The City of Dubuque Zoning Advisory Commission has reviewed the above -cited
request. The application, staff report and related materials are attached for your review.

Gary Valentine 11429 Edval Lane, owner of the property discussed the proposal saying
they wish to create a lot for his son to build a house to help on the farm, and that Lot 3
is the remainder of the lot cut off by SW Arterial.
Staff detailed the staff report noting the request to reconfigure the existing property to
create a new lot for residential development. Staff shared a diagram showing the
existing and proposed configurations and noted that this subdivision qualifies as a minor
subdivision per the Unified Development Code. Staff outlined the proposed lot
configuration and stated that the applicant is working to get an access easement from
Walser Lane to the proposed Lot 3 through an adjacent lot to the west. Staff noted the
lot that the easement would go through is owned by the applicant and confirmed that
City departments including Engineering and Water have reviewed and approved the
proposed configuration.
The Commission asked for clarification regarding Lot 3 access. Staff clarified that the
City does not like to approve lots without access which is why the access easement is
required. Staff further clarified that the property through which the easement will be
provided is also owned by the same property owner as the subject property.
There were no public comments.
The Zoning Advisory Commission discussed the request and found it appropriate.

INTRODUCTION
The Final Plat of Valentine Place No. 4 is classified as a Minor Subdivision' per the City's
Unified Development Code (UDC). The plat affects two existing lots, one of which is in
the City of Dubuque and the other is located within Dubuque County. The proposed plat
would reconfigure the existing parcels and would create a total of three new lots.
Pursuant to the UDC, a subdivision of property that creates three or more lots is classified
as a Minor Subdivision and requires review by the Zoning Advisory Commission and City
Council. The image below identifies the existina lot confiauration.

The Unified Development Code Chapter 11 defines a Minor Subdivision as `Any subdivision or
consolidation of property in which no new streets, public or private, are proposed and which does not require
the construction of any public improvements, and which creates three or more lots."

DISCUSSION
As proposed, the Final Plat of Valentine Place No. 4 would reconfigure the existing two
lots thereby creating three new lots. The image below provides an overview of the
proposed lot configuration. Lot 1 would approximately 1.9 acres, would have frontage
along Edval Lane, and would be located entirely within Dubuque County. Lot 2 would be
approximately 97.9 acres, would have frontage along Edval Lane and North Cascade
Road, and portions of the site would be located in both Dubuque County and the City of
Dubuque. Lot 3 would be approximately 8.1 acres and would be located in Dubuque
County. Lot 3 would have frontage along the Southwest Arterial, however, the site would
be accessed through an access easement across the property directly to the west to
Walser Lane. The property to the west is under common ownership as Lot 3.
The Zoning Advisory Commission and City Council are the reviewing authorities for a
minor subdivision. The Zoning Advisory Commission shall review the plat to determine
whether it is in substantial conformance with the Unified Development Code.
The portions of the subdivision located within the City of Dubuque are zoned R-3
Moderate Density Multiple -Family Residential and will remain in this zoning. The portions
of the subdivision in the County are zoned County A-1 Agricultural and will remain in this
zoning.

The City's Comprehensive Plan identifies the future land use for the subdivision area as
Multi -Family and Single -Family. The proposed subdivision is not anticipated to be in
conflict with the City's Comprehensive Plan uses and goals.
As requested, the proposed subdivision will have little effect on the status of the subject
lots or surrounding properties. The proposed subdivision plat would comply with all
aspects of the City of Dubuque's subdivision regulations contained in the Unified
Development Code and the land use goals within the City's Comprehensive Plan.
RECOMMENDATION
Planning staff requests that the Zoning Advisory Commission review the Final Plat of
Valentine Place No. 4 and recommends approval as submitted of the Minor Subdivision.

RESOLUTION NO. 109-23
A RESOLUTION APPROVING THE FINAL PLAT OF VALENTINE PLACE NO. 4,
IN THE CITY OF DUBUQUE & IN DUBUQUE COUNTY, IOWA
Whereas, there has been filed with the City Clerk a Final Plat of Valentine Place
No. 4 in the City of Dubuque & in Dubuque County, Iowa that is within the City's 2-mile
extraterritorial jurisdiction and a portion that is located within the City of Dubuque; and
Whereas, said Final Plat has been examined by the Zoning Advisory
Commission and its approval has been endorsed thereon; and
Whereas, said Final Plat has been examined by the City Council and they find
that it conforms to the statues and ordinances relating thereto.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL, OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That the Final Plat of Valentine Place No. 4, in the City of Dubuque &
in Dubuque County, Iowa is hereby approved, and the Mayor and City Clerk are hereby
authorized and directed to endorse the approval of the City of Dubuque, Iowa upon said
Final Plat.
