Petition of Elizabeth Keller, claim-
ing that her property was damaged by
the blasting done in Mr. Welsh's stone
quarry adjoining her property. On
motion of Ald. Frith, to suspend the
rules to give Elizabeth Keller an op-
portunity to address the Council. Car-
ried by the following vote:

On motion of Ald. Strobel, her pe-
tition was referred to the committee
of the whole.
Petition of Walter Eichman, asking
for a permit to install a gasoline sta-
tion at 2197 Rhomberg avenue, pre-
sented and read. Ald. Frith moved to
grant the petition, provided the ap-
plicant sign the proper waiver. Car-
ried.
The report of N. J. Staner was pre-
sented and read. Mr. Staner states
that he will not he able to complete
his contract on Heeb street in the
specified time as the company fur-
nishing the brick cannot guarantee
the delivery of enough to complete
the work. On motion of Ald. Frith,
the report was referred to the com-
mittee of the whole.
Petition of C. J. W. Saunders, C. H.
Keller and other tenants, between
Tenth and Eleventh streets on Main
street, stating that they had paid for
the maintenance of the boulevard
lights as per contract until May 1st,
1918, now ask the City of Dubuque to
relieve them from any further re-
sponsibility for their maintenance.

Petition of Anna A. Hermansader,
relative to injury sustained by her on
February 15, 1918, resulting from a
defective sidewalk on and in front of
Lot 6 of City Lot 684, in the City of
Dubuque, presented and read. On
motion of Ald. Andresen, the petition
was referred to the city attorney.
Petition of Miss K. C. Bissell, ask-
ing the City Council to grant her a
reduction on her taxes on City Lot
466, South 86.4 feet, located on the
east side of Main street, corner of
Eleventh street, presented and read.
On motion of Ald. Strobel, the peti-
tion was referred to the committee of
the whole to view the grounds.
Petition of Sisters of St. Francis,
asking the City Council to refund to
them amount paid for 1917 taxes on
Lot 14 and part Lot 13, in Corriell's
Dubuque, City of Dubuque, Iowa,
stating same was exempted by the
City Council and paid through an er—
ror, presented and read. On motion
of Ald. Strobel, the petition was re-
ferred to the city treasurer and city
assessor.
Petition of M. H. Martin and oth-
1 -s, asking the City Council, to have
est Fourteenth street, between Dell
a. d Bluff streets oiled, stating that
sprinkling is of no service for it dries
up too fast, the grade is not percepti-
ble and would work no hardship on
horses, presented and read. On mo-
tion of Ald. Hird, the prayer of the
petitioners was granted.
Petition of Mary C. Schmitt, ask-
ing for reduction of assessment for
the year 1918 on the north 1 -2 of the
north 1 -5 of Outlot 479, in the City
of Dubuque, Iowa, to $2,250.00, the
same property now assessed at $3,-
650.00, presented and read. On mo-
tion of Ald. Plamondon, the petition
was referred to the committee of the
whole to view the grounds.
Petition of Dr. A. M. Pond, by John
G. Chalmers, his attorney, asking the
City Council to cancel his taxes for the
year 1917, on Lot 160 and the north
13 feet, 7 inches of Lot 159, city lots
in the City of Dubuque, Iowa, known
as the old H. B. Glover residence.
Dr. A. M. Pond states he received his
captain's commission in the military
service of the United States on Sept-
ember 25, 1917, and entered into the
active service on December 15, 1917,
and is still in the service, presented
and read. On motion of Ald. Andre-
sen, the prayer of the petition was
granted.
Petition of Ed. E. Milligan, asking
for reduction of assessment on Lot 9,
in Yates Sub., presented and read.

