Mayor Brady read the call and stated
this is the REGULAR MONTHLY
MEETING of the City Council called for
the purpose to act upon such business
which may properly come before the
Council.

Thexe was a signing of a Protocol
Agreement between the City of Du-
buque, IA and Pyatigorsk, District of
Stavropol, USSR. Bob Wild, of Dubuque,
spoke and coordinated the signing.

rules be suspended to allow anyone pre-
sent to address the Council, Seconded by

SEWER
WHEREAS, the City Coundfl has pre-
posed a Resolution of Necessity for the
Construction of G'fllespie Sanitary Sewer,
has given notice of the public hearing
thereon as required by law; and
WHEREAS, the public hearing has
been held, all persons offering objections
have been heard and consideration given
to all objections and is pending before
this Conncil; and
WHEREAS, this is the time and place
set as provided for the taking of action
on the proposed Resohiffmn of Necessity.
NOW, THEREFORE, BE IT RE-
SOLVED BY THE CIq~ COUNCIL OF
THE CITY OF DUBUQUE, IOWA AS

RESOLUTION ADOPTING
PLANS AND SPECIFICATIONS
WHEREAS, on the 1st day of
February, 1989, plans, specifications,
form of contract and estimated cost were
filed with the City Clerk of Dubuque,
Iowa, for the Construction of Glilespie
Street Sanitary Sewer; and
WHEREAS, notice of hearing on
plans, specifications, form of contract,
and estimated cost was published as re-
quired by law.
NOW, THEREFORE. BE IT RE-

That the Construction of Gillespie
Street Sm~itary Sewer is hereby ordered
to be advertised for bids for construction.
BE IT FURTHER RESOLVED, that
the mount of the security to accompany
each bid shall be in 'an mnount winch
shall conform to the provisions of the
notice to bidders hereby approved as a
part of the plans and specifications
heretofore adopted.
That the City Clerk is hereby directed
to advertise for bids for the construction
of the improvemente herein provided, to
be published in a newspaper having
generai circulation in the City of Du-
buque, Iowa, winch notice shall not be
less than four days nor more than twen-
ty days prior to the receipt of said bids
at 2:00 p.m. on the 14th day of March,
1989. Bids shall be opened and read by
the City Clerk at said time and will be
sub~ditted to the Council for final action
at 7:30 p.m. on the 20th day of March,

hereinafter described property from R-1
Single-Family Residential District to OR
Office Residential District with condi-
tions, to wit:
Lot I of Lot 7, Lot 2 of Lot 7, Lot
1 of Lot 6, Lot 2 of Lot 6, Lot 1
of Lot 5 and Lot 2 of Lot 5, all in
Block 3, Johansen Subdivision
No. 1; and to the center line of the
adjoining public right-of-way, all
in the City of Dubuque, Iowa.
Section 2. That the above-described
reclassification to OR Office Residential
District shall include the hereinafter
described condition to which the proper-
ty owners, Robert Lundin and Dan Boge,
and the applicant, Dominic Goodmann
have agreed to in writing prior to the
public hearing;
(A) A six-foot screening of live
plant material be established on
the westerly boundary.
Section 3. That the foregoing amend-
ment has heretofore been approved by
the Planning and Zoning Commission of
the City of Dubuque. Iowa.
Section 4. That the Mayor and City
Clerk of the City of Dubuque, Io~a shall
certify and file this ordinance, after its
passage, with the County Recorder of

WHEREAS, Dubuque In-Faturo, Inc.,
has flied an application for reclassifica-
tion from AG Agricultural to PI Planned
Industrial District and has also filed a
conceptual development plan for certain
properties hereinafter described in accor-
dance with provisions of the PI Planned
Industrial District regulations as set
forth in Section 3-4.3 of the Code of Or-
dlnances, Appendix A thereof, of the City
of Dubuque, Iowa; and
WHEREAS, the Planning and Zoning
Commission has held a public hearing on
said application for zoning reclassifica-
tion and conceptual development plan
pursuant to required published notice;
and
WHEREAS. the Plauning and Zoning
Commission has approved said applica-
tion for zoning reclassification and ap-
proval of said conceptual development
plan subject to specific conditions and
restrictions having found that said plan
conforms with the review standards ap-
plicable to such plans as set forth in Sec-
tion 3-4.3D(4) of the Code of Ordinances,
Appendix A thereof, of the City of Du-
buque, Iowa; and
WHEREAS, the Plauning and Zoning
Commission recommended the concur-
rence of the City Council and approval
of said application for zoning reclassifica-
tion and said conceptual development
plan; and
WHEREAS, the City Comicil h~s held
a public hearing on said conceptual
development plan and said application
for zoning reclassification pursuant to re-
quired published notice; and
WHEREAS, the City Council has ap-
proved said conceptual development plan
and said application for zoning
reclassification subject to the same
specific conditions and restrictions:

