Council met at 8:30 p. m.
Mayor Saul in the chair.
Present—Aids. Callahan, Frith,
Leist, McLaughlin, Plamondon, Stro-
bel, Wallis.
Ald. Wallis moved to take from the
committee of the whole the bids for
the improvements of Pfohl street and
Ungs street and act on them in the
council meeting. Carried.
Ald. Wallis moved to award the
contracts for the improving of Pfohl
street and for the improving of Ungs
streets to J. M. Kenety & Son, they
being the lowest bidders and their
bond placed at one - fourth the amount
of the contracts. Carried.
Ald. Wallis moved to suspend the
rules for the purpose of allowing Mr.
Irwin, professor at the high school, to
address the council. Carried by the
following vote:

Wallis.
Nays None.
Mr. Irwin addressed the council
asking for permission to use the Ar-
mory hall for basketball practice for
the high school students. Ald. Mc-
Laughlin moved that the high school
students be granted permission to use
the Armory hall for basketball prac-
tice Monday and Tuesday afternoons
until the Governor Greys return and
after that date the high school to
make arrangements with the Gover-
nor Greys for the use of the Armory
hall. Carried.
BIDS.
Bids for furnishing counters in
the office of the city treasurer, city
auditor and city recorder. Bid of
Geo. A. Kampmann, furnish and in-
stall fixtures in the offices of the city
treasurer, city auditor and city re-
corder for the sum of $605.00. Bid
of 11. Herrmann & Sons, furnish and
install fixtures in the offices of the
city treasurer and city auditor for the
sum of $350.00.

Petition of Dubuque Real Estate
Board asking the city council to have
all city offices open continuously from
9 a. in. on and not be allowed to close
for the dinner hours presented and
read. On motion of Ald. Leist the
petition was referred to the commit-
tee of the whole.
Petition of Edward Farrell, driver
of the city ambulance, asking the
city council to have his position taken
from the control of the board of
health and that he placed upon • ciVil
service rules and regulations and that
he be enrolled as a member of the
fire department and paid out of the
fire fund presented and read. On
motion of Ald. Leist the prayer of the
petitioner was granted.
Petition of Kretschmer Mfg. Co.,
per Fred Kretschmer, asking the city
council to place the valuation on their
property for the years 1912, 1913,
1914, 1915 and 1916 at $5,000.00 ac-
cording to ordinance passed by the
city council in February, 1912, pre-
sented and read. On motion of Ald.
Frith the petition was referred to the
committee of the whole.
Communication of the League of
Iowa Municipalitiek asking the city
council to pay a sum of money suffi-
cient to give the legislative committee
the necessary funds to carry on its
work before the state legislature pre-
sented and read. Ald. Frith moved to
refer the communication to the com-
mittee of the whole. Ald. Wallis
amended Ald. Frith's motion to grant
the prayer of the , communication.
Carried by the following vote:

Nays —Ald. Frith.
Petition of A. E. Gmehle asking the
city council to re- appoint him the col-
lector of delinquent personal taxes for
the year 1915 and prior at 15 per cent
commission presented and read. On
motion of Ald. Callahan the prayer of
the petitioner was granted.
Ald. Wallis moved that a. warrant
in the sum of $20.00 be ordered drawn
on the city treasurer in favor the
League of Iowa Municipalities as the
city of Dubuque's share toward the
work of the legislative committee.

Petition of H. B. Spensley asking
to have his remonstrance withdrawn
against the improvement of Fourth
street from Main street to Locust
street presented and read. On mo-
tion of Ald. McLaughlin the petition
was made a matter of record.
Petition of Mary Klee asking the
city council to reduce the assessment
against lot 14 Sister's Add., presented

