steam heating plant and plumbing
in the Fire Department Building,
No. 1, and the proposed Comfort
Station, located at Eighteenth street
and Couler avenue, in accordance
with plans and specifications pre-
pared by the City Enginer and now
on file in the office of the City Re-
corder.
Bidders must state price in total
of plant installed complete in Fire

Honorable Mayor and City Council
of Dubuque, Iowa:
Gentlemen: We acknowledge re-
ceipt of official notice of the resolu-
tion passed by your honorable body
on Friday last, requesting that our
street lighting proposal be so modi-
fied as to include rates for a one,
two, three and five year periods.
To be asked to submit a lighting
contract proposal for such short
terms as one, two and three years is
most unusual, if not unprecedented,
as logically the annual charge per
lamp should cover depreciation
charges in a one, two and three year
period, respectively, which in a ten
year period contract would be spread
over the entire ten years. The an-
nual charge for a short period
should, therefore, be greatly in-
creased.
With conviction, however, that
even with a short term contract your
honorable body will continue to con-
tract with us to perform the street
lighting in question, inasmuch as
any intelligent investigation would
show beyond of a doubt,
that it would be to the financial ad-
vantage of the city to so continue,
we hereby submit the same figures
on a short term contract as already
submitted on a ten year contract, in-
cluding and protecting coal clause.
You will note, however, a modifi-
cation of the original proposition in
regard to the installation of addi-
tional units and the modification of
existing units.
We assume that your desire for a
short term contract is to permit con -
zlideration of municipal operation.
With such a possibility In view you
could not reasonably expect, nor
could we economically consent to in-
crease our investment in poles,,
wires, lamp units, etc., which would
not be assured of permanence
through contract.

THIS AGREEMENT made and
entered into this day of
, 1919, by and between the
Dubuque Electric Company, herein-
after called the, first party, and the
City of Dubuque, hereinafter called
the second Party.
WITNESSETH, that whereas the
first party is engaged in the manu-
facture, distribution and sale of
electric current, and the second
party desires to operate certain
lamps necessary for illumination of
its streets and alleys, therefore it is
mutually agreed and contracted that

such lamps as are deemed necessary
by second party shall be installed,
maintained and operated by first
party upon the so- called, all night-.
every night schedule, of approxi-
mately four thousand (4,000) hours
per year, to be lighted fifteen (15)
minutes after sunset and extinguish-
ed thirty (30) minutes before sun-
rise of each calendar Idlay, except
that the magnetite or boulevard
lamps shall be lighted fifteen (15)
miutes after sunset and extinguished
at twelve o'clock midnight of each
day.
For the equipment, operation and
maintenance of said lamps the sec-
ond party shall pay the first party
On or before the tenth (10th) of
each month, one - twelfth (1 -12th)
of the total annual bill based upon
the following schedule of rates:
For each type "C" gas filled Mazda
lamp of 600 C. P. rating, the sum of
Sixty -five ($65.00) Dollars per year.
For each type "C" gas filled Mazda
lamp of 400 C. P. rating, the sum.
of Fifty -seven Dollars and Fifty
Cents ($57.50) per year.
For each type "C" gas filled Mazda
lamp of 250 C. P. rating, the sum
of Forty -five ($45.00) Dollars per
year.
For each type "C" gas filled Mazda
lamp of 100 C. P. rating, the sum
of Twenty -seven Dollars and Fifty
Cents ($27.60) per year.
For each type "C" gas filled Mazda
lamp of 60 C. P. rating, the sum
of Fifty -five ($56.00) per year.
It is understood and agreed that
the above schedule of rates is based
on a present price of Four ($4.00)
Dollars per ton for coal the equal
of Harrisburg (Southern Illinois)
one and one - quarter inch (1 /, ")
screenings, averaging 12,500 B. T. U..
per ,pound.
It is further understood and
agreed that for every twenty -five
(25) cent increase or reduction in
the above coal price, F. O. B. at the
first party's Central Station, there
shall be an increase or reduction in
the annual charge per lamp as fol-
lows:
On each 600 C. P. lamp, $2.00 per
year.
On each 400 C. P. lamp, $1.50 per
year.
On each 260 C. P. lamp, $1.00 per
year.
On each 1000 G. P. Boulevard
lamp, $2.00 per year.
The adjustment of rates made
necessary by the changing price of
coal shall be made at the close of
each year's life of this contract,
and shall be effective for the suc-
ceeding twelve months.