B. Accessory Uses,

C. Site Development.
Development of land in this PI Planned
Industrial District shall be regulated by
the attached document entitled "Condi-
tions of Development and Operation,
Dubuque Industrial Center -- Phase II".
The development of each lot is regulated
~ the standards for each as shown on

The development, operation and
~aintenance of uses in the district shall
be conducted in conformance with the
standards and regulations of the PI
Planned Industrial District.
D. Time Limitation.
The conceptual development plan will be
valid for a period of five years provided

ted within two years from the date of
approval.
E. Transfer of Ownership.
Transfer of ownership or lease of proper-
ty in this PI Planned Industrial District
shall include in the transfer or lease
agreement a provision that the purchaser
or leasee acknowledges awareness of the

of this district.

WHEREAS, pursuant to resolution
and published notice of time and place of
hearing, published in the Telegraph
Herald, a newspaper of general circula-
tion published in the City of Dubuque,
Iowa on the 25th day of February, 1989,
the City Council of the City of Dubuque,
Iowa met on the 6th day of March, 1989,
at 7:30 p.m. in the Public Library
Auditorium, 11th & Locust, Dubuque,
Dubuque County, Iowa to consider the
proposal for the sale of real estate
described as:

Lot 60A of Ham's Addition in the
City of Dubuque, Iowa to Barn-
stead Thermolyne Corporation
and Lot 60B of Ham's Addition

Section 1. That the disposal of the in-
terest of the City of Dubuque, Dubuque
County, Iowa in real property described
as Lot 60A of Hmn's Addition in the City
of Dubuque, Iowa to Barnstead Ther-
molyne Corporation and Lot 60B of
Ham's Addition in the City of Dubuque,
Iowa to Mr. & Mrs. Richard J. Kelly be
and the same is hereby approved for the
sum of $500.00 plus cost of publication
and filing fees; conveyance shall be by
Quit Claim Deed.
Section 2. That the Mayor be author-
ized and directed to execute a Quit Claim
Deed, and the City Clerk be and is hereby
directed and authorized to deliver said
deed of conveyance to the above nmned
grantee upon receipt of the purchase
price in full.
Section 3. That the City Clerk be and
is hereby authorized and directed to
record a certified copy of this Resolution
in the Office of the City Assessor. Du-
buque County Recorder and the Du-
buque County Treasurer.

WHEREAS, Iowa Rails to Trails:
Heritage Trail, Inc. has successfully

developed a recreational trail along the
right-of-way of the abandoned Chicago
Great Western Railroad; and
WHEREAS, the Dubuque County
Historical Society has been actively in-
volved in the development of the Ice Har-
bor as a destination point for Dubuque's
growing tourism industry; and
WHEREAS, the Iowa Department of
Transportation's Recreational Trails Pre-
gram has funds available for the
establishment of recreational trails for
the use, enjoyment and participation of
the public; and
WHEREAS, Heritvge Trail, Inc. and
the Dubuque County Historie Society
wish to e~hance the city's existing recrea-
tlonal opportunities through the exten-
sion of the Heritage Trail and the
development of a recreational trail along
,he shoreline of the Ice Harbor; and
WHEREAS. the City of Dubuque
agrees that the extension of Heritage
Trail between 32nd and 24th streets is
a high priority; and
WHEREAS, the City of Dubuque
recognizes the commercial and recrea-
tional potential of the Ice Harbor and has
identified the development of the area as
a top priority; and
WHEREAS, the Iowa Department of
Transportation has asked that the City
provide assurance that once developed,
the proposed trail will be adequataly
maintained as a trail for a period of twen-
ty years except as provided by the Iowa
½tare Transportation Commission; and
NOW, THEREFORE, BE IT RE-
SOLVED BY THE CITY COUNCIL OF
THE CITY OF DUBUQUE, IOWA:
Section 1. That the Mayor and City
Clerk be and they are hereby authorized
and directed to submit a joint Recrea-
tional Trail Program application to the
Iowa Dopartment of Transportation on
behalf of Rails to Trails: Heritage Trail.
Inc. and the Dubuque County Historical
Society.
Section 2. That in the event said ap-
plication is approved, the City Manager
is hereby authorized to negotiate
maintenance agreements with the Du-
buque County Conservation Board and
the Dubuque County Historical Society
to ensure that tbe proposed trails will be

trails for a period of not less than twen-
ty (20) years or until such time as the

