AN ORDINANCE.
AN ORDINANCE FIXING THE
PRICE TO BE CHARGED TO
PRIVATE CONSUMERS BY
THE KEY CITY GAS COMPANY
FOR THE USE OF GAS WITH-
IN THE CITY OF DUBUQUE.
Whereas, representation and ap-
peal has been made to the City
Council of the City of Dubuque and
the citizens generally of said city
by the Key City Gas Company
wherein it was shown that the in-
creased cost which is now necessar-
ily attached to the supply of gas for
private consumption on account of
abnormal conditions existing
throughout the country has directly
affected the furnishing of gas to the
citizens of Dubuque by said Key
City Gas Company; and
Whereas, it is recognized by
said council and known generally
throughout the city that such con-
ditions have materially affected the
price of all other commodities; and
Whereas, the City Council feels

that some relief should be given the
Key City Gas Company by permit-
ting said company to increase their
rate per thousand cubic feet to pri
rate consumers and thereby assist-
ing said company in securing addi-
tional revenue for the service and
commodity furnished; and
Whereas, said company as
heretofore charged for gas furnish-
ed to private consumers the rate of
one dollar ($1.00) per thousand
cubic feet net, that is if paid for on
or before the 10th of the month,
and one dollar and twenty -five cents
($1.25) per thousand feet gross,
that is if paid for after the 10th of
the month, and
Whereas, the City Council has
given reasonable notice to said com-
pany of its intention to fix the price
of gas to private consumers as pro-
vided for by the ordinance granting
the franchise to said company; and
Whereas, it is deemed advis-
able that said company shall be per-
mitted to charge for gas furnished
to private consumers the rate of one
dollar and ten cents ($1.10) per
thousand cubic feet net, that is if
paid for on or before the 10th of
the month, and one dollar and thir-
ty cents ($1.30) per thousand cubic
feet gross, that is if paid for after
the 10th of the month, said raise in
rate, however, to continue only
while conditions throughout the
country remain abnormal, the coun-
cil reserving for itself the right to
fix again the rate of gas to be fur-
nished to private consumers when-
ever it deems it advisable to do so,
but not oftener than once a year;
and now therefore
Be It Ordained by the City Coun-
cil of the City of Dubuque:
Section 1. That the Key City Gas
Company of the City of Dubuque
shall he permitted and is hereby
authorized to charge the net rate of
one dollar and ten cents ($L10) per
thousand cubic feet, that is if paid
on or before the 10th of the month,
and the gross rate of one dollar and
thirty cents ($1.30) per thousand
cubic feet, that is if paid after the
10th of the month, of gas so fur-
nished and sold to private consum-
ers within the limits of the City of
Dubuque, said charge to be and
constitute the fixed and established
rate for gas for private consump-
tion in the City of Dubuque.
Sec. 2. That said Key City Gas
Company shall furnish for private
consumption at the rate above stat-
ed, gas possessing the heating qual-
ity of not less than five hundred and
sixty British thermo units (560 B.
T. LT.); and said quality shall be
maintained as long as this ordi-
nance shall he in effect or until it
shall be deemed advisable by the
City Council to change the same.
Sec. 3. That the rate for gas
herein above specified shall be the
price which said Key City Gas Com-
pany shall be permitted to charge
for gas to private consumers begin-
ning with the October, 1918, reading
and shall be fixed on the bills which
become payable in November, 1918.
Sec. 4. That the City Council
reserves the right to fix the price
of gas for private consumption at
any time that it may deem it ad-
visable and for the public good, not
oftener, however, than once a year
as provided for by the franchise en-
joyed by said Key City Gas Com-
pany.
Sec. 5. That the explanation and
preamble of this ordinance shall be
and remain a part of the same.
This ordinance shall be in force
and in effect from and after its
passage by the City Council and
publication in the Telegraph -- Herald
and Times- Journal newspapers as
provided for by law,

passed the ordinance relative to the

matter to the courts, which would
result in expenditure of several
thousand dollars by the City of Du-
buqu

strance of the Key City Gas com-
pany, and the ordinance relative to
establishing the gas rate at $1.10
per thousand cubic feet, be referred
to the Committee of the Whole.

