street and
Cox Street, which was levied against
Lot 2, Kringle's Sub., which she
owns, has been investigated and I
wish to report the following facts:
Special Session, December 14, 1921
In the first place, the improvement
of Cox Street and the improvement
of Angella Street Were separate im-
provements. Both were levied on
November 6, 1919. The assessment
on account of the improvement of
Cox Street was $69.12; $19.74 of this
assessment has been paid, leaving a
balance of $41.38. The assessment
against the lot on account of the im-
provement of Angella Street amount-
ed to $126.56, of which $36.16 has
been paid, leaving a balance of
$90.40. Assuming that the value of
this lot is $200.00, which is a fair
value, Miss Reid would be entitled
to a reduction in the outstanding as-
sessment on account of the improve-
ment of Angella Street.

Mrs. Catherine Rea addressed the
Council remonstrating against the
assessment for constructing a side-
walk in front of and adjoining her
property on Catherine Street. Ac-
tion on this was taken later in the
meeting.
Miss Julia Kemler addressed the
Council relative to condemned build-
ing on Central Avenue, stating that
she had a prospective buyer for the
property and asked for an extension
of time for removing same. Council-
man Melchior moved that the time
be extended to Jan. 15, 1922, with the
understanding that the building must
be razed after that date, irrespective
of who the owner may be • at that
time. Seconded by Councilman
Brede. Carried by the following

J. H. Rhomberg addressed the
Council relative to condemned build-

Estate, stating that he had good
prospects of selling the property con-
demned and asking the Council to

A communication from Geo. D.
Yyon, Agent for the Lyon Estate,
relative to condemned building own-
ed by the Estate, presented, stating
that arrangements had been made
with Contractor Gere to repair the
building, to comply with recommen-
dations made by the Chief of the
Fire Department.
Councilman Melchior recommend-
ed that the Contractor submit sketch
of the proposed work to be done. No
further action taken at this time.
Bids for the sale of the South 44.6
feet of City Lot 108, with all build-
ings and appurtenances thereto be-
longing, known as Engine House
Number Two (2), located on the N.
W. Corner of Fourth and Locust
Streets, received.
There were four bidders on this
property, Fischer & Co., Inc., per
Eldon F. Fischer, being the highest
bidder, his bid being $13,100.00.
Councilman Brede moved that the
property be sold to him with the un-
derstanding that the City is to have
the use of the property until August
1, 1922, the City to pay no rent for
the use thereof for this period, and
the City guarantees that the Fischer
& Co., Inc., be exempt from paying
City taxes on this property for the
year 1922; also that the Fischer &
Co., Inc., make a payment of $500.00,
and the Mayor be authorized to exe-
cute a deed of the said property to

Whereas, the contract heretofore
entered by the City of Dubuque for
the construction of a sanitary sewer,
hereinafter described, has been com-
pleted and the City Engineer has
computed the cost and expense of
said improvement amounts to
$3,575.44;
Therefore, be it resolved by the
City Council of the City of Dubuque
that to provide for the cost of con-
structing a sanitary sewer in West
Seventeenth Street from the end of
the present sewer in said street to
Cox Street, there he issued Sewer
Bonds to the amount of $100.00.
Said bonds shall be issued under the
provisons of Chapter 8, Title V, of
the Code of Iowa and the amend-
ments thereto, shall bear date as of
the 20th day of January, A. D. 1921,
shall be in the denominations of
$100.00 each, ecxept that there shall
be one bond to the amount of $75.44;
they shall be numbered 7214 to 7249
inclusive, and shall be divided into

relative to delinquent taxes and spe-

property has been subdivided on two
different occasions, making' the mat-
ter confusing and misleading both to ,
himself and to the City officials.
That this property has been subject
to both special assessment forpaving
and part delinquent taxes, a portion
of both of which have been paid,
having paid $1,248.26 to the City and
$1,023.88 to the County, which
amounts to $2,281.41 and with this
year's taxes will amount to over
$2,500.00, and further that the spec-
ial assessments levied in 1915 for
paving seems out of all proportion
to the value of the property. He
therefore petitions the City Council
to investigate and try to arrive at
some fair and reasonable basis in
settlement with the City.