A NEW RESOLUTION AUTHORIZ-
ING THE MAYOR TO EXECUTE AN
APPLICATION TO PARTICIPATE
IN THE SECTION 8 HOUSING
VOUCHER PROGRAM.
WHEREAS, the City of Dubuque
recognizes the continuing unme~ need for
provision of assisted housing to the
City's qualifying lower-income
households and families; and
WHEREAS, the U.S. Department of
Housing and Urban Development has in-
vlted the City to make application for
additional Section 8 Housing Voucher
Program funds; and
WHEREAS, and in accordance with
Section 403A.5 of the Iowa Code which
states
"A municipality or a 'Municipal
Housing Agency' may not proceed
with a housing project until a
study or a report and recommen-
dation on hous'mg available within
the community is made public by
the municipality or agency and is
included in its recommendations
for a housing project. Recommen-
dations must receive majority ap-
proval from the l~cai governing
body before proceeding on the
housing project."
AND IN ACCORDANCE WITH
Section 213(c) of the Housing and
Community Development Act of
1974, which states in part that we
must determine whether or not
there is a need for such housing
assistance, taking into considera-
tion any applicable State or
areawide housing assistance plan
as well as generally available data
with respect to population, pover-
ty, housing overcrowding, housing
vacancies and substandard hous-
ing. An application may be
proved only if o~cc determination
is in the affirmative; and
WHEREAS, this application is consis-
tent with the 1988-91 Housing Assist-
ance Plan for the City of Dubuque as ap-
proved by the HUD Area Office in
December, 1988.
NOW, THEREFORE, BE IT RE-
SOLVED BY THE CITY COUNCIL OF
THE CITY OF DUBUQUE, IOWA:
Section 1. That the City of Dubuque
has determined there is a need for addl-
tional housing assistance and is
knowledgeable of the status of available
housing within the City as required by
Iowa Code and that majority approval of
the proposed housing activity within the
City's jurisdiction is hereby grauted.

Section 2. That this resolution is in-
tended to s~rve as the City of Dubuque's
final notice to the U.S. Department of
HouEmg and Urban Development of such

U.S. Department of Housing and Urban
Development for participation in the Sec-
tion 8 Housing Voucher Program.
Section 4. The City of Dubuque Hous-
ing Commission is hereby directed to con-

garding this application as soon as possi-
ble in accordance with requirements of
Chapter 403.A.28 of the Code of Iowa,

WHEREAS, the City of Dubuque,
Iowa in conformance with the En-
viromnental Review Procedures for the
Community Development Block Grant
Program convened an Ad Hoc Commit-
toe on January 3, 1989 which completed
an environmental assessment of the
following identified project:

ware Project.
WHEREAS, pursuant to Resolution
No. 74-89, adopted February 20, 1989,
public notice of a Finding of No Sigdifi-
cant Effect on the Environment" for the
above project was published February
22, 1989 in the Dubuque Telegraph
Herald, a newspaper of general circula-
tion and provided for a public comment
period until 12:00 Noon on Friday, March
10, 1989; and
WHEREAS, public notice of a Finding
of No Significant Effect on the Environ-
ment for the project was sent by regular
mail to various federal, state and local
public agencies and to local news media,
individuals and groups known to be in-
terested and believed to be appropriate
to receive such a public notice; and
WHEREAS, any and all objections, if
any, to such proposal has been duly con-
sidered; and
WHEREAS, it is the intent of the City
Council to authorize the submission of a
request to the U.S. Department of Hous-
ing and Urban Development for the
release of funds to carry out the above-
identified project.
NOW, THEREFORE, BE IT
SOLVED BY THE CITY COUNCIL OF
THE CITY OF DUBUQUE, IOWA:
Section 1. That the Environmental
Review Record for the project shall con-

directed to submit to the U.S. Depart-
teent of Housing and Urban Develop-
ment, a Request for Release of Funds in
the amount of $80,000.00 to undertake

sent to assume the status of a responsi-
ble federal official under the National En-
vironmental Protection Act, insofar as
the provisions of the said Act apply to

WHEREAS, there has been filed with
the City Clerk a final plat of Embassy
West No. 2 in the City of Dubuque, Iowa;

