Steger, Housing & Community Development Director Subject: Second Amendment to CDBG Subrecipient Agreement between the City of Dubuque and Dubuque Community School District Date: March 27, 2023 BACKGROUND The Dubuque Community School District applied for CDBG funds to assist with the redevelopment of the playground at Lincoln School, which serves as a neighborhood park when school is not in session. The Community Development Advisory Commission (CDAC) members reviewed and approved the School District's application on August 18, 2021. The Lincoln Outdoor Wellness Project is three phased and includes Phase 1: raised garden beds and outdoor classroom space, Phase 2: updated outdoor exercise equipment and basketball court resurfacing, Phase 3: accessible playground surfacing, new play structure with ramped access, and softscape perimeter. The City of Dubuque entered into a Community Development Block Grant (CDBG) Subrecipient Agreement Amendment #1 with the Dubuque Community School District on May 16, 2022, to include engineering survey, preliminary design and Phase Intensive Archaeological Survey. Due to recommendations from State Historic Preservation Office (SHPO) it is necessary to amend the Agreement. This memorandum transmits a resolution to amend the Subrecipient Agreement to reflect the Budget and Term and Time of Performance. DISCUSSION The original Subrecipient Agreement Amendment #1 specified the funding amount to be $35,000 to cover engineering survey, preliminary design, and Phase I Intensive Archaeological Survey. Based off our submittals from Phase I Archaeological Survey, the recommendations from SHPO include further Ground Penetrating Radar (GPR) work to fully understand identified anomalies, potentially further archeological work, and maybe even having an archeologist on call during excavation. Because SHPO is requesting more information and further measures to avoid impacting the area, we must amend the budget and term and time of performance. Therefore, we are requesting to increase the budget by $15,000 totaling $50,000. Lastly, we are requesting to extend the Term and Time of Performance to December 31, 2023. The CDBG Annual Action Plan has adequate funds allocated to the Lincoln Outdoor Wellness Project to cover these expenses. RECOMMENDED ACTION I recommend the City Council approve the second amendment to the Subrecipient Agreement with the Dubuque Community School District and authorize the Mayor to execute the amendment on behalf of the City. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. That the Second Amendment to the CDBG Subrecipient Agreement be approved. Section 2. WHEREAS, City and Subrecipient entered into a Subreciplent Agreement Amendment #1 dated May 16, 2022 (the Subrecipient Agreement); and WHEREAS, City and Subreciplent desire to amend the Subrecipient Agreement as set forth herein. NOW THEREFORE, INCONSIDERATION OF THE MUTUAL TERMS AND COVENANTS CONTAINED HEREIN, CITY AND SUBRECIPIENT AGREE AS FOLLOWS: Section 1. Section A.3 and A.4 of the Subrecipient Agreement is hereby amended to read as follows: A.3 Project Budget The City agrees, subject to the terms and conditions of this Agreement, to compensate the Subrecipient for the Statement of Work outlined in Exhibit A, not to exceed $50,000.00. A.4 Term and Time of Performance Services of the Subrecipient shall start on March 14, 2022 and end on December 31, 2023. Section 2. Exhibit A of the Subrecipient Agreement is hereby amended to read as follows: Exhibit A —Statement of Work This contract covers soft costs related to planning and administration for the Lincoln Wellness Project. Activities under this agreement may include; Under the consultation of the City of Dubuque's Planning Department, procurement of an Archaeological Firm to perform a Phase I Intensive archaeological survey as requested by the State Historic Preservation Office for the purposes of Section 106 Review. All archaeological work should be completed by a Secretary of interior qualified archaeological consultant and follow the Association of Iowa Archaeologists Guidelines for Archaeological Investigation (2021), • Expenses for Architectural and Engineering consultation for plan development. The National Objective that is met by these activities is Low -Mod Area Benefit. This project benefits all residents in the neighborhoods surrounding Lincoln School, 555 Nevada St., Dubuque, IA 52001, in which at least 51% of the residents are LMI persons. Section 3.