Petition of the Independent Order
of Odd Fellows, by D. W. Rand, clerk
for the board of trustees, asking the
City Council to reduce the taxes on
Lot 633, known as the Odd Fellows
building, presented and read. on mo-
tion of Ald. Frith, the petition was
referred to the committee of the
whole.
Petition of August Rupp, asking the
City Council to allow him the sum of
$35.00 (the amount of his doctor bill)
in full satisfaction for any claim he
may hajve against the City of Du-
buque. Mr. Rupp states that he fell
on the icy sidewalk in front of the
court house on or about Jan. 5, 1918,
and broke his wrist, presented and
read. On motion of Ald. Leist, the
petition was referred to the commit-
tee of the whole.
Petition of C. A. Roshon, asking
the City Council to reduce his taxes on
Lots 262 265 and 266, in East Du-
buque Add., presented and read. On
motion of Ald. Leist, the petition was
referred to the committee of the
whole to view the grounds.
Petition of Chris. Gantenbein, ask-
ing the City Council to grant him the
amount provided by the law under
the workmen's compensation act for
injury sustained by him in falling on
the sidewalk in front of 1012 Lincoln
avenue, while attending to his duties
as ward foreman, presented and read.
On motion of Ald. Leist, the petition
was referred to the city attorney.
Petition of Henry A. George, ask-
ing the City Council to allow him the
sum of $100.00 damages because of
the inconvenience and destruction
caused by the overflowing of sanitary
sewer at 465 Delhi street on March
31, 1918, presented and read. On
motion of Ald. Plamondon, the peti-
tion was referred to the city attorney
and sewer inspector.
Petition of City Recorder Stuber,
asking the City Council to approve of
his appointing Charles E. Bradbury,
as deputy city recorder, presented and
read. On motion of Ald. Strobel, the
appointment of City Recorder Stuber
was approved.

To the Honorable Mayor and Council
of the City of Dubuque:
Gentlemen: The petition of the
McFadden Coffee and Spice Co., ask-
ing for the cancellation of the tag
upon Lot 1 of the Subdivision of Lots
529 and 530, located at the corner of
First and Iowa streets, has been re-
ferred to me investigation and report.
I find that in 1909 the city agreed, by
an ordinance which was enacted on
June 18, 1909, to remit and cancel all
taxes against this lot for a period of
ten years. This was done in consid-
eration of the deeding to the city by
said company of a part of these lots
for street purposes.
In view of these circumstances I
recommend that the prayer of this
petition be granted and the treasurer
instructed accordingly.

of the City of Dubuque:
Gentlemen: The claim, of William
H. Bishop for damages which were
sustained by his wife, Gertrude Bish-
op, on January 12, 1918, when it is
claimed that she fell on an icy side-
walk, was referred to me by your
honorable body. I beg to report that
I find from an investigation of this
claim that the same does not comply
with the statute in such cases made
and provided and for that reason the
claim cannot be consideerd by this
office. I might suggest, however, that
if the claim is worthy of any consid-
eration upon the part of the council
that the same might be referred
to the committee of the whole and
there consisdered.

Gentlemen: Attached plat shows
the location of street car tracks and
the curb at the southwest corner of
Julien and Alpine, also the distance
this curb can be set back to widen
street at this corner without buying
a corner of the building located on
this lot. It would be advisable to
have this proposed new curb line
marked on sidewalk and viewed by
the committee of the whole before
any work is ordered done.

amined the sidewalks abutting lots
15, 16, 17, 18, 19 and 20, Kringle's
Sub., J. Lee, contractor, and would
respectfully recommend that they be
accepted.
We would further recommend that
the city engineer be and he is hereby
instructed to prepare a special assess-
ment against the lots or parcels of
real estate subject to assessment for
the construction of said sidewalks and
file the same in the office of the city
recorder who will thereupon publish
the notice of said assessment as re-
quired by ordinance.

mittee on claims and the city attor-
ney having had before us the claim
for damages of Mrs. Lily M. Calvert,
in the sum of One Thousand Dollars
and after careful investigation of the
facts and circumstances surrounding
the case, including the expense inci-
dent to the injury which was a frac-
ture of the left arm in two places,
recommend to your Honorable Body a
settlement of said claim in the sum
If One Hundred and Eighty Dollars,
and we request your approval of our
action and order a warrant drawn in
her favor for said amount.

Mrs. Anton Peters, asking that her

Atlantic avenue be reduced because

Be it Resolved by the City Council
of the City of Dubuque, That it is
deemed necessary and advisable to
change the course of Jansen avenue,
taking in a strip of land in Lot 5,
Jansen's Subdivision, and be it further
resolved that the city engineer be and
he is hereby instructed to make a plat
and survey of such purposed improve-
ments, showing the most feasible
route for such purposed change the
land or lots through or over which the
same is purposed to be made, the
amount of land purposed to be taken
and file such plat in his office for
public inspection.
That after such plat is prepared
and filed said city engineer shall give
the owners of the property through or
over which such improvement is pur-
posed to be made, notice as prescrib-
ed by Section 2 of Chapter 31 of the
revised ordinance of the City of Du-.
buque.

