The submitted annexation request is to allow the development of the Butler Children's Garden, known as The Wanderwood Gardens. The children's garden activity center proposes to be adjacent to and accessed through the Dubuque Arboretum. To facilitate that connection and to ensure provision of City of Dubuque services and utilities, the applicant is seeking annexation. By lowa Code, the annexation will be subject to final approval of the State of lowa's City Development Board because the property is considered to be in an urbanized area since it is within two miles of the City of Asbury and the City of Sageville. (applicant and property owner) DATE: August 11, 2023 INTRODUCTION This memorandum transmits a 100% voluntary annexation request for City Council approval after a public hearing. The request is being filed by the Butler Children's Garden Foundation, Inc. (applicant and property owner) for approximately 18.7 acres of property. The resolution, maps, and other supporting documentation are enclosed. DISCUSSION The City received a written application from the Butler Children's Garden Foundation, Inc. (applicant and property owner) for voluntary annexation of approximately 18.717 acres. The annexation territory is comprised of undeveloped forest land just north of the Dubuque Arboretum in Dubuque County. The submitted annexation request is to allow the development of the Butler Children's Garden, known as The Wanderwood Gardens. The children's garden activity center proposes to be adjacent to and accessed through the Dubuque Arboretum. To facilitate that connection and to ensure provision of City of Dubuque services and utilities, the applicant is seeking annexation. In 2022, the Zoning Advisory Commission and City Council approve the plat of Y-Camp Place No. 2. The platted lot, containing site of the future children's garden, did not have frontage on a public street. The applicant received city council approval for an access easement agreement providing access and parking in the City's Marshall Park. A pre- annexation agreement for the lot was also approved in this process. By lowa Code, the annexation will be subject to final approval of the State of lowa's City Development Board because the property is considered to be in an urbanized area since it is within two miles of the City of Asbury and the City of Sageville. RECOMMENDATION I recommend that the City Council approve the annexation request for the reasons described in the enclosed staff report, and summarized below: ■ It is 100% voluntary and in compliance with lowa Code, ■ It is consistent with the Imagine Dubuque Comprehensive Plan, ■ It is consistent with lowa Smart Planning Principles, ■ the City of Dubuque has the capacity to provide substantial municipal services to the annexation territory, ■ the future growth and development of the City of Dubuque, lowa makes it desirable that the annexation territory be made part of the City of Dubuque, lowa; and ■ the annexation is in the public interest. (applicant and property owner)forthe voluntary annexation of approximately 18.717 acres of property. The property is comprised of undeveloped forest land just north of the Dubuque Arboretum in Dubuque County as shown on Exhibit A and legally described as: All of Lot 2 of Y-Camp Place No. 3 In Dubuque County, Iowa, Containing 18.717 Acres; and Whereas, the annexation territory is not subject to an existing annexation moratorium agreement and does not include any railroad property; and Whereas, the annexation territory does not include State-owned property; and Whereas, Chapter 368 of the Code of Iowa authorizes this annexation by adoption of a resolution and required notification; and Whereas, the annexation territory is consistent with the City's Comprehensive Plan; and Whereas, the future growth and development of the City of Dubuque, Iowa makes it desirable that the annexation territory be made part of the City of Dubuque, Iowa; and Whereas, the City of Dubuque has the capacity to provide substantial municipal services to the annexation territory; and Whereas, the annexation is in the public interest. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. That the application for the voluntary annexation of property by the Butler Children's Garden Foundation, Inc. (applicant and property owner) consisting of 18.717 acres as shown on Exhibit A is hereby approved for annexation to the City of itDubuque. Section 2. That, subject to the approval of the City Development Board, the corporate limits of the City of Dubuque be and they hereby are extended to include the approximately 18.717 acres of annexation territory as shown on Exhibit A Annexation Map and Exhibit C Annexation Legal Description. Section 3. That the City Council does hereby certify that the City of Dubuque has complied with the notice and hearing requirements of the Iowa Code pertaining to 100% voluntary annexation of territory within the urbanized area of another city. Section 4. That if the City Development Board approves this annexation, the territory hereby annexed shall become a part of Ward