ORDINANCE NUMBER 112.
An ordinance regulating the sale
and distribution of milk, cream and
ice -cream within, the City of Du-
buque; prescribing sanitary condi-
tions for dairies and milk, cream and
ice -cream . depots, and other places
where these products are sold, .re-
ceived and delivered from;' requiring
a. license for the selling of milk and
cream and defining the procedure to
procure the same; providing for the
appointment of a dairy inspector and
defining his duties; and fixing a
penalty for a violation hereof.
Be it ordained by the City Council
of the City of Dubuque:
Permits.
Section 1. It shall be unlawful for
any person or persons to bring into
or receive into the City of Dubuque
for ,sale, or to sell, or to offer for
sale, any milk or cream without first
having obtained from the City Man-
ager a permit or license to do so,
as hereinafter provided. The term
"Dairy" shall apply to any person
or persons selling milk or cream of
two or more cows, and such person
or persons shall be considered in
this Ordinance as owning or having
a dairy.
Section 2. Said permit or license
shall state that the licensee will
comply with this or any other Ordi-
nances of the City, and, for violation
of any of its terms, the Manager
shall have the power to suspend or
revoke such license and said license
may also be revoked by a majority
vote of Board of Health. A new li-
cense may be granted to do a regu-
lar dairy business if the applicant
therefor agrees to comply with all
the Ordinances and laws of the City
pertaining to same and upon the
recommendation of the Board of
Health and the Health officer. It
shall be unlawful to carry on said
business after the revocation of the
license. All ,permits or licenses shall
be issued free of charge. '
Section 3. To procure such a
permit or license the applicant
therefor shall file with the said
Health Officer a written statenient,
setting forth his residence, the num-
ber of cows owned by him, the name
and address of any and all persons
from whom he is purchasing or ob-
taining milk, and the number of
gallons of milk sold by him daily,
as nearly as he .can estimate same: '
and if such permit or license be
granted, it shall be the duty of the
holder thereof to notify the Health
Officer in writing of any change in
the name or address of the persons
front whom he obtains his supply 'cif
milk,
Section 4. All permits or licenses
must be renewed during the month
of April of each. year to be valid.
Renewal of permits or licenses may
be granted at the discretion of the
Health Officer after - investigating
the record of said applicant.' There'
shall be •no 'charge or fee made for
license ' or permits. • '
Section 5. There' 'shall be no
charge for permits issued to in-
dividuals'' or - family cogs not desig=
uated as dairies, but such cows shall
come under the supervision of the
sanitary and health officers of the
City of Dubuque as provided by City
Ordinances on Sanitation. Owners
of private cows are not permitted
to sell or offer for sale or in any
way exchange milk or cream other
than is hereinafter provided. Per-
sons issued such license or permit
heretofore mentioned will deliver to
the milk inspector such samples of
milk as he may desire to be used in
making chemical and - bacterial
analysis.
Section 6. It shall be unlawful
for any person to sell, offer for sale
or have on hand for sale in this city
any milk, or cream who fails or
neglects, by himself or agents, to
comply with all the terms of this
Ordinance, or who sells, or offers
for sale, or has on hand for sale,
milk or cream from cows or dairies
which are not maintained as re-
quired by the terms of this ordi-
nance. Owners of individual or pri-
vate cows are permitted to dispose
of any surplus milk or cream that
is produced by the number of cows
permitted under dairy Ordinances to
any person who on application shall
call at the home for such milk or
cream products, but such owners
are not allowed to make deliveries.
Section 7. No building shall be
used for stabling cows for dairy pur-
poses which is not well lighted, ven-
tilated, drained or constructed.
Section 8. The stalls or places
where the cows are milked shall be
provided with clean floors. The ac-
cumulation of urine, manure, stag-
nant water, or other filth, shall not
be permitted in any stable or place
where milk cows are kept to the ex-
tent that the cows may become be-
fouled by lying in or walking through
same.
Section 9. No water closet, cess
pool, urinal or habited room shall be
located within any building or shed
used for stabling cows for dairy
purposes.
Section 10. No accumulation of
manure, urine, stagnant water or
other filth shall be permitted within
twenty feet of this stall or place
where cows are kept.
Section 11. Every building or
shed for cows for dairy purposes
shall be kept clean and in good re-
pair and well painted or white-
washed.
Section 12. Milk from cows suf-
fering with tuberculosis, actinomy-
cesis, texas fever, abscess, or any
other contagious or infectious dis-
ease, and milk from cows twenty
days pervious to and ten days after

