WHEREAS, Richard C. Henschel,
owner and applicant, filed an application
for reclassification of said property from
AG Agricultural District to PR Plann-
ed Residential District and has filed a
Conceptual Development Plan for cer-
tain property hereinafter described in ac-
cordance with provisions of the Plan-
ned Residential District regulations as
set forth in Section 8-6.1D of the Code
of Ordinances, Appendix A thereof, of
the City of Dubuque, Iowa; and
WHEREAS, the Planning and Zoning
Commission has held a Public Hearing
on said Conceptual Development Plan
and said application for zoning
reclassification pursuant to required
published notice; and
WHEREAS, the Commission has
found that said property is located ad-
jacent to and is accessible through an
established residential neighborhood by
means of the private road known as
Richards Road extension; and
WHEREAS, the Planning and Zoning
Commission has approved said Concep-
tual Development Plan and said applica-
tion for zoning reclassification subject
to specific conditions and restrictions
having found that said plan conforms
with the review standards applicable to
such plans as set forth in Section
3-1.6D(4) of the Code of Ordinances, Ap-
pendix A thereof, of the City of Dubu-
que, Iowa; and
WHEREAS, the Planning and Zoning
Commission recommended the concur-
rence of the City Council ond approval
of said application of zoning reclassifica-
tion; and
WHEREAS, the City Council has
received the recommendation of the
Planning and Zoning Commission and
has held its own Fublic Hearing on said
Conceptual Development Plan and said
application of zoning reclassification;

WHEREAS, the City Council has
received the recommendation of the
Planning and Zoning Commission and
has held its own Public Hearing on said
conceptual Development Plan and said
application for zoning reclassification
pursuant to required published notice;
and
WHEREAS, the City Council has ap-
proved said Conceptual Development
plan and said application for zoning
reclassification subject to the same
specific conditions and restrictions.
NOW, THEREFORE, BE IT OR-
DAINED BY THE CITY COUNCIL
OF THE CITY OF DUBUQUE, IOWA:
Section 1. That the Code of Ow
dinances of the City of Dubuque, Iowa
be amended by revising Appendiz A
thereof, also hnown as the Zoning Ow
dinance and Zoning Map of the City of
Dubuque, Iowa; by reclassifying from
"AG Agricultural District" to "PR
Planned Residential District" the follow-
ing described property, to wit:
All of Block 2 in Henschel' s Additlor~
except the northerly 600 feet hnown as
Richards Road Extension, in the city of
Dubuque, Iowa.
Section 2. That in order to accomplish
the purposes of the "PR Planned
Residential Dis trict" and of the Zoning
Ordinace, the porperty herein above
described and reclassified are so
reclassified subject to the following con-
ditions and restrictions:
(a) Use Regulations. The following
regulations shall apply to all uses made
of land in the above described Planned
Residential District:
(1) Principal permitted uses shall be
limited to single - family detached dwell-
ings, with a maximum of two dwellings
for the entire four acre parcel.
(2) Accessory uses, conditional uses
and temporary uses shah be the same as
allowed by the R-1 Single-Family
Residential District.
(3) No secondary or contingency uses
shall be permitted.
(b) Lot and Bulk Regulations.
Development of land in this particular
PR planned Residen5al District shall be
regulated as follows:
(1) Each lot shall be established with

a minimum lot frontage of 60 feet.
(2) Structures shall not cover more
than 40 percent of each lot.
{3) The required yards shall be
established at a minimum of 20 feet for
a front yard, 6 feet for a side yard and
20 percent of lot depth for a rear yard.
(4) No building or structure can exceed
30 feet in height.
(c) Transfer of Ownership. Any
transfer of ownership or lease of prope~
ty in the Planned Residential District
shall include in the transfer or lease
agreement, a provision that the pu~
chaser or leasee acknowledges
awareness of the conditions authorizing
the establishment of the specific PR
Planned Residential District.
Section 3. That approval of the Con-
ceptual Development Plan shall be valid
for a period of three (3) years provided
that after the first year, if no Final
Development Plan has been filed, the
Commission or Council may require the
resubmission of a conceptual Develop-
ment Plan in conformity with the pro-
cedures and standards of Section 3-1.6
of the Code of Ordinances, Appendix A
thereof, the City of Dubuque, Iowc~ also
known as the Zoning Ordinance and
Zoning Map of the City of Dubuque,
lowa and further that a final site
development plan shall be approved by
the City Development Planner if found
to be in conformance with the approv.

