Connors, Economic Development Director SUBJECT: Resolution of Necessity for the Amendment of the Dubuque Industrial Center Economic Development District Urban Renewal Plan, Version 2023.3 DATE: April 25, 2023 INTRODUCTION This memorandum presents for City Council consideration a Resolution of Necessity that finds that: 1) an Amended and Restated Urban Renewal Plan for the Dubuque Industrial Center Economic Development District ("District") is both necessary and appropriate; and 2) sets a public hearing on the proposed amendment for June 5, 2023. The proposed Amended and Restated Urban Renewal Plan ("Urban Renewal Plan") for the District would expand the District to include property to be designated as a new Subarea T and include a new project under the public purpose activities, specifically, a City Data Center. BACKGROUND The original Dubuque Industrial Center Economic Development District was created on May 2, 1988. The District is an urban renewal area which allows the City of Dubuque to capture tax increment revenue from improvements made in the District in order to promote economic development activities. The original area included the Dubuque Industrial Center (known as Subarea A) and has been expanded several times over the years to include Dubuque Industrial Center West, the County Farm, the Bergfeld Farm, the North Siegert Farm, the Rail Site, the South Siegert Farm, the Graf Farm, McFadden Farms, small adjacent parcels, and several County-owned parcels (known as Subareas B, C, D, E, F, G, H, I, J, K, L, M, N, O, P, Q, and R). Before a municipality can exercise the authority conferred by lowa Code Chapter 403 Urban Renewal, a Resolution of Necessity must be adopted finding that the area being considered for urban renewal district designation is either a slum, blighted or economic development area and that the rehabilitation, conservation, redevelopment, development, or a combination thereof, of the area is necessary in the interest of the public health, safety or welfare of the residents of the city. DISCUSSION This proposed amendment of the Dubuque Industrial Center Economic Development District would result in an expansion of the District to include property to be designated as a new Subarea T and the addition of a City data Center listed under the Public Purpose Activities. Engineering staff are recommending the District be expanded to include property to be designated as a new Subarea T. Subarea T is approximately 10 acres. The property at 6505 Pennsylvania Avenue is within the 10 acres of Subarea T. The current property owner intends to sell a portion of their property at 6505 Pennsylvania Avenue. The City of Dubuque has been purchasing several properties on Pennsylvania Avenue, when available, in anticipation of a future road widening improvement project planned for Pennsylvania Avenue. Inclusion of Subarea T in the Plan will facilitate the acquisition of the property at 6505 Pennsylvania Avenue. As the importance of technology to City functions has grown, so has the need for staff, training, and equipment space. City Information Services and technology equipment has been located by default to multiple locations across the City, many of which are not optimal for physical, operational or security purposes. City staff have been exploring opportunities to improve the situation for some time, but available locations with the space and technological infrastructure required were limited and very expensive. City Staff have been communicating with Dubuque Initiatives (DI), a local 501(C)3 non-profit community organization and owners of 7900 Chavenelle Road. The DI Board had determined to look for partners to fill the space that would be consistent with the DI Mission of improving local development and quality of life and that would not conflict with the operation of an adjacent childcare center. City Information Services staff toured 7900 Chavenelle and discovered that not only did it contain an excellent data room with redundant power and a well-designed network connectivity system, but also had adjacent offices that could easily, and cost-effectively house City IS staff. In order to utilize tax increment generated in the Dubuque Industrial Center to fill the funding gap for the necessary improvements to create the City Data Center, the project must be included in the Public Purpose Activities of the Urban Renewal Plan. 2 The attached Resolution directs staff to prepare a Version 2023.3 Amended and Restated Urban Renewal Plan for the Dubuque Industrial Center Economic Development District. Additionally, staff is required to hold a consultation process, required by law, with the affected taxing entities concerning the proposed Plan. A City Council public hearing on the 2023.3 Amended and Restated Urban Renewal Plan will be scheduled for June 5, 2023. The public notice will be published four to twenty days before the meeting to allow for the appropriate publication requirements. This will allow time for preparation of the Plan and the consultation process with the taxing entities. RECOMMENDATION / ACTION STEP I recommend the City Council adopt the attached Resolution of Necessity that begins the process of drafting the Amended and Restated Urban Renewal Plan for Dubuque Industrial Center Economic Development District to add a project to the Public Purpose Activities. 3 RESOLUTION NO. 131-23 AUTHORIZING AND DIRECTING THE CITY MANAGER TO PREPARE AN AMENDED AND RESTATED URBAN RENEWAL PLAN VERSION 2023.3 FOR THE DUBUQUE INDUSTRIAL CENTER ECONOMIC DEVELOPMENT DISTRICT, SETTING A DATE FOR THE PUBLIC HEARING AND DIRECTING THE CONSULTATION PROCESS ON THE PROPOSED AMENDED AND RESTATED URBAN RENEWAL PLAN VERSION 2023.3 FOR SAID DISTRICT. Whereas, the City Council of the City of Dubuque has heretofore approved the Amended and Restated Urban Renewal Plan (the "Plan" or "Urban Renewal Plan") for the Dubuque Industrial Center Economic Development District (the "District") in order to provide redevelopment opportunities which will further the purposes and objectives of the foregoing Urban Renewal Plan; and Whereas, City staff has recommended that the Plan be further amended to expand the District to include additional property to be designated as a new Subarea T and to add a project to the Public Purpose Activities, specifically a City Data Center, for the Dubuque Industrial Center Economic Development District; and Whereas, Iowa Code Chapter 403 requires that before a Plan may be modified, the City Council must follow the notification, consultation, and public hearing process set forth therein. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. That the City Manager is authorized and directed to prepare an Amended and Restated Urban Renewal Plan Version 2023.3 for the Dubuque Industrial Center Economic Development District to include in such Plan any appropriate project activities and details, and to determine an appropriate date for and conduct the consultation process required by law with affected taxing entities concerning the proposed amendment. Section 2. That the City Council hold a public hearing on the adoption of the proposed Amended and Restated Urban Renewal Plan Version 2023.3 for the Dubuque Industrial Center Economic Development District on June 5, 2023 at 6:30 p.m. in the form attached hereto. The notice of said hearing shall generally identify the areas covered by the Plan Version 2023.3 and the general scope of the urban renewal activities planned for such areas and said notice shall be published in a newspaper having general circulation within the City not less than four days nor more than twenty days before the date of said meeting. A copy of the notice of public hearing shall be sent by ordinary mail to the affected taxing entities. Section 3. That the Economic Development Department is further directed to send by ordinary mail a copy of said Plan Version 2023.3, the notice of public hearing, a notice of consultation, and, to the extent the Plan Version 2023.3 includes the use of tax increment revenues for a public building, an analysis of alternative development and funding options for such public buildings, to the Dubuque Community School District and the Dubuque County Board of Supervisors, as the affected taxing entities.