Two of the City of Dubuque. Section 5. That the City Clerk shall file this resolution, all exhibits and the applications for voluntary annexation with the City Development Board of the State of Iowa in accordance with the provisions of Chapter 368 of the Iowa Code. Section 6: That the Real Estate owned by Butler Children's Garden Foundation, Inc. shall be entitled to the following partial exemption from taxation for City taxes for a period of then (10) years following the final order of the City Development Board after the exhaustion of any and all appeals from the action of the Board by any person or the expiration of the time within which such appeals may be brought, approving the voluntary annexation of the property: 1. Land Use recommendation: • Preserve key environmental features and provide recreational opportunities for all segments of the population through a variety of demanded active and passive options. Future Land Use Map — The property is identified as Public Open Space on the Future Land Use Map. The proposed use as a children's garden fits this category. Impact of Request on: Utilities: • City water is available in the Dubuque Arboretum and, with additional improvements, could be extended to serve development of the subject parcel. • City sanitary sewer is available in the Dubuque Arboretum and, with additional improvements, could be extended to serve development of the subject parcel. • Storm water pipes are not nearby to connect to, but the development would still need to follow the City's stormwater management requirements. Traffic Patterns/Counts: Arboretum Drive, the street leading into the Arboretum, does not have a recent traffic count from the lowa Department of Transportation. Public Services: City of Dubuque Fire and Police Departments will serve the subject site. Refuse collection will be provided by City of Dubuque Public Works. Environment: Staff anticipates that adverse impact to the environment from future development will be mitigated provided that the property complies with established City standards for storm water management and erosion control. The applicant intends for the property to be a place where children and their families can enjoy, appreciate, and learn about the environment in a natural setting. Adlacent Properties: The adjacent property to the north and east is owned by the YMCA for their Union Park Camp. The property to the south is owned by the City of Planned District Staff Report - Dubuque Industrial Center South Page 4 Dubuque as Marshall Park and operated by the Dubuque Arboretum. The property to the west is residential and owned by Daryl and Roben Bee. CIP Investments: None. Staff Analysis: The Butler Children's Garden Foundation, Inc. (property owner and applicant) is requesting annexation of the subject property. Once the property is annexed and rezoned, the property owner intends to develop The Wanderwood Gardens, a children's garden activity center that would be adjacent to the Dubuque Arboretum. To facilitate that connection and to ensure provision of City of Dubuque services and utilities, the applicant is seeking annexation. In 2022, the land for the children's garden was platted off the Dubuque YMCA property. The platted lot did not have frontage on a public street, so the applicant received an access easement agreement providing access and parking in the City's Marshall Park. A pre- annexation agreement for the lot was also approved in this process. When the children's garden is completed, it will be donated to the Dubuque Arboretum Association. The subject property is in Dubuque County just north of the Dubuque Arboretum. It is 18.717 acres. It is almost entirely wooded and includes some hilly topography. The property would be accessed through the Dubuque Arboretum. It is zoned County A-1 Agricultural and is proposed to be zoned City AG Agriculture. Adequate city utilities are available nearby and could be extended to the subject property. Prior to any development taking place on the property, the future applicant would be required to obtain an approved Site Plan. Site plans are reviewed by all relevant City departments regarding development standards such as access, parking, SUDAS (Statewide Urban Design and Specifications), screening, paving, stormwater management, water connections, sanitary sewer connection, and fire safety. Potential effects on the environment would be reviewed and mitigated through appropriate site design and development. The submitted annexation request is to allow the development of the Butler Children's Garden, known as The Wanderwood Gardens. The children's garden activity center proposes to be adjacent to and accessed through the Dubuque Arboretum. To facilitate that connection and to ensure provision of City of Dubuque services and utilities, the applicant is seeking annexation. By Iowa Code, the annexation will be subject to final approval of the State of Iowa's City Development Board because the property is considered to be in an urbanized area since it is within two miles of the City of Asbury and the City of Sageville.
