Petition of W. J. Robinson, pas-
tor of the First Baptist Church, ask-
ing the City Council to remit the
taxes on Lot 1 and 2 of Lot 756,
McDaniel's Sub. of Town Lot, Du-
buque, for the years 1916 and 1917,
claiming same were deeded to the
church in 1915 and are non- assess-
able, Presented and read.
On motion of Ald. Frith, the peti-
tion was referred to the City Assess-
or.
Petition of the Adams Company,
asking the City Council to sell to
them the small triangle of land sit-
uated near the corner of Fourth
Street Extension, Sixth Street and
Market Street, known as Lots 1 of
1 of 15 and 1 of 1 of 16, in Block
30. Dimensions, 50 ft on Sixth
Street, about 65 ft. on Fourth Street
Extension, about 60 ft. deep on the
west side, and about 12 ft. deep on
the east side, claiming that in the
county books, by some misunder-
standing said lots are assessed to
John V. Rider. The Adams Com-
pany purchased from John V. Rider
all the Property that he owned in
Block 30, and he never claimed to
own any of Lot 15 or 16 mentioned
above, also according to the books
of the City of Dubuque, the above
lots belong to the City. of Dubuque
and when the Fourth Street Exten-
sion was improved, this street as-
sessment was charged up to the City
of Dubuque on the above mentioned
lots. They offer to pay the City of
Dubuque $100.00 for a clear title to
the above mentioned lots, presented
and read.
On notion of Ald. Leist, the peti-
tion was referred to the Committee
the Whole to view the grounds,
and the City Engineer instructed to
stake off and make a plat of the said
lo ts.
Petition of Louis F. Metz, guar-
dian for the minor children of
George Schlegel, deceased, asking
the City Council to cancel taxes or

Lots 8 and 9, Weiland's Sub., stat-
ing that there is an assessment lev-
ied against said lots for $94.96 and
the property was bid in at the sale
for $104.26, presented and read.
On motion of Ald. Andresen, the
petition was referred to the Com-
mittee of the Whole and Mr. Metz
to be notified to be present.
Petition of Mrs. E. Crunion, ask-
ing the City Council to cancel the
taxes and have same remain as a
lien against the N. E. 80x100 ft. of
Lot 9, Summer Hill Add., for the
years 1914, 1915, 1916, 1917 and
1918, assessed to John Crunion Est.,
presented and read.
On motion of Ald. Plamondon, the
prayer of the petition was granted
as an act of charity.
Petition by residents on Burden
and Davis Ave., asking the City
Council to have a light placed at the
corner of said streets, presented and
read.
On motion of Ald. Leist, the peti-

of the Whole to view the grounds.
Petition of Mrs. C. J. Evans, ask-
ing' the City Council to investigate
and arrange to pay bill of $52.40 for
repairs made on sewer running from
her house at 2671 Couler Ave.,
claiming said work had to be done
on account of the storm sewer not
being properly laid, presented and
read.
On motion of Ald. Frith, the peti-
tion was referred to the Sewer Com-
mittee to report to the Committee
of the Whole. •