and read. On motion of Ald. Mc-
Laughlin the petition was referred to
the committee of the whole to view
the grounds.
Petition of Nettie Blake, by Mul-
lany and Stewart, her attorneys, rela-
tive to an incorrect and excessive as-
sessment levied against lot 1 of lot 7
of Ellen Blake's Add., for the im-
provement of West Locust street pre-
sented and read. On motion of Ald.
Frith the petition was referred to
the city engineer to report back to
the city council.
Notice of claim for damages of
Mary McCullough in the sum of $1,-
500.00 for injuries sustained by step-
ping on a defective cover of coal chute
on the south side of Third street be-
tween Main and Locust street present-
ed and read. On motion of Ald. Leist
the notice was referred to the city at-
torney.
Maintenance bonds of N. J. Staner
in the sum of $500.00 per block for
the improvement of North Main street
and in the sum of $100.00 for cement
curb and gutter on Park avenue pre-
sented and read. On motion of Ald.
Wallis the bonds were referred to the
city attoi ney.
Notice of claim of Rellihan and
Mullen in the sum of $200.00 for in-
juries to horse and damages to wagon
on account of defective grate in the
alley between Nevada street and Al-
pine street presented and read. On
motion of Ald. Frith the notice was
referred to the city attorney.
Bond of Fred J. Heller, city assess-
or, presented and read. On motion
of Ald. Frith the bond Was referred
to the city attorney.
Annual report of the Board of
Water Works Trustees for the year
ending May 31, 1916, presented. On
motion of Ald. Frith the report, was
referred to the special auditing com-
mittee appointed by the mayor.
City Recorder Shea presented and
read the notice, certified to by the
publisher's, of the city council's in-
tention to improve Jones street from
the easterly rail of Illinois Central
Railroad company's tracks first west
of Warren street to eighty -five feet
east of the east property line of the
Dubuque Harbor company's addition,
also the written remonstrance of A.
A. Cooper Wagon and Buggy Co., by
A. A. Cooper, Jr. Ald. Plamondon
moved to receive and file the notice
and remonstrance. Ald. Callahan
amended Ald. Plamondon's motion to
receive and file the notice and to re-
fer the, remonstrance to the commit-
tee of the whole to view the grounds.

Gentlemen: I hereby petition your
honorable body to reduce the valua-
tion of Wm. Roehl on his building
from $880.00 to $600.00 for the year
1J15, as the mistake was made by
the Sourer System by placing the
house that belonged to the next lot
on his and W. Roehl's value on the
other, and that the City Treasurer be
instructed accordingly.

Gentlemen: I return herewith Quit
Claim Deed of William P. Slattery
and Anna P. Slattery, his wife, con-
veying to the City of Dubuque a cer-
tain piece of ground now known as
North Nevada Street as indicated on-
a plat of Slattery's Subdivision in the
City of Dubuque, which said plat was
approved by the City Council No-
vember 2, 1916.
I recommend that this be made a
matter of record.

petition of the William Palmer Es-
tate asking that the City of Dubuque
accept the sum of Twenty Dollars
($20.00) as payment, in full, for a
special assessment levied against the
Northerly One -Half of Inlot No. 235.
You are advised that said assess-
ment is now outlawed and uncol-
lectable. I therefore recommend that
the prayer of the petition be granted.

Gentlemen: The petition of Bridget
Casey relative to the payment of
Twenty -Five ($25.00) Dollars in full
settlement of two special assessments
which had been levied against Lot
No. 9 in O'Neil's Addition No. 2, said
assessments being levied in 1894 and
1897 and amounting to Forty -Nine
and 22 -100 ($49.22) Dollars.
Under the facts as stated, and
which have been verified by City
Treasurer Wybrant, I would recom-
mend that the Council accept the
proposition of the petitioner and
cancel the tax upon the payment of
the amount stated in said petition.

report of the City Attorney was ap-

Gentlemen: In reply to attached
petition of Margaret H. Connolly rel-
ative to assessment on West Locust
Street I find that the city owns a cor-
ner of this lot which was purchased
for Union Avenue and was included
in this assessment. The assessment
against Margaret Connolly Lot 1
Mosher's Sub. should be $693.05 in-
stead of $751.19. The assessment for
the part of lot 1 Mosher's Sub. owned
by the city should be $58.14.
Would respectfully recommend that
the city treasurer be instructed to
make this change on his hooks.

ners where there are buildings and at
all other points where traffic requires
signs.

by agrees to the reassessment of lots
1 of 1 of 1 of 2 and 2 of 1 of 1 of 2,
Caroline Boxleiter's Sub. of M. L. 160
for the payment for sewer constructed
in West Third street during the year
1916, and agrees further that the city
has the right" to make such reassess-
ment without any formal procedure
on its part; and also hereby waives
any right to object to said assessment
because of reassessment thus made.