WHEREAS, upon said final plat ap-
pear streets to be known as Embassy
West Drive, Camelot Drive and Colonel
Drive, together with certain public utili-
ty easements which the owners by said
plat have dedicated to the public forever

WHEREAS, pursuant to notice
published as required by law, tkis Coun-
cil has held a public meeting and hear-
ing upon the proposal to institute
proceedings for the issuance of
$4,000,000 General Obligation Bonds for
the essential corporate purpose of pay-
ing costs of construction, reconstruction
and repairing of street improvements;
construction, reconstruction, extension
and ilnprovement of works and facilities
useful for the collection and disposal of
surface waters and streams; reconstruc-
tion, extension, and improvement of an
existing airport and acquisition, installa-
tion and repair of traffic control devices,
and has considered the extent of objec-
tions received from residents or proper-
ty owners as to said proposed issuance
of bonds; and, accordingly the following
action is now considered to be in the best
interests of the City and residents
thereof:
NOW, THEREFORE. BE IT RE-
SOLVED BY THE CITY COUNCIL OF
THE CITY OF DUBUQUE, IOWA:
Section 1, That this Cotmcil does
hereby institute proceedings and takes
additional action for the sale and issuance
in the manner required by law of

directed to proceed on behalf of the City
with the sale of the said bonds, to salect
a date for the sale thereof, to cause to be

WHEREAS, a reconmaaqded five year
Capital Improvement pragram for the
period beginning July 1, 1989 and ending
June 30, 1994 for the City of Dubuque
has been prepared and submitted to the
City Council; and
WHEREAS, the five year Capital Im-
provement Program:
(1) describes specific capital improve-
ment projects;
(2) provides estimated costs fur those
projects;
(3) proposes sources of funds for each
of them; and
(4) schedules the year during which
each project will be undertaken; and

projects for the first year are included in
the Fiscal Year 1990 budget for the City
of Dubuque; and
WHEREAS, the five year Capital Im-

year Capital Improvement Program is a
prudent measure to provide continuity of
programs and is in the best interest of
the City of Dubuque.

Section 1. Tke Code of Ordinances of
the City of Dubuque, Iowa is hereby
amended by repealing Section 17-36.
Section 2. The Code of Ordinances of
the City of Dubuque, Iowa is hereby
amended by adopting the following new

Section 17-36. Charges-Amounts;
Exceptions
(a) Class I premises. Except as
qualified below, a fee of four dollars and
fifty cents ($4.50) per month shall be
charged by the City and collected from
each property owner of a class I premises
for such services effective July 1, 1989.
Said charges or fee shall be in payment
for collection and disposal of garbage wad
refuse as defined. Exceptions to the col-
lection charges for class I pre~nises are
as follows:
(1) When a class I premises has
been vacant for a porit~d of thi'ee (3) con-
secutive months or longer, tbe owner
may apply for a credit under procedures
to be established by the City Manager.
Such exemptions shall continue only so
long as the class I premises is vacm~t.
(2) Class I premises when the head
of the household is sixty-five (65) years
or older and with a per fumily income of
ten thousand nine hundred dollars
($10,900.00) or less, may, upon applica-
tion of the owner be exempted from one-
half the established collection charge.
Subsequent to initial application and
eligibility, annual application must be
made on July first of each year to verify
annual income and ellgibifity.
(3) In cases of extreme financial
hardship, the City Manager may, and is
hereby authorized and empowered to,
make adjustments hi the monthly collec-
tion charges.
In such cases, the City Manager
shall have the authority to require such
proof of vacancy, financial status, age or
extreme hardalfip as he/she may deem
necessary.

(b) Class II premises. The City shall
continue to collect f~om class II premises
currently receiving such service. The
charge for such collection service al~all be
based upon the average weekly quanti-
ty of garbage and refuse being collected,
as deter~nined by the City Manager. The
rate charge shall be a multiple of the rate
charged class I premises as follows:
Il) The first one hundred twenty
(120) gallons of garbage and refuse per
week shall be charged the class I
premises rate times one (1).
(2) The second one hundred twen-
ty (120) gallons per week or fraction
thereof shall be charged the class I
premises rate times seventy-five one-
hundredths (0.75).
(3) All addigional units of one hun-
dred twenty (120) gallons per week or
fraction thereof shall be charged the class
I premises rate times five-tenths (0.5).
The owner of a class II premises
no longer wishing to be served by City
garbage and refuse collectinn shall pro-
vide the City with thirty (30) days writ-
ten notice of the intent to terminate the
service. Such termination of service shall
be effective with the next billing period.
Section 3. The City Clerk is directed to
publish this Ordinance as provided by
Iowa Code Section 380.7.
Section 4. This ordinance shall take ef~