AGREEMENT WITH THE IOWA
DEPARTMENT OF TRANSPORTA'
TION ON RIGHT-OF-WAY
ASSURANCE STATEMENT FOR
FEDERAL-AID PROJECTS
WHEREAS, Iowa Department of
Transportation has requested the City
to execute an agreement stipulating that
the City will comply with the 1970
Uniform Relocation Assistance and
Land Acquisition Policies Act, on
federal-aid to transportation projects;
and
WHEREAS, such a statement must
be on file with the Iowa Department of
Transportation in order for the City to
be in compliance with the federal-aid
projects for transpor~atinn purposes and
to be eligible for federal transportation
funds.
NOW, THEREFORE, BE IT
RESOLVED, by the City Council of the
City of Dubuque, Iowa:
Section 1. That the Mayor be
agreement with the Iowa Department of
Transportation stipulating that the Ci-
ty of Dubuque will comply with the
federal regulations relative to acquisi-
zion of property for transportation pu~
poses, for which federal funds are
involved.

A RESOLUTION AUTHORIZING
ECIA BUSINESS GROWTH, INC. TO
LOAN $53,000 FROM THE CITY OF
DUBUQUE'S PORTION OF THE EDA
REVOLVING LOAN FUND TO DUBU-
QUE DATA SERVICES COMPANY.
WHEREAS, the City of Dubuque has
funded a part of the local match of an
Loan Fund IRLF) which
is administered by ECIA Business
Growth, Inc.; and
WHEREAS, Dubuque Data Services
Company has requested a loan of
$102,000 from the RLF for acquisition
of computer equipment; and
WHEREAS, Dubuque County has
authorized the loan of $49,000 from its
portion of the RLF; and
WHEREAS, ECIA Business Growth,
Inc. has requested that the City of
Dubuque authorize it to loan Dubuque
' the balance of
the funds requested from the City of
Dubuque's portion of the RLF; and
WHEREAS, the City Manager and
Staff have reviewed the Dubuque Data
Services Company project and have
recommended that the City support said

RESOLVED BY THE CITY COUN-

IOWA:
Section 1. That ECIA Business
Growth, Inc. is hereby authorized to loan
to Dubuque Data Services Company
$53,000 from the City of Dubuque's pot-
tion of the EDA Revolving Loan Fund.

hereby directed to notify ECIA Business
Growth, Inc. of said authorization by

recommends its acceptance.

City of Dubuque, Iowa, that the recom-
mendation of the City Manager be ap-

BE IT FURTHER RESOLVED that
the City Treasurer be and he is hereby
directed to pay to the contractor from
the Revenue Sharing Fund in amount

be amended by enacting a new Section
25-272 thereof as follows;
"Sec. 25-272. Reserved law enforce-
ment vehicle parking.
(a) When appropriate signs have been
posted, that area located on the northe~
ly side of Eighth Street between Central
and the alley lying westerly of Central
A venue is hereby set aside for the park-
lng of law enforcement vehicles.
(b)lt shall be unlawful for the operator
of any vehicle to stop, stand or park
within such area unless such vehicle is
clearly identified and marked as a vehi-
cle assigned to law enforcement
activities.

Article IV. Emergency Succession
Sec. 2-199. Purpose
(a) Because of the existing and increas-
ing possibility of the occurrence of
natural or person-caused disaster or
major accident, it is imperative that th,
administrative functions of the City be
maintained and continued to protect the
public peace, health and safety.
(b) It is the policy of the City Council
to provide for emergency interim
successors to those City employees
whose appointments are the respon-
sibflity of the City Council.
Sec. 2-200. Definitions.
As used in this article the foliowlng
terms shall have the meanings as set
forth.
Disaster means person-caused and
natural occurrences such as fire, flood
drought, earthquake, tornado, wind-
storm, hazardous substance or nuclear
plant accident or incident which
threatens the public peace, health and
safety of the people of the City of Dubu-
que or which damage and destroy public
or private property. The term includes
enemy attack, sabotage or other hostile
actions from without the state.
Emergency interim successor means
a person designated pursuant to this
article in the event a person is
unavailable to exercise the powers and
discharge the duties of an office until a
successor is apninted or until the lawful
encumbent is able to resume exercise of
the powers and discharge the duties of
the office.
Unavailable means either that a
vacancy in office exists and there is no
deputy authorized to exercise all of the
powers and discharge the duties of the
office or that the lawful encumbent of
the office is absent or unable to exercise
the powers and discharge the duties of
the office.
Sec. 2-201. Appointment.
The following emergency interim suc-
ceasors are appointed in the event of the
unavailability of the encumbent of that
office.
(a) Administrative Assistant to the
City Manager shall become City
Manager if the latter is unavailable.
(b) Deputy City Clerk shall become
City Clerk, if the latter is unavailable.
(c) City Solicitor shall become Cot-
poratinn Counsel, if the latter is
unavailable.
Sec. 2-202. Termination of Author-
ity by Council.
City Council may at any time by adop~
tlon of a resolution terminate the
authority of any emergency interim
successors.