ner of Lot 22, all of short street and
the alley running from the south lino
of Short street to the north line of
Lots 20 and 21, and the alley between
Lots 13 and 22, as shown on the plat
in said Bellevue Addition.
Whereas, said petitioner represents
that he is the owner of all property
abutting on said streets and alleys,
and that his object in asking said va-
cation is that he desires to replat said
addition and lay out streets and alleys
more in conformity with the topogra-

whereas, said petition was referred to
the committee of the whole, which

on the east side of Couler avenue,
owned by Mrs. Amy Shortel, said side-
walks to be built of cement (artificial
stone) and to be completed not later
than the fifteenth day of May, 1918.

full payment of special assessment of

claiming said assessment is now out-
lawed but remains a cloud on the
title, presented and read. On motion
of Ald. Strobel, the petition was re-
ferred to the city attorney.
Petition of Mary Harper, asking the
City Council to construct a sanitary
sewer on Pickett street, from Cornell
street to Henion street, presented and
read. On motion of Ald. Hird, the
petition was referred to the commit-
tee of the whole to view the grounds.
Petition of Dubuque Commercial
club, asking the City Council to re-
duce their taxes for the years 1914,
1915, 1916 and 1917, presented and
read. On motion of Alcl. Andresen,
the petition was referred to the com-
mittee of the whole.
Petition of State street property
owners, claiming that State street,
commencing at Grandview avenue,
has not been made and placed ac-
cording to the original survey, and
that the curb and gutter is from 40 to
42 ft. in on some of the lots, and they
ask the City Council to have same
changed, presented and read. On
motion of Ald. Leist, the petition was
referred to the committee of the
whole to view the grounds and the
city engineer to be present.
Petition of Chas. E. Karn, asking
the City Council to grant him per-
mission to install a Bowser gasoline
station in front of his place of busi-
ness at 445 Iowa street, presented and
read. On motion of ,Ald. Strobel, the
prayer of the petition was granted and
the city attorney instructed to draw
a waiver and agreement covering the
same.
Petition of C. H. Berg, et al, com-
mittee of the several patriotic socie-
ties of the city, asking the City Coun-
cil to donate the sum of $200 to de-
fray the expenses of observing Mem-
orial Day, presented and read. On
motion of Ald. Strobel, the prayer of
the petition was granted and a war-
rant in the sum of $200 was ordered
drawn on the city treasurer.
Petition of Dubuque Lodge No. 355,
Loyal Order of Moose, asking the City
Council to grant them a permit to
hold an open -air carnival during the
week beginning May 27th, 1918, on
the property known as Olinger Park.
Ald. Leist moved to suspend the rules -
for the purpose of allowing the repre-
sentative of the Moose club to address

Stipulation and Agreement.
Know All Men By These Presents,
Whereas Walter Eichnian, of the City
of Dubuque, has petitioned the City
Council of said City for permission to
install a gasoline filling station, with
tank underground beneath sidewalk,
having pump on curb, the same to be
in front of the building known as
2197 Rhomberg avenue.
Now, therefore, inconsideration of
the permission granted by the City
Council to place said gasoline tank
under the sidewalk at No. 2197 Rhom
berg avenue, and also the curb pump
as above specified. Walter Eichman
agrees, and by these presents does
agree, to maintain said gasoline tank
and curb pump in a safe and careful
manner, and
It is further stipulated and agreed
that Walter Eichman shall alone be
liable and responsible, as well as his
successors and assigns, for any and
all damage that may arise from any
injury which may be sustained by any
person by reason of the existence and
maintenance of said gasoline tank and
curb puinp, and there shall be no lia-
bility on the part of the City of Du-
buque whatsoever.

Whereas the Star Taxi Company of
the City of Dubuque, has petitioned
the City Council of said city for per-
mission to install a gasoline filling sta-

Now, therefore, in consideration of

Star Taxi Company agrees, and by
these presents does agree, to maintain
said gasoline tank and curb pump in
a safe and careful mariner, and
It is further stipulated and agreed
that the Star Taxi Company shall
alone be liable and responsible, as
well as his successors and assigns, for
any and all damage that may arise
from any injury which may be sus-
tained by any person by reason of the
existence and maintenance of said
gasoline tank and curb pump, and
there shall be no liability on the part
of the City of, Dubuque whatsoever.