That through no fault of the peti-
tioner the returns as stated above,
were lost or mislaid in the Asses-
sor's office, and the assesment in
each case was made from the re-
turns furnished for the previous
year.
That through no fault of your peti-
tioner the assessment books for the
year 1916 were not completed until
about March 1st, 1917, at which
time your petitioner was first able
to discover the error.
That since that date he has paid
all of the taxes, both personal and
real estate, assessed against the per-
sons and estates named above, ex-
cept the personal taxes for 1916.
That he is desirous of paying the
personal tax for 1916. Wherefore,
your petitioner prays that your
honorable body authorize the City
Treasurer to accept from your pe-
titioner full payment of the per-
sonal tax in each of the above nam-
ed cases as stated herein.
Your petitioner further states
that the books of the City Treasurer
shows an assessment of $40.60
against O. P. Shiras for the year
1915.
That your petitioner, as adminis-
trator of the estate of said O. P.
Shiras, found no taxable assets in
said estate.
Wherefore, your petitioner prays
that the assessment of $40.60
against O. P. Shiras for the year
1915 be canceled and that the City
Treasurer be instructed to cancel
the _same on his hooks, presented
and read.

from the report of the Police De-
partment, that the total hours that
51 lamps failed to burn, would equal
2 lamps burned for one month, or
$11.25.

report of the City Electrician was
approved, and the City Auditor in-

from the bill of the Dubuque Elec-
tric Company.

Council of the City of Dubuque.
Gentlemen: The petition of Ed-
ward F. Connolly, referee in parti-
tion, appointed by the District Court
of Dubuque County, Iowa, to sell
the south half of Lot 574 in the City
of Dubuque, at partition sale has
been referred to me for advice. This
petition states that said Edward F.
Connolly sold said property upon an
order of Court and it appears that
there is a special assessment against
said whole lot in the sum of $238.20
for the improvement of South Lo-
cust Street. It appears further that
one P. H. Halpin is the owner of
the other half of said Lot. It ap-
pears further that the Court has de-
creed that James O'Connor is en-
titled to an undivided one -half of
the south half of said Lot 574 and
P. H. Halpin is entitled to an un-
divided one -half of the south half
of Lot 574 and said sale was made
and ordered to be made free and
clear of all liens. Said Edward F.
Connolly tendered the sum of
$145.61, being one -half of the as-
sessment against said Lot 574, and
offered to pay said amount, which
is in full of the assessment against
that part of the lot which is owned
by said James O'Connor. I, there-
fore, recommend that you instruct
the treasurer to accept from. said
Edward F. Connolly, referee, the
suns of $1455.61 and that he credit
said amount to said James O'Con-
nor upon the undivided one -half of
the south half of said Lot 574 and
discharge the lien against said in-
terest in said lot owned by said
O'Connor and that the balance of
said assessment of $145.61 shall be
permitted to remain a lien against
the other undivided one -half of said
south half of said Lot 574, which
is owned by P. H, Halpin, and that
the prayer of the petition as pre-
sented to the council be granted.

Lee, contractor. be notified to repair
the Streets on Rhomberg Avenue
and South Locust Street at once.

buque Electric Company be notified
to repair the Streets between and
one foot each side of the street car
tracks on Clay Street, and the Street
Commissioner be notified to repair
the rest of the Street outside of the

Ald. Plamondon moved that the
recommendation of the City Attor-
ney to present to the Dubuque Elec-
tric Company a bill for the damages
sustained to the aerial truck by be-
ing struck by a street car, be ap-
proved. Carried.
On motion of Ald. Frith the City
Electrician was instructed to have
installed all the street lights pos-
sible, that have been recommended
by the Council.
Ald. Leist moved that Joe Ben -
zer be paid same amount as the
drivers of the other Fire Auto En-
gines. Carried.
Aid. Frith moved that the Fire
Chief be instructed not to fill any
more vacancies or hire any more
new Firemen until after a list of
same have been submitted to and

be suspended for the purpose of al-
lowing interested parties to address
the Board.

