Van Milligen, City Manager SUBJECT: Acceptance of Certain Subdivision Improvements in Rustic Point Estates #2 DATE: August 15, 2023 City Engineer Gus Psihoyos is recommending City Council adoption of the attached resolution accepting certain public improvements in Rustic Point Estates #2. As a condition of subdivision plat approval through Resolution No. 281-21, the developer of Rustic Point Estates #2 was required to install certain public improvements including street paving with curb, sanitary sewer main, water main, storm sewers and catch basins, street lighting, fiber optic conduit, accessible sidewalk ramps, sanitary sewer lift station, and storm water detention facilities and to dedicate said improvements to the City upon completion. On August 14, 2023, the owners requested City's acceptance of additional improvements in Rustic Point Estates #2. Upon inspection by the City, it has been determined that the accessible sidewalk ramps and sanitary sewer lift station public improvements required by Resolution 281-21 have been completed in accordance with plans approved by the City Council and in conformance with City specifications. The storm water detention facilities are not completed and not being accepted at this time. I concur with the recommendation and respectfully request Mayor and City Council approval. v Mic ael C. Van Milligen, City Manager FROM: Gus Psihoyos, City Engineer DATE: August 14, 2023 SUBJECT: Acceptance of Certain Subdivision Improvements in Rustic Point Estates #2 INTRODUCTION The enclosed material provides for City Council acceptance of certain public improvements that the developers, Derby Grange LLC, have recently completed in Rustic Point Estates #2. BACKGROUND As a condition of subdivision plat approval through Resolution No. 281-21, the developer of Rustic Point Estates #2 was required to install certain public improvements including street paving with curb, sanitary sewer main, water main, storm sewers and catch basins, street lighting, fiber optic conduit, accessible sidewalk ramps, sanitary sewer lift station, and storm water detention facilities and to dedicate said improvements to the City upon completion. DISCUSSION The Subdivision Ordinance requires that upon completion of all the required public improvements, the subdivider shall notify the City in writing of the completion of the improvements, requesting that the City either approve or reject the acceptance of the improvements, together with a statement of reasons for any rejection. Previously and per to Resolution 13-23, all public improvements except accessible sidewalk ramps, sanitary sewer lift station, and storm water detention facilities were accepted by the City of Dubuque. On August 14, 2023, the owners requested City's acceptance of additional improvements in Rustic Point Estates #2. RECOMMENDATION I would, therefore, recommend that the City Council accept the accessible sidewalk ramp and sanitary sewer lift station public improvements as described above. Maintenance guarantees for said public improvements shall be provided by the owners, Derby Grange LLC, for a period of two (2) years from the date of acceptance by City Council. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, 10WA: Section 1. That the recommendation of the City Manager be approved and that said accessible sidewalk ramps and sanitary sewer lift station public improvements in Rustic Point Estates #2, be and the same are hereby accepted. Section 2. That the storm water detention facilities are not completed and not being accepted at this time. Section 3. That a maintenance guarantee covering said accessible sidewalk ramps and sanitary sewer lift station public improvements shall be provided by the owners, Derby Grange LLC, for a period of two (2) years from the date of this resolution.