Plumbers' Association asking the
City Council to adopt rules and reg-
ulations governing the proper in-
stallation of sewerage and general
plumbing work, for the safeguarding
of the public health, submitting an
ordinance entitled "An Ordinance to.
Provide for the appointment of an
Inspector of Plumbing." Present-

of any existing lamps, and will in-
stall and equip an additional
lamp within a distance of one av-
erage city block from any existing
street lamp, at its own expense,
upon written order of second party,
should said second party elect to
enter into a contract for a term of
ten years or longer; and will install
and equip any additional lamps, or
modily the type of any existing
lamps at the expense of the second
party, upon the written order of
second party, should said second
party elect to enter into a contract
for the shorter term of five or less
years.
The first party agrees to hold sec
ond party harmless from all dam-
ages which may occur by reason of
the construction, maintenance or
operaion of its .poles, wires or elec-
trical appliances in connection with
such lights.
Should the second party desire to
change the location of any lamp
provided in this contract, the first
party shall make the change at the
expense of second party.
At the expiration of this con-
tract, the .first party shall remove
all poles and wires employed in
• furnishing the above lights, except-
ing such poles and wires as may be
necessary for providing electric cur-
rent for commercial and domestic
purposes, and shall repair all
streets, alleys and sidewalks dam-
aged by the removal of such poles.
It is further agreed between the
parties hereto that the second party
shall have the option to purchase
the properties of the first party at
any time within the period of this
contract, upon payment to said first
party the value thereof. If the
second party shall elect to exercise
the said right of purchase, and the
parties thereto shall disagree as to
the value thereof, the value of said
property shall be affixed by ap-
praisement, thereof by five (6) dis-
interested appraisers, two (2) of
whom shall be selected by the first
party, two (2) by the second party,
and the fifth by the four thus
chosen, or the majority thereof.
The second party shall give three
months' notice in writing of its in-
tention to purchase said property
and therein name the time at
which the appraisement is to be
made.
This contract and agreement to
become effective on its acceptance,
and to continue for a period of
years from such time.

Gentlemen: Your City Assessor,
to whom was referred the petition
of the First Baptist church, rela-
tive to the taxes assessed against
Lots 1 and 3 of Lot 756, A. Mc-
Daniel's Sub., would respectfully
state that I find that this or these
lots above stated were deeded to
the First Baptist church in April
and August, 1915, according to the
records in the County Recorder's
office. There being at present no
building on the above mentioned
lots, the foundation is all that is
completed.

Spanish - American War Veteran.
I beg to report that it is by opin-
ion that the petition of Dr. C. Kear-
ney should be granted under the
law governing such cases.
With reference to the petition of
Fred C. Burdt, the only fact there is
whether or not Mr. Burdt is a Span-
ish- American war veteran, ' and if
he is the owner of the property
stated in his petition. If both of
these facts are true, then he is' enti-
tled to the exemption to the amount

The meeting was called for the
purpose of discussing the method
of ordering supplies and the pay-
ment of same for the Dteention
Hospital, and any other matterd ,
that may come before the Board.
The City Committee Clerk was
instructed to order all supplies for
the Detention Hospital and all par-
ties quarantined for infectious dis-
eases that are to be supplied with
provisions by the Board of Health.
It was also recommended that the
Mayor check over all such orders.
Assistant Attorney Cooney and
County Attorney Willging were in-
structed to draw up a bill to be
presented to the legislature to allow
thhe county to make an appropria-
tion to build a detention hospital,
said question to be voted on by the
voters of Dubuque couny at the
next general election.
Another joint meeting was called
to be held at 2:00 p. m. Monday,
March 3rd, 1919. State Represen-
tatives Miller and O'Donnell and
Senator Horchem to be invited to be
present.

at the meeting of Feb. 26th) was
presented to the Legislature, that
there was no doubt that it would
pass, and also proposed hat if the
City and County Attorneys and
probaby the Mayor, or some other
members of the Board of Heath
were present at the session, it
would add great weight in having
the bill passed.

should be revised, consolidated and
arranged in a manner so as to pre-
sent all of the ordinances which at
present affect the operation of the
various departments of the city,
regulate the operation of the city's
business and the conduct of its
citizens; and
Whereas, it is deemed advisable
that the ordinances now in exist-
ence should he bound in book form
and entitled "REVISED ORDI-
NANCES OF THE CITY OF DU-
BUQUE," 1919; now therefore
Be it Resolved by the City. Coun-
cil of the City of Dubuque, That all
of the ordinances of the city of Du-
buque should be revised and pub-
lished in book form, and that such
publication shall be sufficient pub-
lication and they shall be in force
from and after such publication.

