Acceptance of Public Improvement Construction Contract

INTRODUCTION
The attached resolution provides for the acceptance of the public improvement
construction contract for the Highway 20 - N. Cascade Road Truck Stop Water Service
Connection Project.
BACKGROUND
In March 2017, the City purchased the Vernon Public Water Supply System in Dubuque
County from Central lowa Water Association (CIWA). Per the terms of the agreement,
CIWA transferred and assigned to the City, all of CIWA rights, titles, interests, uses,
privileges, liabilities, obligations, and duties arising under the Limited Easements for
constructing the Vernon Public water Supply System.
Per the Limited Easement, dated February 11, 2015, with Genesis Two Holdings, LLC
(Ron White, Highway 20 Truck Stop), the City agreed to honor the terms and conditions
of said easement and agreed to extend a new water service to the Highway 20 Truck
Stop building.
The City elected to hold off on extending the water service until the US Highway 20 Swiss
Valley interchange project was completed by the lowa Department of Transportation and
the new, relocated water main along both Cottingham Road and North Cascade Road
was also completed.
The Highway 20 - N. Cascade Road Truck Stop Water Service Connection Project
provided for the construction of a new 2-inch copper water line to serve the Truck Stop.
The new water service line was constructed through the asphalt paved parking lot to
inside the building. The project included asphalt pavement sawcut, removal and
replacement, rock excavation, and approximately 250 L.F. of 2-inch copper water line.
DISCUSSION
The Highway 20 - N. Cascade Road Truck Stop Water Service Connection Project was
completed by Midwest Concrete, Inc. of Peosta, IA in the final contract amount of
$45,488.31. This is a 24.4% increase from the original contract amount of $36,566.25.
The increase ($8,922.06) was due to additional costs incurred for additional depth of
asphalt pavement to match existing conditions to restore the truck stop parking lot
pavement and driving lanes. Staff was originally informed that the existing asphalt
pavement was 4-inches thick, however the actual asphalt pavement depth was 8-
inches.
RECOMMENDATION
I recommend that the City Council accept the improvements and authorize the payment
of the final contract amount of $45,488.31 to Midwest Concrete, Inc. for the Highway 20
- N. Cascade Road Truck Stop Water Service Connection Project.

RESOLUTION NO. 247-23
ACCEPTING THE HIGHWAY 20 - N. CASCADE ROAD TRUCK STOP WATER
SERVICE CONNECTION PROJECT AND AUTHORIZING THE PAYMENT TO THE
CONTRACTOR
Whereas, the public improvement contract for the Highway 20 - N. Cascade Road
Truck Stop Water Service Connection Project (the Project) has been completed by the
Contractor, Midwest Concrete, Inc., (Contractor), and the City Engineer has examined
the work and recommends that the Project be accepted; and
Whereas, the final contract amount for the Project is $45,488.31; and
Whereas, the Contractor has previously been paid $32,621 .39, leaving a balance
of $12,866.92; and
Whereas, the City Council finds that the recommendation of the City Engineer
should be accepted.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. The recommendation of the City Engineer is approved, and the Project
is hereby accepted.
Section 2. The Finance Director is hereby directed to pay to the Contractor the
balance of the retainage of$12,866.92 as provided in Iowa Code chapter 573, and to pay
such retainage in accordance with the provisions of Iowa Code chapter 573 or Iowa Code
chapter 26.13.

The undersigned City Engineer of the City of Dubuque, Iowa, hereby certifies that he has
inspected the Highway 20 - N. Cascade Road Truck Stop Water Service Connection
Project has been performed in compliance with the terms of the Public Improvement
Contract, and that the total cost of the completed work is $48,904.52.