such examination, to be in excess
of what would be a reasonable and
fair return on the value of the Com-
pany's property employed in the gas
service; and, while said Company
claims that the cost of reproduction
at the present time of its plant and
property used in the gas service
would exceed the amount of the per -
n]anent capital liabilities of the
Company, that is, its capital stock
and bonds, which aggregate $710,-
500.00, it is willing to have the re-
turn for said period based on the
amount of said permanent capital
liabilities, and,
Whereas, this Council knows that
the price of labor, coal, and other
articles and commodities entering
into the cost of supplying gas and
gas service have greatly increased
over what they were prior to the
war and it desires to be just and
fair alike to said Gas company, and
to its customers, and it believes that
it is for the best interests of this
ccmmunity that said Gas Company
should be permitted to charge a
rate for gas that will enable it to
maintain its solvency and to earn a
lair and reasonable return or profit
from its business, and it believes
that the public generally who are
the customers of said Gas Company
entertain the same opinion, and,
Whereas, this Council further be-
lieves that it is desirable that the
expense of litigation in the Courts
to determine the question of the suf-
ficiency of said rate be avoided and
that the interests of the customers
of said Gas Company, as well as said
Gas 'Company, itself, can be fully
and justly protected by an actual
experiment and adjustment of the
rates for gas determined by the re-
sult of such experiment and from
the books and accounts of said
Company at the end of the period
covered by such experiment and it
further believes that under the ab-
normal conditions now prevailing
and under all the circumstances said
Gas Company ought to be satisfied
with a return of 6 per cent per an-
num, on its permanent capital lia-
bilities during said period of eigh-
teen months.
NOW THEREFORE, Resolved,
by the City Council of the City of
Dubuque:
That the price of gas for the
eighteen months' period beginning
July 1, 1918 and ending December
31 1919, to consumers in the .City
of Dubuque, shall be adjusted -in the
following manner:
(a) Three auditors or umpires,
citizens of Dubuque, Iowa, shall be
chosen,' one by the City Council, one
Regular session, Jan. 2, 1919.
by the Key City Gas company, and
the third by the two thus chosen.
The representatives of each party to
be chosen at the pleasure of the
pleasure of the party represented,
but not less than sixty (60) days pri-
or to December 31, 1919 and the
third auditor or umpire not less
than thirty (30) days prior to said
date,
(b) As soon after December 31,
1919, as practicable, these auditors
shall investigate the accounts of
the Key City Gas company for the
purpose of determining the financial
result of its operations for said
eighteen months' period ending De-
cember 31, 1919.
(c) In the event the result of op-
erations show net earnings of more
than 6% per annum, on the present
permanent capital liabilities of the
company, being the amount of its
capital stock and bonde outstanding,
and which amount is $710,500.00,
such excess over said 6% shall be
rebated by the Key City Gas com-
pany to its consumers of gas dur-
ing said period in proportion to their
respective bills for gas for said
period.
(d) The Key City Gas Company
shall be required to execute to the
City of Dubuque, a bond in the sum
of Fifty Thousand ($50,000.00) Dol-
lars to guarantee the payment of
such rebate if any that may be due
its consumers. The bond to be in
substantially the form hereto at-
tached and the surety of ' sureties
thereon to be approved by the
Mayor.
(e) This resolution is to take ef-
fect and be binding on the Council
only in case that the said Key City
Gas Company shall within five (5)
days after its adopton deliver to the
Mayor the bond above referred to,
and file with the City Recorder an
instrument in writing, accepting
the terms and conditions of this res-
olution, and agreeing that the rates
for gas for the eighteen months'
period in question shall be deter-
mined in the manner set forth here-
in.

(f) In as much as the ordinance
adopted by this Council on December
5, 1918, and hereinbefore referred
to is inconsistent with the provisions
of this resolution, it is understood
that upon the acceptance of the pro-
visions of this resolution by the said
Key City Gas Company, said ordi-
nance will be repealed by this Coun-
cil.
(g) It is further provided and
agreed that the heat units employed
by said Gas Company shall be not
less than 560 B. T. N. for three (3)
consecutive days at any one time.
(h) It is further provided that ex-

whom was referred the petition of
the Key City Gas Co., asking that
the Ordinance adopted by the City
Council on December 5th, 1918, set-
ting the price on gas at $1.10 per
1000 cu. ft., be repealed and asking
the Council to allow the rates to r.)-
main as it has been for the past six
months ($1.25 per 1000 cu. ft.) and
at the end of the year 1919 the City
and the- Gas Company appoint an
auditor each and the two thus ap-
pointed to pick another and the
three of them examine the books of
said company and if they showed a
large profit said company would re-
bate it back to the consumer, would
respectfully recommend that the
prayer of the petition be granted
and the said Ordinance repealed.