parturition shall not be marketed in
the City of Dubuque. All cattle of
dairy herds supplying unpasteurized
milk to the City of Dubuque at retail
shall be subjected to a recognized
tubercline test, at least once a year
and as often as the Board of Health
of the City of Dubuque deems it
necessary to apply such test.
When the above mention tuber -
culine test is applied and animals
are found to be tubercular as the
result of said test, such animals that
are reactors must be marked in such
manner as they may be readily
identified, and disposed of in man-
ner specified by the State Law of
Iowa. No milk produced from a cow
or cows which have reacted to the
tuberculine test _shall be pasteurized
and distributed or intended for dis-
tribution as fluid milk.
Section 13 It shall be the duty
of every person having charge or
control of any premises upon which
cows are kept to notify the dairy
inspector of the existence of any
contagious diseases or serious or re-
curring inflammation or abscess of
the udder immediately upon the dis-
covery thereof, and to immediately
isolate such cow or cows, and keep
same away from herd until permis-
sion is granted in person by the
Dairy Inspector to permit such cow
or cows to return to the herd.
Section 14. It shall be unlawful
for any Dairyman to feed to milk
cows, or have in his possession with
intent to feed to milk cows, any
garbage, swill, refuse, wet brewers'
grain or other improper food.
Milkers.
Section 15. All milkers and other
attendants who handle the milk or
cream which is offered for sale or
delivered in the City of Dubuque
shall be personally clean, and all
such persons, before entering upon
their duties shall thoroughly wash
their hands with soap, and no milker
shall be permitted to wash the teats
of the cows with milk or water in
the milk bucket, or to milk the cows
with wet or moist hands.
Section 16. It shall be the duty
of any person having charge or con-
trol of any permises upon which
milk or cream is produced, handled,
stored or distributed, to notify the
Health Officer immediately upon
the discovery of diphtheria, measles,
membranous croup, scarlet fever,
small pox, typhoid fever, or any
other contagious or infectious dis-
ease upon such premises.
Section 17. No milk or cream
shall be sold, exchanged, given
away, or in any manner distributed

from such infected premises until
all danger of the spread of the dis-
ease shall be removed and the
Health Officer certifies to that ef-
fect.
Section 18. Any person who at-
tends to cows, or milks them, or
who has the care of handling of ves-
sels for the sale, storage or distribu-
tion of milk or cream shall not enter
any place or premises wherein exists
any of the diseases mentioned herein.
Nor shall any such have any com-
munication direct or indirect, with
any person who resides in or is any
occupant of such infected place.
Section 19. All vehicles used for
handling or distributing milk or
cream must be kept neat and clean,
and in good repair, and must not be
ored for hauling manure, slops, or
anything elae of any objectionable
nature and must be provided with a
covered top of canvas, or of ' -r ;: a-
tcrial with% -will protect all vessels
containing milk or cream from
rays of the sun. Vegetables, fowls
and other farm products will be
termed under this section as objec-
tionable and will not be premitted on
wagons or vehicles used for the de-
livery of milk and cream, except in
case of delivery by grocer, and all
milk thus delivered must be in bot-
tle and sealed with closely fitting
lid.
Section 20. Each vehicle used for
distributing milk or cream shall have
'printed on each side, in letters not
less than inches, either the
name of the dairy, the name of the
person to whom such permit was
granted or the number of such per-
mit.
Milk Depot.
Section 21. All milk depots and
places for handling milk must be
kept thoroughly clean throughout,
and must he screened so as to ex-
clude all flips. The floors of milk
depots must be of cement or tiling,
the room in which milk is handled,
or kept, shall be screened, or pro-
tected in such manner as to be free
from flies and bugs. ,
Care of Milk.
Section 22. All milk shall be
strained as soon as milked through
not less than two thicknesses of
gauze or through sterilized cotton
similar to that used in the Clark
Strainer. -
Section 23. All milk must be of-
fered for sale as milked from the
cow, and shall not be passed through
cream separators or other apparatus,
other than strainers or clarifiers for
the purpose of removing manure,
dirt or other substance.
Section 24. All milk must be
cooled to 60 degrees Fahrenheit or
lower immediately after being milk-
ed, and all milk shall be marketed
as soon as possible after milking.
Section 25. All milk brought into
the City, or sold or offered for sale
in the City at retail must not con-
tain more than 200,000 bacteria per
cubic centimeter. Market milk must
not contain more than 500,000 bac-
teria per c. c. All milk sold in the
City of Dubuque, at retail, shall be
from tuberculine tested cattle or shall
be pasteurized as hereinafter stated.
Section- 26. It shall be unlawful
for any person or persons to bring
or receive into the City of Dubuque
for sale, or to sell any milk which
contains any manure or dirt in quan-
tity sufficient to be detected with
the naked eye after milk has been
standing for one hour or more, or
to sell or offer for sale any milk
that may contain any obnoxious odor
or taste.
Section 27. No milk shall be kept
in ice ,boxes or refrigerators which
are in any way connected with
sewers or cess pools, nor shall any
milk be kept in the same compart-
ments of any ice box or refrigerator
in which meats or other articles of
food of objectionable nature are
kept.
Section 28. It shall be unlawful
for any dealer in milk or cream, or
his agents, to serve milk or cream
in bottles to any dwelling that is
placarded by the Department of
Health for contagious disease, until
such placard has been removed by
the proper authorities. This section
is not .intended to prevent the de-
livery of milk or cream to such
dwellings.
Section 29. It shall be unlawful
for any person to remove from such
dwelling any bottles or receptacles
which have been or are to be used
for the purpose of receiving or stor-
ing milk or cream.
Section 30. It shall be unlawful
for any dealer in milk or cream, or
his agents, to bottle or cause to be
bottled, or to be placed in jars or
cans, any part of his milk or cream
supply while upon the wagon or at
any other place than the dairy or
milk depot. Restaurants, hotels,
cafes, lunch stands, and other eating
places, must supply milk to the pub-
lic in the original container as sup-
plied them by the dairymen. No
milk shall be served in the above
mentioned places where same has
to he dipped or poured, and no milk
furnished to any of the above men-
tioned places can be supplied in con-
tainers larger than a quart size ex-
cept for cooking purposes.
Section 31. All milk or cream
brought or shipped into the City for