Mrs. LaMall, a trained nurse from
New York, addressed the Board on
the disease which is now prevalent
in the eastern part of the United
States, and especially at the army
cantonments, namely, Spanish In-
fluenza, and cautioning the Board
on the dangers of it, and advised the
Board to seek information relative
to it from the medical fraternity of
Dubuque, the object being to pre-
vent it if possible from getting a
foothold in this community,
On motion of Mr. Zillig, the Board
offered Mrs. La Mali a vote of
thanks, and the clerk was instruct-
ed to communicate with and get the
desired information from the med-
ical fraternity, and report at the
next meeting.
On motion of M. M. Hoffman, the
clerk of the Board of Health was
instructed to make arrangements
with the Board of Supervisors for
a meeting with the Board of Health
as soon as possible to discuss plans
for the proposed new Detention
Hospital, City Attorney Czizek,
Messrs. Roshek, Fawkes and Collier
to be notified to be present.
A letter was read from Ma-
jor Witte of the LT. S. Public Health
Service, relative to the care of ven-
ereal disease cases reported at a
previous meeting, stating that the
local board had taken the right ac-
tion in quarantining the cases, and
also stating that there is on foot a
state -wide movement to restrain this
dreadful disease, and recommend-
ing the establishment of a deten-
tion hospital for venereal diseases.
Also stating that Dr. McLaughlin,
director of the state -wide venereal
control in Iowa, will visit Dubuque
in the near future for the purpose
of co- operating with the local
board to abate the spread of the
disease,
Mr. Zillig moved that this letter
he made a matter of record. Car-

Be it Resolved by the City Coun-
cil of the City of Dubuque, That a
sanitary sewer of eight inch tile
pipe be constructed in Seminary
Street from West Locust Street to a
point four hundred and fifty feet
north, according to the plans and
specifications of said sewer prepared
by the City Engineer and now on
file in the office of the City Re-
corder, and be it further
Resolved, that said sewer shall be
completed on or before the 1st day
of December, 1918, and shall be
paid for at the time and in the man-
ner prescribed by Chapter XXXIV
of the Revised Ordinances of 1901
of the City of Dubuque for the pay-
ment of the cost of constructing
sewers. The proposals for doing
such work will be acted upon by the
Council on the 17th day of October,
1918, and the City Recorder is here-
by ordered to give ten days' notice
by publication asking for proposals
as provided by ordinance.

Mayor Saul stated that this meet-
ing is called for the purpose of act-
ing on resolutions recommended by
the Board of Health and any other
business that might properly come
before a regular meeting of the City
Council.
Ald. Leist offered the following:
Whereas; there prevails at the
present time in the City of Dubuque
quite a large number of cases of
Spanish or Epidemic Influenza and
Whereas; the Board of Health of
said City is anxious to prevent the
spread of said disease as far as pos-
sible and to adopt such measures as
will adequately curtail the danger
from said disease; and
Whereas; the Board of Health
feels that public gatherings should
be immediately dispense with; now
therefore
Be it resolved by the Board of
Health of the City of Dubuque in
special session held on October
11th., 1918, that all churches,
schools, theaters and places of
public amusements and all other
places where public gatherings are
held be and the same are hereby
ordered to be immediately closed
and discontinued until further
notice from the Board of Health.
All colleges are hereby prohibited
from permitting day pupils from
attendance and all classes should be
suspended.
The Board of Health further in-
structs the City Attorney to com-
municate with the Dubuque Electric
Co, and request said company to
put into service sufficient addition-
al cars to carry passengers during
the rush hours so that no more per-
sons will be carried than can be
comfortably seated and crowding
cars should be dispensed with dur-
ing the period while the disease
continues to increase.
Be it further resolved that this
resolution be presented to the City
Council and recommended it's
adoption.

the Board on October 11, 1918.

met in special session October 9th,
1918, Chairman Saul in the chair.

