INTRODUCTION
The purpose of this memorandum is to recommend the annual renewal of the above retail
alcohol license establishments and to highlight the calls for service related to incidences
of disturbances, crimes against persons, crimes against property, and public morals
occurring at the business since the last liquor license renewal.
BACKGROUND
Regarding the listed establishments, the following is a summary of activity since their last
renewal. The following key provides a brief description of those calls for service
displaying four areas of concern.

numerous instances. A liquor license issuance agreement was drafted by City Legal
and the Police Department. The licensee met with representatives of the Police
Department on June 9, 2023 and signed the agreement to be in compliance (see
attached agreement). As part of the agreement, the licensee agreed to meet with
representatives of the Police Department quarterly and to remain in compliance. See

BY CITY OF DUBUQUE CODE OF ORDINANCES TITLE 4 BUSINESS AND
LICENSE REGULATIONS, CHAPTER 2 LIQUOR CONTROL, ARTICLE B LIQUOR,
BEER AND WINE LICENSES AND PERMITS
Whereas, applications for retail alcohol licenses have been submitted and filed
with the City Council for approval, and the same have been examined, provisionally
approved, and/or approved; and
Whereas, the premises to be occupied by such applicants were inspected and
found to comply with the Ordinances of the City, and the applicants have filed the proper
fees and bonds and otherwise complied with the requirements of the Code of
Ordinances.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY

LIQUOR LICENSE ISSUANCE AGREEMENT
WHEREAS, I, Sara Oglesby, owner of 1st & Main located at 101 Main Street, Dubuque,
IA, have applied for a liquor license or wine/beer permit for 1st & Main; and
WHEREAS, I acknowledge I have previously operated out of compliance with the Iowa
Code and City of Dubuque Code of Ordinances provisions for liquor license or wine/beer
permit holders related to:
a. Selling, serving, and/or dispensing alcoholic beverages to person(s) under the
legal age of twenty-one (21), in violation of State of Iowa Code 123.47.
b. Allowing persons under the age of twenty-one (21) to enter or remain inside the
establishment after 9:00 pm, in violation of City of Dubuque Code of ordinances
section 4-2A-7(C)(1)(a).
c. Selling, serving, and/or dispensing alcoholic beverages to an intoxicated
individual, in violation of City of Dubuque Code of Ordinances section 4-2A-
3(A).
d. Persons of Good Moral Character: State of Iowa Alcoholic Beverages Division
investigation report dated 09/07/2022 indicating potential violations of State of
Iowa Code 123 pertaining to ownership of 1st & Main involving John Oglesby
and Terry Tabor, both convicted felons, who were at one time listed as agents
of Enzo's, LLC, which is the LLC that owns 1 st & Main.
e. Allowing employees to become intoxicated on the job.
Allowing intoxicated employees to sell, serve, and dispense alcoholic
beverages.
WHEREAS, I agree and pledge to the City Council and the neighborhood in which 1st &
Main is located that I will continue to work with police and my neighbors to foster a safe
business, clean property, and a legally compliant business by either implementing or
continuing the list of management items that follow:
1) 1 will cooperate with the City to verify that I am operating as required by City
ordinances and state code. I understand that a failure on my part to
cooperate as outlined in this agreement could result in revocation of my
liquor license or wine or beer permit.
2) 1 agree that all staff will diligently check ID's of patrons entering
establishment, ensuring only those of legal age are allowed entry and/or
sold and/or served alcoholic beverages.

3) 1 agree to provide ID scanners to staff members responsible for checking
ID's at the facility entrances in an effort to improve on underage detection.
ID scanners can also be in the form of ID checking software such as the
Age to Purchase App from the State of Iowa Alcoholic Beverages Division.
4) 1 agree that all staff will monitor customers' sobriety and consumption levels
and will not serve additional alcoholic beverages to intoxicated persons.
5) 1 agree that those not of good moral character will not be involved in
management and business decisions for the business 1st & Main.
6) 1 agree to prohibit employees to consume alcoholic beverages while
working and to relieve employees from duty if they are discovered working
while intoxicated.
7) 1 will cooperate with police and my neighbors to assist in resolving any
problems that may occur with the operation of my business.
8) 1 agree to meet with Police staff on a quarterly basis to discuss calls for
service to the business 1st & Main and steps I am taking to eliminate
occurrences not in compliance with Iowa Code and City of Dubuque Code
of Ordinances.
9) 1 have an open-door policy to address any neighborhood concerns with
neighbors.
This agreement and pledge is in the spirit of wanting to be a good neighbor where any
problems will be addressed and worked on for the betterment of the neighborhood.

BACKGROUND
Pursuant to Iowa Code §453A.47A, a retail permit is required to sell tobacco, tobacco
products, alternative nicotine products, or vapor products at any place of business or
through delivery sales. All permits provided for in Iowa Code §453A.47A expire on June
30 of each year and require payment of the applicable fee established in Iowa Code
§453A.47A(7). The Iowa Department of Revenue implements the retail permit
requirements of Iowa Code §453A.47A and has designated city clerks to issue all permits
for retailers located within their respective limits. As part of the retail permit process, the
Iowa Department of Revenue requires that applications be approved by the city council
once the city clerk receives the completed application and appropriate fee.
RECOMMENDATION
Upon confirmation that the City Clerk's Office has received the completed applications
and proper fees, I recommend approval of retail permits for tobacco, tobacco products,
alternative nicotine products, and vapor products for the following retailers:

RESOLUTION NO. 197-23
APPROVING APPLICATIONS FOR RETAIL PERMITS TO SELL TOBACCO,
TOBACCO PRODUCTS, ALTERNATIVE NICOTINE PRODUCTS, AND VAPOR
PRODUCTS, AS REQUIRED BY IOWA CODE §453A.47A
Whereas, applications for retail permits to sell tobacco, tobacco products, alternative
nicotine products, vapor products, or a combination of these products have been
submitted and filed with the City Clerk; and
Whereas, the applicants have filed the proper application and fees as required by Iowa
Code §453A.47A; and
Whereas, the Iowa Department of Revenue requires all applications be approved by
the City Council; and
Whereas, all retail permits to sell tobacco, tobacco products, alternative nicotine
products, and vapor products shall expire on June 30 of each year, as established in Iowa
Code §453A.47A(7).
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA THAT:
Section 1. The City Clerk is hereby authorized and directed to cause to be issued the
following named applicants and locations for retail permits to sell one or more of the
following as specified on the retail permit applications: tobacco, tobacco products,
alternative nicotine products, and vapor products.
Effective from: July 9. 2023 to June 30. 2024