Ald. Frith moved to adopt the re-
port of the Committee of the Whole
relative to the petition of the Key
City Gas Co.
Carried by the following vote:

Ald. McLaughlin offered the fol-
lowing:
Whereas. for many years prior to
July 1, 1918, the Key City Gas' Com-
pany charged and collected from
users of gas in the City of Dubuque,
Iowa, a net rate of $1.00 per thous-
and cubic feet where the consump-
tion of gas amounted to 1000 cubic
feet or more per meter per month,
'and a higher. rate for gas used and
for the use of meter, in all cases
where the consumption of gas 'was
less than 1000 cubic feet, per meter,
per month; and on said date in-
credsed its rates* to $1.25, net, per
1000 cubic feet where the consump-
tion amounted to 1000 cubic feet
per meter, per month, or over, and
a higher rate for gas used and for
the use of meter where the con-
sumption of gas- was less than 1000
cubic feet per meter, per month,
and,
Whereas, remonstrance against
said raise was filed with this Coun-
cil and this Council di,d, on Decem-
ber 5, 1918, adopt an ordinance
which, on December 6, 1918, was
signed by the Mayor and officially
published and which ordinance fixed
the price which- said Company may
charge private consumers for gas at
the rate of $1.10, net, per thousand
cubic feet, said price to commence
with the gas bills of February 1,
1919, and,
Whereas, said Gas company has
protested against said rate and said
ordinance, and represents, and
' claims, that the rate fixed by said
ordinance is inadequate to enable it
to earn any reasonable return on the
value of its property employed in
the gas' service, and amounts to a
confiscation of its property, and
claims, that if said rate is insisted
upon, said Company will be obliged
to bring snit to have the sufficiency
and validity of said rate determined
in Court, and has stated that such
litigation is extremely expensive, and
it desires to avoid such litigation,
and has asked that said ordinance
brs repealed, and has suggested that
for the period of eighteen months,
commencing with July 1, 1918, the
question of the rates to be finally al-
lowed for gas be adjusted by agree-
ment, which includes an examina-
tion of tite books and accounts of
said Company, at the end of said
period, and a rebate by the Corn-

tensions or improvements made by
the Gas Company during the period
covered by this agreement shall not
be charged as an item of expense,
but rather be investments.
FORM FOR BOND.
Know All Men By- These`Presents:
That we, The Key City Gas Com-
pany of Dubuque, Iowa, as princi-
pal, and — -- as surety, are held
and firmly bound unto the City of
Dubuque, Iowa, and to all persons
here concerned in the penal sum of
Fifty Thousand ($50,000) Dollars,
for the payment of which well and
truly to be made we do bind our-
selves, our heirs and successors,
firmly by these presents.
The condition of the above obli-
gation is such that whereas the
above named The Key City Gsa
Company, has entered into an agree-
ment with the City of Dubuque, by
the terms of which the price of gas
to be charged its consumdrs for the
period of eighteen months, begin-
ning July 1, 1918, and ending De-
cember 31, 1919, is to be adjusted
and determined at the end of said
period from an examination of the
books and accounts of said Gas
Company by three auditors or um-
pires, citizens of Dubuque, to be
chosen, one by the City Council, one
by the said Gas Company, and the
third by the two thus chosen. And
the said Gas Company has agreed
that in the event the result of oper-
ations for said period show net earn-
ings of more than six (6) per cent -
per annum on its present permanent
capital liabilities, which are Sever
Hundred Ten. Thousand, Five Hun-
dred (3710,500) dollars, such excess
ever said 6 per .cent-shall be rebated
by the Key City Gas Company to
its consumers of gas during said
period, in .proportion to their re-
spective bills for gas for said 'Period.
Now if the Key City Gas Company
shall carry out its said agreement,
and shall, with reasonable prompt-
ness pay such rebates, if any, as
shall be found to be due its custom-
ers, then the above obligation is to
be void and of no effect; otherwise
it is to be, and remain in full force
and virtue in law.

THE USE OF GAS WITHIN THE
CITY OF DUBUQUE."
Be it ordained by the City Council
of the City of Dubuque: -
Section 1. That an ordinance en=
titled "AN ORDINANCE FIXING
THE PRICE TO BE CHARGED TO
PRIVATE CONSUMERS BY THE
KEY CITY GAS COMPANY FOR
THE USE OF GAS WITHIN THE
CITY OF DUBUQUE," passed by
this Council December 5, 1918, be
and the same is hereby repealed.
Section 2. This ordinance shall
be in force and effect from and after
its passage by the City Council and
publication in the Times - Journal and
Telegraph- Herald, newspapers, as
provided by law.