Czizek.
Chairman Saul stated that the
purpose of this meeting was to take
steps to prevent the spread of the
Spanish Influenza.
Attorney Czizek addressed the
Board, stating that he had written
to Dr. Guilford H. Sumner, secre-
tary of the State Board of Health,
and received a reply stating that
he would send assistance to Du-
buque if needed.
The clerk was instructed to send
a letter to all the schools in the
city, instructing the teachers to take
proper precautions against the
spread of influenza, also to send a
child home at once if it showed
symptoms of the disease.
04. M. Hoffman addressed the
Board relative to quarantine in
cases where there had been infan-
tile paralysis, inquiring if it wall
necesary to keep a card on the
premises after the patient had died,
been buried and the house properly
fumigated. Attorney Czizek stated
he would telegraph to Dr. Sumner
relative to the above inquiry and
report at the next meeting.
Mr, Chas. Steuck addressed the
Board asking for the extension of
time to connect his property at the
corner of Iiniest street and Lincoln
avenue with sanitary sewer. On
motion of Ald. Leist the prayer of
the petition was granted,
Miss Dolan, nurse, reported that
the property located at 1073 -1075
Jackson street, was in an unsani-
tary condition, and recommended
that the Board investigate same.
Ald. Andresen moved to adjourn

has occurred at a house quarantined
for Ihfantile Paralysis, stating that
if there are no children on the
Premises, and the place where the
patient died is properly fumigated,
the quarantine may be lifted at the
discretion of the Board of Health;
otherwise not until the time of
quarantine has expired.

Whereas, There prevails at the
present time in the city of Dubuque
quite a large number of cases of
- Spanish or epidemic influenza; and
Whereas, The Board of Health
feels that public gatherings should
be immediately dispensed with;
now, therefore, be it

Resolved by the Board of Health
of the City of Dubuque, in special
session held on October 11, 1918,
that all churches, schools, theatres,
and places of public amusements
and all other places where public
gatherings are held be and the same
are hereby ordered to be imme-
diately closed and discontinued un-
til further notice from the Board of
Health.
All colleges are hereby prohibited
from permitting day pupils from
attendance and all classes should
be suspended.
The Board of Health further in-
structs the City Attorney to com-
municate with the Dubuque Electric
Co. and request said company to
put into service sufficient additional
cars to carry passengers during the
rush hours so that no more persons
will be carried than can be com-
fortably seated and crowding cars
should be dispensed with during the
period while the disease continues
to increase.
Be it further Resolved that this
resolution be presented to the City
Council and recommend its adop-
tion.
Adopted by unanimous vote of the
Board Oct. 11, 1918.

Notice to Sewer Contractors.
Sealed proposals will be received
at the Council Chamber, City Hall,
by the City Recorder, until 8:00 P.
m. Thursday, October 17th, 1918, to
be acted on by the City Council on
said elate, for the construction of an
eight -inch tile pipe sanitary sewer
in Seminary street from West Lo-
cust street to a point four hundred
and fifty feet north, in accordance
with the plans and specifications
prepared by the City Engineer and
now on file in the office of the City
Recorder.
It is estimated by the City Engi-
neer that said improvement will re-
quire
570 feet eight -inch tile pipe.
5 manholes.
The work to be paid for when
said work is completed and as pre-
scribed by Chapter XXXIV of the
Revised Ordinances of 1901 of the
City of Dubuque, Iowa, work to be
completed on or before December
1st, 1918.
Bidders must state price per lin-
eal foot of completed sewer, also
Price per manhole complete.
Each bid must be accompanied by
a certified check of $100.00 on some
Dubuque bank as a guarantee that
a contract will be entered into if
awarded. Checks and bid in separ-
ate envelopes.
The City Council reserves the
right to reject any and all bids.

