Consistent with the fiscal year 2024 approved budget regarding wage increases, along with the desire to recruit and retain an engaged and diverse workforce, to create an inclusive workplace, to better assure service and department operational needs, and/or to format provisions for ease in locating provisions, the following Amendments to the five existing union/collective bargaining agreements (CBA's) have been proposed to, and have been ratified by, the respective unions: First Amendment to Teamsters Local No. 120 (Mixed) July 1, 2022 through June 30, 2025: • Revises Article 29 Wage Plan for FY24 from 3.0% to 5.0%. • (Note: The Juneteenth Holiday was already negotiated for inclusion in the contract at the time of bargaining and at ratification) 2. First Amendment to Teamsters Local No. 120 Bus Operators July 1, 2022 through June 30, 2025: Revises Article 17 Holidays at section 1 to include the Juneteenth Holiday. Revises Article 25 Wage Plan for July 1, 2023 — June 30, 2024 from a base rate increase of 3.0% to 5.0%. 3. Second Amendment to Dubuque Police Protective Association July 1, 2020 through June 30, 2024: • Revises Article XVII Holidays to include the Juneteenth Holiday • Revises Article XXVI Wage Plan at Section 4. July 1, 2023 — June 30, 2024 Wage Base Rate from 3.0% to 6.0%, • Article XXIII Callback and Standby/On-Call is revised to 0 organize Callback and Standby/On-call into separate sections o provide Standby/On-call supplement pay for crime scene technicians for major crimes assigned to on -call. • Revises Article XX Overtime and Supplemental Pays to: o Provide increased Field Training Officer Supplemental Pay from the equivalent of four hours of pay per week to eight hours per assigned week. o Provide supplemental pay for employees assigned to and performing K-9 Officer duties. o Organize and break into sections for ease of access and understanding. 4. Third Amendment to Dubuque Professional Fire Fighters Association Local #25 July 1, 2017 through June 30 2022 and by Resolution extension to June 30, 2024: • Revises Article 12 Wage Plan with regard to the amendment/changes executed by Resolution No. 147-19 at the second bullet for the FY 24 wage plan from a 3.0% increase to a 6.0% increase. • Revises Article 24 Holidays at Section 1 to include the Juneteenth Holiday. 5. Fourth Amendment to The International Union of Operating Engineers AFL-CIO Local #234 July 1, 2017 through June 30, 2022 and by Resolution NNO. 77-19 extended to June 30, 2024: • Revises Article XXXI Holidays o at Section 1 to include the Juneteenth Holiday. o at Section 4 to provide Public Safety Dispatchers with up to 12 hours of paid holiday leave for holidays on which they do not work. o adds Section 5 — Holiday Pay for clarification and distinction between holiday paid leave time and payment for working on a holiday. • Article XXVIII Hours of Work is revised to provide full-time Public Safety Dispatchers with 12-hour work shifts. • Article XXX Overtime Pay is revised to provide for Overtime for Public Safety Dispatchers who work over 40 hours per work week. • Article XXXX Wage Plan is revised regarding the amendment executed by Resolution No. 77-19 at the second bullet for the FY24 wage increase to be 5.0%, except for Public Safety Dispatchers for whom the increase is 6.0%. • Adds Article XXXXIII Training Pay for Public Safety Dispatchers. I am recommending that the Dubuque City Council ratify the above referenced CBA amendments. I respectfully request your support for this recommendation. Employes in the classification of Inspector I shall not be entitled to premium payment as provided in this Article or any other premium payment as provided in this Agreement except for callback pay. Section 2. ARTICLE XXV1L1 HOURS OF WORK is amended as follows: The regular workday and workweek shall be eight (8) hours per day or forty (40) hours per week, except for Public Safety Dispatch positions For shift employees the workday shall be a twenty-four (24) hour period which normally commences at 11:00 P.M. and ends at 11:00 RM. on the following day, except for Public Safety Dispatchers A shift employee shall be defined as an employee who works in an activity for which them is regularly scheduled employment for seven (7) days per week and twenty-four (24) hours per day and who is assigned to one (1) of three shifts in the workday which normally begins at 11;00 P.M. Classifications that meet this definition are Plant Operator (Water and Wastewater) and Assistant Plant Operator. The commencement of the workday and the number of shifts in a workday for employees in the classification of Public Safcty Dispatcher may vary from this definition. Days in a workweek shall be established by each department. The workday at the Eagle Point Plant shall start at 7:00 A.M. The normal workweek of the Water Distribution Crew shall be Monday through Friday. Article XXXX WA E PLAN regarding the Amendment executed by RI:SOLU 1014 NO.77-14, the second bullet is amended to: • I'ltective July 1, 2023 through June 30, 2024, the wage plan in effect on June 30, 2023 shall be increased by 5% acniss the hoard, except that employees in the position of Public Safety Dispatcher