Van Milligen, City Manager FROM: Michael Belmont, Assistant Housing Director SUBJECT: Adoption of the 2021 Uniform Plumbing Code DATE: May 11 th 2023 Introduction This memorandum forwards the enclosed amendments to the City of Dubuque Code of Ordinances, Title 14 Building and Development, Chapter 1 Building Codes, Article H Plumbing Code, for City Council's consideration. Background The Uniform Plumbing Code is a model code which serves as the standard by which plumbing for new construction and renovations are constructed. This code reflects modern plumbing best practices and serves as an essential tool to preserve public health and safety and provide safeguards from hazards associated with improperly installed plumbing systems. The Uniform Plumbing Code establishes minimum requirements for plumbing systems using prescriptive and performance -based provisions. The codes are kept up to date through an ongoing review process involving code enforcement officials, industry professionals, design professionals and other interested parties. Proposed changes are carefully considered through an open code development process in which all interested stakeholders may participate. The 2021 editions contain changes approved by the International Association of Mechanical and Plumbing Officials (IAPMO) code Development Process through 2020. A new edition of this code is created every 3 years. Discussion The proposed amendments will adopt a new model plumbing code to replace the currently adopted 2018 International Plumbing Code (IPC). The 2021 Uniform Plumbing Code (UPC) is adopted by the state of Iowa as the "State Plumbing Code". In prior years, local jurisdictions had the option of adopting different plumbing codes, provided those codes were not less restrictive than the state code. However, state law now requires local jurisdictions to adopt the "State Plumbing Code", which is the 2021 Uniform Plumbing Code with state amendments. Local amendments may be adopted provided those amendments are no less strict than the state code. Like the previously adopted IPC, the UPC is a comprehensive and thorough plumbing code. Over the several months, Inspection and construction services staff, along with stakeholders in various other departments, performed an in-depth review of the proposed UPC code and amendments. Proposed local amendments are limited to defining allowable service line materials to align with the city's water department requirements. As a result of the adoption of the UPC, the International Plumbing Code (IPC) and the International Fuel Gas Code (IFGC) is no longer required and are proposed to be repealed. The UPC has a fuel gas section. When combined with the International Mechanical Code, the requirements of the IFGC are covered. Continued adoption of the IFGC would be redundant and potentially create future conflicts. Public Input. After staff review of the codes was completed, the proposed amendments were brought to the Building Code Advisory and Appeal board for review and input. The Building Code Advisory and Appeal Board is a seven -member board tasked with reviewing proposed code adoptions for recommendation to the City Council and to serve as an appeal body for decisions of the code official. Each member is qualified by experience and/or training in matters related to building construction. On March 15, 2023, the agenda was posted for the Building Code Advisory and Appeal Board meeting. On March 21 st, a reminder email was sent to our contractor email list to remind them of the meeting and inviting attendance and input. The Building Code Advisory and Appeal board held a public meeting on March 22nd 2023. There were no contractors present for the meeting, and no public input was submitted. At the meeting the Building Code Advisory and Appeal Board recommended approval of the 2021 Universal Plumbing Code (UPC), as amended by the State, with proposed local amendments. Proposed local amendments are limited to defining allowable service line materials to align with the city's water department requirements. In addition to the BCAAB review of the proposed amendments, a contractor reception was held at the grand river center on April 13t", where contractors were provided with the proposed amendments and invited to provide input. Several plumbing contractors were in attendance. No proposed changes were submitted. Requested Action The Inspection & Construction Services, along with the Building Code Advisory and Appeal Board has reviewed the Uniform Plumbing code along with state and local amendments, and recommend approval as submitted.