Geo. Icks, and motorman W. Wilson,
ran their car over a line of Hose laid
by Auto Engine Co. No. 1 from
hydrant located at the South West
corner of Jones and South Main
Street, damaging one section of hose
to such an extent as to render It
useless for Fire service.
Also two other sections of hose to
such an extent that it will be neces-
sary to cut 18 ft. off each section, al-
so damaging one pair of couplings.
The hose was purchased in 1917.

Gentlemen —
I would most respectfully call your
attention to the conditions existing in
that part of the City bounded by 24th.
Street on the South, and 32nd. Street
on the North, Jackson Street on the
West, Pine Street on the East, cover-
ing an area of • 32 City blocks fairly
well built up with wooden dwellings.
The only protection for this large
area; is a line of Fire Hydrants on
Jackson Street on the Western Foun-
dry of the tract. Therefore i most
earnestly recommend that , there be
two Hydrants placed on Elm Street,
one at 28th, and one at 30th. Street.
I_ respectfully recommend the placing
of two Fire Hydrants on 3rd Street
extension for safe guarding or pro-
perty East of the .C. B. & Q. Freight
House. I also recommend that a
Dry pipe line be laid up Mertz Street
to Althauser Avenue. I recommend
that a competent Auto Machinist be
employed by the City for the care of
its Motors.

Complying with your request I have
prepared a contract between the Du-
buque Electric Company and the City
of Dubuque for the operation of street
lighting, which contract is hereto at-
tached and submitted for your con-
sideration. A copy of this contract
has been given to the Dubuque Elec-
tric Company.

CONTRACT.
This agreement, made and entered
into this 1st day of April, 1919, by
and between the Dubuque Electric
Company, hereinafter called the first
party, and the City of Dubuque, here-
inafter called the second party.
Witnesseth, that whereas the first
party is engaged in the manufacture,
distribution and sale of electric cur-
rent, and the second party desires to
operate certain lamps necessary for
the illumination of its streets and al-
leys, therefore it is mutually agreed
and contracted that such lamps as
are deemed necessary by second party
shall be installed, maintained and op-
erated by first party upon the so -caIl-
ed all night -every -night schedule, of
approximately four thousand (4,000)
hours per year, to be lighted fifteen
(15) minutes after sunset and extin-
guished thirty (30) minutes before
sunrise of each calendar day, except
that the magnetite or boulevard
lamps shall be lighted fifteen (15) mm-
utes after sunset and extinguished at
twelve o'clock midnight of each day.
For the equipment, operation and
maintenance of said lamps the second
party shall pay the first party on or
before the tenth (10) of each month,
one- twelfth (1 -12th) of the total an-
nual bill, based upon the following
schedule of rates:
For each type "C" gas filled Mazda
lamp of 600 C. P, rating, the sum of
Sixty -five ($65.00) Dollars per year.
For each type "C" gas filled Mazda
lamp of 400 C. P. rating, the sum of
Fifty -seven Dollars and Fifty Cents
($57.50) per year.
For each type "C" gas filled Mazda
lamp of 250 C. P. rating, the suns of
Forty -five ($45.00) Dollars per year.
For each type "C" gas filled Mazda
lamp of 100 C. P. rating, the sum of
Twenty -seven Dollars and Fifty
Cents ($27.50) per year.
For each type "C" gas filled Mazda
lamp of 60 C. P. rating, the sum of
Twenty -two Dollars and Fifty Cents
($22.50) per year.
For each boulevard Magnetite lamp
of 1000 C. P. rating, the sum of Fifty -
five ($55.00) Dollars per year.
It is agreed and understood by and
between the parties hereto that the
first party will modify the type of any
existing, lamp, or change the same,
and will install and equip any individ-
ual lamps within a distance of one
average city block from any existing
street lamp, at its own expense, upon
a written order of the City Council of
the City of Dubuque, it being under-
stood, however, that during the lire
of this contract the first party shall
not be required to install more than
one hundred (100) additional lights,
nor shall the party of the second part
be permitted to request or demand
more than one hundred (100) modifica-
tions in the lamps now in operation
or hereafter to be installed, provided,
however, that the entire one hundred
(100) modifications or extensions here-
after referred to may be made during
the first year of this contract, but, in
that event, there shall be no modifica-
tions or extensions made during the
remaining four years of this contract;
or the second party is given the right
to request the modifications and exten-
sions herein provided for to be spread
over the entire period of this contract
with this limitation, however, that the
second party shall not be required to
make more than thirty -six (36) exten-
sions or modifications in the first year,
or more than sixteen (16) extensions
or modifications in each of the follow -
ing four years.
That no lamps shall be modified or
extensions made except upon the writ-
ten order from the City Council.
The first party agrees to hold sec-
ond party harmless from all damages
which may occur by reason of the con-
struction, maintenance or operation of
its poles, wires or electrical appli-
ances in connection with such lights.
At the expiration of this contract,
the first party shall remove all poles
and wires employed in furnishing the
above lights, excepting such poles and
wires as may be necessary for provid-
ing electric current for commercial
and domestic purposes, and shall re-
pair all streets, alleys and sidewalks
damaged by the removal of such poles
and appliances.
It is agreed and understood by and
between the parties hereto that dur-
ing the term of this contract there
shall be no change required or de-
manded by either party and both par-
ties waive, in consideration of the mu-
tual benefits arising hereunder, any
right to request or demand that this
contract be changed in any manner re-
lating to the contract price herein
stipulated, nor to request or demand
that any of the terms hereof be sub-
mitted for revision by any board, com-
mittee or commission, but nothing
contained in this contract shall pre-
vent the parties hereto, by mutual
agreement, to adjust any question
which may arise during the term of
the Contract.
This contract and agreement to be-
come effective on its acceptance and
to continue for a period of five years
from such time.