WHEREAS, the City of Dubuque,
Iowa in conformance with the Eh-
vlronmental Review Procedures for the
Community Development Block Grant
Program convened an Ad Hoc Commit-
tee on December 2, 1985 which com-
pleted an environmental assessment of
the following identified project:
Removal of Architectural
Barriers - City Hall
WHEREAS, pursuant to Resolution
No. 407-85, adopted December 16, 1985,
public notice of a "Finding of No Signifi-
cant Effect on the Environment" for the
above project was published December
27, 1985 in the Dubuque Telegraph
Herald, a newspaper of general circula-
tion and provided for a public comment
period until 12:00 Noon on Monday,
January 13, 1986; and
WHEREAS, public notice of a "Fin-
ding of No Significant Effect on the Eh-
vironment' for the project was sent by
regular marl to various federal, state and
local public agencies and to local news
media, individuals and groups known to
be interested and believed to be ap-
propriate to receive such a public notice;
and
WHEREAS, any and all objections,
if any, to such proposal has been duly
considered; and
WHEREAS, it is the intent of the Ci-
ty Council to authorize the submission
of a request to the U.S. Department of
Housing and Urban Development for
the release of funds to carry out the
above-identified project.
NOW, THEREFORE, BE IT
RESOLVED BY THE CITY COUN-
CIL OF THE CITY OF DUBUQUE,
IOWA:
Section 1. That the Environmental
Review Record for the project shall con-
tinue to remain on file in the Office of

directed to submit to the U.S. Depart-
ment of Housing and Urban Develop-

approved and adopted.
That there be, and is hereby assessed
and levied as a special tax against and
upon each of the lots, the respective
sums indicated. Provided, further, that
the amounts shown ia said final schedule
of assessments as deficiencies are found
to be proper and are levied conditional-
ly against the respective properties
benefited by the improvements as
shown in the schedule, subject to the
)rovisians of Section 384.63, Code of
Iowa. Said assessments against said lots
are hereby declared to be in proportion
to the special benefits conferred and not
in excess of twenty4ive percent of the

Assesmente of 550.00 or more are
payable in 10 equal annual installments,

pose TO CONSIDER A RESOLUTION
AUTHORIZING APPLICATION
FOR RISE FUNDS FOR COMPLE-
TION OF NORTHWEST ARTERIAL
AND AUTHORIZING MAYOR TO
EXECUTE.
RESOLUTION NO. 23-86
RESOLUTION AUTHORIZING AP-
PLICATION FOR RISE FUNDS FOR
THE COMPLETION OF THE NORTH-
WEST ARTERIAL.
WHEREAS, there is a need to com-
plete the Northwest Arterial from
Asbury Road to U.S. 52/U.S. 3; and
WHEREAS, the completed highway
facility would enhance opportunities for
economic development on the westerly
and northerly sectors of Dubuque; and
WHEREAS, this transportation
arterial will facilitate tourists visiting
the Little Maquoketa River Mounds, the
Heritage Trail, and the Dubuque Ar-
boretum; and
WHEREAS, completion of this
arterial would relieve overloaded traffic
conditions on the primary system in the
City of Dubuque; and
WHEREAS, the County of Dubuque
has pledged to join the City in suppor-
ting the project and utilization of RISE
funds allocated to counties.
NOW, THEREFORE, BE IT
RESOLVED by the City Council of the
City of Dubuque, Iowa:
Section 1. That an application be sub-
mitred to the lowa Department of
7~ansporta~on for a grant of SZ5 million
of RISE funds to be used over a three
year period, fiscal year 1987 through
fiscal year 1990.
Section 2. That the City endorses the
portunities for economic development in
the area.
Section 3. That this improvement will
be classified as a major arterial and will
be available for public use.
Section 4. That the City of Dubuque
will assume all responsibilities
associated for the maintenance of the
facility within the City of Dubuque on
its completion.
Section 5. That the Mayor is authoriz-
ed and directed to sign a RISE applica-
lion for local development funding and
to forward application to the Iowa
Department of Transportation.
