Van Milligen, City Manager FROM: Gus Psihoyos, City Engineer SUBJECT: Plat of Survey — Seippel Warehouse LLC Property at Seippel Road and Cottingham Road DATE: August 14, 2023 INTRODUCTION This memo provides information regarding the platting of property and acceptance of dedication of right of way and easements at the intersection of Seippel Road and Cottingham Road. BACKGROUND Recently, the developer Seippel Warehouse, LLC (developer) has constructed a warehouse facility at the intersection of Seippel Road and Cottingham Road for use by the Simmons Company for their expanding business in the Dubuque Industrial Center South. DISCUSSION The extent and scope of the developers site plan required them to acquire property on the east and west sides of the subject property. As part of an amended agreement with the developer (per Resolution 135-23), these additional properties on the east and west side needed to be consolidated into one overall lot (so as to not create non-conforming lots). The attached plat consolidates these three lots into one as required by the agreement. Because the development plans included a building location that conflicts with the existing access and trail easement on the property, the amended agreement with the developer (per Resolution 135-23) required them to plat and dedicate an easement for the relocation of the proposed trail. This new trail easement runs along the western and southern portion of the site. The plat also includes the creation of Lot A which sits directly over an area which is currently in the right of way easement of Cottingham Road. Generally speaking, road right of ways in the County are held by easements, while inside corporate limits the land under streets are owned in fee by the City. The City Attorney Office's policy is to acquire ownership of street right of way as opposed to simply being the beneficiary of a roadway easement. Origin Design has prepared a plat of survey to provide right of way for Cottingham Road that will be dedicated to the public for street and utility purposes. The plat also dedicates a 40' wide access and trail easement allows for the construction and maintenance of a future public recreational trail expansion in the Dubuque Industrial Center South Fourth Addition. RECOMMENDATION I recommend that the City Council approve the Plat of Survey of Lot 1 & Lot A of Dubuque Industrial Center South Fourth Addition in the City of Dubuque, lowa, which consolidates the three lots, dedicates street right of way, and dedicates an access and trail easement by the adoption of the attached resolution.
