The application, staff report and related materials are attached for your review. Discussion Tonya Trumm, O'Connor & Thomas Law Firm, 1000 Main Street, council for Dubuque Racing Association spoke on behalf of the project stating that the final plat would clean up some lease boundaries and allow for future development on the island. John Tranmer, Origin Design, 137 N Main Street was also present to respond to any questions. Staff detailed the staff report and noted the proposed plat would reconfigure the existing mineral lots into four new lots and is considered a Minor Subdivision per the Unified Development Code. Staff described each lot and what they would generally contain. Staff noted that Lot 2 would not have frontage on a private or public street and a waiver of that requirement was part of the final plat request. Staff further articulated that Lot 2 would be accessed by a 60' wide access easement across Lot 1. Commissioners discussed access and utility easement locations. Staff identified the access easement location on the proposed plat. Staff further explained that the property is currently owned by the City of Dubuque and would remain under City ownership. In the event any lots would be sold in the future, the City would identify utility easements as needed at that time. There were no public comments. The Zoning Advisory Commission discussed the request and found it appropriate. Pursuant to the UDC, a subdivision of property that creates three or more lots is classified as a Minor Subdivision� and requires review by the Zoning Advisory Commission and City Council. DISCUSSION As proposed, the Final Plat of Chaplain Schmitt Island would reconfigure multiple existing mineral lots thereby creating four new lots. The reconfiguration is being proposed to help define lease boundaries and lots for potential future development on the island. The following is a description of each proposed lot: ■ Lot 1 (27.78 acres)would encompass the existing Hilton Garden Inn, the Q Casino, Houlihan's restaurant, and the existing parking lot areas associated with these businesses. Lot 1 would maintain street frontage along Greyhound Park Road. ■ Lot 2 (5.03 acres)would encompass the area of the existing dog racing track which is no longer operational. Lot 2 would not have frontage along a private or public street but would maintain access from Greyhound Park Road by way of a 60' access easement across Lot 1. ■ Lot 3 (3.41 acres) would encompass the area previously used for dog kennels, which are no longer in use, and would have street frontage along Admiral Sheehy Drive. ■ Lot 4 (107.46 acres) would encompass the remaining portions of the northern half of the island which would include the Miller Riverview Park and Campground, hiking trails, and natural open spaces along the Lake Peosta Channel. Lot 4 will have frontage along Greyhound Park Road and Admiral Sheehy Drive. ' The Unified Development Code Chapter 11 defines a Minor Subdivision as `Any subdivision or consolidation of property in which no new streets,public or private, are proposed and which does not require the construction of any public improvements, and which creates three or more lots." Staff Memo — Final Plat of Chaplain Schmitt Island The Zoning Advisory Commission and City Council are the reviewing authorities for a Minor Subdivision. The Zoning Advisory Commission shall review the plat to determine whether it is in substantial conformance with the Unified Development Code. The City's Comprehensive Plan identifies the future land use for the Chaplain Schmitt Island as Commercial and Park & Open Space. The proposed minor subdivision is not anticipated to be in conflict with the City's Comprehensive Plan uses and goals. As requested, the proposed subdivision will have little effect on the status of the Chaplain Schmitt Island existing and proposed land uses. The proposed subdivision plat would comply with all aspects of the City of Dubuque's subdivision regulations contained in the Unified Development Code, with the exception of frontage along a private or public street for Lot 2. The subdivision plat would comply with the land use goals within the City's Comprehensive Plan. RECOMMENDATION Planning staff requests that the Zoning Advisory Commission review the Final Plat of Chaplain Schmitt Island and recommends approval as submitted subject to waiving the street frontage for Lot 2.
