Steger, Housing & Community Development Director Subject: Second Amendment to CDBG Subrecipient Agreement between the City of Dubuque and Dubuque Community YMCA/YWCA Domestic Violence Shelter Date: May 9, 2023 BACKGROUND The City of Dubuque entered into a Community Development Block Grant (CDBG) Subrecipient Agreement with Dubuque Community YMCA/YWCA on July 6, 2021, to assist with the rehab of the Domestic Violence Shelter. Unexpected change orders have necessitated an increase in funding and an updated time of performance to make this project viable. This memorandum transmits a resolution to amend the Subrecipient Agreement to reflect increased project costs and updated time of performance. DISCUSSION The Amendment 1 specified the funding amount to be $172,182 based on updated material costs. The Dubuque Community YMCA/YWCA has requested an additional $5,453 to cover the unexpected change orders up to $177,637. Unexpected change orders will also push back the completion date. Therefore, we are updating the time of performance. The CDBG Annual Action Plan has available funding, so this increase can be accommodated without a budget amendment. Attest Brad M. u agh, Mayor Az� " / �/4 Adrienne Breitfelder, City Clerk SECOND AMENDMENT TO SUBRECI PEINT AGREEMENT BETWEEN THE CITY OF DUBUQUE AND DUBUQUE YMCA/YWCA DOMESTIC VIOLENCE SHELTER This Second Amendment to Subrecipient Agreement, dated for reference purposes the _15th day of May 2023, is made and entered into by the City of Dubuque, Iowa, a Responsible Entity administering Community Development Block Grant funds (City), and the Dubuque YMCA/YWCA Domestic Violence Shelter (Subrecipient). WHEREAS, City and Subrecipient entered Into a Subrecipient Agreement dated July 6, 2021 (the Subrecipient Agreement); and herein. WHEREAS, City and Subrecipient desire to amend the Subrecipient Agreement as set forth NOW THEREFORE, IN CONSIDERATION OF THE MUTUAL TERMS AND COVENANTS CONTAINED HEREIN, CITY AND SUBRECIPIENT AGREE AS FOLLOWS: follows: Section 1. Section A.3 and A.6 of the Subrecipient Agreement is hereby amended to read as A.3 Proiect Budget The City agrees, subject to the terms and conditions of this Agreement, to compensate the Subrecipient for the Statement of Work outlined in Exhibit A, not to exceed $177,637.00. If indirect costs are charged, the Subrecipient will develop an indirect cost allocation plan for determining the appropriate Subrecipient's share of administrative costs and shall submit such plan to the City for approval, in a form specified by the City. A.6 Term and Time of Performance Services of the Subrecipient shall start on December 5, 2022 and end on September 30, 2023. All the required activities and services, except for audit, will be completed by or before this date. The City may grant extensions at its sole discretion. Only a valid written Amendment to the Agreement shall alterthis completion date. The term of this Agreement and the provisions herein shall be extended to cover any additional time period during which the Subrecipient remains in control of CDBG funds or other assets, including program income.
