CITY COUNCIL PROCEEDINGS
REGULAR SESSION
The Dubuque City Council met in regular session at 6:30 p.m. on July 5, 2023, in the second -
floor Council Chambers of the Historic Federal Building, 350 W. 6th Street.
Present: Mayor Cavanagh; Council Members Farber, Jones, Roussell, Sprank, Wethal; City
Manager Van Milligen (attended virtually), City Attorney Brumwell.
Absent: Council Member Resnick.
Mayor Cavanagh read the call and stated this is a regular session of the City Council called
for the purpose of conducting such business that may properly come before the City Council.

Motion by Jones to receive and file the documents, adopt the resolutions, and dispose of as
indicated. Seconded by Farber. Motion carried 6-0.
1. Minutes and Reports Submitted: City Council Proceedings of 6/20/23; Civil Service
Commission of 6/14/23; Historic Preservation Commission of 6/15/23; Housing Appeals and
Mediation Board of 2/21/23; Long Range Planning Advisory Commission of 6/21/23. Upon
motion the documents were received and filed.
2. Notice of Claims and Suits: Robert Davis for property damage; Juan Lampe for property
damage; Matthew Lynch for property damage; Brian Sanger for property damage; LaVonne
Steffensmeier for vehicle damage. Upon motion the documents were received, filed, and
referred to the City Attorney.
3. Disposition of Claims: City Attorney advised that the following claims have been referred
to Public Entity Risk Services of Iowa, the agent for the Iowa Communities Assurance Pool:
Robert Davis for property damage; David Hawkins for vehicle damage; Matthew Lynch for
property damage; LaVonne Steffensmeier for vehicle damage. Upon motion the documents
were received, filed, and concurred.
4. Approval of City Expenditures: Upon motion the documents were received and filed, and
Resolution No. 206-23 Authorizing the Chief Financial Officer/City Treasurer to make certain
payments of bills that must be paid and approved for payment in accordance with City
procedures was adopted.
5. Iowa Initiative for Sustainable Communities (IISC) Resolution & Memorandum of
Understanding (MOU): City Manager recommended City Council adoption of a resolution
authorizing a formal partnership with the University of Iowa's Iowa Initiative for Sustainable
Communities program in the 2023-2024 academic year. Upon motion the documents were
received and filed, and Resolution No. 207-23 Authorizing a partnership with the Iowa Initiative
for Sustainable Communities, a program of the University of Iowa was adopted.