Thirty- fourth General Assembly, it is
' hereby determined, that inasmuch as
the tax levy for the present year has
been fixed at fourteen mills, which
levy is based on the assessment on
actual values on a one hundred per
cent basis, it is hereby determined
that the equivalent thereof based upon
a twenty -five per cent (25 per cent),
valuation would be fifty -six (5,6)
mills. It is hereby ordered that the
city recorder shall certify said, ag-
gregate value of 56 `mills to the eoun,
ty treasurer of Dubuque county, Iowa,
for the purpose of computing the pro,-
, portion of the taxes due the city of
Dubuque under said act.

macadam improvement to the east line
of Louisa street be improved by grad-

nation cement curb and gutter and by
macadamizing said portion of said
street, the same in accordance with
the plans and specifications for such
improvement prepared by the city en-
gineer and now on file in the office of
the city recorder, and be it further
Resolved, that said improvement
shall be completed on or before the
1st day of July, 1917, and shall be
paid for in the manner prescribed by
Chapter XXXII, as amended of the
Revised Ordinance of the City of Du-
buque for the payment of the cost of
street improvements.
The proposals for doing said work
shall be acted upon by the council on
the 18th day of January, 1917, and
the city recorder is hereby ordered to
give ten days' notice by publication

Illinois Central Railroad company's
tracks first west of Warren street to
eighty -five feet east of the east prop-
erty line of the Dubuque Harbor com-
pany's Addition be improved by grad-
ing, curbing with new stone curb
where necessary and resetting old
stone curb where necessary, and by
paving said portion of said street with
brick block on a concrete foundation
outside the railroad tracks and with
brick block on a concrete foundation
between the rails and one foot outside
thereof and asphaltic filler to be used,
the same in accordance with the plans
and specifications for such improve-
ment prepared by the city engineer
and now on file in the office of the
city recorder, and be it further
Resolved, that said improvement
shall be completed on or before the
1st day of July, 1917, and shall be
paid for in the manner prescribed by

of the City of Dubuque.
Gentlemen: At the present Janu-
ary term of the District Court the
case of William Hein vs. `City of Du-
buque, was called for trial. This ac-
tion was brought for personal injur-
ies sustained by the plaintiff by rea-
son of a fall upon an icy sidewalk on
West Third street where the same in-
tersects with Nevada street, by reason
of which fall the plaintiff sustained
severe and permanent injuries. The
action was brought to recover die
sum of Two Thousand ($2,000.00)
Dollars. After making a careful in-
vestigation of the claim and all of
the evidence surrounding the same,
it was deemed advisable by us to ef-
fect a reasonable settlement. With
that object in view we have agreed,
subject to your approval, to pay the
plaintiff the sum of Three Hundred
($300.00) Dollars in full settlement
of his case. The proposition has been
accepted by the plaintiff.
If this settlement is satisfactory to
you, you will instruct the city treas-
urer to draw a warrant in the sum of
Three Hundred ($300.00) Dollars and
Make the same payable to P. J. Nel-
son, attorney for the plaintiff.

proposed to grade, curb with new
stone curb where necessary. to reset
old stone curb where necessary and
to curb with new cement curb where
necessary and to pave said portion of
said street with brick block on a con-
crete foundation or with creosote
wood block on a concrete foundation.
or to gutter with an eighteen -inch
cement gutter and to pave said street
with either sheet asphalt on a con-
crete foundation or with bitulithic
pavement on a concrete foundation,
or paving with bitulithic pavement on

to prepare a plat showing generally
the location, nature and extent to the

and South Bluff street from the north
property line of Third street to the
north property line of Dodge street
and the kind or kinds of material or
materials to be used, and an estimate
of the entire cost thereof, and the
amount and cost of such improve-
ment, and the amount assessable up-
on any railway or street railway com-
pany, the amount and cost thereof to
be paid by the city, if any, and the
cost thereof and amount assessable
upon each lot or parcel of land adja-
cent to such improvement as con-
templated by Chapter 76 bf the Laws
df the Thirty -fifth General Assembly
of the State of Iowa and acts amend-
ed thereby, and to file such plat and
estimate in the office of the city re-
corder; that after the filing of said
plat and estimate in his office, the
city recorder shall publish in three
consecutive issues of a newspaper
published in this city, a notice stating
that such plat and estimates are on
file, the location and nature of the
improvement, kind or kinds of ma-
terial or materials to be used, and an
estimate of its cost, and the time be-
fore which objections thereto can be
filed, and the time fixed for hearing,
which time shall not be less than five
days after the last publication of such
notice, and after such publication
shall have been made, the city record-
er shall, at the next regular session
of the city council, notify the council
thereof in writing, with a printed
copy of such notice accompanying

tersection of Hill and West Third
streets taking a strip of Lot 1 McCoy's
Subdivision, owned by A. W. Kemler
Est., making said portion of said
street in accordance with the plans
of said widening prepared by the city
engineer and now on file in his office;
Therefore, Be it resolved by the
City Council of the City of Dubuque
that the city recorder be and he is
hereby instructed to issue a venire to
the chief of police, and to furnish him
with the names of the owners of
pronerty as furnished him by the city
engineer, and commanding him to
summon a jury of twelve freeholders,
citizens of said city and nor directly
interested to appear at a time and
place therein stated, which time shall
he ndt less than five days from the
date thereof, and that the chief of po-
lice shall give the persons named as
owners of property as aforesaid (pro-
vided they be residents of the city)
of the time and place, when and
where the jury so summoned shall
appear.
Be it further resolved that the
proceeding thereupon had at the
time and place thus affixed shall be
in the manner as provided by Chapter
XXXI of the Revised Ordinance of