sale or offered for sale by dairymen
or their agents, milk depots, hotels,
restaurants, lunch rooms, ice cream
factories, etc., at retail, shall be kept
at a temperature below 55 degrees
Fahrenheit, and must not contain
more than 200,000 bacteria per cubic
centimeter.
Section 32. It shall be unlawful
to sell, offer for sale or have on
hand for sale, any milk, cream, but-
ter or cheese containing any pre-
servatives of any kind, or adulterat-
ed milk, cream, butter or cheese.
Section 33. The words "adulter-
ated milk," as used in this ordinance
mean:
Milk containing more than 88 per
centum of water.
Milk containing less than 11.50
per centum of milk solids.
Milk containing less than 3 per
centum of butter fats.
Milk which has been diluted with
water or other fluid, or to which has
been added, or into which has been
introduced any substance whatever.
Milk drawn from animals fed on
distillery waste, wet brewers' grain
or any substance in a state of putre-
faction, or on any unwholesome
food.
Cream.
Section 34. Cream sold or offered,
or kept for sale as such, must con-
tain at least 16 per cent butter fats,
and must not contain any foreign
substances or coloring matter, and
must not contain more than 1,500,-
000 bacteria centimeter.
Ice Cream.
Section 35. Ice cream, sold or
kept for sale, must contain at least
10 per cent butter fats for fruit ice
cream, and 12 per cent for plain ice
cream.
All ice cream factories, where ice
cream is manufactured for sale, must
have floors of tiling or cement, and
must be maintained in a cleanly
manner. The bacterial count of ice
cream must be less than 2,000,000
per c. c.
Skimmed Milk.
Section 36. All milk which con-
tains less than 3 per cent butter fats
and not less than 11.50 total solids,
which is of specific gravity between
1030 and 1038, which is free from
foreign addition of any kind, and
conforms to the requirements of
sweet milk as regards temperature
and number of bacteria per cubic
centimeter, except where being
ripened for butter milk, shall be
known as "skimmed milk," and may
be lawfully sold as such, if all ves-
sels, cans and packages be distinctly
marked in a conspicuous place on

the outside of each container with
the words "skimmed milk" in letters.
Buttermilk.
- Section 37. This ordinance is also
to apply to buttermilk and the care
thereof which is herein defined to
be a product obtained from properly
reopened whole milk, cream, or
skimmed milk where most of the
butter fat has been removed. But-
termilk must have at least 9 per
cent total solids and show no visible
dirt, and shall not be adulterated
or otherwise manufactured, other
than above mentioned.
Care of Vessels.
Section 38. All cans, bottles or
vessels of any kind, used for holding
milk or cream, must be cleansed at
least once a day with soap or soda,
or other cleansing preparations and
then rinsed with boiling water. They
shall always be cleansed as soon as
emptied. All bottles, cans and ves-
sels in which milk or cream has been
delivered must be thoroughly
cleansed before they are returned to
the dairymen.
Section 39. Copies of this Ordi-
nance are to be printed on card
board, and copy of same delivered
with each permit, or renewal of
same, and said copy must be posted
in a conspicuous place in the dairy
or milk depot of party holding such
permit.
Section 40. The Board of Health
shall appoint a suitable person as
Dairy Inspector at a salary to be
fixed by the Council by resolution.
The Dairy Inspector shall familiarize
himself with all States Laws, Ordi-
nances and rules and regulations of
all State Officers and of the State
and local Board of Health relating
to the production and distribution of
milk, skim milk and cream, and shall
see that all such laws, ordinances
and rules are strictly enforced. He
shall take samples of milk, skim -
milk and cream distributed or in-
tended for distribution for deter-
mining whether such complies with
all State laws, Ordinances, rules and
regulations of all State Officers, and
of the State and local Board of
Health. He shall inspect all dairies
from which milk is distributed and
all distributing stations and places
where milk is kept for distribution,
a complete record of all conditions
and examinations found shall be
filed with the Health Officer. The
powers and duties of the Dairy In-
spector may be exercised by, com-
bined with or delegated to any other
officer or employee of the Board of
Health. In the discharge of his duties
he shall co- operate with the State