6. West 1st Street Sanitary Repair Project Reject Recommendation: Upon motion the
documents were received and filed, and Resolution No. 208-23 Rejecting all competitive bid
proposals for the W 1 st Street Sanitary Repair Project was adopted.
7. Royalwood Subdivision Water Main Loop - North Cascade Road Crossing Project:
Acceptance of Public Improvement Construction Contract: Upon motion the documents were
received and filed, and Resolution No. 209-23 Accepting the Royalwood Subdivision Water
Main Loop - North Cascade Road Crossing Project and authorizing the payment to the
contractor was adopted.
8. First Amendment to an Agreement with Kwik Trip, Inc. - Kwik Trip, Inc. Convenience
Store/Gas Station at Intersection of Kerper Boulevard and Kerper Court: Upon motion the
documents were received and filed, and Resolution No. 210-23 Approving the First Amendment
to an Agreement between the City of Dubuque, Iowa and Kwik Trip, Inc. for construction of
certain off -site public roadway improvements at the intersection of Kerper Boulevard and Kerper
Court related to the proposed site improvements at said intersection was adopted.
9. Adoption of the 2023 Edition of the City Supplemental Specifications for the 2023 edition
of Iowa Statewide Urban Design and Specifications (SUDAS) Program: Upon motion the
documents were received and filed, and Resolution No. 211-23 Approving adoption of the 2023
Edition of City Supplemental Specifications to the Iowa Statewide Urban Design and
Specifications (SUDAS) Program's Specification Manual for Public Works Improvements was
adopted.
10. CC15, LLC (Joel Callahan) Property Right of Way Plat and Dedication — Future
Improvements at the Intersection of Bies Drive, Sylvan Drive and Century Drive: Upon motion
the documents were received and filed, and Resolution No. 212-23 Approving the Acquisition
Plat of Lot 1A of Roger F. and Kathleen A. Klauer Family Place, in the City of Dubuque, Iowa
was adopted.
11. Improvement Contracts / Performance, Payment and Maintenance Bonds: Ostrom
Painting & Sandblasting, Inc. for the 2023 Pavement Marking Project; Temperly Excavating,
Inc. for the Foothill Ct. Drain Tile Project - 2023; Valentine Construction Co., LLC for the 2023
Asphalt Overlay Ramp Project Four. Upon motion the documents were received, filed, and
approved.
12. Grass and Weed Cutting and Garbage Collection Assessments: Upon motion the
documents were received and filed, and Resolution No. 213-23 Authorizing the city to collect
delinquent grass and weed cutting and garbage collection charges in accordance with Title 6-
4-3A and Title 6-8-2 of the Code of Ordinances of the City of Dubuque, Iowa was adopted.
13. 2095 University Avenue Settlement Agreement: Upon motion the documents were
received and filed, and Resolution No. 214-23 Approving a Settlement Agreement between the
City of Dubuque, Iowa and Metropolitan Life Insurance Company was adopted.
14. Establishing the Compensation for the City Clerk: Upon motion the documents were
received and filed, and Resolution No. 215-23 Establishing the compensation for the City Clerk
was adopted.
15. Retail Permit Approval for Tobacco, Tobacco Products, Alternative Nicotine Products,

and Vapor Products: Upon motion the documents were received and filed, and Resolution No.
216-23 Approving applications for retail permits to sell Tobacco, Tobacco Products, Alternative
Nicotine Products, and Vapor Products, as required by Iowa Code §453A.47A was adopted.
ITEMS SET FOR PUBLIC HEARING
Motion by Roussell to receive and file the documents, adopt the resolutions, and set the
public hearings as indicated. Seconded by Sprank. Motion carried 6-0.
1. Resolution Setting a Public Hearing on a Proposed Development Agreement by and
between the City of Dubuque, Iowa and 799 Main, LLC Providing for the Issuance of Urban
Renewal Tax Increment Revenue Grant Obligations Pursuant to the Development Agreement:
Upon motion the documents were received and filed and Resolution No. 217-23 Fixing the date
for a public hearing of the City Council of the City of Dubuque, Iowa on a Development
Agreement by and between the City of Dubuque, Iowa and 799 Main, LLC, including the
proposed issuance of Urban Renewal Tax Increment Revenue Obligations relating thereto and
providing for the publication of notice thereof was adopted setting a public hearing for a meeting
to commence at 6:30 p.m. on July 17, 2023 in the Historic Federal Building.
2. John F. Kennedy Road and West 32nd Street Intersection Improvement Project: Upon
motion the documents were received and filed and Resolution No. 218-23 John F. Kennedy
Road and W. 32nd Street Intersection Improvement Project: preliminary approval of plans,
specifications, form of contract, and estimated cost; setting date of public hearing on plans,
specifications, form of contract, and estimated cost was adopted setting a public hearing for a
meeting to commence at 6:30 p.m. on July 17, 2023 in the Historic Federal Building.
BOARDS/COMMISSIONS
Applications were reviewed for the following Boards and Commissions. Applicants were
invited to address the City Council regarding their desire to serve on the following
Boards/Commissions.
Transit Advisory Board: One, 3-Year Term through July 30, 2026 (Expiring Term of Orwoll).
Applicant: Greg Orwoll, 2635 West 32nd St. Mr. Orwoll spoke in support of his application and
provided a brief biography.
PUBLIC HEARINGS
1. Resolution of Adoption for the proposed Switch Homes Housing Urban Renewal Area:
Motion by Jones to receive and file the documents and adopt Resolution No. 219-23 Approving
the Urban Renewal Plan for the Switch Homes Housing Urban Renewal Area. Seconded by
Sprank. Responding to questions from the City Council, Economic Development Director Jill
Connors stated that the development agreement with Switch Homes previously approved by
the City Council provides for incentives created through the urban renewal area. Ms. Connors
further stated that the increment is collected as the development progresses, with 38.1 % of the
increment allocated to programming and capital projects that benefit low to moderate income
households in the city. The remaining funds are available to reimburse for eligible costs for the
development. Ms. Connors clarified a typo in her memo, stating that infrastructure
improvements are not limited to the examples listed in the memo. City Attorney Brumwell stated
that the amount of property taxes collected by the city and other taxing bodies remains