b. Commencing with all billings on

charged for water supplied by the City
Water Division to residential, commer-
cial, industrial and other uses and pur-
poses by any person, firm or corporation,
outside the corporation limits of the City
of Dubuque, Iowa. shall be at one hun-
dred fifty percent (150%1 of the rates set
forth herein above.
c. For all meters in service, bills will
be issued monthly. When a meter is not
read monthly for any reason, bills will be
issued on estimated consumption. For
estimated billings, either on alternate
months or when readings are not ob-
t alnshle for any reason, consumption will
be predicated on the monthly average of
past usage for the meter. For estimated
bills issued for an account in which
historical data is not available, billing will
be predicated on the minimum charge
and related consumption identified for
the size of the meter in service for the
particular account.
d. Adjustmente from estimated
readings will be made when au actual
meter reading is obtained. The adjust-
ment will be reflected on the user's next
regular bill.
Section 3. The City Clerk is hereby
directed to publish this Ordinance as pro-
vided by Iowa Code Section 380.07.

Section 2. The Code of Ordinances of
the City of Dubuque, Iowa, is amended
by adopting the following new Section:
Section 36-56. Established.
a. Commencing with all billings on
and after July 1, 1989. contributors
whose property lies within tlie corporate
limits of the city, except as otherwise pro-
vided in tins division, shall pay to the city
through its collection agent at its office
at tlie same time payment for water set-
vices is made, a sewer service charge
computed on water consumption on the
following rates:
1. Basic Charges. The sewer rates
and charges shall be based on the quan-
tity of water used on or in the property
or premises. For all customers utilizing
sewer service, bills will be issued month-
ly. When a water meter is not read
monthly for any reason, bills will be
issued on estimated consumption. For
'estimated billings, either on alternate
meter is not obtainable for any reason,
consumption will be predicated on the
monthly average of the past usage for the
metered account. For estimated bills
issued for an account in which historical
data is not available, billing will be
predicated on the minimum charge and
related consumption idenfifiad in subsec-
tion (c)(7) for the size of the water meter
iix service for the particular account.
2. Schedule of Rates. Rate per
month per each 100 cubic feet is $1.44.
3. Service Charge.
(1) When a parcel of real estate
property or building, discharging
sanitary ~ewage, industrial wastes, water
or other approved waste, either directly
or ~directly into the city's sanitary sewer
system, is not a user of water supplied
by the city water division and the water
used thereon or therein is not acceptable
to the city, the amount of water used
shall be determined by the city in such
a manner as the city manager may elect
to establish the rate of charge as provid-
ed in this division, or the owner or other
interested parties at their expenses, may
install and maintain a meter acceptable
to the city for said purposes.
(2) When a parcel of real estate
property' or building, discharging
sanitary sewage, industrial wastes, water
or other approved waste, aither directly
or indirectly into the city's sanitary sewer
system, is a user of water supplied by the
city water division and in additio~ uses
water from another source which is not
measured by a water meter or is meas-
ured by a water meter not acceptable to
the city, the amount of water used shall
be determined by the city in such a man-
ner as the city manager may elect in
order to establish the rate of charge as
provided in this division, or the owner or
other interested parties at their expense
may install and maintain a meter accep-
table to the city for said purposes.
(3) When a parcel of real estate,
property or building, discharging
sanitary sewage, industrial wastes, water
or other approved waste either directly
or indirectly into the city's sanitary sewer
system, is not a user of water supplied
by the city water division, the amount of
sanitary sewage, industrial wastes, water
or other approved waste discharged in-
to the sanitary sewer system shall be
determined by the city in such a manner
as tlie city manager may elect in order
to establish the rate of charge as provid-
ed in this division, or the owner or other
interested parties at their expense, may
install and maintain a sewage meter ac-
ceptaffle to the city for said purposes.
(4) The city council may, in its
discretion, when applicable, permit con-
nection to the elty sanitary sewer system
of properties located outside the corpora-
tion limits upon suci~ terms and condi-
tions as it may establish; provided,
however, that such terms shall not be
more favorable to such property than
rates herein establislied for city users.
(5) In order that the rates and
charges may be modestly and equitably
adjusted to the service rendered, the aity
shall have the riglit to base its charges
not only on volume, but also on the
strength and character of the user. The
city shall have the right to measure and
determine the strength and content of ail
sewage and wastes discharged either
directly or indirectly into the city's
sanitary sewage system, in such manner
and by such metlieds as it may deem
practicable in the light of the conditions
and circumstances of the case in order to
letermine the proper charge.
Extra charges will be appli-
:able and negotiated with users on an