Whereas, The present Detention
Hospital located on an island in the
Mississippi River is in a deplorable
condition, being unsafe and unsani-
tary and as the law as it now stands
does not provide means for raising
funds for the erection of a Detention
or Contagious Disease Hospital and it
is of urgent and imperative necessity
that the people of Dubuque County
have a Hospital to care for the un-
fortunates whom we are obliged to
isolate;
Therefore Be It Resolved, by the
City Council of the City of Dubuque,
Iowa that we urge upon the Iowa
Senate and House of Representatives
the necessity of passing this bill as
one of urgent necessity.

the City Council on said date, for
building a Public Comfort Station in
Phoenix Park in accordance with
plans and specifications prepared by
the City Engineer and now on file
in the office of the City Recorder.
Bidders to state price in total
of the building complete, to be made
of Hollow Tile, according to plans
and specifications.
Each hid must be accompanied by
a certified check for ten per cent of
the gross amount of the bid on some
Dubuque bank as a guarantee that
a contract will be entered into if
awarded. Check and bid in separ-
ate envelopes.
The City Council reserves the
right to reject any and all bids.

sary equipment (viz., one horse, and
one -horse dump wagon with a ca-
pacity of 1 1 -4 cubic yards) to do
the work. The actual time neces-
sary to do this work will be three
ten hour working days of each
week. Work to be done by the
hour, by order and under the super-
vision of the Sanitary Officer.

for actual time put in.

GRADE, CURB AND GUTTER
WITH COMBINATION CEMENT

PAVE SAID PORTION OF
SAID STREET WITH TAR -MA-

To Whom It May Concern:
You and each of you are hereby
notified that it is the intention of
the City Council of the City of Du-
buque, Iowa, to improve Edina
street from the west property line
of Alta Vista street to the end of
said street and it is hereby proposed
to grade, curb and gutter with com-
bination cement curb and gutter and
to pave said portion of said street
with Tar- Macadam.
That a plat of said improvement
is now on file in the office of the
City Recorder.
It is estimated by the City Engi-
neer that said improvement will re-
quire:
1145.2 square yards Tar Ma-
cadam.
1289 lineal feet combination curb
and gutter.
Making a total estimated cost to
the legally. assessable property own-
