The application, staff report and related materials are attached for your review. Discussion Dave Schneider, Schneider Land Surveying, 906 1st St N, Farley, Iowa spoke on behalf of property owners, Bob Miller and Ross Miller. He noted the location of the plat and explained that it is reconfiguring three existing lots in order to transfer some property and provide the building code required 5' setback for the existing garage. Staff detailed the staff report noting the submitted Plat of Survey is for a reconfiguration of three existing lots, which is a Minor Subdivision, requiring ZAC review, and City Council review and approval. Staff explained the existing garage was built over property lines, and the plat seeks to adjust the property lines, so the garage is entirely one property. Staff explained the third lot is legally non -conforming with respect to street frontage and this condition would remain, and an access easement for that lot is included on the plat. The Commission sought to clarify whether the access easement for the 2745 Dodge Street (Lot 2) property was already existing, and staff confirmed it is and would continue to be in place with the proposed plat. The Commission also asked to confirm that the lack of street frontage for Lot 2 is the only waiver required, and staff confirmed that it is. There were no public comments. The Zoning Advisory Commission discussed the request and found it appropriate. A simple majority vote is needed for the City Council to approve the request. The plat affects three existing lots located within the City of Dubuque. The proposed plat would reconfigure the existing lots in order to move a shed onto another lot. Pursuant to the UDC, a subdivision of property that creates three or more lots is classified as a Minor Subdivision and requires review by the Zoning Advisory Commission and City Council. DISCUSSION As proposed, the Final Plat of Steger Heights Plat 3 would reconfigure three existing lots thereby creating three new lots. The reconfiguration of the lots is being proposed in order to shift properties lines around an existing detached garage so that the garage is located entirely on one property, and not straddling the property line between two lots. In order to do this, the property at 2745 Dodge would be subdivided to separate the garage. Additionally, the property line along the west side of the garage would be adjusted so that it would not run through the detached garage, thereby modifying the east property line of 2727 Dodge Street. And finally, the newly create lot containing just the garage would be consolidated with the existing lot to the north at 2760 New Haven Street. As proposed, the property at 2760 New Haven Street (Lot 1) would be increased to 1.89 acres, the property at 2745 Dodge Street (Lot 2) would be reduced to .711 acres, and the property at 2727 Dodge Street (Lot 3) would be reduced to 1.53 acres. The property at 2760 New Haven Street (Lot 1) would continue to have frontage along and be accessed from New Haven Street. The property at 2745 Dodge Street (Lot 2) does not currently have street frontage along a street and this condition would remain. This property would continue to be accessed from Dodge Street through an existing 40' wide access easement across the property at 2727 Dodge Street. The property at 2727 Dodge Street (Lot 3) would continue to have frontage along and be accessed from Dodge Street. The Unified Development Code Chapter 11 defines a Minor Subdivision as `Any subdivision or consolidation of property in which no new streets, public or private, are proposed and which does not require the construction of any public improvements, and which creates three or more lots." The Zoning Advisory Commission shall review the plat to determine whether it is in substantial conformance with the Unified Development Code. The City's Comprehensive Plan identifies the future land use for the subdivision area as Commercial and Single -Family. The proposed subdivision is not anticipated to be in conflict with the City's Comprehensive Plan uses and goals. As requested, the proposed subdivision will have little effect on the status of the subject lots or surrounding properties. The proposed subdivision plat would comply with all aspects of the City of Dubuque's subdivision regulations contained in the Unified Development Code and the land use goals within the City's Comprehensive Plan. RECOMMENDATION Planning staff requests that the Zoning Advisory Commission review the Final Plat of Steger Heights Plat 3 and recommends approval as submitted of the Minor Subdivision.