buque quite a large number of
cases of Spanish or Epidemic
Influenza; and
Whereas, the Board of
Health of said City is anxious to
prevent the spread of said dis-
ease as far as possible and to
adopt such measures as will ade-
quately curtail the danger from
said disease and,
Whereas, __ the __ Board __ of
Health feels that public gather-
ings should be immediately dis-
pensed with; now therefore
Be it resolved by the Board
of Health of the City of Du-
buque, in special session held on
October 11, 1918, that all
churches, schools, theatres, and

lic gatherings are held be and
the seine are hereby ordered to
be immediately closed and dis-
continued until further notice
from the Board of Health.
All colleges are hereby pro-
hibited from permitting day
pupils from attendance and all
classes should be suspended.
The Board of Health further
instructs the City Attorney to
communicate with the Dubuque
Electric Co. and request said
company to put into service suf-
ficient additional cars to carry
passengers during the rush hours
so that no more persons will be
carried than can be comfortably
seated and crowding cars
should be dispensed with during
the .period while the disease
continues to increase.
Be it further resolved that
this resolution be presented to
the City Council and recom-
mend its adoption.

Notice is hereby given that the
registers of election duly appointed
to register voters in the City of Du-
buque, Iowa, will be in attendance
at the places hereinbelow mention-
ed, for the purpose of making the
registry lise of names of such elec-
tors as may be entitled to vote at
this fall election to he held Tues-
day, November 5th, 1918. Said
registers will meet at their respec-
tive places on Thursday and Friday,
October 24th and 25th, 1918, at 8
o'clock a. m. and be in session un-
til 9 o'clock p. m. of said days.
Said registers will hereafter meet
on Saturday, November 2nd, 1918,
from 8 o'clock a. m. to 9 o'clock p.
m. of said day for the purpose of
correcting the list and adding there-
to such names of voters as may be
entitled to vote. Said registers will
hereafter meet on Tuesday, Novem-
ber 5th, 1918 (election day) and be

provided by law will be levied at a
session of the City Council of the
City of Dubuque, Iowa, to be held
Thursday, November 7th, 1918, to
pay for constructing cement side-
walks abutting the following naniecl
lots: South 161 feet of Lot 10 of 14
and 15, Bush's Sub., assessed to
Margt. Ryan, amount of assessment,
$81.31. Lot 10 to 14 and 15, Bush's
Sub., assessed to Mary J. Beacon,

Petition of Michael Mullen call-
ing the attention of the City Coun-
cil to a hill that he had presented

Petition of Kretschmer Mfg. Co.
asking the City Council to instruct
the City Treasurer to accept the
taxes of Kretschmer Mfg. Co. and
Kretschmer Building Co. on a valua-
tion of $5,000 for the years 1916,
1917 and 1918, on City Lots 417,
418 and 419, stating that the City
Council took action to that effect in
February, 1912. Presented and read..
On motion of Ald. Frith the peti-

Petition of Voelker Realty Co.
asking the City Council to instruct
the City Treasurer not to advertise
for sale and to accept as payment in
full on a valuation as of January,
1917, this being for 1917 taxes of
$1,200.00, on the following: Lots
2 to 26, inclusive and 36 and 53,
Bellevue Add., assessed to under-
signed in the sum of $1,520, and odd
numbered Lots 1 to 19, 27, 35, 41, 57
and 59, in Bellevue Add., assessed
to M. M. Hoffman, Trustee, all now
owned by the undersigned, the lat-
ter being assessed for a total of
$3,580.00, each of which groups of
lots were purchased entire for $600,
making a total valuation of $1,200.

asking the City Council to instruct
the City Treasurer to accept the
taxes for the year 1914 in full of
$1,300 and cancel interest on lot
315, Woodlawn Park, which was
assessed for $2,300, claiming same
was a clerical error. Presented and
read. On motion of Ald. Frith the
petition was referred to the Com-
mittee of the Whole.
Petition of Voelker Realty Co.
asking the City Council to instruct
the City Treasurer to accept in
full on a valuation of $200, with-
out interest, and not to advertise for
tax sale, but to make a correction
on assessment for the following lots:
Rosedale Add., 32, 35, 36, 37, 38 and
39, which were assessed for $840,
though for the following years 1912,
1913 and 1911 they were assessed
for $240. A house on lots 33 or
34, owned by Mrs. S. Cooper, was
erroneously assessed as being on
our lots. Presented and read. On
motion of Ald. Frith the petition