Petition of C. T. Bush asking the

levied in 1899 and the east 1 -2 of lot
30 Mt. Pleasant Add. for the repair-

Petition of the Dubuque Boat and
Boiler Works asking the city council
to inspect and change the storm
sewer on the north side of the ice
harbor which drains Third street pre -

the south line of lot 1 Burden & Law -
ther's Addition, the mayor be and he
is hereby required to execute and de-
liver to the city recorder, to be by
him registered and countersigned,
seventy -one bonds for two hundred
and fifty dollars each, and one for
two hundred forty -four and 65 -100
dollars, numbered 4812 to 4883 in-
clusive, dated February 21st, 1917,
payable on or before seven years af-
ter the date thereof, and bearing in-
terest at the rate of five per cent per
annum, payable semi - annually.

Notice to Contractors -
Sealed proposals will be received at
the City Recorder's Office, City. Hall,
by the City Recorder until 8:00 p. m.,
Thursday, January 18, 1917, to be
acted on by the City Council on said
date, for improving North Street,
from the end of the present macadam
improvement to the east line of Louisa
Street, in accordance with the plans
and specifications prepared by the
City Engineer and now on file in the
office of the City Recorder.
It is estimated by the City Engineer
that said improvement will .require:
1,704 lineal feet of cement curb and
gutter
3,02 9 square yards of macadam.
5,500 cubic yards of cutting.
1,300 cubic yards of filling.
The work to be paid for when said
work is completed and as prescribed
by Chapter XXXII and amendments
thereto of the Revised Ordinances of
1901 of the City of Dubuque, Iowa,
work to be completed on or before the
1st day of July, 1917.
Bidders must state price per square
yard of macadam and price per lineal
foot of cement curb and gutter and
price for grading in total.
Each bid must be accompanied by a.
certified check for $400.00 on some
Dubuque Bank as a guarantee that a.
contract will be entered into if award-
ed. Check and bid in separate en..
velopes. •
The City Council reserves the right
to reject any and all bids.

NOTICE OF SPECIAL ASSESSMENT
Notice is hereby given to all con-
cerned that a special assessment as
provided by law will be levied at a
session of the City Council of the City
of Dubuque, Iowa, to be held Mon-
day, January 22nd, 1917, to pay for
improving Windsor Avenue, from the
end of the present Improvement to
the south line of Lot' 1, Burden and
Lawther's Addition; C. B. McNamara
& Co., Contractors.
Amount of Special Assessment $17,.
994.65, same to be assessed against
the property legally subject to assess-
ment upon and along said street.
And that there Is plat and schedule
on file in the office of the City Re-
corder of said City of Dubuque, show-
ing the street in which said improve-
ment was made and the separate lots
and parcels of ground or specified
portions thereof subject to assessment
for such improvement, the name of
the owner thereof as far as practic-
able and the amount to be assessed
against each lot or parcel of ground,

which plat and schedule are subject
to public inspection.
And that any and all persons ob-
jecting to said special assessment or
to said plat must file his or their ob-
jections in writing with the City Re-
corder of said City of Dubuque on or
before said session of the City Coun-
cil to be held Monday, January 22nd,
1917, or to appear at said session of
the Council to show cause, if any you
have, why said assessment should not
be levied.

Notice to Vault Cleaners.
Sealed proposals will be received at
the office of the City Recorder up to
2:00 o'clock p. m., February 1st, 1917,
for cleaning of vaults in the City of
Dubuque, Iowa, for the season of
1917.
Bidders will state the price per
cubic foot below the bluffs and the
price per cubic foot on the bluffs.
The City reserves the right to re-
ject any and all bids.

ERS OF PROPERTY.
YOU ARE HEREBY NOTIFIED
That all sidewalks must be cleaned
and cleared of snow and ice within
ten hours after such snow and ice
shall have fallen and formed thereon,
as provided by the Laws of Iowa, and
the Ordinances of the City of Du-
buque, any person, persons or corpor-
ation failing to remove such snow or
ice or permitting snow or ice to form
or accumulate upon said sidewalk,
whether they be tenant or property
owners, will be made a party defend-
ant to any action or suit which may
be brought against, said city by per-
sons sustaining injury by falling upon