unchanged during the timeframe of the development. The city captures the increase in property
taxes generated during the timeframe of the development. At the end of the 10-year Tax
Increment Financing (TIF) period, all revenue is distributed to all the taxing bodies. City Manager
Van Milligen stated that the Dubuque Community School District supports urban renewal areas
because of their enrollment increases resulting from any students who will reside in the newly
created residential areas. All new residents will also support the local economy. Motion carried
6-0.
2. Voluntary Annexation Request - City of Dubuque Engineering Department (applicant) and
the Iowa Department of Transportation (property owner): Motion by Roussell to receive and file
the documents and adopt Resolution No. 220-23 Approving an application for voluntary
annexation of territory to the City of Dubuque, Iowa. Seconded by Wethal. Motion carried 6-0.
3. Weber Acres Rezoning Request: Motion by Jones to receive and file the documents and
that the requirement that a proposed ordinance be considered and voted on for passage at two
Council meetings prior to the meeting at which it is to be passed be suspended. Seconded by
Farber. Planning Services Manager Wally Wernimont provided a staff report. Motion carried 6-
0.
Motion by Jones for final consideration and passage of Ordinance No. 32-23 Amending Title
16 of the City of Dubuque Code of Ordinances, Unified Development Code, by reclassifying
hereinafter described parcel of land located along Westside Drive from County M-2 Heavy
Industrial to City CS Commercial Service and Wholesale concurrently with annexation into the
City of Dubuque. Seconded by Farber. Motion carried 6-0.
PUBLIC INPUT
Clark Schloz, 2925 Burlington St., provided input in favor of automated speed cameras.
ACTION ITEMS
1. Update on Water & Resource Recovery Center Odor Abatement Efforts: Motion by Farber
to receive and file the documents. Seconded by Jones. Responding to a question from the City
Council regarding the estimated timeframe to execute the process outlined in Water and
Resource Recovery Center (W&RRC) Manager William O'Brien's memo, City Manager Van
Milligen stated that Mr. O'Brien was unable to attend the City Council meeting and that a written
response will be provided to the City Council. City Council Members thanked city staff for their
efforts on odor abatement. Motion carried 6-0.
2. Tax Increment Ordinance for the Switch Homes Housing Urban Renewal Area: Motion by
Jones to receive and file the documents and that the requirement that a proposed ordinance be
considered and voted on for passage at two Council meetings prior to the meeting at which it is
to be passed be suspended. Seconded by Wethal. Motion carried 6-0.
Motion by Jones for final consideration and passage of Ordinance No. 33-23 Providing that
general property taxes levied and collected each year on all property located within the Switch
Homes Housing Urban Renewal Area, in the City of Dubuque, County of Dubuque, State of
Iowa, by and for the benefit of the State of Iowa, City of Dubuque, County of Dubuque, Dubuque
Community School District and other taxing districts, be paid to a special fund for payment of
principal and interest on loans, monies advanced to and indebtedness, including bonds issued
or to be issued, incurred by said city in connection with said Switch Homes Housing Urban
Renewal Area. Seconded by Wethal. Motion carried 6-0.