shall be increased by 6%. Section 5. Adding ARTICLE XXXXIII TRAINING PAY FOR PUBLIC SAFETY DISPATCHERS Public safety Dispatchers shall receive the equivalent of one hour of regular pay for every ten (10) hours of training provided to new dispatchers. The Emergency Communications department manager shall have sole discretion for specifically designating both who is a trainer for a new employee and training hours. In no event shall training pay be counted or considered as actual hours worked for the computation of overtime pay eligibility - Section 6. The parties agree as follows: Section 1. Effective June 19, 2023, Article XVII HOLIDAYS, Section 1. of the Agreement is amended to add Juneteenth observed on June Nineteenth. Section 2. Article XX OVERTIME is amended to reflect that the Article references OVERTIME and certain SUPPLEMENTAL PAY and is amended as follows: ARTICLE XX OVERTIME AND SUPPLEMENTAL PAYS Section 1 - Overtime Except as otherwise provided in this Article, one and one-half (1 1/2) times the regular rate of pay shall be paid for all hours worked outside a scheduled payroll day or a scheduled payroll week. For employees assigned to an eight (8) hour workday, daily overtime will commence after eight (8) hours and twenty (20) minutes have elapsed from the designated reporting time of the employee. For employees assigned to a ten (10) hour workday, daily overtime will commence after ten (10) hours and twenty (20) minutes have elapsed from the designated reporting time of the employee. Employees who are eligible to receive overtime may be granted time off in order to compensate for and in lieu of overtime payment. Compensation shall not be paid more than once for the same hours of work under any provision of this Article or Agreement. When overtime is required, it must be approved by the employee's supervisor. Section 2 — Court Annearance/Witness Fees An employee shall be paid double time for time spent in court during the employee's scheduled vacation. This double time provision does not apply to the employee's court appearance on a casual day. Employees shall be paid a minimum of two (2) hours at 1 t/2 times their regular rate of pay as witness fee or if the employee spends more than two (2) hours in court, the employee shall be paid 1 t/2 times their regular rate of pay for the total hours worked. Page 1 of 3 Section 3 — Field Training Officer Sunblemental Pa Effective upon enactment of this amendment, an employee who is assigned the duties of Field Training Officer shall receive eight (8) hours of compensatory time off or eight (8) hours of pay at the regular rate of pay for each full week during which he/she is assigned to and works with a police officer during his/her trial period as a Field Training Officer. Section 4 — Travel Time Travel time related to attending training sessions as defined by the Fair Labor Standards Act as compensable hours of work, will be paid in accordance with the overtime provision of the Agreement. Section 5 — Performance of K-9 Officer Duties Effective January 25, 2001, an employee who is assigned to and performs the duties of K-9 Officer on a regular basis shall receive an additional thirty (30) minutes of compensatory time per day or thirty (30) minutes of pay at the regular rate of pay per day. In no instance will the thirty (30) minutes of pay at the regular rate of pay per day be considered hours worked for the purposes of overtime eligibility. Section 3. Article XXIII CALL BACK is amended to reflect that the Article references CALL BACK and STANDBY/ON-CALL and is amended as follows: ARTICLE XXIII CALL BACK AND STANDBY/ON-CALL Section 1 — Call back Except as otherwise provided in this Article, an employee who, having left the premises after his/her regular shift, is recalled for additional work shall receive not less than two (2) hours pay. When such work merges with the employee's regular workday this provision does not apply. Employees in the classifications of Sergeant and Identification Officer are not entitled to receive payment under this or any other Article of this Agreement for time spent in department staff meetings outside of their regular work shift. Section 2 — Standbv/On-Call The City has the right to determine who is on standby/on-call and the operationally needed number of employees on standby/on-call. A) Employees assigned to the Drug Task Force on standby/on-call will receive, at their option, either six (6) hours at their regular rate of pay or six (6) hours of compensatory time for each full week they are on standby/on-call. B) Employees assigned to the Criminal Investigation Division or employees assigned to the team of crime scene technicians for major crimes on standby/on-call will receive, at their option, either four (4) hours at their regular rate of pay or four (4) hours of compensatory time for each full week they are on standby/on-call. Standby/on-call pay shall not be considered hours worked for purposes of overtime eligibility. Employees who are on standby/on-call, but are not available for work, will not receive standby/on-call pay and will be subject to disciplinary action. Page 2 of 3 Section 4. Article XXVI WAGE PLAN at Section 4.