individual account basis when concentra-
tion of the sewage exceeds three hundred
(300) milllgeams per liter of biochemical
oxygen demand, thiee hundred fifty (350)
milligrams per liter of suspended solids
or two (2) percent or more of the flow rate
into the sewage treatment plant.
(6) The rates and charges may be
billed the tenant and tenants occupying
the properties served, unless otherwise
requested in writing by the owners, but
such billings, shall in no way relieve the
owner from liab'dity in the event payment
is not made as required in this division.
Where the quantity of water
consumed is such that the minimum
water service is charged, the minimum
sewer service charge, according to the
size of the meter, shall be as follows:

No person shall discharge, or cause to be
discharged, any storm water, surface
water, ground water, roof runoff, subsur-
face drainage, including interior and ex-
terior foundation drahas, floor drains used
for collecting storm water, uncon-
taminated cooling water, or unpolluted
industrial process waters, to any sanitary
sewer. This section shall be constraed to
prohibit such discharge to any sanitary
sewer from sump pumps or sump pump
connections, and no person shall install,
cause to be installed, or permit to be in-
stalled any sump pump or sump pump
connection that discharges or causes such
discharge to any sanitary sewer.
Section 3. This ordinance shall take ef-
fect immediately upon publication as pro-
vided by law.

or female, and six dollars ($6.00)
for each male or female cat not
neutered. For licenses valid on and
after July 1, 1989, the license fee
per calendar year, or fraction
thereof, shall be seven dollars
($7.00) for each neutered cat,
either male or female, and twelve
dollars ($12.00) for each male or
female cat not neutered.
Section 3. The City Clerk is hereby
directed to publish a copy of this Or-
dinance as provided by Iowa Code Sec-
tion 380.7.
Section 4. This Ordinance shall toke ef-
fect upon publication.

response to a citizens' petition (lid re-

sion to study the regulations relating to
billboards and to make its recommenda-
tion to the City Council for Zoning Or-
dinance amendments; and
WHEREAS, the planning and Zoning
Commission has formed a Freeway Plan-
ning Committee to study the Freeway

tunities, appropriate reuse of vacant and

compatible land uses along and adjacent
to the corridor.
WHEREAS, the Cominission has com-

the Commission and the City Council a
reasonable period of time to study the
issues of Freeway Corridor Planning.

Section 1. That Section 3-64, Division
3, Article 3, Chapter 3, of the Code of Or-
dinances be amended by adding thereto
the following new paragraph:
"No pern~it for an off-premise
sign, as defined in Subsection 4-3
of the Zoning Ordinance, within
the Freeway Corridor area as
shown on the attached map, shall
be issued by the building official
from the date of the adoption oI
this Ordinance for a period of six
months thereafter. The morator-
ium provided for herein shall not
be construed to deprive any per-
son, firm, or corporation of vested
right which such person, firm, or
corporation may have acquired as
a matter of law for the construc-
tion of an off-premise sign as of
the effective date of the adoption
of this ordinance. Any person,
firm. or corporation aggrieved by
or adversely affected by the
building official's refusal to issue
a permit for the construction of an
off-premise sign pursuant to this
moratorium shall appeal there-
from to the City Council of the
City of Dubuque."

WHEREAS, Ed Tschiggfrie,
developer of Birch Acres, has requested
the City to secure two easements across
a third person's property in order to serve
Birch Acres, a subdivision which has
been under development since 1978; and
WHEREAS, the developer has dis-
posed of the land across which the
easements would be located, but the
surveyor in the course of preparing the
plat for disposition of this land failed to
reserve the necessary sanitary
easements; and
WHEREAS, the developer has not
been able to negotiate a satisfactory
agreement with the third party for ac-
quisition fur these easements; and
WHEREAS. it is in the interest of the
City to have expausion of Birch Acres be
served by the gravity type sanitary
systems rather than lift stations; and
WHEREAS, there is drawings and
records to indicate that the long range
plans for servicing this area was by
means of a gravity type sanitary sewers
from the subdivision to the main trunk
line of the City along Catfish Creek.