3. Fiscal Year 2024 Arts & Culture Operating Support Grant Funding Recommendation:
Motion by Roussell to receive and file the documents and approve with the Arts & Cultural Affairs
Advisory Commission recommendation to fund the FY2024 Operating Support grant
applications. Seconded by Farber. City Council Members expressed enthusiasm for the funding
to support various organizations and thanked the Arts & Cultural Affairs Advisory Commission
for their work in selecting the organizations to award funds. Motion carried 6-0.
4. Fiscal Year 2024 Arts & Culture Special Projects Grant Funding Recommendation: Motion
by Sprank to receive and file the documents and approve the Arts & Cultural Affairs Advisory
Commission recommendation to fund the FY2024 Special Projects grant applications.
Seconded by Jones. Motion carried 6-0.
5. Fiscal Year 2024 Purchase of Services Grant Recommendations & Agreements: Motion
by Jones to receive and file the documents and adopt Resolution No. 221-23 Authorizing
execution of FY24 Purchase of Services Grant Agreements. Seconded by Farber. Responding
to a question from the City Council, Housing and Community Development Director Alexis
Steger stated that this set of agreements encompasses all agreements that will be approved in
FY24. Motion carried 6-0.
6. Proceedings to Direct Advertisement for Sale of $6,250,000 Taxable General Obligation
Bonds, Series 2023A, Approval of the Preliminary Official Statement, and Approval of Electronic
Bidding Procedures: Motion by Wethal to receive and file the documents and adopt Resolution
No. 222-23 Setting the date for the sale of Taxable General Obligation Corporate Purpose
Bonds, Series 2023A and authorizing the use of a preliminary official statement in connection
therewith. Seconded by Farber. Motion carried 6-0.
7. Federal Transit Administration (FTA) 5339 Bus and Bus Facilities Low or No Emission
Grant Award: Motion by Jones to receive and file the documents. Seconded by Sprank.
Responding to questions from the City Council, Director of Transportation Services Ryan
Knuckey stated that he has conversed with many other cities regarding electric buses and that
the city's gradual approach to acquiring the buses is beneficial since the technology continues
to advance. Mr. Knuckey further stated that the city has adequate time to purchase the new
buses with the grant funds that the grant also includes training for city staff on operating,
maintaining, and working with the vehicles. City Council Members expressed enthusiasm
toward building the city's electric fleet. Motion carried 6-0.
8. Work Session Request: State Legislation/Property Tax Reform — Impact on City Revenue:
Motion by Roussell to receive and file the documents and schedule the work session for July
17, 2023, at 5:30 p.m. Seconded by Farber. Motion carried 6-0.
9. Work Session Request: State and Federal Grant Updates: Motion by Jones to receive and
file the documents and schedule the work session for August 21, 2023, at 5.00 p.m. Seconded
by Sprank. Motion carried 6-0.
10. Work Session Request: Travel Dubuque: Motion by Farber to receive and file the
documents and schedule the work session for August 21, 2023, at 6:00 p.m. Seconded by
Jones. Motion carried 6-0.
11. Marshallese Video on Air Quality: Motion by Roussell to receive and file the documents

and view the video. Seconded by Sprank. Chief of Equity and Human Rights Gisella Aitken-
Shadle introduced a video of the June 28, 2023 air quality warning delivered in Marshallese.

COUNCIL MEMBER REPORTS
Council Member Jones congratulated Assistant Fire Chief David Grass on his new position.
Council Members Sprank and Farber respectively reported on the Comiskey Park
celebration.
Mayor Cavanagh also reported on the Comiskey Park celebration and the 3rd of July fireworks
and air show.
CLOSED SESSION
Motion by Jones to convene in closed session at 7:31 p.m. to discuss Professional
Evaluation(s) — Chapter 21.5(1)(i) Code of Iowa. Seconded by Wethal. Motion carried 6-0.
The City Council reconvened in open session at 8:04 p.m. stating that staff had been given
proper direction.
ADJOURNMENT
There being no further business, Mayor Cavanagh declared the meeting adjourned at 8:04
p.m.