Dairy and Food Commissioner, the
Animal Health Commission, and the
State Board of Health.
Section 41. Pasteurization, as
used in this Ordinance, shall be
process by which milk is heated to
a temperature of not less than 140
degrees F. and held at this tempera-
ture for not less than thirty (30)
minutes, or to a temperature not
less than 145 degrees F. and held
at this temperature for twenty (20)
minutes. Pasteurized milk shall be
immediately cooled to a temperature
of fifty degrees F. or below and held
at that temperature until delivery is
made to consumer. No milk shall be
re- pasteurized.
Section 42. Every pasteurizing
apparatus shall be equipped with a
standard type of automatic time and
temperature recording device which
shall be attached, adjusted, and used
in a manner prescribed by the
Health Officer.
The recording chart shall be dated
and filed at the pasteurizing plant
and be available for inspection by
the Inspector or other representa-
tives of the Health Department.
Section 43. No pasteurized milk
or cream shall be sold or distributed
in the City which is not labeled as
pasteurized.
Section 44. All drains in the pas-
teurizing plant shall be properly
trapped and all sewage disposed of.
Section 45. All rooms in which
milk is handled and in which milk
apparatus and utensils are washed
shall be adequately lighted and pro-
vided with sufficient ventilation.
Section 46. All pasteurizing plants
shall be effectively screened against
flies. Screen doors shall be provided
with self - closing devices.
Section 47. Suitable toilet facili-
ties shall be provided for use of em-
ployees. Toilets shall not open di-
rectly into any room in which milk
or milk utensils are handled. Hand
washing facilities and clean towels
shall be provided.
Section 48. No cats, dogs, or
other animals shall be permitted in
rooms where milk is handled or
stored.
Section 49. An adequate supply
of pure water shall be provided.
Section 50. All cans, storage vats,
mixing vats, and other apparatus
shall be constructed of tinned or
glazed metal or other suitable ma-
terial, and all angle joints shall be
smoothly soldered. They shall be
provided with close fitting covers.
Section 51. All pipes and pumps
shall be of sanitary construction and
so arranged that they may be easily
opened or taken apart for cleaning.
The use of tightly closed elbow
joints shall be prohibited.
Section 52. The rooms in which
milk is handled, and the surrounding
premises, shall be maintained in a
clean and sanitary condition.
Section 53. Suitable facilities
shall be provided for washing and
sterilizing apparatus, and such ap-
paratus shall be cleaned and steri-
lized immediately before the process
is begun.
Section 54. No person shall be
employed in a pasteurizing plant or
in handling or bottling milk who
has any communicable disease as
determined by a medical examina-
tion made under the direction of the
Board of Health, and before any per-
son shall. be employed in any pas-
teurizing plant, his name and ad-
dress shall be furnished to the City
Dairy Inspector and a certificate ob-
tained from the examining physician.
Section 55. After July 1st, 1923,
or as soon as State aid is available
for the assistance in obtaining tuber -
culine tests all milk sold or distrib-
uted in the City shall come from
cows free from tuberculosis as
shown by tuberculine tests, as speci-
fied in Section 12 of this Ordinance.
Section 56. Any person violating
any of the provisions of this Ordi-
nance shall be deemed guilty of a
misdemeanor and for each offense
shall, upon conviction be fined not
less than five dollars and not more
than one hundred dollars or impris-
oned not more than thirty days.
Section 57. All ordinances or
parts of Ordinances in conflict with
this Ordinance are hereby repealed.
Section 58. This Ordinance shall
be in force and effect ten days from
and after its final passage by the
City Council and publication as pro-
vided by law.

and has a residence upon that part
of the lot which fronts upon Kauf-
mann Avenue. The remaining por-

examination of the circumstances