1st, the rate will be as follows, which
is the same as was in effect prior to
the "lightless nights ":

Mayor Saul stated this meeting was
called for the purpose of adopting the
report of the committee of the whole
requesting the citizens of Dubuque to
destroy the barberry bush and any
other matter that might come before
a regular session of the City Council.
Ald. Andresen moved that Clerk
Lawlor be appointed recorder pro -
tem. Carried.
Your committee' of the whole, hav-
ing taken up the matter of the de-
struction of the barberry bush, would
respectfully recommend that the fol-
lowing resolution be adopted:
A.ld. Frith offered the following:
Whereas, It has been scientifically
established through experiments made
by the agricultural department of the
United States government that a cer-
tain shrub known as the common or
tall barberry (Berberat Vulgaris) is
injurious to the growth of wheat be-
cause it is the breeding place for
black stem rust, which rust causes
the destruction of wheat crops, and
said species of barberry is declared to
be a noxious growth; and
Whereas, This variety of shrub is
very common within the City of Du-
buque; and
Whereas, It is the intention of the
City Council of the City of Dubuque
to aid and assist in the raising of
wheat crops especially at this time
when there is a shortage of wheat in
the world; now therefore
Be it Resolved by the City Council
of the City of Dubuque that it recom-
mend and urge upon the citizens of
Dubuque, as a patriotic duty, to im-
mediately remove all barberry, Japa-
nese barberry excepted, growing upon
their property and thereby show that
they are willing to co- operate with
the government in raising wheat in
abundance so that our armies and
the armies of our allies may be sup-
plied with food.

On motion of Ald. Frith, the con-
tract was awarded to N. J: Staner, he
being the lowest bidder.
Bid for construction of Bee Branch
sewer south from present sewer at
32nd street. Bid of Peter Herkes,
$19.35 per lineal foot. Ald. Frith
moved to return bid and check to
Peter Herkes as check was not certi-
fied. Carried.
Bids for constructing concrete gut-

Petition of Jas. F. Lee, asking the
City Council to take action on his bill'
of $134.00 and interest, $32.16, total
$164.16, for material and labor at
municipal athletic field in April, 1914,
presented and read. On motion of
Ald. McLaughlin, the petition was re-
ferred to the committee of the whole.
Petition of 13. J. Horchem, asking
the City Council's approval of the bill
of Nick Grandgenet of $43.90,- for
plowing at baseball park and Lin-
coln avenue, presented and read. Ald.
Frith moved that a warrant be drawn
and the amount be divided among the
five wards. Carried.
Petition of A. W. Reifstack, asking
the City Council to investigate the
condition of the sidewalk in front of
the property at 884 Rhomberg ave-
nue, stating it is in an unsatisfactory
condition and they have not been
able to adjust the matter with the
Iowa Telephone Co., presented and
read. On motion of Ald. Frith, the
petition was referred to the commit-
tee of the whole to view the grounds.
Petition of E. C. Keating, asking
the City Council to grant him per-
mission to install a gasoline filling
station on the sidewalk in front of his
drug store at 385 West Fifth street,
presented and read. On motion of
Ald. McLaughlin, the prayer of the
petition was granted and the city at-
torney instructed to draft a waiver
and agreement covering the same.
Petition of Catholic Printing Co.,
asking the City Council permission to
excavate the sidewalk on Iowa street
forty -one feet in length for the in-
stallation of a coal storage bin, pre-
sented and read. On motion of Ald.
Strobel, the petition was referred to
the committee of the whole to view
the grounds.
Petition of the Union Trust and
Savings bank, asking the City Council
to instruct the city treasurer to ac-
cept taxes as follows: For the year
1913, $2,183.67 less the taxes on $27,-
000.00 of city water works bonds; for
the year 1914, upon the basis of its
capital stock of $100,000.00; for the
year 1915, $3,088.04; for the year
1916, $3,332.49; for the year 1917,
$3,612.84, presented and read. On
motion of Ald. McLaughlin, the peti-
tion was referred to the committee of
the whole and the city attorney and
city treasu "er notified to be present.
Petition of the Corn Belt Packing
Co., asking the City Council to grant
them permission to operate and main-
tain a packing plant and slaughter
house at what is known as the old
Dubuque Brewing and Malting Co.
