PROCLAMATIONS: Week of September 1-6 as "Union Label Week" received by Mary Ann Specht; Sept. 17, 1987 as "United States Constitution Day". Mayor Brady swore in Loras Klueener as "Mayor pro-Tern". Council Members Krieg and Manning entered the chambers at 7:34 P.M. Council Member Kluesner moved to suspend the rules to let anyone present address the Council if they so desire. RESOLUTION NO. 202-86 WHEREAS, pursuant to Resolution and published notice of time and place of hearing, published in the Telegraph Herald, a newspaper of general circula- tion, published in the City of Dubuque, Iowa, on August 22, 1986, the City Council of the City of Dubuque, Iowa met on September 2, 1986 at 7:30 p.m. in the Public Library Auditorium, 11th and Locust Street, Dubuque, Dubuque County, Iowa to consider the proposal for the sale of real estate described as: Lot 2 in Mt. Carmel Subdivision in the City of Dubuque, Dubuque County, Iowa I to Zephyr Aluminum Products Com- ~ party, Inc.; and ~ WHEREAS, the City Council of the ! B) Lot and BuLk Regulations. Development of land in the ID Insti- tutional District simil be regulated as follows: 1) All buildings, structures and acti- vities shall be located in conformance with the attached amended Conceptual Development Plan and all final site levelopment plans shall be approved in accordance with the provisions of the ID Institutional District regulations as provided in the Zoning Ordinance of the City of Dubuque, Iowa. 2) The maalmum building size for the student housing will be an eight- plex with a maximum building height of two stories and twenty-five feet. Additional Standards. 1) The off-street parking require- ment for the principal permitted uses for the herein described ID Institu- tional District shall be designated by a bracket enclosed number next to the use, as herein described: 9) 1.5 spaces for each dwelbng unit. 11) Two spaces for each dwelling unit. 14) One space for each four hundi'ed square feet devoted to office use or one space for each employee on the maxi- mum shift, whichever is greater. 7) One space for each fora' perma- nent seats. 13) One space for each five hun&ed square feet of floor area accessible to ~he general public. 45) Dormitories - one space for each bed. Gymnasiums - one space for each six permanent seats. Lecture halls - one space for each six permanent seats. TAXICABS DIVISION L GENERALLY "Sec. 38-16. Definitions. (j) Waiting time means the time when a taxicab is not in motion from the time of acceptance of a passenger or passengers to the ti~ne of discharge, but does not include any time that the taxicab is not in motion if due to any cause ot%r than the request, act or fault of a passenger or passengers. Sec. g8-17. Taxicab service. All persons engaged in the taxicab business in the city shall render an overall service to the public desiring to use taxicabs. Holders of operator permits shall maintain a central place of business and shall answer all calls received by them for services inside the corporate limits of the city as soon as they can do so; ff said services cannot be rendered within a reasonable time, they shall then notify the prospective passengers how long it will be before she said call can be answered and give the reason therefor. Any holder who shall refuse to accept a call anywhere in the city at any time when such l~dider has av~dlable cabs, or who shall fail or refuse to give overall service, shall be deemed a violator of this arti- cle and the permit granted to such holder shall be subject to revocation or face of the taximeter shall be illumin- ated. Sec. 3849. Rates. (a) The operator shall fix and estab- lish rates and chm'ges for the trans- vn~:hin the city limits fro' the following services: 1) one passenger; (2) two or more passengers, same points of origin and destination, for related groups and unrelated groups; (3) two or more passengers, same points of origin but different destlna- tions; (4) various points of origin and desti- nation; (5) extra luggage; and (6) waiting sharges. (b) No driver shall permit any other person to occupy or ride in said taxi- cab, unless the person or persons first employing the taxicab shall consent to the acceptance of additional passenger or passengers. ' d (c) A copy of the operator s rates an charges shall be placed on file w~th the City Clerk and no increase and/or decrease of sucl~ rates and charges shall become effective until ten (10) days after such change or changes is placed on file with the City Clerk and published at least one time at the oper- ator's expense in a newspaper of gem eral circulation in the city. Sec. 38-20. Issuance of receipts. The driver of any taxicab shall upon request, furnish any passengm' a receipt for the amount charged, either by a mechaaically printed receipt or by a specially prepared receipt, on which shall be shown the name of the taxicab operator, the driver's name and license number, the taxicab license number, the date and the items for which ct~m'ges are made, Sec. 38-21 Refusal of passenger to pay legal fare. It shall be unlawful for any person to ret~tse to pay the legal fare after h~vi.g hired the taxicab, and it shall 353 Regular Session, September 15, 1986 authorized and empowered to establish open stands in such place or places upon tire streets of the city as deemed necessary for the use of taxicabs o.erated in the city. Drivers shall stay within five feet of their cabs and shall not engage in loud or boisterous talk while at an open stand· Nothing in this artlcle shall be construed as preventing a passenger from boarding the cab of the passenger's choice that is pm'ked at open stands. ~ec. 38-2g. (a) Every driver shall maintain a daily manifest upon which are recorded all trips made each day, showing time and place of origin and destination of each trip and amount of fare and all such completed manifests shall be returned to the owner by the ddrlver at the con- clusion of the tour of duty. The forms for each manifest shall be furnished to the driver by the owner. (b) Every holder of an operator per- mit shall retain and preserve ali driv- ers' manifests in a safe place for at least the calendar year next preceding the current calendar year, and said mmfifests shall be open to inspection by the Police Department. (a) As a condition to granting the taxi- cab operator permit required under this division, the person seeking such permit shall file in the office of the City Clerk, a Certificate of Insurance for a motor vehicle operator liability insurance policy, issued by a company authorized to do business in the state, on a form to be approved by the Cot- poratlan Counsel· (b) The minimum lhnits of such pol- icy shall be as follows: (1) To cover the assured's liability for personal injury or death of one person, as the result of one accident, or other cause, one hundred thousand dollars ($100,~00.00). Such fees shall be for one year starting April first and shall be in addition to any other license fees or chm'ges established by proper authority and applicable to such holder and the vehicle or vehicles under the holder's operation and con- t~'ol. Sec. 38-36.