That to provide for the cost of cone
structing a sanitary sewer in Semi-
nary Street from West Locust Street
to a point 450 feet north, the Mayor
be and he is hereby required
to execute and deliver to the
City Recorder- to be by him
registered and countersigned, four
bonds for Two I Hundred ,,and
Fifty dollars each and one for Thir-
ty -one and 61 -100 Dollars, numbered
5641 to 5645, inclusive, dated Janu-
ary 18th, 1919, payable on or before
seven years after the date thereof,

THE CITY OF DUBUQUE,
IOWA.
Whereas, a petition has been filed
by the Liberty Tractor Company for
the vacation of parts of certain
streets and alleys in the City of Du-
buque, and
Whereas, the said Liberty Tractor
Company owns all - the property
abutting the parts of said streets and
alleys in question and said streets
and alleys are of no use to anyone
excepting said company, and
Whereas, by direction of the City
Council of the City of Dubuque the
City Engineer has made a plat of,
and showing said streets and alleys
purposed to be vacated and filed the
same in his office subject to public
inspection and due notice has been
given to all abutting property own-
ers and ten days' notice of said pur-
posed vacation has been published
in the official papers of the City of
Dubuque and the purposed action
has been submitted to the City
Council at two regular sessions, and
Whereas, it appears that there is
no objection on the part of anyone
interested -in the property benefitted
by said streets to the granting of
said petition, and
Whereas, it appears that the va-
cation of said street and alley will
be of great commercial advantage
to the City of Dubuque, and there
appears no valid objection to said
vacation and the granting of the use
of the land so vacated to the owners
of the property abutting on said
street and alley.
Therefore, Be it ordained by the
City Council of the-City of Dubuque:
Section 1. - That Elm Street, from
Twenty - seventh Street to Twenty-

eighth Street; and the alley between
Elm Street and Washington Street
from Twenty- seventh to Twenty -
eighth Street, in Glendale Addition
No. 3 in the City of Dubuque, Iowa,
be and the same is hereby vacated
and annulled and the permanent use
thereof granted to the owners of the
property abutting on said street and
alley so vacated.
Section 2. This Ordinance shall
be in force and take effect from and
after its passage by the City Council
and its publication in the Dubuque
Telegraph- Herald and Times -Jour-
nal newspapers.

The agreement of the Key City
Gas Company nrass/Itad and read as
follows:
The Key City Gas Company here -
y accepts the terms and conditions
of the certain resolution adopted by
the City Council of the City of Du-
buque, at its meeting of January 2,
1919, and agrees that the rates for
gas for the eighteen months' period
from July 1, 1918, to December 31,
1919, shall be adjusted and deter-
mined in the manner set forth in
said resolution.
It desires, however, to state• that,
while this instrument is, and is in-
tended to be, an unqualified accept-
ance of and agreement to the terms
and conditions of said resolution,
this company does not wish to be
understood as agreeing that the rate
of return to it of net earnings of
6 per cent on the amount of its
present permanent capital liabilitis,
as fixed in said agreement for the
period in question, is adequate; or
to the adequacy of such return of
net earnings either as to rate or aS
to value of property on which it is
to be computed for any purpose
other than the purpose of compro-
mising and settling the present con-
troversy.

sum of two hundred ($200.00) dol-
lars.
We recommend that this settle-
ment be accepted and that a war-

Ald. Andresen moved to suspend
the rules for the purpose of allowing
anyone present to address the Coun-
cil. Carried by the following vote:

Mr. Chas. A. Wright, representing
the Federation of Labor, addressed
the council relative to establishing
a Municipal Electric plant in the
city, and stated that he would have
an expert from Chicago to submit
figures on same if the council would
suspend action until that time.
Ald. Plamondon entered and took
his seat at 8:20 p. m.
Ald. Andresen moved that the
Federation of Labor be notified
when the matter of letting the
lighting contract is to be discussed,
that they may have a representative
there and to extend the time of said
discussion until the Federation of
Labor could be present with said ex-
pert from Chicago. Carried.
Petition of Mrs. Paulin Wagner,
asking the City Council to cancel
the taxes against her property for
the year 1918, as she was unable to
pay the same, presented and read.
On motion of Ald. Frith, the petition
was referred to the Committee of
the Whole.
Petition of Mrs. Ida Worst asking
the City Council to cancel the taxes
against her property, Lot 40, Staf-
ford Add., for the year 1918, stating
she is unable to pay same. Pre-
sented and read. On motion of Ald.
Leist, the petition was referred to
the Committee of the Whole, and in-
terested notified to be pres-
ent.
Petition of A. E. Gmehle, asking
the City Council to appoint him col-
lector of delinquent personal taxes
for 1917 and prior at 10 per cent
commission, presented and read. On
motion of Ald. Leist, the prayer of
the petition was granted.
Petition of McFadden Building Co.,
Regular Session, February 6th, 1919. 17
asking the City Council to instruct
the City Treasurer to cancel the
taxes against Lot 1 of the Sub of
529 and 530, located at the corner of
First and Iowa streets, stating that
according to an ordinance adopted
June 18, 1909, assessment on said
lots was to he cancelled for a period
of ten years. Presented and read.
On motion of Ald. Frith, the petition
was referred to the Committee of
the Whole.
Petition of Mrs. Louis S. Kessler,
asking the City Council to remit
taxes on the southerly 28 ft. of Lot
242 and northerly 5 feet of Lot 24'1,
in Glendale Add., stating that she
is a widow and unable to pay the
same. Presented and read. On rrro-
tion of Ald. Frith, the prayer of the
petition was granted as an act of
charity.
Petition of the property owners
and residents of Edina street, asking
the City Council to improve said
street from Alta Vista street to the
end of said street. Presented and
read. On petition of Ald. Andresen,
the petition was referred to the
Fourth ward alderman and the City
Engineer be instructed.
Petition of Conrad F. Helbing,
asking the City Council to cancel the
taxes for 1918 against the easterly
22 ft. of Lots 14 and 14A, and the
westerly 26 ft. of Lots 13 and 13A,
in Pauline Langworthy Add., as he
is in the United States army. Pre-
sented and read. On motion of Ald.
Frith, the prayer of the petition
was granted, as Mr. Heldbing has a
contract of purchase for this prop-
erty.
Petition of Mrs. Mary Neenan,
asking the City Council to grant
soldier's exemption on the property
of her son, Herbert J. Neenan, be-
ing Lot 8 Grandview Ave. Add., as
he is in the service of the U. S. army.
Presented and read. On motion of
Ald. Plamondon, the prayer of the
petition was granted.
Petition of W. H. Rauch, asking
the City Council to correct error in
assessment for 100 ft of sewer
againts Lot 12, Stewart's Sub., stat-
ing there is only about 50 ft abut-
ting said lot. Presented and read.
On motion of Ald. Leist, the petition
was referred to the City Engineer.
Petition of George Watters, asking
the City Council to accept $25.00 in
full payment of assessment for the
undivided half of Middle 1 -5 of Out
Lot No. 457 in the City of Dubuque,
was levied on December 23, 1897.

PRICE TO BE CHARGED TO
PRIVATE CONSUMERS BY THE
KEY CITY GAS COMPANX FOR
THE USE OF GAS WITHIN THE
CITY OF DUBUQUE."
Be it ordained by the City Council
of the City of Dubuque:
Section 1. That an ordinance en-
titled "AN ORDINANCE FIXING
THE PRICE TO BE, CHARGED TO
PRIVATE CONSUMERS BY THE
KEY CITY GAS COMPANY FOR
THE. USE OF GAS WITHIN THE
CITY OF DUBUQUE," passed by
this Council December 5, 1918, be
and the same is hereby repealed.
Section 2. This ordinance shall
be in force and effect from and after
its passage by the City Council and
publication in the Times - Journal and
Telegraph-Herald,_ newspapers, as
provided by law.
